Definition of the problemStaff and patients in institutions of organized health care experience and express a variety of adverse conditions of these organizations. Within a theoretical framework of institutional pathology we can explain some of these “miserable conditions” as effects of the activities of organizations belonging to the political system (health policy) and to the economic system (health economy). Clinical ethics committees (CECs) cannot effectively handle such adversities or even address them properly. Standard organizational ethics can address them but cannot (...) handle them effectively.ArgumentsI propose to strengthen organizational ethics by a theory of institutional pathology. Basic nosological distinctions such as disease, illness and sickness, whose primary reference is to biological organisms and persons, can be analogically extended to socially constituted entities (e.g. hospitals) in terms of functional deficiency, miserable conditions, and need for reform of such entities. A very promising focus for analysis are organizational disorders of responsibility allocation. This group of institutional pathological disorders engenders, amongst other kinds of miserable conditions, specifically morally relevant miserable conditions.ConclusionThe institutional pathology paradigm, oriented to concrete institutions and organizations, can help “clinical” organizational ethics to considerably expand, in theoretical ethics as well as in ethically guided practice e.g. for members of CECs and organizational ethics advisors, the capacities for observing, evaluating and, if necessary, amending disturbed relations of responsibility. Personal und Patienten in Einrichtungen organisierter Krankenbehandlung erfahren und bekunden vielfältige miserable Zustände dieser Organisationen. Einige „Miseren“ lassen sich im Rahmen einer Theorie institutioneller Pathologien als störende Auswirkungen der Aktivitäten und Strukturen von Organisationen des Politiksystems und des Wirtschaftssystems erklären. Deshalb können Klinische Ethik-Komitees solchen Miseren nicht wirksam begegnen oder sie sogar nicht einmal thematisieren. Organisationsethik kann sie thematisieren, aber ihnen nicht wirksam begegnen. Vorgeschlagen wird die Verstärkung von Organisationethik durch eine Theorie institutioneller Pathologie. Institutionspathologisch aufgeklärte, „klinische“ Organisationsethik kann helfen, (...) in Ethiktheorie und Praxis, etwa für Mitglieder von KEKs und Organisationethikberater, die Möglichkeiten der Beobachtung, Bewertung und ggf. This article views the Hippocratic Oath from a new perspective and draws consequences for modern health care. The Oath consists of two parts, a family-like alliance where the teacher of the “art” is equal to a father and a set of maxims how the “art” is to be practiced. Self-commitments stated before the gods tie the parts together and give the alliance trustworthiness. One might call this a proto-profession. Modern physicians form a similar alliance. Specific knowledge and skills and specific (...) action guiding rules are elements of a profession but its trustworthiness rests on a combination of professional autonomy and public control. In order to be granted autonomy the profession must show some effort in enforcing its specific rules and in order to do so its members need to be convinced of the intrinsic value of their profession. Whereas in antiquity physicians acted as single individuals the modern alliance is shaped by division of labour. Physicians use each other and other professions by mutual consent and the health care system as means in the diagnostic-therapeutic process. As any actor is reponsible for the means he uses physicians are co-responsible accordingly. Thus, professional conduct now entails care for the organisation of the alliance as detailed in the “Charter on Medical Professionalism”. The effort the profession gives to this task will confirm its trustworthiness. (shrink)

Definition of the problem Commercialisation of hospitals undermines medical professionalism and modifies patient care. What should be enforced by or expected from or required of the institutional actors in the health care system to do in order to preserve these values? Arguments The said three types of commitment in colloquial language are corroborated by referring to Kant’s moral philosophy and applied to the main actors. Seit der Einführung der G‑DRGs als Instrument zur Vergütung von Krankenhausleistungen steht das Gesundheitswesen als System unter Kritik. Denn die Ausrichtung der Krankenhäuser auf wirtschaftlichen Erfolg relativiert den Anspruch aller Bürgerinnen und Bürger auf gute medizinische Versorgung. Der Artikel geht der Frage nach, von welchem Akteur im System welche Aktivität erzwungen, erwartet, oder verlangt werden kann, dem entgegenzuwirken. Die genannten alltagsmoralischen Urteile werden unter Rückgriff auf Kants Moralphilosophie validiert und auf die wichtigsten Akteure angewandt. Ergebnis: Der Kern des Ökonomisierungs‑/Kommerzialisierungs-Problems besteht (...) in der Entwertung der Professionalität der patientennahen Berufe. Die Neujustierung des Systems kann vom Gesetzgeber nur dann verlangt werden, wenn die verfasste Ärzteschaft sich dazu bekennt, mit den ihr zu Gebote stehenden Mitteln gegen professionswidrige Handlungsanreize vorzugehen.
