Using the bench trial of Colorado’s Amendment 2 as an example, this article focuses on the more general question of expert testimony in moral philosophy. It argues that there is indeed expertise in moral philosophy but argues against admitting such expert testimony in cases dealing with what John Rawls terms “constitutional essentials” and ‘matters of basic justice.” Developing the idea of public reason inherent in the Rawlsian concept of political liberalism, the article argues that philosophers can and should speak out (...) on public issues, if they do so with due respect for certain restrictions, but that they should not serve as expert witnesses on core constitutional questions, since doing so suggests that they claim a type of authority that would require fellow citizens to defer to their views. Such claims to authority in basic ethical matters threaten the mutual respect for divergent comprehensive doctrines that lies at the core of political liberalism. Philosophers have a duty to serve the public good, and they perform this service in fruitful ways. But they should refuse a public role that appears incompatible with equal respect for the committed ethical searching of their fellow citizens. (shrink)

This article argues that political liberalism, of the type formulated by John Rawls and Charles Larmore and further developed in Amartya Sen and Martha Nussbaum's capabilities approach, is superior to more comprehensive political views both in domestic and in global affairs. Perfectionist liberalism as advocated by John Stuart Mill and Joseph Raz attempts to erase existing religions and replace them with the religion of utility or autonomy. This is wrong, because in the ethico-religious environment of reasonable disagreement that we (...) inhabit all comprehensive forms of political morality pose a threat to people's liberty and equality. Only thin and narrow conceptions of value like the ones suggested by Rawls, Larmore, Sen, and Nussbaum can guarantee the respect for diversity that is needed in a pluralistic world. Although Rawls famously failed to extend this idea from domestic to transnational matters, the argument of the article is that not only do the principles of political liberalism apply to global mat.. Nietzsche claimed to be a political thinker in Ecce Homo and elsewhere. He constantly compared his thought with other political theorists, chiefly Rousseau, Kant and Mill, and he claimed to offer an alternative to the bankruptcy of Enlightenment liberalism. It is worthwhile re-examining Nietzsche's claim to offer serious criticisms of liberal political philosophy. I shall proceed by setting out seven criteria for serious political thought: understanding of material need; procedural justification; liberty and its worth; racial, ethnic and religious difference; gender (...) and family; justice between nations; and moral psychology. I shall argue polemically that on the first six issues Nietzsche has nothing to offer, but that on the seventh, moral psychology, he makes a profound contribution. Serious political theory, however, needs to forget about Nietzsche and turn to those thinkers he found so boring - the liberal Enlightenment thinkers. (shrink)

All modern liberal democracies have strong reasons to support an idea of toleration, understood as involving respect, not only grudging acceptance, and to extend it to all religious and secular doctrines, limiting only conduct that violates the rights of other citizens. There is no modern democracy, however, in which toleration of this sort is a stable achievement. Why is toleration, attractive in principle, so difficult to achieve? The normative case for toleration was well articulated by John Locke in his influential (...) A Letter Concerning Toleration , although his attractive proposal thus rests on a fragile foundation. Kant did much more, combining a Lockean account of the state with a profound diagnosis of ‘radical evil’, the tendencies in all human beings to militate against stable toleration and respect. But Kant proposed no mechanism through which the state might mitigate the harmful influence of ‘radical evil’, thus rendering toleration stable. One solution to this problem was proposed by Rousseau, but it has deep problems. How, then, can a respectful pluralistic society shore up the fragile human basis of toleration, especially in a world in which we need to cultivate toleration not only within each state, but also among peoples and states, in this interlocking world? The classical utilitarian legacy of Jeremy Bentham, J. S. Mill, James Mill, and Henry Sidgwick has often been charged with both theoretical and practical complicity in the growth of British imperialism and the emerging racialist discourse of the nineteenth century. But there has been little scholarly work devoted to bringing together the conflicting interpretive perspectives on this legacy and its complex evolution with respect to orientalism and imperialism. This volume, with contributions by leading scholars in the field, represents the first (...) attempt to survey the full range of current scholarly controversy on how the classical utilitarians conceived of 'race' and the part it played in their ethical and political programs, particularly with respect to such issues as slavery and the governance of India. The book both advances our understanding of the history of utilitarianism and imperialism and promotes the scholarly debate, clarifying the major points at issue between those sympathetic to the utilitarian legacy and those critical of it. This paper aims to check some Nussbaum’s reviews, in Hiding from Humanity, about Mill’s conception of liberty. The analysis frame is given by constant tension between the utilitarian justification and the justification based on per se value of liberty. This article wants to support the following hypothesis: Millean liberty cannot be criticized for reducing its value to instrumental terms. On the contrary, in order to be loyal with Mill, liberty has a double justification: one based on its utilitarianism and another (...) based on its intrinsic value. We use Bernard Williams’s suggestion about the intrinsic value of human goods for supporting the latter. He proposed an important criterion to demonstrate the intrinsic value: coherent relation with other values and other human necessities. Finally, the article briefly exposes the problem of coherence in Millean utilitarianism. (shrink)

Well-versed in recent debates over nationalism, colonialism, orientalism, and racism, he aims to address rather than avoid questions about Mill's supposed imperialistic (...) and racist leanings.Although slim and rather costly, Mill on Nationality marks an important statement of Varouxakis's extensive research on Mill. It "offers a study of Mill's attitudes and pronouncements on nationality, patriotism, national character, national self-determination, and related issues, based on a great range of writings, from his major works through his innumerable journalistic articles to his voluminous correspondence. Writings that prove particularly useful and illuminating are those related to France and his constant Franco-British or Franco-English comparisons, as well as his writings on Ireland and the Irish question, the Celtic peoples more generally, India, and, last but far from least, his pronouncements on Englishness, the "English national character," and his recipes and subtle strategies aimed at its education and "improvement" (5).The book delivers. If the prose at times suggests a lightly reworked dissertation, Varouxakis does nonetheless cheerfully maul scores of commentators on Mill whose works betray a less-than-intimate familiarity with the Mill corpus—e.g., everyone from Will Kymlicka to Bhiku Parekh. Varouxakis's criticisms reflect his methodology; he aims to trounce "misinterpretation due to lack of adequate contextualization and to insufficient conversance with Mill's overall thought" (8). But as with so many champions of this approach, he plainly adores the subject of his hermeneutical efforts, who emerges as a very bright light amid the dimness of later commentary on him. Referring to a passage from Mill's Inaugural Address to the University of St. Andrews, he writes that this "is impressive indeed: the thinker who is associated (wrongly) with so-called elitism, asserts that as complex an area of policy as foreign and international policy should be under the close scrutiny of the citizens and that it is a gross dereliction of duty if citizens fail to scrutinize their country's foreign policy and international comportment using as an excuse that international law is too complicated to understand. This is a very demanding conception of citizenship and a very lofty and high-minded perception of what constitutes a good citizen and a good patriot" (125-6). That it remains a relevant one is clear—indeed, "Mill's conception of the relationship between obligations to country and obligations to mankind was close to that of [Martha] Nussbaum" (118). For both, patriotism is commendable only when it conduces "to the interests of the whole of humanity" (116).As for racism, one of the most explosive issues in Mill studies, Varouxakis helpfully urges that discussions "about national and... cultural characteristics were, in Victorian Britain, inextricably associated with discussions about 'race,' and the term, 'race,' was often substituted for nation, nationhood, or national character" (39). Mill often used the term "race" in a loose way, discussing national characteristics "without reference as to whether they were biologically inherited or simply cultural traits occurring in these groups" (41). Moreover, "while accepting vaguely that racial origin is one of the factors influencing the formation of national character, Mill went further to establish that racial predisposition in itself could prove nothing and was liable to be modified out of any recognition through the agency of circumstances such as institutions, historical accidents and human effort" (43). In fact, for all his criticisms of the historical naiveté of the Enlightenment, Mill, in such mature works as The Subjection of Women, offered "not only a theoretical rejection of biological determinism, but also... an unequivocal belief in the malleability of human nature and therefore in the improvability of the character of various nations" (47).To be sure, disturbing questions remain. The UK government has recently committed to adopting a new policy—dubbed ‘Martha’s Rule’—which has been characterised as providing patients the right to rapidly access a second clinical opinion in urgent or contested cases. Support for the rule emerged following the death of Martha Mills in 2021, after doctors failed to admit her to intensive care despite concerns raised by her parents. We argue that framing this issue in terms of patient rights is not productive, and should be (...) avoided. Insofar as the ultimate goal of Martha’s Rule is the provision of a clinical service that protects patient safety, an approach that focuses on the obligations of the health system—rather than the individual rights of patients—will better serve this goal. We outline an alternative approach that situates rapid clinical review as part of a suite of services aimed at enhancing and protecting patient care. This approach would make greater progress towards addressing the difficult systemic issues that Martha’s Rule does not, while also better engaging with the constraints of clinical practice. (shrink)

Martha Saxton tackles these and other fascinating issues in Being Good , her history of the moral values prescribed for women in early America. Using data collected from 280 full-time employees from a variety of organizations, this study examined the effects of employee perceptions of the behavioral integrity (BI) of their supervisors on job tension. The moderating effect of procedural justice (PJ) on this relationship also was examined. Substitutes for leadership theory (Kerr and Jermier, 1978) and psychological contract theory (Rousseau, Empl Responsib Rights J 2:121–139, 1989) were used as the theoretical foundations for the hypothesized relationships. Results indicated a negative relationship between BI and (...) job tension. PJ moderated this relationship such that it was weakened under conditions of high PJ. Visual Agnosia is a comprehensive and up-to-date review of disorders of higher vision that relates these disorders to current conceptions of higher vision from cognitive science, illuminating both the neuropsychological disorders and the nature of normal visual object recognition.Brain damage can lead to selective problems with visual perception, including visual agnosia the inability to recognize objects even though elementary visual functions remain unimpaired. Such disorders are relatively rare, yet they provide a window onto how the normal brain might accomplish the (...) complex task of vision. The doctor patient relationship starts with a story. Doctors' notes, a patient's chart, the recommendations of ethics committees and insurance justifications all hinge on written and verbal narrative interaction. The "practice" of narrative profoundly affects decision making, patient health and treatment and the everyday practice of medicine. In this edited collection, the contributors provide conceptual foundations, practical guidelines and theoretical considerations central to the practice of narrative ethics.

The biology of early life adversity explores how social experiences early in life affect physical and psychological health and well-being throughout the life course. In our previous work, we argued that narratives emerging from and about this research field tend to focus on harm and lasting damage with little discussion of reversibility and resilience. However, as the Science and Technology Studies literature has demonstrated, scientific research can be actively taken up and transformed as it moves through social worlds. Drawing on (...) fieldwork with actors in education and juvenile corrections in the US Pacific Northwest, we found that they employed the biology of early life adversity not only to promote prevention but also to argue for changes within their own institutions that would allow them to better serve children and youth who have experienced adversity and trauma. Our study shows that biosocial narratives are neither inherently liberatory nor inherently oppressive but that the situated narrative choreographies in which they are enrolled are essential for their political effects. In our case, we show how these biosocial narratives have been articulated with knowledge and practices from restorative justice and trauma-informed care to reimagine the social meaning of the biology of early life adversity. This paper argues that Locke has a representative theory of sensitive knowledge. Perceivers are immediately aware of nothing but sensory ideas in the mind; yet perceivers think of real external substances that correspond to and cause those ideas, and they are warranted in believing that those substances exist (at that time). The theory poses two questions: what warrants the truth of such beliefs? What is it in virtue of which sensory ideas represent external objects and how do they make perceivers (...) think of those objects? Both the epistemic and semantic issues need to be addressed. This paper urges that Locke's basic account of warrant is roughly reliabilist. The causal origin of sensory ideas assures that, in general, sense based beliefs are true. Locke defines the limit of this warrant by the theoretical point that we cannot discuss skeptical doubt without assuming the truthfulness of our perceptual faculty. Turning to the semantic question, the paper argues that ideas are mental modifications or entities. They are not intrinsically representative (satisfiable), but rather represent only by virtue of their causal origin. They merely “track” the presence of substances and their qualities. Ideas nevertheless prompt perceivers to think of their causes. This is roughly because sensory ideas have a specific mental role, namely, to serve as marks for distinguishing substances and their respective qualities for purposes of action. The paper suggests that, for Locke, the challenge posed by the semantic veil of ideas is to explain this externally directed marking function within bounds of his anti‐innatism. But it concludes that his answers to the twin questions fit together reasonably well. (shrink)
