En este trabajo confrontamos la posición de Bulygin acerca de las normas con la del escéptico semántico y la del incorporacionista. entendemos a ambas figuras como expresiones -matizadas- de dos enfoques generales respecto del comportamiento en base a reglas: a) el que no ve en este más que "decisiones arbitrarias", meras reacciones o hábitos de conducta, y b) el que asimila la explicación de lo normativo con el ajuste a reglas o principios. Ahora bien, la noción general de Bulygin que (...) concibe a las normas como proposiciones o entidades conceptuales, parece -paradójicamente- rozar el escepticismo cuando se enfrenta a la imposibilidad de listar en forma completa las excepciones implícitas en la formulación de una regla. Proponemos una concepción alternativa basada en la noción de que el significado se muestra en el "uso", entendido este como el dominio de una técnica que constituye una "práctica social", en la cual reside un tipo de corrección práctica que no depende de justificaciones explícitas, sino de un trasfondo no expreso que hace irreductible a una teoría la aplicación de normas jurídicas. We contrast Bulygin's position on rules against that of the semantic skeptic and the inclusionist. We understand these two positions as in some sense expressing two general approaches on behavior according to rules: a) the first one stating that ruled behavior is no more than "arbitrary decisions," mere reactions or behavioral habits, and b) the second one explaining everything normative as actions adjusted to rules or principles. Bulygin's general notion according to which rules are propositions or conceptual entities paradoxically seems to be close to a skeptic position when facing the impossibility of completely listing implicit exceptions when formulating a rule. We propose an alternative conception based on the notion that meaning is shown in use, understanding by "use" the mastering of a technique that constitutes a social practice, in which resides a sort of correction practice. This correction does not depend on explicit justifications but on an unexpressed background which makes impossible a theory of legal application of rules. (shrink)

En este segundo documento nos ocupamos del aborto realizado por motivos terapéuticos o, dicho más brevemente, del aborto terapéutico. En la Argentina, el aborto plantea serios desafíos para la salud pública, ya que, pese a estar prohibido, se practica de forma clandestina y, muchas veces, insegura, poniendo en riesgo la vida y la salud de las mujeres. Por esta razón, creemos que la sociedad y el Estado deben debatir este problema y encontrar soluciones que resguarden los derechos de las mujeres. (...) El artículo 86, inciso 1, del Código Penal argentino expresamente despenaliza el aborto cuando corre peligro la vida o la salud de la mujer. En estos casos, se habla de aborto terapéutico. Esta disposición legal no suele aplicarse ni por los médicos ni por los profesionales que trabajan en la justicia, ya sea por desconocimiento o por razones ideológicas. Más aún, en muchos casos, las interpretaciones del Código Penal se apartan de su letra y restringen arbitrariamente su aplicación. Por estas razones, nos parece importante analizar este problema y proveer información sobre los aspectos legales y éticos involucrados en el aborto terapéutico en la Argentina. Este documento comienza con el relato de un caso hipotético, elaborado a partir de experiencias reales, con el objetivo de acercar al público a una situación concreta. Intercaladas en el cuerpo del relato, se desarrollan algunas reflexiones acerca de las implicaciones médicas, éticas y legales del caso. A continuación, se presenta un apartado referido al marco legal en el que se deben encuadrar los casos de aborto no punible. El documento sigue con una serie de breves recomendaciones destinadas tanto a los profesionales que trabajan en el sistema judicial como a los profesionales de la salud. Por último, se incluye un apéndice que contiene los principios que rigen la interpretación en materia penal y el glosario médico y legal, donde se pueden buscar las palabras resaltadas a lo largo del documento. Dies ist nicht im Sinne einer Rangfolge gemeint, sondern zeichnet die Hellsichtigkeit eines Dichters aus, der sich ins Freie vorwagt. Was er dort schaut und empfangt, kommt auch dem Denker zu, der dafur andere, weniger poetische Worte finden muss. Der Dichter spricht die Sache des Denkers an, (...) der Denker versucht der Sprache des Dichters auf den Grund zu gehen. Beide muhen sich im Sinne eines Auftrags, der vor unvordenklichen Zeiten ergangen sein muss und der uber den irdischen Geschaftsbetrieb hinausweist. Holderlin hat diesen Auftrag als Dichter wahrgenommen; Heidegger ist ihm als Denker nachgekommen, der die Vielfalt des Seienden zurucklasst, um zum Sein aufzubrechen. (shrink)

Background In this study, we examined the ethical implications of Egypt’s new clinical trial law, employing the ethical framework proposed by Emanuel et al. and comparing it to various national and supranational laws. This analysis is crucial as Egypt, considered a high-growth pharmaceutical market, has become an attractive location for clinical trials, offering insights into the ethical implementation of bioethical regulations in a large population country with a robust healthcare infrastructure and predominantly treatment-naïve patients. Methods We conducted a comparative analysis (...) of Egyptian law with regulations from Sweden and France, including the EU Clinical Trials Regulation, considering ethical human subject research criteria, and used a directed approach to qualitative content analysis to examine the laws and regulations. This study involved extensive peer scrutiny, frequent debriefing sessions, and collaboration with legal experts with relevant international legal expertise to ensure rigorous analysis and interpretation of the laws. Results On the rating of the seven different principles (social and scientific values, scientific validity, fair selection of participants, risk-benefit ratio, independent review, informed consent and respect for participants) Egypt, France, and EU regulations had comparable scores. Specific principles (Social Value, Scientific Value, and Fair selection of participants) were challenging to directly identify due to certain regulations embodying 'implicit' principles more than explicitly stated ones. Conclusion The analysis underscores Egypt's alignment with internationally recognized ethical principles, as outlined by Emanuel et al., through its comparison with French, Swedish, and EU regulations, emphasizing the critical need for Egypt to continuously refine its ethical regulations to safeguard participant protection and research integrity. Key issues identified include the necessity to clarify and standardize the concept of social value in research, alongside concerns regarding the expertise and impartiality of ethical review boards, pointing towards a broader agenda for enhancing research ethics in Egypt and beyond. Wie wollen wir leben und wie können wir unserem Leben Sinn geben angesichts der drängenden Krisen der Gegenwart? Wie können solche Fragen überhaupt beantwortet werden, wenn eine säkulare Kultur scheinbar nur Antworten auf Fragen nach dem „wie?“, nicht aber nach dem „wozu?“ erlaubt. Martin Kolmar deutet im vorliegenden Buch die gegenwärtigen und bevorstehenden Krisen, allen voran die Klimakrise, als Krise der westlichen Denk- und Wahrnehmungsweisen und versucht einen Ausweg daraus aufzuzeigen. Based on the findings that the ’weirdness’ of quantum theory can be understood to derive from a vanishing distinguishability of indiscernible particles, and the observation that a similar vanishing distinguishability is found for bundle theories in philosophical ontology, the claim is made that (...) quantum theory can be interpreted in an intelligible way by positing a bundle-theoretic view of objective idealism instead of materialism as the underlying fundamental nature of reality. This book examines the work of the Czech Philosopher Jan Patočka from the largely neglected perspective of religion. Patočka is known primarily for his work in phenomenology and ancient Greek philosophy, and also as a civil rights activist and a critic of modernity. He also maintained a persistent and increasing interest in Christianity, Martin Koci shows, and indeed his first and last publications concerned religion and theology. This book examines the theological motifs in Patočka's work, and brings his thought into (...) discussion with recent developments in phenomenology, making a case for Patočka as a forerunner to what has become known as the theological turn in continental philosophy. Koci systematically examines his thoughts on the relationship between theology and philosophy, and his perennial struggle with the idea of crisis. For Patočka, modernity, metaphysics, and Christianity were all in different kinds of crises, and Koci demonstrates how his work responded to those crises theologically. Thinking Faith after Christianity thus provides new insights on theology understood as the task of thinking and living transcendence in a problematic world. It perceives the un-thought element of Christianity - what Patočka identified as its greatest resource and potential - not as a weakness, but as a credible way to ponder Christian faith and the Christian mode of existence after the proclaimed death of God and the end of metaphysics. En esta investigación, titulada "Concursos para parroquias en la Archidiócesis de Sevilla (1611-1791)", se analiza el método de los concursos para la provisión de parroquias. Se define este sistema de concursos, se hace una discusión histórica y, finalmente, se estudia la forma concreta en que se llevaron a cabo en la sede de Sevilla. Unas breves conclusiones ponen fin a este trabajo. Los documentos utilizados forman parte de los archivos diocesanos, titulados como Sección II: Gobierno-Curas.

This chapter gives substance to the idea of a ‘communitarian value-driven epistemology’ by developing and combining ideas from Edward Craig's and Bernard Williams' ‘epistemic genealogy’ and Barry Barnes' and Steven Shapin's ‘sociology of knowledge’. In order to make transparent how this project might slot into more familiar, or more mainstream, projects, the paper maintains throughout a critical dialogue with Jon Kvanvig's position. The chapter is structured around an attempt to defend Craig's position against Kvanvig's criticisms: by treating the institution of (...) testimony as a collective good underwritten by the intrinsic and interrelated values of accuracy and sincerity; by rendering protoknowledge attributions as ascriptions of honour; and by allowing attributions of protoknowledge to be intertwined with attributions of freedom. The view that emerges is that the core of our knowledge practices comprises institutions of testimony, and that these practices are a collective good. (shrink)

Recent advances in DNA sequencing have revolutionized the field of genomics, making it possible for even single research groups to generate large amounts of sequence data very rapidly and at a substantially lower cost. These high‐throughput sequencing technologies make deep transcriptome sequencing and transcript quantification, whole genome sequencing and resequencing available to many more researchers and projects. However, while the cost and time have been greatly reduced, the error profiles and limitations of the new platforms differ significantly from those of (...) previous sequencing technologies. The selection of an appropriate sequencing platform for particular types of experiments is an important consideration, and requires a detailed understanding of the technologies available; including sources of error, error rate, as well as the speed and cost of sequencing. We review the relevant concepts and compare the issues raised by the current high‐throughput DNA sequencing technologies. We analyze how future developments may overcome these limitations and what challenges remain. (shrink)

Listening to someone from some distance in a crowded room you may experience the following phenomenon: when looking at them speak, you may both hear and see where the source of the sounds is; but when your eyes are turned elsewhere, you may no longer be able to detect exactly where the voice must be coming from. With your eyes again fixed on the speaker, and the movement of her lips a clear sense of the source of the sound will (...) return. This ‘ventriloquist’ effect reflects the ways in which visual cognition can dominate auditory perception. This response to Jason A. Springs’s Healthy Conflict in Contemporary Society praises Springs for his recommendations for improving the discourse found in ethical conflicts in public life. Springs’s main prescription is for culture to stop repressing conflict. But if Springs ought to be praised for desiring to give conflict its due in public life, Healthy Conflict in Contemporary Life ought also to be criticized for not always being clear on whether there are criteria that authorize excluding some people (e.g. white (...) supremacists) from participating in nonviolent cultural conflict. This essay on Cathleen Kaveny's Prophecy Without Contempt challenges her argument from two opposing sides. First, it critiques all jeremiads. It asks how a person uttering prophetic indictments, whether in the form of a classical jeremiad or the more moderate form that Kaveny argues for, can possibly know of what she speaks, given the otherness of God. Second, it calls for more jeremiads. It asks whether a person, whether religious or not, might indeed know enough to offer withering jeremiads, in (...) those cases where she sees the target of her jeremiad making flagrantly incompatible commitments. This paper consists of brief critical comments on Chapter 8, “Personifying Group Agents”, of Christian List’s and Philip Pettit’s book Group Agency (2011). A first set of objections concerns the chapter’s history of ideas. List and Pettit present the history of the idea of corporate personhood as divided between “intrinsicist” and “performative” conceptions. I argue that this distinction does not fit with the historical record and that it makes important political and legal divides and battles invisible. A second set of (...) criticisms builds on perspectives provided by the sociology of knowledge and by John Dewey. My guiding thought here is that “person”, at least when the term is applied to groups, is what political scientists call an “essentially contested concept”. My third set of comments targets the rudimentary political philosophy of List’s and Pettit’s book. I suggest that List’s and Pettit’s corporate personhood theory turns out to be normatively irrelevant; that their concept of “respect” is marred by an ambiguity; and that it remains unclear how their work constitutes progress in guarding against corporate power. This paper suggests a new way of analysing testimony. The starting point of the analysis is ‘epistemological communitarianism’. This is the view that communities, rather than individuals, are the primary bearers of knowledge. The new perspective is developed through a discussion of four issues: the scope of testimony; the role of inferences in the reception and evaluation of testimony; the possibility of a global justification of testimony; and the question of whether testimony is a generative source of knowledge or a (...) mere means of transmission of already existing knowledge. We are now, I think, in the midst of a sea change in Levinas interpretation. Increasingly in the course of the last third of the twentieth century, Levinas’s phenomenological ethics was seen as a resource for intellectuals to protest a certain kind of, shall we say, methodological naturalism in philosophy. Not only scientific positivism but also existential phenomenology with its apparent emphasis on immanence were feared to be terminally infected with neopagan or proto-fascist elements. If the result of these movements (...) was an embrace of (or a failure to adequately critique) modern secularized civilization and its bureaucratized projects — problematic because such a dimension of modernity was a necessary but not sufficient condition of the Holocaust, as ZygmuntBauman has argued — then the putative solution was to bend the stick toward the opposite pole. Scholars could invoke either the broadly monotheistic overtones of Levinas’s discourse of the Infinite or the specifically Judaic texts of the Bible and Talmud that Levinas saw himself as translating into philosophy, in the hope that these acts of citation would persuade scholars’ audiences that a return to monotheism or the Judaeo-Christian tradition could get the West past its embarrassingcentury-long flirtation with human-made mass death. This reading of Levinas would be coherent with a broader trend in American thought from the 1950s onward that would include Abraham Joshua Heschel, Reinhold Niebuhr, and Martin Luther King Jr., wherein secularism (especially as evidenced by communism) is the problem, religion is the solution. The increasing popularity of blogs and blogging, as well as their integration into the mainstream media mix, has sparked an ongoing discussion of whether a code of blog ethics is necessary or even feasible. In this article, I draw upon new communication technology ethics scholarship and an exploratory survey of bloggers to propose such a code. This code, unlike previous proposals, recognizes interactivity and the importance of prioritizing the human element in computer-mediated communication as the core values in blogging ethics.

Social attitudes toward usury (here defined using the archaic meaning as the taking of interest on loans) have changed dramatically over the centuries. From antiquity until the Protestant Reformation, usury was regarded as an inherently evil activity. Today, with few exceptions, usury is met with moral indifference. Modern objections to usury are limited to protest against "excessive" interest rates rather than interest per se. With this change in focus, the very meaning of the term "usury" has also changed. Many early (...) pronouncements against the taking of interest emphasized the plight of the poor, but ironically, the poor actually pay the highest rates of interest in the modern American economy. Despite the universality of usury, some socio-economic subcultures still manage to avoid the taking or giving of interest. Orthodox branches of both Judaism and Islam have maintained bans on usury throughout the centuries and up to the present time. This is especially interesting in the case of Judaism, given the popular cultural image of the Jew as usurer. Jewish free loan systems may actually offer a model for modern loan programs that can be designed to aid poor borrowers, who are frequently shut out of mainstream financial services. (shrink)

Die Eigentumsgarantie nimmt nicht nur in der deutschen Verfassung, dem Grundgesetz, eine bedeutende Stellung ein, sondern prägt auch die verfassungsrechtlichen Grundlagen der europäischen Nachbarstaaten und vieler anderer Rechtsordnungen auf dem Globus. Neben der Bewahrung konkreter Eigentumspositionen gewährleistet die Eigentumsgarantie vor allem das Freiheitsanliegen des Einzelnen, der im Eigentum die materielle Absicherung seiner Selbstbestimmung findet. Allerdings steht das Eigentum nicht allein im Dienst des Eigentümers; es soll auch dem Gemeinwohl dienen. In dieser Wechselbezüglichkeit entstehen Konflikte und es verfestigt sich zusehends eine (...) Unausgewogenheit, wenn durch den Gebrauch von Eigentum ökologische Gemeinwohlinteressen nachhaltig verletzt werden, etwa bei der Zerstörung von Umweltgütern oder dem (übermäßigen) Verbrauch von Umweltressourcen. Dies spricht für eine Neuausrichtung des Verständnisses von Eigentum und seiner Beziehung zu sozio-ökologischen Notwendigkeiten, wobei diese sich an den aktuellen ökologischen Herausforderungen für die Gesellschaft‍(en) – weltweit – orientieren muss: Der im Eigentum verankerte Anteil an Rechten muss wieder mit den sozialen und ökologischen Verantwortlichkeiten in Balance gebracht werden. Hierzu gibt es sozio-historisch, aber auch verfassungsrechtlich vielversprechende Ansatzpunkte; ein aktuelles Urteil des Bundesverfassungsgerichts zum Klimaschutz deutet in dieselbe Richtung. : Is Peirce's esthetic relevant for the philosophy of art—what is usually referred to today as aesthetics? At first glance Peirce's idiosyncratic esthetic seems quite unconcerned with issues of art. Yet a careful examination reveals that this is not the case. Thus, rather than attempt to "apply" Peirce's views to some aspect of the practice or the theory of art (e.g., creativity, historiography of art, style, genre), or even to a particular work of art, my intention is to examine how (...) art fits into Peirce's own conception of his esthetic theory. The argument is divided into two parts. In the first section I present Peirce's conception of esthetics in the context of the normative sciences. I argue that esthetics connects with various strands of Peirce's philosophy, most notably his cosmology, his agapasm and with the way that important aspects of them hang together around the principle of abduction and the corresponding notion insight. In the second section, I consider in what way art may be said to be admirable, to contribute to the summum bonum. I try to show that Peirce's esthetic suggests that what attracts us towards art is first and foremost a semeiotic quality qua quality of mind or quality of Thirdness. (shrink)

Psychosocial distress is highly prevalent in cancer patients, approaching rates around 40% across various cancer sites according to multicenter studies. As such, distress screening procedures have been developed and implemented to identify and respond to cancer patients' psychosocial distress and concerns. However, many cancer patients continue to report unmet psychosocial needs suggesting gaps in connecting patients with psychosocial services. Presently, there is a paucity of research examining sex-based disparities in referral rates to behavioral oncology services, particularly for adolescent and young (...) adult cancer patients. Informed by gender role conflict and empirical literature documenting disparities in cancer care and treatment based on a variety of sociocultural variables, this study aimed to examine the presence of sex disparities in referral rates to behavioral oncology services for AYA cancer patients. Data for this study consisted of 1,700 AYA cancer patients who completed a distress screening at a large cancer center of a teaching hospital in the Midwestern United. Results indicated that patient sex significantly predicted the odds of behavioral oncology referral. This finding indicates that female AYA cancer patients are 2.5 times more likely to be referred to behavioral oncology services compared to male AYA cancer patients after controlling for psychosocial distress and emotional, family, and practical problems. Additionally, we found that emotional problems significantly moderated the odds of referral for males and females, however the odds of referral for males who endorsed emotional problems were lower than males who did not endorse emotional problems. This contrasted with female AYA cancer patients where the endorsement of emotional problems increased the odds of referral to behavioral oncology services. Findings are discussed with particular focus on how to enhance equitable care and reduce sex and other sociocultural-based disparities in AYA psychosocial oncology. (shrink)

This paper examins how the medieval distinction between proper and improper signification can give a plausible explanation of both metaphorical use and the usual transformations a language can undergo. I will show how Thomas Aquinas distinguishes between ordinary ambiguous terms and metaphors, whereas William of Ockham and Walter Burley do not leave room for this distinction. I will argue that Ockham’s conception of transfer of sense through subsequent institution of words is best thought of as an explanation of how ordinary (...) usage can contain ambiguities, whereas Burley’s conception of transfer of sense without new imposition is more plausible when it comes to explaining metaphors. If metaphorical use is lumped together with equivocation, the account of how they work cannot do full justice to either, an insight that we already find in Peter Abelard, if not in Boethius. In this chapter, I investigate the metaphysical assumptions that medieval thinkers considered necessary in order to integrate the vegetative powers and processes into their conception of human beings as composed of a material body and an immaterial soul. My aim is to show that vegetative powers and processes are central to the late medieval debate on faculty psychology and on the unity or plurality of substantial forms. The chapter has two parts. First, I present three different accounts of the ontological (...) status of the vegetative powers in relation to the body and the soul, as found in Thomas Aquinas, William of Ockham, and John Buridan. All three maintain that the vegetative powers belong to the soul but disagree as to whether they are identical with it or somehow distinct from it, especially when the soul in question is immaterial. Second, I investigate how medieval thinkers accounted for the metaphysics behind the operations of the vegetative powers in human beings, who are endowed with immaterial souls, in particular when it comes to procreation and digestion. A pressing problem for the vegetative powers of human beings is how they can produce a new substance when this composite is supposed to include an immaterial soul which is not naturally generated. Regarding procreation, one can distinguish two different approaches: dispositional generation of material conditions and substantial generation of the body. A similar problem for human beings arises in nutrition and growth once this process is taken to be some kind of substantial change, namely, the corruption of food and the production of new parts of the living being. Two accounts can be distinguished: “transmateriation” of the matter of food into the nourished body and generation of parts of the body. (shrink)

Analyzing features of Wittgenstein's philosophical work and including in-depth textual analyses, this study investigates the impact of Ludwig Wittgenstein's work on contemporary German and French novelists. Drawing upon aesthetics, architectural history, philosophy of science, and photography, the book seeks to explain why references both to Wittgenstein as a person, as well as to his work are more pervasive than other equally renowned twentieth century philosophers and asks why some authors such as Händler and Roubaud, are less well-known and only partially (...) translated into English. This essay examines the early writings of Samuel Cocceji on the foundations of natural law. A key focus of this study is his criticism of the ‘principle of sociality’. It situates Cocceji in a debate about sociality that took place in the 1690s and early years of the 1700s throughout various German universities. This was a debate with its own language and integrity. Reconstructing this language and explaining the key terms of contention is central to this enquiry. This aspect of (...) the argument is pursued by focusing on Cocceji's inaugural dissertation and rebuilding his case against sociality. I present an analytical framework drawn from these discussions to understand the principle of sociality in a new light. As an incisive critic of sociality, Cocceji provides an ideal flashlight to examine the use of this principle in debates surrounding the foundations of natural law. (shrink)
