En este trabajo confrontamos la posición de Bulygin acerca de las normas con la del escéptico semántico y la del incorporacionista. entendemos a ambas figuras como expresiones -matizadas- de dos enfoques generales respecto del comportamiento en base a reglas: a) el que no ve en este más que "decisiones arbitrarias", meras reacciones o hábitos de conducta, y b) el que asimila la explicación de lo normativo con el ajuste a reglas o principios. Ahora bien, la noción general de Bulygin que (...) concibe a las normas como proposiciones o entidades conceptuales, parece -paradójicamente- rozar el escepticismo cuando se enfrenta a la imposibilidad de listar en forma completa las excepciones implícitas en la formulación de una regla. Proponemos una concepción alternativa basada en la noción de que el significado se muestra en el "uso", entendido este como el dominio de una técnica que constituye una "práctica social", en la cual reside un tipo de corrección práctica que no depende de justificaciones explícitas, sino de un trasfondo no expreso que hace irreductible a una teoría la aplicación de normas jurídicas. We contrast Bulygin's position on rules against that of the semantic skeptic and the inclusionist. We understand these two positions as in some sense expressing two general approaches on behavior according to rules: a) the first one stating that ruled behavior is no more than "arbitrary decisions," mere reactions or behavioral habits, and b) the second one explaining everything normative as actions adjusted to rules or principles. Bulygin's general notion according to which rules are propositions or conceptual entities paradoxically seems to be close to a skeptic position when facing the impossibility of completely listing implicit exceptions when formulating a rule. We propose an alternative conception based on the notion that meaning is shown in use, understanding by "use" the mastering of a technique that constitutes a social practice, in which resides a sort of correction practice. This correction does not depend on explicit justifications but on an unexpressed background which makes impossible a theory of legal application of rules. (shrink)

En este segundo documento nos ocupamos del aborto realizado por motivos terapéuticos o, dicho más brevemente, del aborto terapéutico. En la Argentina, el aborto plantea serios desafíos para la salud pública, ya que, pese a estar prohibido, se practica de forma clandestina y, muchas veces, insegura, poniendo en riesgo la vida y la salud de las mujeres. Por esta razón, creemos que la sociedad y el Estado deben debatir este problema y encontrar soluciones que resguarden los derechos de las mujeres. (...) El artículo 86, inciso 1, del Código Penal argentino expresamente despenaliza el aborto cuando corre peligro la vida o la salud de la mujer. En estos casos, se habla de aborto terapéutico. Esta disposición legal no suele aplicarse ni por los médicos ni por los profesionales que trabajan en la justicia, ya sea por desconocimiento o por razones ideológicas. Más aún, en muchos casos, las interpretaciones del Código Penal se apartan de su letra y restringen arbitrariamente su aplicación. Por estas razones, nos parece importante analizar este problema y proveer información sobre los aspectos legales y éticos involucrados en el aborto terapéutico en la Argentina. Este documento comienza con el relato de un caso hipotético, elaborado a partir de experiencias reales, con el objetivo de acercar al público a una situación concreta. Intercaladas en el cuerpo del relato, se desarrollan algunas reflexiones acerca de las implicaciones médicas, éticas y legales del caso. A continuación, se presenta un apartado referido al marco legal en el que se deben encuadrar los casos de aborto no punible. El documento sigue con una serie de breves recomendaciones destinadas tanto a los profesionales que trabajan en el sistema judicial como a los profesionales de la salud. Dies ist nicht im Sinne einer Rangfolge gemeint, sondern zeichnet die Hellsichtigkeit eines Dichters aus, der sich ins Freie vorwagt. Was er dort schaut und empfangt, kommt auch dem Denker zu, der dafur andere, weniger poetische Worte finden muss. Der Dichter spricht die Sache des Denkers an, (...) der Denker versucht der Sprache des Dichters auf den Grund zu gehen. Beide muhen sich im Sinne eines Auftrags, der vor unvordenklichen Zeiten ergangen sein muss und der uber den irdischen Geschaftsbetrieb hinausweist. The discussion of collective agency involves the reduction problem of the concept of a collective. Individualism and Cartesian internalism have long restricted orthodox theories and made them face the tension between an irreducible concept of a collective and ontological reductionism. Heterodox theories as functionalism and interpretationism reinterpret the concept of agency and accept it as realized on the level of a collective. In order to adequately explain social phenomena that have relations as their essence, in this paper we propose a (...) relational, holistic account of collective agency and argue that functionalism and interpretationism can be integrated into such an account. This article develops an ecological framework for understanding collective action. This is contrasted with approaches familiar from the collective intentionality debate, which treat individuals as fundamental units of collective action. Instead, we turn to social ecological psychology and dynamical systems theory and argue that they provide a promising framework for understanding collectives as the central unit in collective action. However, we submit that these approaches do not yet appreciate enough the relevance of social identities for collective action. To analyze this (...) aspect, we build on key insights from social identity theory and synthesize it with embodied and ecological accounts of perception and action. This results in the proposal of two new types of affordances. For an individual who enacts her "embodied social identity" of being a member of a particular collective, there can be what we call embodied social identity affordances. Moreover, when several individuals dynamically interact with each other against the background of their embodied social identities, this might lead to the emergence of a collective, which we understand as a dynamically constituted and ecologically situated perception-action system consisting of several individuals enacting relevant embodied social identity affordances. Building on previous work in social ecological psychology, we suggest that there can be genuine collective affordances, that is, affordances whose subject is not an individual, but a collective. Recent empirical findings from social psychology, ecological psychology, and embodied cognitive science indicate that situational factors crucially shape the course of human behavior. For instance, it has been shown that finding a dime, being under the influence of an authority figure, or just being presented with food in easy reach often influences behavior tremendously. These findings raise important new questions for the philosophy of action: Are these findings a threat to classical conceptions of human agency? Are humans passively pushed around (...) by situational factors, or are there agential aspects in the way we spontaneously experience and react to situations? How can one conceptualize the pervasive influence of situational factors on human action? What are situations in the first place, and how should the influence of these situations on action be thought of? This paper sets out to develop a new conceptual repertoire for thinking about the influence of situations on action, drawing on research from ecological psychology as well as from embodied and enactive cognitive science. The key proposal is the development of a philosophical sensorimotor account of agency: Action, it is proposed, should be conceived of as constant dynamical interaction of agential and environmental factors – factors which should all be conceptualized in new ways. In this paper we present an overview, with historical and critical remarks, of two articles by S. Jaśkowski ([20, 21] 1948 and [22, 23] 1949), which contain the oldest known formulation of a paraconsistent logic. Jaśkowski has built the logic – he termed discussive (D2) – by defining two new connectives and by introducing a modal translation map from D2 systems into Lewis’ modal logic S5. Discussive systems, for their formal details and their original philosophical justification, have attracted discrete attention (...) among experts. Indeed, in what follows, after having introduced Jaśkowski methodology of building D2 and his main philosophical motivations for providing such a system, we will explore some of the main contributions to the development of D2. Dream is a state of consciousness characterized by internally-generated sensory, cognitive and emotional experiences occurring during sleep. Dream reports tend to be particularly abundant, with complex, emotional, and perceptually vivid experiences after awakenings from rapid eye movement sleep. This is why our current knowledge of the cerebral correlates of dreaming, mainly derives from studies of REM sleep. Neuroimaging results show that REM sleep is characterized by a specific pattern of regional brain activity. We demonstrate that this heterogeneous distribution of brain (...) activity during sleep explains many typical features in dreams. Reciprocally, specific dream characteristics suggest the activation of selective brain regions during sleep. Such an integration of neuroimaging data of human sleep, mental imagery, and the content of dreams is critical for current models of dreaming; it also provides neurobiological support for an implication of sleep and dreaming in some important functions such as emotional regulation. The creation of CIHR was in follow-up to the Canadian Medical Research Council (MRC) as well as to the National Health Research (...) and Development Program of Health Canada that, up until that point in time, had supported the breadth of health research in Canada. Two important characteristics of CIHR were crucial for the development of research on aging. The first was that CIHR, unlike MRC, was entrusted with the challenge of supporting the whole spectrum of health research, from the basic biomedical perspective to clinical research, research on health services and policies as well as social aspects of health research, not to mention research on ethics and other perspectives (including the science of research). The second characteristic of the nascent CIHR that impacted the community of research on aging was the decision that a small part of the overall CIHR budget would be used to address priority-driven questions or topics (strategic competitions), while the majority of the budget would be invested in grants and awards programs that would be investigator-initiated, as in the time of the MRC (open competition). Since its inception, CIHR has included 13 institutes that are central to the priority-driven actions. Institutes not only play an important convener role within their communities and among their stakeholders, but they are also expected to listen to the needs, gaps and opportunities in their area and to introduce initiatives---most of the time involving more than one Institute---in order to tackle these needs and gaps and to seize upon the opportunities.The Institute of Aging was introduced at the same time as the other 12 Institutes and it is clear that many challenges were awaiting the new Institute since, at that time, research on aging was still in its early years. This article is about the trajectory of the CIHR Institute of Aging in its first 18 years of existence. Having now reached an age that is either the age of majority or quite close to it, it is important to be able to provide a reflection on the evolution of the priorities over this period, while also taking a peek at some of the priorities that will surely come in the near future.The Early Years (2001-2004)The founding Scientific Director of the Institute of Aging was Dr. Réjean Hébert. A well-known and prolific [End Page 1] geriatrician and researcher, Dr. Hébert was the perfect person to launch the Institute. One of his first actions was, in fact, to harmonize the French and English names of the Institute. In French, the name of the Institute focused on Aging (Institut du vieillissement) while, in English, the name of the Institute focused on Healthy Aging. The CIHR Institute of Healthy Aging thus became the CIHR Institute of Aging in all versions of its documentation. But above and beyond this important name change, the real work of Dr. Hebert, accompanied by the first Institute Advisory Board1, chaired by Prof. Dorothy Pringle, was to identify the gaps, the needs and the opportunities. After a rigorous process came the first Strategic Plan of the CIHR Institute of Aging, which was clearly influenced by Dr. Réjean Hébert's vision of the aging population as an opportunity, instead of a catastrophe, for our society that comes, of course, with its own challenges. Dr. Hébert left CIHR during his first mandate as he was called upon to become the Dean of his Faculty, and then went on to become the first CIHR Scientific Director to sit as a Minister of Health and Social Services in the Québec Government. Earlier in this century, many philosophers of science (for example, Rudolf Carnap) drew a fairly sharp distinction between theory and observation, between theoretical terms like 'mass' and 'electron', and observation terms like 'measures three meters in length' and 'is _2° Celsius'. By simply looking at our instruments we can ascertain what numbers our measurements yield. Creatures like mass are different: we determine mass by calculation; we never directly observe a mass. Nor an electron: this term is introduced in order to (...) explain what we observe. This (once standard) distinction between theory and observation was eventually found to be wanting. First, if the distinction holds, it is difficult to see what can characterize the relationship between theory :md observation. How can theoretical terms explain that which is itself in no way theorized? The second point leads out of the first: are not the instruments that provide us with observational material themselves creatures of theory? Is it really possible to have an observation language that is entirely barren of theory? The theory-Iadenness of observation languages is now an accept ed feature of the logic of science. Many regard such dependence of observation on theory as a virtue. If our instruments of observation do not derive their meaning from theories, whence comes that meaning? Surely - in science - we have nothing else but theories to tell us what to try to observe. (shrink)

The fundamental question whether, or in which sense, science informs us about the real world has pervaded the history of thought since antiquity. Is what science tells us about the world determined unambiguously by facts or does the content of any scientific theory in some way depend on the human condition? "Sokal`s hoax" added a new dimension to this controversial debate, which very quickly came to been known as "Science Wars". "Knowledge and the World" examines and reviews the broad range (...) of philosophical positions on this issue, stretching from realism to relativism, to expound the epistemic merits of science, and to address the central question: in which sense can science justifiably claim to provide a truthful portrait of reality? Upon introspection, we judge that suffering feels bad. I argue there is no appearance-reality gap when it comes to introspective judgments about simple, intrinsic, nonrepresentational phenomenal states like itches, tingling, and suffering's feeling bad. On constitutivism about phenomenal introspection, there is no appearance-reality gap here because these judgments are literally constituted by the phenomenal states they are about. As a result, we are directly acquainted with the intrinsic properties of experience in having these judgments. Reflecting on our direct acquaintance with (...) intrinsic badness, we can know that our suffering instantiates this judgment-independent evaluative property. (shrink)

The aim of this paper is to provide a proof-theoretic characterization of relevant logics including fusion and fission connectives, as well as Ackermann’s truth constant. We achieve this by employing the well-established methodology of labelled sequent calculi. After having introduced several systems, we will conduct a detailed proof-theoretic analysis, show a cut-admissibility theorem, and establish soundness and completeness. The paper ends with a discussion that contextualizes our current work within the broader landscape of the proof theory of relevant logics.

Emotion evaluations are assumed to play a crucial role in the emotion regulation process. We tested a postulate from our framework of emotion dysregulation (Nowak, U., Wittkamp, M. F., Clamor, A., & Lincoln, T. M. [2021]. Using the Ball-in-Bowl metaphor to outline an integrative framework for understanding dysregulated emotion. Frontiers in Psychiatry, 12, 118), namely that the extent to which individuals evaluate an emotion as harmful and their personal resources to modify and accept/tolerate the emotion as sufficient predict the subsequent (...) use of regulation strategies. Participants (n = 118) from a community sample took part in an experience-sampling assessment over 7 days including 10 daily paired measurements. The first measured momentary affective valence and arousal along with harmfulness evaluations and evaluations of personal resources to modify and accept/tolerate an emotion. The second followed three minutes later and measured emotion regulation strategies. The more harmful individuals evaluated an emotion, the more likely they were to use an emotion regulation strategy. The more harmful individuals evaluated an emotion, and the less sufficient they evaluated their personal resources to accept/tolerate an emotion, the more likely they were to use a maladaptive emotion regulation strategy. We conclude that emotions that people evaluate as harmful or difficult to accept are most likely to be regulated in a maladaptive manner. This implies that modifying beliefs about emotions could represent a promising treatment approach. (shrink)

Para lograr justificar nuestra conjetura nos centraremos especialmente en la obra de Heidegger Kant y el problema de la Metafísica (1929). En dicho texto nos encontraremos con una controvertida interpretación que el pensador de Meßkirch elaboró del opus magnum de Immanuel Kant. Interpretación que, justamente, podría (...) sugerirnos que su Ser y Tiempo, no sólo estaría hermanado con la Crítica de la razón pura, sino que vendría a ser una correcta continuación del camino allí trazado por el filósofo de Königsberg. Nursing acts occur in thousands of instances daily, being a major component of professional health care delivery in institutions, communities and homes. It follows that the ethical practice of most nurses is put to the test on an everyday rather than an occasional basis. Hence, within nursing practice there must be a rich and deep seam of reflective interpretation and practical wisdom that is ‘embedded’ within the experiences of every experienced nurse. This article presents discussion on some of the main (...) findings of a recently completed study on nursing ethics in New Zealand. An interpretation of a nurse’s story taken from the study is offered and suggestions are made for nursing ethics education. (shrink)

This paper challenges the negative attitudes towards labelled proof systems, usually referred to as semantic pollution, by arguing that such critiques overlook the full potential of labelled calculi. The overarching objective is to develop a practice-based philosophical analysis of labelled calculi to provide insightful considerations regarding their proof-theoretic and philosophical value. To achieve this, successful applications of labelled calculi and related results will be showcased, and comparisons with other relevant works will be discussed. The paper ends by advocating for a (...) more practice-based approach towards the philosophical understanding of proof systems and their role in structural proof theory. (shrink)

This article explores the social and ethical elements of cultural safety and combines them in a model of culturally safe practice that should be of interest and relevance for nurses, nurse educators and nurse ethicists in other cultures. To achieve this, the article briefly reviews and critiques the main underpinnings of the concept from its origins and development in New Zealand, describes its sociocultural and sociopolitical elements, and provides an in-depth exploration of the key socioethical elements. Finally, a model is (...) presented to illustrate the strong connection between the social and ethical components of cultural safety that combine to produce culturally safe practice through the activities of a ‘socioethical’ nurse. Recent developments in Continental philosophy have included the emergence of a school of “speculative realism,” which rejects the human-centered orientation that has long dominated Continental thought. Proponents of speculative realism differ on several issues, but many agree on the need for an object-oriented ontology. Some speculative realists identify realism with materialism, while others accord equal reality to objects that are non-material, even fictional. Several thinkers retain a focus on difference, a well-established theme in Continental thought. This paper looks at speculative (...) realism from the perspective of systems theory. Many of the tenets of speculative realism have long been features of systems metaphysics and are expressed clearly in a systems framework. However, some views of some speculative realists differ substantially from systems theoretic ideas. (shrink)

The Mind in Nature has two central aims. First, that of defending a ‘basic ontology’. Second, having advanced a plausible ontological framework, to appeal to it to cast light on the status of intentionality and the nature of consciousness, paying particular attention to the question of what distinguishes conscious systems from those that are vegetative.Central to Martin's basic ontology is his acceptance of a realist conception of dispositionality. Contrary to the view of David Lewis and others, talk about a thing's (...) dispositions cannot be analysed as talk about a thing's behaviour in a set of counterfactual circumstances. The account of dispositions that emerges from Martin's discussion is one according to which a specific disposition is either actual or it is not. To be actual a disposition need not be manifesting any manifestation. Unmanifesting dispositions are not, therefore, unactualized possibilia – a description which, he observes, is more fitting of unmanifested manifestations. En este trabajo se analizan las reflexiones de Ernst Jünger sobre la idea de progreso para, después, ofrecer una hipótesis acerca de las bases metafísicas de este concepto. Para ello, se presenta una lectura de los textos fundamentales de Jünger en torno a esta cuestión, publicados durante la época de entreguerras, en los que el progreso aparece vinculado al desarrollo de la técnica y del nihilismo. Después, se propone una genealogía de la idea de progreso para descubrir sus cimientos filosóficos (...) desde una perspectiva crítica. The considerations set out in the paper are intended to suggest that in practical contexts predictive power does not play the outstanding roles sometimes accredited to it in an epistemic framework. Rather, predictive power is part of a network of other merits and achievements. Predictive power needs to be judged differently according to the specific conditions that apply. First, predictions need to be part of an explanatory framework if they are supposed to guide actions reliably. Second, in scientific expertise, the (...) demand for accurate predictions is replaced with the objective of specifying a robust corridor of estimates. Finally, it is highly uncertain to predict the success of research projects. The overall purpose of the paper is to enlarge the debate about predictions by addressing specifically the roles of predictions in application-oriented research. (shrink)

The authors analyse a new paradigmatic approach to the enhancement of human beings proposed in transhumanist visions. Transhumanist authors promote the biochemical enhancement of healthy people via the concepts of bio-happiness and bio-love. The paper is based on an assessment of the value attributed to the lives of disabled people vis-à-vis those of healthy people. The value imbalance in the transhumanist conception is criticized on the grounds that it is an incorrect response to the posthuman urge to redefine human beings. (...) Drawing on resources from Heidegger, social theory, ecological psychology, and enactive cognitive science, this paper presents novel analyses of social normativity and social change. The key idea is that we humans are often stunned with the practical necessities we experience in everyday action: Often, it feels hard or even impossible for us to act differently from what “one” has to do – for instance, it just feels “wrong” to go shopping in a dressing gown. However, a philosophical analysis reveals that (...) we only experience the world in the way we experience it because we are the beings that we are: There are subjective background conditions for bringing about meaningful experiences, background conditions which only philosophical reflection can make us aware of. These background conditions, it is suggested, are shaped and transformed by social conventions and public interpretations of the world. Thus, the point of view from which we experience the world is socially shaped – a fact most humans are ignorant about when absorbed in action. Yet apprehending this fact, and realizing that the interpretation which we ordinarily presuppose is radically contingent is the first step of becoming “authentic”. Individuals gaining this insight understand that it is to an important part up to them how the world shows up. Thus, they can modify their attitude toward the world. Likewise, it is suggested, even a whole society can become socially authentic and decide which of the contingent social conventions which constitute it as a society should be retained and which modified. Ontological perspectives in higher education and particularly in professional education and development have focused attention on the question of the learner’s being and becoming rather than on the epistemological concern of what and how they know. This study considers the formation of the professional self in the light of the requirements for professional practice. It raises the question of agency in relation to this formational process and considers the implications of the autonomy paradox which arises from the simultaneous influence of (...) the sovereign self and the external authority of the profession on the formation of the professional self. This study considers a structural perspective on both of these matters and concludes with implications for professional education and development derived from constructive developmental theory and the notion of subject–object transformation. Das Problem, unter welchen Bedingungen eine Hypothese oder Theorienmodifikation als methodologisch akzeptabel gilt, wird in der wissenschaftstheoretischen Tradition als die Frage des Ad-Hoc-Charakters von Hypothesen diskutiert. Das gleichartige Problem tritt aber auch in Lakatos' Methodologie wissenschaftlicher Forschungsprogramme auf, welche von methodologisch zulässigen Theorienänderungen die Vorhersage 'neuer Tatsachen' verlangt. Über diesen Begriff der neuen Tatsache und damit der Adäquatheitsbedingungen für wissenschaftliche Erklärungen hat sich eine weitgefächerte Debatte entsponnen. In diesem Papier wird der Versuch unternommen, die Forderung der unabhängigen Testbarkeit einer Hypothese, (...) welche im Rahmen der Diskussion des Ad-hoc-Charakters von Hypothesen eine wichtige Rolle spielt, auch für die Frage der Spezifizierung von 'neuen Tatsachen' fruchtbar zu machen. Ich argumentiere zugunsten der Bedingung, daß eine Hypothese als methodologisch akzeptabel gelten sollte, wenn sie zumindest zwei unabhängige Tatsachen erklärt. Ein derartiger Ansatz verlangt die Kennzeichnung dessen, was als 'eine Tatsache' zu gelten hat. Die Schwierigkeit einer derartigen Kennzeichnung ist ein notorisches Problem jedes Kriteriums, das auf unabhängige Testbarkeit zielt. Eine Klärung dieses Problems wird über das Konzept der empirischen Generalisierung versucht. Als 'eine Tatsache' im methodologischen Sinne gilt demnach ein gesetzmäßiger Zusammenhang zwischen zwei Meßgrößen. Dies erlaubt weiterführend eine Klärung des Problems, was methodologisch als 'ein Experiment' zu werten ist, d. h. was als Reproduktion desselben und was als andersartiges Experiment gelten soll. Mit Hilfe dieser Klärungen wird unter anderem der Ad-hoc-Charakter der Lorentzschen Kontraktionshypothese sowie das Problem der Gleich- oder Verschiedenartigkeit von Michelson-Morley- und Kennedy-Thorndike-Experiment untersucht.
