This book defends morality against the critiques of egoims, subjectivism, and relativism. It argues that we can and should construe some moral standards as objective and that justice and self-development are the cornerstones of healthy morality. Opening with a dialogue meant to tease and provoke the reader, the book's subsequent chapters treat misconceptions about morality, the possibility of unselfish action, the nature of free will and moral responsibility, and the identity of moral right and wrong.

Some commentators have condemned Kant’s moral project from a feminist perspective based on Kant’s apparently dim view of women as being innately morally deficient. Here I will argue that although his remarks concerning women are unsettling at first glance, a more detailed and closer examination shows that Kant’s view of women is actually far more complex and less unsettling than that attributed to him by various feminist critics. My argument, then, undercuts the justification for the severe feminist critique of Kant’s (...) moral project. (shrink)

Classical logic has proved inadequate in various areas of computer science, artificial intelligence, mathematics, philosopy and linguistics. This is an introduction to extensions of first-order logic, based on the principle that many-sorted logic (MSL) provides a unifying framework in which to place, for example, second-order logic, type theory, modal and dynamic logics and MSL itself. The aim is two fold: only one theorem-prover is needed; proofs of the metaproperties of the different existing calculi can be avoided by borrowing them from (...) MSL. To make the book accessible to readers from different disciplines, whilst maintaining precision, the author has supplied detailed step-by-step proofs, avoiding difficult arguments, and continually motivating the material with examples. A significant theory of corporate social responsibility is the Stakeholder Model. Within this model, entities make decisions that impact all stakeholders. Occasionally, the decision that is made ultimately impacts one stakeholder differently than another. Negative data by its very definition is seen as problematic for any organization as it pertains to its stakeholders. In trying to connect a primarily literary account of sentimental history and theory to a primarily philosophical account of feminist pragmatism,1 certain dangers emerge. One is to unintentionally privilege the genre of philosophy over the genres of poetry or sentimental fiction. In H.S. Thayer’s insightful Meaning and Action: A Critical History of Pragmatism, as but one example, philosophical writing subordinates other genres, such as poetry or novels, leading to readings of Dewey and James that disproportionately weight the influence of philosophical (...) writing on their attitudes. While debate continues over the role of the lawyer in society, this article notes that the recently amended professional conduct rules of both barristers and solicitors and the proposed draft National Law prioritise the duty to the court and the administration of justice. In addition, the Australian Learning and Teaching Council's threshold learning outcomes for legal education corroborate these obligations when they assert that the role of a lawyer includes a professional responsibility to promote justice in service to the community. By referring to Australia's proposed regulatory framework and associated national professional conduct rules, and drawing upon the American Bar Association's Model Rules of Professional Conduct and a body of US literature that refers to lawyers as public citizens, this article will argue that Australian lawyers owe a duty to the public in their everyday dealings with clients. In doing so, this article will refer to some theories of citizenship; and what it means for lawyers, in a practical sense, to act as public citizens. (shrink)

In this article, I examine and criticize John Searle's account of the relation between mind and body. Searle rejects dualism and argues that the traditional mind-body problem has a 'simple solution': mental phenomena are both caused by biological processes in the brain and are themselves features of the brain. More precisely, mental states and events are macro-properties of neurons in much the same way that solidity and liquidity are macro-properties of molecules. However, Searle also maintains that the mental is 'ontologically (...) irreducible' to the physical, a view which follows from his understanding of the status and nature of consciousness. Consciousness is essential to the mind; subjectivity is essential to consciousness; and no purely objective, physical description of consciousness could ever capture or explain its essentially subjective character. None the less, Searle maintains that irreducibility is a 'trivial' result of our 'definitional practices' and is entirely compatible with his theory. I contend that this latter claim is based on an equivocation: Searle's conclusion only seems to follow because he alters and trivializes what philosophers ordinarily mean by 'reduction'. I also maintain that Searle's position is reductionist in the ordinary, nontrivial sense. For this reason, his theory fails to accommodate the subjective character of consciousness and fails to solve the traditional mind-body problem. Finally, I briefly discuss Searle's claim that he is not an epiphenomenalist, and argue that given the assumptions of his view there is no interesting causal role for consciousness in the physical world. In the Philippines, all transplant centers are mandated by the Department of Health (DOH) to have a Hospital Transplant Ethics Committee (HTEC) to ensure that donations are altruistic, voluntary and free of coercion/commercial transactions. This study was undertaken primarily to describe the organizational and functional profile of existing HTECs and identify areas for improvement. This is a descriptive cross‐sectional study. There was variation in their logistical arrangements (support from hospital, filing systems, office spaces), operations (length and frequency of meetings, number (...) of referrals) and membership (composition, qualifications, occupation, training). The approval rate for donor‐recipient pairs is high with the majority of cases made by living non‐related donors. Appropriate reasons were cited for rejection. The perception of HTECs is that they are competent and confident in their decision‐making. However, there is a need to standardize HTEC composition, provide operating procedures and additional training which can be done by the DOH. (shrink)

ABSTRACTA lawyer's behaviour derives from their own principles and values, the norms of professionalism, the professional conduct rules and the common law. In the past, much emphasis has been placed upon the first two sources as they formed the basis of self-regulation and influenced the development of legal ethics. Recently, the Australian codes of ethics explicitly detail an increasing range of duties which might reasonably have been thought to be implicit characteristics of sound ethical values and professionalism, for example, a (...) duty to be civil, and an explicit prohibition against harassment, intimidation and bullying. Such additions have been deemed necessary as a response to increasing concerns about lawyer incivility and empirical reports detailing high levels of harassment, intimidation and bullying within law firms. Plato famously promised to complement the Sophist and the Statesman with another work on a third sort of expert, the philosopher--but we do not have this final dialogue. Mary Louise Gill argues that Plato promised the Philosopher, but did not write it, in order to stimulate his audience and encourage his readers to work out, for themselves, the portrait it would have contained. The Sophist and Statesman are themselves members of a larger series starting with the Theaetetus, Plato's investigation of (...) knowledge, and the whole series relies on the Parmenides, the second part of which presents a philosophical exercise, introduced as the first step in a larger philosophical program. Gill contends that the dialogues leading up to the missing Philosopher, though they reach some substantive conclusions, are philosophical exercises of various sorts designed to train students in dialectic, the philosopher's method; and that a second version of the Parmenides exercise, closely patterned on it, spans parts of the Theaetetus and Sophist and brings the philosopher into view. This is the exercise about being, the subject-matter studied by Plato's philosopher. Plato hides the pieces of the puzzle and its solution in plain sight, forcing his students (and modern readers) to dig out the pieces and reconstruct the project. Gill reveals how, in finding the philosopher through the exercise, the student becomes a philosopher by mastering his methods. She shows that the target of Plato's exercise is internally related to its pedagogical purpose. (shrink)

Rosalind Hursthouse The daughter of a pacifist rector who answered "No!" when his congregation asked him "Is everything in the bible true?", perhaps Mary Midgley was destined to become a philosopher. Yet few would have thought this inquisitive, untidy, nature-loving child would become "one of the sharpest critical pens in the west." This is her remarkable story. Probably the only philosopher to have been in Vienna on the eve of its invasion by Nazi (...) Germany in 1938 and dance in Trafalgar Square on VE day seven year later, she studied philosophy at Oxford in the same year as Iris Murdoch, Elizabeth Anscombe and Philippa Foot, all of whom became close friends. Midgley tells us in vivid and humorous fashion how they cut a swathe through the arid landscape of 1950s British philosophy, writing and arguing - often with each other - about the grand themes of character, beauty and the meaning of rudeness while the spectral figure of Ludwig Wittgenstein hovered in the background. She also charts the highs and lows of philosophy and academia in Britain. On joining the Reading philosophy department on £400 a year in 1949, she doubled its staff complement. But her many years at Newcastle University - where Mike Brearley, who later captained England at cricket, also used to teach - were rewarded with the closure of the philosophy department in the 1980s. The mother of three children, her journey is also one of a woman who in the 1950s and 1960s was fighting to combine a professional career with raising a family. In startling contrast to many of the academic stars of her generation, we learn that Midgley nearly became a novelist and started writing philosophy only when in her fifties, suggesting that Minerva's owl really does fly at dusk. Plainly told like her philosophy, this is an elegiac and moving account of friendships found and lost, bitter philosophical battles and of a profound love of teaching all too rarely acknowledged today. Phenomenologists such as Merleau?Ponty have argued that the ordinary teleological relation between an embodied agent and the world is neither ?subjective? nor ?cognitive?, i.e. that it is not normally mediated by a chain of explicit cognition occurring within a distinct mental subject. Yet, while this seems true from a first?person, phenomenological perspective, I argue that teleological forms of explanation require the ascription of Intentional states. Intentional states, however, are usually regarded as subjective, cognitive states. In order to reconcile the phenomenology (...) with the logic of teleology, I introduce the notion of ?body?intentionality?. I maintain that we can use a modified version of Jonathan Bennett's concept of a teleological law to specify third?person empirical criteria for a pre?cognitive, pre?subjective kind of Intentionality. I also argue that this notion of body?intentionality provides us with at least a partial solution to the mind?body problem that avoids the inadequacies of the computational theory of mind. (shrink)

The concept of equity is clearly important in Thomas Hobbes's philosophy. In his writings he repeatedly employs it in significant load bearing ways, particularly in the areas of civil law and governance. Equity is, however, not directly addressed in a sustained way in his core works and—perhaps even more frustratingly—it is often applied in ways which ask more questions about the concept than they answer. This presents an impediment to accurately understanding what equity really means to Hobbes. His late Dialogue (...) Between a Philosopher and a Student of the Common Laws of England (1681) seems to offer a solution to this challenge. This work contains extensive discussion on equity, including on the application of equity in relationship to absolute rule. However, equity in the Dialogue is not always the same as what we see in Hobbes's core works. The question is, did Hobbes change his mind on equity? This article argues no. Hobbes did not change his mind on equity; rather, within the Dialogue he is engaging with a common understanding of the term as it existed in English law. Consequently, Hobbes's discussions here should not inform us about how equity fits into his philosophy. (shrink)

The Conditional Probability Interpretation of Quantum Mechanics replaces the abstract notion of time used in standard Quantum Mechanics by the time that can be read off from a physical clock. The use of physical clocks leads to apparent non-unitary and decoherence. Here we show that a close approximation to standard Quantum Mechanics can be recovered from conditional Quantum Mechanics for semi-classical clocks, and we use these clocks to compute the minimum decoherence predicted by the Conditional Probability Interpretation.

This case study attempts to frame the ethical considerations between hiring a known smoker over a non-smoker in today’s cultural climate. Referenced data from a parallel project gauging the likelihood of Human Resources representatives to hire smokers and accommodate them in the workforce could help manage the response and critical thinking components of the case scenario. Questions also arise as to whether it is advisable for employers to take particular attitudes toward smoking in the workplace. This is not only in (...) the interest of the health of employees, customers and clients, but is also on the basis of a concern that employers may otherwise expose themselves to lawsuits where employees may, on the basis of illness contracted due to a smoking environment supported by an employer, sue for the costs of care and income. Often conflicts arises between stakeholders of a firm. Instances where one stakeholder’s needs conflict with the rights of other stakeholders can put managers in a precarious situation. Strict adherence to contract rules, for example, may be the absolute right of the firm but at the same time enforcement of that contractual right or rule may be unduly damaging to another stakeholder. Managers in these situations may seek to find a balancing act between the two conflicting sides in order to maintain (...) the balance that prioritizes the competing and conflicting responsibilities. Ethics practice is both relative and situational. Perhaps there is an area of no greater demonstration of these realities than where an organization, be it a public governmental entity and/or a quasi-governmental entity with government contracts has the duty of care owed to a vulnerable constituency as well as to other community stakeholders. These agencies have the public trust as well as the ethical caretaking concerns to master. In the following fact scenario and discussion, one would consider a situation where (...) the care of the vulnerable constituency is the paramount concern and the facilitation of that care is also in question. Human Resource and leadership teams need to be cognizant of not only impropriety of members within their organization but also the appearance of impropriety as well. This paper explores the notion of the 'evidence-based practitioner' is relation to the National Numeracy Strategy (NNS). The exploration is dealt with in the context of a pilot study of the implementation of the NNS one year before its national launch in September 1999. We begin by describing some of the milestones encountered in the relatively short life history of evidence-based practice (EBP) and exploring some of its various articulations. Challenging the appropriateness of current externally derived formulations of 'evidence' we (...) develop the notion of 'warranting' in order to examine alternative ways in which teachers legitimate their professional practice in relation to the NNS.
