Defenders of the strong view of divine conservation hold that nothing that God creates is capable of sustaining its own existence from one moment to the next without His immediate and continual influence. Assuming a traditional view about efficient causality, I demonstrate that simply in virtue of being committedto creation ex nihilo, the theist is thereby committed to this strong view of conservation.

La pena natural es una situación paradójica que se puede presentar cuando el autor de un delito, al cometerlo o a causa de éste, ha sufrido un daño igual o mayor al que padecería si el juez de la causa le aplicara la pena estatal prevista para tal conducta. Se da con frecuencia al juzgar ciertos accidentes viales, cuando el acusado ya carga el peso de ser quien, por imprudencia, mató a su pareja o familiar cercano, por ejemplo. Pero ¿en (...) qué situaciones y cómo cabe recurrir a la pena natural? En esta investigación, Manuel Serrano explora las diversas aristas y posturas en pugna que atraviesan este tema, donde se cruzan cuestiones como la idea de la “culpa compensada”, la prohibición de aplicar castigo doble por un mismo hecho (non bis in idem) y la clemencia judicial. El autor desmonta la estructura conceptual de la pena natural, estudia jurisprudencia argentina y recorre producciones teóricas de juristas que se han preocupado por este asunto complejo, profundo y poco abordado del derecho penal. The use of black box algorithms in medicine has raised scholarly concerns due to their opaqueness and lack of trustworthiness. Concerns about potential bias, accountability and responsibility, patient autonomy and compromised trust transpire with black box algorithms. These worries connect epistemic concerns with normative issues. In this paper, we outline that black box algorithms are less problematic for epistemic reasons than many scholars seem to believe. By outlining that more transparency in algorithms is not always necessary, and by explaining that (...) computational processes are indeed methodologically opaque to humans, we argue that the reliability of algorithms provides reasons for trusting the outcomes of medical artificial intelligence. To this end, we explain how computational reliabilism, which does not require transparency and supports the reliability of algorithms, justifies the belief that results of medical AI are to be trusted. We also argue that several ethical concerns remain with black box algorithms, even when the results are trustworthy. Having justified knowledge from reliable indicators is, therefore, necessary but not sufficient for normatively justifying physicians to act. This means that deliberation about the results of reliable algorithms is required to find out what is a desirable action. Thus understood, we argue that such challenges should not dismiss the use of black box algorithms altogether but should inform the way in which these algorithms are designed and implemented. When physicians are trained to acquire the necessary skills and expertise, and collaborate with medical informatics and data scientists, black box algorithms can contribute to improving medical care. This paper is devoted to the study of some subvarieties of the variety Q of Q-Heyting algebras, that is, Heyting algebras with a quantifier. In particular, a deeper investigation is carried out in the variety Q subscript 3 of three-valued Q-Heyting algebras to show that the structure of the lattice of subvarieties of Q is far more complicated that the lattice of subvarieties of Heyting algebras. We determine the simple and subdirectly irreducible algebras in Q subscript 3 and we construct (...) the lattice of subvarieties lambda (Q subscript 3) of the variety Q subscript 3. (shrink)

A satisfactory construal of the subject matter of free will debates must allow for disagreements along two axes. First, it must allow for the possibility of higher order disagreements, or disagreements about what concepts, phenomena, or practices an account of free will is supposed to capture or explain. Second, it must allow for the fact of variation in the extent to which theories are bound by antecedent pre-philosophical thought, talk, and practices. A promising way of accommodating these two thoughts is (...) to treat free will in broadly functionalist terms. On the account proposed here, free will is a power that makes sense of everyday responsibility practices. This construal is not widely shared, but it allows for the possibility that we might have false beliefs about the nature of free will, while still making sense of central philosophical debates about free will. This paper discusses the logical space of alternative conceptual engineering projects, with a specific focus on (1) the processes, (2) the targets and goals, and (3) the methods of such projects. We present an overview of how these three aspects interact in the contemporary literature and discuss those alternative projects that have yet to be explored based on our suggested typology. We show how choices about each element in a conceptual engineering project constrain the possibilities for the others, thereby giving (...) rise to distinct groupings of possible projects under the banner of conceptual engineering. We conclude with a critical reflection on the potential ethical issues that arise as a result of effectively putting conceptual engineering into practice. (shrink)

The variety O2 of double Ockham algebras consists of the algebras (A ∨, ∧, f,g 0,1) of type (2,2,1,1,0,0) where (A; ∨, ∧,f, 0,1) and (A; ∨, ∧,g 0,1) are Ockham algebras. In [16], M. Sequeira introduced several subvarieties of O2. In this paper we give a construction of free double Ockham algebras on a partially ordered set. We also describe free objects for the subvarieties of O2 considered in [16].

Firms engage in corporate social responsibility (CSR) because they consider that some kind of competitive advantage accrues to them. We contend that resource-based perspectives (RBP) are useful to understand why firms engage in CSR activities and disclosure. From a resource-based perspective CSR is seen as providing internal or external benefits, or both. Investments in socially responsible activities may have internal benefits by helping a firm to develop new resources and capabilities which are related namely to know-how and corporate culture. In (...) effect, investing in social responsibility activities and disclosure has important consequences on the creation or depletion of fundamental intangible resources, namely those associated with employees. The external benefits of CSR are related to its effect on corporate reputation. Corporate reputation can be understood as a fundamental intangible resource which can be created or depleted as a consequence of the decisions to engage or not in social responsibility activities and disclosure. Firms with good social responsibility reputation may improve relations with external actors. They may also attract better employees or increase current employees’ motivation, morale, commitment and loyalty to the firm. This article contributes to the understanding of why CSR may be seen as having strategic value for firms and how RBP can be used in such endeavour. (shrink)

The Luck Problem has existed in one form or another since David Hume, at least. It is perhaps as old as Stoic objections to the Epicurean swerve. Although the general issue admits of different formulations with subtly different emphases, the characterization of it that will serve as my target focuses on “cross-worlds” luck, a kind of luck that arises when the decision-making of agents is indeterministic.

In the analysis of Aquinas, instrumental causation is central to his doctrine of providence, yet their connection is not widely understood. On the one hand, early modern thinkers like Nicolas Malebranche claim that any notion of instrumental causation is unintelligible as a mode of divine operation. Alternatively, certain Thomists commit Aquinas to the doctrine of premotion, which partially resolves the problem of instrumental causation, but only at the cost of eliminating the causal freedom of creatures. In this paper I address (...) these two issues. After providing an outline of Aquinas’s position on instrumental causation, I first argue that Thomistic instrumentalism is not the target of Malebranche’s objections, for Malebranche endorses a view very much like that of Aquinas. Secondly, I discuss the doctrine of premotion and offer some reasons for thinking that Aquinas was not a premotionist. (shrink)

El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

Conceptual engineering means to provide a method to assess and improve our concepts working as cognitive devices. But conceptual engineering still lacks an account of what concepts are (as cognitive devices) and of what engineering is (in the case of cognition). And without such prior understanding of its subject matter, or so it is claimed here, conceptual engineering is bound to remain useless, merely operating as a piecemeal approach, with no overall grip on its target domain. The purpose of this (...) programmatic paper is to overcome this knowledge gap by providing some guidelines for developing the theories of concepts and of cognition that will ground the systematic unified framework needed to effectively implement conceptual engineering as a widely applicable method for the cognitive optimization of our conceptual devices. Conceptual engineering is the method for assessing and improving our concepts. However, little has been written about how best to conceive of concepts for the purposes of conceptual engineering. In this paper, I aim to fill this foundational gap, proceeding in three main steps: First, I propose a methodological framework for evaluating the conduciveness of a given concept of concept for conceptual engineering. Then, I develop a typology that contrasts two competing concepts of concept that can be used in conceptual (...) engineering — namely, the philosophical and psychological ones. Finally, I evaluate these two concepts of concept using the proposed methodological framework and I show that, when it comes to making conceptual engineering an actionable method, the psychological concept of concept outclasses its philosophical counterpart on all counts. This provides a baseline from which the concept of concept can be further improved for the purposes of conceptual engineering. (shrink)

There is a traditional view, maintained by Aquinas and others, which holds that there is a mutual entailment between the power to Create Ex Nihilo and the property of omnipotence. In his Metaphysical Disputations, however, Suarez attacks the traditional view by pointing out a seriousflaw in Aquinas’s argument. Suarez claims that there is no reason in principle why God cannot miraculously bestow CEN-power to creatures––albeit in a limitedform––even on the assumption that God cannot make creatures omnipotent. In this paper the (...) authors argue that the debate can be resolved in favor of Aquinas;that CEN-power does indeed strictly imply omnipotence. After clarifying a sufficient condition for the property of omnipotence, the authors argue that attention to amodest possible worlds semantics and some interesting properties of counterfactuals are together sufficient to show that beings with CEN-power are in every case beings that are omnipotent. The ArgumentLevi ben Gerson, also known as Gersonides or Leo de Balneolis, was one of the most original Jewish thinkers of the Middle Ages, and he wrote on logic, philosophy, biblical exegesis, mathematics, and astronomy. During the last years of his life he maintained relations with the papal court of Clement VI (1342–52) at Avignon, and collaborated in the translation into Latin of hisSefer Tekhuna(Book of Astronomy). The object of this paper is to establish the main stages of the redaction (...) of the Hebrew and Latin extant versions of his astronomical work. Although Levi declares that the work was finished in 1328,1 argue that this text was the preliminary draft of the preserved one, most of which was composed after 1338. A thorough revision of the work was undertaken at an indeterminate date before 1344. It is also argued that the final form of the work was probably due to the request of solar and lunar tables made to Levi by “great and noble Christians” around 1332. (shrink)

The bridges of Königsberg case has been widely cited in recent philosophical discussions on scientific explanation as a potential example of a structural explanation of a physical phenomenon. However, when discussing this case, different authors have focused on two different versions, depending on what they take the explanandum to be. In one version, the explanandum is the _failure_ of a given individual in performing an Eulerian walk over the bridge system. In the other version, the explanandum is the _impossibility_ of (...) performing an Eulerian walk over the bridges. The goal of this paper is to show that only the latter version amounts to a real case of a structural explanation. I will also suggest how to fix the first version, and show how my remarks apply to other purported cases of structural explanations. (shrink)

The Enhanced Indispensability Argument appeals to the existence of Mathematical Explanations of Physical Phenomena to justify mathematical Platonism, following the principle of Inference to the Best Explanation. In this paper, I examine one example of a MEPP—the explanation of the 13-year and 17-year life cycle of magicicadas—and argue that this case cannot be used defend the EIA. I then generalize my analysis of the cicada case to other MEPPs, and show that these explanations rely on what I will call ‘optimal (...) representations’, which are representations that capture all that is relevant to explain a physical phenomenon at a specified level of description. In the end, because the role of mathematics in MEPPs is ultimately representational, they cannot be used to support mathematical Platonism. I finish the paper by addressing the claim, advanced by many EIA defendants, that quantification over mathematical objects results in explanations that have more theoretical virtues, especially that they are more general and modally stronger than alternative explanations. I will show that the EIA cannot be successfully defended by appealing to these notions. (shrink)

Noteworthy is that several countries and regions, including China, the European Union, and the United States, have launched investigations into the allegedly anticompetitive and exclusionary business practices of companies such as Amazon, Apple, Facebook, and Google and their Chinese counterparts, Alibaba and Tencent. This paper builds on the renewed interest in the topic and discusses in detail – (...) and from an ordoliberal perspective – the key characteristics of the digital economy, the business conduct of tech platforms, and the corresponding antitrust concerns, as well as possible reform steps which could help to strengthen modern-day competition law and policy (and antitrust enforcement). The main focus of this dissertation is the late medieval doctrine of Concurrentism. Concurrentists hold that God is immediately, causally involved in every event in nature, and yet so are creatures: For any natural effect to obtain, both God and creature must make a genuine causal contribution to the effect. Yet the presence of God's immanent activity in nature is claimed to not overdetermine or render otiose the real and necessary causal input of creatures. I develop and defend this view (...) as follows. First, I explain that---for the theist---any proper account of secondary causation can be given only against the backdrop of God's primary causation, which is best described as God's causal providence. Next, I offer a traditional interpretation of the doctrine of creation ex nihilo, one that sharply distinguishes it in kind from ordinary, natural efficient causality or production. Given this interpretation, I argue that simply in virtue of being committed to creation ex nihilo, the theist is thereby committed to a theory of primary causation that I call The Strong View of Divine Providence . SP entails that God must not only sustain or conserve that which He creates, but also act directly in the operations of His creatures, and in the production of their effects. I then employ SP to evaluate the various theories of secondary causation available. Of the three possible contenders---Mere Conservationism, Occasionalism, and Concurrentism---I argue that only the latter two are compatible with SP. I then provide objections to occasionalism, showing how the doctrine either undermines its commitments to both divine providence and human freedom---so is philosophically and theologically unacceptable---or is better categorized as a version of one of the other two theories. Since mere conservationism is ruled out, simply given the conditions of SP, it follows that the most plausible view for the traditional theist to hold is some version of concurrentism. I then offer a positive analysis of concurrentism by explaining why God must concur with creatures, what God's concurrence amounts to, and then describe a simple model to explain how God concurs with creatures. Understanding what motivates employees is essential to the success of organizational objectives. Therefore, properly capturing and explaining the full range of such motivations are important. However, the classical and most popular theories describing employee motives have neglected, if not omitted entirely, the importance of the ethical and spiritual dimensions of motivation. This has led to a model of a person as self-interested, amoral, and non-spiritual. In this paper, we attempt to expose this omission and offer a more complete taxonomy of (...) motivations which include these dimensions. Although more work will need to be done to fully develop the ethical and spiritual dimensions of motivation, the expanded taxonomy will provide the foundations and serve as a guide for such further research. Furthermore, this new categorization of motivations brings out the full dimensions of being human, which promises to lead to improved management practices with regard to employees and foster greater human flourishing in the workplace.
