In his Autobiography, John Stuart Mill tells us that though his conviction regarding the equality of the sexes was a result of his earliest engagements with political subjects, it remained an abstract idea before his relationship with Harriet Taylor began. Crediting her as the author of “all that was best” in his writings, Mill's praise of his wife has not been well received by many of his readers, and scholars have long questioned her capacities as an intellectual and as a (...) political thinker. I argue that such doubts reflect a narrow standard for adjudicating Taylor Mill's intellectual worth, and what counts as intellectual labor more broadly. Examining Taylor Mill's own writings in fact illuminates and challenges the gendering practices that have sustained scholarly interrogations of Taylor Mill and of her relationship to JS Mill. I make this case first by drawing attention to her “experiential politics” as a credible source of intellectual scholarship, and second by raising questions about the gendered aspects of how intellectual labor has been defined and evaluated in studies of the canon. This article argues that universities have duties to negotiate contracts with the pharmaceutical industry that are favourable to the world’s poor, and to do more research into diseases which disproportionately strike the global poor. It is argued that these duties are related to human rights (in particular to a human right to health) and that they are therefore very weighty. Furthermore, these duties are in line with some of the most important things that Universities Allied for Essential Medicines (UAEM), a (...) worldwide group of students and academics, wants universities to do. A number of objections are discussed, among other things to do with safeguarding pharmaceutical innovation, and it is argued that the aforementioned duties should, as UAEM also advocates, often be combined with efforts on the part of universities to work towards more long-term, large-scale institutional arrangements to ensure access to and availability of essential medicines for the global poor. -/- . Racist jokes are often funny. And part of this has to do with their racism. Many Polish jokes, for example, may easily be converted into moron jokes but are not at all funny when delivered as such. Consider two answers to ‘What has an I.Q. of 1007’: a nation of morons; or Poland. Similarly, jokes portraying Jews as cheap, Italians as cowards, and Greeks as dishonest may be told as jokes about how skinflints, cowards, or dishonest people get on in (...) the world. But they are less funny as such. As this suggests, racist humor is ‘put down’ humor. We laugh, in part, because we find put-downs funny, sometimes even if they are about us. In many contexts, this tendency is relatively harmless; indeed, within reason, it may be therapeutic to join others in a good laugh at oneself. Why, then, all the commotion about racist humor? This paper investigates the moral duties that human rights NGOs, such as Amnesty International, and development NGOs, such as Oxfam, have in relation to human rights – especially in relation to the human right to a decent standard of living. The mentioned NGOs are powerful new agents on the global scene, and according to many they might be duty-bearers in relation to human rights. However, until now their moral duties have hardly been investigated. The present paper investigates NGO duties in (...) relation to human rights by looking in particular to a moral theory recently proposed by Leif Wenar, a theory which has some similarities to utilitarianism. In applying this theory, a case for human-rights duties of NGOs is developed mainly by considering the indispensable role that civil society plays in protecting human rights. The paper concludes that, at least, NGOs bear duties with regard to human rights when, as in certain real-life cases, NGO involvement is the only way to achieve acceptable protection against standard threats to certain goods, such as a decent standard of living. Classifying human beings according to race and ethnicity may seem straightforward to some but it, in fact, belies a difficult process. No standard procedure exists for categorizing according to race and ethnicity, calling into question the variables’ use in research. This article explores the use of race and ethnicity variables in the nursing research literature. Content analysis was conducted of a sample of 337 original research studies published in Nursing Research from the years 1952, 1955, and then every 5 years (...) through to 2000. Of the 337 research articles reviewed, 167 mentioned race, ethnicity, or their 81 code words or phrases. Out of the 167 articles, 153 used race or ethnicity to describe the study sample, and 45 of the 167 articles included race or ethnicity as an element of data analysis. Throughout the sample, there was substantial inconsistency related to race and ethnicity categorization, meanings of the terms, and use of these variables. Specificity related to conceptual assumptions, definitions, and context was missing and, as a result, data interpretation and understanding are suspect. The integrity of nursing knowledge requires that nurse researchers recognize and address the difficulties inherent in using race and ethnicity in health research. (shrink)

This book argues that ultimately human rights can be actualized, in two senses. By answering important challenges to them, the real-world relevance of human rights can be brought out; and people worldwide can be motivated as needed for realizing human rights. Taking a perspective from moral and political philosophy, the book focuses on two challenges to human rights that have until now received little attention, but that need to be addressed if human rights are to remain plausible as a global (...) ideal. Firstly, the challenge of global inequality: how, if at all, can one be sincerely committed to human rights in a structurally greatly unequal world that produces widespread inequalities of human rights protection? Secondly, the challenge of future people: how to adequately include future people in human rights, and how to set adequate priorities between the present and the future, especially in times of climate change? The book also asks whether people worldwide can be motivated to do what it takes to realize human rights. Furthermore, it considers the common and prominent challenges of relativism and of the political abuse of human rights. Wars and crises worldwide force millions of people to flee and seek refuge, often outside their countries of origin. What moral responsibilities do states have towards refugees? In this Ethical Annotation, Dr Jos Philips and his co-authors zoom in on the responsibilities of EU countries. They consider arguments in favour of and against admitting refugees and argue that EU countries must do at least at much as they can do at little cost, and perhaps even more.

It is widely believed that preferential hiring practices inevitably result in hiring less qualified candidates for jobs. Indeed, this follows analytically from some definitions of preferential hiring (e.g. George Sher's). This paper describes several preferential hiring strategies that do not have this consequence. Sher's definition is thus shown to be inadequate and an alternative definition is proposed.

The 2008 UN Convention on the Rights of Persons with Disabilities (CRPD) provides a landmark articulation of the universality of human rights. It affirms in strong terms that all human beings have a claim to full inclusion and equal participation in society, something denied to many because of disability. One very important question about poverty is what rich people like us should do to fight it. In this article, I argue that we can, at little cost to ourselves, give tithes of our money and live within our so-called ‘ecological footprint’. At the end of the article, it is argued that we should, morally, do these things.

Philosophical accounts of punishment are primarily concerned with punishment by the (or: a) state. More specifically, they attempt to explain why the (a) state may justifiably penalize those who are judged to violate its laws and the conditions under which it is entitled to do so. But any full account of these matters must surely be grounded in an account of the nature and purpose of the state and the justification of state authority. Because they are not so grounded, deterrence (...) and retributive theories are incomplete as they are typically formulated. The intuitions behind these theories can be satisfied in a variety of complete theories, i.e., theories that understand the justification of punishment in relation to the justification of state authority. A consequence of this is that at least some of the intuitions underlying deterrence and retributive theories can be satisfied at the same time by a given theory. (shrink)

This paper attempts to explain the significance of the ideologies — or middle-level normative discourse — described by Kenneth Goodpaster in his paper Business Ethics, Ideology, and the Naturalistic Fallacy. It is argued that the propositions constitutive of this discourse are not invokable moral principles (i.e. principles which generate solutions to actual moral problems). Rather, they are characterizations of the normative contexts in which moral decisions are made. As such, they place limits on the ways in which the abstract moral (...) principles of traditional moral theory may be applied or interpreted in making real-life moral decisions. (shrink)

Should conflicts among human rights be dealt with by including general principles for priority setting at some prominent place in the practice of human rights? This essay argues that neither setting prominent and principled priorities nor a case-by-case approach are likely to be defensible as general solutions. The main reasons concern how best to realize all human rights for all. Conflicts among human rights are more defensibly addressed by checking whether the conflict has been correctly diagnosed: Do human rights as (...) a whole get due priority? Have feasibility considerations inherent in human rights been considered, and the possibility of bringing in additional dutybearers? If a conflict among human rights is genuine, formal principles for priority setting are of some help. Sometimes, it is clear that these should be “upgraded” to substantive principles and sometimes that they should not. Many cases, however, are as yet unclear and will need further investigation. I argue that given what is meant by reason (practical reason) in economics, Decision theory and much moral philosophy, It is doubtful that rationality entitles a being to any special status at all. Moreover, And more generally, All historical appeals to reason to ground such claims are covert appeals to some more specific set of human (...) capacities. It is widely supposed that agreements made in response to coercion are entered into involuntarily for that reason. This paper argues that that supposition is false and that it has generated a good deal of avoidable confusion in the courts and among some legal commentators. Agreements entered into involuntarily of course, have no legal standing. But, on any plausible account of coercion, agreements entered into in response to coercion are an inevitability of social life. To prohibit them would be to (...) prohibit many agreements we ought to and do enforce (e.g. labor agreements entered into under threat of strike). This is not to deny that agreements induced by certain uses of force or certain threats of force have and ought to have no standing. But here it is the type of force or threat that invalidates the agreement, not the use of coercion per se. (shrink)

There is an obvious and important difference between bank loans and typical personal loans, viz., that banks charge interest in order to make a profit. Accordingly, what banks do is more accurately described as selling or renting money than as loaning money. Moreover, it is advantageous to banks misleadingly to describe their activity as loaning. For this assimilates their activity to the case of personal loans and helps to create an impression that banks do us a favor by loaning us (...) money and that we owe them gratitude for so doing. This paper critically discusses three studies about the question of how much morality may demand of moral agents. These studies may together constitute the most prominent literature about this question to emerge in recent years. In reverse order, they are: Garrett Cullity’s The Moral Demands of Affluence , Tim Mulgan’s The Demands of Consequentialism , and Liam Murphy’s Moral Demands in Nonideal Theory . The paper’s first part very briefly presents the position that these studies defend, and in addition it (...) is argued that all three studies risk denying, for unconvincing reasons, an intuitively very plausible statement, namely that moral agents morally ought to do great good whenever they can do so at little cost to themselves. The second part of the paper then considers the critical position that the three mentioned books take towards an ‘appeal to cost to the moral agent’. Such an appeal, the details of which will be discussed in the paper, has often been prominent in arguments for limiting the demands made on moral agents. I argue that the doubts that the threestudies have about this appeal, are unwarranted. (shrink)

In "Perversion and the Unnatural as Moral Categories" (Ethics, 90:191-202, January 1980) David Levy argues against a number of theories of perversion by means of the method of counter-example. This is inappropriate since many familiar accounts are not attempts to provide a "one-over-many" formula for a core of clear cases. Rather, like Levy himself, many understand perversions as "unnatural" or "non-human" actions, i.e. as distortions of human nature. Here there is agreement on the intension of the term. Differences in the (...) extension arise in virtue of the relational character of the meaning. For what counts as a distortion of human nature depends on the paradigm of human nature one endorses. In these cases the appropriate way to decide between competing lists of perversions is to evaluate the competing paradigms of human nature on which they rest. It is often held that moral considerations take precedence over considerations of other kinds in determining what we ought to do. I contend that this claim is ambiguous and argue that objections to each interpretation of it can be met only by rejecting the other. One surprising consequence of my argument is that no deontic moral theory can effectively guide action unless it is conjoined with a theory of the good. Another interesting consequence is that the deontologists' favorite objection to (...) teleological theories — the objection from injustice — does not go through. (shrink)

Therefore, the question of what should we do about poverty, which is the central question of this study, readily arises. This book also asks more specific questions such as: How much money should wealthy individuals like us spend on fighting poverty? and, What restrictions should we place (...) on the extent and orientation of our expenditure in the light of poverty? The question of what rich individuals like us should do morally about poverty, first of all requires clarity about some relatively general issues: Must we always do whatever does the most good, or should we only do the most good possible while avoiding great cost to ourselves? Or, do we only need to do our fair share in a cooperative scheme which would eradicate poverty if everyone else also does their share? A large part of this study focuses on such issues. The book argues that if we can do great good at little cost to ourselves, we ought to do so – and perhaps we ought to do great good even if the cost to ourselves of doing so, is not small. Also, it is argued that rich individuals like us can often, at little cost to ourselves, undertake a number of concrete actions which help to fight poverty, and that we are morally obligated to undertake acs such as giving tithes, living within our ecological footprint, and frequently buying fair trade products. Alienation as an aspect of the human condition has a long and storied history. Much of the attention has been focused, however, on alienation among humans themselves. Yet it is increasingly clear that we are in the process of alienating ourselves from the world and all of the creatures and objects in it. This discussion examines the second choral ode from Sophocles’ Antigone and some analyses of the content and formal aspects of Berg’s opera, Wozzeck, in the context of Adorno’s (...) concept of “distinctness without domination,” as means of providing a brief analysis of the problem of alienation considered in this larger sense. Theseconsiderations enable the isolation of several important factors that have inhibited our insight into the seriousness of this form of alienation: First, alienation among humans has effectively distracted us from the increasing urgency of our alienation from the world and the things in it. Second, blinded by our spectacular illusion of “progress,” we continue to pay for it by wreaking destruction upon the planet, the very fount of our existence. Third, morality has only too often been seen as being located in rationalized (hierarchical) relationships among humans rather than as an equally shared, spiritual relationship among the human community,the rest of the biosphere, and the very rocks and water upon which we exist. This final point suggests changes in attitude and behavior that could help us avoid the most devastating effects of this more broadly conceived form of alienation. (shrink)

The Liberalism Trap identifies a methodological problem in contemporary political theory: focus on liberalism has become an interpretive custom directing engagements with politics. Though scholars have long analysed the meaning, merits, successes or failings of liberalism, little attention is paid to how such preoccupations shape the way we study political questions and texts. Evaluating the effects of these preoccupations is what motivate the book. To interrogate those effects, Philips turns to John Stuart Mill-the so-called father of modern liberalism. As (...) she argues, Mill's canonical status as a liberal is habitually substituted for his political arguments such that the now standard association of Mill with liberalism conditions how and why he is read. Offering a comparative reading of Mill's proposals concerning gender, class, and empire, Philips instead recovers a thinker motivated not by ideological certainties, but by a politics of uncertainty. In so doing, she draws into view the complex strategies that Mill employs across his work on domestic and imperial questions, strategies obscured by his liberal mantle. Her recovery of Mill's uncertain politics sets into relief the interpretive costs of reading through liberalism. That even the paradigmatic liberal is unduly constrained by this label ought to give us pause. Taking a break from liberalism, Philips shows that we gain a more nuanced account of Mill's politics, and critical and evaluative distance from our own customs of interpretation. With these interventions, The Liberalism Trap integrates an innovative reading of a canonical thinker with a methodological critique of interpretive practices in contemporary political theory. The increased use of anonymous digital platforms raises substantive concerns about accountability in digital spaces. However, contemporary evaluations of anonymity focus too narrowly on its protective function: its ability to protect a diversity of speakers and ideas. Drawing on two examples of anonymous political engagements – Publius’s writing of the Federalist Papers and college students’ use of the social media platform Yik Yak – we develop an account of anonymity’s associational function: the processes by which people generate and negotiate collective (...) identities, discussions, and actions in wider publics. As we argue, anonymity’s associational function can generate conditions under which individuals develop collective interests and identities to foster collective action, and enable novel interactions between these individuals and communities and the larger publics of which they are part. We conclude with a discussion of how attention to associational anonymity can contribute to a more nuanced account of democracy in practice. (shrink)
