The lysine demethylase KDM5A collaborates with PARP1 and the histone variant macroH2A1.2 to modulate chromatin to promote DNA repair. Indeed, KDM5A engages poly(ADP‐ribose) (PAR) chains at damage sites through a previously uncharacterized coiled‐coil domain, a novel binding mode for PAR interactions. While KDM5A is a well‐known transcriptional regulator, its function in DNA repair is only now emerging. Here we review the molecular mechanisms that regulate this PARP1‐macroH2A1.2‐KDM5A axis in DNA damage and consider the potential involvement of this pathway in transcription (...) regulation and cancer. Using KDM5A as an example, we discuss how multifunctional chromatin proteins transition between several DNA‐based processes, which must be coordinated to protect the integrity of the genome and epigenome. The dysregulation of chromatin and loss of genome integrity that is prevalent in human diseases including cancer may be related and could provide opportunities to target multitasking proteins with these pathways as therapeutic strategies. An introduction to Reformed Epistemology.

This study described parent participation in the informed consent conference for randomized clinical trials (RCTs) in childhood leukemia and documented the relationship of physician communication to parent participation. Parents of 140 children with newly diagnosed leukemia who were eligible for RCTs were studied at six sites using comprehensive methods involving direct observation and transcripts of parent-physician communication based on audiotapes. Parent participation during the informed consent conference reflected a wide range of content categories. Consistent with hypotheses, Physician Rapport and Partnership (...) Building related to parent participation in the informed consent conference but Information Giving did not. Higher parent socioeconomic status also was related to greater parent participation for two of three measures of parent participation. Findings suggest that physician behaviors that provide support and facilitate communication may enhance parental participation in the informed consent conference for RCTs in childhood leukemia. The standard by which we apply decision-making for those unable to do so for themselves is an important practical ethical issue with substantial implications for the treatment and welfare of such individuals. The approach to proxy or surrogate decision-making based upon substituted judgement is often seen as the ideal standard to aim for but suffers from a need to provide a clear account of how to determine the validity of the proxy's judgements. Proponents have responded to this demand by providing (...) the truth-conditions for the substituted judgement in terms of counterfactual reasoning using a possible worlds semantics. In this paper, I show how these underpinnings fail to support the substituted judgement approach as a reasonable standard for decision-making. Firstly, I show how this counterfactual element has been poorly interpreted. I then explain how various accounts have failed to reflect problems and limitations associated with providing an interpretation of their truth-conditions using counterfactuals. Finally, I argue that, even when we attend to the initial problems of providing a counterfactual analysis, it still deeply problematic as a means of determining the validity of substituted judgements for two main reasons. Firstly, making determinate judgements as to the truth-value of these judgements will often not be possible and, secondly, there is a strong requirement when interpreting many counterfactual claims to charitably accede to their being true. I conclude that substituted judgements, as interpreted through counterfactual reasoning and possible worlds semantics, do not therefore provide an adequate standard for surrogate decision-making. This essay seeks to characterise the essential features of an equitable health care system in terms of the classical Aristotelian concepts of horizontal and vertical equity, the common language of “need” and the economic notion of cost-effectiveness as a prelude to identifying some of the more important issues of value that policy-makers will have to decide for themselves; the characteristics of health that can cause policy to be ineffective ; the information base that is required to support a policy directed (...) at securing greater equity, and the kinds of research that are needed to underpin such a policy. The leading idea under this view is that the two frames are simply different surface manifestations of the same underlying structure. In a 2020 article published in volume 9, number 1 of [Filosofia Theoretica]_, _Martin F. Asiegbu and Anthony Chinaemerem Ajah questioned the continued relevance of Afro-communalism. They argued that nothing about communalism makes it African. They also demonstrated how the brand of communalism presented as ‘African’, is too reductive, emphasizes conformism and therefore is against the individual and counter-productive for entire societies in Africa. For the above reasons, they summed that communalism with ‘Afro-’ is irrelevant and needs to end. (...) In a 2021 article published in the same journal in response to the initial submission by Asiegbu and Ajah, Enweh held that their take on Afro-communalism was too harsh. He marshalled out five “issues and difficulties” regarding their critique of the concept. Although Enweh’s critique is a worthwhile invitation to a conversation, which clarifies and complements, his proposal for an interpretative rehabilitation of Afro-communalism in the 21 st century is surely wrongheaded. To respond to Enweh, a review of his critique of Asiegbu and Ajah will foreground the attempt to clarify some parts of Asiegbu and Ajah’s initial position. We will assess Enweh’s arguments in terms of the relevance of the rehabilitation he suggested and question the meaning of what Enweh termed the “amity of ethnic nationalities.” We will argue that Enweh was unable to provide sufficient grounds to show that Asiegbu and Ajah’s critique of Afro-communalism was “uninformed… [and] harsh.” We will also demonstrate that his critique of their views was indefensible just as he was unable to explain what he meant by the alternative model he claimed to introduce in the discussion. J. L. Mackie's famous claim that Locke ‘anticipates’ Kripke's Causal Theory of Reference (CTR) rests, I suggest, upon a pair of important misunderstandings. Contra Mackie, as well as the more recent accounts of Paul Guyer and Michael Ayers, Lockean Real Essences consist of those features of an entity from which all of its experienceable properties can be logically deduced; thus a substantival Real Essence consists of features of a Real Constitution plus logically necessary objective connections between them and features of (...) some particular Nominal Essence. Furthermore, what Locke actually anticipates is the most significant contemporary challenge to the CTR: the qua‐problem. (shrink)

Steinbock provides a complete phenomenology of mysticism based in the Abrahamic religious traditions. He relates a broad range of religious experiences, or verticality, to philosophical problems of evidence, selfhood, and otherness. From this philosophical description of vertical experience, Steinbock develops a social and cultural critique in terms of idolatry—as pride, secularism, and fundamentalism—and suggests that (...) contemporary understandings of human experience must come from a fuller, more open view of religious experience. There is no doubt that the model presented here is incomplete. Many important categories, particularly negation and the adverbials, have been entirely ignored, and the treatment of Tense and the affixes is certainly inadequate. It also remains to be seen how the many constructions that have been ignored here are to be accommodated within the framework that has been outlined. However, the fact that a standard categorial lexicon, plus the four rule schemata, seems to come close to exhaustively specifying the (...) main clause constructions of English, and also seems to explain a number of major constraints on transformations, encourages us to compare the theory with certain alternatives, and to examine its broader implications. Sport often seems to teeter on the edge, on one side of the entertainment industry, on the other of cheating violent aggression: from a make-believe simulacrum of serious play to a nasty chemically enhanced descent into a Hobbesian state of nature. Such perversions lend credibility to reductive views of sport itself as a metonymic feature of capitalism. But that sport as entertainment means fixing it to produce exciting outcomes and amplifying capacities to superhuman proportions, while sport as aggression means treating (...) rules as mere obstacles to brute dominance, shows how far we in fact are from these abysses, even in the days of the Coca Cola/Nike Olympics, Vinny Jones and cricket sledging. In this essay, I try to delineate through history— from Homer to … Gomer?—a common culture of sport and sportsmanship that, with its excesses and perversions, continues to operate as one, albeit complex, ideal of human excellence. Recent legal rulings concerning the status of advance statements have raised interest in the topic but failed to provide any definitive general guidelines for their enforcement. I examine arguments used to justify the moral authority of such statements. The fundamental ethical issue I am concerned with is how accounts of personal identity underpin our account of moral authority through the connection between personal identity and autonomy. I focus on how recent Animalist accounts of personal identity initially appear to provide a (...) sound basis for extending the moral autonomy of an individual - and hence their autonomous wishes expressed through an advance directive - past the point of severe psychological decline. I argue that neither the traditional psychological account nor the more recent Animalist account of personal identity manage to provide a sufficient basis for extending our moral autonomy past the point of incapacity or incompetence. I briefly explore how analogies to similar areas in law designed to facilitate autonomous decision, such as wills and trusts, provide at best only very limited scope for an alternative justification for granting advance statements any legal or moral authority. I conclude that whilst advance statements play a useful role in formulating what treatment is in a patient’s best interests, such statements do not ultimately have sufficient moral force to take precedence over paternalistic best interest judgements concerning an individual’s care or treatment. An ethic of the fitting: a conceptual framework for nursing practiceNurses are expected to act within an ethos of care cognisant of duty, the right, and the good. Concepts of virtue theory, utilitarianism and deontology are used to outline a conceptual ethical framework for nurses in practice. This ‘Moebius’ framework aims to locate the virtues in a symbiotic relationship with the principles of utilitarianism and deontology. Under this framework, fitting ethical responses are sought. Within an ethic of the fitting, rules (...) and principles do not guarantee the most ethically justifiable outcomes. Within the Moebius approach, the nurse ought to respond with a sense of compassion that befits the moment rather than adhere to a rule at all costs. (shrink)

Disvaluing nature—a cognitive act—usually leads quickly to devaluing it too: to real-world exploitation and destruction. Worse, in fact, nature in its devalued state can then be held up as an excuse and justification for the initial disvaluation. In this way, dismissal and destruction perpetuate themselves. I call this process “self-validating reduction.” It is crucial to recognize the cycle of self-validating reduction, both in general and specifically as it applies to nature, if we are to have any chance of reversing it.

The term “Electronic Health Records” means something different to each of the stakeholders in health care, but it always seems to carry a degree of emotional baggage. Increasingly, EHRs are advertized as a nearly unmitigated good that will transform medical care, improve safety and efficiency, allow better patient engagement, and open the door to an era of cheap, effective, timely, and patient-centered care. Indeed, for some EHR proponents the benefits of adopting them are so obvious that adoption has become an (...) end in itself. But for others — and especially for a number of skeptical practitioners and patients — EHR is a code word that portends the corporate transformation of health care delivery, the loss of patient privacy, the demand that patients bear more responsibility in health care, and the unreflective takeover of the health care system by people who do not understand medical care or how health care relationships unfold. Few aspects of social behavior tell us more about a culture than those practices that involve the roles it assigns to models and copies. Under interpretation, such conduct reveals its attitudes toward authority and antiquity, its sense of identity and regard for security, and the relative importance that it attached to imitation and invention. To varying degrees, all societies display these concerns, but in none were they so firmly grounded in a considered theory of the relation between prototype and derivative (...) as they were in Byzantium. An example from the domain of law will illustrate, though not explain, this cultural difference. As against the Roman tradition in which the use of copies as evidence in court was prohibited, at least from the tenth century on Byzantine tribunals accepted the legitimacy of certified copies of documents. The very word used for an official copy—ison, meaning equal— suggests the conceptual distinction between it and the terms copie, Kopie, kopiya, and so on, in modern languages, all derived from the Latin word for abundance. A phenomenological account of the forms of life characteristic of late capitalism--including television, celebrity culture, and personal electronics--culminating in an ontology of the gadget-commodity that brings together Marxist theories of commodity fetishism and ideology with Heidegger's attempt to think truth as unconcealment.

Rejecting the tendency to regard Fichte as merely a transitional figure in the development of German idealism, the following paper argues that, in the years following his dismissal from Jena, Fichte will come to map out a unique and compelling philosophical trajectory. This will be demonstrated, in particular, through a close reading of the Erlanger lectures Institutiones omnis philisophiae of 1805: in these texts, which undertake the pedagogical task of introducing his students to philosophy and indeed achieving a “transformation” of (...) perspective, Fichte makes a fundamental philosophical breakthrough. This becomes possible precisely because his focus on the pedagogical task draws his attention to the most fundamental subjective or even “existential” conditions of philosophical insight, leading him, in turn, to a theorization of the capacity of understanding, by producing contradictions, to open up a space of negativity; a negativity that is itself the essence of human freedom, and through which truth is yielded rather than either discovered or produced. Whereas Hegel and Schelling regard Kant’s residual dualism as a philosophical scandal, Fichte, through this notion of a radical freedom born from the unresolved negativity of the understanding, will seek not to overcome dualism through a higher perspective but to recognize its absolutely binding character. Agamben’s self-professed epigonism underwrites his entire project, serving as an even more fundamental methodological concept than the signature, paradigm, and archeology. In Infancy and History, Agamben maintains that transcendental experience is no longer a viable source of philosophical insight; philosophers go astray referring their thinking back to an authentic yet esoteric experience that, itself unspeakable, grounds positive philosophical assertions. Neither mysterious nor ineffable, the experience founding philosophy is the completely patent, non-latent, experience of language’s pure exteriority. Rather than “deconstructing” metaphysics (...) by exposing its hidden contradictions, philosophy must “deconfabulate,” telling fables about philosophy to undo its enchantments, since it is through the fable that the spell of silence, which itself originates in fable, can be broken. This “epigonal” method, which follows after the tradition rather than seeking a new grounding, is itself justified through Agamben’s account, in The End of the Poem, of the Italian, as opposed to Germanic, physiognomy and of a specifically Italian relation to language going back to Dante. To be Italian is to embrace the “deadness” of one’s own language, rejecting the myth of the resurrection of the original potencies of a dead classical language through a living, modern language. Taking its departure from The Differend’s analysis of Auschwitz as a sign for the evental character of history, I argue that the looming ecological disaster we now face reveals both the continuing relevance and limits of Lyotard’s thought. While the form of political agency of the catastrophe to come involves a differend, this differend cannot be attached to a proper name, however problematic its mode of signification. This, however, suggests the even greater relevance of Lyotard’s treatment, in the conclusion of (...) The Differend, of capitalism in terms of temporal contradiction, as well as his theorization of oikos and ecology in subsequent works, where he distinguishes between the economic and the ecological. This distinction, I conclude, is rendered problematic by the catastrophe to come, as indeed is any attempt to draw an absolute distinction between “philosophical politics” and mere technocratic management or even to exclude speculation from the heart of philosophy. The following paper argues that J.G. Fichte, despite his apparent philosophical neglect of art and aesthetics, does develop a strong, original, and coherent account of art, which not only allows the theorization of modern, non-representative art forms, but indeed anticipates Nietzsche and Heidegger in conceiving of truth in terms of art rather than scientific rationality. While the basis of Fichte’s philosophy of art is presented in the essay “On Spirit and Letter in Philosophy,” it is not developed systematically either in (...) this text or anywhere else in his writings, but must be reconstructed through a broad consideration of all his works, including, above all, his political and economic writings. For Fichte, the art-work does not exist as an object possessing “aesthetic value” and which can, in turn, be possessed, consumed, and enjoyed through the subjective act of aesthetic experience. Rather, it involves a mode of praxis which, grounded in a radical and original power of imagination, creatively discloses possibilities for future forms of existence, experience, and political community that cannot be theoretically anticipated. While Fichte cannot himself theorize specific forms of art, since the art that concerns him belongs to the future, we can, however, retrospectively try to understand non-representational painting and non-mimetic dance as concrete realizations of Fichte’s art-work of the future. In this way, Fichte’s philosophy of art ultimately suggests an alternative to Heidegger’s understanding of the work of art as a projective institution of truth. Fichte suggests that the human body, rather than human language, is the fundamental medium of art. (shrink)

I’m certainly not alone in noting that the year 2011 brings, for those of us who are students of the work of Frantz Fanon, two different anniversaries. This year marks the fiftieth anniversary of the publication of Les damnés de la terre , Fanon’s final book and, for many, his most lasting achievement. But it also marks the fiftieth anniversary of Fanon’s death: he died, tragically young, on December 6, 1961, not long after the book’s publication. It is no exaggeration (...) to say that Les damnés de la terre was composed by Fanon from his deathbed, and that he was well aware that he was racing death as he rushed to complete the manuscript, as his publisher François Maspero remarked, “in pitiful haste.” Fanon had managed to complete it by July, although, as he told a friend, “I should have liked to have written something more.” As David Macey notes in his indispensable biography, “Fanon did see copies of his last book, but for its first readers, Les damnés de la terre was a posthumous work.” The book and Fanon’s death thus come to us bound inextricably together, fifty years later. So it would seem that we have an anniversary to celebrate (and in doing so, we would thus be celebrating the continuing relevance of a classic work, as this special issue intends us to do), but also a death to mourn. If I proceed to make a suggestion that will seem at first to be the height of perversity, let me preface it by saying that this suggestion is occasioned by what I believe to be Fanon’s greatest legacy, a legacy of unsparing intellectual and political commitment. For I want to begin by suggesting that this year brings us the mournful fact that fifty years on, Les damnés de la terre remains, in many ways, as relevant to our contemporary world as it was in 1961; but conversely, the anniversary of Fanon’s death offers us a cause for celebration. . Contemporary nonanthropocentic environmental ethics is profoundly shaped by the very anthropocentrism that it tries to transcend. New values only slowly struggle free of old contexts. Recognizing this struggle, however, opens a space for—indeed, necessitates—alternative models for contemporary environmental ethics. Rather than trying to unify or fine-tune our theories, we require more pluralistic andexploratory methods. We cannot reach theoretical finality; we can only co-evolve an ethic with transformed practices.

We might begin by trying to unsettle the apparently natural inferences that are supposed to lead us so ineluctably to recognize something called “intrinsic value”.

Ideophony is a neglected aspect of investigations of world poetic traditions. This article looks at the use of ideophony in a variety of Navajo poetic genres. Examples are given from Navajo place-names, narratives, and songs. A final example involves the use of ideophony in contemporary written Navajo poetry. Using the work of Woodbury, Friedrich, and Becker it is argued that ideophones are an example of form-dependent expression, poetic indeterminacy, and the inherent exuberances and deficiencies of translation and thus strongly resists (...) translation. This fact becomes more relevant when understood in light of the current language shift from Navajo to English. (shrink)

Parfit’s (1984) Non-Identity Problem provides a strong line of argument that we cannot be harmed by pre-conception choices or actions. I argue that we can no longer appeal to the Non-Identity problem in order to justify using pre-conception genetic screening and selection techniques as a harmless tool to determine the genetic constitution of future individuals. My criticism of the Non-Identity problem is based on a rejection of the metaphysical foundations of Parfit’s argument - Kripke’s (1980) essentialist arguments for the necessity (...) of origin. I offer an alternative account of modal harms based on counterpart theory such as that offered by David Lewis (1986). On this account, individuals can make legitimate harm claims in regard to pre-conception choices made in determining their genetic constitution by appeal to their counterparts across possible worlds. Increasing computational power and improving deep learning methods have made computer vision technologies pervasively common in urban environments. Their applications in policing, traffic management, and documenting public spaces are increasingly common (Ridgeway 2018, Coifman et al. 1998, Sun et al. 2020). Despite the often-discussed biases in the algorithms' training and unequally borne benefits (Khosla et al. 2012), almost all applications similarly reduce urban experiences to simplistic, reductive, and mechanistic measures. There is a lack of context, depth, and specificity in these (...) practices that enables semantic knowledge or analysis within urban contexts, especially within the context of using and occupying urban space. This paper will critique existing uses of artificial intelligence and computer vision in urban practices to propose a new framework for understanding people, action, and public space. This paper revisits Geertz's (1973) use of thick descriptions in generating interpretive theories of culture and activity and uses this lens to establish a framework to approach evaluating the varied uses of computer vision technologies that weigh meaning. By discussing cases of implemented examples of urban computer vision—from LinkNYC and Numina's urban measurements to the Detroit Police's use of DataWorks Plus's facial recognition technology—it proposes a framework for evaluating the thickness of the algorithm's conclusions against the computational method's complexity required to produce that outcome. Further, we discuss how the framework's positioning may differ (and conflict) between different users of the technology, from engineer to urban planner and policymaker, to citizen. This paper also discusses how the current use and training of deep learning algorithms and how this process limits semantic learning and proposes three potential methodologies toward gaining a more contextually specific, urban-semantic, description of urban space relevant to urbanists. This paper contributes to the critical conversations regarding the proliferation of artificial intelligence by challenging the current applications of these technologies in the urban environment by highlighting their failures within this context while also proposing an evolution of these algorithms that may ultimately make them sensitive and useful within this spatial and cultural milieu. This book represents a serious and philosophically sophisticated guide to modern American legal theory, demonstrating that legal positivism has been a misunderstood and underappreciated perspective through most of twentieth-century American legal thought. Anthony Sebok traces the roots of positivism through the first half of the twentieth century, and rejects the view that one must adopt some version of natural law theory in order to recognize moral principles in the law. On the contrary, once one corrects for the mistakes of (...) formalism and postwar legal process, one is left with a theory of legal positivism that takes moral principles seriously while avoiding the pitfalls of natural law. The quantum-mechanical description of the world, including human observers, makes substantial use of entanglement. In order to understand this, we need to adopt concepts of truth, probability and time which are unfamiliar in modern scientific thought. There are two kinds of statements about the world: those made from inside the world, and those from outside. The conflict between contradictory statements which both appear to be true can be resolved by recognising that they are made in different perspectives. Probability, in an (...) objective sense, belongs in the internal perspective, and to statements in the future tense. Such statements obey a many-valued logic, in which the truth values are identified as probabilities. (shrink)
