This paper looks at transgender identities and the law in the context of marriage in common law jurisdictions. It particularly focuses on the nature and sources of authority over word meaning as well as the role of language and definition in classifying transgender individuals into a legal category. When it comes to the legal question of who may marry whom, and what the terms “man” and “woman” actually refer to, there is no statutory definition of the terms “man”, “woman”, “male” (...) and “female”. This has put the onus on judges, especially those who needed to decide whether a transgender person can marry in his/her affirmed sex, to interpret these terms. Two lines of cases in transgender jurisprudence are examined so as to have a close study of how the courts construed these terms and classified transgender people into a category. The first concerns United Kingdom cases, namely Corbett v Corbett, Bellinger v Bellinger and the Hong Kong case W v Registrar of Marriages, &. The second consists of Australian cases such as Secretary, Department of Social Security v State Rail Authority and Re Kevin. This paper discusses these issues by analyzing and comparing different cases in transgender jurisprudence as well as examining how these issues play out in contemporary Hong Kong. (shrink)

African American adolescents have become more active users of digital media, which may increasingly expose them to direct online discrimination based on their racial and gender identities. Despite well-documented impacts of offline discrimination, our understanding of if and how direct online discrimination affects African American adolescents similarly remains limited. Guided by intersectional and ecological frameworks, we examined the association between direct online discrimination and internalized computing stereotypes in African American adolescents. Further, we explored the moderating effects of systemic and individual (...) factors – vicarious online discrimination, parental technological attitudes, and racial identity centrality – on this association by adolescent gender. Utilizing data from 1041 African American parent-adolescent dyads, we found a positive association between adolescents’ direct online discrimination and internalized computing stereotypes. Surprisingly, greater vicarious online discrimination mitigated this association for both male and female adolescents. Further, parental technological attitudes and racial identity centrality mitigated this association only for female but not male adolescents. Our findings highlight the importance of understanding the impact of media on adolescents’ online experiences from intersectional and systemic perspectives. We discuss the implications for prospective research and educational programs focused on African American adolescents’ digital media use and online experiences. (shrink)

Purpose: Short track speed skating is a racing sport with racing tactics are equally crucial to speed and technical skating skills. Therefore, to investigate the relationship between starting and finishing positions for elite skaters and subsequently, explore pacing patterns for champions are necessary.Methods: To investigate a pattern of effective tactical positioning strategy, Kendall’s tau-b correlations between starting and finishing position were calculated, with 500 m races having the most positive correlation.Results: Furthermore, starting position distributions of winners in each round, as (...) well as the fluctuations in champion starting positions across rounds were analyzed. Our findings showed that skaters on the first track were inclined to win the rounds in 500, 1,000, and 1,500 m, and the differences between starting and finishing positions for champions were minimized in semi-finals. Meanwhile, the pacing patterns were gaining more fluctuations by the increase of race distances for champions, as the average standard deviation of lap rankings equaled 0.90, 1.15, and 2.21 for 500, 1,000, and 1,500 m races, respectively.Conclusion: In conclusion, elite skaters should adopt flexible tactics at the lowest cost of energy consumption. The overall variability of lap ranking in long-distance races were distinctly higher than it in short distance. (shrink)

A medical intervention is a medical procedure or application intended to relieve or prevent illness or injury. Examples of medical interventions include vaccination and drug administration. After a medical intervention, adverse events (AEs) may occur which lie outside the intended consequences of the intervention. The representation and analysis of AEs are critical to the improvement of public health. Description: The Ontology of Adverse Events (OAE), previously named Adverse Event Ontology (AEO), is a community-driven ontology developed to standardize and integrate data (...) relating to AEs arising subsequent to medical interventions, as well as to support computer-assisted reasoning. OAE has over 3,000 terms with unique identifiers, including terms imported from existing ontologies and more than 1,800 OAE-specific terms. In OAE, the term ‘adverse event’ denotes a pathological bodily process in a patient that occurs after a medical intervention. Causal adverse events are defined by OAE as those events that are causal consequences of a medical intervention. OAE represents various adverse events based on patient anatomic regions and clinical outcomes, including symptoms, signs, and abnormal processes. OAE has been used in the analysis of several different sorts of vaccine and drug adverse event data. (shrink)

This study examines the mediating role of rumination, state anger, and blame attribution, and the moderating role of trait forgiveness in the relationship between workplace harassment intensity and revenge among employed students at a medium-sized Midwestern U.S. university and full-time employees from various industries in Shanghai, China. We tested the proposed model using techniques described by Hayes. Results within both samples suggested that workplace harassment intensity is positively associated with both major and minor revenge. Results of multiple mediation tests showed (...) that state anger and blame attribution mediated the relationships between workplace harassment intensity and both types of revenge behavior. Furthermore, trait forgiveness moderated the relationship between blame attribution and major revenge. (shrink)

: In a short and much-neglected passage in the second Critique, Kant discusses the threat posed to human freedom by theological determinism. In this paper we present an interpretation of Kant’s conception of and response to this threat. Regarding his conception, we argue that he addresses two versions of the threat: either God causes appearances directly or he does so indirectly by causing things in themselves which in turn cause appearances. Kant’s response to the first version is that God cannot (...) cause appearances directly because they depend essentially on the passive sensibility of finite beings. Kant’s response to the second version is that human beings are endowed with transcendental freedom, which blocks the causal transitivity that is presupposed by this version. Cooperative spreading dynamics on complex networks is a hot topic in the field of network science. In this paper, we propose a strategy to immunize some nodes based on their degrees. The immunized nodes disable the synergistic effect of cooperative spreading dynamics. We also develop a generalized percolation theory to study the final state of the spreading dynamics. By using the Monte Carlo method, numerical simulations reveal that immunizing nodes with a large degree cannot always be beneficial for containing cooperative (...) spreading. For small values of transmission probability, immunizing hubs can suppress the spreading, while the opposite situation happens for large values of transmission probability. Furthermore, numerical simulations show that immunizing hubs increase the cost of the system. Finally, all numerical simulations can be well predicted by the generalized percolation theory. (shrink)

Different countries have different education systems and their advantages and disadvantages. It is necessary to optimize their own higher education system and formulate policy plans to fully realize the optimization of the higher education system. For this reason, we propose to establish a continuous evaluation model of higher education health. This study mainly uses principal component analysis and entropy weight method to determine the evaluation model of higher education health status and makes autoregressive moving average model time series analysis based (...) on the higher education evaluation model, which is obtained by studying long-term trends. The future development of education realizes the evaluation of sustainability. For Vietnam, that needs to be adjusted, the evaluation indicators based on the health status of the higher education system in developing countries will be added, tested, and adjusted and combined with the ARMA model prediction to determine the time period for the policy to meet reasonable expectations, and targeted development policies are proposed. Finally, we test the sensitivity of the established model, evaluate and analyze the advantages and disadvantages of the model, And combine the full text analysis to get the final conclusion. The network-based cooperative information spreading is a widely existing phenomenon in the real world. For instance, the spreading of disease outbreak news and disease prevention information often coexist and interact with each other on the Internet. Promoting the cooperative spreading of information in network-based systems is a subject of great importance in both theoretical and practical perspectives. However, very limited attention has been paid to this specific research area so far. In this study, we propose an effective approach for identifying (...) the influential latent edges which, if added to the original network, can promote the cooperative susceptible-infected-recovered dynamics. To be specific, we first obtain the probabilities of each nodes being in different node states by the message-passing approach. Then, based on the state probabilities of nodes obtained, we come up with an indicator, which incorporates both the information of network topology and the co-SIR dynamics, to measure the influence of each latent edge in promoting the co-SIR dynamics. Thus, the most influential latent edges can be located after ranking all the latent edges according to their quantified influence. We verify the rationality and superiority of the proposed indicator in identifying the influential latent edges of both synthetic and real-world networks by extensive numerical simulations. This study provides an effective approach to identify the influential latent edges for promoting the network-based co-SIR information spreading model and offers inspirations for further research on intervening the cooperative spreading dynamics from the perspective of performing network structural perturbations. The U.S. Supreme Court declared procreation to be a fundamental right in the early twentieth century in a case involving Oklahoma's Habitual Criminal Sterilization Act, an act that permitted unconsented sterilization of individuals convicted of certain crimes. The right that the Court articulated in that case is a negative right: it requires that the government not place unjustified roadblocks in the way of people seeking to procreate, but it does not require the government to take positive steps to help people (...) procreate if they wish to. I argue that a positive legal right is morally necessary in the United States, given the profound significance of procreation, the current barriers to access to care, and the related issues of individual and societal justice. I assume at the outset that the right to procreate should be expansive enough to include a right to noncoital reproduction. The absence of a positive right to procreate reflects not just constitutional tradition but also a governmental and societal commitment to a longstanding set of reproductive hierarchies by which those who fall outside of the traditional framing of family too frequently find their procreative dreams hindered. Reconceiving procreative rights to include a positive right would create greater opportunities to argue and lobby for increased access to technologies that are out of reach for many. (shrink)

Hybrid renewable energy system arises regularly in real life. By optimizing the capacity and running status of the microgrid, HRES can decrease the running cost and improve the efficiency. Such an optimization problem is generally a constrained mixed-integer programming problem, which is usually solved by linear programming method. However, as more and more devices are added into MG, the mathematical model of HRES refers to nonlinear, in which the traditional method is incapable to solve. To address this issue, we first (...) proposed the mathematical model of an HRES. Then, a coevolutionary multiobjective optimization algorithm, termed CMOEA-c, is proposed to handle the nonlinear part and the constraints. By considering the constraints and the objective values simultaneously, CMOEA-c can easily jump out of the local optimal solution and obtain satisfactory results. Experimental results show that, compared to other state-of-the-art methods, the proposed algorithm is competitive in solving HRES problems. (shrink)

In recent years, scholars have come to understand emotions as dynamic and socially constructed—the product of interdependent cultural, relational, situational, and biological influences. While researchers have called for a multilevel theory of emotion construction, any progress toward such a theory must overcome the fragmentation of relevant research across various disciplines and theoretical frameworks. We present affect control theory as a launching point for cross-disciplinary collaboration because of its empirically grounded conceptualization of social mechanisms operating at the interaction, relationship, and cultural (...) levels, and its specification of processes linking social and individual aspects of emotion. After introducing the theory, we illustrate its correspondence with major theories of emotion construction framed at each of four analytical levels: cultural, interactional, individual, and neural. Smith argues that liberalism properly understood can recognize the moral status and social meaning of animals and provides guidance in fashioning animal policy.

We argue that, under certain plausible assumptions, de Sitter space settles into a quiescent vacuum in which there are no dynamical quantum fluctuations. Such fluctuations require either an evolving microstate, or time-dependent histories of out-of-equilibrium recording devices, which we argue are absent in stationary states. For a massive scalar field in a fixed de Sitter background, the cosmic no-hair theorem implies that the state of the patch approaches the vacuum, where there are no fluctuations. We argue that an analogous conclusion (...) holds whenever a patch of de Sitter is embedded in a larger theory with an infinite-dimensional Hilbert space, including semiclassical quantum gravity with false vacua or complementarity in theories with at least one Minkowski vacuum. This reasoning provides an escape from the Boltzmann brain problem in such theories. It also implies that vacuum states do not uptunnel to higher-energy vacua and that perturbations do not decohere while slow-roll inflation occurs, suggesting that eternal inflation is much less common than often supposed. On the other hand, if a de Sitter patch is a closed system with a finite-dimensional Hilbert space, there will be Poincaré recurrences and dynamical Boltzmann fluctuations into lower-entropy states. Our analysis does not alter the conventional understanding of the origin of density fluctuations from primordial inflation, since reheating naturally generates a high-entropy environment and leads to decoherence, nor does it affect the existence of non-dynamical vacuum fluctuations such as those that give rise to the Casimir effect. It has been argued that infants possess a rich, sophisticated theory of mind that is only revealed with tasks based on spontaneous responses. A mature theory of mind implies the understanding that mental states are person-specific. Previous studies on infants’ understanding of motivational mental states such as goals and preferences have revealed that, by 9 months of age, infants do not generalize these motivational mental states across agents. However, it remains to be determined if infants also perceive epistemic states as (...) person-specific. Therefore, the goal of the present study was to use a switch agent paradigm with the classic false belief violation-of-expectation task. Results revealed that 16-month-old infants attributed true and false beliefs to a naïve agent—they did not perceive beliefs as person-specific. These findings indicate that infants’ understanding of beliefs is not as sophisticated as the rich mentalistic view suggests. (shrink)

As resident physicians practicing Internal Medicine in hospitals within the USA, we are confronted on a daily basis with patients who wish to leave the hospital floor to smoke a cigarette. While many physicians argue that hospitals should do everything in their power to prevent patients from smoking, we argue that a more comprehensive and nuanced approach is needed. In part 1 of this perspective piece, we outline the various forms of smoking bans in hospital settings, applauding the development of (...) indoor smoking bans while questioning the move towards stricter, campus-wide smoking bans. In part 2, we turn to traditional biomedical ethics to guide our approach to the hospitalised patient who smokes. This approach, which is informed by our backgrounds in harm reduction and medical anthropology, takes into account the lived realities of patients and acknowledges the complicated sociohistorical contexts of tobacco use. This book rewrites the story of classical Chinese philosophy, which has always been considered the single most creative and vibrant chapter in the history of Chinese philosophy. Works attributed to Confucius, Mozi, Mencius, Laozi, Zhuangzi, Xunzi, Han Feizi and many others represent the very origins of moral and political thinking in China. As testimony to their enduring stature, in recent decades many Chinese intellectuals, and even leading politicians, have turned to those classics, especially Confucian texts, for alternative or complementary sources (...) of moral authority and political legitimacy. Therefore, philosophical inquiries into core normative values embedded in those classical texts are crucial to the ongoing scholarly discussion about China as China turns more culturally inward. It can also contribute to the spirited contemporary debate about the nature of philosophical reasoning, especially in the non-Western traditions. -/- This book offers a new narrative and interpretative framework about the origins of moral-political philosophy that tracks how the three normative values, humaneness, justice, and personal freedom, were formulated, reformulated, and contested by early Chinese philosophers in their effort to negotiate the relationship among three distinct domains, the personal, the familial, and the political. Such efforts took place as those thinkers were reimagining a new moral-political order, debating its guiding norms, and exploring possible sources within the context of an evolving understanding of Heaven and its relationship with the humans. Tao Jiang argues that the competing visions in that debate can be characterized as a contestation between partialist humaneness and impartialist justice as the guiding norm for the newly imagined moral-political order, with the Confucians, the Mohists, the Laoists, and the so-called fajia thinkers being the major participants, constituting the mainstream philosophical project during this period. Thinkers lined up differently along the justice-humaneness spectrum with earlier ones maintaining some continuity between the two normative values (or at least trying to accommodate both to some extent) while later ones leaning more toward their exclusivity in the political/public domain. Zhuangzi and the Zhuangists were the outliers of the mainstream moral-political debate who rejected the very parameter of humaneness versus justice in that discourse. They were a lone voice advocating personal freedom, but the Zhuangist expressions of freedom were self-restricted to the margins of the political world and the interiority of one's heartmind. Such a take can shed new light on how the Zhuangist approach to personal freedom would profoundly impact the development of this idea in pre-modern Chinese political and intellectual history. (shrink)
