The coronavirus disease-2019 (COVID-19) has caused shortages of life-sustaining medical resources, and future waves of the virus may cause further scarcity. The Yale New Haven Health System developed a triage protocol to allocate scarce medical resources during the COVID-19 pandemic, with the primary goal of saving the most lives possible, and a secondary goal of making triage assessments and decisions consistent, transparent, and fair. We outline the process of developing the protocol, summarize the protocol, and discuss the major ethical challenges (...) encountered, along with our answers to the challenges. These challenges include (1) the role of age and chronic comorbidities; (2) evaluating children and pregnant patients; (3) racial, ethnic, and socioeconomic disparities in health; (4) prioritization of healthcare workers; and (5) balancing clinical judgment versus protocolized assessments.We conclude with a review of the limitations of our protocol and the lessons learned. We hope that a robust public discussion of such protocols and the ethical challenges they raise will result in the fairest possible processes, less need for triage, and more lives saved during future waves of the pandemic and similar public health emergencies. The general conceit of Schiller’s aesthetic education is that our experiences with art and beauty set us free from internal and external constraints and allow us to embrace our full humanity as rational and sensuous beings. Experiencing the aesthetic, or the play impulse, puts one in a state of aesthetic determinacy—or rather indeterminacy—that Schiller calls the highest sense of freedom, aesthetic freedom. Gail K. Hart examines Anthony Burgess’s A Clockwork Orange as an example of what Schillerian aesthetic education might look (...) like in practice. Though it represents a distortion of Schiller’s aesthetic education, Hart argues that it also reveals an ineradicable element of coercion in aesthetic education. I argue that Burgess’s Ludovico Technique leaves out a key element of Schiller’s conception of aesthetic cultivation—play—and that Hart’s analysis of Schiller’s work likewise lacks a robust analysis of his notion of play. I argue that, when Schiller’s account of the play impulse is taken seriously as a necessary condition for aesthetic cultivation to take place, coercion is by definition made impossible. Aesthetic play is accomplished by the mutual destruction of physical and moral determinations, and this mutual erasure leads to a higher and more expansive freedom. External constraints and coercion cannot induce the aesthetic state, so aesthetic education as Schiller presents it in On the Aesthetic Education of Man cannot contain the element of coercion Hart suspects. Over several years, genetic studies in the model system, Drosophila melanogastor, have uncovered genes that when mutated, lead to a block in myoblast fusion. Analyses of these gene products have suggested that Arp2/3‐mediated regulation of the actin cytoskeleton is crucial to myoblast fusion in the fly. Recent advances in imaging in Drosophila embryos, both in fixed and live preparations, have led to a new appreciation of both the three‐dimensional organization of the somatic mesoderm and the cell biology underlying myoblast fusion. Using qualitative data based on interviews with 22 married infertile couples living in western New York State, we describe the ways in which husbands and wives interact in the process of constructing their infertility. The wives experienced infertility as a cataclysmic role failure. Husbands tended to see infertility as a disconcerting event but not as a tragedy. Couples tended to see infertility as a problem for wives. Frustration and lack of communication were typical consequences of the confrontation of husbands' and (...) wives' perspectives on infertility. Interactions with medical professionals tended to reinforce these consequences. These interactions between wives, husbands, and medical professionals may lead to taking wrong directions in treatment and to ignoring treatment options. Some of the problems we describe could be lessened by adopting a model of couple-centered treatment in a setting that incorporated routine counseling. (shrink)

Invited media scholars and journalists examine the general issue of nuclear waste, risk and the sicentific promises that were made, but not kept, about safe disposal. The mass media uncovered and reported on nuclear waste problems at Rocky Flats in Colorado and Hanford in Washington. Two environmental journalists review efforts to expose problems at these sites, how secrecy hampered reporting, and the effects of media coverage on nearby residents. An environmental communications scholar evaluates media coverage, the role of the U.S. (...) Department of Energy, and the impact of secrecy on public risk perceptions and attitudes toward government nuclear waste policies. (shrink)

Filmmaking is one of the most complexly layered forms of artistic production. It is a deeply interactive process, socially, culturally, and technologically. Yet the bulk of popular and academic discussion of filmmaking continues to attribute creative authorship of films to directors. Texts refer to “a Scorsese film,” not a film by “Scorsese et al.” We argue that this kind of attribution of sole creative responsibility to film directors is a misapprehension of filmmaking processes, based in part on dubious individualist assumptions (...) about creative minds. Such a misapprehension is effacing the public value that a more inclusive and accurate understanding of filmmaking offers. By “public value” we mean the potential to enhance social and cultural well-being, particularly in working lives and collaborative undertakings in the screen industries. Better understanding of the systemic and social nature of creativity in filmmaking can potentially help in democratising aesthetics, which we consider a clear public good. (shrink)

The position and power of women in the early church has been much explored by scholars such as Karen Jo Torjesen and Virginia Burrus. Research has often indicated that women had little power, especially sacramental power, at this time. This article challenges such a perspective by examining and comparing three accounts of women’s experience of the Eucharist in the private sphere during the third century. Drawing on Gregory of Nyssa’s account of Macrina, his sister, and her making of the (...) eucharistic bread, Pseudo-Athanasius’ instructions to virgins celebrating their own eucharistic meals, and Gregory Nazianzus’ description of his sister, Gorgonia, anointing herself for healing with the Eucharist, this article demonstrates that, in the private setting, sacramental power was not the preserve of the male. The Eucharist, in far more varied forms than might be anticipated, is potent in the domestic setting of these women of the early Church. (shrink)

A striking and unexplained feature of granulomatous inflammation is its anatomical association with the lymphatic system. Accumulating evidence suggests that lymphatic tracks and granulomas may alter the function of each other. The formation of new lymphatics, or lymphangiogenesis, is an adaptive response to tumor formation, infection, and wound healing. Granulomas also may induce lymphangiogenesis which, through a variety of mechanisms, could contribute to disease outcomes in tuberculosis and sarcoidosis. On the other hand, alterations in lymph node function and lymphatic draining (...) may be primary events which attenuate the risk and severity of granulomatous inflammation. This review begins with an introduction of granulomatous inflammation and the lymphatic system. A role of the lymphatic system in tuberculosis and sarcoidosis is then hypothesized. With a focus on lymphangiogenesis in these diseases, and on the potential for this process to promote dissemination, parallels are established with the well‐established role of lymphangiogenesis in tumor biology. Critical legal scholarship has recently turned to consider the form, mode and role of law in neoliberal governance. A central theme guiding much of this literature is the importance of understanding neoliberalism as not only a political or economic phenomenon, but also an inherently juridical one. This article builds on these conceptualisations of neoliberalism in turning to explore the wider historical, cultural and sociological contexts which inform the production of neoliberal authority. The papers in this collection were first presented at (...) the symposium ‘Forms of authority beyond the neoliberal state’, held at the Griffith Law School in December 2017. They consider the role of the corporation, the site of the university, the politics of debt, the genre of prestige television, and the archic sources of state violence, in order to imagine forms of authority which lie beyond neoliberalism as an ideology and a set of practices, and the ensemble of institutions which constitute the neoliberal state. The contributions draw on social theory, philosophy, cultural studies, legal geography and political theology in exploring new possibilities for cultivating judgement through and beyond the sovereign, political and aesthetic terrains of neoliberal governance. Considerable efforts have been made in recent years to improve the safety of human subjects who participate in research. However, there are no data to demonstrate that we have made human research safer. There is a critical need to determine whether we have achieved our goal of better protecting research subjects. We have developed 16 quality indicators for assessing the quality of human research protection programs at the Department of Veterans Affairs. Our experience implementing these quality indicators at the VA (...) may help other institutions to develop appropriate quality indicators for assessing their own human research protection programs. This article explores the role of limit experiences (Tracy) and linguistic relativity (Whorf) in shaping our ontological and epistemological understandings of the world. Specifically, I trace the transformations in embodied understanding I have undergone in three situations across my life course–in Hawai'i, Solomon Islands, and as an acutely ill and disabled patient in a live-in clinic in Dallas, Texas. I give examples of how our perceptions, conceptions, and proprioceptions are positioned, constrained, opened to interpretation, and even denied by our culture (...) and language. Limit experiences, however, open the possibility for transformation of understanding and recognition that there are probably infinite manifest and unmanifest realities. (shrink)

This article takes a birds-eye view of equity in action, showcasing efforts to embed an equity lens in legislated and non-legislated policies and practices in three states. Authors from California, Colorado, and Minnesota provide state-specific examples of how equity has been advanced and operationalized in state-level governance. The article describes progress and lessons learned and offers guidance to others.

These astute essays describe the way ordinary people value human relationships and reason through the commonplace contradictions of their local way of life in a global age, rather than measure the actions of their subjects as evidence of either universal rationality or shared cultural beliefs. Each contributor conveys the ways in which people challenge the ascribed moral standards of custom, religious belief, bureaucratic policies through passionate words such as anecdotes, joke, rumors, and gossip. Religious freedom is one of the most debated and controversial human rights in contemporary public discourse. At once a universally held human right and a flash point in the political sphere, religious freedom has resisted scholarly efforts to define its parameters. Taliaferro explores a different way of examining the tensions between the aims of religion and the needs of political communities, arguing that religious freedom is a uniquely difficult human right to uphold because it rests on two competing conceptions, human (...) and divine. Drawing on classical natural law, Taliaferro expounds a new, practical theory of religious freedom for the modern world. By examining conceptions of law such as Sophocles' Antigone, Maimonides' Guide of the Perplexed, Ibn Rushd's Middle Commentary on Aristotle's Rhetoric, and Tertullian's writings, The Possibility of Religious Freedom explains how expanding our notion of law to incorporate such theories can mediate conflicts of human and divine law and provide a solid foundation for religious liberty in modernity's pluralism. I probably also share with most clinicians the willingness, sometimes even without a specific invitation, to share with others what is on my mind.

El texto presenta resultados del proyecto de investigación de la exploración del medio al espíritu investigativo en perspectiva de filosofía e infancia (FeI). Esta indagación hace parte de las preocupaciones teóricas y metodológicas que los grupos de investigación Aión: tiempo de la infancia y Gifse de la Uptc vienen desarrollando e implementado en instituciones de educación básica y media, especialmente en zonas rurales. Este artículo centra su atención en las siguientes preguntas: ¿qué significa investigar en perspectiva de filosofía e infancia?, (...) ¿existen rasgos particulares de los sujetos —maestros investigadores— involucrados a los proyectos?, si es así, ¿cuáles se destacarían?, ¿cuál es el lugar de la pregunta en los procesos de investigación?, ¿de qué manera incide el contexto?, ¿qué hay de investigación en el movimiento creativo que transforma la realidad educativa?, ¿qué es lo creativo en investigación?, ¿qué compromisos éticos y políticos se piensan en el vínculo investigación-comunidad? el procedimiento metodológico tiene sus raíces en perspectivas que reconocen las voces de los actores. Se realiza un trabajo documental que involucra ponencias, artículos, tesis de maestría y doctorado; también se efectúan entrevistas no estructuradas a profesores investigadores universitarios y de escuelas públicas que hacen parte de la red filosofía e infancia de Boyacá. Assessing national levels of happiness has become an important research and policy issue in recent years. We examined happiness and satisfaction in Ireland using phone text messaging to collect large-scale longitudinal data from 3,093 members of the general Irish population. For six consecutive weeks participants’ happiness and satisfaction levels were assessed. For four consecutive weeks (weeks 2 to 5) a different random third of the sample got feedback on the previous week's mean happiness and satisfaction ratings. Text messaging proved a (...) feasible means of assessing happiness and satisfaction, with almost three quarters (73%) of participants completing all assessments. Those who received feedback on the previous week’s mean ratings were eight times more likely to complete the subsequent assessments than those not receiving feedback. Providing such feedback data on mean levels of happiness and satisfaction did not systematically bias subsequent ratings either towards or away from these normative anchors. Texting is a simple and effective means to collect population level happiness and satisfaction data. (shrink)

Michael Frede has provided a substantial introduction that illuminates the dialogue's perennial interest, its Athenian political background, and the particular difficulties and ironic nuances of its argument.

Publishing scientific articles is a crucial activity performed by a scientist to demonstrate inclusion as part of the community of scientists: a community constituted by journal editors, reviewers, authors and readers. A manuscript submitted to journals is first read by reviewers, and their decision to accept it creates membership in the community for the author with its attendant privileges of ingroup status. Rejection bars such membership. In this article we examine the language used by this powerful individual — the journal (...) reviewer — to recognize another individual — the author — as being a member or not. Five reviewer reports of two different manuscripts submitted by non-native English-speaking authors are analyzed in this case study. Complementary discourse analytical approaches are used: group ideology, syntactic structure and personal pronouns. The analysis of the linguistic strategies used reveals three distinct positions that the reviewers adopt within this under-researched genre. (shrink)

Education empowers readers to diagnose diversity flashpoint situations and positively address them without creating defensiveness and barriers to dialogue. The authors include an overview of the changing ethnic, racial, and gender composition of students in higher education in the United States and the major trends in campus responses to the changing student population. They offer an approach to creating higher education environments that welcome people of all cultural characteristics and promote civility on campus. The book is founded on the authors' research on diversity flashpoints in higher education for which they interviewed a national sample of student affairs professionals. The authors identified uncomfortable interpersonal situations with faculty members in which the discomfort arose from student identity difference. This process led to the formulation of strategies for using vignettes in professional development sessions. (shrink)

The practice of sending and receiving sexually explicit images via mobile phones has grown exponentially in recent years with the accessibility of cellular technology. This essay examines this practice, when conducted by teenagers, in light of a Christian feminist approach to justice. Without harmfully exhorting girls' sexual "purity", we must nevertheless develop a moral framework that challenges the practice of sexting while simultaneously empowering young women to claim primary control over their own sexual experience. For Christians, justice, addressed to sexting, (...) must attend to sexual injustice even as it promotes genuine freedom, embodiment, mutuality and relational intimacy, and equality. (shrink)

The authors examine the “second shift” in the former socialist Yugoslavia through the analysis of 1989-90 data from a random sample of 7,790 adults in the paid labor force. Despite working outside the home, women are primarily responsible for housework. Neither education, occupation, urbanization, nor participation in the informal economy has a significant effect in reducing this; only the presence of an older female in the household measurably reduces an employed woman's participation in the second shift. Not only are men's (...) attitudes important for women's performance of the second shift but also men's ability to act in terms of this value displays the significance of a gendered social structure in socialist societies. Considering that culture is the product of creative and human processes, it is believed that intellectual property is a legal tool that allows for its protection given that it helps conserve, safeguard and preserve its tangible and/or intangible assets. In the case of digital heritage, which is made up of digital elements that should be preserved due to their cultural value, some challenges have arisen regarding their legal protection. One of these challenges is the lack of clarity about how the (...) elements that comprise it should be protected, giving rise to doubts about how intellectual property should help solve this conflict. This article presents the discussion regarding the protection of digital heritage in Colombia, how copyright is becoming an instrument that contributes to its legal protection, and the challenges to further develop it in the country. Scholars of hermeneutics have recently taken up the task of elucidating Gadamer’s ethics by studying his work on the structure of understanding and human experience. This article seeks to contribute to that scholarship through an examination of Gadamer’s aesthetics. I suggest that Gadamer’s notions of play and aesthetic non-differentiation provide further resources for understanding Gadamer’s hermeneutic ethics as an ethics of non-differentiation, i.e., a unification of theory and practice (understanding and application). For Gadamer, an understanding of the good is its (...) enactment in the context of the dialogical play we find ourselves engaged in with others. Furthermore, Gadamer’s identification of aesthetic non-differentiation with play reveals that his ethics aims not only to unify theory and practice but also to unite participants in the ethical play as intersubjective elements of a shared experience. Retrieving the ethical import of Gadamer’s aesthetics also helps to unfold Gadamer’s suggestion that hermeneutics itself is an ethical enterprise. (shrink)
