Este estudio analiza el artículo 146 del Código Orgánico Integral Penal (COIP) de Ecuador, esta trata sobre el homicidio culposo por práctica profesional equivocada. La mala praxis médica es un problema grave en el sistema de salud de Ecuador, y la interpretación inadecuada de este artículo ha generado confusión en los procesos legales relacionados. El objeto de la investigación es analizar la normativa del artículo 146 del COIP y las lagunas de interpretación jurídica para determinar la culpabilidad o inocencia de (...) los profesionales de la salud. Para ello, se emplearán métodos comparativos e históricos, que incluyen revisión bibliográfica, análisis de contenido del artículo 146. Los resultados esperados son demostrar las dudas razonables en la prueba del delito de mala praxis, resaltar la importancia de la bioética en los procedimientos legales. Este estudio busca contribuir a una mejor comprensión del marco legal y brindar ideas para la resolución de casos de mala praxis y homicidio culposo en Ecuador. (shrink)

A Brief History of the Philosophy of Time is a concise and accessible survey of the history of philosophical and scientific developments in understanding time and our experience of time. Corporate, Social, Ethical and Environmental Reporting should ideally discharge the accountability of an organisation to its stakeholders. Voluntary reporting has been characterised by a dearth of neutral and objective information such that the advocates of SEER recommend that it be made compulsory. Their underlying rationale is that legally specified disclosure requirements and enforcement mechanisms will enhance the quality of such reporting. This paper sets out to explore how realistic this scenario actually is, in view of the conflicting interpretations in the (...) literature on this subject. To that end, a survey of the reporting patterns of 78 of the largest Spanish companies between 2001 and 2003 examines the extent of their compliance with the ICAC-2002 standard, which obliged them to make environmental disclosures in their financial statements. The results suggest that progressive and improved regulation could increase the volume and quality of SEER disclosures. They also suggest, however, that persistent non-compliance means that the problems associated with voluntary disclosure still exist. Finally, through an impression management perspective, the study reveals, the diverse strategies, ranging from dismissal to concealment, that are employed by companies to avoid transparency. As regulation improves and enforcement expectations rise, it becomes more difficult to dismiss compulsory reporting norms. As a result, some firms engage in more complex concealment strategies to attain corporate legitimacy, depriving stakeholders of regulatory information. The latter point serves to reconcile apparently contradictory explanations in the literature as to whether legitimacy theory might explain partial compliance with SEER regulation. (shrink)

Thus the first part of the Critique of Pure Reason, entitled the Transcendental Aesthetic, enumerates the necessary presuppositions of, among other things, our ability to make empirical judgments about particular (...) works of art. These presuppositions are sensible rather than intellectual because on Kant’s view, all intellection that considers objects of any kind, whether abstract or concrete, must at base connect to actual, material objects with which we come into direct contact; and this we can do only through sensibility (A 19/B 33). Thus the following discussion explores what Kant claims must be true of us in order to make the sorts of aesthetic judgments we make, rather than any particular class or quality of aesthetic judgments itself. On Kant’s view, what must be true of us in order to make aesthetic judgments is not different from what must be true of us in order to make any other kind of judgment about empirical objects. Inspired by the writings of J. M. Hinton (1967a, 1967b, 1973), but ushered into the mainstream by Paul Snowdon (1980–1, 1990–1), John McDowell (1982, 1986), and M. G. F. Martin (2002, 2004, 2006), disjunctivism is currently discussed, advocated, and opposed in the philosophy of perception, the theory of knowledge, the theory of practical reason, and the philosophy of action. But what is disjunctivism?

Research has found that both cisgender and transgender androphilic males (i.e., males sexually attracted to and aroused by other adult males) have female-typical occupational preferences when compared with gynephilic males (i.e., males sexually attracted to and aroused by adult females). Moreover, whereas cisgender androphilic males’ occupational preferences tend to be intermediate between those of gynephilic men and androphilic women, transgender androphilic males tend to have occupational preferences that are more similar to androphilic women. No study has directly compared both types (...) of androphilic males within the same culture. The present study investigated occupational preference and its relation to childhood sex-atypical behavior (CSAB), among gynephilic men (_n_ = 208), androphilic women (_n_ = 138), and cisgender (_n_ = 132) and transgender (_n_ = 129) androphilic males from the Istmo region of Oaxaca, Mexico, where androphilic males are recognized as third gender, _muxes_. The study found large sex differences in occupational preferences (_d_ = 2.80). Furthermore, both cisgender _muxe nguiiu_ (_d_ = 2.36) and transgender _muxe gunaa_ (_d_ = 3.44) reported having more sex-atypical occupational preferences compared with men. However, _muxe gunaa_ reported higher female-typical occupational preferences than women (_d_ = 0.59) and _muxe nguiiu_ (_d_ = 0.57), whereas _muxe nguiiu_ and women did not differ (_d_ = 0.08). These findings are consistent with the conclusion that sex-atypical occupational preferences are a cross-culturally universal aspect of male androphilia. Finally, CSAB was associated with sex-atypical occupational preferences among all participants. These findings suggest that a developmental continuity exists between childhood and adulthood sex-atypicality. (shrink)

There remains no consensus among social scientists as to how to measure and understand forms of information deprivation such as misinformation. Machine learning and statistical analyses of information deprivation typically contain problematic operationalizations which are too often biased towards epistemic elites' conceptions that can undermine their empirical adequacy. A mature science of information deprivation should include considerable citizen involvement that is sensitive to the value-ladenness of information quality and that doing so may improve the predictive and explanatory power of extant (...) models. I critically discuss two claims which Hannah Ginsborg makes on behalf of her account of meaning in terms of ‘primitive normativity’: first, that it avoids the sceptical regress articulated by Kripke's Wittgenstein; second, that it makes sense of the thought—central to Kripke's Wittgenstein—that ‘meaning is normative’, in a way which shows this thought not only to be immune from recent criticisms but also to undermine reductively naturalistic theories of content. In the course of the discussion, I consider and attempt to (...) shed light on a number of issues: the structure of the sceptical regress; the content of the thought that ‘meaning is normative’, and its force against reductive theories; the connection between meaning and justification; and the notion of ‘primitive normativity’. Mental body-representations are highly plastic and can be modified after brief exposure to unexpected sensory feedback. While the role of vision, touch and proprioception in shaping body-representations has been highlighted by many studies, the auditory influences on mental body-representations remain poorly understood. Changes in body-representations by the manipulation of natural sounds produced when one's body impacts on surfaces have recently been evidenced. But will these changes also occur with non-naturalistic sounds, which provide no information about the impact produced by or (...) on the body? Drawing on the well-documented capacity of dynamic changes in pitch to elicit impressions of motion along the vertical plane and of changes in object size, we asked participants to pull on their right index fingertip with their left hand while they were presented with brief sounds of rising, falling or constant pitches, and in the absence of visual information of their hands. Results show an "auditory Pinocchio" effect, with participants feeling and estimating their finger to be longer after the rising pitch condition. These results provide the first evidence that sounds that are not indicative of veridical movement, such as non-naturalistic sounds, can induce a Pinocchio-like change in body-representation when arbitrarily paired with a bodily action. This chapter offers an indirect defence of the Evansian conception of egocentric space, by showing how it resolves a puzzle concerning the unity of egocentric spatial perception. The chapter outlines several common assumptions about egocentric perspectival structure and argues that a subject’s experience, both within and across her sensory modalities, may involve multiple structures of this kind. This raises the question of how perspectival unity is achieved, such that these perspectival structures form a complex whole, rather than merely disunified set (...) of individually, distinctively structured experiences. The shortcomings of variety of accounts are considered: switch accounts ; sensory accounts; transformation accounts; and ultimate accounts. These shortcomings are addressed by a further kind of account provided by the Evansian conception – an agentive account – according to which egocentrically structured experiences present the world in relation to parts of a single thing, the body as a dynamic unity. Does the existence of body representations undermine the explanatory role of the body? Or do certain types of representation depend so closely upon the body that their involvement in a cognitive task implicates the body itself? In the introduction of this special issue we explore lines of tension and complement that might hold between the notions of embodiment and body representations, which remain too often neglected or obscure. To do so, we distinguish two conceptions of embodiment that either put weight (...) on the explanatory role of the body itself or body representations. We further analyse how and to what extent body representations can be said to be embodied. Finally, we give an overview of the full volume articulated around foundational issues (How should we define the notion of embodiment? To what extent and in what sense is embodiment compatible with representationalism? Mathematics, as Eugene Wigner noted, is unreasonably effective in physics. The argument of this paper is that the disproportionate attention that philosophers have paid to discrete structures such as the natural numbers, for which a nominalist construction may be possible, has deprived us of the best argument for Platonism, which lies in continuous structures—in fields and their derived algebras, such as Clifford algebras. The argument that Wigner was making is best made with respect to such structures—in a loose sense, with (...) respect to geometry rather than arithmetic. The purpose of the present paper is to make this connection between mathematical realism and geometrical entities. It thus constitutes an argument against formalism, for which mathematics is merely a game with humanly set rules; and nominalism, in which whatever mathematics is used is eliminable in the final analysis, by often insufficiently specified means. The hope is that light may be cast on the stubborn mysteries of the nature of quantum mechanics and its mathematical formulation, with particular reference to spinor representations—as they have been developed by Andrej Trautman. Thus, according to our argument, quantum mechanics (QM) may appear more natural, as we have better reasons to take spinor structures as irreducibly real, a view consonant with the work of Trautman and Penrose in particular. The purpose of this paper aims to unravel the ideological strategy that rises from the well-celebrated epistemic rigor of neoclassical economic thought. From the Economics Nobel Price Paul Krugman’s popularized connotation naming to "freshwater" economists as those fervent followers of the most orthodox academic creed, we will expose the logical inconsistency and empirical implausibility of such thought’s underlying assumptions: perfect competence and equilibrium’s approaching. From a critical analysis that will be conducted from each of those mentioned assumptions, we will argued (...) that the neoclassical thought is an ideological strategy subverting reality’s principles, overcoming "artificially" those relevant deficiencies and limitations of its theoretical approach. A lo largo de este trabajo se intenta desvelar la estrategia ideológica que emana del celebrado rigorismo epistémico del pensamiento neoclásico de economía. Desde la connotación popularizada por el Nobel Paul Krugman a los economistas de "agua dulce" como aquellos fervientes seguidores del credo académico más ortodoxo, expondremos la incoherencia lógica e imposibilidad empírica de los supuestos fundamentales de su pensamiento: competencia perfecta y aproximación al equilibrio. Desde un examen crítico que irá conduciéndose por cada uno de tales supuestos, resolveremos cómo el marco neoclásico no es más que una estrategia ideológica que subvirtiendo los principios de lo real consigue superar solo "artificialmente" las importantes deficiencias y limitaciones de su marco teórico. Ezequiel Rojas is recognized as one of the most important Colombian utilitarian thinkers of the nineteenth century. His writings, however, have been ignored or underestimated by philosophy historians in Colombia who read them from the perspective of European history of philosophy, class struggles or partisan issues —a reading which ignores the manner of local writings. The present text offers instead a reflection on the notion of “science” in Rojas’ philosophical works emphasizing the practice of localized “exercise of writing”, and thus (...) provides a comprehensive view of his works as part of Colombian history of philosophy. We deal with situations incongruent with our automatic response tendencies much better right after having done so on a previous trial than after having reacted to a congruent trial. The nature of the mechanisms responsible for these sequential congruency effects is currently a hot topic of debate. According to the conflict monitoring model these effects depend on the adjustment of control triggered by the detection of conflict on the preceding situation. We tested whether these conflict monitoring processes can operate implicitly (...) in an implicit learning procedure, modulating the expression of knowledge of which participants are not aware. We reanalyze recently published data, and present an experiment with a probabilistic sequence learning procedure, both showing consistent effects of implicit sequence learning. Despite being implicit, the expression of learning was reduced or completely eliminated right after trials incongruent with the learned sequence, thus showing that sequential congruency effects can be obtained even when the source of congruency itself remains implicit. We argue that artificial networks are explainable and offer a novel theory of interpretability. Two sets of conceptual questions are prominent in theoretical engagements with artificial neural networks, especially in the context of medical artificial intelligence: Are networks explainable, and if so, what does it mean to explain the output of a network? And what does it mean for a network to be interpretable? We argue that accounts of “explanation” tailored specifically to neural networks have ineffectively reinvented the wheel. In (...) response to, we show how four familiar accounts of explanation apply to neural networks as they would to any scientific phenomenon. We diagnose the confusion about explaining neural networks within the machine learning literature as an equivocation on “explainability,” “understandability” and “interpretability.” To remedy this, we distinguish between these notions, and answer by offering a theory and typology of interpretation in machine learning. Interpretation is something one does to an explanation with the aim of producing another, more understandable, explanation. As with explanation, there are various concepts and methods involved in interpretation: Total or Partial, Global or Local, and Approximative or Isomorphic. Our account of “interpretability” is consistent with uses in the machine learning literature, in keeping with the philosophy of explanation and understanding, and pays special attention to medical artificial intelligence systems. There is a long history and growing evidence base that the use of drugs, such as anabolic-androgenic steroids, to enhance human performance is common amongst armed forces, including in Australia. We should not be surprised that this might have occurred for it has long been predicted by observers. It is a commonplace of many recent discussion of the future of warfare and future military technology to proclaim the imminent arrival of Super Soldiers, whose capacities are modified via drugs, digital technology (...) and genetic engineering, in ways that increase their performance exponentially. This is what some observers have referred to as the “Gladiator Model” wherein the aim is to create soldiers able to perform feats of which ordinary citizens are not capable. One key aspect of this “gladiator project” is the use of illicit drugs to enhance performance. Could we use drugs, such as steroids or amphetamines, to enhance performance? Should we use such drugs? In this paper we explore the ethics of creating Super Soldiers, and raise issues of consent, coercion and the extent to which such use is permitted or condemned by just war theory. We conclude that much will depend on the extent to which such use is harmful to the soldiers themselves and this is still an open question. (shrink)

Francis Ysidro Edgeworth’s unduly neglected monograph New and Old Methods of Ethics (1877) advances a highly sophisticated and mathematized account of social well-being in the utilitarian tradition of his 19th-century contemporaries. This article illustrates how his usage of the ‘calculus of variations’ was combined with findings from empirical psychology and economic theory to construct a consequentialist axiological framework. A conclusion is drawn that Edgeworth is a methodological predecessor to several important methods, ideas, and issues that continue to be discussed in (...) contemporary social well-being studies. A growing body of empirical evidence suggests that folk knowledge attribution practices regarding some epistemological thought experiments differ significantly from the consensus found in the philosophical literature. More specifically, laypersons are likely to ascribe knowledge in the so-called Authentic Evidence Gettier-style cases, while most philosophers deny knowledge in these cases. The intuitions shared by philosophers are often used as evidence in favor (or against) certain philosophical analyses of the notion of knowledge. However, the fact that these intuitions are not universal, (...) as non-philosophers do not sympathize with verdicts made by philosophers, is problematic and requires some explanation. Recently, a promising theoretical approach emerged that could be used to explain away unexpected folk knowledge attributions. According to the protagonist projection hypothesis, when subjects answer questions about some hypothetical scenario, their judgments might result from adopting the cognitive perspective of the protagonist in the given scenario. Previous experimental findings suggest protagonist projection might be responsible for problematic knowledge attributions in Gettier-style cases. This paper reports data collected in an experiment which focused on five different Authentic Evidence Gettier-style scenarios and investigated the impact of protagonist projection on folk knowledge ascriptions in such cases. The results bring some support to the protagonist projection hypothesis, but do not allow to explain away a substantial number of problematic folk knowledge attributions. (shrink)

Can we be realists about a general category but pluralists about concepts relating to that category? I argue that paleobiological methods of delineating species are not affected by differing species concepts, and that this underwrites an argument that species concept pluralists should be species category realists. First, the criteria by which paleobiologists delineate species are ‘indifferent’ to the species category. That is, their method for identifying species applies equally to any species concept. To identify a new species, paleobiologists show that (...) interspecies processes, such as phenotypic plasticity, sexual dimorphism, or ontogenetic diversity, are a worse explanation of the variance between specimens than intraspecies processes. As opposed to operating under a single or plurality of species concepts, then, paleobiologists use abductive inferences, which would be required regardless of any particular species concept. Second, paleobiologists are frequently interested in large-scale, long-term morphological patterns in the fossil record, and resolving the fine-grained differences which result from different species concepts is irrelevant at those scales. I argue that this claim about paleobiological practice supports what I call ‘indifference realism’ about the species category. The indifference realist argues that when legitimate investigation is indifferent to a plurality of concepts, we should be realists about the category those concepts pertain to. (shrink)

Although logical consistency is desirable in scientific research, standard statistical hypothesis tests are typically logically inconsistent. To address this issue, previous work introduced agnostic hypothesis tests and proved that they can be logically consistent while retaining statistical optimality properties. This article characterizes the credal modalities in agnostic hypothesis tests and uses the hexagon of oppositions to explain the logical relations between these modalities. Geometric solids that are composed of hexagons of oppositions illustrate the conditions for these modalities to be logically (...) consistent. Prisms composed of hexagons of oppositions show how the credal modalities obtained from two agnostic tests vary according to their threshold values. Nested hexagons of oppositions summarize logical relations between the credal modalities in these tests and prove new relations. (shrink)

Moore] There are criteria of ineffability whereby, even if the concept of ineffability can never serve to modify truth, it can sometimes serve to modify other things, specifically understanding. This allows for a reappraisal of the dispute between those who adopt a traditional reading of Wittgenstein's Tractatus and those who adopt the new reading recently championed by Diamond, Conant, and others. By maintaining that what the nonsense in the Tractatus is supposed to convey is ineffable understanding, rather than (...) ineffable truth, we can do considerable justice to each of these readings. Much recent cognitive neuroscientific work on body knowledge is representationalist: “body schema” and “body images”, for example, are cerebral representations of the body (de Vignemont 2009). A framework assumption is that representation of the body plays an important role in cognition. The question is whether this representationalist assumption is compatible with the variety of broadly situated or embodied approaches recently popular in the cognitive neurosciences: approaches in which cognition is taken to have a ‘direct’ relation to the body and to (...) the environment. A “direct” relation is one where the boundaries between the body and the head, or between the environment and the animal are not theoretically important in the understanding of cognition. These boundaries do not play a theoretically privileged role in cognitive explanations of behavior. But representationalism appears to put a representational veil between the locus of cognition and that which is represented, making cognitive relations to the body and to the environment be indirect, with a high associated computational load. For this reason, direct approaches have tried to minimize the use of internal representations (Suchman 1987; Barwise 1987; Agre and Chapman 1987; Brooks 1992; Thelen and Smith 1994; van Gelder 1995; Port and van Gelder 1995; Clark 1997, 1999; Rupert 2009, p. 180). Does a cognitive neuroscience committed to direct relations rule out a representationalist approach to body knowledge? Or is direct representationalism possible? (shrink)

In their widely cited article, Swain et al. report data that, purportedly, demonstrates instability of folk epistemic intuitions regarding the famous Truetemp case authored by Keith Lehrer. What they found is a typical example of priming, where presenting one stimulus before presenting another stimulus affects the way the latter is perceived or evaluated. In their experiment, laypersons were less likely to attribute knowledge in the Truetemp case when they first read a scenario describing a clear case of knowledge, and more (...) likely to ascribe knowledge when they first read a vignette describing a clear case of nonknowledge. We tried to replicate Swain et al. findings in three experiments: one devised in Polish, and the other two conducted in English. We found no priming effect for knowledge ratings regarding the Truetemp case – laypersons were similarly likely to attribute knowledge in all three investigated conditions. These three failed replication attempts are not decisive as to whether the priming effect in question occurs, nevertheless, the collected data puts Swain et al. conclusions about instability of epistemic intuitions in jeopardy. This article explores the metaphor of Science as provider of sharp images of our environment, using the epistemological framework of Objective Cognitive Constructivism. These sharp images are conveyed by precise scientific hypotheses that, in turn, are encoded by mathematical equations. Furthermore, this article describes how such knowledge is pro-duced by a cyclic and recursive development, perfection and reinforcement process, leading to the emergence of eigen-solutions characterized by the four essential properties of precision, stability, separability and composability. Finally, this article discusses (...) the role played by ontology and metaphysics in the scientific production process, and in which sense the resulting knowledge can be considered objective. (shrink)
