One of the most influential ideas in the field of business ethics has been the suggestion that ethical conduct in a business context should be analyzed in terms of a set of fiduciary obligations toward various “stakeholder” groups. Moral problems, according to this view, involve reconciling such obligations in cases where stakeholder groups have conflicting interests. The question posed in this paper is whether the stakeholder paradigm represents the most fruitful way of articulating the moral problems that arise in business. (...) By way of contrast, I outline two other possible approaches to business ethics: one, a more minimal conception, anchored in the notion of a fiduciary obligation toward shareholders; and the other, a broader conception, focused on the concept of market failure. I then argue that the latter offers a more satisfactory framework for the articulation of the social responsibilities of business. (shrink)

In the economic literature on the firm, especially in the transaction-cost tradition, a sharp distinction is drawn between so-called “market transactions” and “administered transactions.” This distinction is of enormous importance for business ethics, since market transactions are governed by the competitive logic of the market, whereas administered transactions are subject to the cooperative norms that govern collective action in a bureaucracy. The widespread failure to distinguish between these two types of transactions, and thus to distinguish between adversarial and non-adversarial relations, (...) has led many business ethicists to develop a “uniform” moral code. Yet in market transactions, the checks and balances built into the system of commercial exchange are such as to permit more instrumental forms of behavior. In administered transactions, by contrast, these checks and balances are absent, and thus the institutional context calls for much greater exercise of moral restraint. In this paper, I begin the task of developing an adversarial ethic for business. According to this view, the competitive environment licenses a greater range of “self-interested” behavior, but also imposes its own constraints on the strategies that firms may adopt in the pursuit of their interests. : This paper presents a method of moral problem solving in clinical practice that is inspired by the philosophy of John Dewey. This method, called "clinical pragmatism," integrates clinical and ethical decision making. Clinical pragmatism focuses on the interpersonal processes of assessment and consensus formation as well as the ethical analysis of relevant moral considerations. The steps in this method are delineated and then illustrated through a detailed case study. This paper raises a challenge for those who assume that corporate social responsibility and good corporate governance naturally go hand-in-hand. The recent spate of corporate scandals in the United States and elsewhere has dramatized, once again, the severity of the agency problems that may arise between managers and shareholders. These scandals remind us that even if we adopt an extremely narrow concept of managerial responsibility – such that we recognize no social responsibility beyond the obligation to maximize shareholder value – (...) there may still be very serious difficulties associated with the effective institutionalization of this obligation. It also suggests that if we broaden managerial responsibility, in order to include extensive responsibilities to various other stakeholder groups, we may seriously exacerbate these agency problems, making it even more difficult to impose effective discipline upon managers. Hence, our central question: is a strong commitment to corporate social responsibility institutionally feasible? In searching for an answer, we revisit the history of public management, and in particular, the experience of social-democratic governments during the 1960s and 1970s, and their attempts to impose social responsibility upon the managers of nationalized industries. The results of this inquiry are less than encouraging for proponents of corporate social responsibility. In fact, the history of public-sector management presents a number of stark warnings, which we would do well to heed if we wish to reconcile robust social responsibility with effective corporate governance. Analyzes Schelling's arguments for his idealism and pieces together a description of his theory of nature from among the large number of his writings in this area. It also traces the influence of Naturphilosophie on 19th-century science and connects it with recent System Theory.

We propose new definitions of (causal) explanation, using structural equations to model counterfactuals. The definition is based on the notion of actual cause, as defined and motivated in a companion article. Essentially, an explanation is a fact that is not known for certain but, if found to be true, would constitute an actual cause of the fact to be explained, regardless of the agent's initial uncertainty. We show that the definition handles well a number of problematic examples from the literature.

The unifying idea of Gramsci's famous Prison Notebooks is the concept of hegemony. In his study of these fragmentary writings, now published in paperback for the first time, Dr Femia elucidates the precise character of this concept, explores its basic philosophical assumptions, and sets out its implications for Gramsci's explanation of social stability and his vision of the revolutionary process. There are many examples in the literature that suggest that indistinguishability is intransitive, despite the fact that the indistinguishability relation is typically taken to be an equivalence relation (and thus transitive). It is shown that if the uncertainty perception and the question of when an agent reports that two things are indistinguishable are both carefully modeled, the problems disappear, and indistinguishability can indeed be taken to be an equivalence relation. Moreover, this model also suggests a logic of vagueness that seems (...) to solve many of the problems related to vagueness discussed in the philosophical literature. In this paper, I argue that Humean theories of moral motivation appear preferable to Kantian approaches only if one assumes a broadly foundationalist conception of rational justification. Like foundationalist approaches to justification generally, Humean psychology aims to counter the regress-of-justification argument by positing a set of ultimate regress-stoppers-in this case, unmotivated desires. If the need for regress-stoppers of this type in the realm of practical deliberation is accepted, desires do indeed appear to be the most likely candidate. But if this (...) foundationalist strategy is rejected, there is no longer any reason to suppose that all motivation must be traceable to some extra-rational incentive. This clears the way for a rehabilitation of the Kantian claim that reasons for action can take the form of categorical imperatives. To illustrate this thesis, I show how a conception of practical rationality that incorporates a contextualist model of justification can be developed that treats social norms as reasons for action, without assigning any mediating role to agent desires. a theory of action of this type eliminates the gap between moral obligation and action, and so articulates the fundamental Kantian intuition that acting on the basis of moral principle-and with disregard for self-interest-is just one way of acting rationally. Henry Hansmann has claimed we have reached the “end of history” in corporate law, organized around the “widespread normative consensus that corporate managers should act exclusively in the economic interests of shareholders.” In this paper, I examine Hansmann’s own argument in support of this view, in order to draw out its implications for some of the traditional concerns of business ethicists about corporate social responsibility. The centerpiece of Hansmann’s argument is the claim that ownership of the firm is most naturally (...) exercised by the group able to achieve the lowest agency costs, and that homogeneity of interest within the ownership group is the most important factor in achieving lower costs. He defends this claim through a study of cooperatives, attempting to show that homogeneity is the source of the competitive advantage most often enjoyed by shareholders over other constituency groups, such as workers, suppliers and customers, when it comes to exercising control over the firm. Some business ethicists, impressed by this argument, have taken it to be a vindication of Milton Friedman’s claim that profit-maximization is the only “social responsibility” of management. I would like to suggest that this conclusion does not follow, and that the “Hansmann argument” lends itself to a less minimalist view, what I refer to as a “market failures” approach to business ethics. In this article we will draw on experiences from our own research on deep brain stimulation of the central thalamus in the minimally conscious state. We describe ethical challenges faced in clinical research involving medical devices and offer several cautionary notes about its funding and the interplay of market forces and scientific inquiry and suggest some reforms.

Few issues in business ethics are as polarizing as the practice of risk classification and underwrit­ ing in the insurance industry. Theorists who approach the issue from a background in economics often start from the assumption that policy-holders should be charged a rate that reflects the ex­ pected loss that they bring to the insurance scheme. Yet theorists who approach the question from a background in philosophy or civil rights law often begin with a presumption against socalled “actuarially fair” premiums (...) and in favor of “community rating,” in which everyone is charged the same price. This paper begins by examining and rejecting the three primary argu­ ments that have been given to show that actuarially fair premiums are unjust. It then considers the two primary arguments that have been offered by those who wish to defend the practice of risk classification. These arguments overshoot their target, by requiring a “freedom to under­ write” that is much greater than the level of freedom enjoyed in most other commercial transac­ tions. The paper concludes by presenting a defense of a more limited right to underwrite, one that grants the legitimacy of the central principle of risk classification, but permits specific deviations from that ideal when other important social goods are at stake. Available for the first time in English, this is the definitive account of the practice of sexual slavery the Japanese military perpetrated during World War II by the researcher principally responsible for exposing the Japanese government's responsibility for these atrocities. The large scale imprisonment and rape of thousands of women, who were euphemistically called "comfort women" by the Japanese military, first seized public attention in 1991 when three Korean women filed suit in a Toyko District Court stating that they had (...) been forced into sexual servitude and demanding compensation. Since then the comfort stations and their significance have been the subject of ongoing debate and intense activism in Japan, much if it inspired by Yoshimi's investigations. How large a role did the military, and by extension the government, play in setting up and administering these camps? What type of compensation, if any, are the victimized women due? These issues figure prominently in the current Japanese focus on public memory and arguments about the teaching and writing of history and are central to efforts to transform Japanese ways of remembering the war. Yoshimi Yoshiaki provides a wealth of documentation and testimony to prove the existence of some 2,000 centers where as many as 200,000 Korean, Filipina, Taiwanese, Indonesian, Burmese, Dutch, Australian, and some Japanese women were restrained for months and forced to engage in sexual activity with Japanese military personnel. Many of the women were teenagers, some as young as fourteen. To date, the Japanese government has neither admitted responsibility for creating the comfort station system nor given compensation directly to former comfort women. This English edition updates the Japanese edition originally published in 1995 and includes introductions by both the author and the translator placing the story in context for American readers. In 1960, E. P. Wigner, a joint winner of the 1963 Nobel Prize for Physics, published a paper titled On the Unreasonable Effectiveness of Mathematics in the Natural Sciences [61]. This paper can be construed as an examination and affirmation of Galileo's tenet that “The book of nature is written in the language of mathematics”. To this effect, Wigner presented a large number of examples that demonstrate the effectiveness of mathematics in accurately describing physical phenomena. Wigner viewed these examples as (...) illustrations of what he called the empirical law of epistemology, which asserts that the mathematical formulation of the laws of nature is both appropriate and accurate, and that mathematics is actually the correct language for formulating the laws of nature. At the same time, Wigner pointed out that the reasons for the success of mathematics in the natural sciences are not completely understood; in fact, he went as far as asserting that “… the enormous usefulness of mathematics in the natural sciences is something bordering on the mysterious and there is no rational explanation for it.”. Joseph Margolis, known for his considerable contributions to the philosophy of art and aesthetics, pragmatism, and American philosophy, has focused primarily on the troublesome concepts of culture, history, language, agency, art, interpretation, and the human person or self. For Margolis, the signal problem has always been the same: how can we distinguish between physical nature and human culture? How do these realms relate? _The Cultural Space of the Arts and the Infelicities of Reductionism_ identifies a conceptual tendency that can (...) be drawn from the work of the twentieth century's best-known analytic philosophers of art: Arthur Danto, Richard Wollheim, Kendall Walton, Nelson Goodman, Monroe Beardsley, Noël Carroll, and Jerrold Levinson, among others. This trend threatens to impoverish our grasp and appreciation of the arts by failing to do justice to the culturally informed nature of the arts themselves. Through his analysis, Margolis sets out to retrieve an adequate picture of the essential differences between physical nature and human culture—particularly through language, history, meaning, significance, the emergence of the human self or person, and the essential features of human life—all to explain how such difference bears on our perception of paintings and literature. A defining characteristic of Alzheimer’s disease is difficulty in retrieving semantic memories, or memories encoding facts and knowledge. While it has been suggested that this impairment is caused by a degradation of the semantic store, the precise ways in which the semantic store is degraded are not well understood. Using a longitudinal corpus of semantic fluency data, we derive semantic network representations of patients with Alzheimer’s disease and of healthy controls. We contrast our network-based approach with analyzing fluency data with (...) the standard method of counting the total number of items and perseverations in fluency data. We find that the networks of Alzheimer’s patients are more connected and that those connections are more randomly distributed than the connections in networks of healthy individuals. These results suggest that the semantic memory impairment of Alzheimer’s patients can be modeled through the inclusion of spurious associations between unrelated concepts in the semantic store. We also find that information from our network analysis of fluency data improves prediction of patient diagnosis compared to traditional measures of the semantic fluency task. (shrink)

Even though the concept of a 'validity claim' is central to Habermas's theory of communicative action, he has never given a precise definition of the term. He has stated only that truth is a type of validity claim, and that rightness and sincerity are analogous to truth. This paper explores the basis of this analogy, arguing that rightness and sincerity must share at least two characteristics with the truth predicate: each must be the designated value in an appropriate system of (...) logic, and each must serve as the 'central notion' in a theory of meaning for some corresponding class of speech acts. It is these two characteristics that establish the internal connec tion between understanding and justification that Habermas's more general project requires. However, there is an unnoticed tension between these two characteristics, since the relative autonomy of linguistic meaning from specific contexts of use appears to require that speech acts be governed by a uniform logic, and thus by a single validity claim. Three decades ago, planned obsolescence was a widely discussed ethical issue in marketing classrooms. Planned obsolescence is topical again today because an increasing emphasis on continuous product development promotes shorter durables replacement and disposal cycles with troublesome environmental consequences. This paper offers explanations of why product obsolescence is practiced and why it works. It then examines the ethical responsibilities of product developers and corporate strategists and their differing responses to this problem. Pro-environment product design and marketing practices and innovative government (...) policies may alleviate the problem over time. However, given the current lack of understanding about consumer replacement and disposal behavior, it is questionable as to whether these practices and policies will be sufficiently informed to be effective. Thus, marketing scholars have a significant opportunity to contribute to sustainable durables product development. (shrink)

One of the most troubling features of international trade is that it often involves exchange between individuals facing dramatically different life circumstances, who therefore derive different levels of benefit from the exchange. Most obviously, wages are extremely low in underdeveloped countries. However, the principle underlying these wages is the same as the one the dictates wage levels in wealthy countries. It is, therefore, difficult to criticize the wages paid to ?pauper labor? without at the same time criticizing the way that (...) capitalism functions as a whole. For those who would like to question aspects of globalization, without simply repeating the standard moralizing critique of capitalism, this poses particular difficulties. This paper offers some suggestions on how egalitarians can approach this issue. The central piece of conceptual apparatus introduced, in the service of this aim, is the distinction between a ?first-best?, a ?second-best?, and an ?nth best? set of normative principles. It is then suggested, first, that capitalism is acceptable to egalitarians only within a third-best framework, and second, that this low level of idealization imposes real constraints on how far one can go in criticizing trade practices at the global level. Kevin Sauvé has recently argued in this journal that David Gauthier's conception of ‘morals by agreement’ is inimical to the development of long-term productive investment and sustainable levels of resource exploitation. According to Sauvé, this is because society is confronted with an intergenerational interaction problem whose strategic equilibrium is suboptimal. However, unlike the ‘contemporaneous Prisoner's Dilemma’ that Gauthier analyzes, the intergenerational version cannot be solved by an appeal to constrained maximization. As a result, Sauvé claims, Gauthier cannot effectively address the (...) question of intergenerational justice.The portion of Sauvé's argument that concerns me is the following:Gauthier solves the contemporaneous Prisoner's Dilemma by ensuring that each person will cooperate only if all others cooperate, and indeed his conception of morality is aimed at ensuring that all individuals incur the costs as well as the benefits of social cooperation. But the contemporaneous solution cannot be applied to the Intergenerational Dilemma: if each generation will save for the next only if the previous generations have also saved, none will ever save. Fogelin posits, and Flew with reservations acknowledges, a "traditional interpretation" consisting (...) oftwo theses: TI.1 Hume did not put forward ana priori argument intended to show that miracles are not possible. TI.2 Hume did put forward an a priori argument intended to show that testimony, however strong, could never make it reasonable to believe that a miracle had occurred. (Fogelin 1990, 81) The disagreement between Fogelin and Flew could not be more complete: FogeUn thinks TLl is false and TI.2 true; Flew thinks TI.l is true and TI.2 false. Nonetheless, I disagree with both of them: I defend both theses of TI, and shall give a different (better) reason for each. FogeUn argues against TI.l by citing "clear texts... that go dead against it" (1990, 81). These are three sentences from the last but one paragraph of part 1: Amiracle is a violation ofthe laws ofnature; and as a firm and unalterable experience has established these laws, the proof against a miracle, from the very nature ofthe fact, is as entire as any argument from experience can possibly be imagined.... There must... be a uniform experience against every miraculous event, otherwise the event would not merit that appellation. And as a uniform experience amounts to a proof, there ishere a directand fullproof, from the nature ofthe fact, against the existence of any miracle; nor can such a proofbe destroyed, or the miracle rendered credible, butbyan opposite proof, which is superior.1 From these passages Fogelin constructs an argument, which I shall reconstruct as follows: Volume XLX Number 1 203 JOSEPH ELLIN 1.The proof against any miracle is direct and full unless destroyed by an opposite, superior, proof. 2.Since the proof against any miracle is as entire as any argument from experience can be imagined, there can be no opposite superior proof. Therefore: 3.The proofagainst any miracle is direct and full. FogeUn comments: "the strong claim in the second premise that the proof against a miracle is as entire as any argument from experience can possibly be imagined cancels the possibility left open in the first premise that there might be an opposite proof, which is superior. The conclusion then follows at once" (1990, 83). This argument is certainly sound; is it Hume's? Is it a priori? Does it show that miracles are not possible? Flew argues that it is not Hume's: "Proofs against proofs are no proofs" (1990, 142). Because a "proof" is a conclusive argument, there cannotbe proofs which are opposite but superior to other proofs; hence Hume's term "proof" needs some qualification: Hume means "what would in ordinary circumstances be accounted a proof, yet in the present case may conceivably not be" (Flew 1990, 144). One support for Flew is that when Hume in the previous paragraph supposes "that the testimony [for the miracle] considered apart and in itself, amounts to an entire proof " (E 114), he invokes a double standard, distinguishing the kind of evidence which, in the ordinary case, would be taken as proof, from what shouldbe so regarded in the case ofan alleged miracle (if one hundred witnesses testify that Lazarus got up from his bed and danced, this would ordinarily be taken to be proof; but not if he had died first). But though Flew has the better ofit with regard to the word "proof," 2 he hasn't made out his case against Fogelin, for it is not the word "proof" but the terms "direct and full" and "entire" that seem to carry the burden of Fogelin's reconstructed argument. Hume's distinction is between proof tout court, which means roughly a good enough case, and proof "full" or "entire," which perhaps does mean conclusive demonstration. Objective Although patients exercise greater autonomy than in the past, and shared decision making is promoted as the preferred model for doctor-patient engagement, tensions still exist in clinical practice about the primary locus of decision-making authority for complex, scarce, and resource-intensive medical therapies: patients and their surrogates, or physicians. We assessed physicians’ attitudes toward decisional authority for adult venoarterial extracorporeal membrane oxygenation (VA-ECMO), hypothesizing they would favor a medical locus. Design, Setting, Participants A survey of resident/fellow physicians and internal medicine (...) attendings at an academic medical center, May to August 2013. Measurements We used a 24-item, internet-based survey assessing physician-respondents’ demographic characteristics, knowledge, and attitudes regarding decisional authority for adult VA-ECMO. Qualitative narratives were also collected. Main Results A total of 179 physicians completed the survey (15 percent response rate); 48 percent attendings and 52 percent residents/ fellows. Only 32 percent of the respondents indicated that a surrogate’s consent should be required to discontinue VA-ECMO; 56 percent felt that physicians should have the right to discontinue VA-ECMO over a surrogate’s objection. Those who self-reported as “knowledgeable” about VA-ECMO, compared to those who did not, more frequently replied that there should not be presumed consent for VA-ECMO (47.6 percent versus 33.3 percent, p = 0.007), that physicians should have the right to discontinue VAECMO over a surrogate’s objection (76.2 percent versus 50 percent, p = 0.02) and that, given its cost, the use of VA-ECMO should be restricted (81.0 percent versus 54.4 percent, p = 0.005). Conclusions Surveyed physicians, especially those who self-reported as knowledgeable about VA-ECMO and/or were specialists in pulmonary/ critical care, favored a medical locus of decisional authority for VA-ECMO. VA-ECMO is complex, and the data may (1) reflect physicians’ hesitance to cede authority to presumably less knowledgeable patients and surrogates, (2) stem from a stewardship of resources perspective, and/or (3) point to practical efforts to avoid futility and utility disputes. Whether these results indicate a more widespread reversion to paternalism or a more circumscribed usurping of decisional authority occasioned by VA-ECMO necessitates further study. (shrink)

It is argued that current attempts to model human learning behavior commonly fail on one of two counts: either the model assumptions are artificially restricted so as to permit the application of mathematical techniques in deriving their consequences, or else the required complex assumptions are imbedded in computer programs whose technical details obscure the theoretical content of the model. The first failing is characteristic of so-called mathematical models of learning, while the second is characteristic of computer simulation models. An approach (...) to model building which avoids both these failings is presented under the title of a black-box theory of learning. This method permits the statement of assumptions of any desired complexity in a language which clearly exhibits their theoretical content.Section II of the paper is devoted to the problem of testing and comparing alternative learning theories. The policy advocated is to abandon attempts at hypothesis testing. It is argued that, in general, we not only lack sufficient data and sufficiently powerful techniques to test hypotheses, but that the truth of a model is not really the issue of basic interest. A given model may be true in the sense that on the basis of available evidence we cannot statistically reject it, but not interesting in the sense that it provides little information about the processes underlying behavior. Rather, we should accept or reject models on the basis of how much information they provide about the way in which subjects respond to environmental structure. This attitude toward model testing is made precise by introducing a formal measure of the information content of a model. Finally, it is argued that the statistical concept of degrees-of-freedom is misleading when used in the context of model testing and should be replaced by a measure of the information absorbed from the data in estimating parameters. David Gauthier tries to defend morality by showing that rational agents would choose to adopt a fundamental choice disposition that permits them to cooperate in prisoner's dilemmas. In this paper, I argue that Gauthier, rather than trying to work out a prudential justification for his favored choice disposition, should opt for a transcendental justification. I argue that the disposition in question is the product of socialization, not rational choice. However, only agents who are socialized in such a way that they (...) acquire a disposition of this type could acquire the capacity to use language. Given the internal connection between language and thought, this means that no agent endowed with such a disposition could rationally choose to adopt another. Thus rational reflection by moral agents upon their own fundamental choice disposition will have no tendency to destabilize it. (shrink)
