Abstractabstract:Interpreters of John Stuart Mill's moral philosophy have long disagreed about whether he was an act or rule utilitarian. Though debate has often focused on Utilitarianism, this paper instead analyzes a less studied work, "Whewell on Moral Philosophy," which contains a more detailed and systematic discussion of moral rules. "Whewell," I argue, favors reading Mill as an act utilitarian: it understands the importance of rules in moral reasoning to arise from the uncertainty under which human action occurs, not from any (...) direct role that rule compliance plays in determining right action. This dissertation analyzes three legal doctrines that regulate unintentional aspects of criminal conduct. Chapter one defends the influence the law grants to an action’s unintended results in determining the extent of the agent’s criminal liability. First, I critique the argument that criminal law’s general mens rea requirement allows a result to affect the extent of a defendant’s criminal liability only if he possesses mens rea with respect to that result. The rules that define offenses and the rules that specify sentences (...) for individual criminal actions each guide conduct, but they do so differently. Effective offense definitions must be framed in terms of mental states, but effective sentencing rules need not be; therefore, mens rea must set the limits of liability, but the extent of liability need not depend on mens rea alone. Second, I argue that sentencing rules can most effectively guide offenders to reduce the risk that their offenses will unintentionally cause harm if those rules grade the seriousness of each offense based on its results, since the primary alternative, grading offenses based on their risk, requires methods of measuring and communicating risk that exceed the capacities of the criminal justice system. While chapter one addresses the extent of liability, chapters two and three address its scope: each presents an account of one of the two types of mens rea used to define unintentional crimes. Recklessness, the subject of chapter two, is often analyzed as requiring defendants to possess a belief (or similar mental state) directed towards the degree of risk an action creates. Defining offenses in terms of an agent’s beliefs about risk, however, guides individuals to evaluate actions in deliberation by estimating the degree of risk they create. And because individuals ordinarily cannot estimate risks accurately, such rules will not effectively guide them to reduce harm. Effective rules, I will argue, must identify prohibited actions in a different way—namely, through the features of those actions that make them unreasonably risky. The definition of recklessness does not itself identify those features directly; instead, by requiring individuals to comply with the standard of conduct of the law-abiding person, recklessness indirectly incorporates into law the social norms that regulate dangerous activities. To be reckless, then, defendants must recognize the features of their conduct in virtue of which it violates such a norm. Finally, chapter three analyzes negligence. Criminal negligence is paradoxical: even though culpability ordinarily requires advertence, negligent defendants are typically understood to be culpable for a risk they inadvertently create. Rather than rejecting culpability for negligence or expanding culpability beyond advertence, I dissolve the paradox by reconceptualizing negligence. Negligent defendants are culpable despite their failure to perceive one risk because they advert to a different risk—the risk that by failing to inquire before acting they will fail to uncover evidence of the risk that they do, in the end, actually fail to perceive. Negligence is epistemic recklessness, the culpable disregard of the risk of inadvertently performing a risky action. Though negligence, like recklessness, involves advertence to risk, it constitutes a distinct form of mens rea because it regulates a different aspect of conduct—the decision to inquire rather than the decision to act. And because omitting inquiry creates only a risk of a risk, negligence is systematically less risky than recklessness, and therefore less culpable. (shrink)

Research on theory of mind has primarily focused on demonstrating and understanding the ability to represent others' non‐factive mental states, for example, others' beliefs in the false‐belief task. This requirement confuses the ability to represent a particular kind of non‐factive content (e.g., a false belief) with the more general capacity to represent others' understanding of the world even when it differs from one's own. We provide a way of correcting this. We first offer a simple and theoretically motivated account on (...) which tracking another agent's understanding of the world and keeping that representation separate from one's own are the essential features of a capacity for theory of mind. We then show how these criteria can be operationalized in a new experimental paradigm: the “diverse‐knowledge task.”. (shrink)

What does it mean to see someone as human, as a member of humankind? What kind of call for justice is it to demand that a group be seen as human beings? This article explores a fundamental kind of injustice: one of perception and how we respond to our perceptions. Drawing on Cavell, Wittgenstein and Rancière, we elucidate “soul blindness” as a distinct and basic form of injustice. Rancière’s police orders and Cavell’s soul blindness are mutually constitutive; the undoing of (...) police orders entails a politics of soul dawning. Soul dawning entails acknowledging the humanity of others without erasing difference. In the concluding section, we consider white obliviousness to the Black Lives Matters movement as a case of soul blindness. Part of the political import of BLM is its capacity to illustrate how practices of soul blindness in the United States constitute whiteness in a racialized police order. (shrink)

ABSTRACT Natural language semantics is heir to two formalisms. There is the extensional machinery of explicit variables traditionally used to model reference to individuals, and the intensional machinery of implicit index parameters traditionally used to model reference to worlds and times. I propose instead a simple and unified extensional formalism – explicit semantics – on which all sentences include explicit individual, world and time variables. No implicit index parameters are needed.

1. IntroductionA popular view in metaphysics is that which propositions are true depends upon how the world is . In more evocative language, truth requires ground. This thought then gets used to do some serious work. As Sider has it, ‘[t]he point of … the principle that truth supervenes on being is to rule out dubious ontologies’. Here, I argue that ‘dubious’ ontologies are theoretically virtuous.

The first major reassessment of the Western Enlightenment for a generation. Continuing the story he began in Radical Enlightenment, Jonathan Israel now focuses on the first half of the eighteenth century. He traces to their roots the core principles of Western modernity: the primacy of reason, democracy, racial equality, feminism, religious toleration, sexual emancipation, and freedom of expression.

In this paper I argue in favour of a new definition of presentism that I call ‘existence presentism’ (EP). Typically, presentism is defined as the thesis that ‘only present objects exist’, or ‘nothing exists that is non-present’.1 I assume these statements to be equivalent. I call these statements of presentism ‘conventional presentism’ (CP). First, in §2, I rehearse arguments due to Ulrich Meyer that purport to show that presentism is not adequately defined as CP. In §§2.1–2.4 I show that considerations (...) of the sort raised by Meyer infect attempts to define presentism, due to Thomas Crisp, Tom Stoneham, and Theodore Sider. Thus the first half of the paper is constituted by a negative project that looks to show how extant definitions of presentism fail. In the second half of the paper, I continue in the negative theme in §3, before laying out EP and demonstrating that it solves the problems faced by CP and offering explanations of how to make sense of certain key notions that lie at the heart of EP. A picture of sovereignty holds the study of politics captive. Captives of Sovereignty looks at the historical origins of this picture of politics, critiques its philosophical assumptions and offers a way to move contemporary critiques of sovereignty beyond their current impasse. The first part of the book is diagnostic. Why, despite their best efforts to critique sovereignty, do political scientists who are dissatisfied with the concept continue to reproduce the logic of sovereignty in their thinking? Havercroft draws on the writings (...) of Hobbes and Spinoza to argue that theories of sovereignty are produced and reproduced in response to skepticism. The second part of the book draws on contemporary critiques of skeptical arguments by Wittgenstein and Cavell to argue that their alternative way of responding to skepticism avoids the need to invoke a sovereign as the final arbiter of all political disputes. According to some critics, traditional armchair philosophical methodology relies in an illicit way on intuitions. But the particular structure of the critique is not often carefully articulated—a significant omission, since some of the critics’ arguments for skepticism about philosophy threaten to generalize to skepticism in general. More recently, some experimentalist critics have attempted to articulate a critique that is especially tailored to affect traditional methods, without generalizing too widely. Such critiques are more reasonable, and more worthy of serious consideration, than (...) are blunter critiques that generalize far too widely. I argue that a careful (empirical!) examination of extant philosophical practices shows that traditional philosophical methods can meet these more reasonable challenges. (shrink)

Eighteenth-century theologian_Jonathan Edwards remains a significant influence on modern religion, and this book constitutes his most important contribution to Christian thought. Edwards_raises timeless questions about desire, choice, good, and evil, contrasting the opposing Calvinist and Arminian views of free will and addressing issues related to God's foreknowledge, determinism, and moral agency.

In a recent article in this journal, Schaefer et al. argue that it might be possible to enhance autonomy through the use of cognitive enhancements. In this article, I highlight an example that Schaefer et al. do not acknowledge of a way in which we already seem to be using pharmacological agents in a manner that can be understood as enhancing an agent’s autonomy. To make this argument, I begin by following other theorists in the philosophical literature in claiming that (...) impulsivity can serve to undermine an agent’s autonomy. I then explain that we are already able to reduce impulsivity through the use of pharmacological interventions, as is evidenced by the use of Methylphenidate in the treatment of ADHD. (shrink)

This article examines the political themes in Cavell’s philosophy through a reading of the film Gaslight in the context of contemporary American politics. It demonstrates how Cavell’s ideas offer valuable insights into gender politics, fascism, and propaganda in American society. The article proceeds in three sections, first reviewing Cavell’s ontology of film and genre to elucidate his claim that film embodies scepticism. Next, it analyses gaslighting in the film as an enactment of gendered politics of scepticism and explores Cavell’s resources (...) for responding to it. Lastly, it investigates the political implications of gaslighting, particularly in light of its association with post-truth politics, using Cavell’s interpretation as a philosophical framework to understand instances like Donald Trump’s manipulation of America. György Márkus’s Culture, Science, Society: The Constitution of Cultural Modernity is the most sophisticated attempt among contemporary philosophies to proffer a radical critical theory of culture based upon a Marxian philosophical anthropology and an emphatically post-metaphysical re-interpretation of the paradigm of production. In this paper, I aim to evince how the content of Márkus’s published writings is related to the cultural form of his philosophical practice that he describes as ‘orientation in thought’. First, I provide an overview of several key (...) features appertaining to Márkus’s heuristic conceptual framework. Second, I clarify the theoretical and practical horizons of his project through a schematic characterization of the three categories of studies that Márkus has not included in his theory of cultural modernity. In conclusion, I raise the question of the exclusion of religion from high culture and propose some counter-arguments. (shrink)

In this response piece, I argue that the ‘coercive paternalism’ that Sarah Conly endorses in her book Against Autonomy veers towards a back-door perfectionism. Although Conly points out that coercive paternalism does not mandate the imposition of alien values upon us in the same way that perfectionism does, I argue that coercive paternalism might yet impose an alien weighting of our own values; this, I suggest, means that coercive paternalism remains perfectionist in spirit, if not in letter. I go on (...) to concede to Conly that coercive paternalism might be warranted in preventing actions that threaten health and that are only carried out on the basis of cognitive error. However, I conclude by claiming that we must take great care about what we presume that people are consuming only on the basis of cognitive error. More specifically, I suggest that it is crucial that we avoid defining our terms in such a manner that it becomes impossible for agents to choose some action that poses a risk to their health without them being accused of making a cognitive error in weighing their values in that way. This paper is an exploration of the role of intuition in physics. The ways in which intuition is appealed to in physics are not well understood. To the best of my knowledge, there is no analysis of the different contexts in which we might appeal to intuition in physics, nor is there any analysis of the different potential uses to which intuition might be put. In this paper I look to provide data that goes some way to giving a sense (...) of the different contexts in which intuition is appealed to in physics. As I note in the conclusion, there is still much work to be done but I hope that the work here provides us with a first step in the journey to properly understand the use to which intuitions are put in physics and science more generally. A republican theory of social justice specifies how republican freedom should be distributed. The goal of this paper is to assess the plausibility of two recently proposed principles of republican social justice: an aggregative maximizing principle defended by Philip Pettit in Republicanism and a sufficiency principle of republican social justice offered by Pettit in On the People’s Terms. The maximizing principle must be rejected because it permits under-protecting vulnerable members of society in favor of increasing the freedom of the powerful. (...) The sufficiency principle avoids the most basic objection to the maximizing principle, but it is at best an incomplete theory of social justice. Social justice requires principle(s) for determining the justice of distributions above the sufficiency threshold and republican theory does not determine which principle(s) should govern distributions above the threshold. Republicans must decide whether they will incorporate an independent commitment to equality within their theory of social justice. (shrink)

The scope and audacity of Bhaṭṭoji Dīkṣita’s contributions to Sanskrit grammar has made him one of early-modern India’s most influential, if not controversial, intellectuals. Yet for as consequential as Bhaṭṭoji’s has been for histories of early-modern scholasticism, his extensive corpus of non-grammatical writings has attracted relatively little scholarly attention. This paper examines Bhaṭṭoji’s work on Vedānta, the Tattvakaustubha, in order to gage how issues of language became an increasingly important site of inter-religious critique among early-modern Vedāntins. In the Tattvakaustubha, Bhaṭṭoji (...) reproaches Madhvācārya, the founder of the eponymous Mādhva or Dvaita Vedānta system, for his use of ungrammatical words. In extending his accusations of grammatical negligence to include Madhva’s early commentator Jayatīrtha, Bhaṭṭoji sought to undermine Mādhva claims to authoritative scriptural exegesis. Bhaṭṭoji’s provocation impelled later Mādhva scholars like Rāghavendratīrtha to bring a sharper set of grammatical tools to core commentarial works. Where others have pointed to Vyāsatīrtha as a turning point for Mādhva scholastic discourse in the areas of Pūrva Mīmāṃsā and Navya Nyāya, this paper suggests that it was the post-Bhaṭṭoji scholar Rāghavendratīrtha who brought a hitherto unrivaled grammatical expertise to Mādhva writings. That both Mādhva and Advaita Vedāntins wielded grammatical legitimacy as a cudgel against the other raises important socio-historical questions about the relationship between text-criticism, conceptions of scholastic legitimacy, and inter-religious contestation in early-modern South Asia. In this introduction to the Special Issue, we undertake a little ground clearing in order to make room in International Relations for thinking differently about anarchy and world politics. Anarchy’s roots in, and association with, social contract theory and the state of nature has unduly narrowed how we might understand the concept and its potential in International Relations. Indeed, such is the consensus in this regard that anarchy is remarkably uncontested, considering its centrality to the field. Looking around, both inside (...) and outside International Relations, for alternative accounts, we find ample materials for helping us think anew about the nature of and possibilities for politics in anarchy. In the second part of the introduction, we show how our contributors develop and expand on these resources and what we hope the Special Issue brings to International Relations. (shrink)

The works of György Márkus and Hannah Arendt represent two irreconcilable tendencies of contemporary radical philosophy. Whereas Márkus’s critical theory of culture actively refrains from attributing metaphysical significance to its heuristic concepts and the mutable practices they contingently designate, Arendt’s phenomenological methodology attempts to elucidate the constitution of the modern world in order to evince the ontological significance of the political. Due to the inimical nature of their respective projects, Márkus’s writings largely consign its references to Arendt to marginalia. In (...) this article, I consider the exception by taking as my point of departure Márkus’s only substantive comments about Arendt in ‘Beyond the Dichotomy: Poiesis and Praxis’. From a culturological perspective, I then reconstruct the ambivalent conceptions tacitly inhering in Arendt’s principal accounts of culture. In doing so, I reaffirm that Arendt denigrates poiesis, but also show that she regards culture and cultural reception as derivative to the political and praxis. The purpose of this exposition is not to resolve the dispute in one or the other direction, but to render perspicuous the fundamental choice evident in their opposition. (shrink)

Phylogenetic information is often necessary to distinguish between evolutionary scenarios. Recently, some prominent proponents of evolutionary psychology have acknowledged this, and have claimed that such evidence has in fact been brought to bear on adaptive hypotheses involving complex human psychological traits. Were this possible, it would be a valuable source of evidence regarding hypothesized adaptive traits in humans. However, the structure of the Hominidae family makes this difficult or impossible. For many traits of interest, the closest extant relatives to the (...) human species are too phenotypically different from humans for such methods to provide meaningful data. While phylogenetic information can be useful for testing adaptive hypotheses in humans, these generally involve traits that are not widely shared in the species or fairly widely shared in the Hominidae family, and hence likely of a lower order of complexity than the sorts of traits evolutionary psychology has so far been interested in. This essay contends that while Nancy and Esposito have strikingly similar concepts of the place of the political in post-metaphysical community, their respective articulations of these concepts noticeably diverge. Because of his commitment to excavating the political project of immunity as central to the Western political tradition in and through the category of the legal person, Esposito announces community as impolitical, as the interruptive spacing, and thus alternating displacement, of the political conceived as the site of emancipatory agency. In contrast, (...) in the work of Agamben and in the recent work of Nancy, an articulation of the person and the political in more agential terms can be found. This divergence presents interpretive difficulties insofar as Esposito's discussion of community as impolitical could be read as advancing ontological neutrality or passivity that threatens to separate political activity from its liberating potential. I argue that such ontological neutrality is a product of Esposito's confrontation with the political as dominated by both the logic of immunity and an engagement with the complex legacy of Heidegger's problematic political trajectory. To this extent it is an open question whether Esposito's project leaves room for a new vision of the political and for political agency. (shrink)

This article is an introduction to the Synthese Special Issue, Philosophy of Epidemiology. The overall goals of the issue are to revisit the state of philosophy of epidemiology and to provide a forum for new voices, approaches, and perspectives in the philosophy of epidemiology literature. The introduction begins by drawing on Geoffrey Rose’s work on how to conceptualize and design interventions for populations, rather than individuals. It then goes on to highlight some themes that emerged in the articles that make (...) up the issue: philosophy of epidemiology and epidemiological theory—what they are and what they ought to be, pluralism in measurement and causal attribution, epistemic and non-epistemic values in disputes epidemiological practices, decentering philosophy of epidemiology’s Eurocentrism, letting pragmatism guide uses of big data in epidemiology, and revisiting the lessons of classic texts in epidemiological causal inference. The introduction concludes with comments on a philosophy of epidemiology debate we see on, regarding the politics of philosophy of epidemiology. (shrink)

An important measure of the success of an academic institution is evaluation of its moral health. In order to investigate academic integrity in our institution, we administered the Academic Integrity Survey to a representative sample of 384 students from different departments. In addition we performed content analysis on 24 disciplinary hearing files from the previous academic year in order to ascertain which students were brought before the committee and why. Results show that the majority of students perceived academic misconduct as (...) a serious matter. Those who reported high on academic misconduct were concentrated among those who had not done national service, studied in the science faculty, and were Arabic-speaking students. Evaluation of the disciplinary hearings revealed that half the student brought before the committee were Arabic-speaking students despite their relatively small numbers in the college. The findings suggest that prevention of academic misconduct should focus on supporting specific at-risk populations. (shrink)

Si la mécanique énonciative de Maus a plus d’une fois été mise en relief par les sciences sociales, il n’en est, semble-t-il, (...) rien pour les deux autres oeuvres. En conséquence, la présente contribution expose les caractéristiques de l’énonciation des récits testimoniaux composant celles-ci. Puis, compte tenu de l’inévitable disparition des derniers rescapés du génocide, en s’appuyant sur d’autres albums, cette étude s’interroge aussi sur l’avenir de l’expression du témoignage relatif à la Shoah dans et par la bande dessinée.Up to 2007 in France, at least three comic strip albums had been published to give voice to the personal accounts of survivors of the Holocaust. These were the “Maus” and “Au nom de tous les miens” diptychs by Art Spiegelman and the Philippe Cothias / Paul Gillon duo, and “Seules contre tous” by Miriam Katin. While the enunciative mechanics of “Maus” have been highlighted more than once by the social sciences, this does not seem to be the case for the other two works. Consequently, this contribution describes the enunciative characteristics of the testimonial narratives that compose them. Given that the survivors of the Holocaust will inevitably disappear, we then move on to other albums to seek insights into the future of personal accounts of the Holocaust in and through the comic strip medium. Despite his significant influence across the humanities, Cavell's work has attracted little attention from political theorists. This book addresses that gap by explicating the political dimensions of his thought and placing it in conversation with contemporary debates within the discipline, focusing on the challenge of post-truth politics.

Duncan Bell’s Empire, Race and Global Justice is an edited volume that makes an important intervention in philosophical debates about global justice. Its contributors argue that global justice scholarship has paid insufficient attention to the role of imperialism and racism in generating global hierarchies. This review considers the contributions of this volume from three perspectives: as a critique of the global justice literature, as a guide for what methods global justice scholars should use and as a reconsideration of what texts (...) should be incorporated into the global justice canon. Empire is an important book for anyone who researches and teaches in the area of global justice because it demonstrates both why a different approach to this topic is necessary and how a different approach is possible. What are the factors that contribute to (or inhibit) diachronic sound change? While acoustically motivated sound changes are well documented, research on the articulatory and audiovisual-perceptual aspects of sound change is limited. This paper investigates the interaction of articulatory variation and audiovisual speech perception in the Northern Cities Vowel Shift (NCVS), a pattern of sound change observed in the Great Lakes region of the United States. We focus specifically on the maintenance of the contrast between the vowels /ɑ/ and /ɔ/, (...) both of which are fronted as a result of the NCVS. We present results from two experiments designed to test how the NCVS is produced and perceived. In the first experiment, we present data from an articulatory and acoustic analysis of the production of fronted /ɑ/ and /ɔ/. We find that some speakers distinguish /ɔ/ from /ɑ/ with a combination of both tongue position and lip rounding, while others do so using either tongue position or lip rounding alone. For speakers who distinguish /ɔ/ from /ɑ/ along only one articulatory dimension, /ɑ/ and /ɔ/ are acoustically more similar than for speakers who produce multiple articulatory distinctions. While all three groups of speakers maintain some degree of acoustic contrast between the vowels, the question is raised as to whether these articulatory strategies differ in their perceptibility. In the perception experiment, we test the hypothesis that visual speech cues play a role in maintaining contrast between the two sounds. The results of this experiment suggest that articulatory configurations in which /ɔ/ is produced with unround lips are perceptually weaker than those in which /ɔ/ is produced with rounding, even though these configurations result in acoustically similar output. We argue that these findings have implications for theories of sound change and variation in at least two respects: 1) visual cues can shape phonological systems through misperception-based sound change, and 2) phonological systems may be optimized not only for auditory but also for visual perceptibility. Current technology has dramatically increased the prevalence of studies to establish the genetic correlates of a wide variety of human characteristics, including not only the physical attributes that determine what we look like and the risk of physiological disease but also the psychological and cognitive characteristics that often define who we are as individuals. Perhaps one of the most deeply personal and often controversial characteristics is the concept of general intelligence, known in the psychological literature as “g.” As with the (...) genetic study of any complex trait, the first step in studying the genetics of g is to carefully define the characteristic of interest. For g, this entails establishing what intelligence means and providing a clear operational definition for how it will be measured. In this paper, we provide a brief historical and theoretical overview of the construct of general intelligence, describe its relationship to the contemporary measurement of intelligence, and discuss these concepts in light of the challenges associated with defining g as a characteristic in the study of genetics.
