A comprehensive study of the ethics of killing in cases in which the metaphysical or moral status of the individual killed is uncertain or controversial. Among those beings whose status is questionable or marginal in this way are human embryos and fetuses, newborn infants, animals, anencephalic infants, human beings with severe congenital and cognitive impairments, and human beings who have become severely demented or irreversibly comatose. In an effort to understand the moral status of these beings, this book develops and (...) defends distinctive accounts of the nature of personal identity, the evaluation of death, and the wrongness of killing. The central metaphysical claim of the book is that we are neither nonmaterial souls nor human organisms but are instead embodied minds. In ethical theory, one of the central claims is that the morality of killing is not unitary; rather, the principles that determine the morality of killing in marginal cases are different from those that govern the killing of persons who are self‐conscious and rational. Another important theme is that killing in marginal cases should be evaluated in terms of the impact it would have on the victim at the time rather than on the value of the victim's life as a whole. What primarily matters is how killing would affect that which would be rational for the victim to care about at the time of death. By appealing to various foundational claims about identity, death, and the morality of killing, this book yields novel conclusions about such issues as abortion, prenatal injury, infanticide, the killing of animals, the significance of brain death, the termination of life support in cases of persistent vegetative state, the use of anencephalic infants as sources of organs for transplantation, euthanasia, assisted suicide, and advance directives in cases of dementia. In particular, the book defends the moral permissibility of abortion, infanticide, and euthanasia in certain cases and argues that brain death is not the appropriate criterion of death either for a person or a human organism. For more than a quarter of a century, Hubert L. Dreyfus has been the leading voice in American philosophy for the continuing relevance of phenomenology, particularly as developed by Edmund Husserl, Martin Heidegger, and Maurice Merleau-Ponty. Dreyfus has influenced a generation of students and a wide range of colleagues, and these volumes are an excellent representation of the extent and depth of that influence.In keeping with Dreyfus's openness to others' ideas, many of the essays in this volume take the form (...) of arguments with various of his positions. J. E. Malpas discusses and develops the ideas of Donald Davidson, influential in contemporary thinking on the nature of understanding and meaning, and of truth and knowledge. He provides an account of Davidson's holistic and hermeneutical conception of linguistic interpretation, and, more generally, of the mind. Outlining its Quinean origins and the elements basic to Davidson's Radical Interpretation, J. E. Malpas' book goes on to elaborate this holism and to examine the indeterminacy of interpretation and the principle of charity. The (...) metaphysical and epistemological consequences of Davidson's approach are considered, particularly in relation to scepticism and relativism, the realist/anti-realist debate, and the problem of truth. Drawing on a range of sources in philosophy and literature, but with particular reference to the work of Heidegger, makes a compelling case for the importance of place in philosophical discourse.

This paper sets out an account of hermeneutics as essentially ‘topological’ in character at the same time as it also argues that hermeneutics has a key role to play in making clear the nature of the topological. At the centre of the argument is the idea that place and understanding are intimately connected, that this is what determines the interconnection between topology and hermeneutics, and that this also implies an intimate belonging-together of place and thinking, of place and experience, of (...) place and the very possibility of appearance, of presence, of being. We have been left with a big challenge, to articulate consciousness and also to prove it in an artificial agent against a biological standard. After introducing Boltuc’s h-consciousness in the last paper, we briefly reviewed some salient neurology in order to sketch less of a standard than a series of targets for artificial consciousness, “most-consciousness” and “myth-consciousness.” With these targets on the horizon, we began reviewing the research program pursued by Jun Tani and colleagues in the isolation of the formal (...) dynamics essential to either. In this paper, we describe in detail Tani’s research program, in order to make the clearest case for artificial consciousness in these systems. In the next paper, the third in the series, we will return to Boltuc’s naturalistic non-reductionism in light of the neurorobotics models introduced (alongside some others), and evaluate them more completely. Topography or topology is a mode of philosophical thinking that combines elements of transcendental and hermeneutic approaches. It is anti-reductionist and relationalist in its ontology, and draws heavily, if sometimes indirectly, on ideas of situation, locality, and place. Such a topography or topology is present in Heidegger and, though less explicitly, in Hegel. It is also evident in many other recent and contemporary post-Kantian thinkers in addition to Kant himself. A key idea within such a topography or topology is that (...) of triangulation—an idea that appears explicitly in the work of Donald Davidson. Triangulation captures the idea of the topographical domain as constituted through the mutual relatedness of the elements within it, and as only to be understood through the mapping out of such relatedness—in the case of the topographical domain that is the world, through the relatedness of self, other, and thing. The work of the philosopher Donald Davidson is not only wide ranging in its influence and vision, but also in the breadth of issues that it encompasses. Davidson's work includes seminal contributions to philosophy of language and mind, to philosophy of action, and to epistemology and metaphysics. In _Dialogues with Davidson_, leading scholars engage with Davidson's work as it connects not only with aspects of current analytic thinking but also with a wider set of perspectives, including those of hermeneutics, phenomenology, (...) the history of philosophy, feminist epistemology, and contemporary social theory. They link Davidson's work to other thinkers, including Collingwood, Kant, Derrida, Heidegger, and Gadamer. This chapter attempts to examine nostalgia as both a mood or disposition in general, and as a mood or disposition that is characteristic of philosophical reflection. Nostalgia is a combination of the Greek nostos, meaning home or the return home, with algos, meaning pain, so that its literal meaning is a pain associated with the return home. Part of this inquiry will involve a rethinking of the mood of nostalgia and what that mood encompasses. Rather than understand the nostalgic as (...) characterized solely by the desire to return to a halcyon past, it is explored through the connotations suggested by its Greek etymology as precisely a longing for the return home—a return that cannot be achieved—a form of homesickness, and so as unsettling rather than comfortable, as bringing with it a sense of the essential questionability of our own being in the world. Both Kant and Davidson view the existence of mental states, and so the possibility of mental content, as dependent on the obtaining of a certain unity among such states. And the unity at issue seems also to be tied, in the case of both thinkers, to a form of self-reflexivity. No appeal to self-reflexivity, however, can be adequate to explain the unity of consciousness that is necessary for the possibility of content- it merely shifts the focus of the question from (...) the unity of consciousness in general to the unity of self-reflexivity in particular. Through a comparison of the views of Kant and Davidson on these matters, the nature of the unity of consciousness is explored, in relation to both the idea of the unity of the self and the unity that would seem to be required for the possibility of content. These forms of unity are seen to be indeed connected, and to be grounded, in Davidson and perhaps also in Kant, in organized, oriented, embodied activity. (shrink)

Despite the extensive body of literature that aims to explain the phenomenon of consumer scams, the structure of information in scam relationships remains relatively understudied. The purpose of this article is to develop an agency-theoretic approach to the study of information in perpetrator–victim interactions. Drawing a distinction between failures of observation and failures of judgment in the pre-contract phase, we introduce a typology and a set of propositions that explain the severity of adverse selection problems in three classes of scam (...) relationships. Our analysis provides a novel, systematic explanation of the structure of information that facilitates scam victimization, while also enabling critical scrutiny of a core assumption in agency theory regarding contract design. We highlight the role of scam perpetrators as agents who have access to private information and exercise considerable control over the terms and design of scam relationships. Focusing on the consumer scam context, we question a theoretical assumption, largely taken for granted in the agency literature, that contact design is necessarily in the purview of the uninformed principal. ABSTRACT:Some business ethicists view agency theory as a cautionary tale—a proof that it is impossible to carry out successful economic interactions in the absence of ethical behaviour. The cautionary-tale view presents a nuanced normative characterisation of agency, but itsunilateralfocus betrays a limited understanding of the structure of social interaction. This article moves beyond unilateralism by presenting a descriptive and normative argument for abilateralcautionary-tale view. Specifically, we discuss hat swaps and role dualism in asymmetric-information principal-agent relationships and argue that the norm (...) of reciprocity can function as a moral solution to agency risks in adverse-selection and moral-hazard problems. Our bilateral cautionary-tale formulation extends the normative boundaries of agency theory, while leaving the fundamental economic assumptions of agency theory intact. (shrink)

BackgroundThe process of peer-review in academia has attracted criticism surrounding issues of bias, fairness, and professionalism; however, frequency of occurrence of such comments is unknown.MethodsWe evaluated 1491 sets of reviewer comments from the fields of “Ecology and Evolution” and “Behavioural Medicine,” of which 920 were retrieved from the online review repository Publons and 571 were obtained from six early career investigators. Comment sets were coded for the occurrence of “unprofessional comments” and “incomplete, inaccurate or unsubstantiated critiques” using an a-prior rubric (...) based on our published research. Results are presented as absolute numbers and percentages.ResultsOverall, 12% of comment sets included at least one unprofessional comment towards the author or their work, and 41% contained incomplete, inaccurate of unsubstantiated critiques.ConclusionsThe large number of unprofessional comments, and IIUCs observed could heighten psychological distress among investigators, particularly those at an early stage in their career. We suggest that development and adherence to a universally agreed upon reviewer code of conduct is necessary to improve the quality and professional experience of peer review. (shrink)

Our recent paper reported that 43% of reviewer comment sets shared with authors contained at least one unprofessional comment or an incomplete, inaccurate of unsubstantiated critique. Publication of this work sparked an online conversation surrounding professionalism in peer review. We collected and analyzed these social media comments as they offered real-time responses to our work and provided insight into the views held by commenters and potential peer-reviewers that would be difficult to quantify using existing empirical tools. Overall, 75% of comments (...) were positive, of which 59% were supportive and 16% shared similar personal experiences. However, a subset of negative comments emerged, that provided potential insight into the reasons underlying unprofessional comments were made during the peer-review process. These comments were classified into three main themes: forced niceness will adversely impact the peer-review process and allow for publication of poor-quality science ; dismissing comments as not offensive to another person because they were not deemed personally offensive to the reader ; and authors brought unprofessional comments upon themselves as they submitted substandard work. Here, we argue against these themes as justifications for directing unprofessional comments towards authors during the peer review process. We argue that it is possible to be both critical and professional, and that no author deserves to be the recipient of demeaning ad hominem attacks regardless of supposed provocation. Suggesting otherwise only serves to propagate a toxic culture within peer review. While we previously postulated that establishing a peer-reviewer code of conduct could help improve the peer-review system, we now posit that priority should be given to repairing the negative cultural zeitgeist that exists in peer-review. The preoccupation with "depth" and its relevance to cinema and media studies.

Gadamer was fond of telling of his last meeting with his old teacher Martin Heidegger: ‘You are right’, said Heidegger, ‘language is conversation [Sprache ist Gespräch].’1 We might argue as to what such a comment, assuming Gadamer remembered it aright, would really have meant for Heidegger – whether it would have constituted a significant revision of any view to which Heidegger was himself committed.2 The fact that Gadamer felt it worth repeating, however, does indicate something of Gadamer’s conception of the (...) relation between his thought and that of Heidegger, as well as of the centrality of the idea at issue in his own thought. “In space”, declared the posters for the 1979 movie Alien, in a deliberately disconcerting juxtaposition, “no-one can hear you scream.” Yet even the space that lies beyond the earth is not utterly silent – stars and planets themselves produce sounds that radiate through the rarefied gases lying between them, although the wavelengths produced lie far beyond the range of human hearing. There are, then, not even in the spaces between the planets and the stars, any truly silent spaces, and merely (...) to be present in a space, no matter the nature of the space in question, is already to disturb that space in multiple ways – such disturbance typically being manifest acoustically no less than visually. Yet often we tend to conceptualise space and spatial presence in terms that actually give priority to the visual over the acoustic, and even to neglect the spatial character of the acoustic altogether. A classic example of this is to be found in the work of the British philosopher Peter Strawson who famously proposed, as a kind of thought-experiment, the idea of what he called a ‘No-Space world’ that was constituted in purely auditory terms, and was for just this reason taken to be a non-spatial world. 1.. Walter Benjamin’s 1936 essay, ‘The Work of Art in the Age of Mechanical Reproduction’, constitutes one of the earliest reflections on the way in which the cultural experience and interpretation is transformed by the advent of what were then the ‘new’ media technologies of photography and film. Benjamin directs attention to the way in which these technologies release cultural objects from their unique presence in a place and make them uniformly available irrespective of spatial location. The way in which old (...) media technologies apparently obliterate the place of cultural objects is also a feature of new media. However, the apparent obliteration of place that occurs in this way is itself problematic, in giving rise to a loss of the sense of spatial and temporal distance, and so of the relative locatedness of both experiencing subject and interpreted object. The loss of a sense of the place of the object threatens a loss of the sense of place of the subject, and with it, a loss of a proper sense of heritage as such. (shrink)

Celebrates the 50th anniversary of the publication of one of the most important philosophical works in the 20th century with essays by most of the leading figures in contemporary hermeneutic theory.

Much contemporary talk of virtual 'worlds' proceeds as if the virtual could somehow be considered as in competition with or as an alternative to the world of the 'nonvirtual' or the 'everyday'. This paper argues that such a contrast is fundamentally mistaken, and that the virtual is not autonomous with respect to the everyday, but is rather embedded within it, and an extension of it.

One of Max Charlesworth’s most important contributions has been to the development of contemporary bioethical thinking. In Bioethics in a Liberal Society, Charlesworth explores the consequences of the liberal commitment to the core value of autonomy across a range of areas beginning with the end of life. Focusing on just this latter issue, this contribution explores the question whether the principle of autonomy is indeed adequate to be the primary principle on the basis of which to address the issues surrounding (...) the end of life. Part of the underlying concern here is thus with the nature of our dying in a ‘liberal society’ of the sort Charlesworth describes. (shrink)

Ted Relph’s review of Heidegger’s Topology acknowledges the importance of Heidegger’s thought in the contemporary turn to place within the Humanities and Social Sciences, just as it acknowledges the importance of the philosophical inquiry into place as such (Relph is also particularly generous in his estimation of the role of my work, in Heidegger’s Topology and elsewhere, in contributing to this). Moreover, Relph provides a strikingly apt and vivid image of the way the concept of ‘place’ has, in recent years, (...) ‘exploded’ across many different areas and disciplines, in a proliferation of different forms and uses. While there are many works that deploy various senses of place, and that also delineate the detailed textures and forms of particular places, when it comes to the theoretical inquiry into place, the focus, for the most part, is not on place as such, but either on the effects of place or else on place as itself an effect of other processes. Thus David Harvey, as Relph notes, treats place as a social construction, claiming that the only interesting question then concerns the social processes that give rise to place (see Harvey, 1996: 293-4) – here place is nothing more than an effect; Doreen Massey, on the other hand, treats place, which she refuses to distinguish from space, as significant largely in terms of the consequences of our imagination of place (see Massey, 2005: esp. 5-8) – here it is the effects of place that are given priority. Even the work of a theorist such as Henri Lefebvre (see especially Lefebvre, 1991), so often cited as a key figure in the literature on place, turns out to be important, less for his elucidation of the concept, than..
