The recent decrease in public confidence in the measles, mumps and rubella vaccine has important implications for individuals and public health. This article presents moral arguments relating to conflicts between individual autonomy and collective responsibilities in vaccination decisions with a view to informing and advising health professionals and improving the effectiveness of education policies in avoiding resurgence of endemic measles. Lower population immunity, due to falling uptake, is hastening the need for greater public awareness of the consequences for the population. (...) Vaccination refusals go hand in hand with responsibilities owed to future generations and society in not knowingly contributing to preventable harms. Issues such as parents’ rights are considered and balanced against: collective responsibilities for public health; permissibility of ‘free-riding’; conflicting duties of health professionals; and possible enforcement of vaccination. It is suggested that the arguments may form a persuasive tool for the practice of health professionals involved in informing and supporting parents’ vaccination decisions. (shrink)

The objective of this paper is to examine the ‘Code of Ethics Quality’ (CEQ) in the largest companies of Australia, Canada and the United States. For this purpose, a proposed CEQ construct has been applied. It appears from the empirical findings that while Australia, Canada and the United States are extremely similar in their economic and social development, there may well be distinct cultural mores and issues that are forming their business ethics practices. A research implication derived from the performed (...) research is that the construct provides a selection of observable and measurable elements in the context of CEQ. The construct of CEQ consists of nine measures divided into two dimensions (i.e. staff support and regulation). They should not be seen as a complete list. On the contrary, it is encouraged that others propose and elaborate revisions and extensions. A practical implication of this paper is a structure of what and how to examine the CEQ in a managerial setting. It may assist companies in their efforts to establish, maintain and improve their ethical culture, norms and beliefs within the organization and supporting them in their ethical business practices with different stakeholders in the marketplace and society. The dimensions and measures of the construct may be used as a frame of reference for further research. They may be useful and applicable across contexts and over time using similar samples when it comes to large companies, as small‐ or medium‐sized ones may not have considered all areas nor have the elements in place. ICTs, personal data, digital rights, the GDPR, data privacy, online security… these terms, and the concepts behind them, are increasingly common in our lives. Some of us may be familiar with them, but others are less aware of the growing role of ICTs and data in our lives - and the potential risks this creates. These risks are even more pronounced for vulnerable groups in society. People can be vulnerable in different, often overlapping, ways, which place them at a disadvantage (...) to the majority of citizens; Table 3 in this guide presents some of the many forms and causes of vulnerability. As a result, vulnerable people need greater support to navigate the digital world, and to ensure that they are able to exercise their rights. This guide explains where such support can be found, and also answers the following questions: - What are the main ethical and legal issues around ICTs for vulnerable citizens? - Who is vulnerable in Europe? - How do issues around ICTs affect vulnerable people in particular? This guide is a resource for members of vulnerable groups, people who work with vulnerable groups, and citizens more broadly. It is also useful for data controllers1 who collect data about vulnerable citizens. While focused on citizens in Europe, it may be of interest to people in other parts of the world. It forms part of the Citizens’ Information Pack produced by the PANELFIT project, and is available in English, French, German, Italian and Spanish. The year 2019 saw the 130th anniversary of the death of Julian Tenison Woods, Founder of the Sisters of St Joseph and Sisters of Perpetual Adoration. He died in Sydney on 7 October 1889, aged fifty-six. In the anniversary year the Sisters of St Joseph of the Sacred Heart invited the Lochinvar Sisters of St Joseph to join them in raising his profile and recognising him as Founder. The founding of the sisters in South Australia and the life of Mary (...) MacKillop have been well publicised and St Mary is widely recognised. Still, though Woods is portrayed and acclaimed in the writing of many, his relatively short and varied life, his remarkable gifts, his impact in the Australian church and the world of science is little known. Woods, the man, the priest, the founder, the scientist, the man of God, a man for our time awaits wider recognition. (shrink)

Cresp, Mary; Tranter, Janice Entanglements were part of Julian Edmund Tenison Woods' life from the time of his birth in London on 15 November 1832. His mother, Henrietta Tenison, daughter of a Church of Ireland rector, had several relatives in the Anglican clergy, including Thomas Tenison, Archbishop of Canterbury, and Edmund Tenison, Bishop of Ossory. Julian's father, James Dominic, was the son of a Cork businessman and studied law in Ireland. He was Catholic, but not practising during his working (...) years. James and Henrietta married in London, raising their family there. James joined 'The Times' as parliamentary reporter; their home was a centre for Irish writers, newspaper men and those in the medical and legal professions. His brother, Nicholas, following duty as surgeon with the East India Company Civil Service, joined the Woods household with his two daughters after his wife's death. Stories of India and his uncle's collections of 'curiosities of various kinds' fascinated Julian and 'served to form [his] taste for natural history'. (shrink)

Wilmington, Del.: Michael Glazier, 1989. Pp. 158. $15.95. Rather than offering a sustained study of the question of authority and leadership in the Church, Rausch presents a collection of essays related to the topic. The format reflects the book's genesis: much of the material was developed for the 23rd Faith and Order Conference of the Texas Conference of Churches on the subject "Authority in the Body of Christ." Although the title does not reflect the hook's ecumenical focus, readers who want a general introduction to the present status of agreement in ecumenical discussion of authority and ministry may find Rausch's hook helpful. In " Authority in the Ecumenical Dialogue " Rausch reviews and summarizes the ARCIC Final Report, the Lutheran-Roman Catholic Dialogue, the WCC Baptism, Eucharist and Ministry text, and the Consultation on Church Union. The emerging consensus on the value of ordained ministry in these documents indicates that this ministry is permanent, although the threefold ministry of bishop, presbyter, and deacon stands in need of reform. Rausch notes that the documents do not limit " valid " ministry to ordained ministry in communion with the historic episcopate. As for the shape of ministry in the church of tomorrow, not surprisingly, he identifies shared responsibility and collegiality as the marks of the future exercise of authority. Among the important issues still unresolved by the churches are Petrine ministry and primacy and the problem of the " reception " of ecumenical documents. The chapter on authority and reception, originally published in Theological Studies, may well be the most original contribution of the book. It broadens the discussion of reception from its historical " classical " understanding as " the acceptance by local churches of particular ecclesiastical or conciliar decisions " to an ecumenical understanding of the concept as " the acceptance by one church of a theo- 166 BOOK REVIEWS logical consensus arrived at with another church, and ultimately, the recognition of the other church's faith and ecclesial life as authentically Christian (p. 103)." He concludes that (1) reception is more properly understood as a process rather than as a juridical determination, (2) it also involves formal decisions on the part of church authorities, (3) it cannot be reduced to the acceptance of doctrinal formulations, and (4) the norm for recognizing a common faith is not agreement with a particular ecclesial position but agreement with the apostolic tradition. Ultimately, reception involves the whole church and is not the sole product of theologians or church authorities. Ecumenical dialogues will only be effective when they enter into the practical life of the churches. In "Imaging Tomorrow's Church: Models of Christian Unity" Rausch summarizes four models of church unity: organic union, conciliar fellowship, reconciled diversity, and communion of Churches. He opts for the fourth model. The chapter does not offer any new information to someone familiar with ecumenical discussions, but it does serve as an introduction for the neophyte. Rausch's image of authority in the future lies somewhere between a strictly hierarchical or institutional model and a more egalitarian model. His final chapter, " Authority in Tomorrow's Church," predicts that the church of the future will be " ordered " in the sense that it will combine an authoritative ordained ministry (based on the church's apostolic office) with a recognition of multiple and diverse charismatic gifts. He retrieves Karl Rahner's suggestion that recognition of charism for leadership in an individual may result in that person's " relative" ordination for a particular local community. Authority of the future will be collegial with a more participatory style of decision-making. The renewed papacy will encourage not only a more participatory style of decision-making but also a broader participation in the formulation of church teaching. This example of a “hard case” in sport officiating sets Aaron Harper’s book Sport Realism: A Law-Inspired Theory of Sport in motion. Harper’s aim in Sport Realism is to provide a new “theory of sport” drawing primarily from American legal realism—and supplemented by philosophical pragmatism and virtue jurisprudence. Sport realism, Harper argues, serves as the best resource to understand how rules are applied in sport and how officials make in-game decisions, and it highlights the importance of participants being able to develop an expectation for how calls will be made in the future and to make difficult normative judgments.In chapter 1, Harper provides an excellent overview of the sport philosophy literature related to “theories of sport.” Using a chronological approach, he develops a clear and extensive “history” of the evolution of the field’s most influential theories and their connections to legal theory. Harper summarizes how formalism’s rigid commitment to “constitutive” rules that supposedly define a sport led to criticisms from conventionalists who alternatively generated their account of how nonwritten rules or a sporting ethos defines how a sport is played. However, the laissez-faire nature of conventionalism, as well as the inflexibility of formalism, gave rise to now-dominant interpretivist theories of sport that Harper covers in significant detail. Primarily inspired by Ronald Dworkin, philosophers developed theories that relied on the interpretation of principles that affirmed a sport’s point and purpose. Emergent formulations of interpretivism—from realist accounts to antirealist/historicist versions—all relied on the interpretation of some essential starting point (rules, principles, ethos, deep conventions) to both explain sport and provide officials with normative guidance.Harper regularly lauds interpretivism as the best theory of sport developed to date. However, in chapter 2 he highlights deficiencies with interpretivist accounts via two case studies: New York Yankees’ pitcher Michael Pineda’s “illegal” use of pine tar to improve his grip on the [End Page 147] baseball, as well as Tiger Woods taking a favorable drop after hitting his golf ball into a water hazard. As algorithms have become ubiquitous in consequential domains, societal concerns about the potential for discriminatory outcomes have prompted urgent calls to address algorithmic bias. In response, a rich literature across computer science, law, and ethics is rapidly proliferating to advance approaches to designing fair algorithms. Yet computer scientists, legal scholars, and ethicists are often not speaking the same language when using the term ‘bias.’ Debates concerning whether society can or should tackle the problem of algorithmic bias are hampered by conflations (...) of various understandings of bias, ranging from neutral deviations from a standard to morally problematic instances of injustice due to prejudice, discrimination, and disparate treatment. This terminological confusion impedes efforts to address clear cases of discrimination. -/- In this paper, we examine the promises and challenges of different approaches to disambiguating bias and designing for justice. While both approaches aid in understanding and addressing clear algorithmic harms, we argue that they also risk being leveraged in ways that ultimately deflect accountability from those building and deploying these systems. Applying this analysis to recent examples of generative AI, our argument highlights unseen dangers in current methods of evaluating algorithmic bias and points to ways to redirect approaches to addressing bias in generative AI at its early stages in ways that can more robustly meet the demands of justice. In this position paper, we introduce a new epistemic lens for analyzing algorithmic harm. We argue that the epistemic lens we propose herein has two key contributions to help reframe and address some of the assumptions underlying inquiries into algorithmic fairness. First, we argue that using the framework of epistemic injustice helps to identify the root causes of harms currently framed as instances of representational harm. We suggest that the epistemic lens offers a theoretical foundation for expanding approaches to algorithmic (...) fairness in order to address a wider range of harms not recognized by existing technical or legal definitions. Second, we argue that the epistemic lens helps to identify the epistemic goals of inquiries into algorithmic fairness. There are two distinct contexts within which we examine algorithmic harm: at times, we seek to understand and describe the world as it is, and, at other times, we seek to build a more just future. The epistemic lens can serve to direct our attention to the epistemic frameworks that shape our interpretations of the world as it is and the ways we envision possible futures. Clarity with respect to which epistemic context is relevant in a given inquiry can further help inform choices among the different ways of measuring and addressing algorithmic harms. We introduce this framework with the goal of initiating new research directions bridging philosophical, legal, and technical approaches to understanding and mitigating algorithmic harms. (shrink)

Analytic theology can flourish in the secular academy, and flourish as authentically Christian theology. Analytic Theology and the Academic Study of Religion explains analytic theology to other theologians and scholars of religion, while simultaneously explaining those other fields to analytic theologians. This paper uses Popper's treatment of probability and an epistemic constraint on probability assignments to conditionals to extend the Bayesian representation of rational belief so that revision of previously accepted evidence is allowed for. Results of this extension include an epistemic semantics for Lewis' theory of counterfactual conditionals and a representation for one kind of conceptual change.

A classic objection to autonomous weapon systems (AWS) is that these could create so-called responsibility gaps, where it is unclear who should be held responsible in the event that an AWS were to violate some portion of the law of armed conflict (LOAC). However, those who raise this objection generally do so presenting it as a problem for AWS as a whole class of weapons. Yet there exists a rather wide range of systems that can be counted as “autonomous weapon (...) systems”, and so the objection is too broad. In this article I present a taxonomic approach to the objection, examining a number of systems that would count as AWS under the prevalent definitions provided by the United States Department of Defense and the International Committee of the Red Cross, and I show that for virtually all such systems there is a clear locus of responsibility which presents itself as soon as one focuses on specific systems, rather than general notions of AWS. In developing these points, I also suggest a method for dealing with near-future types of AWS which may be thought to create situations where responsibility gaps can still arise. The main purpose of the arguments is, however, not to show that responsibility gaps do not exist or can be closed where they do exist. Rather, it is to highlight that any arguments surrounding AWS must be made with reference to specific weapon platforms imbued with specific abilities, subject to specific limitations, and deployed to specific times and places for specific purposes. More succinctly, the arguments show that we cannot and should not aim to treat AWS as if all of these shared all morally relevant features, but instead on a case-by-case basis. Thus, we must contend with the realities of weapons development and deployment, and tailor our arguments and conclusions to those realities, and with an eye to what facts obtain for particular systems fulfilling particular combat roles. But what if we read Heidegger with the same respectful irreverence that he brought to reading the Greeks, Kant, Hegel, Husserl and the others? For Wood, it is Derrida's engagements with Heidegger that set the standard here – enacting a repetition through transformation and displacement. But Wood is not content to crown (...) the new king. Instead he sets up a many-sided conversation between Heidegger, Hegel, Adorno, Nietzsche, Blanchot, Kierkegaard, Derrida and others. Derrida and deconstruction are first critically addressed and then drawn into the fundamental project of philosophical renewal, or renewal _as_ philosophy. The book begins by rewriting Heidegger's inaugural lecture, 'What is Metaphysics?' and ends with an extended analysis of the performativity of his extraordinary _Beitrage_. _Thinking after Heidegger_ will be a valuable text for scholars and students of contemporary philosophy, literature and cultural studies. Few outstanding questions in the human behavioral sciences are timelier or more urgently debated than the evolutionary source of religious behaviors and beliefs. Byproduct theorists locate the origins of religion in evolved cognitive defaults and transmission biases. Others have argued that cultural evolutionary processes integrated non-adaptive cognitive byproducts into coherent networks of supernatural beliefs and ritual that encouraged in-group cooperativeness, while adaptationist models assert that the cognitive and behavioral foundations of religion have been selected for at more basic levels. Here, (...) we survey these differing approaches, noting their respective strengths and weaknesses. We then advance a novel model that centers on the ability of language to generate alternative worlds independent of immediate empirical facts, and thus highlight the similarities between religious belief and the modes of cognition that underlie institutions in general. The institutional cognition model of religion accounts for some of the shortcomings of extant approaches and draws attention to the human ability to create non-empirical worlds; that is, worlds that are imaginary. Both religious beliefs and institutional facts—such as jurisdictional borders—are non-empirical assertions, yet they are socially accepted as truths and reified through ritual and behavior. One type of non-empirical, linguistically generated belief—supernatural agent belief—is particularly effective for stabilizing systems of arbitrary norms by rooting them in deontic rather than utilitarian reasoning. The evolutionary roots and continued persistence of religion are thus functions of the capacity for humans to generate cognitive alternatives to empirical reality, and the need to stably coordinate those alternative conceptions. Is exploitation always unjust? Is it by definition unjust? If we answer both these questions negatively, as I do, then we need to ask: when is exploitation unjust and when is it not? Exploitation is the use of a vulnerability for the exploiter's ends. This is sometimes morally wrong, even when it is not unjust. But it is unjust when it violates the exploited person's rightful freedom. When is labor for hire exploitative? Whenever the terms of the labor contract permit (...) either the employer or the employee to make use of the vulnerability of the other. But when is such exploitation unjust? When it involves the ownership by either of the conditions of life of the other, because then one is in a position of control over the other and deprives the other of a free mode of life. In capitalist wage labor, this is often the case—the employer, or a class to which the employer belongs, owns the conditions of life for the employed. When this is so, the employed do not have the free life which is basic to human rights. (shrink)

Due to advances in military technology, there has been an outpouring of research on what are known as autonomous weapon systems (AWS). However, it is common in this literature for arguments to be made without first making clear exactly what definitions one is employing, with the detrimental effect that authors may speak past one another or even miss the targets of their arguments. In this article I examine the U.S. Department of Defense and International Committee of the Red Cross definitions (...) of AWS, showing that these definitions are far broader than some recognize, and that they therefore classify a much larger set of weapons as AWS. I then show that these broader views of AWS have implications for what moral and legal rules we might argue should be applied to such systems. I conclude by arguing there is a greater need for precision and clarity within AWS debates, in order to ensure that researchers are discussing the same weapon systems (autonomous or otherwise) when they argue for or against particular points. The purpose of this article is not to defend any specific view of AWS, nor to further any general endorsement or objection to such systems, but rather to show the importance of argumentative clarity in this debate. The Akaike Information Criterion can be a valuable tool of scientific inference. This statistic, or any other statistical method for that matter, cannot, however, be the whole of scientific methodology. In this paper some of the limitations of Akaikean statistical methods are discussed. It is argued that the full import of empirical evidence is realized only by adopting a richer ideal of empirical success than predictive accuracy, and that the ability of a theory to turn phenomena into accurate, agreeing measurements (...) of causally relevant parameters contributes to the evidential support of the theory. This is illustrated by Newton's argument from orbital phenomena to the inverse-square law of gravitation. (shrink)

Discourses of recovery and resilience have risen to positions of dominance in the mental health field. Models of recovery and resilience enjoy purchase, in both policy and practice, across a range of settings from self-described psychiatric survivors through to mental health charities through to statutory mental health service providers. Despite this ubiquity, there is confusion about what recovery means. In this article we problematize notions of recovery and resilience, and consider what, if anything, should be recovered from these concepts. We (...) focus on three key issues, i) individualization, ii) the persistence of a deficit model, and iii) collective approaches to recovery. Through documentary analysis we consider these issues across third sector organizations, and public and mental health policy. Firstly, definitional debates about recovery reflect wider ideological debates about the nature of mental health. The vagueness of these concepts and implicit assumptions inherent in dominant recovery and resilience discourses render them problematic because they individualize what are social problems. Secondly, these discourses, despite being seen as inherently liberatory are conceptually dependent on a notion of deficit in that talk of “positives” and “strengths” requires the existence of “negatives” and “weaknesses” for these concepts to make sense. We argue that this does little to substantially transform dominant understandings of psychological distress. Thirdly, these issues combine to impact upon the progressive potential of recovery. It comes to be seen as an individualistic experiential narrative accompaniment to medical understandings where the structural causes of distress are obscured. This in turn impacts upon the potential for recovery to be used to explore more collective, political aspects of emotional distress. Drawing on the work of Fraser, we use this critique to characterize “recovery” as a “struggle for recognition,” founded on a model of identity politics which displaces and marginalizes the need for social, political and economic redistribution to address many of the underlying causes of emotional distress. We conclude by stating that it is only when the collective, structural experiences of inequality and injustice are explicitly linked to processes of emotional distress that recovery will be possible. Although'Otherness' is an extremely common phenomenon in every society, related research is still at its beginnings.'Otherness' in the Middle Ages is a versatile and complex theme that covers a great number of different aspects, facets, and approaches: from non-human monsters and cultural strangers from remote places up to foreigners from another country or another town; it can refer to ethnic, cultural, political, social, sexual, or religious'Otherness', inside or outside one's own community. In any case, however,'Otherness' is a subjective phenomenon depending (...) on personal views and ascriptions, an issue of'imagination' and experience rather than'reality'. There is neither one single model of alterity nor is'Otherness' a stable phenomenon, but it changes over time and according to the cultural context. All this calls for methodological reflection and needs thorough investigation.00The methodological introduction and the 18 contributions of this volume demonstrate the great diversity of the theme and its different manifestations and perspectives. They tackle the problem from distinct angles and disciplines (history, art history, archaeology, literary history, and philology) in a wide chronological and thematic frame, using different methodological approaches, dealing with different areas (from Northern and Southern Europe to Byzantium and India), perspectives (including law, social order, the past, a sea), and diverse kinds of sources. They examine all kinds of'Otherness' mentioned above, highlight demarcation and rejection, aversion or acceptance, assimilation and integration, thus relativizing a strict dichotomy between'the Self' and'the Other' or between inside and outside. This volume is so far the most comprehensive attempt to tackle the huge problem of'Otherness' in the Middle Ages. (shrink)

I take Newton's arguments to inverse square centripetal forces from Kepler's harmonic and areal laws to be classic deductions from phenomena. I argue that the theorems backing up these inferences establish systematic dependencies that make the phenomena carry the objective information that the propositions inferred from them hold. A review of the data supporting Kepler's laws indicates that these phenomena are Whewellian colligations-generalizations corresponding to the selection of a best fitting curve for an open-ended body of data. I argue that (...) the information theoretic features of Newton's corrections of the Keplerian phenomena to account for perturbations introduced by universal gravitation show that these corrections do not undercut the inferences from the Keplerian phenomena. Finally, I suggest that all of Newton's impressive applications of Universal gravitation to account for motion phenomena show an attempt to deliver explanations that share these salient features of his classic deductions from phenomena. This Element defends a reading of Kant's formulas of the moral law in Groundwork of the Metaphysics of Morals. It disputes a long tradition concerning what the first formula attempts to do. The Element also expounds the Formulas of Humanity, Autonomy and the Realm of Ends, arguing that it is only the Formula of Humanity from which Kant derives general duties, and that it is only the third formula that represents a complete and definitive statement of the moral principle as (...) Kant derives it in the Groundwork. The Element also disputes the claim that the various formulas are 'equivalent', arguing that this claim is either false or else nonsensical because it is grounded on a false premise about what Kant thinks a moral principle is for.
