What challenges are you experiencing in ensuring the protection and security of your project data, and compliance with the GDPR, within existing data management processes/systems? What information/tools/resources do you need to overcome these challenges? (...) What are the best formats/channels for receiving, sharing and acting upon this information? ICTs, personal data, digital rights, the GDPR, data privacy, online security… these terms, and the concepts behind them, are increasingly common in our lives. Some of us may be familiar with them, but others are less aware of the growing role of ICTs and data in our lives - and the potential risks this creates. These risks are even more pronounced for vulnerable groups in society. People can be vulnerable in different, often overlapping, ways, which place them at a disadvantage (...) to the majority of citizens; Table 3 in this guide presents some of the many forms and causes of vulnerability. As a result, vulnerable people need greater support to navigate the digital world, and to ensure that they are able to exercise their rights. This guide explains where such support can be found, and also answers the following questions: - What are the main ethical and legal issues around ICTs for vulnerable citizens? - Who is vulnerable in Europe? - How do issues around ICTs affect vulnerable people in particular? This guide is a resource for members of vulnerable groups, people who work with vulnerable groups, and citizens more broadly. It is also useful for data controllers1 who collect data about vulnerable citizens. While focused on citizens in Europe, it may be of interest to people in other parts of the world. It forms part of the Citizens’ Information Pack produced by the PANELFIT project, and is available in English, French, German, Italian and Spanish. In this article, we review empirical evidence regarding the relationship between facial expression and emotion during infancy. We focus on differential emotions theory’s view of this relationship because of its theoretical and methodological prominence. We conclude that current evidence fails to support its proposal regarding a set of pre-specified facial expressions that invariably reflect a corresponding set of discrete emotions in infants. Instead, the relationship between facial expression and emotion appears to be more complex. Some facial expressions may have different (...) meanings in infants than in children and adults. In addition, nonemotion factors may sometimes lead to the production of “emotional” facial expressions. We consider alternative perspectives on the nature of emotion and emotional expression in infancy with particular focus on differentiation and dynamical systems approaches. (shrink)

People typically show excellent memory for information that is central to an emotional event but poorer memory for peripheral details. Not all studies demonstrate memory narrowing as a result of emotion, however. Critically important emotional information is sometimes forgotten; seemingly peripheral details are sometimes preserved. To make sense of both the general pattern of findings that emotion leads to memory narrowing, and findings that violate this pattern, this review addresses mechanisms through which emotion enhances and impairs memory. Divergent approaches to (...) characterising information as central versus peripheral are also addressed. By directly contrasting these approaches, and the evidence supporting them, this review helps to clarify when and how emotion enhances memory and provides directions for future research. Evidence shows that memory narrowing as a result of emotion, and a number of violations of the memory narrowing pattern, can be explained by the view that emotion enhances memory for information relevant to currently active goals. Today''s business students have grown up in a society where distinctions between right and wrong have become blurred and where unethical behavior is observed and even expected in high-profile leaders. Especially troubling is the impression educators have that many students no longer view cheating as morally wrong (Pavela and McCabe, 1993). By contrast, the general public is demanding higher ethics of businesspeople. In this environment, educators are challenged to instill ethical norms in business students, especially when recent research indicates that (...) students intending to enter business fields are more likely than any other group of students to engage in cheating and other forms of academic dishonesty (McCabe and Trevino, 1995). One of the major future roles of accounting students depends on their honesty, however. For audits to have economic value, the auditors must be perceived by the public as acting with independence, integrity, and objectivity. Public accountants have adopted a Code of Professional Conduct in order to protect the integrity of the profession. In an effort to teach accounting students the importance of ethical professional conduct, the author has developed a class project wherein groups of students write proposals for a student honor code at Niagara University. In the following we shall see, however, that Chisholm’s interpretation of Brentano’s intentionality doctrine is not wholly accurate, and that while the doctrine he sets forth as Brentano’s is an interesting and provocative one, it gives a misleading impression of what Brentano’s views actually were, by obscuring almost entirely the specific nature of the question Brentano was trying to solve, and by misreading the answer Brentano gave. If only for the sake of historical accuracy a corrective should be given, but, (...) of course, taking another look at Brentano’s particular way of construing the mind/body problem and the solution he put forth may also prove to be suggestive in its own right. Whether or not to grant ‘amnesty’ has been a contentious policy issue in a wide range of settings, from human rights violations to draft avoidance to library fines. Recently, the idea of amnesty has come to structure many debates over irregular immigration. While amnesty’s meaning is usually treated as self-evident, the term in fact signifies in a variety of normative directions. This article employs amnesty as an optic to examine accountability questions that structure normative debates over irregular immigration in liberal (...) states. It distinguishes among conceptions of amnesty emphasizing forgiveness, erasure and vindication, and argues that developing a vindicatory account of amnesty is both particularly difficult and particularly necessary in the immigration setting. In this article, Ms. Krieger explores the controversy concerning pregnancy disability leave presented by the case of California Federal Savings v. Guerra in light of Thomas Kuhn's model of scientific paradigm change and Carol Gilligan's theory regarding sex differences in moral reasoning. She argues that the controversy reflects a period of paradigm crisis in equality jurisprudence, brought about in part by the recent inclusion of greater numbers of women into the jurisprudential community.

Can artifacts be agents in the same sense as humans? This paper endorses a pragmatic stance to that issue. The crucial question is whether artifacts can have free will in the same pragmatic sense as we consider humans to have a free will when holding them responsible for their actions. The origin of actions is important. Can an action originate inside an artifact, considering that it is, at least today, programmed by a human? Emotion theories based on research with adults must be able to accommodate developmental data if they are to be deemed satisfactory accounts of human emotion. Inspired in part by theory and research on adult emotion, developmentalists have investigated emotion-related processes including affect elicitation, internal and overtly observable emotion responding, emotion regulation, and understanding emotion in others. Many developmental studies parallel investigations conducted with adults. In this article, we review current theories of emotional development as well as research related to the (...) several aspects of emotion designated above. Beyond providing an overview of the field, we hope to encourage greater cross-fertilization and research collaboration between developmental psychologists and scholars who focus on adult emotion. In this paper I explore the filmakers' intention of making a film about Martin Heidegger's 1942 lecture series on Friedrich Holderlin's poem, 'Der Ister,' as an 'act of philosophical expression'. With and against Heidegger's principles of thought and the possibilities of expression, I argue the filmmakers undermine its generic classification as an essay film through interruption, a technique that is exemplary of Holderlin's poetry.

This article was developed from a paper given at an international conference on the influence of Malthus, held in Paris in January 1980; its purpose was to suggest the way in which the U.S. experience of Malthusianism and neo-Malthusianism was profoundly different from that in Europe . Thus the points made here were chosen specifically to hightlight the U.S.-European contrasts. The paper draws on materials and arguments in numerous articles and a book on the subject by myself. Should the private sector concern itself with the health of the communities in which it operates? Should the community look to local businesses for collaboration in the effort to elevate the health of its citizens? Is there an opportunity between the public and private sectors to create shared value through the enhancement of public health? These are questions this paper explores and analyzes, using theoretical models that originate in disparate literatures.

Professor Reimer presents several interesting cases meant both to extend and test the limits of our proposal. We appreciate this approach and respond to each case in turn.Genes and AlcoholismSuppose Alejandro, an adult raised by adoptive parents, struggles with alcohol addiction. He learns that his biological parents died of alcoholic liver disease and comes to believe that his alcohol problem is caused by a genetic propensity toward alcohol abuse. One can ask: “Does an understanding first approach have the potential to undermine the sense of agency that is necessary for the effective treatment of maladaptive traits?”Answer: It can be explained to Alejandro that genetic proclivities are just that—proclivities—that can be overridden. In fact, behavior can alter our very genes—although not at the sequence level— changes known as “epigenetic.” And the liver disease of the biological parents can serve as a cautionary tale. If even in light of these considerations, Alejandro’s tendency to see genetic propensities as deterministic persists, it is worth asking why. There is no evidence that “genes are destiny,” so the disposition to see them that way must have a psychological explanation. What is the explanation? A self-destructive desire? Fear of freedom? This exploration can itself be empowering. [End Page 211]Adaptive ForgettingSuppose Beata, who has an eating disorder, was molested by her own father when she was a child. Subsequently, her father shot himself and now she has no recollection of the molestation. However, Beata’s eating disorder is largely a result of those experiences. It is quite possible that if Beata were to recall being molested, that would do more harm than good. In this connection, one can ask together with Reimer: “Does an understanding first approach have the potential to undermine an adaptive ‘forgetting’ of root causes of maladaptive traits?”Answer: Here, understanding the history, instead of forgetting it, might allow Beata to gain insight into and empathize with possible motives that may have led to becoming obese. For example, she might have the phantasy that if she had been obese and unattractive, she could have prevented the molestation—hence, become that way now to prevent it from happening again, and more wishfully reverse it. (In unconscious goings-on time is thought to be in the “unexamined present” (Brakel 2009, p. 63; 2015, p. 131; 2022, p. 4; 2023, p. 404.) One benefit of this is that in gaining this type of recognition, Beata might find it easier to change her behavior that she otherwise would not have; it was never her responsibility to prevent her own molestation, and there is no reason whatsoever for her to now make herself unattractive to her deceased father, and very little reason to remain obese in an attempt to deter current day men.Ego-Syntonic Maladaptive TraitsClaire is a concert pianist and alcoholic. Importantly, Claire does not see her own desire for alcohol as destructive but rather, as something constitutive of her own identity. “I wouldn’t be myself without alcohol,” she says. Reimer asks whether our approach would “work for cases where the agent sees a maladaptive trait as constitutive of their identity?”Answer: Although no approach can guarantee success, our claim is that our approach has a better chance than the main alternative known as the pruning view. Ainda que Said e Bakhtin tenham se engajado de forma diferente na política de suas respectivas épocas e que tivessem ideias distintas sobre a relação entre ética e política, seus escritos abrangentes têm sido adaptados e suas ideias apropriadas por estudiosos em diferentes áreas - com frequência, as mesmas. Eles compartilharam a paixão pelo diálogo, explorando a alteridade e a exotopia, e (...) acreditando na responsa-habilidade. O que o romance era para Bakhtin, o pianismo era para Said, como crítico musical. Said nunca desempenhou o papel de guia do consumidor ou de guardião. Era antes o par crítico ou o professor que atribui menções. A variedade de possíveis respostas do público sempre condicionou as suas. Em toda sua vida musical Said pensou como Bakhtin, talvez sem saber disso. As críticas musicais de Said eram, por definição, respostas ou réplicas. Eram híbridas, narrações e transmissões bivocais, mas também apropriações, como eram os romances aos olhos de Bakhtin. Os escritos de Said sobre música foram analisados à luz de vários conceitos-chaves de Bakhtin: dialogismo, endereçamento, responsa-habilidade e o papel do contexto.ABSTRACT The article reads the work of the postcolonial theorist Edward Said through a Bakhtinian lens. Although Said and Bakhtin engaged differently with the politics of their time and had different ideas on the relationship between ethics and politics, their wide-ranging writings have been adapted and their ideas appropriated by scholars in many different fields-often the same ones. They shared a passion for dialogue, for exploring otherness and outsidedness, and for believing in response-ability. What the novel was to Bakhtin, pianism was to Said, the music reviewer. Said never played the role of consumer guide or gate-keeper. He was more the peer reviewer or the grade-assigning professor. The multiple possible responses of the audience always conditioned his own. Said thought like Bakhtin all his musical life, perhaps without knowing it. Said's music reviews are, by definition, responses or rejoinders. They are hybrid, double-voiced narrations and transmissions, but also appropriations, as was the novel, in Bakhtin's eyes. Said's writings on music are analyzed in light of several key Bakhtinian concepts: dialogism, addressivity, response-ability, and the role of context. (shrink)

In this essay, I explore the question of who should determine what an ambiguous tax statute means, the courts or the Department of Treasury. The answer to that question is based on two administrative law doctrines: Chevron and Brand X. Here, I explain why Chevron and Brand X violate the Administrative Procedure Act and are unworkable. Then, using a provision in the tax code, I propose that we return to a standard that is both consistent with the APA and easier (...) to implement: Skidmore. (shrink)

This book examines the works of major artists between the seventeenth and nineteenth centuries, as important barometers of individual and collective values toward non-human life. Once viewed as merely representational, these works can also be read as tangential or morally instrumental by way of formal analysis and critical theories. Chapter Two demonstrates the discrimination toward large and small felines in Genesis and The Book of Revelation. Chapter Three explores the cruel capture of free roaming animals and how artists depicted their (...) furs, feathers and shells in costume as symbols of virtue and vice. Chapter Four identifies speciest beliefs between donkeys and horses. Chapter Five explores the altered Dutch kitchen spaces and disguised food animals in various culinary constructs in still life painting. Chapter Six explores the animal substances embedded in pigments. Chapter Seven examines animals in absentia-in the crafting of brushes. The book concludes with the fish paintings of William Merritt Chase whose glazing techniques demonstrate an artistic approach that honors fishes as sentient beings. (shrink)

Despite Robert Boyle’s enthusiasm as a leading chemist in the early years of the Royal Society, his experiments on animals raised acute moral and theological issues in regard to animal suffering. Many years after Boyle’s experiments in the scientific field of pneumatics, Joseph Wright of Derby painted a complex representation of Boyle’s early experiment called An Experiment on a Bird in an Air Pump. I use an art historical methodology to resituate Wright’s imagined painting of group performance as a microcosm (...) of 18th-century morality against the backdrop of Boyle’s profound eschatological beliefs and earlier discourse on animal ethics. ABSTRACTTwo categories of ethical questions surrounding military autonomous systems are discussed in this article. The first category concerns ethical issues regarding the use of military autonomous systems in the air and in the water. These issues are systematized with the Laws of Armed Conflict as a backdrop. The second category concerns whether autonomous systems may affect the ethical interpretation of LOAC. It is argued that some terms in LOAC are vague and can be interpreted differently depending on which ethical normative (...) theory is used, which may increase with autonomous systems. The impact of Unmanned Aerial Vehicles on the laws of war will be discussed and compared to Maritime Autonomous Systems. The conclusion is that there is need for revisions of LOAC regarding autonomous systems, and that the greatest ethically relevant difference between UAVs and MAS has to do with issues connected to jus ad bellum – particularly lowering the threshold for starting war – but also the sen...
