With regard to organ donation, Germany is an ‘opt-in’ country, which requires explicit consent from donors. The relatives are either asked to decide on behalf of the donors’ preferences, if these are unknown or if the potential donor has explicitly transferred the decision to them. At the core of this policy lies the sociocultural and moral premise of a rational, autonomous individual, whose rights require legal protection in order to guarantee a voluntary decision. In concrete transplantation practices, the family plays (...) an even more important role. Potential donors and their families decide while being embedded in relations, a point which does still not gain full recognition. This particular discrepancy between policy and practice creates conflicts, which remain taboos of academic inquiry and public discourse. Our analysis shows a plurality of the family’s role in the transplantation process, which reveals an inner tension of the organ donation system. This tension provokes epistemic opacity on the one hand and different collective strategies as responses to discursive exclusion on the other. In future deliberations about organ donation, it is important to create spaces for open discussion, but also practices of communicative engagement, which take care of the needs and emotions attached to taboos. In the last few decades, the democratic credentials of global governance institutions have been extensively debated in the fields of international relations and political philosophy. However, despite their prominent role in the architecture of global governance, club governance institutions like the Group of Seven (G7) or the Group of Twenty (G20) have rarely been considered from the perspective of democratic theory. Focussing on the G20, this paper analyses its functions in international political practice and discusses whether, in exercising these functions, (...) the G20 exhibits a democratic deficit. As a standard of democracy, the analysis uses the all-affected principle, according to which all those who are affected by a policy decision should be given the opportunity to participate in decision-making. This paper identifies several democratic shortcomings of the G20, for instance related to the exclusion of citizens of non-member states and a lack of parliamentary and public control. By describing realisable reforms that could to some degree alleviate these shortcomings, it is shown that more democratic institutional alternatives are feasible. Thus, the ascription of a democratic deficit to the G20 is warranted. (shrink)

Global governance has a major impact on the lives of people around the world. However, traditional theories of legitimacy were usually developed for states and are not suitable for the diversity of global governance institutions that exist today. This book first develops a normative concept of legitimacy that is applicable to all political institutions. According to this concept, to regard an institution as legitimate means ascribing it the right to exercise its function in political practice. Secondly, the book discusses how (...) the use of this concept opens up new perspectives in the debate on legitimacy criteria for global governance institutions. In this context, the book analyses the relationship of legitimacy to the values of justice and democracy and discusses the role of feasibility constraints and the all-affected principle in legitimacy judgements. The concept of legitimacy as the right to function opens up the conceptual space to accommodate the insight that legitimacy criteria are not the same for all global governance institutions, but depend on their function and context. Eine Möglichkeit hierfür besteht darin, an einer engen Verbindung von Normativität (...) und Moral festzuhalten. In diesem Fall muss die Wahrheit moralischer Sätze jedoch auf eine ähnliche Art als akteursrelativ verstanden werden, wie Street die Wahrheit normativer Sätze versteht. Eine zweite Möglichkeit besteht darin, an einem absolutistischen Verständnis moralischer Sätze festzuhalten. Dann wären nach Streets Konzeption von Normativität jedoch Fälle denkbar, in denen eine Akteurin keinen normativen Grund hat, moralisch zu handeln. A large campaign has sought to destigmatize psychiatric disorders by disseminating the view that they are in fact brain disorders. But when psychiatric disorders are associated with neurobiological correlates, laypeople's attitudes toward patients are harsher, and the prognoses seem poorer. Here, we ask whether these misconceptions could result from the essentialist presumption that brain disorders are innate. To this end, we invited laypeople to reason about psychiatric disorders that are diagnosed by either a brain or a behavioral test that were (...) strictly matched for their informative value. Participants viewed disorders as more likely to be innate and immutable when the diagnosis was supported by a brain test as compared to a behavioral test. These results show for the first time that people spontaneously essentialize psychiatric conditions that are linked to the brain, even when the brain probe offers no additional diagnostic or genetic information. This bias suggests that people consider the biological essence of living things as materially embodied. (shrink)

Personalised learning systems—systems that predict learning needs to tailor education to the unique learning needs of individual students—are gaining rapid popularity. Praise for educational technology is often focused on how technology will benefit school systems, but there is a lack of understanding of how it will affect the student and the learning process. By uncovering what the meaning of ‘personal’ is in educational philosophy and as embodied in the technology, we illustrate that these two understandings are different regarding the autonomy (...) of the student. Personalised learning technology, therefore, bears the risk of failing to achieve its educational ideal of what personalisation should be. We also illustrate how personalised learning technology effects student autonomy by requiring the intensive tracking of the learning process, exposing them to privacy and data protection risks. When Black Feminist Thought by Patricia Hill Collins was published in 1990, reviewers called it "remarkable", "rich and valuable", and proclaimed, "with the publication of this book, Black feminism has moved to a new level". Now, in Fighting Words, Collins expands and extends the discussion of the "outsider within" presented in her earlier work, investigating how effectively Black feminist thought confronts the injustices African American women currently face. Collins takes on a broad range of issues -- poverty, mothering, white supremacy (...) and Afrocentrism, the resegregation of American society by race and class, the ideas of Sojourner Truth and how they can serve as a springboard for more liberating social theory. Contrasting social theories that support unjust power relations of race, class, gender, and nation with those that challenge inequalities, Collins investigates why some ideas are granted the status of "theory" while others remain "thought". "It is not that elites produce theory while everyone else produces mere thought", she writes. "Rather, elites possess the power to legitimate the knowledge that they define as theory as being universal, normative, and ideal". Collins argues that because African American women and other historically oppressed groups seek economic and social justice, their social theories may emphasize themes and work from assumptions that are different from those of mainstream American society, generating new angles of vision on injustice. Collins also puts such oppositional social theory to the test: while the words of these theories may challenge injustice, do the ideas make a difference in the lives of the people they claim to represent? Throughout,Collins provides an essential understanding of how "outsiders" resist mainstream perspectives, and what the mainstream can learn from such "outsiders". The essay theorizes the responsibilities moral agents may be said to have in relation to global structural social processes that have unjust consequences. How ought moral agents, whether individual or institutional, conceptualize their responsibilities in relation to global injustice? I propose a model of responsibility from social connection as an interpretation of obligations of justice arising from structural social processes. I use the example of justice in transnational processes of production, distribution and marketing of clothing to illustrate operations of structural (...) social processes that extend widely across regions of the world. The social connection model of responsibility says that all agents who contribute by their actions to the structural processes that produce injustice have responsibilities to work to remedy these injustices. I distinguish this model from a more standard model of responsibility, which I call a liability model. I specify five features of the social connection model of responsibility that distinguish it from the liability model: it does not isolate perpetrators; it judges background conditions of action; it is more forward looking than backward looking; its responsibility is essentially shared; and it can be discharged only through collective action. Myth, Utopia, and Political Action Starting from the premise that some form of "reality transcendence", i.e. the ability to imagine a different reality and reach out for the (un)thinkable, is necessary for political action, the aim of this paper is to analyse the concepts of myth and utopia elaborated by Georges Sorel and Karl Mannheim and to examine their possible contributions to a theory of political action and social change. By comparing the role the authors assign to rationality and irrationality (...) in human affairs, methodological and conceptual differences between Sorel's and Mannheim's approaches to the political are illustrated. It turns out that due to its immunity to critique Sorel's concept of the social myth is highly problematic. Mannheim's concept of utopia, on the other hand, culminates in a technocratic understanding of the political. Though both approaches emphasise the collective dimension of political action, they ultimately exhibit elitist understandings of the political. (shrink)

People naturally intuit that an agent's ethereal thoughts can cause its body to move. Per intuitive physics; however, one body can only interact with another. Are people, then, covertly puzzled by the capacity of thoughts to command the body? Experiment 1 first confirms that thoughts (e.g., thinking about a cup) are indeed perceived as ethereal—as less detectible in the body (brain), and more likely to exist in the afterlife relative to matched percepts (e.g., seeing a cup). Experiments 2–5 show that (...) thoughts are considered less likely to cause behavior than percepts (e.g., thinking of a cup vs. seeing one). Furthermore, mind–body causation is more remarkable when its bodily consequences are salient (e.g., moving an arm vs. brain activation). Finally, epistemic causes are remarkable only when they are ascribed to mental‐ (e.g., “thinking”) but not to physical states (“activation”). Together, these results suggest that mind–body interactions elicit a latent dualist dissonance. (shrink)

Do newborns think-do they know that 'three' is greater than 'two'? Do they prefer 'right' to 'wrong'? What about emotions--do newborns recognize happiness or anger? If they do, then how are our inborn thoughts and feelings encoded in our bodies? Could they persist after we die? Written over a span of more than two decades, the essays by Iris Marion Young collected in this volume describe diverse aspects of women's lived body experience in modern Western societies. Drawing on the ideas of several twentieth century continental philosophers--including Simone de Beauvoir, Martin Heidegger, Luce Irigaray, Julia Kristeva, and Maurice Merleau-Ponty--Young constructs rigorous analytic categories for interpreting embodied subjectivity. The essays combine theoretical description of experience with normative evaluation of the unjust constraints on their freedom and opportunity (...) that continue to burden many women. The lead essay rethinks the purpose of the category of "gender" for feminist theory, after important debates have questioned its usefulness.
