William D’Alessandro has recently argued that there are no implicit truths in fiction. According to the view defended by D’Alessandro, which he terms explicitism, the only truths in fiction are the ones explicitly expressed therein. In this essay, I argue that explicitism is incorrect on multiple counts. Not only is the argument D’Alessandro gives for it invalid, but explicitism as a theory of truth in fiction fails drastically to account for a number of phenomena that are crucial to our understanding (...) and interpretation of fiction, such as pragmatic implicatures and speech acts occurring in fiction, psychological profiles of fictional characters, and fictional truths determined by literary conventions. It is usually taken for granted, in discussions about fiction, that real things or events can occur as referents of fictional names . In this paper, I take issue with this view, and provide several arguments to the effect that it is better to take the names in fiction to refer to fictional surrogates of real objects. Doing so allows us to solve a series of problems that arise on the reference-continuity view. I also show that the arguments philosophers usually (...) rely on in order to ban surrogates are not as serious as they have been taken to be. In the first part of the paper, I describe the two conflicting views. In the second part, I discuss several specific arguments in favor of surrogates. The idea that animals should have the right to vote sounds preposterous. Accordingly, most authors who have touched on the issue dismiss it in few words as obvi.

This article is a reaction to the following argument that has been offered in favor of abstract realism about fictional characters: fictional characters do not impose any extra ontological cost on our ontology, because they belong to the same ontological kind as literary works, which we already accept. I address arguments that have been adduced by Jeffrey Goodman in defense of this argument, and I show that there is no relevant parallelism between fictional entities and literary works that the abstract (...) fictional realist can use to bolster her theory. There are two main questions that any account of corporate lawyers’ moral obligations needs to answer: (1) Do corporate lawyers have moral obligations to third parties? and (2) In cases of conflict between obligations to the corporation and obligations to third parties, which should prevail? This Article offers answers to these questions in the context of lawyers working in medical corporations. I argue that lawyers do have moral obligations to third parties, and that in cases where patients’ rights are being (...) violated by a medical company, patients’ rights should prevail. Consequently, attorney–client confidentiality rules should be relaxed to allow for attorney disclosures in egregious cases of potential harm to third parties. (shrink)

It is customary for institutions that organize sporting competitions and events to exercise a considerable degree of authority over the participants. That authority is often manifested in the enforcement of penalties for infringements of fair play. This paper focuses on one concrete case from soccer, although I take the discussion to extend to other sports as well. I argue that not all fair play rules should be enforced by the respective organizing institutions, and that enforcing all of them indiscriminately is (...) a cause of injustice, rather than promoting fairness in sports. I propose a principled way of making the necessary distinction between those fair play rules that are enforceable and those that are not. (shrink)

In this article, I set out a theoretical framework for analyzing fictional copyright protection of fictional characters in literature. Using this framework, I argue that the two most prominent approaches that U.S. courts have adopted with respect to fictional character copyright (the Nichols test and the Sam Spade “Story Being Told” test) are unsustainable. The idea of distinct delineation that came out of Nichols may be understood in two ways: on one view, fictional characters are distinctly delineated if they deviate (...) from a literary type. On the other view, they are distinctly delineated if they are attributed a sufficient number of properties in the fictions where they appear. Both views succumb to serious objections, while the test in Sam Spade is no better. The failure of the two judicial tests suggests that, instead of asking questions about fictional character copyrightability, courts should instead focus on the substantial similarity question. In the last part of the paper, I draw a distinction between two types of fictional character copyright infringement cases (transformations and transfers), and suggest that a Nichols-type substantial similarity analysis is all that is required in transformation situations. Although the focus of this article is U.S. law, the issues discussed and the analyses proposed may prove helpful in addressing fictional copyright in other jurisdictions as well. (shrink)

A patient suffering from a severe illness that is entering its terminal stage is forced to develop a coping process. Of all the coping patterns, the religious one stands out as being a psychological resource available to all patients regardless of culture, learning, and any age. Religious coping interacts with other values or practices of society, for example the model of a society that takes care of it's elder members among family or in an institutionalized environment or the way the (...) health system offers or not psychological support for a terminally ill patient. Health care providers should have at least some psychological coping patterns training because not all patterns of religious coping are equally effective, and some have been described as increasing the level of stress or producing other negative psychological effects on the patient. This article aims to review the complex models of religious coping that are unanimously accepted in psychooncology, arguments in favor of religious coping, the types of patients that use this model, ethical dilemmas that could be reinterpreted using religious arguments. Finally, we will also discuss the need of Romanian patients to embrace a religious coping in case of an incurable illness, and also the support that they can receive from both curative and palliative health care providers.  . Economic profit is produced by entrepreneurs, those special individuals able to detect and seize as yet unexploited market opportunities. Many large capitalist firms manage to deliver positive profits even in the most competitive environments. They can do so, thanks to internal entrepreneurs, a subset of their employees able to drive change and develop innovation in the workplace. This paper argues that the goal of increasing economic profit is fully consistent with the corporation doing good for society. However, there is little (...) justification for corporations to transfer the whole economic profit to shareholders. Economic agents entitled to receive the economic profit are precisely those who create this profit, namely the internal entrepreneurs. (shrink)

Formalised knowledge systems, including universities and research institutes, are important for contemporary societies. They are, however, also arguably failing humanity when their impact is measured against the level of progress being made in stimulating the societal changes needed to address challenges like climate change. In this research we used a novel futures-oriented and participatory approach that asked what future envisioned knowledge systems might need to look like and how we might get there. Findings suggest that envisioned future systems will need (...) to be much more collaborative, open, diverse, egalitarian, and able to work with values and systemic issues. They will also need to go beyond producing knowledge about our world to generating wisdom about how to act within it. To get to envisioned systems we will need to rapidly scale methodological innovations, connect innovators, and creatively accelerate learning about working with intractable challenges. We will also need to create new funding schemes, a global knowledge commons, and challenge deeply held assumptions. To genuinely be a creative force in supporting longevity of human and non-human life on our planet, the shift in knowledge systems will probably need to be at the scale of the enlightenment and speed of the scientific and technological revolution accompanying the second World War. This will require bold and strategic action from governments, scientists, civic society and sustained transformational intent. (shrink)

Drawing on recent theories and debates concerning the everydayness of non-artistic and even private aesthetic experiences, this article aims at differentiating new ways of dealing with revulsion at the intersection of negative and everyday aesthetics, as another manner of extending or transcending the scope of traditional art-oriented aesthetics. The paradigms that I will trace in the history of negative aesthetics are not mere occurrences of disgust or repulsiveness in art and in everyday life, but ways of addressing the repulsive in (...) relation to the culturally variable scope of art and aesthetics. Besides the classical paradigm that associates repugnant subjects with their pleasure-inducing imitations in art, and the transgressions of modern and contemporary art that increasingly shocked their audience, revulsion can also be regarded as a form of displeasure linked to the quotidian, yet aesthetically relevant forms of life. By virtue of this ordinary nature, which is not unfamiliar to other (non-Western) cultures, revulsion could be placed at the core of everyday aesthetics, since it confirms both the transition from contemplation to action in recent aesthetics, that is, the practical preoccupation with the aesthetic quality of living, and the broader redefinition of aesthetics in terms of sensory reactions. The term “rationality” is applied to many different things, from beliefs and preferences to decisions and choices, actions and behaviors, people, collectivities, andinstitutions. Therefore this paper will limit its considerations only to social preferences and choices in order to clarify the role of rationality in social explanation. The paper will focus on degrees of rationality, calling upon the concept of transitivity for help.

The relation between Christianity and nation is a very old but also a permanent theme within the Ecumenical Movement. Our aim is to explain why this relation is so important for us, the Europeans, because Europe is in fact, a continent of nations that have to be known by their traditions and by the reciprocal manifestations which, unfortunately, are sometimes conflicting. This is why it is not very easy to speak or to write about it. From the Orthodox point of (...) view, the ideal of the nation can be completely integrated in the Christian ideal. Such an ideal makes possible the development of a nation’s natural qualities. It does not lead to a uniformity of nations, on the contrary, it leads to their growth within the unity of the Christian faith. (shrink)

In the context of the Union of Greater Romania, a problem specific to the development of the Romanian society and of the re-united national state was the regulation of the status or the varied religious cults. It is well known that under the Older Romanian Kingdom, the Orthodoxy was a state religion. The other cults – Lutheran, Catholic, Mosaic, and Moslem – represented small numbers of believers and had not been regulated under the law; they were tolerated. Following the Union (...) of 1918, the Romanian State came to accommodate not just one, but several denominations. Consequently, it had to clarify its relations with the cults in the Romanian provinces of Bucovina, Basarabia, Banat, and Transylvania. These cults which had not existed in the Older Kingdom functioned according to the legislative systems they had belonged to before 1918. Thus came the necessity of establishing the unitary status for the minority cults, which, given the diversity of their religious doctrines, rituals and interests, posed new problems to be settled for the government policy. This also should be the focus of the debates surrounding the forthcoming law of the cults in Romania. (shrink)

Leading invasion biologists sometimes dismiss critics and criticisms of their field by invoking “the straw man” fallacy. Critics of invasion biology are also labelled as a small group of “naysayers” or “contrarians”, who are sometimes engaging in “science denialism”. Such unfortunate labels can be seen as a way to possibly suppress legitimate debates and dismiss or minimize reasonable concerns about some aspects of invasion biology, including the uncertainties about the geographic origins and complex environmental impacts of species, and the control (...) programs against species perceived as “invasive”. In assessing the quality of the debate in this area, we examine the validity of the use of various strategies, including the “straw man” concept, and explore a range of potential logical fallacies present in some recent prominent discussions about invasion biology and so-called “invasive” species. The goal is to add some clarity to the concepts involved, point out some problematic issues, and improve the quality of the debates as the discussions move forward. (shrink)

Arguing for mathematical realism on the basis of Field’s explanationist version of the Quine–Putnam Indispensability argument, Alan Baker has recently claimed to have found an instance of a genuine mathematical explanation of a physical phenomenon. While I agree that Baker presents a very interesting example in which mathematics plays an essential explanatory role, I show that this example, and the argument built upon it, begs the question against the mathematical nominalist.

"In 2022, two cans of tomato soup were thrown over Van Gogh’s Sunflowers at the National Gallery in London by two climate activists. The aim of this paper is not to explain the motives behind the protest in terms of environmental activism, but to address the implications of this phenomenon for the status of artistic images in our time. The protest in question is one of the many symptoms of the fact that images associated with a pure state of gaze (...) have become morally dubious due to a certain moralistic turn in contemporary discourses on art. Consequently, what seems to be lost in today’s movements of moralizing aesthetics, whether in art or in environmental activism, is not only the “aura” of an artwork, but also the idea that the contemplation of beauty in and for itself would provide a foundation for humans’ moral vocation. In a gaseous state of art (Y. Michaud) in which the transient effects of things are more important than their essence, the moralistic tendencies combined with the lack of moral foundations can no longer conceive of the ethical effects of images without explicit moral content, thus calling for a new form of heteronomy in art. This article explores the development of the theme of the Life-giving Spring in Byzantine iconography. The path towards its establishment was initiated at the moment when a representation rule, an original convention was set. Thereafter, because of its diffusion in time and space, the theme became enriched by particular mentalities and sensibilities of the epochs and the communities that adopted it as a form of devotion for the Virgin Theotokos. As a result, the representations we have known so far are (...) extremely varied. CONTRIBUTION: The final purpose of this approach, as well as its contribution, is to highlight the diverse unity of the iconographic tradition and illustrate both the evolution of the theme in the painting of Romanian church artists and its gradual refinement through the incorporation of diverse nuances and new perspectives. According to the social contract theory, in order to achieve justice, people grouped themselves in societies. Historically speaking, judges appeared long before the legislator which means that justice was the first element of the social life. Therefore, it expresses the social ethics of a particular time and requires a minimum of credibility. Excessive pragmatism and utilitarianism have kidnapped more and more of what is humane, superior and sacred in the act of justice, and “secularized” it. As Eliade said in The (...) Sacred and the Profane, the sacred is something which is totally different, a space of radical otherness which overshadows the physical territory. This shading manifests itself through limitation, sequencing, reiteration and keeping what is sacred there, even in a courtroom, through ritualization. (shrink)

The transformation of the relations between reflection and reality and between concepts and their correspondent objects into themes represents even in the present a field for most heated discussions. The joining of conceptual schemes corresponding to the intellect and reality represents a problem which is still to be solved. A solution to this problem was proposed by R. Carnap in his extremely ambitious project from Der logische Aufbau der Welt (1928). Overlooked for a long time, this work has returned to (...) the philosophical spotlight in recent years, because philosophers finally realized that Carnap’s project comprises almost allthe major themes of contemporary epistemology, such as the relation between theory and reality, between concepts and experience, the major lines of a phenomenology and of a “logic of experience” or the status of language and of the concepts of science. Situated at the confluence of some philosophical traditions such as neo-kantian philosophy, the logical analysis of Russell and Wittgenstein, but also phenomenology, Carnap’s program in Aufbau starts from some premises such: the need to control experience (= major stake of any scientific knowledge); the orientation towards form of the modern concept of scientific knowledge (under Kant’s direct influence); the assertion of a concept of knowledge mostly relational or structural (issue resulted in the orientation towards form of modern knowledge); the need for a methodology engaged in a constructive way and modelled on mathematical thinking; our reporting to the instance of sensitivity in the formation of experience (under E. The article presents the preliminary results of the author’s study of the unedited homily De transfiguratione et eleemosyna, ascribed to John Chrysostom. The question of the manuscript tradition is first discussed. The article shows that Maurice Sachot is right when he indicates only the manuscript Romanus Angelicus gr. 125 as a manuscript witness of this homily and that the other two witnesses indicated by Pinakes are erroneous. Then, the descriptions of the folios that preserve the homily are analysed in the (...) light of a new examination of them. This re-examination shows that hitherto several sources that inspired the compiler have gone unnoticed. This is followed by a brief summary of the contents of the homily and an analysis of the passages in which almsgiving is mentioned.Contribution: The article offers a re-examination of the folios 353v–361 from the manuscript Romanus Angelicus gr. 125, the first presentation of the content of the homily De transfiguratione et eleemosyna, and tries to shed light on the association of the theme of the Transfiguration with almsgiving. The present study investigated the associations between social media use integration and Technological Intimate Partner Violence (TIPV) while also exploring the mediating role of the three dimensions of jealousy and the moderating role of moral absolutism. Our sample consisted of 404 adults aged 18 to 59. The results indicated a significant positive effect of social media use integration on cognitive jealousy and TIPV. Social media use integration was correlated with behavioral jealousy and TIPV, while TIPV was positively associated with all (...) three dimensions of jealousy. The moderated mediation analysis suggested that behavioral jealousy fully mediated the effect of social media use integration toward TIPV at all levels of moral absolutism, while cognitive jealousy had a partial mediating effect only at medium and high levels of moral absolutism. We discuss our findings by pointing out that (a) various dimensions of jealousy might be influenced differently by social media use integration, and (b) individuals with high levels of moral absolutism might be more prone to cognitive jealousy after being exposed to prolonged social media use. We acknowledge that our results may have limited generalizability as our sample was primarily female. Research involving larger portions of male participants would be important to pursue. (shrink)

In order to study the intelligent collection system of moving object trajectory data under cloud computing, information useful to passengers and taxi drivers is collected from massive trajectory data. This paper uses cloud computing technology, through clustering algorithm and density-based DBSCAN algorithm combined with Map Reduce programming model and design trajectory clustering algorithm. The results show that based on the 8-day data of 15,000 taxis in Shenzhen, the characteristic time period is determined. The passenger hot spot area is obtained by (...) clustering the passenger load points in each time period, which verifies the feasibility of the passenger load point recommendation application based on trajectory clustering. Therefore, in the absence of holidays, the number of passenger hotspots tends to be stable. It is reliable to perform cluster analysis. The recommended application has been demonstrated through experiments, and the implementation results show the rationality of the recommended application design and the feasibility of practice. The contributors to this volume examine recent controversies about the importance of common sense psychology for our understanding of the human mind. Common sense provides a familiar and friendly psychological scheme by which to talk about the mind. Its categories tend to portray the mind as quite different from the rest of nature, and thus irreducible to physical matters and its laws. In this volume a variety of positions on common sense psychology from critical to supportive, from exegetical to speculative, (...) are represented. Among the questions posed are: Is common sense psychology an empirical theory, a body of analytic knowledge, a practice or a strategy? If it is a legitimate enterprise can it be naturalized or not? If it is not legitimate can it be eliminated? Is its fate tied to our understanding of consciousness? Should we approach its concepts and generalizations from the standpoint of conceptual analysis or from the philosophy of science? (shrink)

The present study intends to demonstrate that there is no logical-formal inconsistency in the Christian Trinity. However, the demonstration requires specific tools, other than those of classical logic. There are many older or newer attempts that try to remove the thesis of the inconsistency of the Christian Trinity. There is often a call for mathematical tools. As far as we are concerned, we will appeal to co -inherence and the nesting relationships specific to the Christian Trinity, as they appear especially (...) in Augustine’s work. We advance the hypothesis that Augustine's metaphor "heaven of heavens" has a foundational role in the logical plane of explanation. In this sense, Augustine points out that in the "heaven of heavens", reason does not know "in part", but it knows everything suddenly, entirely, as in a totality. This totality with a founding role functions as a principle, which we can call the principle of free totality. But the co -belonging of entities in the free and founding totality also expresses co -inherence. Divine persons are an emanation of God. That is why we are talking about co -inherence. The "co" particle points out that the starting point is in the free totality of God, and that this totality logically precedes the rest of the process. Thus, we can consider the term "the Christian Trinity" as a nested term, as co -habitation. The totality of God is not a generalization in the spirit of the Aristotelian abstraction, but rather a particularity, a "personalization" that does not cancel the individual, but it highlights in instantiation. In this sense, the Christian God is not an abstraction, but a divine Being in three persons, in whom He instantiates. The logic of this process is the one of vagueness. (shrink)

The first part is dedicated to the different accounts on secularization that may be applied to European countries: the classical Weber theory that view secularization as an “iron law” of any society, the institutional secularization, secularization as the decline and adequacy of religious practice, the continuation of the classical theory in the 60’s and beyond, the criticism of this theory and the particular argument of the increase of fundamentalist religious movements. The attempts to formulate new theories on secularization based on other assumptions than the classical one are also presented. The increased presence of religion in private life does not mean a decrease of religion in the public space but rather a new definition of it. Despite the different intensity of belief in national terms, some trends like “believing without belonging” are common, meaning that secularization could have a single meaning in Europe, apart from other continents. The second part starts with presenting the three types of Church - State relationship at the national level. All these have in common the fact that the state is neutral towards religious subjects, a religious subsection is singled out within the public sphere and the state has the right to intervene in this area only as an arbiter. There is already a European law on religion and this statement is supported by examples from the Lisbon Treaty, The Charter of Fundamental Rights, different Directives and decisions of the European Court of Justice. Common rules on religion agreed at the European level helps better to understand why there is a common European model on religions, different from the national models. After taking into account the two aspects described above, a common European model on religion in the public sphere emerges as a necessary conclusion. (shrink)

Following the violent protests in the Republic of Moldova against the Communist Party – governing since 2001 – that took place in April 2009, after the release of the parliamentary elections results, the Romanian Government has adopted the measure of simplifying the fundamental and formal conditions for regaining Romanian citizenship through Government Emergency Ordinance (GEO) No. 36/2009 for modifying and completing Law on Citizenship No. 21/1991. This measure is focusing particularly on the citizens of the Republic of Moldova who wish (...) to be granted Romanian citizenship. By presenting the changes brought by GEO No. 36/2009, by comparing them to the other changes made to Law No. 21/1991 in 2007 and 2008, this article tries to answer the question of how the system of granting and regaining Romanian citizenship should be regulated, taking into account the Romanian accession to the European Union and the necessity to discard the consequences of the Ribbentrop – Molotov Pact, which was officially condemned by the Romanian Parliament in 1991. The de lege ferenda proposals made in this article have the purpose to make the system of acquiring Romanian citizenship more transparent and easier to explain to the entitled persons and to the European Union institutions monitoring the legal and illegal migration.
