This book examines philosophical approaches to linguistic vagueness, a puzzling feature of natural language that gives rise to the ancient Sorites paradox and challenges classical logic and semantics. -/- The Sorites, or Paradox of the Heap, consists in three claims: (1) One grain of sand does not make a heap. (2) One billion grains of sand do make a heap. (3) For any two amounts of sand differing by at most one grain: either both are heaps of sand, or neither (...) one is. The third claim is rendered plausible by an initial conviction that vague predicates like ‘heap’ tolerate small changes. However, the repeated application of a tolerance principle to the second claim yields the further proposition that one grain of sand does make a heap – which contradicts claim number one. Consequently, many philosophers reject or modify tolerance principles for vague predicates. -/- Inga Bones reassesses prominent responses to the Sorites and defends a Wittgensteinian dissolution of the paradox. She argues that vague predicates are, indeed, tolerant and discusses how this finding relates to the paradox itself, to the notion of validity and to the concept of a borderline case . (shrink)

This paper reassess the evaluation of ethical, legal and social issues in relation to the agile development of information systems in the domain of crisis management. The authors analyse the differing assessment needs of a move from a traditional approach to the development of information systems to an agile approach, which offers flexibility, adaptability and responds to the needs of users as the system develops. In turn, the authors argue that this development requires greater flexibility and an iterative approach to (...) assessing ELSI. The authors provide an example from the Horizon 2020 EU-funded project iTRACK to exemplify this move to an iterative approach in practice, drawing on the process of undertaking an ethical and privacy impact assessment for the purpose of this project. Many philosophical disputes, most prominently disputes in ontology, have been suspected of being merely verbal and hence pointless. My goal in this paper is to offer an account of merely verbal disputes and to address the question of what is problematic with such disputes. I begin by arguing that extant accounts that focus on the semantics of the disputed statement S do not capture the full range of cases as they might arise in philosophy. Moreover, these accounts bring in heavy (...) theoretical machinery. I attempt to show that we can capture the full range of cases with an approach that is theoretically lightweight. This approach explains verbal disputes as a pragmatic phenomenon where parties use the same utterance type S with different speaker’s meaning. Moreover, it provides an answer to the crucial question Jackson’s pragmatic account leaves, at best, highly implicit. Based on my account, we can distinguish between different ways in which disputes can be verbal and different extents to which they are defective. Distinguishing between these varieties of verbalness furthermore allows us to specify what kind of substantive issues remain to be discussed once the linguistic confusion is resolved. (shrink)

When is it morally acceptable to expose others to risk? Most moral philosophers have had very little to say in answer to that question, but here is a moral philosopher who puts it at the centre of his investigations.

On the basis of an interdisciplinary approach linking taxation, marketing, and corporate social responsibility, the present research investigates the effects of media reports on aggressive and responsible corporate tax strategies (CTSs) on corporate success with consumers. By means of two laboratory experiments (N = 150, 360), we analyze the effects of the CTSs on corporate reputation, consumer purchase intention, and the consumer’s willingness to pay. Our results suggest that aggressive CTSs diminish corporate success with consumers, whereas responsible CTSs enhance it. (...) Nevertheless, consumers are not willing to pay a price premium for products sold by responsible tax-planning companies, but rather punish aggressive tax-planning companies through a slightly lower willingness to pay. Finally, consumers’ tax morale and their attitude toward tax avoidance are important moderating variables. Given the growing level of media interest in taxation, our findings are crucial for assessing consumer-related non-tax costs and the benefits of different CTSs. (shrink)

Disposition ascription has been discussed a good deal over the last few decades, as has the revisionary metaphysical view of ordinary, persisting objects known as 'fourdimensionalism'. However, philosophers have not merged these topics and asked whether four-dimensional objects can be proper subjects of dispositional predicates. This paper seeks to remedy this oversight. It argues that, by and large, four-dimensional objects are not suited to take dispositional predicates.

Formal representations of values and norms are employed in several academic disciplines and specialties, such as economics, jurisprudence, decision theory and social choice theory. Sven Ove Hansson closely examines such foundational issues as the values of wholes and the values of their parts, the connections between values and norms, how values can be decision-guiding and the structure of normative codes with formal precision. Models of change in both preferences and norms are offered, as well as a method to base (...) the logic of norms on that of preferences. Hansson has developed a unified formal representation of values and norms that reflects both their static and their dynamic properties. This formalized treatment, carried out in terms of both informal value theory and precise logical detail, will contribute to the clarification of certain issues in the basic philosophical theory of values and norms. Coherence-spaces and domains with totality are used to give interpretations of inductively defined types. A category of coherence spaces with totality is defined and the closure of positive inductive type constructors is analysed within this category. Type streams are introduced as a generalisation of types defined by strictly positive inductive definition. A semantical analysis of type streams with continuous recursion theorems is established. Two modes of reasoning are used by humans – the `theoretical' (formal) and the `empirical' (non-formal), the first operating with inside-the-syllogism information, the second utilising out-of-the-syllogism information. Cross-cultural research (since Lévy-Bruhl, and especially after Luria) and developmental research (since Piaget) discovered respectively that members of `traditional' societies and children up to a certain age are able to operate only in the empirical mode.The paper brings together diverse discussions about usage of these modes in actual discourse (Ennis, Johnson-Laird, Moore, Olson, Ong, (...) etc.). It concentrates on contradictory opinions as to whether contemporary individuals after they acquire the formal mode preserve and utilise the empirical mode. In this connection it discusses results of neurological experiments investigating performance in solving syllogisms under conditions of transitory suppression of the left or the right hemisphere (Deglin et al.) which demonstrated that one and the same person, depending on which hemisphere is suppressed, uses both strategies. The activated right hemisphere utilizes the `empirical' pattern, the activated left hemisphere utilizes the `logical' pattern. Thus both mechanisms of reasoning are present in the brain simultaneously, but each of them is controlled by different hemispheres. (shrink)

Ensuite, les bases de données de petits corpus bilingues Talkbank, HZSK, Sketchengine et CLAPOTY sont brièvement décrites pour discuter les possibilités de visualisation ainsi que de mise en disposition des données de corpus. This article is an attempt at a systematic account of decision making under greater uncertainty than what traditional, mathematically oriented decision theory can cope with. Four components of great uncertainty are distinguished: (1) the identity of the options is not well determined (uncertainty of demarcation) ; (2) the consequences of at least some option are unknown (uncertainty of consequences); (3) it is not clear whether information obtained from others, such as experts, can be relied on (uncertainty of reliance); and (4) (...) the values relevant for the decision are not determined with sufficient precision (uncertainty of values). Some possible strategy types are proposed for each of these components. Decisions related to environmental issues are used to illustrate the proposals. (shrink)

Two recent arguments purport to find a new and firmer foundation for evidentialism in the very nature of the concept of belief. Evidentialism is claimed to be a conceptual truth about belief, and pragmatism to be ruled out, conceptually. But can the conclusion of such conceptual arguments be regarded as the denial of pragmatism? The pragmatist traditionally conceived belief through its motivational role. Therefore, when confronted with conceptual evidentialism, the pragmatist should cede the term ‘belief,’ but insist that pragmatism be (...) understood as a claim about another attitude, a motivational duplicate of belief. Thus, the original dispute is simply relocated terminologically. (shrink)

The notion of exemplification is essential for Goodman’s theory of symbols. But Goodman’s account of exemplification has been criticized as unclear and inadequate. He points out two conditions for an object x exemplifying a label y: (C1) y denotes x and (C2) x refers to y. While (C1) is uncontroversial, (C2) raises the question of how “refers to” should be interpreted. This problem is intertwined with three further questions that consequently should be discussed together with it. Are the two necessary (...) conditions (C1) and (C2) conjointly sufficient? Do they amount to a definition of “exemplification”? Which notions of Goodman’s theory are basic, and hence undefined? In this paper, we address these questions and defend a reconstruction of the notion of exemplification that interprets “refers to” in (C2) as exemplificational reference and hence treats “exemplification” as a basic notion of Goodman’s theory. Firstly, we argue that even though the notion of exemplification is not defined, it is still sufficiently clear. This ensures its contribution to Goodman’s theory of symbols. Secondly, we show that our account is plausible as an interpretation of Goodman’s and Elgin’s writings, although it implies that some of Goodman’s theorems about self-reference have to be weakened. Thirdly, we argue that it is the only materially adequate reconstruction of Goodman’s notion of exemplification, whereas the alternative definitional accounts fail. (shrink)

Implant ethics is defined here as the study of ethical aspects of the lasting introduction of technological devices into the human body. Whereas technological implants relieve us of some of the ethical problems connected with transplantation, other difficulties arise that are in need of careful analysis. A systematic approach to implant ethics is proposed. The major specific problems are identified as those concerning end of life issues (turning off devices), enhancement of human capabilities beyond normal levels, mental changes and personal (...) identity, and cultural effects. In the first part of this paper, I clear the ground from frequent misconceptions of the relationship between fact and value by examining some uses of the adjective “natural” in ethical controversies. Such uses bear evidence to our “natural” tendency to regard nature as the source of ethical norms. I then try to account for the origins of this tendency by offering three related explanations, the most important of which is evolutionistic: if any behaviour that favours our equilibrium with the (...) environment is potentially adaptive, nothing can be more effective for this goal than developing an attitude toward the natural world that considers it as a dispenser of sacred norms that must be invariably respected. By referring to the Aristotelian notion of human flourishing illustrated in the first part of the paper, in the second I discuss as a case study some ethical problems raised by mini-chips implantable in our bodies. I conclude by defending their potential beneficial effects of such new technological instruments. (shrink)

The increasing focus on disability rights—as found, for instance, in the U.N. Convention on the Rights of Persons with Disabilities —challenges philosophical imaginaries. This article broadens the philosophical imaginary of freedom by exploring the relation of dependence, independence, and interdependence in the lives of people with disabilities. It argues that traditional concepts of freedom are rather insensitive to difference within humanity, and that the lives of people with severe disabilities challenge philosophers to argue and conceptualize freedom not only as independence (...) and interdependence but also as dependence. After tracing this need through a Hegelian understanding, via Julia Kristeva's work on disability, and finally the CRPD, it concludes that a unified solution might not be possible. Hence, it argues that disability issues necessitate philosophical modesty. (shrink)

Due to modern biochemistry and, in particular, recent developments in genomics, proteomics, and bioinformatics, human samples have become the most important raw materials for advancement in the health sciences. Such material has been at the center of fundamental biomedical research for a long time. What is new is its increased usefulness in research with direct clinical relevance, such as the development of drugs. Because of the larger commercial involvement in such research, this has also led to greater economic interests in (...) human biological material and in the information that can be extracted from it. World Trade Organization (WTO) Agreement includes the Annex 2 Dispute Settlement Understanding (DSU) that reveals with WTO dispute settlement rules and procedures. The Dispute Settlement Body (DSB) is hereby established to administer these rules and procedures. The article analyses the problematic issues of the direct effect of the DSB decisions in the European Union (EU) legal order. ECJ concluded that an individual does not have the right to challenge, the incompatibility of Community measures with WTO rules, even if the DSB (...) had previously declared the EU legislation to be incompatible with those rules. The position of the ECJ is based on the WTO dispute settlement system specifics—the importance of the negotiation between the parties, even after the DSB decision-making and lack of reciprocity, which means that major commercial partners of the EU does not recognize the direct effect of DSB decisions. This research investigates the impact of corporate tax strategies on consumers’ corporate social responsibility perceptions, willingness to pay, and attitude toward the firm in two laboratory experiments in the United States and Germany. Using the Becker–DeGroot–Marschak incentive-compatible mechanism, which avoids a social desirability bias found in prior research, our results indicate only a minor indirect effect of corporate tax strategies on WTP by way of the mediator CSR perceptions. However, we find a strong effect on attitude toward the firm again (...) mostly mediated by CSR perceptions. In contrast to German consumers, U.S. consumers’ CSR perceptions of tax avoidance are independent of whether a strategy is likely accepted by the tax authorities. Overall, we conclude that CSR perceptions are highly relevant when it comes to consumer responses to tax avoidance. (shrink)

French truc and machin (‘thing’) can function as placeholders, fillers or in general extender constructions. The aim of our paper is to investigate whether the prosodic characteristics of these three different uses may give a clue as to their respective status. For our analysis, we extracted 112 occurrences of truc and 57 occurrences of machin from the audio data of the PFC Corpus, which were analysed using Praat, focusing on the acoustic duration, the individual pitch contour and the integration of (...) machin and truc into the intonation contour of the utterance. As in previous studies, our results show that the prosodic patterns vary remarkably and show a highly heterogeneous picture so that the use of prosodic properties as cues for disambiguation is problematic. However, we are able to show some weak tendencies which point to a close functional link between placeholders and fillers reflecting their pragmatic functions. There is no evidence for prosodic weakening or even phonetic reduction in placeholders. Furthermore, we detect some evidence for the detachment typical of pragmatic markers in the case of fillers. The prosodic characteristics of truc and machin in general extender constructions diverge from both the placeholder and the filler functions. Their prosody seems to be largely determined by the particular respective construction into which both forms are strongly integrated. (shrink)

Sweden is probably one of the most secularized nations in the world. Therefore religious arguments tend to play a smaller role in the public bioethical debate than in most other countries. Issues such as abortion, stem-cell research, and therapeutic cloning have been far less controversial in Sweden than elsewhere. Instead, other issues have dominated recent bioethical debates in Sweden, in particular those concerning privacy and the control over biological information about individuals.

The relatively new discipline of risk analysis promises to provide objective guidance in some of the most controversial issues in modern high‐technology societies. Four conditions are discussed that must be satisfied for this promise to be fulfilled. Since none of these conditions is satisfied, risk analysis does not keep its promise. In its attempts to reduce genuinely political issues to technocratic calculations, it neglects many of the factors that should influence decisions on risk acceptance. Dos serán las preguntas que nos ayuden a ello en este artículo: a) ¿qué es la epistemología? y b) ¿para qué le sirve al científico?

This article reports a study exploring the meaning of the complex phenomenon of moral responsibility in nursing practice. Each of three focus groups with a total of 14 student nurses were conducted twice to gather their views on moral responsibility in nursing practice. The data were analysed by qualitative thematic content analysis. Moral responsibility was interpreted as a relational way of being, which involved guidance by one’s inner compass composed of ideals, values and knowledge that translate into a striving to (...) do good. It was concluded that, if student nurses are to continue striving to do good in a way that respects themselves and other people, it is important that they do not feel forced to compromise their values. Instead they should be given space and encouragement in their endeavours to do good in a relational way that advances nursing as a moral practice. (shrink)

Trust among current and future patients is essential for the success of biobank research. The submission of an informed consent is an act of trust by a patient or a research subject, but a strict application of the rule of informed consent may not be sensitive to the multiplicity of patient interests at stake, and could thus be detrimental to trust. According to a recently proposed law on “genetic integrity” in Sweden, third parties will be prohibited from requesting or seeking (...) genetic information about an individual. Cumbersome restrictions on research may be lifted, thus creating a more favourable climate for medical research. (shrink)

This book draws new connections between twentieth-century German and French film theory and practice and vitalist conceptions of life from biology and philosophy. Inga Pollmann shows how the links between the two created a modernist, experimental, and cinematic strand of vitalism in and around the movie theatre. Articulated by film theorists, filmmakers, biologists and philosophers, this cinematic vitalism maps out connections among human beings, milieus, and technologies that continue to structure our understanding of film.

Yablo argued that some metaphors are representationally essential: they enable us to express contents that we would not be able to express without them. He defended a fictionalist view of mathematical language by making the case that it similarly serves as a representational aid. Against this, Colyvan argued that metaphorical/figurative language can never play an essential role in explanation and that mathematical language often does, hence concluding that Yablo’s fictionalism is untenable. I show that Colyvan’s thesis about explanation is highly (...) implausible in the absence of a challenge to Yablo’s position on representationally essential metaphors, which Colyvan does not attempt. I also briefly discuss other attempts to produce a simple knock-out argument against fictionalism and show them wanting. (shrink)

Healthcare depends increasingly on advanced medical technology. In addition, other forms of technology contribute to determine how our lives are influenced by disease and disability. The extent to which persons with impaired bodily functions are forced to live their lives differently than other people depends to a large part on a variety of technologies, from wheelchairs to computer interfaces, from hearing aids to garage doors. This wide-ranging influence of technology has important ethical aspects, but has seldom been discussed in bioethics, (...) the ethics of technology, or other branches of applied ethics. (shrink)

The empirical basis for this article is threeyears of experience with ethical rounds atUppsala University Hospital. Three standardapproaches of ethical reasoning are examined aspotential explanations of what actually occursduring the ethical rounds. For reasons given,these are not found to be satisfyingexplanations. An approach called ``imaginativeethics'', is suggested as a more satisfactoryaccount of this kind of ethical reasoning. Theparticipants in the ethical rounds seem to drawon a kind of moral competence based on personallife experience and professional competence andexperience. By listening to (...) other perspectivesand other experiences related to one particularpatient story, the participants imaginealternative horizons of moral experience andexplore a multitude of values related toclinical practice that might be at stake. Inhis systematic treatment of aesthetics in theCritique of Judgement, Kant made use ofan operation of thought that, if applied toethics, will enable us to be more sensitive tothe particulars of each moral situation. Basedon this reading of Kant, an account ofimaginative ethics is developed in order tobring the ethical praxis of doctors and nursesinto sharper relief. The Hebraic and theHellenic traditions of imagination are used inorder to illuminate some of the experiences ofethical rounds. In conclusion, it is arguedthat imaginative ethics and principle-basedethics should be seen as complementary in orderto endow a moral discourse with ethicalauthority. Kantian ethics will do the job if itis remembered that Kant suggested only amodest, negative role of principle-baseddeliberation. (shrink)

SummaryThe salience of mediated scandals today is deeply linked with the formation of norms and values in our society. This is a particular challenge for the field of sport as the compliance with norms and values is of particular relevance in this social area. The paper shows the extent of scandalization in sport reporting and discusses possible implications for sport. Therefore, it offers a definition and typology for sport scandals. It indicates why sport scandals might have a fundamental share of (...) overall scandal reporting today in comparison to other fields of society. The paper further emphasizes content-related aspects such as celebrity status, sport discipline and type of sport scandal. In the empirical portion, a quantitative content analysis of all reported scandals in three German newspapers over a period of one year is provided. Implications of the findings for athletes, organizations, and society are discussed. (shrink)

In this article the main features and development trends of mediation as an alternative dispute resolution method are analyzed in the legal environment of the Republic of Lithuania. Mediation is analyzed as one of the primary informal alternative dispute resolution processes during which the third neutral, which is not authorized to take a decision during negotiations, helps the parties solve their dispute and the main aim of this process is the peaceful resolution of the dispute and the renewal of social (...) peace between parties. In order to create favourable legal environment for the implementation of mediation process, it is necessary to consolidate the main requirements for the mediation process: requirements for confidentiality, responsibility of mediators, legal power of conciliatory agreements, etc. In this article the legal regulation of mediation in the Republic of Lithuania is described as well. Extended antipaternalism means the use of antipaternalist arguments to defend activities that harm (consenting) others. As an example, a smoker’s right to smoke is often invoked in defence of the activities of tobacco companies. It can, however, be shown that antipaternalism in the proper sense does not imply such extended antipaternalism. We may therefore approve of Mill’s antipaternalist principle (namely, that the only reason to interfere with someone’s behaviour is to protect others from harm) without accepting activities that harm (consenting) (...) others. This has immediate consequences for the ethics of public health. An antipaternalist need not refrain from interfering with activities such as the marketing of tobacco or heroin, boxing promotion, driving with unbelted passengers, or buying sex from “voluntary” prostitutes. In standard Bayesian probability revision, the adoption of full beliefs (propositions with probability 1) is irreversible. Once an agent has full belief in a proposition, no subsequent revision can remove that belief. This is an unrealistic feature, and it also makes probability revision incompatible with belief change theory, which focuses on how the set of full beliefs is modified through both additions and retractions. This problem in probability theory can be solved in a model that (i) lets the codomain of (...) the probability function be a hyperreal-valued rather than the real-valued closed interval [0, 1], and (ii) identifies the full beliefs as the propositions whose probability is either 1 or infinitesimally smaller than 1. In this model, changes in the probability function will result in changes in the set of full beliefs (belief set), which constitutes a submodel that can be conceived as the “tip of the iceberg” within the larger model that also contains beliefs on lower levels of probability. The patterns of change in the set of full beliefs in this modified Bayesian model coincides with the corresponding pattern in a slightly modified version of AGM revision, which is commonly conceived as the gold standard of (dichotomous) belief change. The modification only concerns the marginal case of revision by an inconsistent input sentence. These results show that probability revision and dichotomous belief change can be unified in one and the same framework, or – if we so wish – that belief change theory can be subsumed under a modified version of probability revision that allows for iterated change and for the removal of full beliefs. Three of the bioethical issues recently discussed in Sweden appear to be particularly interesting also to an international audience. A new law allowing restrictive use of preimplantation genetic diagnosis /human leukocyte antigen () has been implemented, a new recommendation for the cessation of life-sustaining treatment has been issued, and the scope of individual responsibility for medical mistakes has been rather thoroughly discussed.

In Elder-Vass’s response to my it is maintained: that a social object is not identical with but is merely composed of its suitably interrelated parts; that a social object is necessarily indistinguishable in terms of its causal capacities from its interrelated parts; and that ontological individualism lacks an adequate ontological justification. In this reply, I argue that in view of the so-called redescription principle defended by Elder-Vass ought to be reformulated and renamed; that the conjunction of and renders social objects (...) causally redundant; and that ontological individualism can be coherently formulated and theoretically justified within Elder-Vass’s own metaphysics of objects with causal powers. This article aims to deepen the understanding of courage through a theoretical analysis of classical philosophers’ work and a review of published and unpublished empirical research on courage in nursing. The authors sought answers to questions regarding how courage is understood from a philosophical viewpoint and how it is expressed in nursing actions. Four aspects were identified as relevant to a deeper understanding of courage in nursing practice: courage as an ontological concept, a moral virtue, a property of an ethical (...) act, and a creative capacity. The literature review shed light on the complexity of the concept of courage and revealed some lack of clarity in its use. Consequently, if courage is to be used consciously to influence nurses’ ethical actions it seems important to recognize its specific features. The results suggest it is imperative to foster courage among nurses and student nurses to prepare them for ethical, creative action and further the development of professional nursing practices. Fictionalists claim that instead of believing certain controversial propositions they accept them nonseriously, as useful make-believe. In this way they present themselves as having an austere ontology despite the apparent ontological commitments of their discourse. Some philosophers object that this plays on a distinction without a difference: the fictionalist’s would-be nonserious acceptance is the most we can do for the relevant content acceptance-wise, hence such acceptance is no different from what we ordinarily call ‘belief’ and should be so called. They (...) conclude that it is subject to the norms applicable to paradigmatic empirical beliefs, and hence, pace fictionalists, ontological commitments must be taken seriously. I disentangle three strands in the objector’s thought: the ‘What more can you ask for?’ intuition, a linguistic/ conceptual claim, and a claim about norms. I argue that the former two are compatible with ontological deflationism, and therefore do not entail applicability of the norms. Nevertheless, if indeed there is no more robust acceptance with which to contrast the supposed nonserious acceptance, then the fictionalist’s claim to austere ontology must be abandoned. Is there a reason to suppose there is any merit to the distinction-without-a-difference charge? I argue that there is, clarify it, and defend against objections, focusing on Daly 2008. (shrink)
