This is an attempt to clarify the relation between Schmitt and Hobbes by examining Hobbes's thinking about enemies and enmity. On the one hand, Hobbes shares a strong war/crime distinction with Schmitt. On the other hand, Hobbes never suggests that lethal enmity gives a ?meaningful? tension to human life. Hobbes also describes the way feverish human minds may imagine enemies where none exist. This is another non?Schmittian theme. Although Schmitt was a profoundly anti?Hobbesian thinker for these and other reasons, an (...) examination of Hobbes with the Schmittian question (?who is the enemy??) in mind, proves exceptionally fruitful, opening up aspects of Hobbes's political theory that have hitherto lingered in obscurity. In this collection of essays on the core values of liberalism, Stephen Holmes—noted for his scathing reviews of books by liberalism's opponents—challenges commonly held assumptions about liberal theory. By placing it into its original historical context, _Passions and Constraints_ presents an interconnected argument meant to fundamentally change the way we conceive of liberalism. According to Holmes, three elements of classical liberal theory are commonly used to attack contemporary liberalism as antagonistic to genuine democracy and the welfare state: (...) constitutional constraints on majority rule, the identification of individual freedom with an absence of government involvement, and a strong emphasis on the principle of self-interest. Through insightful essays on Hobbes's analysis of the English Civil War in _Behemoth_, Bodin's writings on the benefits of limited government, and Mill's views on science and politics, Holmes shows that these basic principles provide, to the contrary, a necessary foundation for the development of democratic, regulatory, and redistributionist politics in the modern era. Holmes argues that the aspirations of liberal democracy—including individual liberty, the equal dignity of citizens, and a tolerance for diversity—are best understood in relation to two central themes of classical liberal theory: the psychological motivations of individuals and the necessary constraint on individual passions provided by institutions. Paradoxically, Holmes argues that such institutional restraints serve to enable, rather than limit, effective democracy. In explorations of subjects ranging from self-interest to majoritarianism to "gag rules," Holmes shows that limited government can be more powerful than unlimited government—indeed, that liberalism is one of the most effective philosophies of state building ever contrived. By restricting the arbitrary powers of government officials, Holmes states, a liberal constitution can increase the state's capacity to focus on specific problems and mobilize collective resources for common purposes. _Passions and Constraint_ is an assessment of what that tradition has meant and what it can mean today. In order to set up a dialogue the author, first, will attempt to discern similarities and differences between the ideas of Gregory Bateson and those of the so-called Pragmatist philosophers, John Dewey and William James. Second, he will address connecting points and relevance to intercultural communication training and teaching. For both sides aesthetics are of central importance, for Bateson, coming from the direction of systems, more in the observation of the pattern that connects. For Dewey, the aesthetic experience is embedded (...) in the context potentially in any situation. For both Dewey and James human and other organisms actively experiencing environments as situations are the beginning and the end of any philosophy of pragmatic significance. This paper focuses on the practical question of how the ideas of John Dewey can contribute to improved intercultural communication theory and practice, especially to training. The question is answered in four parts. The first part refers to the presumed superiority of sensitivity to difference as opposed to similarity in intercultural communication. The second part suggests that Dewey’s duality of potentiality and interaction can be carried over to the duality of competence and performance. The third part highlights the use of (...) the generic concepts of pattern and habit to better understand culture as a practical experience. The final part advocates a closer look at the idea and experience of rhythm as an epistemological alternative to subject vs object. The author relies on his experience as a trainer and a teacher of Intercultural Communication and proceeds down an interdisciplinary path, especially attempting to set up a dialogue with biology, systems and the arts. From the standpoint of an intercultural communication trainer in an exploration mode, the author starts by analyzing and evaluating two Third Culture models in order to sort out their contributions to practically improving intercultural communicative performance with the stranger. In his exploration he strives to move from competence to performance by shifting the focus of the abstract potential of competence to the body as an experiencing organism and its environment, the point in a situation where performance takes place. El presente artículo trata algunas cuestiones teóricas e históricas respecto de la regulación del acceso a los medios de comunicación. En primer lugar, se hace un recorrido de las doctrinas liberales de los siglos XVI y XVII que inspiraron la igual desconfianza que refleja la Constitución de Estados Unidos respecto de los poderes públicos y privados en relación con el control de los medios de comunicación y de la opinión pública; en segundo lugar, se hace una revisión de la supervivencia (...) de tales doctrinas liberales en la en la interpretación de la Suprema Corte de la Primera Enmienda, relativa a la libertad de expresión y de prensa y, en tercer lugar, analiza la aplicación de dicha doctrina en los principios que han regido la administración de concesiones de radio y televisión por parte de la Comisión Federal de Comunicaciones. In diesem Aufsatz wird die Auffassung entwickelt, daß die Lehre von der Einfachheit Gottes erstens theologisch sinnvoll vertreten werden kann und sich zweitens für die Gotteslehre als hilfreich erweist. Der erste Argumentationsgang weist nach, daß die Kritik an der Lehre von der Einfachheit Gottes, die in den letzten Jahren mehrheitlich vorgetragen worden ist, auf einem Mißverständnis beruht. Es wird unterstellt, daß diese Lehre eine Ontologie voraussetzt, die faktisch in den traditionellen Ausformungen der Lehre von der Einfachheit Gottes gänzlich fehlt. Vor (...) diesem Hintergrund wird gezeigt, daß die Einfachheit Gottes im Rahmen trinitätstheologischer und christologischer Reflexion begründet werden kann. Damit kann diese Lehre dogmatisch sinnvoll vertreten werden – auch im Kontext trinitarischer Theologie. Im zweiten Argumentationsgang wird die Debatte zwischen Realismus und Nominalismus in ihren Konsequenzen für das Verständnis der Eigenschaften Gottes einer erneuten Prüfung unterzogen. Diese führt zu dem Ergebnis, daß scheinbar unlösbare dogmatische Probleme durch die Lehre von der Einfachheit Gottes einer Klärung näher gebracht werden können. This article considers the post-Reformation debates over the extent of the Atonement. It traces the origins of these debates from the articles of the Arminian Remonstrance of 1610 through the declarations of the supporters of the Synod of Dort in 1618-19. The debate is then considered in relation to an English Baptist context, and specifically the exegetical dispute over the meaning of the word ‘all’ in 2 Corinthians 5:14-15 and Romans 3:23-4. Three options are examined and the various difficulties in (...) arbitrating between these various interpretations. Recognising these difficulties, the article goes on to explore the relationship between scriptural exegesis and theology with reference to the formulation of the ecumenical doctrine of the Trinity in the fourth century. It argues that while theology should always attempt to be consistent with the exegetical data on occasion it proves inconclusive, as in the case of the debate over the extent of the atonement. In such cases the role of theology becomes one of mediation as it seeks a way of reading the texts of Scripture that allows them to be heard without contradicting each other. Again, this is illustrated from the fourth century and the Christology of Basil of Caesarea and Gregory of Nyssa. Returning to the question of atonement with this understanding of the task of theology the article seeks to propose a way to reconcile the biblical texts which speak of the atonement as both universal and limited. Aristotle's Politics is widely recognized as one of the classics of the history of political philosophy, and like every other such masterpiece, it is a work about which there is deep division.

Three experiments investigated response times for remember and know responses in recognition memory. RTs to remember responses were faster than RTs to know responses, regardless of whether the remember–know decision was preceded by an old/new decision or was made without a preceding old/new decision . The finding of faster RTs for R responses was also found when remember–know decisions were made retrospectively. These findings are inconsistent with dual-process models of recognition memory, which predict that recollection is slower and more effortful (...) than familiarity. Word frequency did not influence RTs, but remember responses were faster for words than for nonwords. We argue that the difference in RTs to remember and know responses reflects the time taken to make old/new decisions on the basis of the type of information activated at test. (shrink)

Bermúdez persuasively argues that framing effects are not as irrational as commonly supposed. In focusing on the reasoning of individual decision-makers in complex situations, however, he neglects the crucial role of the social-communicative context for eliciting certain framing effects. We contend that many framing effects are best explained in terms of basic, rational principles of discourse processing and pragmatic reasoning.

The regulatory mechanism which ensures that eukaryotic chromosomes replicate precisely once per cell cycle is a basic and essential cellular property of eukaryotes. This fundamental aspect of DNA replication is still poorly understood, but recent advances encourage the view that we may soon have a clearer picture of how this regulation is achieved. This review will discuss in particular the role of proteins in the minichromosome maintenance (MCM) family, which may hold the key to understanding how DNA is replicated once, (...) and only once, per cell cycle. Parts of the body are often embedded in the structure of compound words, such as heartbreak and brainchild. We explored the relationships between the semantics of compounds and their constituent body parts, asking whether these relationships are largely arbitrary or instead reflect deeper metaphorical mappings shared across languages and cultures. In three studies, we found that U.S. English speakers associated the English translation equivalents of Chinese compounds with their constituent body parts at rates well above chance, even for compounds with (...) highly abstract meanings and even when accounting for the semantic relatedness of the compounds and body parts. English speakers in India and Chinese speakers in Hong Kong showed similar intuitions about these associations. Our results suggest that the structure of compound words can provide insight into cross‐culturally shared ways of connecting meaning to the body. (shrink)

Many suggest that professionalism as traditionally understood is all but dead in today's legal marketplace. Some scholars believe that 'professional' orientations based on managerialism and influenced by profitability have seen the demise of the lawyer's traditional professional identity. This paper argues otherwise. A pilot qualitative study of new Australian lawyers indicates that professional ideals can still flourish. Participants both understood the traditional ideals and sought to incorporate them in their own developing sense of professionalism. This paper reviews the experiences of (...) 11 early-career Australian lawyers in their first year of practice. Preliminary results suggest that certain experiences are crucial to developing and retaining a broad sense of professionalism: finding a balance between autonomous/independent work and close mentoring and supervision; realizing that legal practice is not merely a rational and rule-based activity, but one that involves ongoing uncertainty, including the uncertainly of dealing with 'real' people displaying 'real' emotions; and reaching a comfortable 'value convergence' between one's own values and those modelled by colleagues. Designer Biology: The Ethics of Intensively Engineering Biological and Ecological Systems consists of thirteen chapters that address the ethical issues raised by technological intervention and design across a broad range of biological and ecological systems. Among the technologies addressed are geoengineering, human enhancement, sex selection, genetic modification, and synthetic biology.

Holmes exists is false. How can this be, when there is no one for the sentence to misdescribe? Part of the answer is that a sentence’s topic depends on context. The king of France is bald, normally unevaluable, is false qua description of the bald people. Likewise Holmes exists is false qua description of the things that exist; it misdescribes those things as having Holmes among them. This does not explain, though, how Holmes does not exist (...) differs in cognitive content from, say, Vulcan does not exist. Our answer builds on an observation of Kripke’s: even if Holmes exists, he is not in this room, for we were all born too late. (shrink)

We may usefully distinguish between one’s having fallible knowledge and having a fallibilist stance on some of one’s knowledge. A fallibilist stance could include a concessive knowledge-attribution. But it might also include a questioning knowledge-attribution. Attending to the idea of a QKA leads to a distinction between what we may call closed knowledge that p and open knowledge that p. All of this moves us beyond Elgin’s classic tale of the epistemic capacities of Holmes and of Watson, and towards (...) a way of resolving Kripke’s puzzle about dogmatism and knowing. (shrink)

This paper addresses two issues: the controversy over pragmatism in environmental philosophy, and the habitual exclusion of William James's work from serious examination. Addressing critiques of pragmatic naturalism from Max Horkheimer, Eugene Hargrove and Holmes Rolston, I argue that their criticisms misfire, primarily due to skewed perception derived from mis-interpretative projections of views to which pragmatism is not committed. I conclude that the critics' major concerns are largely groundless, but that greater emphasis on pragmatism's experiential aspect would clarify this.

This article examines Augustine’s anti-Donatist claim that it is not the punishment but the cause (non poena sed causa) that makes a martyr. Augustine’s non poena sed causa argument arises as part of the larger rhetoric of martyrdom that recent scholarship has highlighted in late antiquity. I argue here that a more specific look at classical rhetorical techniques can provide a better understanding of what Augustine is up to in his particular rhetoric of martyrdom. To that end, after providing an (...) overview of North African martyr discourse, I turn to forensic rhetoric and issue theory as described in Cicero and Quintilian. I show that two types of forensic arguments—one on the issue of definition and other on the contested interpretation of a legal text—shaped Augustine’s non poena sed causa approach to the Donatists’ claims to be the church of the martyrs.
