A foreign juridicial databank inquiry gives to difficulties not only with the linguistic problem of the translation but also with the comparison of the different law systems. So, it’s necessary to create a device able to resolve the collation of different juridicial systems specially when the files data retrieval is realised by a foreign user. These interfaces use specific connexion which allow an efficient documentary research and protect the integrity and the specificity of each national law systems.

BackgroundMoral case deliberation as a form of clinical ethics support is usually implemented in health care institutions and educational programs. While there is no previous research on the use of clinical ethics support on the level of health care regulation, employees of regulatory bodies are regularly confronted with moral challenges. This pilot study describes and evaluates the use of MCD at the Dutch Health Care Inspectorate.The objective of this pilot study is to investigate: 1) the current way of dealing with (...) moral issues at the IGZ; 2) experience with and evaluation of MCD as clinical ethics support, and 3) future preferences and needs regarding clinical ethics support for dealing with moral questions at the IGZ.MethodsWe performed an explorative pilot study. The research questions were assessed by means of: 1) interviews with MCD participants during four focus groups; and 2) interviews with six key stakeholders at the IGZ. De qualitative data is illustrated by data from questionnaires on MCD outcomes, perspective taking and MCD evaluation.ResultsProfessionals do not always recognize moral issues. Employees report a need for regular and structured moral support in health care regulation. The MCD meetings are evaluated positively. The most important outcomes of MCD are feeling secure and learning from others. Additional support is needed to successfully implement MCD at the Inspectorate.ConclusionWe conclude that the respondents perceive moral case deliberation as a useful form of clinical ethics support for dealing with moral questions and issues in health care regulation. Consciousness and Physicalism: A Defense of a Research Program explores the nature of consciousness and its place in the world, offering a revisionist account of what it means to say that consciousness is nothing over and above the physical. By synthesizing work in the philosophy of mind, metaphysics, and philosophy of science from the last twenty years and forging a dialogue with contemporary research in the empirical sciences of the mind, Andreas Elpidorou and Guy Dove advance and defend a novel (...) formulation of physicalism. Although physicalism has been traditionally understood to be a metaphysical thesis, Elpidorou and Dove argue that there is an alternative and indeed preferable understanding of physicalism that both renders physicalism a scientifically informed explanatory project and allows us to make important progress in addressing the ontological problem of consciousness. Physicalism, Elpidorou and Dove hold, is best viewed not as a thesis (metaphysical or otherwise) but as an interdisciplinary research program that aims to compositionally explain all natural phenomena that are central to our understanding of our place in nature. Consciousness and Physicalism is replete with philosophical arguments and informed, through and through, by findings in many areas of scientific research. It advances the debate regarding the ontological status of consciousness. It will interest students and scholars in philosophy of mind, metaphysics, philosophy of cognitive science, and philosophy of science. The method of positron emission tomography illustrates the circular logic popular in subtractive neuroimaging and linear reductive cognitive psychology. Both require that strictly feed-forward, modular, cognitive components exist, before the fact, to justify the inference of particular components from images after the fact. Also, both require a "true" componential theory of cognition and laboratory tasks, before the fact, to guarantee reliable choices for subtractive contrasts. None of these possibilities are likely. Consequently, linear reductive analysis has failed to yield general, reliable, (...) componential accounts. (shrink)

Research into moral decision-making has been dominated by sacrificial dilemmas where, in order to save several lives, it is necessary to sacrifice the life of another person. It is widely assumed that these dilemmas draw a sharp contrast between utilitarian and deontological approaches to morality, and thereby enable us to study the psychological and neural basis of utilitarian judgment. However, it has been previously shown that some sacrificial dilemmas fail to present a genuine contrast between utilitarian and deontological options. Here, (...) I raise deeper problems for this research paradigm. Even when sacrificial dilemmas present a contrast between utilitarian and deontological options at a philosophical level, it is misleading to interpret the responses of ordinary folk in these terms. What is currently classified as “utilitarian judgment” does not in fact share essential features of a genuine utilitarian outlook, and is better explained in terms of commonsensical moral notions. When subjects deliberate about such dilemmas, they are not deciding between opposing utilitarian and deontological solutions, but engaging in a richer process of weighing opposing moral reasons. Sacrificial dilemmas therefore tell us little about utilitarian decision-making. An alternative approach to studying proto-utilitarian tendencies in everyday moral thinking is proposed. (shrink)

It is commonly assumed that personalization technologies used by Google for the purpose of tailoring search results for individual users create filter bubbles, which reinforce users’ political views. Surprisingly, empirical evidence for a personalization-induced filter bubble has not been forthcoming. Here, we investigate whether filter bubbles may result instead from a searcher’s choice of search queries. In the first experiment, participants rated the left-right leaning of 48 queries (search strings), 6 for each of 8 topics (abortion, benefits, climate change, sex (...) equality, immigration, nuclear family, Islam, and taxation). An independent sample of participants were then asked to select one of these queries for each of the 8 topics. With the exception of the topic of Islam, participants were significantly more likely to select a query corresponding to their own political leaning, compared to other queries, explaining between 12% and 39% of the variance. A second experiment investigated the effect of the political leaning of the same queries on the overall political leaning of Search Engine Result Pages (SERPs) in Google Search. The top six results of each SERP were rated collectively by a third group of participants, explaining 36.3% of the variance across all 48 search terms (p < .00001). That is, (1) participants in our experiments tended to select own-side search queries, and (2) using those queries tended to yield own-side search results when using the Google search engine. Our results are consistent with the notion of a self-imposed filter bubble in which query selection plays a salient role. (shrink)

John Cook Wilson is an important predecessor of contemporary knowledge first epistemologists: among other parallels, he claimed that knowledge is indefinable. We reconstruct four arguments for this claim discernible in his work, three of which find no clear analogues in contemporary discussions of knowledge first epistemology. We pay special attention to Cook Wilson’s view of the relation between knowledge and forms of thinking (like belief). Claims of Cook Wilson’s that support the indefinability of knowledge include: that knowledge, unlike belief, straddles (...) an active/passive divide; that, rather than entailing belief, knowledge excludes belief; and that understanding forms of thinking other than knowledge (such as belief) depends on understanding knowledge. Reflecting on Cook Wilson’s framework highlights underappreciated concerns relevant to any attempt to define knowledge. (shrink)

Thus an object that is perfectly useless from a biological point of view (such as a medal, or the enemy's flag) can be desired because it is the object of other desires. Such a human desire, and human reality as it differs from animal reality, is only created by the action that satisfies such desires. Human history is the history of desires that are desired [Désirs désirés]. Undoubtedly, these could be words written by Girard. However, they are not. These words are quoted from the famous lectures given by Alexandre Kojève on Hegel's Phänomenologie des Geistes at the Ecole pratique des hautes études between 1933 and 1939. They were followed by what would become the crème ofpost-war French philosophy: Raymond Aron, Georges Bataille, Alexandre Koyré, Pierre Klossowski, Jacques Lacan, Maurice Merleau-Ponty, Jean-Paul Sartre.' He owes his reputation first and foremost to his literary analyses, subsequently to his research in anthropology, finally to his exegesis ofthe Bible. Time and again, Girard has expressed his preference for literature to both humanities and philosophy. Human behavior is, in his view, much less elucidated by the conceptual structures of discursive philosophy than by the evocative force of a Greek tragedy, the Biblical passion story or a modern novel. Debates about new technologies, such as crop and food genetic modification, raise pressing questions about the ways ‘experts’ and ‘ nonexperts’ communicate. These debates are dynamic, characterized by many voices contesting numerous storylines. The discoursal features, including language choices and communication strategies, of the GM debate are in some ways taken for granted and in others actively manipulated by participants. Although there are many voices, some have more influence than others. This study makes use of 50 hours of in-depth interviews (...) with GM scientists, nonexperts, and other stakeholders in the GM debate to examine this phenomenon. We uncover rhetorical devices used by scientists to characterize and ultimately undermine participation by non-experts in areas including rationality, knowledge, understanding and objectivity. Scientists engage with ‘the public’ from their own linguistic and social domain, without reflexive confirmation of their own status as part of the public and the citizenry. This raises a number of interesting ironies and contradictions, which are explored in the article. As such, it provides valuable insights into an increasingly important type of discourse. (shrink)

Recently, cognitivist accounts about art have come under pressure to provide stronger arguments for the view that artworks can yield genuine insight and understanding. In Gregory Currie’s Imagining and Knowing: Learning from Fiction, for example, a convincing case is laid out to the effect that any knowledge gained from engaging with art must “be judged by the very standards that are used in assessing the claim of science to do the same” (Currie 2020: 8) if indeed it is to count (...) as knowledge. Cognitivists must thus rally to provide sturdier grounds for their view. The revived interest in this philosophical discussion targets not only the concept of knowledge at the heart of cognitivist and anti-cognitivist debate, but also highlights a more specific question about how, exactly, some artworks can (arguably) afford cognitive import and change how we think about the world, ourselves and the many events, persons and situations we encounter. This paper seeks to explore some of the ways in which art is capable of altering our epistemic perspectives in ways that might count as knowledge despite circumventing some standards of evidential requirement. In so doing we will contrast two alternative conceptions of how we stand to learn from art. Whereas the former is modelled on the idea that knowledge is something that can be “extracted” from our experience of particular works of art, the latter relies on a notion of such understanding as primarily borne out of a different kind of engagement with art. We shall call this the subtractive conception and cumulative conception respectively. The cumulative conception, we shall argue, better explains why at least some insights and instances of knowledge gained from art seem to elude the evidential standards called for by sceptics of cognitivism. We examine conceptual and methodological problems that arise in the course of the scientific study of possible influences of religious belief on the experience of physical pain. We start by attempting to identify a notion of religious belief that might enter into interesting psychological generalizations involving both religious belief and pain. We argue that it may be useful to think of religious belief as a complex dispositional property that relates believers to a sufficiently thick belief system that encompasses both cognitive (...) and non-cognitive elements. Such a conception of religious belief is more likely to correlate with psychological properties of believers that are both sufficiently shared and sufficiently unique to distinguish their psychology from believers in another religion or from non-believers. If the dispositional psychological property that constitutes religious belief does influence pain, then our analysis suggests that it doesn’t do so directly but rather through one of its occurrent manifestations. We offer a taxonomy of the different ways in which occurrent states of belief or experience may interact with physical pain, and we try to identify those that are more interesting or promising. We then proceed to employ the conceptual framework we developed to some of the existing evidence about the neural and psychological correlates of religious belief and experience, and about the cognitive modulation of physical pain. Finally we turn to analyse two experiments that directly investigated the relation between religious belief and pain. We draw attention to the limitations of existing evidence and end by suggesting directions for future conceptual and empirical inquiry. (shrink)

Background: There is a lack of empirical data on lay attitudes toward different sorts of deception in medicine. However, lay attitudes toward deception should be taken into account when we consider whether deception is ever permissible in a medical context. The objective of this study was to examine lay attitudes of U.S. citizens toward different sorts of deception across different medical contexts. Methods: A one-time online survey was administered to U.S. users of the Amazon “Mechanical Turk” website. Participants were asked (...) to answer questions regarding a series of vignettes depicting different sorts of deception in medical care, as well as a question regarding their general attitudes toward truth-telling. Results: Of the 200 respondents, the majority found the use of placebos in different contexts to be acceptable following partial disclosure but found it to be unacceptable if it involved outright lying. Also, 55.5% of respondents supported the use of sham surgery in clinical research, although 55% claimed that it would be unacceptable to deceive patients in this research, even if this would improve the quality of the data from the study. Respondents supported fully informing patients about distressing medical information in different contexts, especially when the patient is suffering from a chronic condition. In addition, 42.5% of respondents believed that it is worse to deceive someone by providing the person with false information than it is to do so by giving the person true information that is likely to lead them to form a false belief, without telling them other important information that shows it to be false. However, 41.5% believed that the two methods of deception were morally equivalent. Conclusions: Respondents believed that some forms of deception were acceptable in some circumstances. While the majority of our respondents opposed outright lying in medical contexts, they were prepared to support partial disclosure and the use of placebos when it is in the patient's interests or when it is what the person would want. These results support the position that physicians should be allowed a greater degree of authority to make a professional judgment about whether deception might be morally warranted by the circumstances, provided that it doesn't involve outright lying. La philosophie de Camus a déjà été bien étudiée ; son rapport au christianisme est connu et les chrétiens se sont immédiatement intéressés à son oeuvre. Mais cette affinité restait à analyser. C'est ce que propose cet ouvrage, selon diverses perspectives : à partir de la formation que reçut Camus, de son art d'écrivain et de metteur en scène, de ses relations avec les philosophes chrétiens et, enfin, de la manière dont sa propre réflexion aborde le christianisme. Camus ne se (...) voulait pas en effet un philosophe "professionnel". Il récusait les dogmes et les systèmes en philosophie, et les combattait également sans relâche dans les religions. Sa pensée de l'absurde et de la révolte a ainsi rencontré dans le christianisme un écho à son sens de la condition humaine, irréductible à l'idéologie. Cet ouvrage est le fruit d'un colloque international, qui fut organisé à l'Institut catholique de Paris, les 15 et 16 mars 2010, avec la collaboration de la Société des études camusiennes. Concerns about climate change have led to the development of legal frameworks, including national regulations and international protocols to limit the emissions of greenhouse gases. Current mitigation measures, however, may not be sufficient to limit global warming to an average of 2°C since the pre-industrial period. Other approaches may therefore be required, including adaptation measures and climate engineering initiatives. Only a few legal frameworks are available to regulate adaptation initiatives and to constrain climate engineering approaches whose potential side-effects are not (...) always sufficiently well known. This Article provides a brief overview of scientific progress made to better assess climate change and addresses possible societal responses, including the mitigation, adaptation and climate engineering strategies. It provides a brief summary of current knowledge about expected climate change as a basis for the definition of future international climate policies and associated legal frameworks. (shrink)

Hoping to foster this link between insight and action, applied geography saw the light of day. In order to be genuinely effective, the practice of this kind of planning, so it was thought, needed to rely on the expertise of the geographer who studied forms of human settlement. More fundamentally, the utilitarian claim of applied geography rested on the conviction according to which the spatial organization of human societies brought into play the question of justice and commonweal. As Jean Gottmann wrote, our epoch is particularly sensitive to the fact that everyone, whoever or from wherever they may be, consider themselves “to be entitled to live just as well as all others.” In this way a “popular will” was affirmed “that the necessary measures be taken to envisage, prepare, and provide for an improvement of life's comforts …, for a better life.” Inspired by the “modern idea of planning,” applied geography set itself the goal of “establishing justice […] by a more even distribution of people, of their means of subsistence, [and] of their living standard.”. Ever since the eighteenth century, when Kant opened the floodgates of subjectivism in aesthetics, common men and philosophers alike have despaired of finding a basis for judgments about beauty. This book provides a comprehensive theory that encompasses beauty in art and nature, as well as intellectual, utilitarian, and moral beauty. The author argues that the beauty of objects can be reduced to the beauty of properties of those objects, which in turn can be understood in terms of "properties of qualitative (...) degree." The theory, developed first with respect to color, is then extended to include all sensory and non-sensory qualities. The author shows how the theory explicates and resolves disagreements about what is beautiful and discusses its relevance to the traditional notions of harmony and sublimity. L’intérêt et l’originalité de l’humanisme merleau-pontien consiste à mes yeux dans sa mise en lumière du dévoilement de l’origine refoulée de l’homme dans le registre de l’art et de l’expression du corps en général. Merleau-Ponty a su percevoir exemplairement ce mouvement de récursion vers l’inhumain dans l’oeuvre de Cézanne. « Je vous dois la vérité en peinture disait Cézanne ». Cézanne nous donne en effet la vérité de l’hominisation en peinture. Nul mieux que Merleau-Ponty nous permet d’entendre encore aujourd’hui la (...) voix de Cézanne. Il nous permet de fonder sur l’écho de cette voix un nouvel humanisme, un humanisme qui garde en mémoire l’inhumain, qui lève le refoulement mais sans le supprimer, tout comme l’artiste présente l’invisible du visible et tout comme le philosophe décrit la profondeur de l’être. Cet humanisme de la surrection est celui de l’apparition de l’homme à lui-même dans la constellation hasardeuse des signes et dans l’adversité du non-sens, à égale distance de l’humanisme sans vergogne des aînés de Merleau-Ponty et de l’antihumanisme postmoderne de ses cadets.The interest and originality of Merleau-Ponty’s humanism lie, in my view, in the unveiling of the repressed origin of humanity in the domain of art and the expression of the body more generally. Through the echo of this voice, he allows us to found a new humanism, a humanism that bears the memory of the inhuman, that lifts up the repressed but without effacing it, all while presenting us with the invisible in the visible and exposing the profundity of the human being.
