Nowhere has H.L.A. Hart's influence on philosophical jurisprudence in the English-speaking world been greater than in the way its fundamental project and method are conceived by its practitioners. Disagreements abound, of course. Philosophers debate the extent to which jurisprudence can or should proceed without appeal to moral or other values. They disagree about which participant perspective—that of the judge, lawyer, citizen, or “bad man”—is primary and about what taking up the participant perspective commits the theorist to. However, virtually unchallenged is (...) the view that jurisprudence is fundamentally interpretive or “hermeneutic”; that it takes for its subject a certain kind of social practice, constituted by the behavior and understandings of its participants; that its task is to explain this practice and its relations to other important social practices; and that it can properly be explained only by taking full account of participant understandings. It is, perhaps, some measure of the hegemony of Hart's influence that Ronald Dworkin mounts his fundamental challenge to Hart's positivism squarely from within this jurisprudential orthodoxy. Dworkin may have exceeded the limits of the method as Hart conceived it, but, as Stephen Perry has argued, “the seeds of Dworkin's strong version of inter-pretivism were sown by Hart himself.”. There are Humeans and unHumeans, disagreeing as to the validity of the Treatise’s ideas regarding practical reason, but not as to their importance. The basic argument here is that the enduring irresolution of their Hume centric debates has been fostered by what can be called the fallacy of normative monism, i.e. a failure to distinguish between two different kinds of normativity: empirical vs. rational. Humeans take the empirical normativity of personal desire to constitute the only real kind, while unHumeans insist (...) that only the objective rationality associated with categorical morality can provide reliable normative guidance. In turn, the failure to recognize the dual nature of normativity has helped engender motivational obscurantism: as essentially causal notions, motive and motivation obscure the rational processes that lie at the heart of deliberation and choice. Once it is realized that normativity takes two different forms, each with its own distinctive role, it becomes possible to mediate if not mitigate the differences between Humeans and unHumeans. Choice will be the key to understanding practical reasoning, and its analysis will provide the basis for a belief/desire model that upends conventional wisdom regarding motivation and desire. The aim of this book is to show how McTaggart's atemporal vision of reality is a serious attempt to describe a coherent world without time. It proposes that the answer to the puzzling nature of time is not to be found in the components of time itself, but in an atemporal reality that lies behind it. McTaggart takes an idealist view that reduces all that is real to spirit, that any expression of reality is dependent on a manifestation of consciousness. (...) McTaggart's argument that time is unreal, has been the subject of much philosophical debate since it first appeared in 1908; but much discussion has ignored McTaggart's positive account of time and concentrated on his negative proof. The author argues that the negative thesis should be separated from the positive account, he attacks the standard approaches to interpreting time and provides a full account of McTaggart's atemporal world. The conclusion is drawn that the timeless world has psychological appeal and can form the basis for an atemporal thinking which can break away from the confusing philosophical models of temporality that often bear little resemblance to our experience of it. The Matrix exposes us to the uncomfortable worries of philosophical skepticism in an especially compelling way. However, with a bit more reflection, we can see why we need not share the skeptic’s doubts about the existence of the world. Such doubts are appropriate only in the very special context of the philosophical seminar. When we return to normal life we see immediately that they are groundless. Furthermore, we see also the drastic mistake that Cypher commits in turning his back upon (...) reality and re-entering the matrix. Not only does reason compel us to admit the existence of the external world, it also requires us to face this world, to build for ourselves meaningful lives within it, and to engage, as adults, in the serious business of living. . A structured awareness of time lies at the core of the law's distinctive normativity. Melody is offered as a rough model of this mindfulness of time, since some important features of this awareness are also present in a hearer's grasp of melody. The model of melody is used, first, to identify some temporal dimensions of intentional action and then to highlight law's mindfulness of time. Its role in the structure of legal thinking, and especially in precedent‐sensitive legal reasoning, is (...) explored. This article argues further that melody‐modeled mindfulness of time is evident also at a deeper and more pervasive level, giving structure to the distinctive mode of law's normative guidance. The article draws one important theoretical consequence from this exploration, namely, that the normative coherence of momentary legal systems depends conceptually on their coherence over time. Lounsbury and Beckman counter with an expansive review of several thriving domains of contemporary organizational research that demonstrate the theoretical vibrancy of the field. This article responds by seeking to define ‘theoretical progress’ in ways that extend beyond (...) just the volume of articles produced. It finds that 1970s‐era classics have seen a surge of citations since the turn of the twenty‐first century, consistent with a view of limited progress.
