When I think about America, I think about a great diversity of types of people, from different backgrounds, national origins, races, religions, classes and points of view. The US is made up of descendants of African slaves and recent African immigrants; mid-western farmers and Asian Americans whose families come from nearly every Asian nation; Jewish families from Eastern Europe and Native Americans who have owned our land for centuries before any others. The Human Fertilisation and Embryology Authority’s recent restrictive recommendations on sex selection have highlighted the need for consideration of the plausibility of ethical arguments against sex selection. In this paper, the author suggests a parental virtues approach to some questions of reproductive ethics as a superior alternative to an exclusively harm focused approach such as the procreative liberty framework. The author formulates a virtue ethics argument against sex selection based on the idea that acceptance is a character trait of the (...) good parent. It is concluded that, because the argument presented posits a wrong in the sex selecting agent’s action that is not a harm, the argument could not function as a justification of the HFEA’s restrictive position in light of their explicit commitment to procreative liberty; it does, however, suggest that ethical approaches focused exclusively on harm fail to capture all the relevant moral considerations and thus that we should look beyond such approaches. This paper argues that the professional situation of junior doctors is unique in ethically important ways and thus that ethics work focusing on junior doctors specifically is necessary. Unlike the medical student or the more senior doctor, the doctor in his or her early postgraduate years is simultaneously a responsible health professional, a subjugate learner and a human resource. These multiple roles generate the set of ethical issues faced by junior doctors, a set that has some overlaps with that faced (...) by medical students and with that faced by more experienced doctors but is far from completely continuous with either. Further, the multiple roles that junior doctors play affect their options for negotiating the ethical challenges that they face. Their position determines not only the content of the set of ethical issues that they encounter, but also the kinds of actions they can take in the face of these challenges. Thus considering junior doctors only in combination with medical students or more senior doctors fails on two fronts. Firstly, only a very incomplete set of the ethical issues faced by junior doctors will be addressed, and, secondly, the constraints associated with the specific professional situation of junior doctors will not be adequately considered, limiting the practical applicability for these agents of any such analyses. The claim that human reproductive cloning constitutes an affront to human dignity became a familiar one in 1997 as policymakers and bioethicists responded to the announcement of the birth of Dolly the sheep. Various versions of the argument that reproductive cloning is an affront to human dignity have been made, most focusing on the dignity of the child produced by cloning. However, these arguments tend to be unpersuasive and strongly criticised in the bioethical literature. In this paper I put forward (...) a different argument that reproductive cloning is an affront to human dignity, one that looks beyond the dignity of the child produced. I suggest that allocating funds to such a pursuit can affront human dignity by diverting resources away from those existing people who lack sufficient health to enable them to exercise basic rights and liberties. This version of the argument posits cloning as an affront to human dignity in particular circumstances, rather than claiming the technology as intrinsically inconsistent with human dignity. (shrink)

And, unlike some other of the great unsolved problems, it is also of far-reaching and profound practical importance. The kind of answer we give to the question affects in a multitude of ways the conduct of our lives, the form and working of all our institutions, our science, our law, our politics, our economics, our morals, (...) our religion. The words “idea” and “concept” have been, and still are, the source of so much confusion in psychology that we shall do well to banish them from the vocabulary of that science. I have urged this reform and have endeavoured to promote it by writing a psychology without ideas.It has seemed to me that the word “concept” plays a no less pernicious rôle in logic. But it was not until I began to look into the matter with a view to (...) writing this article that I became aware of the desperate degree and extent of the confusion obtaining in all that pertains to the concepts of logic. The Press and the general public, in America, at least, seem to be aware of only two of these, namely the psychoanalytic and the behaviouristic schools; and the newspaper writers and the average highbrow are content to mix snippets and catchwords from these two utterly different schools, ignoring all the rest, unless they add to their shop-window display some uncertain (...) reference to the work of the mental testers. Involvement is an important element of good research and a route to impact. In line with early organizational analysis, we advocate involvement with research stakeholders and investing in the necessary communication and rhetorical skills.

Artificial intelligence is increasingly being developed for use in medicine, including for diagnosis and in treatment decision making. The use of AI in medical treatment raises many ethical issues that are yet to be explored in depth by bioethicists. In this paper, I focus specifically on the relationship between the ethical ideal of shared decision making and AI systems that generate treatment recommendations, using the example of IBM’s Watson for Oncology. I argue that use of this type of system creates (...) both important risks and significant opportunities for promoting shared decision making. If value judgements are fixed and covert in AI systems, then we risk a shift back to more paternalistic medical care. However, if designed and used in an ethically informed way, AI could offer a potentially powerful way of supporting shared decision making. It could be used to incorporate explicit value reflection, promoting patient autonomy. In the context of medical treatment, we need value-flexible AI that can both respond to the values and treatment goals of individual patients and support clinicians to engage in shared decision making. Anonymized reflection was employed as an innovative way of teaching ethics in order to enhance students' ability in ethical decision making during a `Care of the Dying Patient and Family' module. Both qualitative and quantitative data were collected from the first two student cohorts who experienced anonymized reflection ( n = 24). The themes identified were the richness and relevance of scenarios, small-group work and a team approach to teaching. Students indicated that they preferred this style of teaching. This finding (...) was verified by a postal questionnaire conducted four months later. The conclusions drawn from this study suggest that using anonymized reflection is an effective method for teaching ethics to nurses and indicates that learning about ethical issues in this way reduces uncertainties. I argue that Arendt and Benjamin shared a common understanding of the problems of modernity. For both thinkers contemporary conditions of existence were defined on the one hand, by a similar conception of history, and on the other hand, a break with the tradition of philosophy. I demonstrate that Benjamin’s fragmented history, adopted by Arendt in response to this contemporary politico-philosophical crisis, (...) allowed her to redeem the past as a basis of a future-oriented philosophy by creating a space for arresting the continuum of history and asserting the importance of human agency. This article examines the construction and implementation of the Sullivan Principles, a two-decade effort to use corporate codes of conduct to improve the behavior of multinational corporations in South Africa under apartheid. Without organized social movement pressure, corporations would not have agreed to adopt the code, and corporate compliance required sustained pressure from the anti-apartheid movement. The system's independent monitoring process was problematic, and managers' definitions of “good corporate citizenship” were more guided by monitors'emphases than by substantive concerns. Based on (...) the historic case, the article raises questions about the voluntaristic, stateless character of transnational corporate codes of conduct and questions whether such codes offer a viable strategy for improving working conditions. This paper attempts to account for the peculiarly ‘otherworldly’ character of much contemporary management critique. It does so rather circuitously by focusing upon elements of the work of a moral philosopher, Alasdair MacIntyre. MacIntyre's comments about the ‘character’ of the ‘manager’ have commanded considerable support within critical organizational and management studies and have been regularly cited by critical intellectuals, keen to unmask an ethical and emotional vacuum at the heart of contemporary management practice. In what follows, I attempt to show (...) that the prestige and status accorded to MacIntyre's critique of the manager within organizational and management studies is directly proportional to its abstraction from the institutional realities of managing. In particular, I focus upon the ways in which MacIntyre attempts to hold the character of the manager accountable to a particular ideal of the person, one that derives many of its characteristics from Christian theology. An essential aspect of forming representations of social groups is to recognize socially relevant attributes licensed by the group membership. Because knowledge of cultural practices tends to be transmitted through social contact within social groups, it is one of the fundamental attributes shared among members of a social group. Two experiments explored whether 5‐ and 6‐year‐olds selectively attribute shared cultural knowledge on the basis of group membership of agents. Using novel social groups, children were introduced to one target agent and (...) two other agents, one of which belonged to the same group as the target and one belonged to a different group. Children were then asked who would know or like same things as the target agent. The results showed that children expect group members to know the same songs, whereas they do not necessarily expect them to like the same songs or know the same generic facts. These findings suggest that children are remarkably selective in the attributions they make based on social group membership and from early on, they expect social group membership and cultural knowledge to be closely linked. Cependant, j’avais l’intuition que mon analyse sur ce qu’on appelle aujourd’hui les « legacy media », les médias traditionnels, s’appliquerait de façon pertinente aux pratiques en pleine évolution des personnes travaillant dans les médias digitaux. Il y a plus de quarante ans, je postulai que les employés des médias traditionnels avaient élaboré des manières...

Notant d’un côté que la variabilité de la matière première empêche la routinisation et de l’autre, que les organisations imposent des protocoles de routine afin de contrôler le flux du travail, cet article explore deux questions liées : comment une organisation peut-elle traiter de manière routinière des événements inattendus? Comment les journalistes d’actualité font-ils décroître la variabilité des événements qui forment la matière première de l’information? L’article examine cinq classifications utilisées par les journalistes pour faire le tri parmi les événements (...) qui font l’actualité. En premier lieu, l’article analyse ces classifications en tant que « catégories » qui définissent ces événements. Cette approche se soldant par un échec, pour des raisons qui seront précisées, l’article examine ces mêmes classifications en tant que typifications. Cette dernière analyse montre à quel point la typification de la matière première est constituée par les exigences de la structure organisationnelle du travail d’information. Une attention particulière est prêtée aux problèmes pratiques liés au contrôle du travail. Les conséquences, pour les organisations produisant de l’information, de la manière dont un événement se produit sont également analysées. Certaines conséquences de l’analyse sont débattues. As assisted reproductive technologies become increasingly popular, debate has intensified over the ethical justification for restricting access to ART based on various medical and non-medical factors. In 2010, the Australian state of Victoria enacted world-first legislation that denies access to ART for all patients with certain criminal or child protection histories. Patients and their partners are identified via a compulsory police and child protection check prior to commencing ART and, if found to have a previous relevant conviction or child protection (...) order, are given a “presumption against treatment.” This article reviews the legislation and identifies arguments that may be used to justify restricting access to ART for various reasons. The arguments reviewed include limitations of reproductive rights, inheriting undesirable genetic traits, distributive justice, and the welfare of the future child. We show that none of these arguments justifies restricting access to ART in the context of past criminal history. We show that a “presumption against treatment” is an unjustified infringement on reproductive freedom and that it creates various inconsistencies in current social, medical, and legal policy. We argue that a state-enforced policy of restricting access to ART based on the non-medical factor of past criminal history is an example of unjust discrimination and cannot be ethically justified, with one important exception: in cases where ART treatment may be considered futile on the basis that the parents are not expected to raise the resulting child. This paper reviews the ethical literature on conflicts between health professionals and parents about medical decision-making for children. We present the results of a systematic review which addressed the question ‘when health professionals and parents disagree about the appropriate course of medical treatment for a child, under what circumstances is the health professional ethically justified in overriding the parents’ wishes?’ We identified nine different ethical frameworks that were put forward by their authors as applicable across various ages and clinical scenarios. Each of these frameworks centred on a different key moral concept including harm, constrained parental autonomy, best interests, medically reasonable alternatives, responsible thinking and rationality. The tendency for abstract theorists of democratization to overlook gender dynamics is perhaps exacerbated in the South African case, where racial inequality is obviously key. Yet, attention to the processes through which South African activists inserted gender issues into discussions about how to construct new institutions provides an unusual prism through which to explore the gendered character of citizenship. After providing an explanation for the unusual prominence of gender concerns in South Africa's democratization, the article argues that during the drawn-out (...) democratic transition, South African activists, often influenced by international feminist discussions, developed a collective definition of gender interests and began to build those interests into the structure of democratic institutions, in ways that will affect politics and the definition of “women's interests” in the future. This article examines whether the concept of ‘professionalism’ as applied to the legal profession serves any useful guide as to how lawyers should act. Professionalism is defined in terms of civility for the purposes of this article and considered against the backdrop of a perceived ‘decline’ in professionalism in the legal profession. Arguably, professionalism is all too often subsumed under the heading of ethics in both common parlance and in course content in law schools where Ethics, Professional Responsibility are part (...) of the curriculum with little weight given to professionalism per se. This article reflects, in part, on the student perception as to the state of the profession garnered from their responses to an assessment task at an Australian university. The issue is ripe for further discussion given that in Australia, the Law Admissions Consultative Committee has queried whether the teaching of Ethics should be withdrawn from the core curriculum. The article queries if there is in fact a ‘decline’ in standards and civility and, if so, considers the potential to arrest this ‘decline’ by the profession, universities and students working together to revive ‘professionalism’. In pediatric health care, parents and clinicians sometimes have competing ideas of what should be done for a child. In this article, we explore the idea that notions of what should be done for a child partly depend on one's perception of one's role in the child's life and care. Although role‐based appeals are common in health care, role‐differentiated approaches to understanding parent‐clinician conflicts are underexplored in the pediatric bioethics literature. We argue that, while the parental role is recognized as (...) having social content or value, and sometimes legal force, it is not always recognized as having ethical content or value, as the clinician's role is. We draw together key insights from the normative and empirical literature on parental roles to show how a role‐based lens might inform clinicians’ and clinical ethicists’ approach to cases in which parents and clinicians disagree. BackgroundWhile fertility preservation is recommended practice for paediatric oncology patients, it is increasingly being considered for transgender children and young people in paediatric care. This raises ethical issues for clinicians, particularly around consent and shared decision-making in this new area of healthcare.MethodsA systematic review of normative literature was conducted across four databases in June 2020 to capture ethical considerations related to fertility counselling and preservation in paediatric transgender healthcare. The text of included publications was analysed inductively, guided by the Qualitative (...) Analysis Guide of Leuven.ResultsTwenty-four publications were identified for inclusion. Four key ethical considerations emerged from this literature: access to fertility preservation, conscientious objection, decision-making capacity of children and young people, and shared decision-making.ConclusionIn the identified literature, there is consensus that transgender children and young people should not be refused access to fertility preservation services solely due to their gender identity, and that clinicians with conscientious objections to fertility preservation for this group have an obligation to refer on to willing providers. Factors that create ethical complexity in this area of paediatric care include the child’s age, mental health, and parents’ views. (shrink)
