Depuis Droit, mythe et raison (1980) écrit avec Jacques Lenoble jusqu’aux récents À quoi sert le droit? Usages, fonctions et finalités (2016) ou Le droit, objet de passions (2018), François Ost ne cesse de questionner les rapports de nos sociétés au droit et la place de celui-ci dans nos sociétés contemporaines. Avec Le droit malgré tout, il s’agit de rendre hommage à l’œuvre et à la carrière d’une figure centrale de la théorie du droit contemporaine et aussi au fondateur, (...) avec le regretté Michel van de Kerchove, de ce que l’on appelle parfois « l’école de Saint-Louis ». Abordant les deux pôles de la dialectique à laquelle François Ost est si attaché - la critique et la reconstruction -, l’ouvrage propose un regard interdisciplinaire sur le droit, à travers les principaux thèmes qui ont nourri la pensée de l’auteur. What is it to share the same concept? The question is an important one since sharing the same concept explains our ability to non-accidentally coordinate on the same topic over time and between individuals. Moreover, concept identity grounds key logical relations among thought contents such as samesaying, contradiction, validity, and entailment. Finally, an account of concept identity is crucial to explaining and justifying epistemic efforts to better understand the precise contents of our thoughts. The key question, then, is what psychological (...) and social facts could play these roles? Elsewhere, we have argued for a specific relational model of concept identity, the connectedness model (e.g. Schroeter 2012, Schroeter and Schroeter 2014, 2015). Our aim in this chapter is to further explain the motivations behind that account, to address worries about transitivity and vagueness, and to contrast our approach with closely related accounts of concept identity developed by François Recanati and Simon Prosser. -/- What’s distinctive of our approach is that we seek to vindicate the first-person epistemic perspective of concept users. Concepts, on our account, play a crucial normative role in setting regulative ideals for the representational practices in which individual subjects participate. This focus on the normative role of concepts – as opposed to a purely causal explanatory role – motivates our approach to concept identity and our toleration of vagueness and borderline cases. Our main focus in this paper is Herman Cappelen’s claim, defended in Fixing Language, that reference is radically inscrutable. We argue that Cappelen’s inscrutability thesis should be rejected. We also highlight how rejecting inscrutability undermines Cappelen’s most radical conclusions about conceptual engineering. In addition, we raise a worry about his positive account of topic continuity through inquiry and debate.

What is the relation between monetary policy and inequalities in income and wealth? This question has received insufficient attention, especially in light of the unconventional policies introduced since the 2008 financial crisis. The article analyzes three ways in which the concern central banks show for inequalities in their official statements remains incomplete and underdeveloped. First, central banks tend to care about inequality for instrumental reasons only. When they do assign intrinsic value to containing inequalities, they shy away from trade-offs with (...) the standard objectives of monetary policy that such a position entails. Second, central banks play down the causal impact monetary policy has on inequalities. When they do acknowledge it, they defend their actions by claiming that it is an unintended side effect, that it is temporary, and/or that any alternative policy would fare even worse. The article appeals to the doctrine of double effect to criticize these arguments. Third, even if one accepts that inequalities should be contained and that today’s monetary policies exacerbate them, is it both desirable and feasible to make containing inequalities part of the mandate of central banks? The article analyzes and rejects three attempts on the part of central banks to answer this question negatively. (shrink)

Adopting a communication as constitutive of organization (CCO) perspective on ethics and corporate social responsibility (CSR) invites us to create the conditions of a dialogue, discussion, or debate between various stakeholders, who can then try to confront their respective positions on a given issue, and possibly come to a decision regarding how a situation should be evaluated and/or responded to. As shown in this article, getting human stakeholders to voice their concerns about a specific situation is a way not only (...) to rationally confront multiple viewpoints on what should be done about it (à la Habermas) but also to allow elements of this situation to reveal themselves in a discussion. This is why any ethical decision has to experience a form of undecidability and surprisability. When beliefs and opinions can be called into question, it means that participants are ready to become attentive to what a situation might surprisingly call for. Communication is therefore a matter of ventriloquism, as human participants should also be considered the means by which elements of a situation manage to express themselves in a discussion, dictating specific courses of action over others. This concretely means that multiple voices can be heard in such a scene: not only the voices of the human stakeholders who speak to each other but also the voices of facts, principles, future generations, ecosystems, populations that are made to say things through these various turns of talk. The article introduces a special issue on “Rethinking Liberal Multiculturalism: Foundations, Practices and Methodologies.” The contributions presented in this special issue were discussed during the conference « Multicultural Citizenship 25 Years Later », held in Paris in November 2021. Their aim is to take stock of the legacy of Kymlicka’s contribution and to highlight new developments in theories of liberal multiculturalism and minority rights. The contributions do not purport to challenge the legitimacy of theories of multiculturalism and minority rights, they (...) rather aim at deepening our understanding of the foundations of liberal multiculturalism and of its practical implementation, sensitive to social scientific dynamics of diverse societies. Without abandoning the general idea that cultural minorities should be granted special minority rights, the essays presented raise new questions about three dimensions central to liberal multiculturalism: its normative foundations, its practical categories of minorities or groups, and its fact-sensitive methodology. Taken together they shed light on the renewed variety of theories of liberal multiculturalism highlighting their complexity and internal disagreements. To introduce these articles, the article first draws a brief historical overview of the debates on multiculturalism since the 1990s (section 1). It then highlights the distinctive aspects of Kymlicka’s contribution (section 2) and identifies recent research trends (section 3). Doing so, it explains how the articles gathered here both expand on those distinctive aspects and explore those new research avenues. The section 4 summarizes the contributions. (shrink)

In this article, we compare Ricard Zappata-Barrero’s interculturalism with Tariq Modood’s multiculturalism. We will discuss the relation between distinct elements that compose both positions. We examine how recent discussions on interculturalism have the potential to contribute to theories of multiculturalism without undermining their core principles. Our position is close to that of Modood’s as he has already carefully tried to incorporate interculturalist insights into his own multiculturalism. Yet we provide a raise a few questions regarding Modood’s treatment of the relation (...) between multiculturalism and interculturalism. After summarizing each author’s potion (I), we will comment on the following set of relations between their basic elements: (II) The relation between intercultural contact and intercultural dialogue; (III) The relation between contact at the local level and the societal/state level; (IV) The relation between group-specific measures, intercultural contact and mainstreaming. This paper articulates what it would take to defend representationalism in the case of emotions – i.e. the claim that emotions attribute evaluative properties to target objects or events. We argue that representationalism faces a significant explanatory challenge that has not yet been adequately recognized. Proponents must establish that a representation relation linking emotions and value is explanatorily necessary. We use the case of perception to bring out the difficulties in meeting this explanatory challenge.

Hundreds of clinical trials of potential treatments and vaccines for the “coronavirus 19 disease” have been set up in record time. This is a remarkable reaction to the global pandemic, but the absence of a global coordination of clinical research efforts raises serious ethical concerns. Some COVID-19 patients might carry the burden of clinical trial involvement even though their trial cannot be completed as researchers are competing for patients. A shortage of medicines can occur when existing drugs are diverted for (...) clinical trials. Research ethics committees are overburdened with multiple applications. A multitude of trials can also overstretch medical staff and risk neglecting non-COVID-19 patients. And finally, conflicting conclusions from a multitude of heterogeneous trials might lead to delays in public health decisions about life-saving issues. These challenges are made worse by the unpredictable evolution of epidemics, the active involvement of political decision-makers in scientific issues and the pressure of social media globally. While freedom to conduct research must be safeguarded, global health emergency situations would greatly benefit from effective international coordination mechanisms for clinical research. (shrink)

In this chapter, we discuss social network analysis as a method for the history of economics. We argue that social network analysis is not primarily a method of data representation but foremost a method of discovery and confirmation. It is as such a promising method that should be added to the toolbox of the historian of economics. We furthermore argue that, to be meaningfully applied in history, social network analysis must be complemented with historical knowledge gained by other means and (...) often by more traditional, mostly qualitative, methods. It should therefore be viewed as a method that complements rather than replaces more established approaches in the history of economics. (shrink)

Many of the most influential theorists of linguistic justice make arguments on the basis of comparisons between language and religion. They claim either that (1) language, by contrast with religion, cannot be separated from the state or that (2) unequal official linguistic recognition, just like unequal official religious recognition, is morally problematic. This article argues that careful attention to debates about liberalism and the place of religion in public life invites us to question the two above-mentioned liberal assumptions about religion (...) underlying many arguments concerning linguistic justice based on (dis)analogies between language and religion. The hope is that such critical scrutiny is likely to shed some light on normative questions of linguistic justice, more precisely on questions about the legitimacy of granting more recognition to certain languages, usually those of national native groups (as opposed to groups resulting from more or less recent immigration). This article forms part of a study which was inspired by the ever-growing need for significance expressed both by my life coaching and pastoral therapy clients as well as the need for existential meaning reported both in the lay press and academic literature. The study reflected on a life that matters with a group of co-researchers in a participatory action research relationship. The study has been positioned within pastoral theology and invited the theological discourse into a reflection of existential meaning. (...) Adopting a critical relational constructionist epistemology, the research was positioned within a postmodern paradigm. The implications for meaning and research were explored and described. This article tells the story of how spirituality was positioned in the narratives of meaning by my fellow researchers. (shrink)

Une justice accessible et à l’écoute suppose un temps d’échange adapté à la nature du procès, à la complexité de l’affaire et aux enjeux du dossier. Un juge actif pendant la phase orale permet aussi de rassurer le justiciable sur la prise en considération de son dossier. Dans le souci d’une bonne administration (...) de la justice, il existe différentes manières de rétablir une forme d’harmonie entre l’écrit et l’oral. À toutes les étapes du procès, en première instance, en appel et devant le juge de cassation, la boîte à outils est, désormais, bien achalandée pour faire du sur-mesure. ll reste à en faire la promotion et se saisir pleinement de ces outils. We present social network analysis as a complement to other methods in the history of economics. We first discuss why social network analysis is especially promising for the study of the history of recent economics. We then use an example of research using it to highlight some of its characteristics.

In this paper, I examine Adorno’s controversial claim that human rationality is inherently mimetic. To do so, I break this claim down into three puzzles (the natural historical puzzle, the metaphysical puzzle, and the epistemic puzzle) and consider each in turn. The first puzzle originates in Adorno’s assertion that in the course of human history the mimetic moment of human thought “is melted together with the rational moment”. So whereas, on his narrative, mimesis has become an intrinsic component of human (...) rationality, it appears that we are oblivious to this state of affair and unable to recognize the workings of mimesis in what we otherwise refer to as rationality. The second puzzle concerns the traditional metaphysical question regarding the possibility of knowledge. Adorno holds that the key to this question lies in the “mimetic moment of knowledge”, which he characterizes as the “moment of the elective affinity between the knower and the known.” The third puzzle concerns his views on how the mimetic moment of thought plays out in our epistemic practices. As he puts it, “consciousness knows of its other as much as it resembles that other,” which seems to entail that our very efforts to conceptualize objects somehow rely on imitative processes. I work out what I take to be the basics of Adorno’s understanding of mimesis and use them to make sense of each puzzle. I argue that Adorno’s insistence on the mimetic component of human rationality isn’t meant to promote more mimetic modes of comportment, but a reflexive awareness of the extent to which our rational activities already rely on imitative (or immersive) processes, even those we view as embodying the strongest claims to the contrary. Healthy Volunteers (HVs) who participate in clinical trials are a vulnerable group that deserves specific protection. We assessed the number and types of studies that involve HVs around the world and outline the methodological barriers to their analysis. We found that tens of thousands of HVs are involved every year in clinical trials in a large variety of countries and that the overwhelming majority of studies are not “first-in-human” but pharmacokinetic studies. The two cornerstones for both ethical and safe participation (...) of HVs in clinical trials are properly obtained informed consent, and a minimization of exposure to risk, in particular by avoiding concealed participation in multiple trials. To minimize the risk of exploitation of HVs and their exposure to risk, we propose ways to ensure genuine informed consent, and advocate setting up national Healthy Volunteer volunteer registries as established in France and the U.K. (shrink)

Cette fonction idéologique et politique du droit positif ne se dégage pas seulement du contenu de ses règles mais aussi des techniques qu'il met en oeuvre : le formalisme et le rationalisme du droit moderne obéissent aux lois d'une rationalité économique. Une solution au problème de la causalité mentale qui ne soutient ni le dualisme de la substance, ni le physicalisme non réductionniste. Une solution qui fait appel aux propriétés particulières et qui permet de prendre en compte l'ensemble du problème : pertinence des propriétés mentales, distinction entre les propriétés mentales et physiques, clôture causale du domaine physique et non surdétermination causale.

La notion d’expologie est relativement récente : ce néologisme est apparu au cours des années 1990, dans la littérature muséologique, pour évoquer l’étude des expositions d’un point de vue théorique.
