El derecho, como lenguaje, cumple diferentes funciones comunicacionales que logra, en buena medida, a través del uso de herramientas y dispositivos narrativos. Entre ellos se destacan las ficciones jurídicas, las cuales, lejos de retratar la realidad, buscan crear una verdad jurídica. En el caso de las ficciones constitucionales, éstas son, con frecuencia, malinterpretadas, lo que lleva a su degeneración. This article deals with a modern disease of academic science that consists of an enormous increase in the number of scientific publications without a corresponding advance of knowledge. Findings are sliced as thin as salami and submitted to different journals to produce more papers. If we consider academic papers as a kind of scientific ‘currency’ that is backed by gold bullion in the central bank of ‘true’ science, then we are witnessing an article-inflation phenomenon, a scientometric bubble that is most (...) harmful for science and promotes an unethical and antiscientific culture among researchers. The main problem behind the scenes is that the impact factor is used as a proxy for quality. Therefore, not only for convenience, but also based on ethical principles of scientific research, we adhere to the San Francisco Declaration on Research Assessment when it emphasizes “the need to eliminate the use of journal-based metrics in funding, appointment and promotion considerations; and the need to assess research on its own merits rather on the journal in which the research is published”. Our message is mainly addressed to the funding agencies and universities that award tenures or grants and manage research programmes, especially in developing countries. The message is also addressed to well-established scientists who have the power to change things when they participate in committees for grants and jobs. (shrink)

The purpose of this paper is to explore the impact that developments in transhumanist technologies may have upon human cultures, and to do so by exploring a potential debate between Habermas and the transhumanists. Transhumanists, such as Nick Bostrom, typically see the potential in genetic and other technologies for positively expanding and transcending human nature. In contrast, Habermas is a representative of those who are fearful of this technology, suggesting that it will compound the deleterious effects of the colonisation of (...) the lifeworld, further constraining human autonomy and undermining the meaningfulness of the lifeworld by expanding the technological control and manipulation of humanity. It will be argued that these opposed positions are grounded in fundamentally different understandings of the consequences of scientific and technological advance. On one level, the transhumanists remain confident that the lifeworld has within it the resources necessary to find meaning and purpose in a society deeply infused by genetic technology. Habermas disagrees. On another level, the difference is articulated by Horkheimer and Adorno in Dialectic of Enlightenment, primarily by challenging what may be understood as a Baconian faith in science as a project for the domination of nature. While the transhumanists broadly embrace this faith, Habermas returns to something akin to Horkheimer and Adorno’s pessimistic scepticism. (shrink)

La ponencia tiene como pretensión, señalar algunas implicaciones conceptuales y curriculares, que la discusión fe-razón tendría para la docencia universitaria, tanto confesionales, como no confesionales. Para ello, la presentación se apoya en las posiciones expuestas por Habermas y el Cardenal J. Ratzinger, en un debate hace dos años. Consta de los siguientes aspectos: 1. En una primera parte, se hace una presentación de la caracterización que hace Habermas, de lo que él denomina las sociedades post-seculares y la forma como se (...) ven impelidas a articularse distintas visiones del mundo, no siempre ni necesariamente opuestas, más sí diferentes; su análisis se orienta a mostrar la necesidad de flexibilizar dichas posiciones, en aquellos componentes que no afectan la esencia de la verdad de cada quien. 2. En la segunda parte, se hace la presentación del punto de vista del Cardenal Ratzinger, quien le señala a las visiones racionalistas filosóficas, la necesidad de que éstas también se apliquen a sí los filtros de la crítica misma de la razón, e identifiquen aquellos elementos igualmente inconclusos, parciales e insuficientes, que han hecho que las visiones racionalistas dejen por fuera de sus análisis, elementos que son inherentes al ser humano y, de los cuales, no pueden ser despojados por el arbitrio del juicio de la razón. 3. Finalmente, se plantean unas conclusiones, a manera de recomendaciones, de cara a la docencia universitaria, con relación específica al enfoque con el cual se imparten asignaturas de formación cristiana, de carácter obligatorio en las universidades confesionales. It is shown that the class of l-hemi-implicative semilattices is a variety. These algebras provide (...) a general framework for the study of different algebras of interest in algebraic logic. In any l-hemi-implicative semilattice it is possible to define an derived operation by $$a \sim b := \wedge $$ a∼b:=∧. Endowing $$$$ with the binary operation $$\sim $$ ∼ the algebra $$$$ results an l-hemi-implicative semilattice, which also satisfies the identity $$a \sim b = b \sim a$$ a∼b=b∼a. In this article, we characterize the commutative l-hemi-implicative semilattices. We also provide many new examples of l-hemi-implicative semilattice on any semillatice with greatest element. Finally, we characterize congruences on the classes of l-hemi-implicative semilattices introduced earlier and we characterize the principal congruences of l-hemi-implicative semilattices. (shrink)

A critique of J. L. Schellenberg's argument from Divine Hiddenness: Schellenberg's conclusion that since apparently there are 'capable inculpable non-believers in God' the cognitive problem of divine hiddenness is actually an argument for the non-existence of God. Schellenberg's conclusion seems at least partly based on his misunderstanding or disregard of significant aspects of the Judeo-Christian tradition and certain assumptions, especially regarding nature of religious belief as well as primacy and instrumentality of reason. I suggest that given the kind of God (...) proposed by the Judeo-Christian tradition it is not necessary that reasonable non-belief in His existence be impossible; moreover it may even be the case that possibility of reasonable non-belief is necessary given the nature and purposes of God as proposed by the Judeo-Christian tradition. The purpose of this paper is to explore the role that modernism in the arts might have in articulating the uselessness and incomprehensibility of physical and mental suffering. It is argued that the experience of illness is frequently resistant to interpretation, and as such, it will be suggested, to conventional forms of artistic expression and communication. Conventional narratives, and other beautiful or conventionally expressive aesthetic structures, that presuppose the possibility and desirability of an harmonious and meaningful resolution to conflicts and (...) tensions, may fundamentally misrepresent the patient
s experience. By drawing on the work of Emmanuel Levinas (on useless suffering) and the aesthetic theories of Nietzsche and T. W. Adorno, it will be argued first that a faith in the possibility of harmonious resolution of suffering is misplaced and does violence to the experience of suffering. Second, it will be argued that the expression of suffering lies not in finding words, images or sounds that communicate the experience of that suffering to others, but rather in the persistent and radical disruption of any illusion of meaning and coherence that might be imposed upon the experience, so that the very possibility of communication is also disrupted. Esta investigación describe la historia del desconocimiento de la pluralidad cultural en Colombia y examina la tensión actual vivida por el Estado colombiano, que en su tarea de procurar la libertad y la igualdad de los ciudadanos debe buscar a la vez el reconocimiento de los derechos colectivos. La experiencia (...) colombiana evidencia los límites de la legislación liberal, basada tradicionalmente en los derechos individuales y sirve como espacio para contextualizar la discusión que en torno al papel del Estado ante los derechos colectivos han desarrollado recientemente los filósofos morales partidarios del comunitarismo y aquellos partidarios del universalismo de los derechos individuales. Das individuelle Gedächtnis und Selbstbewußtsein entwickelt sich im Bezugsrahmen der jeweiligen Weltinterpretation eines Kulturraumes, von dem es seine Begrifflichkeit bezieht. Im Zentrum der Überlegungen steht das Wechselverhältnis von individuellem und kulturellem Gedächtnis. Besonders berücksichtigt wird dabei auch der Zusammenhang von Gedächtnis und Gewissen. Die Frage ist, welcher Spielraum dem Individuum in seinem Selbstverständnis zukommt und welchen Einfluß es umgekehrt auf das kulturelle Gedächtnis ausüben kann, insofern die Gewichtung von (...) individuellem und kulturellem Gedächtnis der Freiheit der Person überlassen bleibt. RESUMEN Este artículo propone la piel como un concepto ontológico y fenomenológico indispensable para comprender el daño y repensar la dimensión sensible de la reparación. El trabajo tiene cuatro secciones. En primer lugar, introduce la relevancia de la fenomenologia para estudiar el dafio. En segundo lugar, formula una ontologia fenomenológica de la piel a la luz de dos componentes: la heteroafección y la autoafección. En tercer lugar, aplica la ontologia de la piel a la violencia. Finalmente, en cuarto lugar, concluye (...) con una conceptualización fenomenológica del daño que permite repensar la reparación como un proceso relativo a la vida sensible. ABSTRACT This paper proposes the skin as an essential ontological and phenomenological concept to comprehend the damage and to rethink the sensible dimension of repair. The work has four sections. First of all, it introduces the relevance of phenomenology for the study of damage. In second place, it formulates a phenomenological ontology of the skin in the light of two components: the hetero-affection and the auto-affection. In third place, it applies the ontology of the skin to violence. Finally, in fourth place, this paper concludes with a phenomenological conceptualization of damage that allows to rethink the repair as a process concerning the sensible life. (shrink)

Die Unabänderlichkeit der Kontingenzen wird zunächst als Götterwille empfunden und gedeutet, der mit menschlicher Einsicht nicht begriffen werden kann. Erst Platon interpretiert die Lebensschicksale als Ergebnis der die ,,Lebenslose wählenden Seele". Mit der Entfaltung eines transzendenten Weltengrundes entsteht das Bedürfnis einer Deutung der Kontingenzen als Teile der Kosmosordnung. Die jüdisch-christliche personale Interpretation Gottes setzt schließlich die Vertrauensbasis für die durch den Erlösungsglauben ermöglichte Lebensfreude und Weltoffenheit.

Die ursprüngliche Wahrheit ist unsagbar und kann nur durch Bilder verdeutlicht werden. Der Begriff vergegenwärtigt zwar Abwesendes, ist aber begrenzt auf Definibles. Dennoch vermag Sprache über Endliches hinaus zu deuten und versucht im Mythos, der in der antiken Vorstellung als göttliche Gabe verstanden wird, Transzendentes darzustellen. Auch das Mittelalter entwickelt ein System der Offenbarungshermeneutik zur Deutung der Welt wie zur Festlegung der Aufgabe, Moral und Stellung des Menschen im Kosmos. Will man Welt verstehen, so muß man im Sinne eines christlich (...) interpretierten Neuplatonismus und der Formel ,,verum et factum convertuntur" eine Vorstellung der göttlichen Schöpfung entfalten. This article sheds light on Hobbes’s concept of the state of nature through a reading of his conception of knowledge, which makes it possible to relate him with the ‘New Science’ or the Scientific Revolution. In consequence, this article describes Hobbes with some problems and traditions of the Scientific Revolution through a fresh reading of his theory of knowledge, whence the concept of the state of nature is redefined in terms of integral cause; this makes it possible to argue the (...) need for Commonwealth, excluding the anthropological pessimism traditionally attributed to Hobbes. Este trabajo pretende mostrar –mediante una interpretación del contexto dado por algunos capítulos clave del Monologion– que la función del argumento de san Anselmo consiste principalmente en determinar los términos a partir de los cuales es posible concebir un ser supremo, sobre la base de la identidad absoluta entre la esencia divina y todo lo que se muestra como propio de ella. Dicha identidad implicaría una confluencia no solamente de las propiedades en la esencia divina, sino sobre todo del ser (...) en el pensar y viceversa. La trascendencia de una actividad en la otra, entendida como una remisión recíproca, permitiría mostrar el contexto especulativo en el cual se concibe la identidad absoluta de las propiedades en el ser supremo, así como también los criterios según los cuales aquello que se reconoce como perfecto en las criaturas puede ser considerado como propio de Dios.
