El derecho, como lenguaje, cumple diferentes funciones comunicacionales que logra, en buena medida, a través del uso de herramientas y dispositivos narrativos. Entre ellos se destacan las ficciones jurídicas, las cuales, lejos de retratar la realidad, buscan crear una verdad jurídica. En el caso de las ficciones constitucionales, éstas son, con frecuencia, malinterpretadas, lo que lleva a su degeneración. En este texto, más allá de ofrecer un acercamiento conceptual a la figura de las ficciones constitucionales, se ofrece un análisis introductorio (...) en cuanto a la forma en la que ha ocurrido esto en el contexto del nuevo constitucionalismo latinoamericano. We present a fully relational definition of inertial systems based in the No Arbitrariness Principle, that eliminates the need for absolute inertial frames of reference or distinguished reference systems as the ``fixed stars'' in order to formulate Newtonian mechanics. The historical roots of this approach to mechanics are discussed as well. The work is based in part in the constructivist perspective of space advanced by Piaget. We argue that inertial systems admit approximations and that what is of practical use are (...) precisely such approximations. We finally discuss a slightly larger class of systems that we call ``relatively inertial'' which are the fundamental systems in a relational view of mechanics. (shrink)

While mechanics was developed under the idea of reciprocal action (interactions), electromagnetism, as we know it today, takes a form more akin to unilateral action. Interactions call for spatial relations, unilateral action calls for space, just one reference centre. In contrast, interactions are matters of relations that require at least two centres. The development of the relational electromagnetism encouraged by Gauss appears to stop around 1870 for reasons that are not completely clear but are certainly not solely scientific. By the (...) same time, Maxwell recognised the equivalence in formulae of his electromagnetism and the one advocated by Gauss and called for an explanation of why such theories so differently conceived have such a large part in common. In this work we reconstruct and update the relational electromagnetism up to the contributions of Lorentz guided by the non-arbitrariness principle (NAP) that requests arbitrary choices to be accompanied by groups of symmetries. We show that a-priori there must be two more symmetries in electromagnetism, one related to the breaking (in the description) of the relation source/detector and one relating all the perceptions of the same source by detectors moving with different (constant) relative velocities. We show that the idea of electromagnetic waves put forward in concept by Lorenz (1861-1863) before Maxwell (1865) and in formulae (1867) just after Maxwell, together with the ``least action principle'' proposed by Lorentz are enough to derive Maxwell's equations, the continuity equation and the Lorentz' force, and that there is a dual formulation in terms of fields of the receiver (as opposed to fields of the source). While Galilean transformations are associated with removing the arbitrariness implied in the election of a reference space, they will not explicitly appear in a formulation based upon a relational space although we occasionally mention their usefulness. In contrast, Lorentz' transformations will emerge in this formulation involving the relations between the perceived fields of different receivers. Moreover, the role of the full Poincaré-Lorentz group as a group of transformations of the perceived actions is elucidated. In summary, we answer Maxwell's philosophical question showing how the same theory in formulae can be abduced using different inferred entities. Each form of abduction implies as well an interpretation and a facilitation of the theoretical construction. This work relies heavily on logical concepts as abduction put forward by C. The prospective formalization of the Anthropocene as a chronostratigraphic unit by the International Commission on Stratigraphy has been intensely debated. This paper explores and assesses the stakes of this process from a philosophical perspective. I distinguish two senses of formalization—the descriptive and the evaluative—and argue that: 1) there are descriptive and evaluative formalizations of the Anthropocene beyond the confines of the ICS; 2) incoherencies between Anthropocene proposals and the ICS’s current tenets are not a decisive reason for deferring descriptive formalization; (...) and 3) the prospective evaluative formalization of the Anthropocene by the ICS would be impactful. During the second half of the nineteenth century, electronegativity has been one of the most relevant chemical concepts to explain the relationships between chemical substances and their possible reactions. Specifically, EN is a property of the substances that allows them to attract external electrons in bonding situations. The problem arises because EN cannot be measured directly. Indeed, the only way to measure it is through different properties that do can be directly measured, for instance enthalpy, ionization energies or electron affinities. (...) What is particularly troubling about this case in quantum chemistry is that the different models used to describe and quantify EN are incompatible but, in a certain sense, equivalent because the same EN scale results in all of them. By analyzing Linus Pauling’s and Robert Mulliken’s models of EN, it will be argued that, if we remain cling to a traditional representative conception of models, we cannot understand the meaning of the information provided by those models. Indeed, if we do not want to adopt an instrumentalist point of view concerning chemical knowledge, we should reconsider by virtue of what a model represents the system, or, in other words, which the factors that determine the representative power of a model are. I will propose a new perspective that incorporates the role of experimental techniques in the very notion of representation; this perspective allows us to understand how supposedly incompatible models of the same target system can be both simultaneously representative. En el presente trabajo intentaré poner de manifiesto las debilidades de los argumentos dados por Contessa para sustentar, como fuente del representar, a los razonamientos subrogantes válidos por sobre los sólidos. En primer lugar, analizo ciertas ventajas epistémicas del criterio sustentado sobre los RS sólidos, evidenciando, consecuentemente, los límites del criterio estipulado por Contessa. En segundo lugar, muestro que los argumentos utilizados por Contessa para descartar el criterio instituido en los RS sólidos son deficientes, ya que, en el mejor de (...) los casos, no demuestran nada y, en el peor de los casos, o bien se comete una falacia por ambigüedad o bien se comete una petición de principio. This paper addresses a variant of the job shop scheduling problem with total tardiness minimization where task durations and due dates are uncertain. This uncertainty is modelled with intervals. Different ranking methods for intervals are considered and embedded into a genetic algorithm. A new robustness measure is proposed to compare the different ranking methods and assess their capacity to predict ‘expected delays’ of jobs. Experimental results show that dealing with uncertainty during the optimization process yields more robust solutions. A sensitivity (...) analysis also shows that the robustness of the solutions given by the solving method increases when the uncertainty grows. (shrink)

El objetivo de nuestra investigación es determinar el impacto de hábitos alimenticios en el desempeño académico. Fue evaluada los hábitos alimenticios según instrumentos validados y establecido su normalidad con Shapiro-Wilk W=0.97 y significancia p-valor=0.34. Tenemos que el consumo alimenticio también tiene distribución normal e impacta en el desempeño académico con una correlación de Pearson de 0.24 y significancia p-valor=0.04. La regresión logística establece el punto de corte de consumo igual a 38 para tener la probabilidad de un 50% de buen (...) desempeño académico. Asimismo, la estimación puntual de desempeño académico correspondiente a este corte de consumo 38 es el puntaje de 14. (shrink)

I respond to Lennart Nordenfelt's analysis of dignity by questioning his attempt to establish an objective standard by which dignity can be determined. I approach this by considering the way in which claims to dignity may be contested and defended. This leads, in the cases of dignity of merit and dignity of moral status, to an apparent relativism. This relativism is checked by further consideration of dignity of identity, and in particular by consideration of the nature of the processes that (...) serve to humiliate people. It is suggested that acts of humiliation attack certain competences that human beings develop as embodied, social beings. Menschenwürde may then be articulated as an account of human nature, in terms of the human potential to develop a series of core competences. This account of human nature aspires to universality, and as such offers an objective ground to dignity. La biopolítica ha devenido, sin duda, una de las categorías centrales para la reflexión política contemporánea. Dada su importancia, resulta imperioso avanzar sobre algunas operaciones teóricas que no logran dar cuenta de su especificidad, en tanto que administración de la vida como forma de dominación. Al respecto, y con la intención de rehabilitar la conceptualización de la política, nos interesa demostrar cómo la aparente dicotomía entre zoé y bíos que pretende discutir Agamben no encuentra respaldo en los textos que él (...) mismo utiliza (fundamentalmente, Aristóteles y Foucault), ni tampoco en la cristalización de tales categorías en prácticas sociopolíticas (por ejemplo, la disciplina moderna con sus raíces en el monasterio cristiano). Precisamente, la identificación de la zoé ya como forma de vida es lo que nos permite comprender el interés biopolítico por gestionar la vida biológica. Así, solamente habiendo clarificado estas categorías, podrá rehabilitarse un pensamiento político sobre la política. (shrink)

Scientific pluralism has gained supporters in philosophy of science during the last decades, since it seems to accurately account for the plural and varied development of science. Arguments in defense of robust, non-merely epistemic pluralistic positions can be found in several contemporary philosophical works. According to these positions, to hold pluralism does not suppose to assume an epistemic position regarding truth and a non-realistic view on scientific theories. Monism can be thought as the “natural” opponent of scientific pluralism. In this (...) paper, we will evaluate the alleged rivalry between the two positions, paying special attention to those riskier, ontologically more robust, pluralistic proposals. We will argue that these strongest versions of pluralism fail to offer an alternative to monism: they either changes the topic or hold a weak skepticism that Hegel develops in the Phenomenology of the Spirit. Recent discussions about the microstructure of materials generally focus on the ontological aspects of the molecular structure. However, there are many types of substances that cannot be studied by means of the concept of molecule, for example, salts. For the quantum treatment of these substances, a new particle, called phonon, is introduced. Phonons are generally conceived as a pseudo-particle, that is, a mathematical device necessary to perform calculations but which does not have a "real" existence. In this context, the aim (...) of this paper will be to analyze the ontological status of phonons. For such purposes we will critically analyze the arguments that would account for the presumed nonexistence of phonons. Finally, having already demonstrated that there are not enough reasons to consider phonons as non-existing entities, we will explore some possibilities that allow us to elucidate their ontological status. En el presente texto se realiza un análisis sobre la utilidad del método de los experimentos mentales en filosofía. Dicha utilidad se da en tanto que el experimento usado sea legítimo, esto es, que cumpla con ciertas exigencias teóricas. Sin embargo, la utilidad de tal método se ve afectada por la proliferación de experimentos mentales ilegítimos. Tomando como referencia un tipo específico de experimentos mentales ilegítimos, el texto se propone presentar una explicación al anterior fenómeno basada en la relación de (...) las nociones de conocimiento y necesidad lógica. Las ideas de Simón Bolívar sobre América y sobre Europa han recibido alguna atención de los investigadores. Mucho menos las que expresó sobre Asia y África. Aunque fueron marginales a su pensamiento, la reunión de sus alusiones al respecto permite arrojar alguna luz sobre la reflexión de la Independencia y sobre los cambios que el Libertador experimentó en su percepción del naciente mundo que aparecía ante sus ojos. Partiendo de una actitud orientalista y despectiva inicial, con el tiempo llegó a (...) pensar que el Oriente no podía descartarse como influencia en las instituciones americanas. (shrink)

Se estudian algunas reacciones en América Latina y se describe el proceso por el cual Renan llegó posteriormente a ser aceptado por círculos conservadores. The French historian Ernest Renan published in 1863 a Life of Jesus that questioned his divinity. The book aroused scandal and attempts of rebuttal. Se adapta al título del libro de Andre Gunder Frank para proponer un esquema de conjunto de la historia americana desde una visión no eurocéntrica y desde la historia mundial. El acento no se coloca en la relación del continente con la Europa mediterránea o atlántica, ni en procesos endógenos, sino en los contactos que mantuvo con las otras civilizaciones del Viejo Mundo: África, la Europa oriental, Rusia, el Medio Oriente, India, China y el Pacífico. Se argumenta que antes de (...) la llegada europea hubo una etapa fuertemente influida por las relaciones con Asia. Éstas continuaron aún en época colonial, en términos comerciales, demográficos y artísticos, junto a una fuerte inmigración e influencia cultural africana. Si bien la independencia supuso una serie de ilusiones sobre el fomento de las relaciones con Asia, el siglo xix fue de creciente influencia europea (demográfica, militar, política, económica, cultural). El esquema propuesto puede servir para entender mejor los procesos por los cuales en nuestros días América, como el resto del mundo, está entrando nuevamente en la órbita asiática. (shrink)

Constructivist research in Science and Technology Studies is committed to revealing the heterogeneity of technological change and the fluid boundaries between the elements involved. Its major theories, the Social Construction of Technology and Actor Network Theory, have however both been criticized for limiting themselves to the micro-level of cases, impeding a structural analysis of technological systems. This article seeks to bridge any such divides. We research the recent changes in the viticulture of Mendoza, Argentina, which underwent radical changes over the (...) past decades: once governed by low-cost yield maximization, grape production now revolves around “quality.” To show how the particular quality definition developed, we depart from a social-constructivist framework, following the sociotechnical shaping of problem-solution relationships across the wine production system. To include relevant social groups from different settings around the world, we gradually incorporate the ANT concepts of obligatory passage points, enrollment, convergence, delegation, and codes into the analysis. Combined into the concept of “sociotechnical alliance,” our analysis follows the dual process of creating agreement while establishing heterogeneous practices across settings at different levels. It shows that functioning involves alliance building and highlights the hybridity and continuous dynamics of systems at large. (shrink)

Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. El objetivo de nuestra investigación es determinar el impacto de demanda de trabajo y recursos psicológicos en el desempeño profesional. Fue evaluada la calidad laboral según instrumentos validados y establecida su normalidad. Tenemos que los recursos psicológicos y demanda de trabajo impactan en el desempeño profesional con una correlación múltiple de Pearson de 0.91. La correlación de Pearson entre calidad laboral y desempeño profesional fue de 0.69 y p valor de 0.004. La correlación de Spearman entre recursos psicológicos y desempeño (...) profesional fue de 0.735 y p valor de 0.002. (shrink)

En este ensayo intentaremos realizar una pequeña aproximación al pensamiento de Gilbert Simondon, filósofo francés cuya obra podría resumirse en sus dos tesis doctorales defendidas en 1958, una de las cuales no fue publicada de forma completa sino póstumamente. No obstante, lo dicho, tras el creciente interés en su pensamiento comenzaron a publicarse ya nacido este milenio, en particular en Argentina, sus cursos sobre percepción, imaginación, invención, información, comunicación y tecnología. A pesar de su escueta obra, Simondon es un filósofo (...) de sistema, que a partir de su teoría de la individuación intentó fundar un monismo ontogenético en el cual puedan entrar en comunicación todas las disciplinas humanas; y para ello buscó explotar todos los recursos conceptuales que brindaron las revoluciones científicas de su época. En este ensayo, sin embargo, abordaremos tan sólo el tipo de realidad o estatus ontológico que Simondon atribuía a los objetos técnicos. Para ello desarrollaremos 4 apartados y un bis. En el primero, haremos un esbozo de lo que es el método filosófico propuesto por Simondon, el cual describimos como un paradigmatismo analógico. En el segundo, desarrollaremos algunas críticas a cierto paradigmatismo particular que, según Simondon, subyace en gran parte del pensamiento occidental y que nos impide, entre otras cosas, comprender la realidad propia de los OT, a saber: el hilemorfismo. En tercer lugar, analizaremos en qué medida podemos salvar la realidad de los OT de ser reducida a mero constructo social. En cuarto lugar; analizaremos algunas analogías y disparidades entre los OT y los seres vivientes. Por último, a modo de apéndice, expondremos sucintamente un artículo de Esperanza García y Villegas Jaraleño, presentado en el último volumen de Scientia in verba, en el cual se plantea la pregunta sobre el estatus ontológico de los artefactos biotecnológicos desde una perspectiva bungeana; así como pequeñas críticas y aportes que pudiésemos hacerle desde el pensamiento simondoniano. Hoy asistimos a un inédito desafío histórico y cultural: la imparable y acrítica expansión de las Tecnologías de la Información y las Comunicaciones (TIC), en tanto estas amplían nuestras capacidades mentales y comunicativas a límites aún insospechados. Ante la radicalidad de su impacto, el desafío es empezar a vivir las TIC de una forma responsable, creativa y crítica. Hasta ahora, en cambio, las hemos vivido deslumbrados ante sus luces y ciegos ante sus sombras. En el ensayo nos preguntamos tanto “¿qué (...) hace una nueva tecnología?” como “¿qué también deshace?”. Buscamos entonces mediante una aproximación preliminar contribuir al debate acerca de los impactos existenciales, cognitivos, comunicativos y sociales de las TIC. (shrink)

The purpose of this study was to analyze the attitude of a group of cardiologists on the ethical conducts they would accept or adopt when encountered with different hypothetical situations of medical practice. Between August and September of 2011, 700 Argentine cardiologists were surveyed in situations which posed ethical dilemmas in the patient-physician relationship, among colleagues or involving financial agreements with employers or the pharmaceutical industry. Ethical conflicts were evidenced in a series of inappropriate conducts such as differential fees, trips (...) and meals sponsored by laboratories, splitting fees, overbilling, self-referral, charging for patient referral, financial compensation for ordering medical procedures, and various situations derived from the relationship with employers. In general, financial compensation from the pharmaceutical industry was more accepted than the conflictive situations which directly involved patients, colleagues or employers. The rejection of these conducts, the physicians' deontological education and the improvement of financial and organizational conditions in medical practice will help to encourage better medical professionalism and avoid unseemly behaviors. The main aim of this article is to start a discussion of social pattern, a term that is commonly used in sociology but not specified or defined. The key question can be phrased as follows: Is it possible to transform the notion of social pattern from its current status in sociology as a proto-concept into a fully worked out concept? And if so, how can this be done? To provide material for the discussion we begin by introducing a few different (...) types of patterns that are currently being used (patterns in nature, cultural patterns, statistical patterns, and computationally generated patterns). This is followed by a suggestion for what a strictlysociologicalconcept of social pattern may look like. A useful and theoretically solid concept of social pattern can in our view be constructed by basing it on Weber’s concept of social action. This means thatboththe behavior of the actorsandthe meaning these invest their behavior with must be taken into account. The article ends with a brief discussion of how to use the concept of social patterns in an effective way and what may endanger such a use. (shrink)

Resumen En las últimas décadas las economías nacionales han experimentado un proceso de cambio estructural que ha desafiado la concepción de la competitividad que sostiene la economía ortodoxa. En particular, es necesario un enfoque que tome en cuenta la importancia de los procesos de aprendizaje involucrados en el logro de niveles de competitividad de las empresas y que coloque el acento en los procesos de cambio y de innovación, adoptando una visión dinámica. Teniendo en cuenta ello, en el presente artículo (...) se presenta una visión teórica alternativa de la construcción de ventajas competitivas y de la competitividad de las naciones, a través de la moderna economía evolucionista e institucionalista. Así, se presentan los principales rasgos de la teoría evolucionista de la empresa y el enfoque de Sistema Nacional de Innovación, que posibilita un abordaje sistémico del fenómeno de la competitividad y el desempeño económico de las naciones. Este artículo analiza una constelación heterocrónica compuesta por nueve figuras de horizontes y de nubes de polvo de la pampa argentina provenientes de la literatura y de las artes visuales de los siglos XIX, XX y XXI. Según se sostiene a partir de un estudio teórico de diversas fuentes filosóficas, las imágenes son nudos semiótico-materiales, espejos emancipados de la servidumbre humana y voces no antropológicas en tiene lugar una configuración estético-política particular del espacio. Las figuras de horizontes están organizadas en (...) función del ojo humano y ponen el espacio bajo su dominio. En cambio, en las nubes de polvo en las que danzan y se conectan los existentes la configuración humana se encuentra deshecha. (shrink)

El TDAH constituye un trastorno de gran frecuencia en la niñez. Se caracteriza por patrones persistentes de desatención, hiperactividad-impulsividad. La condición de TDAH se ha asociado con el mecanismo cerebral cognitivo de auto regulación conocido como Funciones Ejecutivas. El presente trabajo de carácter cuantitativo, correlacional y transversal se focalizó en describir y comparar el rendimiento de Funciones Ejecutivas según padres y profesores en una muestra de escolares con y sin diagnóstico de TDAH. La metodología considero la administración de pruebas de (...) diagnóstico de TDAH y de evaluación de FE a través del Inventario Comprensivo de Funciones Ejecutivas. Los resultados indicaron diferencias significativas entre la evaluación de padres y profesores, como también entre las pruebas administradas. Los padres tenderían a evaluar el rendimiento de funciones ejecutivas en términos más flexibles que los docentes. (shrink)

The incompatibility within the context of modeling cannot be established simpliciter. The fact that modeling is understood as an activity whose representational power can only be partially established, may minimize the supposed existence of incompatible models. Indeed, it is argued from perspectivism that incompatibility can be dissolved, meaning that it becomes trivial or simply false due to the inherently pragmatic and partial nature of the act of representation and modeling. From this perspective, incompatibility can only be a consequence of a (...) misunderstanding of the very nature of modeling and representation In this sense, in order to tackle this strategy at its root from perspectivism, we will first need to outline the maximal perspectivism thesis, attempting to identify the possible escape routes that perspectivism could find in order to explain incompatibility as an illusory incompatibility. Then, we will analyze Valence Bond Model and Molecular Model of covalent bonds, and we will conclude that the dissuasive strategies used to minimize and/or disregard incompatibility prove to be fruitless. El presente estudio se inscribe en la línea de las investigaciones acerca del pensamiento de Evagrio Póntico, el monje filósofo del siglo IV d.C, que se vienen realizando en los últimos años. En este marco, nos interesa profundizar en la significación que tiene en la obra evagriana un concepto filosófica y teológicamente relevante como es el de sophía y cuál es la relación que la realidad que éste designa tiene con la vida moral. Evagrio establece una relación de connaturalidad entre (...) las virtudes y la sabiduría, de tal modo que el ejercicio ético propio de la primera etapa de desarrollo espiritual es planteado como un requisito para alcanzar la sabiduría. En este contexto se plantea el concepto de apátheia como el estado del alma capaz de alcanzar la sabiduría. No obstante, la ciencia que otorga la sabiduría es siempre en el Póntico un don divino. Por esta razón esta división en etapas no puede ni debe ser planteada de modo taxativo como si las mismas fueran compartimentos estancos. (shrink)

Las críticas de Paul Ricoeur a la jerarquización de las instancias de la temporeidad en Ser y Tiempo nos conducen al análisis de la posibilidad y permanencia de la propiedad para el Dasein cotidiano en el nivel de la historicidad. Esta modalidad permite, en Heidegger, una historia propia, que se distingue de la historiografía tradicional en el uso vital que de ella hace el Dasein. Aquí es crucial la influencia de la Historia crítica de Friedrich Nietzsche. This article asks whether there were, in post-dictatorship Chile, limitations of the autonomy of cultural and artistic production addressing the memory of traumatic events. In particular, the article analyzes the content and history of the production of some relevant sections of the mural painting Memoria Visual de una Nación by the Chilean artist Mario Toral. The article demonstrates that public art was an arena of struggle for the meaning of democracy during the postdictatorship period. To do this, he uses concepts (...) from post-structuralist political theory, cultural studies, the philosophy of memory, and memory studies. The article also offers an interpretation of cultural production as an open and contingent process. It concludes that the transition via transaction in Chile had a negative influence on the field of artistic production, reducing its autonomy and divergence from the dominant political discourse in the period. The most outstanding feature of this book is that here, for the first time, is made available in a single volume all the important historical essays Edgar Zilsel (1891-1944) published during WWII on the emergence of modern science. This edition also contains one previously unpublished essay and an extended version of an essay published earlier. In these essays, Zilsel developed the now famous thesis, named after him, that science came into being when, in the late Middle Ages, the social barriers (...) between the intellectuals and the artisans were eroded, due to the fact that the rapidly expanding commercial classes of that period had a keen interest in improvements in technology. This class was city-based and stimulated a social environment in which men of learning came to regard the craftsmen and technicians with a new respect, in which they no longer felt any contempt for manual work and in which theory and practice were eventually combined to produce modern science. This critical edition also carries a long introduction in which much new material about Zilsel's life and work is presented. It suggests that a radical new look at Zilsel's project needs to be taken. Zilsel's essays on the history of science look like a standard case study to substantiate a particular position on the origins of modern science, but they were also an attempt to show that lawlike explanation in history and social theory is possible. It is claimed that Zilsel's historical essays were a part of another project he was working on which focused on the idea that social phenomena were open to causal explanation as much as physical phenomena. Hence the volume also contains the essays Zilsel wrote in relation to this other project. Previously there have been published a German and an Italian edition of the Zilsel essays. This edition is the first in English; compared to the other two editions this one is the first that includes unpublished material and the first to undertake a serious effort to research Zilsel's life and work. What is special about this volume is the well-articulated social perspective it takes on the origins of modern science.
