This paper examines the role of clinical practitioners and clinical researchers internationally in establishing the utility of harm-reduction approaches to substance use. It thus illustrates the potential for clinicians to play a pivotal role in health promoting structural interventions based on harm-reduction goals and public health models. Popular media images of drug use as uniformly damaging, and abstinence as the only acceptable goal of treatment, threaten to distort clinical care away from a basis in evidence, which shows that some ways (...) of using drugs are far more harmful than others and that punitive approaches and insistence on total abstinence as the only goal of treatment often increases the harms of drug use rather than reducing drug use. Therefore the leadership and scientific authority of clinicians who understand the health impact of harm-reduction strategies is needed. Through a review of harm-reduction interventions in Canada, the United Kingdom, the United States, Australia, Switzerland, and the Netherlands, we identify three ways that clinicians have helped to achieve a paradigm shift from punitive approaches to harm-reduction principles in clinical care and in drug policy: through clinical research to provide data establishing the effectiveness and feasibility of harm-reduction approaches, by developing innovative clinical programmes that employ harm reduction, and thereby changing the standard of care to include routine use of these evidence-based approaches in their practices. We argue that through promotion of harm-reduction goals and methods, clinicians have unique opportunities to improve the health outcomes of vulnerable populations. (shrink)

The second theorem concerns issue . It says that if a certain principle of Bayesian decision theory is correct, and if a certain situation is logically possible, then some forms of 'national egoism' are false. ;There follows an examination of some of the issues raised by the two theorems. Included is a discussion of Nagel's theory of ethical viewpoints and a discussion of the relation between what is "morally preferable" and what one ought to do. ;Two theorems are proved in (...) the final chapter. The first theorem concerns issue . It says that if a certain principle of Bayesian decision theory is correct, and if a certain situation is logically possible, then it is not a true principle that the act of allowing someone else to impose a harm is morally preferable to the act of imposing an equal harm oneself. ;The asymmetry doctrine and its variants tend to favor whichever situation is the existing situation. This tendency is brought out and we see how it can lead us to reject the asymmetry view. ;Turning to issue , an attempt is made to indicate the importance of this question in foreign policy decisions. We then consider an asymmetry doctrine which says that imposing an undeserved harm is worse than allowing even a much greater harm to occur. A popular variant of this doctrine which would permit the imposition of harm on 'innocent threats' in certain cases is also considered. However it is argued that by placing substantial moral weight on the distinction between innocent threats and innocent non-threats this variant would commit us to some very unappealing moral judgements. ;Concerning issue , it is argued that even if moral relativism is true it is not always wrong to constrain people in another society to act in the way required by our human rights standards, despite the fact that their society does not accept those standards. ;Turning to moral relativism itself, it is argued that the most influential versions of relativism are unacceptable. Some relativistic theories lead to difficulties when the person or group whose attitudes determine a moral code is unaware of certain facts. Other relativistic theories lead to difficulties when the violation of a moral principle would affect people's attitudes in such a way that, according to the relativistic theories in question, the moral principle would cease to hold. ;Concerning issue , the conclusion is reached that, given some assumptions about domestic policies, it is unjustifiable for governments like the American government to give more weight to the interests of their own country than to the interests of any foreign country. However, following Sidgwick, a distinction is drawn between that kind of 'national egoism' and a government being 'more extensively involved' in advancing its own country's welfare than any other country's. The latter practice is defended. ;Three issues are discussed in this study: If moral relativism is correct, what limits should be placed on foreign policy in the human rights area? In any case, is moral relativism correct? Should a government, in shaping policy, give more weight to the national interest of its own country than to the national interest of any foreign country? Is it just as bad, morally speaking, for a government to allow undeserved harm to befall citizens of foreign countries as it is to actively inflict undeserved harm upon such persons? (shrink)

Response to Ernest Partridge's paper 'The Future - For Better or Worse' in this issue of Environmental Values.

The concept of mental disease has broadened considerably in the last few years. Many mental states that were not previously considered problematic now fall under the category of disease. The most notable example is anxiety. Anxiety disorders are the most prevalently treated mental disease. The current social and psychiatric authorities emphasize the negativity of the affective state and recommend methods by which the state can be avoided. The problem with these approaches is that they do not recognize the functional role (...) of anxiety in the life of the individual. Anxiety is a stimulus for growth and individuation, but this growth can only occur when the anxiety-provoking situation is altered for the better. The theories of Søren Kierkegaard, Ernest Schachtel, and Kurt Goldstein will be called upon to support the theory that anxiety is inherent in personal growth. It is ultimately argued that eliminating anxiety creates static individuals in a static society and is harmful to both individual and social progress. (shrink)

In this book, Ernest Sosa explains the nature of knowledge through an approach originated by him years ago, known as virtue epistemology. Here he provides the first comprehensive account of his views on epistemic normativity as a form of performance normativity on two levels. On a first level is found the normativity of the apt performance, whose success manifests the performer's competence. On a higher level is found the normativity of the meta-apt performance, which manifests not necessarily first-order skill (...) or competence but rather the reflective good judgment required for proper risk assessment. Sosa develops this bi-level account in multiple ways, by applying it to issues much disputed in recent epistemology: epistemic agency, how knowledge is normatively related to action, the knowledge norm of assertion, and the Meno problem as to how knowledge exceeds merely true belief. A full chapter is devoted to how experience should be understood if it is to figure in the epistemic competence that must be manifest in the truth of any belief apt enough to constitute knowledge. Another takes up the epistemology of testimony from the performance-theoretic perspective. Two other chapters are dedicated to comparisons with ostensibly rival views, such as classical internalist foundationalism, a knowledge-first view, and attributor contextualism. The concept of information tempts us as a theoretical primitive, partly because of the respectability lent to it by highly successful applications of Shannon’s information theory, partly because of its broad range of applicability in various domains, partly because of its neutrality with respect to what basic sorts of things there are. This versatility, however, is the very reason why information cannot be the theoretical primitive we might like it to be. “Information,” as it is variously used, is systematically ambiguous (...) between whether it involves continuous or discrete quantities, causal or noncausal relationships, and intrinsic or relational properties. Many uses can be firmly grounded in existing theory, however. Continuous quantities of information involving probabilities can be related to information theory proper. Information defined relative to systems of rules or conventions can be understood relative to the theory of meaning . A number of causal notions may possibly be located relative to standard notions in physics. Precise specification of these distinct properties involved in the common notion of information can allow us to map the relationships between them. Consequently, while information is not in itself the kind of single thing that can play a significant unifying role, analyzing its ambiguities may facilitate headway toward that goal. (shrink)

In “Tracking, Competence, and Knowledge,” Ernest Sosa notes that in attempting to account for the conditions for knowledge, externalists have proposed that the justification condition be replaced or supplemented by the requirement that a certain modal relation be obtained between a fact and a subject's belief concerning that fact. While assessing attempts to identify such a relation, he focuses on an account labeled “Cartesian‐tracking”, which accounts for the relation in the form of two conditionals. If a person S believes (...) a proposition P → P P → S believes P. Sosa suggests that be abandoned as a requirement, and that, equipped with his modifications, can offer promising results in connection with skepticism. He argues that modified coupled with the requirement that S's belief be “virtuous” can illuminate the nature of propositional knowledge. (shrink)

This paper explores how the widely acknowledged conception of tort law as corrective justice is to be applied to the law of negligence. Corrective justice is an ordering of transactions between two parties which restores them to an antecedent equality. It is thus incompatible with the comprehensive aggregation of utilitarianism, and it stands in easy harmony with Kantian moral notions. This conception of negligence law excludes both maximizing theories, such as Holmes' and Posner's, and Fried's risk pool, which combines Kantianism (...) with distributive rather than corrective justice.Central to the Kantian approach is the impermissibility of self-preference. The two types of self-preference, self-preference in conception and self-preference in action can respectively account for the objective standard and the Learned Hand test, which are the two most characteristic features of negligence and which are generally (and wrongly) considered to be inescapably aggregative. This corrective justice conception of the negligence standard can then be compared to Epstein's corrective justice conception of strict liability, and arguments can be offered in favour of the superiority of the former. For corrective justice, liability is the consequence of the parties' being correlatively situated as the doer and sufferer of an injustice, and the remedy is seen as undoing that injustice to the extent possible. Combining consideration of legal doctrine and private law theory, this article applies the framework of corrective justice to gain-based damages for torts. Within this framework, restitutionary damages ought to be available only insofar as they correspond to a constituent element in the injustice that the defendant has (...) done to the plaintiff. The radical proposal that allows restitutionary damages for any wrongful gain is unsatisfactory because it fails to link the damages that the plaintiff receives to the normative quality of the defendant's wrong. In contrast, dealings in another's property give rise to such damages because the idea of property includes within the owner's entitlement the potential gainsfrom the property's use or alienation. Restitutionary damages should not be seen as serving a deterrent or punitive function; such a function cannot account for why the plaintiff, of all people, is entitled to the defendant's gain. Properly understood, even situations where the plaintiff's wilfulness or calculation increases the damage award fit within the framework of corrective justice. The corrective justice approach thus repudiates the notion that restitutionary damages are occasions for the promotion of social purposes extrinsic to the juridical relationship between the parties. The philosolphy of strict finitism is a research programme containing developmental theory and mathematics as its main branches. The first branch is concerned with the ontogenetic and historicaldevelopment of various concepts of infinity. The frame work is Jean Piaget’s genetic epistemology. Based upon these develop mental studies, the mathematical branch introduces a new concept of infinity into mathematics. Cantor propagated the actual infinite, Brouwer and the constructivists the potential infinite. Still more radical is strict finitism, favoring the natural infinite, i.e. (...) the phenomena of the unsurveyable, unfeasible, unreachable.
