This paper takes the recent French elections as an opportunity to reflect on the nature of the presidential function in parliamentary democracies. The discrepancy between the winning candidate's pre-election declarations and his actual approach to his new function reflects a fundamental divergence in the possible interpretations of political representation. This divergence was made fully explicit and came to a head in the debate that opposed the two great jurists of the Weimar Republic, Hans Kelsen and Carl Schmitt. Reasoning research suggests that people use more stringent criteria when they evaluate others' arguments than when they produce arguments themselves. To demonstrate this “selective laziness,” we used a choice blindness manipulation. In two experiments, participants had to produce a series of arguments in response to reasoning problems, and they were then asked to evaluate other people's arguments about the same problems. Unknown to the participants, in one of the trials, they were presented with their own argument as if it was (...) someone else's. Among those participants who accepted the manipulation and thus thought they were evaluating someone else's argument, more than half rejected the arguments that were in fact their own. Moreover, participants were more likely to reject their own arguments for invalid than for valid answers. This demonstrates that people are more critical of other people's arguments than of their own, without being overly critical: They are better able to tell valid from invalid arguments when the arguments are someone else's rather than their own. Wiredu’s call for democracy by consensus is illustrated by his description of traditional African consensual rationality. This description contains the attribution of immanence to African consensual rationality. This paper objects to this doctrine of immanence. More importantly, the doctrine of immanence has led to the attribution of pure rationality to traditional African consensual practices. With reference to Aristotle’s three components of persuasion, I object to deliberation as purely rational and impervious to extraneous factors. I further argue that it is because (...) deliberation is not always perfectly rational that the process of consensus can suffer three forms of social conformity: conformity to dominant players, to numerical opinion majority, and to group-centrism. These forms of conformity mean that a consensus task order could lead to decisions of more inclusive value, but not necessarily decisions of more epistemic value. The concept of agonistic inquiry is employed to tackle what I see as the dangers of conformity and complacency in the project of inclusivity, and this is to strike a crucial balance between too-consensual and purely adversarial forms of deliberation. According to Wiredu, the Akan profess secular esteem rather than religious worship to supra-natural beings, who they perceive in an empirical sense. He backs this up by re-reading what he sees as the Akan general ontology in a way that denies them of the concepts of the supernatural, the transcendental, the mental, the spiritual, and an ontologically distinct mind. At the end of denying the three criteria of worship as well as all of these other concepts which might otherwise be (...) available to the Akan, one might struggle to find any evidence that the Akan even had a religion. I dispute this secular reading, and I more generally demonstrate that the characterizations of the Akan attitude to divinity as non-worshipping, non-supernatural, non-transcendent, and non-spiritual, are either conceptually flawed, factually incorrect, or both. En particulier, la délibération et les problèmes qui en découlent n’ont pas été classées en plusieurs niveaux afin d’exposer les différents défis qui se posent lorsque (...) l’on tente de parvenir à un accord et les types d’approches délibératives impliquées dans chaque catégorie. Most writing on informed consent in Africa highlights different cultural and social attributes that influence informed consent practices, especially in research settings. This review presents a composite picture of informed consent in Nigeria using empirical studies and legal and regulatory prescriptions, as well as clinical experience. It shows that Nigeria, like most other nations in Africa, is a mixture of sociocultural entities, and, notwithstanding the multitude of factors affecting it, informed consent is evolving along a purely Western model. Empirical studies (...) show that 70–95% of Nigerian patients report giving consent for their surgical treatments. Regulatory prescriptions and adjudicated cases in Nigeria follow the Western model of informed consent. However, adversarial legal proceedings, for a multiplicity of reasons, do not play significant roles in enforcing good medical practice in Nigeria. Gender prejudices are evident, but not a norm. Individual autonomy is recognized even when decisions are made within the family. Consent practices are influenced by the level of education, extended family system, urbanization, religious practices, and health care financing options available. All limitations notwithstanding, consent discussions improved with increasing level of education of the patients, suggesting that improved physician's knowledge and increasing awareness and education of patients can override other influences. Nigerian medical schools should restructure their teaching of medical ethics to improve the knowledge and practices of physicians. More research is needed on the preferences of the Nigerian people regarding informed consent so as to adequately train physicians and positively influence physicians' behaviors. (shrink)

In his plea for consensual democracy in Africa, Kwasi Wiredu recommends unanimity about what is to be done, not what ought to be done, or unanimity on action rather than unanimity of values, beliefs and opinion. I caution the use of this procedural instrument by showing that some issues are so value-laden that a group decision cannot be value-neutral. It may sometimes be more productive to entertain value differences to keep them from going underground and becoming dangerous. However, the ability (...) to locate some common interest or ground seems to be crucial for such value confrontation. (shrink)

The article returns to the interpretation of Being and Time and analyzes the meaning and connotations of Heidegger’s use of the German term Bodenlosigkeit. The key methodological issue concerns the need to study the semantic, historical, and political context of concepts instead of hiding these issues by reducing everything to a battle between dogmatic positions. There have been two parallel views regarding the role of voting in deliberation. The first is that deliberation before the fabrication of balloting was completely devoid of voting. The second is that voting is, not just part of deliberation, but is standard to deliberation. I argue in this article that neither of these views is correct. Implicit voting has always existed across time and space but only as a last resort in the event of a failure of natural unanimity. What (...) is relatively modern is the establishment of what I call explicit voting, namely, balloting, outside deliberation and often without deliberation. I also distinguish between natural and artificial unanimities, and clarify that artificial unanimities are products of implicit voting. I demonstrate these clarifications with some examples of deliberation. I deploy these clarifications to rid a certain debate of confusion regarding the precise role of voting in consensual deliberation. (shrink)

Dialectics, especially Engels’s dialectics of nature, is nowadays mostly held in low esteem, even by Marxist scholars because of its Stalinist dogmatisation over the past century. The aim of this comparative review is to show some stakes and prospects, in Marxism and for Marxism, of the debate: the two reviewed books show how the dialectics of nature could, and why it should be considered in a renewed materialist approach to the natural sciences, and provides the reader with complementary outline from (...) the cognitive sciences to physics, via mathematics. Il présente des éléments chronologiques et sociologiques et analyse un certain nombre d’éléments nécessaires pour comprendre la viabilité de l’occupation, l’organisation, la communication, la gestion des forces de l’ordre. Il met en perspective ces éléments et les résultats de l’opération.

ABSTRACTThis essay tracks Heidegger’s thought from 1919 forwards to the decisive years of his political engagement, on behalf of the Nazi movement. Part 1 tracks how the question concerning Being devolves into the implicitly identitarian question of who “we” are. Part 2 addresses the “existential” of Befindlichkeit which Heidegger in Sein und Zeit positions as prior to understanding, and examines his esoteric mode of writing as the means to cultivate a prerational Stimmung. Part 3 examines Heidegger’s response to his 1929–1930 (...) questions of “What mood must we awaken?... Who are we, then?” in the decisive years of the Gleichchaltung, showing how Heidegger’s thinking elevates to ontological primacy a discriminatory and identitarian decision concerning who “we” are as the German volk. Part 4 examines in this light the Heideggerian “end of philosophy” in what the Black Notebooks talks of in terms of a “metapolitics ‘of’ the historical people”. (shrink)

Vanier présentait à l'Institut Catholique de Paris en 1962 et qu'il publie maintenant dans un texte « revu », « amélioré ». Des ouvrages qui se suivent mais ne se ressemblent pas. II n'est pas question de les (...) confronter; indiquons seulement qu'aux aspects historique et philologique, à l'étude des sources, du milieu et du langage, M. Vanier préfère l'approfondissement des principes qui inspirent la morale du Philosophe, cet approfondissement dût-il conduire à des vérités que le texte même n'explicite pas pourvu que la doctrine les implique dans sa synthèse et sa cohérence. L'ethique à Nicomaque s'ouvre par une introduction qui fait problème. Et peut-être le fait-elle davantage de ce que nous sommes habitués d'entendre que pour correspondre à la distinction entre individu, société domestique et société civile, la philosophie morale doit se diviser en trois sciences distinctes qui, à transposer simplement les dénominations anciennes, sont: la Monastique, l'Economique et la Politique. Cette division des sciences morales aurait pour fondement de droit que si l'homme est animal sociable, toute société à laquelle il appartient (...) ne comporte pas plus qu'une unité d'ordre, c'est-à-dire que toutes les opérations que l'homme pose ne sont pas nécessairement des opérations de ces sociétés mêmes, des opérations de l'homme en tant qu'il est formellement partie de ces sociétés. On est ainsi conduit à présumer qu'il ne saurait y avoir de confusion possible entre ces trois sciences: chacune a son nom propre pour se tailler dans l'agir humain un domaine tout à fait spécifique. Kwasi Wiredu, arguably the most influential African philosopher, has proposed a democracy by consensus as an alternative to the majoritarian democracy African countries inherited from their colonial masters. His proposal has generated a lot of debates, and these debates have spanned several aspects of his proposal. In this paper, I focus on the debate regarding his attribution of immanence to the practice of consensus in traditional African social relations. Bernard Matolino has recently written an article defending Wiredu's employment of the (...) word immanence in describing the traditional African attitude to social relations. In this article, I find Matolino's defense to be unsustainable. (shrink)

On y trouve une description critique du totalitarisme national-socialiste, mais aussi l'apologie de Heidegger érigé, malgré son éloge de la "vérité interne et grandeur" du mouvement nazi, en roi secret de la pensée. L'étude des Origines du totalitarisme montre qu'Arendt développe une vision heideggérienne de la modernité. Dans Condition de l'homme moderne, la conception déshumanisée de l'humanité au travail et le discrédit jeté sur nos sociétés égalitaires procèdent également de Heidegger. En outre, (...) des lettres inédites montrent qu'Arendt a décidé de marcher sur les pas de Heidegger avant leurs retrouvailles de l'année 1950. Il s'agit d'une adhésion intellectuelle, irréductible à la seule passion amoureuse, et qui mérite d'être prise au sérieux. Certes, Arendt ne partage pas l'antisémitisme exterminateur de Heidegger confirmé par ses Cahiers noirs. Que devient cependant la pensée, instrumentalisée dans l'opposition - nouveau mythe moderne - entre Heidegger, le "penseur" retiré sur les hauteurs neigeuses de sa hutte de Todtnauberg, et Eichmann, l'exécutant sans pensée, le "clown" muré dans sa cage de verre? The moral debate about open borders needs to go beyond focusing on the interests of the migrant versus the interests of the hosting state and its original citizens to focusing more on the interests of the countries that migrants are leaving. I hint at the long-term insufficiency of so-called economic remittances to the development of migrant-sending states when compared to domiciled skilled labor. But most importantly, I identify the irrelevance of current empirical research on brain drain to an open borders (...) scenario. I hint at the potential scale of brain drain in such a scenario, and I raise a moral question about the propriety of proposing open borders with a focus on the wellbeing of the individual migrant if such a focus is determined to be at the expense of the wellbeing of the migrant’s home country. I add that a preamble to opening borders would be to significantly address gross global economic disparities, world poverty, and political injustices. (shrink)

Being and Nothingness argues that in the master–slave dialectic Hegel had a ‘brilliant insight’ contra solipsism, to the effect that each self-consciousness depends on other consciousnesses. Against Hegel, however, Sartre claims that the separation of the for-itself remains an insurmountable ‘scandal’ and that collectivity can at best exist as a ‘de-totalised totality’, never as Subject. In a confrontation with Hegelian Sittlichkeit, Notebooks for an Ethics extends this analysis to the historical modalities of the mutual recognition of freedoms. A ‘concrete ethics’ (...) must be ‘revolutionary socialist’, centrally concerned with ‘the dialectic of the ends and means of revolution’. Finally, Sartre’s analysis of the dialectic of society and the state in the Critique of Dialectical Reason explains why sovereignty can never be the embodiment of an imaginary Subject. Sartre thus ultimately occupies a highly distinctive middle ground between Hegel’s Philosophy of Right and Marx’s critique of Hegel. A fulcrum of the argument, focused on Notebooks for an Ethics, consists in a comparison between Sartre and Trotsky’s Their Morals and Ours. (shrink)
