The contributors to this issue focus on legal internationalism, including hybrid mixes with nationalist forms. They have provoked us as editors to think more about these sites and forms of engagement. Sankey shows how civic participation in the ECCC has played a key role in surfacing the gendered harms of separation and starvation. Turan highlights the problems with ICC exclusion of the experience of men and boys from sexual violence. Peroni expresses her hesitations over the Istanbul Convention given an association (...) between assumed vulnerability and migrant women, while admiring its uncoupling of violence and culture. Cruz’s interview with Wendy Brown contextualizes and expands on these themes as they consider, with other participants, the future of feminist theory in the context of neo-liberal capturing of rights and legal space. Thinking more about internationalism and commitment in this context also helps us hold a mirror up to ourselves as we reflect more critically on our own naming of FLS as an ‘international’ journal. Together these contributions, and the reviews of new work, play a role in fleshing out an editorial commitment to enacting the journal as a living thing that ‘hangs together somehow’ even as it is known differently in different places. Cosmopolis A Review of Cosmopolitics -/- 2015/3-4 -/- Editorial Dominique de Courcelles & Paul Ghils -/- This issue addresses the general concept of “spirituality” as it appears in various cultural contexts and timeframes, through contrasting ideological views. Without necessarily going back to artistic and religious remains of primitive men, which unquestionably show pursuits beyond the biophysical dimension and illustrate practices seeking to unveil the hidden significance of life and death, the following papers deal with a number of interpretations covering (...) a wide field extending from belief to theory, from emotions to concepts, from the wisdom of personal experience to the most sophisticated doctrines. Spirit and spirituality are indeed many-faceted notions. They may refer to the intricate world of the interacting spirits which inhabit living beings in animistic traditions, without excluding a “grand force” linking human beings within a dynamic whole on which their very existence rely . They also bear upon more atomistic and either/or approaches of Western philosophy, which have become embodied in Cartesian dualism against a monotheist background, to the point of freezing the essence of individuals and culminating in the extreme individualism that characterizes our contemporaries. However, this equally refers to the opposite conception of materialism, across times and cultures, from ancient India and Greece (Cārvāka, originally known as Lokāyata, or some Buddhist doctrines for the former, Democritus or Lucretius for the latter) to more contemporary materialistic schools, whether modern or postmodern. -/- The following papers look at the contrasting forms of the philosophy and spirit of the human factor set into a whole, with no artificial disjoint between the psychical and the physical levels, as Wittgenstein put it: “And how can a body have a soul?”. This approach is not unrelated to the notion of anthropocene examined in a recent issue of Cosmopolis, with provides another comprehensive framework open to a spiritual life emerging from the very environment that generated it. -/- *** The first section of this issue was edited by Dominique de Courcelles, director at the National French Research Centre (CNRS), whom we wish to thank for collecting relevant studies relating to the religious and political questions, with a view to focusing on the war of ideas inevitably waged behind images, concepts and perceptions, taking an asymmetrical approach. To the extent that they are mindful of global/local interactions and include representations, opinions and beliefs, such disciplines as philosophy, philology, history and social sciences can provide useful studies accounting for new practices in geopolitics and a fair diplomacy. -/- In her introduction, Dominique de Courcelles first poses the question of how the religious and political spheres interrelate, with their corresponding religious demands and humanistic values. She then suggests that the right question today may be breaking with the philosophy of human rights concerned with the defense of human beings against the hazards of arbitrary politics or the instrumental use of religion, in favour of a fair philosophy of humankind, a new humanism. This would consist in recognizing a common loyalty of all towards one interhuman, not only interstate community, to protect it from both the autonomy demanded by individuals and the instrumental use of minorities. -/- Considering the fact of diversity, so important today in terms of both politics and religion, Abdelhai Azarkan looks at the conditions under which tolerance could obtain the double status of right and duty. He revisits to two philosophers, John Locke and Voltaire, who thought about it from the historical reality of religious wars. The former made tolerance into a right, basing his analysis on the political-legal level, while the latter saw tolerance as a duty, from an analysis based on ethical-political criteria. -/- Mathieu Guidère examines what he calls semantic denominationalism, a term which implies religious attributes and identities, whichever national loyalties or personal belonging they may have at the same time. Since the early 2000s, thie phenomenon has expanded tremendously, compounded by the “war on terror” and the over media-oriented terrorist actions. Denominational expressions act as formal names for ordinary and high-profile players in domestic and foreign policies of democratic states. These systems reveal a receding secularization, while the powerful comeback of religious identities signals the failure of nation-states and the weakening of the humanist spirit. -/- Barbara De Poli retraces the history of a contemporary jihadism claiming its Islamic essence and asserting the truth of genuine coranic principles via the war on infidels, with a view to restoring the Caliphate. After defining the term jihad, she shows that even if this contemporary jiadism is spreading in the Muslim world, it radically departs from Islamic law and the received use of the term jihad, in so far as it is rooted in the early radical thinking of Islamic ideologues in the 20th century, starting with with Hassan al-Banna, the founder of the Muslim Brotherhood. This current has been fueled by by international conflicts since the outbreak of the war in Afghanistan, in which the so-called Western countries bear a major responsibility. -/- Abderrazak Sayadi starts from the Tunisian experience to ask the question of humanist values and democracy within the relationships between the religious and political spheres. As a historian of religion, he is brought to demystify certain islamic principles and to paying attention to the reform of law, seeing the separation of religion and politics as a precondition to a successful democratic gamble and the establishment of a renewed humanism. -/- Dominique de Courcelles reminds us that getting a better knowledge of narrations and words makes it possible to better understand how logical and rhetorical thinking works for those who wage an asymetriccal war, re-enchanting and mystifying the world to better take control. As soon as 1932, an exchange of letters between Einstein and Freud made it clear that, in order to free man from fatality and war, education understood as culture was fundamental. Such illustrations as the exécution of Oussama ben Laden and the Caliph’s speech in Mossoul show that a premiminary analysis of images and words is essential to a fair diplomacy conducted by people from civil society, whose culture and wisdom allow justice and force to speak together and better resist war. -/- Marcel Boisard thinks that on the day the guns fall silent, exhausted by war, we will not return to the state borders that have prevailed for a century as an outcome of the Sykes-Picot agreement of 1916. It is time to prepare the “day after”, which will be a huge challenge. To this end, a summit of Middle-East nations is urgently needed to globally decide the fate of those peoples. On the condition that we know who the enemy is and accept to name it, to understand the history of the countries, groups and alliances, and to question any false or self-interested sense of certainty. -/- *** In the second section, Paul Schafer provides the author’s experiences to explain how culture, from the artistic to the biological, has the power to to open the doors to spirituality, from the inner self to the global environment. He asks himself whether a relative permanence of spirituality can arise from the specific moments that characterize it. Laurent Ledoux synthesizes the conclusion of a symposium held on 22 January 2015 on the links between philosophy and management, on the basis of the spiritual dimension conceived as “natural” and the answers it may suggest to the issues that face the organizations in a “contemporaniversal” world. Jacques Rifflet makes that question in a secular perspective, based on the wellsprings of personal commitment before it can be caught by any religious creed or scientific theory. In this sense spirituality, in alliance with reason, both inspires human consciousness and illuminates its destiny. Sami Aldeeb asks himself whether Islam can be reconciled with human rights. Caught between the belief in an absolute and final Word descended from the sky, and evidence showing that any religion is the creation of a given culture and a society situated in time and space, the Makkan and … contexts et médinois call for differentiated, if not opposite answers and exegeses. Bernard Carmona provides the outline of a dialogical framework, which is known to be a feature of debates between the various philosophical schools of classical India, exemplified here by the transdisciplinary perspective of debates within a Buddhist context. *** The articles not focused on the previous topic include a study by Landry Signé on China’s strategy, competing with the United States to control African resources. The author deals with the specific case of China’s rapprochement with Southern Sudan since Sudan was broken up. In the last paper, Goran Fejić and Rada Iveković, return to the essential role that women should play, and comments upon the role of some international legal instruments related in particular to the elimination of all forms of discrimination. The perspective is transnational and transethnic and is based on secular criteria, as regards nation-building and more generally society-building. Considering the persistence of widespread violence, whether in times of armed conflict or in times of peace, the question remains whether it is possible to fully implement rights and justice instruments. In light of the recent crisis and its aftershocks, it becomes crucial to reflect on the relationship between finance and accounting and on how to integrate ethics and efficiency, as well as on how to motivate and empower practitioners in the world of finance to commit to justice, fairness and enhanced understanding, and to improving their personal integrity. This article, written as an editorial introduction to a special issue includes works related to control measurement and ethical behavior, misbehaviors in (...) finances and accounting, professionalism in accounting, ethical investing and corporate reporting. We conclude by suggesting further research for a better integration of technical aspects of accounting and finances into business activity—human activity actually—and an for understanding of ethics not limited to rules, but as a mutual and interdependent system of values, virtues and principles. The Guest Editorial On Wolverines and Epistemological Totalitarianism by Etzel Cardeña (JSE 24(3), Fall 2011) is little more than a rant, in which invective, ridicule, and mockery take the place of reasoned argumentation. Mind you, there’s nothing wrong with a good rant, especially when one agrees with the overall perspective, and I actually found myself in agreement with much of what the author had to say. Most of Cardeña’s anger is directed at those Materialist philosophers and psychologists who happily (...) pontificate against the possibility of psi while remaining studiously ignorant of the data that parapsychological research has uncovered. I think everyone who comes to parapsychology with an open mind at some point experiences the same frustration that Cardeña expresses toward Materialist idealogues, whose conclusions and opinions have been formed a priori and appear to be impervious to empirical data. But he seems equally upset with those who are “pro-psi,” lamenting "the epistemological absolutism that pervades both the strident anti-psi and pro-psi proponents from what I consider a healthy abeyance from fully committing to a closed position in science or in other aspects of life." The purpose of this paper is to defend and justify the hypothesis that Perelman’s New Rhetoric can enable the French school of Discourse Analysis to readjust its theoretical positions concerning the ethics of discourse. While it is no longer necessary, in the wake of linguists such as Benveniste and Kerbrat-Orecchioni, to point out the founding role of the inscription of subjectivity in language, it is, paradoxically, still necessary to justify the legitimacy of choosing the axiological dimension of discourse and its (...) ethical issues as a scientific object. Indeed, very few linguists view Perelman’s New Rhetoric as a logic and a “pragmatics” of values; most of them prefer to view it as a technical reservoir of types of arguments (Cf. concerning the critical enumeration and classification of references to the NR, raised in approximately forty linguistic works, Koren 2002: 197–228). So far, the notions of “guarantee” and “commitment” are integrated in pragmatic linguistic theories; but these notions have mostly to do with a “commitment” vis-à-vis a referential truth. Truth is still considered as the ultimate value, as the normative reference to every questioning on discursive rectitude. We are thus left with an epistemological lacuna, namely the integration of the responsibility for value judgments in linguistic theories, that could be partially answered for by the New Rhetoric. After thirty years of editing Philosophy of Music Education Review, it is a good time to take stock of the philosophical work that has been and is being published and of challenges that remain.Over (...) the years, there has been a growing quality of philosophical articles published in the journal, due in significant part to the efforts of reviewers and the willingness of writers to work with their suggestions. Authors regularly express appreciation for the informed, critical, and constructive reviews their work receives. An exemplary body of philosophical scholarship in music education has been published over this time and PMER is regarded as a premier journal internationally devoted exclusively to the philosophy of music education. In thirty volumes of uninterrupted publication, we have sought to be responsive to important issues in music education. Our writers have engaged relevant subjects of interest to our readers, citations of articles remain strong, and articles are included in [End Page 109] university and college course reading lists. PMER is available in print and online via subscription; it has a wide digital exposure in search engines and leading indexes, and our readership continues to grow.Despite this progress, although the number of submissions has increased, their quality has sometimes been uneven. Our pedagogical commitment to foster philosophical writing and the philosophical inexperience of some writers has significantly impacted the work required to bring submissions to publication standard. Submissions sometimes evidence a lack of attention to formulating a tight argument, citing relevant sources, and polishing and editing the manuscript. The published style guidelines are too often ignored, creating a poor first impression with reviewers and editors. Writers are occasionally in a hurry to publish and less willing to entertain multiple revisions of their articles required to produce work of lasting value. The growing number of music education journals that publish philosophical work, while opening more fora, in some cases perversely result in ideologically driven, polemical, and philosophically uninformed articles in the name of philosophy. This is a good moment to reconsider the importance of philosophical fundamentals that should undergird our philosophizing in music education and what these mean for our academic responsibilities. To this end, we suggest several principles that need to be central to our philosophizing in music education. These principles also have broader implications for the expectations of scholarship in music education generally.WRITING PHILOSOPHYLike other subject areas in the academy, philosophy has its own intellectual structure, a canon of significant writings, its own interpretative methods, and its distinctive role and purpose. A philosophical paper in music education reads differently from papers in the history of music education, methods of teaching music, sociology of music education, empirical research in music education, multi-cultural, gender, and ethnic studies, music education curriculum building and policy making, and so on. And yet, the boundaries between these disciplines, which are artificial constructions when human knowledge is considered wholistically anyway, are somewhat porous with concepts and ideas and claims seeming to move easily from one discipline to another.To help distinguish between philosophy and other areas of study and research, it may be helpful to consider philosophy as a second-order activity. That is, first-order activity examines the raw data of research and experience and attempts to make sense of them. Using inference, pattern-seeking, deduction, hypotheses, statistical analysis, and so on, these activities result in claims, interpretations, and theories that give meaning to what we see, hear, and feel. [End Page 110]The second-order activity takes a step away from these first-order activities. It does not concern itself so much with raw data or with creating theories about them, but critically analyzes the claims and inferences that are made in regard to them. Where first-order disciplines analyze inputs from observation and experimentation, second-order disciplines analyze these analyses—that is, they function as meta-analyses. Starting from 2011 the Kierkegaard Studies Monograph Series will intensify the peer-review process with a new editorial and advisory board. KSMS is published on behalf of the S ren Kierkegaard Research Centre at the University of Copenhagen. KSMS publishes outstanding monographs in all fields of Kierkegaard research. This includes Ph.D. dissertations, Habilitation theses, conference proceedings and single (...) author works by senior scholars. The goal of KSMS is to advance Kierkegaard studies by encouraging top-level scholarship in the field. The editorial and advisory boards are deeply committed to creating a genuinely international forum for publication which integrates the many different traditions of Kierkegaard studies and brings them into a constructive and fruitful dialogue. Hardly; it’s the business of the sociology of any human activity to identify and question the intellectual claims and practical ambitions of that enterprise. And that is exactly what Alan Sokal did: he invented a clever test of the intellectual rigor of cultural studies in general and its version of poststructuralist sociology of science in particular. He then subjected Social Text—and implicitly in many minds the intellectual standards of the field it represents—to the test. The issue looks into different issues (...) and provides us with indepth information, queries, fears and reservations.In the article on Knowledge, attitude and practice of medical ethics among medical intern students in a Medical College in Kathmandu, Ramesh P Aacharyaand Yagya L Shakya, report on a Knowledge Attitude and Practice survey of 46 medical undergraduate interns of Maharajgunj Medical Campus. The result of the survey is quite interesting. ‘Doctors know the best irrespective of patients’ opinion was agreed upon by 35 %, ‘Confidentiality cannot be kept in modern era and should be abandoned’ was strongly disagreed by 34.8% and disagreed by 60.9%. The Authors hope that the findings will assist the faculties to strengthen the teaching of medical ethics and guiding the interns for ethical professional conduct. In the article titled Organizational Justice and Employee’s Service Behavior in the Healthcare Organizations in Bangladesh is an agenda for Research, Md. Nuruzzaman and Md. Humayun Kabir Talukder present a conceptual framework and a set of hypotheses regarding the relationships among distributive justice, procedural justice, interactional justice, employee’s citizenship behaviour, role prescribed behaviour and counterproductive behavior in the healthcare organizations in Bangladesh. The authors state that the purpose is to assist the policy makers and service providers in identifying desirable and undesirable HRM practices in order to maintain optimum level of employee commitment for ensuring quality and efficient service delivery to the communities. Though the article is theoretical it may be useful for the policy makers and service providers. If an operational research could be carried out to test the hypothesis the practical utility of the concept could be tested in Bangladesh.Zoheb Rafique in the article Ethical Justification of Conducting Research Trials in Lower and Middle Income Countries Including Pakistan: The Responsibilities of Research Enterprises explores the ethical aspects of research sponsored by commercial agencies. He looks into the factors that influence selection of a study site for a sponsored trial particularly in traditional countries like Pakistan where cultural values add to the problem in assuring that research is conducted in an ethical manner. In this paper, the Author discusses the responsibilities of researchers and funders in low and middle income countries like Pakistan and the ethical justifications of doing research trials in developing countries. He concludes that research participants should be fully informed about the research trial and their participation and it is their right to know all risks and benefits so that they have the option of rejecting participation.The article on Ethical aspects of Dhaka University Tele-medicine System by Ahmed Raihan Abir provides and analysis of the tele- medicine system in Dhaka University. The Author is a member of an extended group at Dhaka University (DU) which has been developing telemedicine equipment and data acquisition software to promote telemedicine practice in Bangladesh. Recently the Telemedicine group of DU and a local NGO named SAMAMA with support from Service innovation fund (SIF) of the Prime Minister Office (PMO) of Bangladesh took the initiative to establish eight rural telemedicine centers and one expert center for the field trial of telemedicine in Bangladesh. The aim of this paper is to examine the ethical challenges of such health care system and the effort to overcome these problems before starting the field trial. The author looks into the details of Data confidentiality and security, Responsibilities of Doctor and Rural Technician, Quality of service and Implications of telemedicine in Bangladesh. He concludes that DU telemedicine project will essentially bring the services of qualified medical experts to the doorsteps of the common people throughout the country, even in the remote rural areas. Although a telemedicine cannot match a face to face consultation, DU tele-medicine system is much better than no consultation at all.Sifat Rahman in the article on Ethical Issues of Fair Subject Selection in Research provides an overview of the criterion for maintaining ethical standards for conducting research. The Author reviews the three fundamental conditions to be met for adhering to strict ethical standards which are: Respect for Persons by protecting the autonomy of people, treating them with courtesy and respect and obtaining informed consent.; Beneficence which incorporates the philosophy of "Do no harm" while maximizing benefits for the research project and minimizing risks to the research subjects; and Justice by ensuring that reasonable, non-exploitative, and well-considered procedures are administered fairly. The holiday season is at our threshold, and we wish everyone to be in the best of health and happiness.This issue of the BJB is very interesting with topics stretching from Non Communicable Diseases to the ethical issues related to the habitation of the planet Mars, and proves how forward looking are our readers and authors.Mohammad Rashedul Islam et al (...) discuss the application of the SARA method in a district in Bangladesh. The method is based on the principle of Service Availability and Readiness Assessment of WHO. The study in a district in Bangladesh found that about 62% of all the facilities were ready to provide general services like basic amenities with basic equipment, standard precautions for infection prevention, diagnostic capacity and essential medicines. However in case of Non-Communicable Diseases (NCD), only 40% of the health facilities had chronic respiratory disease and cardiovascular diseases diagnosis/management and only 32% had availability of diabetes diagnosis/management. Therefore, service availability and readiness of the health facilities to provide NCD related health services were not satisfactory. The authors emphasize that SARA which is a tool to monitor facilities to be ready for provision of services including NCD, should be used by all clinic managers.The very scientific and forward looking article titled “SCNT Method and the Application for Patent Eligibility on Cloned Animals” by Norman K. Swazo reviews US federal court decisions regarding applications for patent in the case of live-born animal clones. A decision issued from the United States Court of Appeals for the Federal Circuit established an earlier decision of the Patent Trial and Appeal Board that live-born animals cloned by the somatic cell nuclear transfer method (SCNT) like cattle, sheep, pigs, and goats are not patentable, so a scientist using the method is not eligible for a patent claim on the animals. The author feels that this decision has ethical implications related to the moral status of cloned animals. The author argues whether the end product of a SCNT (somatic cell nuclear transfer) application is same as an invention or only a revelation of nature at the cellular level. The author quotes Article 11 of Universal Declaration on the Human Genome and Human Rights UNDHGR “Practices which are contrary to human dignity, such as reproductive cloning of human beings, shall not be permitted.” He concludes that the judicial assessments in the USA deciding on the question of patenting of animal clones provide important barriers to human reproductive cloning research, safeguarding moral and legal commitment to human dignity. The article on Ethics in Public Health Research and Clinical Research by Muhammad Waseem Khanet al discusses on the need to continue to focus on ethical values in conducting any research. Tha authors stress the importance, either in public health research or clinical research, of the need to recognize an ethical standard that respects individual’s autonomy and community’s wellbeing. This can be achieved through collective collaboration for the protection of individual’s autonomy, dignity and wellbeing. Research ethics is a fundamental criterion to be complied with throughout a research study. The very interesting article on Planetary Protection for Mars: Time for Reconsideration by Svetoslav Alexandrov looks into the ethical questions beyond mother earth but which could be affected by people from our planet. In this manuscript the author discusses the ethics of the protection of hypothetical organisms on Mars in terms of planned manned space missions and subsequent colonization. The author discusses the possible problems related to a process called terraformation where the planet is converted to make it suitable for Earth life. He argues that terraformation will change the whole condition of the planet. The author quotes Carl Sagan, of The Planetary Society: “If there is life, then I believe we should do nothing to disturb that life. Mars then, belongs to the Martians, even if they are microbes”. I think we all agree with this brilliant recommendation.The article ‘We Still Need to Improve Our Research Writing Ethics’ by Sheikh Arslan Sehgal looks into the value of maintaining professional integrity of research work. Particularly with issues like plagiarism, ethics, authorship and data fabrication. He argues that the scientific community must obey the scientific ethical norms and rules. He feels that ethical problems must be resolved for the advancement of research in countries including Pakistan. The author recommends teaching students the international, institutional and professional standards regarding research and authorship issue. Thus from the beginning researchers will know the key components of ethics in conducting research and the end product will be research work of quality and acceptability.Dear Readers, we look forward to your articles, commentaries, observations on different issues which touch our lives and will help in broadening our knowledge and understanding of Bioethics. Springer. We find in contemporary culture starkly contrasting estimates of the value of faith. On the one hand, for many people, faith is a virtue or positive human value, something associated with understanding, hope, and love, something to be inculcated, maintained, and cherished. On the other hand, for many people, faith is a vice, something associated with dogmatism, arrogance, and close-mindedness, something to be avoided at all costs. The papers included in this special (double) issue on approaches to faith explore (...) questions about faith in a variety of settings through a diverse range of examples, both secular and religious. The attempt to deepen our understanding of faith in the context of ordinary human relationships (e.g., between parents and children, friends, generals and their armies, business partners, citizens and the state), a commitment to ideals, or the pursuit of significant goals is clearly of general philosophical interest, as is the examination of potential connections between faith and topics such as trust or reliance. Prometheus has grown four years older since its last and highly controversial special issue, published in 2017 on the Shaken Baby Debate. But, as always, Prometheus is committed to open discussion and dissemination of scientific research, regardless of the potential backlash or controversy that may ensue from such a venture, a venture that is at the core of authentic scholarship. Since the beginning of 2020, the world has changed irrevocably, making once-held norms seem obsolete in favour of new ways of (...) being in the world and new technologies emerging to face these new ways of living. Although it has been a long-held insight in the philosophy of technology that technical systems are carriers of values, the SARS-CoV-2 pandemic has made manifest how these values, and their incarnations in sociotechnical systems, can likewise change. Prometheus has, since its inception, danced in tandem with the critical interpretations, theories, and methods for understanding innovation, and how innovations fundamentally impact and are impacted by the world in which they emerge and are situated. For this reason, Steffen Steinert, Tristan de Wildt, and I chose to guest edit this special issue on designing for value change and chose Prometheus as its home. (shrink)

In June 2023, a group of ‘Aristotelians without Borders’ met in the splendid Villa San Remigio in Verbania, one of the beautiful premises of the University of Eastern Piedmont. Following in the footsteps of Aristotelians over the centuries, the participants were committed to the belief that engaging in dialogue has a value in itself. Our Aristotelian predecessors have collectively bequeathed to us a common language, a shared form of rationality and a grammar of thought which allow us to engage in (...) dialogue despite our differences. A well-known difficulty of the interdisciplinary dialogue beyond the limits of particular disciplines is the lack of common ground regarding their metaphysical and methodological assumptions and commitments. This is particularly evident for the precarious relationship between science and religion. In a 2016 conference entitled “The Many Faces of Panentheism” held in Zurich, and now in this introduction as well as this section, we try to counteract this situation by choosing a focus theme located at the interface between nature and the (...) divine. Thus, key perspectives, arguments, and implications of panentheism are introduced not only from one selected point of view but in relation to others. This allows us to explore territory beyond the boundaries of disciplinary backgrounds and to address intellectual and practical consequences for current debates. (shrink)

This editorial explains the themes of the forthcoming FLaK seminar and how those themes draw on the collective and individual contributions of the articles, interviews and commentaries presented in this issue. At FLaK, we propose to think with others about the kind of ‘kitchen table’ that FLS might provide into the future. How might feminist legal studies—the approach and the journal—best use its food, equipment, techniques, time, space, mood, energy and commitment? How shall FLS scholars and associates make (...) the most of what we have in a room that can sometimes be confining and confusing, yet also exciting and sustaining? How do others engage with the processes and products of our kitchen table? In considering these issues and more, we propose to draw reflexively on feminist legacies of praxis, internationalism and openness, as we stock up and critically reflect on decolonizing techniques, legal know-how, protest and publishing practices. Fulford (bio)I am grateful to John Sadler and his colleagues for their generous invitation to contribute to this collection marking Philosophy, Psychiatry, & Psychology (PPP)'s thirtieth birthday. True to our editorial tradition of "no nonsense" publishing, the "ask" was a reflection on PPP's past, present and future, limited to 500 words. In fact, one word does (...) it for me—collegiality.Collegiality was our watch word from the start. I still treasure a group photo taken at an early pre-meeting of the Association for the Advancement of Philosophy and Psychiatry (AAPP) convened by Michael Schwartz at his home in 1992, when, among other initiatives, PPP was conceived through transferring our then-nascent journal proposal from a small British publishing house to its current international publisher, the Johns Hopkins University Press. Michael and I had met earlier by phone when he had called the Royal College of Psychiatrists in London to enquire about its recently launched Philosophy Group and (by mere chance) I happened to be standing next to the person who took the call! PPP, with John and myself its founder editors, was subsequently born as, and has remained, a joint venture between our two groups: and Peter Zachar's recent initiative in building closer links with the International Network for Philosophy and Psychiatry (INPP) has taken us an important step towards the vision shared by Michael, John and myself that PPP should grow to reflect and represent a global open society of philosophy and mental health.As a pointer to the future, this global open society was no mere utopian vision but a joint commitment to what we conceived as a necessary ambition. Contemporary disenchantment with the repeated failures of translation of current narrowly empirical models of psychiatry, points to the truth of our German colleague, Paul Hoff's, characterization of the history of psychiatry as a history of serial collapses into single message mythologies. This disenchantment might seem to offer an opportunity for colonial expansion of philosophy into psychiatry (a re-assertion, perhaps, of phenomenology?). But PPP was born out of the "decade of the brain" and has remained throughout an ally of, not competitor to, the neurosciences. [End Page 3] So, while it is true that, with Peter's initiative, and with editorial and other innovations introduced by John, PPP is actively extending its reach (to new areas of philosophy, and to new voices, informed notably by experience as well as by training), this expansion remains a collegial not colonial enlargement of the field. I need hardly point to the challenges presented by the inclusive ambitions of such enlargement (not least to maintaining the highest standards of editorial and peer review). But PPP's collegiality provides the foundation for the work needed to deliver on these challenges. Launched in 1920 by C K Ogden and others as the successor to the Cambridge Magazine , Psyche occupied a unique place for over 30 years as a journal of general and linguistic psychology. Committed from the outset to keeping readers abreast of developments in the burgeoning fields of experimental, theoretical, and applied psychology, Psyche provided not only systematic reporting in these domains but set itself the task of stimulating research of high quality by the critical thrust of its (...) class='Hi'>editorial stance. In addition to full-length articles, Psyche featured lively correspondence and discussion, a regular chronicle of research in the US and on the continent, a comprehensive survey of current literature, and regular reports from the meetings and congresses of associations and societies. Emotion regulation, and in particular cognitive reappraisal. Gross has been booming in theory development and empirical research for the last two decades. A large number of publications have demonstrated the importance of these mechanisms for understanding and promoting well-being and mental health. It is thus timely for Cognition and Emotion to examine the current state of theory in this domain. The resultant invited article, authored by Uusberg, A., Ford, Uusberg, H., and Gross, aims to expand the scope of reappraisal theory (...) by extending their recent reAppraisal model by suggesting different forms of goal commitment and situation construals. Their suggestions are commented on by Kashdan and Goodman from a purpose in life perspective, Ehring, and Woud from a clinical psychopathology perspective. In this editorial, I briefly discuss the lack of specification of the goal construct, which is central to the reappraisal model. Moreover, I point to recent evidence showing that problems may arise because of appraisal biases, in the case of individuals prone to inappropriate evaluations of situations. I suggest that future work in this domain could benefit from increased interaction between theorists and researchers working on appraisal and reappraisal processes. (shrink)

Arising out of one of the annual conferences I organise as Director of the University’s Centre for Applied Philosophy, Politics and Ethics (see http://arts.brighton.ac.uk/research/cappe/) -- ‘Interrogating Terror’ – and from my work on the editorial board of Critical Studies on Terrorism, this collection is published in the Routledge Critical Terrorism Studies series and brings together theoretical and empirical material to challenge the notion that ‘terrorism’ and/or ‘terror’ are transparent, given or limited to non-state agents. Instead, it seeks to expose (...) the political and discursive practices which underlie the use of these terms and which, in doing so, seek to shape our very conceptualisation of what is real. The book has two distinctive features. First, it is interdisciplinary, including contributions from philosophy, law, social policy, media studies, sociology and history. To that extent, the book may also be read as a concrete instantiation of the interdisciplinarity to which my colleagues and I are committed in our undergraduate teaching and our research practices. Second, its format is deliberately designed to foster critical and interdisciplinary engagement, by presenting readers with a series of examples of it. Each chapter is the subject of a commentary from one of the editors, to which each author in turn offers a brief reply. The book thus instantiates, in terms of both authorship and readership, a commitment to collaborative modes of inquiry, in the belief that attending to complex issues – and perhaps especially those bringing theoretical and practical issues together (see also 2009) -- is likely to require a collaborative approach. Dedicated to ‘What’s left of the Left’, the book at once marks a trajectory characterised by an increasing concern to combine academic scholarship and research with activist contributions and to understand how the language of ‘terror’ is coming to shape our political lives. This article explores the impact of the VASKhNIL conference upon the cultural policy of the Italian Communist Party and Italian communist biology, with particular attention to the period between 1948 and 1951. News of the Moscow session did not appear in the Italian news media until October, 1948, and for the next three years party biologists struggled over whether to translate the official transcript of the proceedings, The Situation in Biological Science, into Italian. This struggle reveals the complex efforts of (...) the PCI to confirm the ideological and political connection with the Soviet Union, without completely alienating significant milieus of the democratic and antifascist culture in Italy. The apparent impossibility of doing both is indicated by the fact that the project was finally abandoned in March–April, 1951. The article is divided into three sections, each focused on different actors and their response to Lysenkoism. The first section outlines the features of the PCI’s pro-Lysenko campaign, with particular regard to the intellectual militancy and organizational commitment of Emilio Sereni, head of PCI’s Cultural Commission between 1948 and 1951. The second section analyzes the reaction of the three most important figures in Italian communist biology during this period, Massimiliano Aloisi, Franco Graziosi and Emanuele Padoa. The third section interprets the decision not to publish a translation of The Situation in Biological Science as a consequence of the conflicts between PCI cultural program and the editorial policy of the left-wing publishing house Giulio Einaudi Editore. The journal Biosemiotics was envisioned by its founding editor, Marcello Barbieri, as a major periodical for interdisciplinary papers that integrate biology and semiotics. Since 2008 the journal has published 21 issues, including special issues on crucial problems such as the semiotics of perception, origins of mind, code biology, biohermeneutics, biosemiotic analysis of information and chance. The impact factor of the journal does not fully describe the significance of this journal, because the discipline of biosemiotics is young and remains in its (...) early phase of growth. As the new editorial team of Biosemiotics, we would like to express our gratitude to Dr. Barbieri for his excellent job as an editor, and ensure the readers that we are equally committed to maintain high standards and the scientific rigor of published papers. In this editorial contribution, two issues relevant to the question, what should be at the top of the research agenda for ethics and technology, are identified and discussed. Firstly: can, and do, engineers make a difference to the degree to which technology leads to morally desirable outcomes? What role does professional autonomy play here, and what are its limits? And secondly, what should be the scope of engineers’ responsibility; that is to say, on which issues are they, as engineers, (...) morally obliged to reflect? The research agendas proposed by the authors contributing to this special section, implicitly, give different answers to these questions. We suggest that an explicit discussion of these issues would greatly help in constructing a common research agenda. (shrink)

Justice, one of the four Beauchamp and Childress prima facie basic principles of biomedical ethics, is explored in two excellent papers in the current issue of the journal. The papers stem from a British Medical Association essay competition on justice and fairness in medical practice and policy. Although the competition was open to all comers, of the 235 entries both the winning paper by Alistair Wardrope1 and the highly commended runner-up by Zoe Fritz and Caitríona Cox2 were written by practising (...) doctors—a welcome indication of the growing importance being accorded to philosophical reflection about medical practice and practices within medicine itself. Both papers are thoroughly thought provoking and represent two very different approaches to the topic. Each deserves a careful read. The competition was a component of a BMA 2019/2020 ‘Presidential project’ on fairness and justice and asked candidates to ‘use ethical reasoning and theory to tackle challenging, practical, contemporary, problems in health care and help provide a solution based on an explained and defended sense of fairness/justice’. In this guest editorial I’d like to explain why, in 2018 on becoming president-elect of the BMA, I chose the theme of justice and fairness in medical ethics for my 2019–2020 Presidential project—and why in a world of massive and ever-increasing and remediable health inequalities biomedical ethics requires greater international and interdisciplinary efforts to try to reach agreement on the need to achieve greater ‘health justice’ and to reach agreement on what that commitment actually means and on what in practice it requires. First, some background. As president I was offered the wonderful opportunity to pursue, with the organisation’s formidable assistance, a ‘project’ consistent with the BMA’s interests and values. Abstract Galileo Then and Now (Draft of paper to be discussed at the Conference, HPD1, to be held at the Center for Philosophy of Science, University of Pittsburgh, 11-14 October 2007) William R. Shea, University of Padua The aim of this paper is to stimulate discussion on how shifts in philosophical fashion and societal moods tell us not only what to read but how to go about it, and how history and philosophy of science can jointly deepen our grasp of (...) the issues at stake. The first part highlights some of the things that have occurred in the field of Galileo studies between the monumental edition of Galileo Opere in twenty volumes, edited by Antonio Favaro between 1890 and 1909, and the new enlarged edition that will be published from 2009 onwards by a team of scholars working under Paolo Galluzzi. Part One. From Favaro to Galluzzi "Publish or perish" is an injunction that resonated as clearly in the ears of assistant professors at the end of the 19th century as it does in the first decade of the 21st. But publishing can also mean perishing when what is being edited is the work of an eminent scientist of the past. It simply does not do to offer material that is not what readers expect even if it was written by someone as famous as Galileo, and well authenticated sources were sometimes disregarded when they appeared to be of no interest. It is largely for this reason that a new national edition of Galileo's works is required. Of course, over the last hundred years, a number of letters from and to Galileo as well as a few laudatory or damning comments about his personality or his work have been uncovered, but this would not have been enough to drum up financial and scholarly support for a major editorial project. But the interesting material is Favaro had left out. Before mentioning what this material is, allow me a disclaimer. I'm not focusing on Favaro because he is a singularity, but because he illustrates how a conscientious historian can ride slipshod over evidence because of a philosophical commitment that he is only vaguely aware of, in this case naïve positivism. So what did Favaro to leave out? The answer is large chunks of three collections of manuscript notes that are bound in some of the 347 volumes of the Galilean material in the National Library in Florence. The first of these collections deals with logical treatises and related essays on Aristotelian philosophy, the second with Galileo's laboratory notes on the experiments that he carried out on the pendulum and inclined planes; and the third with astrological computations. Favaro rejected the first collection because they were "pre-Galilean" and hence could only have been trite scholastic exercises that "poor" young Galileo had to undergo in high school. He neglected the second because he had trouble making sense of them The third, astrological collection, he set aside with more trepidation since Galileo cast horoscopes for himself (at least twice), his children and his friends. But the fact that they were also, epistemologically speaking, "pre-Galilean", was enough to cast them into the outer darkness (in this case a dimly lit corridor of the National Library in Florence). The Aristotelian notes that Favaro had neglected were made available by William Wallace, who showed that Galileo culled long passages from professors at the Roman College. Galileo attacked several of Aristotle's ideas, but he never queried Aristotle's scientific realism–namely, the view that there is a uniquely true physical theory, discovered by human powers of reason and observation, and that alternative theories are consequently falls. Wallace made this the basis of his claim that Galileo created, in the heaven above and here on earth, a new science of motion by following the Aristotelian cannons laid down in the Posterior Analytics. On this view, Galileo used Aristotle's logic to subvert Aristotelian physics. It is interesting to contrast Wallace's thesis with that of philosophers of different allegiance, who offer a reconstruction of Galileo's methodology along lines that are much more modern and in which the epistemological core is no longer Aristotelian logic, but common sense instrumentalism. This is not to deny that experiments sometimes speak with a forked tongue, but to stress that methodological rules have also been known to be no more than clashing cymbals. Recent writers have also stressed that Galileo aimed his arguments at a specific audience, and that we must take cognizance of the values and whims of the society in which he operated. The sociology of science can help us understand the background against which Galileo's arguments were assessed and the reasons why he favored some rhetorical strategies over other ones. Mario Biagoli's Galileo Courtier sheds light on the Tuscan court and the Roman famiglia (as the popes styled their entourage), where Galileo found many of his readers and most of his critics. But Galileo was much more than a courtier, and I shall argue that we should use our enhanced knowledge of Galileo's education, his language, his style, and his emoluments to understand his science, not to supplant it. History and philosophy of science can combine their insights to achieve a more critical and balanced view of what actually occurred and why. (shrink)

The goal of KSMS is to advance Kierkegaard studies by encouraging top-level scholarship in the field. The editorial and advisory boards are deeply committed to creating a genuinely international forum for publication which integrates the many different traditions of Kierkegaard studies and brings them into a constructive and fruitful dialogue. The role of an academic editor and publisher is not simple. It is even less so when providing guidance and support for authors from the countries of the majority world becomes a habitual condition of this activity. Editorial commitment in this context becomes ambivalent, as it has to be oriented towards meeting two distinct objectives: ensuring academic quality and providing support to authors. To meet this challenge the publisher hopes to make the most of online tools and networks. (...) If some scholarly work fails to be published, it raises the question whether authors would benefit from mentorship to improve their texts and thereby meet with international academic standards. The publisher cannot entirely compensate for the weakness of the research work, but should seek to mitigate it. (shrink)

The paper presents a dialogical approach applied to the analysis of argumentative strategies in philosophy and examines the case of the critical comments to the Tanner Lectures given by the Dutch biologist and primatologist, Frans de Waal, at Princeton University in November 2003. The paper is divided into five parts: the first advances the hypothesis that what seem puzzling aspects of philosophical argumentation to scholars in other academic fields are explained by the global role played by a series of arguments (...) within a broader argumentative strategy, e.g. arguing that a question that seems important is not really worthwhile; the second presents five groups of dialectical operations, making use of concepts and tools from the dialectical dialogical approach (WaltonWalton and Krabbe, Commitment in Dialogue: Basic Concepts of Interpersonal Reasoning, SUNY Press, Albany, 1995), Hubert Marraud's Argument dialectic (Marraud, En buena lógica. Una introducción a la teoría de la argumentación, Editorial Universidad de Guadalajara, Guadalajara, 2020) and from the vast tradition of formal dialectics and dialogical logic. Appeals to scrutinize the use of race and ethnicity as variables in genetics research notwithstanding, these variables continue to be inadequately explained and inconsistently used in research publications. In previous research, we found that published genetic research fails to follow suggestions offered for addressing this problem, such as explaining the basis on which these labels are assigned to populations. This study, an analysis of genetic research articles using race or ethnicity terms, explores possible features of journals that are associated with (...) improved reporting of race and ethnicity in genetic research. A journal’s expressed commitment to improving how race and ethnicity are used in genetic research, demonstrated by an editorial or in its instructions to authors, was the strongest predictor of following recommendations about reporting race and ethnicity. Journal impact factor had only a limited positive effect on attention to these issues, suggesting that editorial resources associated with higher impact factor journals are not sufficient to improve practices. Our findings reiterate that race and ethnicity variables are used inconsistently in genetic research, but also shed light on how journals might improve practices by highlighting the need for scientists to carefully scrutinize the use of these variables in their work. The recent bioethical literature addresses numerous new problems posed by advancing medical technology and demonstrates an erosion of standards rooted in religion and long widely accepted as almost axiomatic. In the deep soul-searching that pervades the publications on bioethics, several disturbing and dangerous trends neglect some basic lessons of philosophy, logic, and history. The bioethics (...) discourse on medical aid in dying emphasizes similarity over previously recognized important distinguishing features. For example, it overplays a likeness between assistance in dying and the withdrawal of life-saving technology. In many bioethics’ topics, arguments based on a logical continuum are used to question the lines demarcating important moral differences. l. The Line Between Ethical and Not: Logic Based on Continuum Careful case selection, often either end of a continuum, allows the tearing down or ridiculing of many rules and codes across most professions and fields of interest. This situation holds true for traffic laws as well as medical ethics guidelines. It is relatively simple for those who desire to attack a particular viewpoint by selecting a case that makes that position seem untenable. In the ethics realm, good and bad medicine exist at opposite ends of an ethical continuum, with many practices lying in between. For example, much of medical ethics exists between the Nazi criminal physicians and the most sainted nurse or physician. A gradual progression occurred over less than two decades from a utilitarian position that supported limited euthanasia for those with certain mental illnesses to genocide. German society embraced a utilitarian ethic in which the value of human life no longer was intrinsic but instrumental.[1] Many morally significant points on a continuum were then ignored as the misguided utilitarian policy rampantly continued. A point in the continuum to distinguish between ethically justifiable and that which is not can be difficult to identify compared to the two extremes. This continuum is not unique to ethics but can be applied to almost any other aspect of human life and endeavor. Between a severely ill schizophrenic person and a superbly well-adjusted individual, there is a continuum of mental and psychological function. The existence of a continuum should not paralyze thinking and prevent us from drawing lines and identifying moral differences based on objective criteria as well as moral philosophy. Yet, by focusing on a continuum, many bioethicists use logic to disregard dividing lines between an "ethical" and an "unethical" act. Unfortunately, sometimes bioethicists draw revolutionary conclusions that would change the scope of medical practices which is accepted as ethical. There are many examples of similar shifts on the continuum. Many authors argue for the ethical permissibility of abortion by pointing out that the human fetus is no different in various characteristics, one arguing it is as like an ape or chick as it is like a person,[2] and does not achieve unique human and individual characteristics until well into the first year of life.[3] While human fetuses arguably do not have certain distinctive qualities of personhood, most people shy away from the logical next conclusion: permitting infanticide. For example, Joshua Lederberg condemns infanticide, in the face of biological illogic, because of our emotional commitment to infants, to me, a relatively weak explanation. Sir Francis Crick suggests we might consider birth at two days of life in order to decide whether an infant is a "suitable" member of society.[4] Giublini and Minerva suggest that infanticide should be permissible since late pregnancy abortions are permissible, arguing there is no significant difference between a fetus just before birth and an infant just after birth.[5] Clearly the continuum approach would allow for subjective arguments in favor of later infanticide at other points many days post-birth. Years ago, with a cynical tone, I mentioned infanticide as a further step on the continuum beyond abortion, and I was rightly shouted down as being deliberately provocative to assert the logic would ever stretch so far. While it is not an accepted mainstream position, the movement in academic settings from widespread condemnation to limited possible acceptance of infanticide has taken place in an incredibly short time. Public opinion and medical opinion in these areas have shifted dramatically in a short time. In another area, from a biological and chemical point of view, there is a continuum from man down to a single carbon atom. Yet, it would not seem logical to ignore the emotional differences, the meaning of personhood, or the moral distinction between killing an insect and killing a person. ll. A False Continuum: Medical Aid in Dying I assert that there has been an erosion of ethical guidelines in recent years attributable to using continuums to camouflage important distinctions. James Rachels’ work on active and passive euthanasia, which contends that the two are ethically identical, exemplifies that logic.[6] He illustrates this thesis, using a continuum to compare different scenarios with like consequences as morally equivalent, by comparing the deliberate drowning of a child with a deliberate failure to rescue a drowning child when easily able to do so. The author's comparison proposes that since much of the medical profession has already made peace with withholding treatment in order to hasten death, consistency inexorably demands that we permit active euthanasia as well.[7] When permission for active euthanasia was first introduced, it was limited exclusively to patients suffering severely from an intractable, incurable, and irreversible disease. These guidelines have been continuously eroded. There is now a substantial serious consideration for permitting active euthanasia of healthy elderly individuals who feel that they have completed their lives and are "tired of living."[8] There are many moral and factual differences along the ethical continuum. In human life, there is a difference between a live baby and a fetus, between a viable fetus and one that is not, between a fetus and a zygote, and between a zygote and a sperm cell. Similarly, there is a difference between pulling a trigger to kill someone and not interfering in preventing his death, which is reprehensible though both may be. There is a difference between not resuscitating an 80-year-old man with cancer when his heart stops and injecting him with a fatal dose of potassium chloride. I argue that an overt act of taking life repels civilized human beings is to be commended and encouraged as the reverence for human life or even for just a moment of human life is one of the great contributions of our civilization. CONCLUSION As an orthodox Jew, I feel that divinely inspired guidelines that have stood the test of centuries shape my beliefs, and such guidelines contradict medical aid in dying. I cannot speak to the viewpoint of those who do not access religion in defining their moral stance, nor do I implicate them in the current bioethics' trends, as I am not aware of the personal role of religion in the lives of most such authors. While many nonreligious people have a firm philosophical grounding and oppose medical aid in dying, I suggest that in the absence of any religious or other absolute standards, developing logically defensible ethical guidelines may be challenging. At the least, religion may play a role in defining the points on the continuums that are ethically meaningful and refuting the trending beliefs that if the endpoint is the same, allowing different methods of arriving at that end are somehow ethically equal. The continuum of ways death may result does not negate analysis of whether death is brought about in ways that recognize the importance of life. The German philosopher Hans Jonas said, "It is a question whether without restoring the category of the sacred, the category most thoroughly destroyed by the scientific enlightenment, we can have an ethics able to cope with the extreme powers that we possess today and constantly increase and are compelled to use."[9] While countries vary on the role of religion in policy, with many emphasizing freedoms of religion, a recent position paper released by a group of Jewish, Christian, and Moslem leaders suggested the need for agreement on the unique sanctity of human life.[10] I would recommend that such a document serve as an example of consensus on critical foundational bioethical guidelines for democratic secular societies. - [1] Alexander L Medical science under dictatorship. This article explores the impact of the VASKhNIL conference upon the cultural policy of the Italian Communist Party (PCI) and Italian communist biology, with particular attention to the period between 1948 and 1951. News of the Moscow session did not appear in the Italian news media until October, 1948, and for the next three years party biologists struggled over whether to translate the official transcript of the proceedings, The Situation in Biological Science, into Italian. This struggle reveals the complex efforts (...) of the PCI to confirm the ideological and political connection with the Soviet Union, without completely alienating significant milieus of the democratic and antifascist culture in Italy. The apparent impossibility of doing both is indicated by the fact that the project was finally abandoned in March-April, 1951. The article is divided into three sections, each focused on different actors and their response to Lysenkoism. The first section outlines the features of the PCI's pro-Lysenko campaign, with particular regard to the intellectual militancy and organizational commitment of Emilio Sereni, head of PCI's Cultural Commission between 1948 and 1951. The second section analyzes the reaction of the three most important figures in Italian communist biology during this period, Massimiliano Aloisi, Franco Graziosi and Emanuele Padoa. The third section interprets the decision not to publish a translation of The Situation in Biological Science as a consequence of the conflicts between PCI cultural program and the editorial policy of the left-wing publishing house Giulio Einaudi Editore. In my paper, I document a “travel” journey of concept formation and its concrete expression in law, which also constituted a literal travel journey across continents. Through poetic-hermeneutical approaches to language, guided by previously existing concepts stemming from experiences of the Holocaust, communism, and African-American feminist analyses of rape as an attack on a racial/ethnic group, a previously invisible domain of the human condition was charted. Throughout history, sexual atrocities have been committed within the context of wars, but their weaponisation (...) as acts of genocide remained unarticulated. This changed in the 1990s with Serbia-Yugoslavia’s genocidal wars against its neighbours (Editorial comment: The author uses the term Serbia-Yugoslavia to refer to the entity that succeeded the breakup of the Socialist Federal Republic of Yugoslavia after Croatia and Slovenia declared independence on June 25th, 1991. The SFRY up to that point consisted of the six republics Bosnia and Herzegovina, Croatia, Macedonia, Montenegro, Serbia (including the so-called autonomous regions of Kosovo and Vojvodina), and Slovenia. Further declarations of independence by Macedonia and Bosnia and Herzegovina on April 27, 1992, left only Serbia and Montenegro who the same day declared themselves to be the Federal Republic of Yugoslavia (FRY). In 2003, the Federal Republic of Yugoslavia was reconstituted as the State Union of Serbia and Montenegro, which existed until Montenegro and Serbia declared their independence (on June 3rd and June 5th, 2006, respectively)). I sketch the genesis of the concept of sexual atrocities as genocide in connection with my personal journey and how it guided legal prosecution of this “new” crime. My own travel-experience began with my association with Asja Armanda, and her discovery of coordinated mass rapes, when she came to the aid of survivors fleeing the Serbian attacks on Croatia, crimes she attempted to bring to international attention to prevent their expansion into Bosnia-Herzegovina and Kosovo. Testimonials reached me in the U.S. as well. I went to Croatia to join Armanda, where we named the crime “sexual atrocities as genocide.” On the basis of this new concept, we filed a lawsuit in New York against Bosnian Serb leader Radovan Karadžić, pioneering this crime’s recognition under international law. I conclude with philosophical questions that Putin’s similar genocidal attack on Ukraine raises today. (shrink)

It has been three years since we held the Feminism, Legality and Knowledge seminar to respond to our developing frustrations and excitement around feminist legal studies and academic publishing. In the wake of our 25th anniversary in 2018, we critically reflect further on our original intention to stock up on decolonising techniques to mix feminism, legality and knowledge whilst building on previous consideration of our self-proclaimed ‘international’ status. These reflections are prompted by editorial board members’ experiences as participants in (...) the Cardiff Law and Global Justice Centre’s British Academy-funded Global South Socio-Legal Writing Workshops in Accra, Nairobi and Recife in 2018. Following an explanation of the concerns with academic publishing that have prompted this reflection, we provide a narrative of our experiences in each of the three workshops exploring the lessons learned and their impact on our practice as editors and scholars in feminist legal studies. We finish with a renewal of our commitment to decolonise our minds and practices by continuing to struggle to earn the label ‘international’ for the journal now and in future. A brief introduction to the contents of this issue of FLS follows the reflection. (shrink)

In the previous issue of Health Care Analysis, Dr. Andrew Edgar wrote an editorial to round off his 8 years as editor of the journal. His commitment to the journal has provided a remarkable contribution to a range of fields of inquiry that focus on the relationships between health care, policy, practice, and philosophy. As Dr. Edgar indicates, under his stewardship, the journal has published papers addressing both long-standing and novel debates. As he notes, furthermore, his editorial (...) approach has afforded a platform not only for established scholars, but also scholars at the start of their careers. Indeed, when I was amongst that latter category, I was a fortunate and grateful beneficiary of Dr. Edgar’s thoughtful, patient, and generous editorial guidance, and can attest first hand to the important influence he has had in mentoring many of us working in the field, as well as on our scholarship itself.As I now move to the position of editor, I would like here to reflect on my own out. I published my first article in the Journal of Medical Ethics back in 2007 as an newly minted PhD. It was a proud moment. I respected the JME as a journal where I had read some of the most tightly argued and challenging essays in the literature. They inspired me to specialise in medical ethics and rethink some of my fundamental positions on various topics. This has been the case since, and I am proud now to join the editorial (...) team as an associate editor focusing on increasing North American presence and on the journal’s feature articles. The journal has included feature articles for several years now, and because they have worked so well, the editorial team wants to build on and invest in their success. Feature articles are primarily selected from the best extended essays or research papers. They are among the most highly cited and accessed articles in the field. On average, they have twice as many citations as a regular article published in the journal. This may be due, in part, to the journal’s practice of making feature articles open access so that all scholars can access them. A manifesto for the humanities in the digital age, A New Republic of Letters argues that the history of texts, together with the methods by which they are preserved and made available for interpretation, are the overriding subjects of humanist study in the twenty-first century. Theory and philosophy, which have grounded the humanities for decades, no longer suffice as an intellectual framework. Jerome McGann proposes we look instead to philology--a discipline which has been out of fashion for many decades but (...) which models the concerns of digital humanities with surprising fidelity. For centuries, books have been the best way to preserve and transmit knowledge. But as libraries and museums digitize their archives and readers abandon paperbacks for tablet computers, digital media are replacing books as the repository of cultural memory. While both the mission of the humanities and its traditional modes of scholarship and critical study are the same, the digital environment is driving disciplines to work with new tools that require major, and often very difficult, institutional changes. Now more than ever, scholars need to recover the theory and method of philological investigation if the humanities are to meet their perennial commitments. Textual and editorial scholarship, often marginalized as a narrowly technical domain, should be made a priority of humanists' attention. (shrink)

In the years 1829 and 1830 there appeared in Geneva a short-lived journal called l'Utilitaire, edited by Antoine-Élysée Cherbuliez. In the preface to the first issue, the editor wrote that he was working ‘in the spirit of Bentham’, but did not wish to found a party tied to Bentham's name. He wished to emulate Bentham's thinking in so far as it was synonymous with a detached, neutral perspective on the world, a viewpoint superior to the strife of factions. Having spoken (...) eulogisti-cally of Bentham in these terms, the writer added that a well-merited share of the Englishman's glory belonged to Dumont. The names of Jeremy Bentham and Étienne Dumont ‘must no more be separated than those of Kepler and Newton’. After giving some consideration to the question of why Dumont's work was so important for Bentham, I shall concentrate in this article on why the Genevan became so committed to the task of disseminating the utilitarian thought of his English mentor. I will be focusing on the initial stages of Dumont's editorial and translation work in the 1790s and will not be attempting here to give a comprehensive history of a relationship that lasted nearly forty years. She attended McMaster’s Russell Centenary Celebrations in 1972. Her scholarly interests and commitments extended to the McMaster edition of Russell’s Collected Papers, of whose Advisory Editorial Board she was a longstanding member. Kate herself wrote an important and poignant memoir, My Father Bertrand Russell; she was an always charming and friendly visitor to McMaster on those occasions she undertook work in the Russell Archives, which included an annotated, as yet unpublished edition of her correspondence with her father. Joseph Medill's Chicago Tribune was an influential voice for civil rights and equality in the age of slavery. By 1883, however, when the Supreme Court struck down the Civil Rights Act of 1875, the Tribune 's commitment to its moral principles had been compromised. The paper abandoned its editorial support for equality in favor of shoring up the declining fortunes of the Republican Party in the post-Reconstruction era. A content analysis of Tribune news and editorial items on (...) the civil rights law shows strong support for the statute in 1875 when it was passed, and an equally strong support for the Supreme Court decision that annulled it in 1883. To revisit that event—and the Institute’s five founding collaborators who spoke at it—provides an opportunity to (...) re-vision some of the most significant intellectual, moral, cultural, and political factors that shaped both this Institute and the then-nascent field of bioethics.Eunice Kennedy Shriver, who spoke at the press conference, was intensely committed to a new sort of philanthropy that would effect socio-political change in favor the dignity and well-being of the mentally disadvantaged. As executive vice-president of the Joseph P. Kennedy, Jr. Foundation, she had already applied the Foundation’s vision and resources to the task of harnessing the best of the “biological revolution” of the 1960s to prevent developmental disorders. Prompted by the values at stake in the care of the disadvantaged, she turned the Foundation toward the creation of the Institute in 1971.Just prior to the opening of the Institute, Mrs. Shriver had produced and appeared as introducer in a highly influential film, “Who Shall Survive?”, which dealt with a “mongoloid baby” who was allowed to die in the newborn clinic because of its condition. Showcased at a highly publicized symposium involving 2000 people (Editorial 1971) and widely discussed in the press, the film helped to establish neonatal ethics as paradigmatic for the emerging field of bioethics (Bedeviling Question 1971; Rothman 1991, pp. 190–221). Undoubtedly under the influence of her involvement in the publicizing of those issues, Mrs. Shriver commented at the press conference that she hoped the Institute would re-emphasize the value of children in face of the widespread feeling that children are a burden (Kennedys 1971, p. 19).At the press conference, then president of Georgetown University, Robert J. Henle, S.J., announced the Kennedy Foundation’s grant of $1.35 million to establish the Institute. Henle was undoubtedly alert to the fact that certain issues, such as abortion and terminating the lives of infants, would be perceived [End Page 323] as highly controversial when raised at a Catholic university. Not surprisingly, reporters at the press conference raised provocative questions about how Georgetown University would reconcile Catholic moral doctrine with the Institute’s broadly-based inquiries. Henle replied tersely that the Institute “will be a ‘truly ecumenical and catholic effort,’ defining catholic in its classical meaning of universal” (Helping 1971). The reporters might have found it quite ironic that within a few years Georgetown’s ecumenical vision had provided the intellectual environment that permitted the Institute to become famous for development of the first systematic, secular (principle-based) approach to bioethics (Reich 1995).Father Henle was probably also aware that by launching the Kennedy Institute he was creating the first institute principally devoted to ethics research ever established at a university. It took a special sort of university to take this first step into bioethics research and policymaking. In 1971, ethics was regarded as belonging to religion, and religion was generally regarded as suspect academically. While it was difficult, in that atmosphere, for a nonreligious university to take such a bold step, Henle’s Georgetown University offered a promising setting that could scarcely have been found in any other university. It departed from the common mold of Catholic-college-as-indoctrination-center, yet it had an explicit and unashamed commitment to the investigation of religious and secular values in an environment of academic freedom. It was an increasingly cosmopolitan university, committed to developing the best of secular scholarship. Furthermore, Henle was willing to experiment with as-yet unproven interdisciplinary studies.Sargent Shriver—god-father of the Kennedy Institute, chairman of its first Advisory Board, and a constant dialogue partner of his friend and the Institute’s founding director, Dr. André Hellegers—was intensely interested in linking scientific progress with religious belief, unfettered moral debate, and commitment to disadvantaged humans.At the inaugural event, the new Institute was described as... Media attention is a key political resource for protesters. This implies that journalists are a crucial audience to which protesters seek to appeal. We study to what extent features of protest, of journalists, and of news organizations affect journalists’ news judgment. We exposed 78 Spanish journalists to vignettes of asylum seeker protests. Four features were systematically manipulated: protesters’ worthiness, unity, numbers, and commitment. The experiments scrutinize the extent to which journalists consider a protest newsworthy and the likelihood that a (...) protest is featured on a newspaper’s front page. Our results show that in terms of media presence, high turnout is key. Highly unified protesters, in contrast, are considered less newsworthy. Regarding prominence, strongly committed demonstrators more easily make it to the frontpage. Individual characteristics of journalists have no direct effect on news judgment. Journalists’ editorial status and ideological placement only moderate the effect of some of the protest features, although in terms of front-page placement a more potent adversary versus ally effect is distinguished. This Special Issue has presented a series of conversational interviews with editors of leading journals in the field of philosophy of education. This concluding article synthesises the interviews and reflects on what this project offers to early career researchers including the interviewer-authors in this issue. The contributing writers are interested in their own prospects, as well as those of the field of philosophy of education, and indeed education, and society more generally, in the context of the turbulent changes currently remodelling (...) academic lives and institutions. This has been an inspiring project to work on, producing these six interviews, on which this conclusion and special issue is based: ; _Shaping the agenda of the global civil society: an interview with Michael Peters_, by Richard Heraud and Marek Tesar. ; _Publishing and intergenerational learning in philosophy of education: an interview with Paul Smeyers, _ by Daniella J. Forster. ; _Insights from an editor’s journey: an interview with Gert Biesta, _ by Christoph Teschers. ; _Writing in the margins: an interview with Bob Davis, _ by Kirsten Locke. ; _Emerging perspectives on editorial ethics: an interview with Chris Higgins, _ by Liz Jackson. ; _The long arc of knowledge: an interview with Nicholas Burbules, _ by Georgina Stewart. Most of the Editors commented on the large amount of work involved in editing a journal: a demanding, time-consuming, but very rewarding and satisfying job. Paul Smeyers spoke of taking on the role after being approached by the publisher, when he realised there were few alternative candidates. Gert Biesta spoke of being curious to find out about the process of publishing from the inside, as well as regarding it as an honour to be asked, and being motivated by a wish to help the field. Michael Peters said his editing philosophy includes helping academics to realise that editing and publishing are related to having control over one’s own ideas: more political and philosophical than simply the technical tasks of proofreading and editing. All the Editors are motivated by a wish to improve the field, and ultimately society. An editor clearly needs to read a great deal: some of the Editors spoke about reading everything submitted, and everything published in the journal; or of having read thousands of papers in their time as editor; and the daunting commitment of time involved—about half a day per paper, or more. Several Editors spoke about the impact of the job on their own research output: one view being that the sheer time involved in editing a journal is detrimental to being an active researcher. Conversely, reading the work of so many other scholars can provide an editor with more motivation to write, while having limited writing time available encourages more decisiveness, and less perfectionism. Journals and editors need to understand their consumers: who reads what, how and when. In recent decades, reading practices have undergone a major change from paper-based to screen-based, and some of the Editors speculated that paper-based journals will soon disappear entirely. The change to reading digitally is the latest in a series of historical iterations of how the disciplines of reading interact with the mediating technologies, with each change integrating new forms while retaining what is best in their heritage. Reading, and hence also writing, played an important part in the eighteenth-century European development of human rights and the concept of equality, through widespread readership of seminal texts. The contemporary situation, in which everything can be freely read, redefines the relationship of the reader to the author, whereby reading and writing constitute a form of creative labour on the self, involving self-transformation, self-recognition, and the kinds of links that are possible between people in a digital world.
