Legislation usually lacks a systematic organization which makes the management and the access to norms a hard problem to face. A more analytic semantic unit of reference (provision) for legislative texts was identified. A model of provisions (provisions types and their arguments) allows to describe the semantics of rules in legislative texts. It can be used to develop advanced semantic-based applications and services on legislation. Access to legal information and, in particular, to legal literature is examined for the creation of a search and retrieval system for Italian legal literature. The design and implementation of services such as integrated access to a wide range of resources are described, with a particular focus on the importance of exploiting metadata assigned to disparate legal material. The integration of structured repositories and Web documents is the main purpose of the system: it is constructed on the basis of a (...) federation system with service provider functions, aiming at creating a centralized index of legal resources. The index is based on a uniform metadata view created for structured data by means of the OAI approach and for Web documents by a machine learning approach, which, in this paper, has been assessed as regards document classification. Semantic searching is a major requirement for legal literature users and a solution based on the exploitation of Dublin Core metadata, as well as the use of legal ontologies and related terms prepared for accessing indexed articles have been implemented. A model of normative provisions and related axioms represented by using RDF/owl are presented as a contribution to implement the semantic web in the legal domain. In particular, a pattern able to implement the Hohfeldian legal fundamental relations between provisions using OWL-DL expressivity is proposed. Moreover, a query-based approach able to deal with relations between provision instances is described. An example of advanced access and reasoning over provisions using the proposed approach, as well as a prototype architecture of a provision (...) retrieval system, are shown. The main benefit is represented by the ability of the approach to keep the complexity of the problem within a description logic computational tractability. (shrink)

This paper reflects my address as IAAIL president at ICAIL 2021. It is aimed to give my vision of the status of the AI and Law discipline, and possible future perspectives. In this respect, I go through different seasons of AI research : from the Winter of AI, namely a period of mistrust in AI, to the Summer of AI, namely the current period of great interest in the discipline with lots of expectations. One of the results of the first (...) decades of AI research is that “intelligence requires knowledge”. Since its inception the Web proved to be an extraordinary vehicle for knowledge creation and sharing, therefore it’s not a surprise if the evolution of AI has followed the evolution of the Web. I argue that a bottom-up approach, in terms of machine/deep learning and NLP to extract knowledge from raw data, combined with a top-down approach, in terms of legal knowledge representation and models for legal reasoning and argumentation, may represent a promotion for the development of the Semantic Web, as well as of AI systems. Finally, I provide my insight in the potential of AI development, which takes into account technological opportunities and theoretical limits. (shrink)

In this article we argue for the necessity of a new double alliance between phenomenology and cognitive sciences (through embodied theory) onthe one hand, and between phenomenological pedagogy and the embodiment paradigm on the other. We strongly believe that phenomenological pedagogyshould enter into dialogue with the cognitive sciences movement called “Embodiment” in order to renew its educational theories and practices. Indeed, thenew suggestions about the mind that come from the embodiment paradigm can already have a huge impact on learning and (...) education, but a relatively structured “pedagogy of consciousness” is still missing. This topic will be discussed with a special focus on body and embodied consciousness, which nicelybrings together these different traditions. Finally, an actual example of how the embodiment paradigm and phenomenological pedagogy can converge will be presented through the practice of meditative experience. (shrink)

This paper presents an approach for legal compliance checking in the Semantic Web which can be effectively applied for applications in the Linked Open Data environment. It is based on modeling deontic norms in terms of ontology classes and ontology property restrictions. It is also shown how this approach can handle norm defeasibility. Such methodology is implemented by decidable fragments of OWL 2, while legal reasoning is carried out by available decidable reasoners. This special issue focuses on the theoretical, empirical and practical integrations between embodied cognition theory and educational science. The key question is: Can EC constitute a new theoretical framework for educational science and practice? The papers of the special issue support the efforts of those interested in the role of EC in education and in the epistemological convergence of EC and educational science. They deal with a variety of relevant topics in education and offer a focus on the role of (...) the body and embodied experience in learning and educational settings. In conclusion, some further topics are suggested that will need to be investigated in the future, such as a critical evaluation of the possibility for an epistemological alliance between educational theory and embodied cognition, and the contribution that enactive cognition can provide to educational systems, organizations, institutions and policies. In diesem Beitrag wird dem Zeitbezug von pädagogischen Konzeptionen des guten Lebens – im Spannungsfeld von Individualität und Sozialität, Pädagogik und Politik, Bestimmtheit und Unbestimmtheit – exemplarisch anhand pädagogischer Programmatiken einerseits und philosophischer Referenzen andererseits nachgegangen. Diese pädagogischen Deutungen und damit die Pädagogisierung des,guten‘ oder,richtigen‘ Lebens werden in einer bildungsphilosophischen Sichtweise und unter Bezug auf ihre deutschsprachigen Vertreter*innen einer eingehenden Betrachtung unterzogen: So scheint die Pädagogik in Theorie und Praxis einerseits auf eine klare normative Zielperspektive im Sinne einer Vorstellung vom (...) guten menschlichen Leben angewiesen zu sein, die auch für die Zukunft Geltung beanspruchen kann. Anderseits scheint die Offenheit der Zukunft, von der aus sich die Notwendigkeit einer Pädagogik allererst rechtfertigen lässt, in diesem Prozess bedacht und bewahrt werden zu müssen, um Heranwachsenden eine eigenverantwortliche Gestaltung ihrer Welt in Relation zu anderen zu ermöglichen. Letzteres scheint nun aber gerade gegen eine Überformung pädagogischer Kerngedanken durch gegenwartsbezogene starre Vorstellungen eines guten Lebens zu sprechen. Mit dem Aufzeigen dieses Dilemmas und der Analyse verschiedener Lösungsansätze vor dem aktuellen Hintergrund der Ungewissheit gesellschaftlicher Transformationsprozesse möchte der Text einen allgemeinpädagogischen Beitrag zur philosophischen Diskussion um das (kollektiv) gute Leben leisten. After noting the absence of a mutual confrontation, the aim of this research has been redefined in reconstructing the influence of Habermas’ writings on the work of Zygmunt Bauman – an aspect known to scholars of the Polish sociologist but not very well recognized in the international sociological community. Psychiatric disorders like eating disorders might be underpinned by differences in decision making. However, little previous research has investigated this potential relationship using longitudinal data. This study aimed to understand how components of decision making measured by the Cambridge Gambling Task in the United Kingdom’s Millennium Cohort Study at age 11 might explain clusters/types of ED prodrome involving body dissatisfaction, intention to lose weight, dietary restraint, excessive exercise and significant under/overweight measured in the MCS at age 14. Latent class analysis (...) revealed two groups within the cohort: a non-prodromal eating pathology group, who were more likely to be of “average” weight, according to the UK90, with minimal disordered attitudes and behaviors in relation to eating and weight; and a second group with prodromal eating pathology, who had more body dissatisfaction, a desire to lose weight, were using dietary restriction and exercise to influence weight and were more likely to be “overweight” according to the UK90. Logistic regression showed that, after adjustment for confounding, higher risk-taking scores were associated with a 60% greater probability of being in the prodromal eating pathology group, and higher scores on quality of decision making were associated with a 30% lower probability of being in the prodromal eating pathology group. Helping young people to engage in moderate risk taking and improving decision making might reduce the later presence of ED prodromes. (shrink)

The authors examine several issues in teaching phenomenology (1) to advanced researchers who are doing qualitative research using phenomenological interview methods in disciplines such as psychology, nursing, or education, and (2) to advanced researchers in the cognitive neurosciences. In these contexts, the term “teaching” needs to be taken in a general and nondidactic way. In the case of the first group, it involves guiding doctoral students in their conception and design of a qualitative methodology that is properly phenomenological. In the (...) case of the second, it is more concerned with explaining the relevance of phenomenology to an audience of experimental scientists via conference presentations or published papers. In both cases, however, the challenge is to make clear to the relevant audience what phenomenology is and how it can relate to what they are doing. (shrink)

This paper discusses several topics that relate more naturally to groups of papers than a single paper published in the journal: ontologies, reasoning about evidence, the various contributions of Douglas Walton, and the practical application of the techniques of AI and Law.

The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. We argue that the trend toward providing users with feasible and actionable explanations of AI decisions—known as recourse explanations—comes with ethical downsides. Specifically, we argue that recourse explanations face several conceptual pitfalls and can lead to problematic explanation hacking, which undermines their ethical status. As an alternative, we advocate that explanations of AI decisions should aim at understanding.

The Anthropocene is heralded as a new epoch distinguishing itself from all foregoing eons in the history of the Earth. It is characterized by the overarching importance of the human species in a number of respects, but also by the recognition of human dependence and precariousness.
