Psychiatric disorders like eating disorders might be underpinned by differences in decision making. However, little previous research has investigated this potential relationship using longitudinal data. This study aimed to understand how components of decision making measured by the Cambridge Gambling Task in the United Kingdom’s Millennium Cohort Study at age 11 might explain clusters/types of ED prodrome involving body dissatisfaction, intention to lose weight, dietary restraint, excessive exercise and significant under/overweight measured in the MCS at age 14. Latent class analysis (...) revealed two groups within the cohort: a non-prodromal eating pathology group, who were more likely to be of “average” weight, according to the UK90, with minimal disordered attitudes and behaviors in relation to eating and weight; and a second group with prodromal eating pathology, who had more body dissatisfaction, a desire to lose weight, were using dietary restriction and exercise to influence weight and were more likely to be “overweight” according to the UK90. Logistic regression showed that, after adjustment for confounding, higher risk-taking scores were associated with a 60% greater probability of being in the prodromal eating pathology group, and higher scores on quality of decision making were associated with a 30% lower probability of being in the prodromal eating pathology group. Helping young people to engage in moderate risk taking and improving decision making might reduce the later presence of ED prodromes. (shrink)

After noting the absence of a mutual confrontation, the aim of this research has been redefined in reconstructing the influence of Habermas’ writings on the work of Zygmunt Bauman – an aspect known to scholars of the Polish sociologist but not very well recognized in the international sociological community. In a series of three behavioral experiments, we found a systematic distortion of probability judgments concerning elementary visual stimuli. Participants were briefly shown a set of figures that had two features (e.g., a geometric shape and a color) with two possible values each (e.g., triangle or circle and black or white). A figure was then drawn, and participants were informed about the value of one of its features (e.g., that the figure was a “circle”) and had to predict the value (...) of the other feature (e.g., whether the figure was “black” or “white”). We repeated this procedure for various sets of figures and, by varying the statistical association between features in the sets, we manipulated the probability of a feature given the evidence of another (e.g., the posterior probability of hypothesis “black” given the evidence “circle”) as well as the support provided by a feature to another (e.g., the impact, or confirmation, of evidence “circle” on the hypothesis “black”). Results indicated that participants’ judgments were deeply affected by impact, although they only should have depended on the probability distributions over the features, and that the dissociation between evidential impact and posterior probability increased the number of errors. The implications of these findings for lower and higher level cognitive models are discussed. (shrink)

The current disclosure model of informed consent ignores the linguistic complexity of any act of communication, and the increased risk of difficulties in the special circumstances of informed consent. This article explores, through linguistic analysis, the specificity of informed consent as a speech act, a communication act, and a form of dialogue, following on the theories of J.L. Austin, Roman Jakobson, and Mikhail Bakhtin, respectively. In the proposed model, informed consent is a performative speech act resulting from a series of (...) communication acts which together constitute a dialogic, polyphonic, heteroglossial discourse. It is an act of speech that results in action being taken after a conversation has happened where distinct individuals, multiple voices, and multiple perspectives have been respected, and convention observed and recognized. It is more meaningful and more ethical for both patient and physician, in all their human facets including their interconnectedness. This is a study of the effects of a number of background variables on ethical perceptions of Mexican and U.S. marketers. This research investigates how a marketer’s personal religiousness, relativism, and the ethical values influence in perceptions of the degree of ethical problems in hypothetical marketing scenarios. It also examines differences between Mexican and U.S. marketers on these variables. The results show significant differences in perception between the countries, and we discuss the implications of these differences for cross-cultural business activities.

The critical discourse analysis is the tool used in this article, to study how audiovisual media have constructed mental representation about the historical facts occurred in Spain between the final stage of the Spanish Civil War and the late 1980s: the theft of newborn babies. The State has failed in an attempt to establish policies that support truth, justice and reparation as it has been recalled by United Nations experts to the Government of Spain, and the reports and documentaries have (...) become vehicles to capture and recover memories. Our objective is to analyze how this collective awareness has been realized and the contribution of reports and documentaries. Our results show that the Spanish television channels silence the Francoist context to depict the thefts as the product of economical mobs focused on child trafficking. The international channels, however, put the origin of the dictatorship at the center of the discourse. (shrink)

Differences in Common engages in the ongoing debate on ‘community’ focusing on its philosophical and political aspects through a gendered perspective. It explores the subversive and enriching potential of the concept of community, as seen from the perspective of heterogeneity and distance, and not from homogeneity and fused adhesions. This theoretical reflection is, in most of the essays included here, based on the analysis of literary and filmic texts, which, due to their irreducible singularity, teach us to think without being (...) tied, or needing to resort, to commonplaces. Philosophers such as Arendt, Blanchot, Foucault, Agamben or Derrida have made seminal reflections on community, often inspired by contemporary historical events and sometimes questioning the term itself. More recently, thinkers like Judith Butler, Gayatri Spivak or Rada Ivekovic—included in this volume are essays by all three—have emphasized the gender bias in the debate, also problematizing the notion of community. Most of the essays gathered in Differences in Common conceive community not as the affirmation of several properties which would unite us to other similar individuals, but as the “expropriation” of ourselves (Esposito), in an intimate diaspora. Community does not fill the gap between subjects but places itself in this gap or void. This conception stresses the subject’s vulnerability, a topic which is also central to this volume. The body of community is thus opened by a “wound” (Cixous) which exposes us to the contagion of otherness. The essays collected here reflect on different topics related to these issues, such as: gender and nation; nationalism, internationalism, transnationalism; nationalism’s naturalization of citizenship and the exclusion of women from citizenship; the violent consequences of a gendered nation on women’s bodies; gendering community; preservation of difference(s) within the community; bodily vulnerability and new politics; community and mourning; community and the politics of memory; fiction, historical truth and (fake) documentary; love, relationality and community; interpretive communities and virtual communities on the Web, among others. El texto que sigue compendia reflexiones alrededor de lo educativo y lo pedagógico a propósito de procesos y proyectos de investigación en curso del Grupo de Investigación en Escenarios y Subjetividades Educativas (GIESE) de la Facultad de Humanidades de la Universidad Nacional de Mar del Plata. En los protocolos de la investigación académica este manuscrito puede inscribirse en el género “artículo” a condición de que se conciba en el marco de una etnografía previa de larga duración, lo que supone un (...) conjunto de conversaciones en las cuales varias corrientes “teóricas” y experiencias de trabajo de campo intra-actúan—para codificarlo en términos realista-agenciales—en pos de producir relatos que puedan conmover o inspirar otras búsquedas. El artículo utiliza la imagen de la canción para proponer una inmersión en lo que se acuña contingente y provisoriamente como “arqueologías biográficas”, con el fin de estimular la imaginación respecto ciertos modos alternados y alterados de performar la investigación educativa. The Fairness, Accountability, and Transparency (FAccT) literature tends to focus on bias as a problem that requires ex post solutions (e.g. fairness metrics), rather than addressing the underlying social and technical conditions that (re)produce it. In this article, we propose a complementary strategy that uses genealogy as a constructive, epistemic critique to explain algorithmic bias in terms of the conditions that enable it. We focus on XAI feature attributions (Shapley values) and counterfactual approaches as potential tools to gauge these conditions (...) and offer two main contributions. One is constructive: we develop a theoretical framework to classify these approaches according to their relevance for bias as evidence of social disparities. We draw on Pearl’s ladder of causation (Causality: models, reasoning, and inference. Cambridge University Press, Cambridge, 2000, Causality, 2nd edn. Cambridge University Press, Cambridge, 2009. doi:10.1017/CBO9780511803161) to order these XAI approaches concerning their ability to answer fairness-relevant questions and identify fairness-relevant solutions. The other contribution is critical: we evaluate these approaches in terms of their assumptions about the role of protected characteristics in discriminatory outcomes. We achieve this by building on Kohler-Hausmann’s (Northwest Univ Law Rev 113(5):1163–1227, 2019) constructivist theory of discrimination. We derive three recommendations for XAI practitioners to develop and AI policymakers to regulate tools that address algorithmic bias in its conditions and hence mitigate its future occurrence. This paper reflects my address as IAAIL president at ICAIL 2021. It is aimed to give my vision of the status of the AI and Law discipline, and possible future perspectives. In this respect, I go through different seasons of AI research : from the Winter of AI, namely a period of mistrust in AI, to the Summer of AI, namely the current period of great interest in the discipline with lots of expectations. One of the results of the first (...) decades of AI research is that “intelligence requires knowledge”. Since its inception the Web proved to be an extraordinary vehicle for knowledge creation and sharing, therefore it’s not a surprise if the evolution of AI has followed the evolution of the Web. I argue that a bottom-up approach, in terms of machine/deep learning and NLP to extract knowledge from raw data, combined with a top-down approach, in terms of legal knowledge representation and models for legal reasoning and argumentation, may represent a promotion for the development of the Semantic Web, as well as of AI systems. Finally, I provide my insight in the potential of AI development, which takes into account technological opportunities and theoretical limits. (shrink)

This paper presents an approach for legal compliance checking in the Semantic Web which can be effectively applied for applications in the Linked Open Data environment. It is based on modeling deontic norms in terms of ontology classes and ontology property restrictions. It is also shown how this approach can handle norm defeasibility. Such methodology is implemented by decidable fragments of OWL 2, while legal reasoning is carried out by available decidable reasoners. A model of normative provisions and related axioms represented by using RDF/owl are presented as a contribution to implement the semantic web in the legal domain. In particular, a pattern able to implement the Hohfeldian legal fundamental relations between provisions using OWL-DL expressivity is proposed. Moreover, a query-based approach able to deal with relations between provision instances is described. An example of advanced access and reasoning over provisions using the proposed approach, as well as a prototype architecture of a provision (...) retrieval system, are shown. The main benefit is represented by the ability of the approach to keep the complexity of the problem within a description logic computational tractability. (shrink)

Sometimes subjects have sufficient internal and external resources to retrieve information stored in memory, in particular information that carries socially charged content. Yet, they fail to do so: they forget it. These cases pose an explanatory challenge to common explanations of forgetting in cognitive science. In this paper, I take this challenge and develop a new explanation of these cases. According to this explanation, these cases are best explained as cases of norm-induced forgetting: cases in which forgetting is caused by (...) social norms in a relevant sense. These cases draw attention to the normative aspects of the mechanisms of forgetting. This is an important but neglected aspect of cases of everyday forgetting, in particular of those characterized by a social dimension. By investigating some ways in which the psychology of social norms is causally relevant in the mechanisms of retrieval failure, I begin to fill this gap. (shrink)

Legislation usually lacks a systematic organization which makes the management and the access to norms a hard problem to face. A more analytic semantic unit of reference (provision) for legislative texts was identified. A model of provisions (provisions types and their arguments) allows to describe the semantics of rules in legislative texts. It can be used to develop advanced semantic-based applications and services on legislation. In this paper an automatic bottom-up strategy to qualify existing legislative texts in terms of provision (...) types is described. (shrink)

In this article we argue for the necessity of a new double alliance between phenomenology and cognitive sciences (through embodied theory) onthe one hand, and between phenomenological pedagogy and the embodiment paradigm on the other. We strongly believe that phenomenological pedagogyshould enter into dialogue with the cognitive sciences movement called “Embodiment” in order to renew its educational theories and practices. Indeed, thenew suggestions about the mind that come from the embodiment paradigm can already have a huge impact on learning and (...) education, but a relatively structured “pedagogy of consciousness” is still missing. This topic will be discussed with a special focus on body and embodied consciousness, which nicelybrings together these different traditions. Finally, an actual example of how the embodiment paradigm and phenomenological pedagogy can converge will be presented through the practice of meditative experience. (shrink)

The central idea behind this paper is that presuppositions of soft triggers arise from the way our attention structures the informational content of a sentence. Some aspects of the information conveyed are such that we pay attention to them by default, even in the absence of contextual information. On the other hand, contextual cues or conversational goals can divert attention to types of information that we would not pay attention to by default. Either way, whatever we do not pay attention (...) to, be it by default, or in context, is what ends up presupposed by soft triggers. This paper attempts to predict what information in the sentence is likely to end up being the main point (i.e. what we pay attention to) and what information is independent from this, and therefore likely presupposed. It is proposed that this can be calculated by making reference to event times. The notion of aboutness used to calculate independence is based on that of Demolombe and Fariñas del Cerro (In: Holdobler S (ed) Intellectics and computational logic: papers in honor of Wolfgang Bibel, 2000). Some presuppositions are easier to cancel than others in embedded contexts. This contrast has been used as evidence for distinguishing two fundamentally different kinds of presuppositions, ‘soft’ and ‘hard’. ‘Soft’ presuppositions are usually assumed to arise in a pragmatic way, while ‘hard’ presuppositions are thought to be genuine semantic presuppositions. This paper argues against such a distinction and proposes to derive the difference in cancellation from inherent differences in how presupposition triggers interact with the context: their focus sensitivity, anaphoricity, and (...) question–answer congruence properties. The paper also aims to derive the presuppositions of additive particles such as too, also, again, and of it-clefts. (shrink)

Over the last three decades, non-adaptationism has developed as an alternative model to more traditional, adaptationist approaches within Evolutionary Epistemology. Despite its great explanatory strength, non-adaptationist EE finds a potential Achilles heel in its adherence to conceptual relativism, namely the idea that empirical content can be relative to many different and radically incommensurable conceptual schemes. In his seminal essay “On the Very Idea of a Conceptual Scheme”, Donald Davidson did in fact prove the unintelligibility of an analogous form of conceptual (...) relativism. Although Davidson’s original intent was to debunk a conceptual relativist position which he discerned in the works of authors such as Kuhn, Quine, and Whorf, given the apparent similarity between the conceptual relativism supported by non-adaptationist EE and the one criticised by Davidson, one might well wonder if Davidson’s objections would have the same debunking effect if applied to non-adaptationist EE. In this paper I propose to answer this question by directing Davidson’s critiques of conceptual relativism to non-adaptationist EE and by testing to what extent the latter is de facto undermined by Davidson’s attacks. I demonstrate that Davidson’s arguments do not detract from the reliability of non-adaptationist perspectives and, to some extent, they appear to substantiate the non-adaptationist evolutionary epistemological cause anew. This paper examines a little studied type of perspective shift that I call protagonist projection, following Holton :625–628, 1997). PP is a way of describing the mental state of a protagonist that conveys, to some extent, her perspective. Similarly to its better known cousin free indirect discourse, the shift in perspective is achieved without an overt operator. Unlike FID, PP is not based on a presumed speech-act of a protagonist. Rather, it gives a linguistic form to pre-verbal perceptual content, sensations, (...) feelings or implicit beliefs. I propose to analyse PP in a bi-contextual framework, extending Eckardt’s approach to FID. Under the resulting analysis, FID and PP are two instances of a more general category of perspective shift. Access to legal information and, in particular, to legal literature is examined for the creation of a search and retrieval system for Italian legal literature. The design and implementation of services such as integrated access to a wide range of resources are described, with a particular focus on the importance of exploiting metadata assigned to disparate legal material. The integration of structured repositories and Web documents is the main purpose of the system: it is constructed on the basis of a (...) federation system with service provider functions, aiming at creating a centralized index of legal resources. The index is based on a uniform metadata view created for structured data by means of the OAI approach and for Web documents by a machine learning approach, which, in this paper, has been assessed as regards document classification. Semantic searching is a major requirement for legal literature users and a solution based on the exploitation of Dublin Core metadata, as well as the use of legal ontologies and related terms prepared for accessing indexed articles have been implemented. This special issue focuses on the theoretical, empirical and practical integrations between embodied cognition theory and educational science. The key question is: Can EC constitute a new theoretical framework for educational science and practice? The papers of the special issue support the efforts of those interested in the role of EC in education and in the epistemological convergence of EC and educational science. They deal with a variety of relevant topics in education and offer a focus on the role of (...) the body and embodied experience in learning and educational settings. In conclusion, some further topics are suggested that will need to be investigated in the future, such as a critical evaluation of the possibility for an epistemological alliance between educational theory and embodied cognition, and the contribution that enactive cognition can provide to educational systems, organizations, institutions and policies. There is currently a consensus among comparative psychologists that nonhuman animals are capable of some forms of mindreading. Several philosophers and psychologists have criticized this consensus, however, arguing that there is a “logical problem” with the experimental approach used to test for mindreading in nonhuman animals. I argue that the logical problem is no more than a version of the general skeptical problem known as the theoretician’s dilemma. As such, it is not a problem that comparative psychologists must solve before (...) providing evidence for mindreading. (shrink)

This book presents a novel interpretation of Aristotle's account of how shame instils virtue, and defends its philosophical import. Shame is shown to provide motivational continuity between the actions of the learners and the virtuous dispositions that they will eventually acquire.

This paper considers a host of definitions and labels attached to the concept of smart cities to identify four dimensions that ground a review of ethical concerns emerging from the current debate. These are: (1) network infrastructure, with the corresponding concerns of control, surveillance, and data privacy and ownership; (2) post-political governance, embodied in the tensions between public and private decision-making and cities as post-political entities; (3) social inclusion, expressed in the aspects of citizen participation and inclusion, and inequality and (...) discrimination; and (4) sustainability, with a specific focus on the environment as an element to protect but also as a strategic element for the future. Given the persisting disagreements around the definition of a smart city, the article identifies in these four dimensions a more stable reference framework within which ethical concerns can be clustered and discussed. Identifying these dimensions makes possible a review of the ethical implications of smart cities that is transversal to their different types and resilient towards the unsettled debate over their definition. Hélène Cixous is more than an influential theorist. She is also a groundbreaking author and playwright. Combining an idiosyncratic mix of autobiographical and fictional narrative with a host of philosophical and poetic observations, Cixous's writing matches the kaleidoscopic nature of her thought, offering new ways of conceptualizing sex, relationships, identity, and the self, among other topics.
