A model of normative provisions and related axioms represented by using RDF/owl are presented as a contribution to implement the semantic web in the legal domain. In particular, a pattern able to implement the Hohfeldian legal fundamental relations between provisions using OWL-DL expressivity is proposed. Moreover, a query-based approach able to deal with relations between provision instances is described. An example of advanced access and reasoning over provisions using the proposed approach, as well as a prototype architecture of a provision (...) retrieval system, are shown. The main benefit is represented by the ability of the approach to keep the complexity of the problem within a description logic computational tractability. (shrink)

This paper reflects my address as IAAIL president at ICAIL 2021. It is aimed to give my vision of the status of the AI and Law discipline, and possible future perspectives. In this respect, I go through different seasons of AI research : from the Winter of AI, namely a period of mistrust in AI, to the Summer of AI, namely the current period of great interest in the discipline with lots of expectations. One of the results of the first (...) decades of AI research is that “intelligence requires knowledge”. Since its inception the Web proved to be an extraordinary vehicle for knowledge creation and sharing, therefore it’s not a surprise if the evolution of AI has followed the evolution of the Web. I argue that a bottom-up approach, in terms of machine/deep learning and NLP to extract knowledge from raw data, combined with a top-down approach, in terms of legal knowledge representation and models for legal reasoning and argumentation, may represent a promotion for the development of the Semantic Web, as well as of AI systems. Finally, I provide my insight in the potential of AI development, which takes into account technological opportunities and theoretical limits. (shrink)

Legislation usually lacks a systematic organization which makes the management and the access to norms a hard problem to face. A more analytic semantic unit of reference (provision) for legislative texts was identified. A model of provisions (provisions types and their arguments) allows to describe the semantics of rules in legislative texts. It can be used to develop advanced semantic-based applications and services on legislation. In this article we argue for the necessity of a new double alliance between phenomenology and cognitive sciences (through embodied theory) onthe one hand, and between phenomenological pedagogy and the embodiment paradigm on the other. We strongly believe that phenomenological pedagogyshould enter into dialogue with the cognitive sciences movement called “Embodiment” in order to renew its educational theories and practices. Indeed, thenew suggestions about the mind that come from the embodiment paradigm can already have a huge impact on learning and (...) education, but a relatively structured “pedagogy of consciousness” is still missing. This topic will be discussed with a special focus on body and embodied consciousness, which nicelybrings together these different traditions. Finally, an actual example of how the embodiment paradigm and phenomenological pedagogy can converge will be presented through the practice of meditative experience. (shrink)

This paper presents an approach for legal compliance checking in the Semantic Web which can be effectively applied for applications in the Linked Open Data environment. It is based on modeling deontic norms in terms of ontology classes and ontology property restrictions. It is also shown how this approach can handle norm defeasibility. Such methodology is implemented by decidable fragments of OWL 2, while legal reasoning is carried out by available decidable reasoners. This special issue focuses on the theoretical, empirical and practical integrations between embodied cognition theory and educational science. The key question is: Can EC constitute a new theoretical framework for educational science and practice? The papers of the special issue support the efforts of those interested in the role of EC in education and in the epistemological convergence of EC and educational science. They deal with a variety of relevant topics in education and offer a focus on the role of (...) the body and embodied experience in learning and educational settings. In conclusion, some further topics are suggested that will need to be investigated in the future, such as a critical evaluation of the possibility for an epistemological alliance between educational theory and embodied cognition, and the contribution that enactive cognition can provide to educational systems, organizations, institutions and policies. Access to legal information and, in particular, to legal literature is examined for the creation of a search and retrieval system for Italian legal literature. The design and implementation of services such as integrated access to a wide range of resources are described, with a particular focus on the importance of exploiting metadata assigned to disparate legal material. The integration of structured repositories and Web documents is the main purpose of the system: it is constructed on the basis of a (...) federation system with service provider functions, aiming at creating a centralized index of legal resources. The index is based on a uniform metadata view created for structured data by means of the OAI approach and for Web documents by a machine learning approach, which, in this paper, has been assessed as regards document classification. Semantic searching is a major requirement for legal literature users and a solution based on the exploitation of Dublin Core metadata, as well as the use of legal ontologies and related terms prepared for accessing indexed articles have been implemented. In diesem Beitrag wird dem Zeitbezug von pädagogischen Konzeptionen des guten Lebens – im Spannungsfeld von Individualität und Sozialität, Pädagogik und Politik, Bestimmtheit und Unbestimmtheit – exemplarisch anhand pädagogischer Programmatiken einerseits und philosophischer Referenzen andererseits nachgegangen. Diese pädagogischen Deutungen und damit die Pädagogisierung des,guten‘ oder,richtigen‘ Lebens werden in einer bildungsphilosophischen Sichtweise und unter Bezug auf ihre deutschsprachigen Vertreter*innen einer eingehenden Betrachtung unterzogen: So scheint die Pädagogik in Theorie und Praxis einerseits auf eine klare normative Zielperspektive im Sinne einer Vorstellung vom (...) guten menschlichen Leben angewiesen zu sein, die auch für die Zukunft Geltung beanspruchen kann. Anderseits scheint die Offenheit der Zukunft, von der aus sich die Notwendigkeit einer Pädagogik allererst rechtfertigen lässt, in diesem Prozess bedacht und bewahrt werden zu müssen, um Heranwachsenden eine eigenverantwortliche Gestaltung ihrer Welt in Relation zu anderen zu ermöglichen. Letzteres scheint nun aber gerade gegen eine Überformung pädagogischer Kerngedanken durch gegenwartsbezogene starre Vorstellungen eines guten Lebens zu sprechen. Mit dem Aufzeigen dieses Dilemmas und der Analyse verschiedener Lösungsansätze vor dem aktuellen Hintergrund der Ungewissheit gesellschaftlicher Transformationsprozesse möchte der Text einen allgemeinpädagogischen Beitrag zur philosophischen Diskussion um das (kollektiv) gute Leben leisten. Psychiatric disorders like eating disorders might be underpinned by differences in decision making. However, little previous research has investigated this potential relationship using longitudinal data. This study aimed to understand how components of decision making measured by the Cambridge Gambling Task in the United Kingdom’s Millennium Cohort Study at age 11 might explain clusters/types of ED prodrome involving body dissatisfaction, intention to lose weight, dietary restraint, excessive exercise and significant under/overweight measured in the MCS at age 14. Latent class analysis (...) revealed two groups within the cohort: a non-prodromal eating pathology group, who were more likely to be of “average” weight, according to the UK90, with minimal disordered attitudes and behaviors in relation to eating and weight; and a second group with prodromal eating pathology, who had more body dissatisfaction, a desire to lose weight, were using dietary restriction and exercise to influence weight and were more likely to be “overweight” according to the UK90. Logistic regression showed that, after adjustment for confounding, higher risk-taking scores were associated with a 60% greater probability of being in the prodromal eating pathology group, and higher scores on quality of decision making were associated with a 30% lower probability of being in the prodromal eating pathology group. Helping young people to engage in moderate risk taking and improving decision making might reduce the later presence of ED prodromes. (shrink)

The authors examine several issues in teaching phenomenology (1) to advanced researchers who are doing qualitative research using phenomenological interview methods in disciplines such as psychology, nursing, or education, and (2) to advanced researchers in the cognitive neurosciences. In these contexts, the term “teaching” needs to be taken in a general and nondidactic way. In the case of the first group, it involves guiding doctoral students in their conception and design of a qualitative methodology that is properly phenomenological. In the (...) case of the second, it is more concerned with explaining the relevance of phenomenology to an audience of experimental scientists via conference presentations or published papers. In both cases, however, the challenge is to make clear to the relevant audience what phenomenology is and how it can relate to what they are doing. (shrink)

The first issue of _Artificial Intelligence and Law_ journal was published in 1992. This paper discusses several topics that relate more naturally to groups of papers than a single paper published in the journal: ontologies, reasoning about evidence, the various contributions of Douglas Walton, and the practical application of the techniques of AI and Law.

The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. Because the techno-economic paradigm of contemporary conceptualizations of innovation is often taken for granted in the literature, this chapter opens up this self-evident notion. First, the chapter consults the work of Joseph Schumpeter, who can be seen as the founding father of the current conceptualization of innovation as technological and commercial. Second, we open up the concept by reflecting on two aspects of Schumpeter’s conceptualization of innovation, namely its destructive and its constructive aspect, based on findings in the history of (...) innovation. Finally, we synthesize our findings and propose an ontic-ontological conceptualization of innovation as ontogenetic process and outcome with six dimensions—newness, political dimension, economic dimension, temporal dimension, human dimension and risk—that moves beyond its technological and commercial orientation. Research on brain or cognitive/affective processes, culture, social interaction, and structural analysis are overlapping but often independent ways humans have attempted to understand the origins of their evolution, historical, and contemporary development. Each level seeks to employ its own theoretical concepts and methods for depicting human nature and categorizing objects and events in the world, and often relies on different sources of evidence to support theoretical claims. Each level makes reference to different temporal bandwidths (milliseconds, seconds, minutes, hours, days, months, (...) years, decades, and centuries) and focuses on different spatio-temporal activities and controlled and non-controlled stimulus conditions. Biological mechanisms and environmental pressures for survival simultaneously created a gradual intersection and enhancement of cognitive/affective skills, cultural practices, and changes in collaborative social interaction and communicative skills. The evolution of a given level of analysis is assumed to have been incremental and overlapping. These innovative and independent ways humans have learned to characterize their brain or cognitive/affective and social/economic/political life often depend on unexamined, representational re-descriptions or cognitive/affective and socio-cultural devices and forms of communication that facilitate the depiction of practices and beliefs we attribute to respondents or subjects and research colleagues.
