O presente artigo objetiva compreender se o Judiciário pode vetar a implementação de uma Política Pública em decorrência dos parâmetros ideológicos sustentados pelo gestor público que a formatou. Para tanto, tomou-se como ponto de partida o seguinte problema de pesquisa: é possível que o Poder Judiciário proíba uma política pública a partir da ideologia desta? O trabalho foi dividido em três capítulos; o primeiro deles trazendo a discussão atinente ao pós-positivismo jurídico neste país; o segundo visando esclarecer a respeito do (...) conceito de ideologia; e o terceiro e último abordando o controle judicial sobre as chamadas escolas cívico-militares. Ao cabo, concluiu-se que a intromissão do judiciário nesta seara constitui-se em caso de ativismo judicial, que desvirtua e corrompe a separação dos poderes. O mandato político concedido ao gestor público concede a ele a liberdade de escolher a maneira como conduzirá suas ações, desde que constitucionais. The paper starts by distinguishing between two kinds of economic practice: theoretical economic practice (TEP) (model and theory building) and direct economic practice (DEP) (the practical operation upon real economies). Most of the epistemological and philosophical considerations have been directed to the first type of practice, one of whose main goals is the discovery of particular sorts of economic laws, mechanisms and other regularities which throw light on relevant economic patterns. We do not deny that in some restricted domains these (...) kinds of regularities may be found. Rather, we claim that the realm of economics is best understood as consisting of processes whose regular structure (if they have one at all) is not guaranteed beforehand but may be crucially influenced and successfully enforced by what we call DEP. We claim that (a) some economic processes are a particular type of social process that will be referred to as Expectations-Based Processes (EBP). Characteristically, an EBP shows a connection between the information that individuals receive from the relevant economic context, the expectations they form, and the actions they perform; (b) in those cases in which EBP exhibit a regular behaviour, they depend on agents' expectations and, crucially, we argue, on interventions upon them. Authorities as well as other economic actors may intervene to change agents' expectations (and therefore, their decisions), contributing to shape EBP and helping to produce the patterns that lead to some targeted economic phenomena. These features of EBP show that they are not shielded from external influences and they do not run autonomously once triggered. Therefore they cannot be conceived as mechanisms or as economic machines. Rather they are open-ended processes that require continuous prodding on the part of policy makers to keep them running in the intended way. (shrink)

O propósito deste artigo é o de pensar sobre uma estética a partir da filosofia de Gilles Deleuze e Félix Guattari. Trata-se de uma estética da imanência, ou seja, a filosofia deve pensar com a arte e não sobre a arte. Nesse sentido, em um primeiro momento, discutiremos como a filosofia inventa conceitos, em seguida, detalharemos o conceito de bloco de sensações como produto do encontro da filosofia com a arte. This paper presents reasons against semantic relativism. Semantic relativism is motivated by intuitions that are presumed to raise problems for traditional or contextualist semantics in contested domains of discourse. Intuition-based arguments are those based on competent speakers’ putative intuitions about seeming faultless disagreement, eavesdropper, and retraction cases. I will organize the discussion in three parts. First, I shall provide a brief introduction to the intuition-based arguments offered in favor of semantic relativism. Second, I shall indicate that there are ways for (...) contextualism to explain the (appearance of) intuitions that support semantic relativism. Concepts stand at the centre of human cognition. We use concepts in categorizing objects and events in the world, in reasoning and action, and in social interaction. It is therefore not surprising that the study of concepts constitutes a central area of research in philosophy and psychology, yet only recently have the two disciplines developed greater interaction. Recent experiments in psychology that test the role of concepts in categorizing and reasoning have found a great deal of variation, across individuals and (...) cultures, in categorization behaviour. Meanwhile, philosophers of language and mind have investigated the semantic properties of concepts, and how concepts are related to linguistic meaning and linguistic communication. A key motivation behind this was the idea that concepts must be shared across individuals and cultures. With the dawn of experimental philosophy, the proposal that the experimental data from psychology lacks relevance to semantics is increasingly difficult to defend. -/- This volume brings together leading psychologists and philosophers to advance the interdisciplinary debate on the role of concepts in categorizing and reasoning, the relationship between concepts and linguistic meaning and communication, the challenges conceptual variation poses to communication, and the social and political effects of conceptual change. In this essay, I consider an evolutionary debunking argument (EDA) that purports to undermine the epistemic justification of the belief in the reliability of our belief-forming processes, and an evolutionary vindicating argument (EVA) that seeks to establish that such a belief is epistemically justified. Whereas the EDA in question seems to fall prey to crippling self-defeat, the EVA under consideration seems to fall prey to vicious circularity. My interest in those arguments and the problems they face lies in what they (...) might tell us about the possibly aporetic nature of reason. For, if we take the EDA and the EVA in question to consist of true or plausible premises and valid inferences at which we arrive through a meticulous use of reason, then their falling victim to either crippling self-defeat or vicious circularity might be regarded as a sign that, when we push rational reflection on the reliability, or lack thereof, of our belief-forming capacities to the limit, we end up in a situation of aporia from which there seems to be no escape. We argue that political propaganda is a negative phenomenon, against a recent strain of philosophical theorizing that argues that political propaganda can sometimes be neutral or even positive. After an exploration of the sense and connotation of the word ‘propaganda’ in ordinary use and in the scholarly literature, we discuss Ross’s (2002) account of propaganda as an epistemically defective form of political communication. We claim that, with some refinements, it is an explanatorily useful analysis. We then assess two prominent attempts (...) that aim at classifying legitimate cases of public communication as cases of propaganda, namely Ross’s (2013) revision of her previous model, and Stanley’s (2015) influential account. We show that some of the cases in contention are problematic and that the arguments the authors offer for classifying other non-problematic cases as propaganda are inconclusive. El concepto de trastorno mental permite justificar intervenciones médicas, psicológicas y judiciales. Además, facilita a la/el consultante acceder a tratamientos mediante reembolsos o programas de salud pública, y por otro lado, podría conllevar estereotipos sociales. No obstante, el significado de dicho concepto no ha dejado de suscitar debate. En el presente artículo argumentaré que los trastornos de personalidad, tal como son definidos en el DSM-5, no cumplen con los criterios de patología de las propuestas principales (i.e. teoría bio-estadística de la (...) salud, disfunción dañina, o entidad patológica) debido a tres razones independientes: (i) no se han propuesto dis/funciones a la base de cada trastorno y, dado el estado del arte de la psicología evolucionista, es poco probable que se pueda llevar a cabo ese programa en el futuro; (ii) el concepto de daño (distrés, perjuicio) aplicable a los trastornos de personalidad es constitutivamente social (aunque no exclusivamente social), por lo que resulta más adecuado hablar de grados de discapacidad que de trastornos del individuo; y (iii) que la ausencia de condiciones patognomónicas para cada trastorno, junto a la elevada comorbilidad y multimorbilidad entre trastornos de personalidad, horada la validez de la nosología actual y de los diagnósticos diferenciales. Propondré como solución la eliminación de los trastornos de personalidad de la nosología psiquiátrica. Eliminar los trastornos de personalidad no equivale a desconocer el sufrimiento de las personas diagnosticadas, ni a ignorar que dicho sufrimiento precede a, –y no acaba con la disolución de– la etiqueta diagnóstica. Por ello, se propondrá una reconceptualización de dicho sufrimiento en términos de discapacidad, entendida desde el modelo social, y que no presupone patología. (shrink)

Puede decirse, sin ir demasiado lejos, que la obra del sociólogo francés de Pierre Bourdieu ha sido una de las más brillantes e imaginativas del panorma de las ciencias sociales en la segunda mitad del siglo XX. Este libro trata de sacar a la luz la forma en la que las herramientas de su sociología fueron creadas. No obstante, este texto no comienza con un realto de sus obras, sino de su vida. Pierre Bourdieu no nace intelectual, se hace en (...) un contexto que -en su caso, especialmente durante sus primeros años de su vida- tiene poco de tal. Se trata, pues, de una investigación histórica de la figura de un intelectual que evita dos caminos ya trillados: la vía externalista, que toma a los eventos históricos, sociales o económicos como fuente de toda explicación de la vida intelectual y científica, y la vía internalista, que cosidera que sus miembros viven en una esfera aislada y ajena a toda influencia exterior. Está última vía es la que se suele transitar cuando un pensador ha legado una obra que despierta admiración. Para ello, el autor emplea algunas de las ideas que Randall Collins delineo en su opus magnum Sociología de las filosofías, quizá uno de los libros que mejor ha sabido captar las dinámicas que gobiernan el mundo intelectual. Este capítulo introduce al lector a teorías contemporáneas sobre el lenguaje dañino, y su impacto político y social. Distinguiré entre las formas directas y las formas indirectas por medio de las cuales el lenguaje puede hacer daño. El discurso puede dañar directamente a través del insulto, el lenguaje despectivo o la deshumanización. Y puede perjudicar indirectamente, por ejemplo, al socavar normas sociales y morales de manera subrepticia. La presentación que haré aquí tendrá que ser concisa e incompleta. Utilizaré el caso (...) del lenguaje peyorativo o despectivo para ilustrar cómo el lenguaje puede ser directamente dañino, y propondré que el análisis defendido para el discurso despectivo se puede extender al discurso de odio. Utilizaré además los fenómenos de los silbatos de perro y las perversiones del significado para ilustrar cómo el lenguaje puede ser indirectamente dañino. Mucho del trabajo actual sobre los efectos perjudiciales del lenguaje se debe a escritos de filósofas como Rae Langton, y empezaré con un resumen de un artículo suyo para situar la discusión. Some authors have called into question the normativity of logic, using as an argument that the bridge principles for logical normativity (MacFarlane, In what sense (in any) is logic normative for thought, 2004 )? are just by-products of general epistemic principles for belief. In this paper, I discuss that suggestion from a formal point of view. I show that some important bridge principles can be derived from usual norms for belief. I also describe some possible ways to block this derivation (...) by modifying the epistemic norms or weakening the bridge principles. Reconstructing some of the experiences of people living with tuberculosis in Argentina in the first half of the twentieth century, as reflected not only in written and oral accounts but also in individual and collective actions, this article explores the ways in which patients came to grips with medical expertise in times of biomedical uncertainty. These negotiations, which inevitably included adaptations as well as confrontations, highlight a much less passive and submissive patient–physician relationship than is often assumed. Though patients were (...) certainly subordinate to medical doctors’ knowledge and practices, that subordination, far from absolute, was limited and often overthrown. The article focuses on patients’ demands to gain access to a vaccine not approved by the medical establishment. By engaging with media organizations, the sick invoked their “right to health” in order to obtain access to experimental treatments when biomedicine was unable to deliver efficient therapies. According to methodological anti-exceptionalism, logic follows a scientific methodology. There has been some discussion about which methodology logic has. Authors such as Priest, Hjortland and Williamson have argued that logic can be characterized by an abductive methodology. We choose the logical theory that behaves better under a set of epistemic criteria. In this paper, I analyze some important discussions in the philosophy of logic, and I show that they presuppose different methodologies, involving different notions of evidence and different epistemic values. (...) I argue that, rather than having a specific methodology such as abductivism, logic can be characterized by methodological pluralism. O presente artigo busca, a partir da filosofia de Michel de Montaigne, explicitar quais lições podemos aprender sobre o contexto de epidemia em que vivemos. Mas, afinal, aqui fica a pergunta fundamental deste texto: o que podemos aprender com um filósofo francês do século XVI, Michel de Montaigne, sobre esse momento tão devastador que estamos vivendo? É claro que Montaigne não nos dirá nada sobre a natureza do vírus, nem sobre nosso sistema imunológico, muito menos sobre metodologias de investigação científicas (...) para a procura de medicamentos para o tratamento da doença. O que Montaigne nos pode ensinar é algo de outra ordem, não da biológica, mas, da subjetiva. É uma (nova) disposição de nosso espírito que podemos aprender a desenvolver com o filósofo. (shrink)

This paper explores the notion of reciprocity in the context of active pulmonary and laryngeal tuberculosis treatment and related control policies and practices. We seek to do three things: First, we sketch the background to contemporary global TB care and suggest that poverty is a key feature when considering the treatment of TB patients. We use two examples from TB care to explore the role of reciprocity: isolation and the use of novel TB drugs. Second, we explore alternative means of (...) justifying the use of reciprocity through appeal to different moral and political theoretical traditions. We suggest that each theory can be used to provide reasons to take reciprocity seriously as an independent moral concept, despite any other differences. Third, we explore general meanings and uses of the concept of reciprocity, with the primary intention of demonstrating that it cannot be simply reduced to other more frequently invoked moral concepts such as beneficence or justice. We argue that reciprocity can function as a mid-level principle in public health, and generally, captures a core social obligation arising once an individual or group is burdened as a result of acting for the benefit of others. We conclude that while more needs to be explored in relation to the theoretical justification and application of reciprocity, sufficient arguments can be made for it to be taken more seriously as a key principle within public health ethics and bioethics more generally. South Africa shared with the world the warning of a new strain of SARS-CoV2, Omicron, in November 2021. As a result, many high-income countries (HICs) instituted complete travel bans on persons leaving South Africa and other neighbouring countries. These bans were unnecessary from a scientific standpoint, and they ran counter to the International Health Regulations. In short, South Africa was penalized for sharing data. Data sharing during pandemics is commonly justified by appeals to solidarity. In this paper, we argue that (...) solidarity is, at best, an aspirational ideal to work toward but that it cannot ground an obligation to share data. Instead, low-and-middle income countries (LIMCs) should be guided by the principle of reciprocity, which states that we ought to return good for good received. Reciprocity is necessarily a conditional principle. LMICs, we argue, should only share data during future pandemics on the condition that HICs provide enforceable assurances that the benefits of data sharing will be equitably distributed and that LMICs won’t be penalized for sharing information. Suppose that a team of neurosurgeons and bioengineers were able to remove your brain from your body, suspend it in a life-sustaining vat of liquid nutrients, and connect its neurons and nerve terminals by wires to a supercomputer that would stimulate it with electrical impulses exactly like those it normally receives when embodied. According to this brain-in-a-vat thought experiment, your envatted brain and your embodied brain would have subjectively indistinguishable mental lives. For all you know—so one argument goes—you could be (...) such a brain in a vat right now.1 Daniel Dennett calls this sort of philosophical thought experiment an “intuition pump” (Dennett 1995). An intuition pump is designed to elicit certain intuitive convictions, but is not itself a proper argument: “intuition pumps are fine if they’re used correctly, but they can also be misused. They’re not arguments, they’re stories. Instead of having a conclusion, they pump an intuition. They get you to say ‘Aha! Oh, I get it!’ (Dennett 1995, p. 182). Philosophers have used the brain-in-a-vat story mainly to raise the problem of radical skepticism and to elicit various intuitions about meaning and knowledge (Putnam 1981). The basic intuition the story tries to pump is that the envatted brain, though fully conscious, has systematically false beliefs about the world, including itself. Society increasingly demands corporations to be accountable for their past misbehaviours. Some corporations engage in forgetting work with the aim of avoiding responsibility for their wrongdoings. We argue that whenever social actors have their past actions called into question and engage in forgetting work, an ethics of remembering takes place. A collective project of social forgetting is contingent on the emergence of coordinated actions among players of an industry. Similarly, sustained efforts of forgetting work depend on the continuity of the (...) project through various generations of employees, which presumes the existence of frameworks of remembering in place. We analysed this paradox through a historical case study of the U.S. tobacco industry. We conclude that forgetting work may be a double-edged sword. It might be beneficial in the short run, to the extent that corporations can successfully maintain the public ignorance about their deceitful pasts. In the long run, however, it creates additional layers of historical irresponsibility and may turn into a compounded liability in the event the memory of the collective strategy of social forgetting becomes public. Procuro mostrar por primeiro, como os temas propostos por Elisabeth se inscrevem no cerne mesmo do caetesianismo, na medida em que uma de suas preocupações era o modo de relação entre aIma e o corpo. Em seguida, será visto como se estabelece nesta correspondência uma reflexão moral com traços estoicos, mas que não prescinde de uma técnica médica, realizando, (...) assim, a totalidade do projeto cartesiano, que se quer comparado à sabedoria, que não dispensa a metáfora da árvore com raízes, tronco, galhos e frutos bem determinados. BREVES PONDERAÇÕES ACERCA DO INSTITUTO DA DELAÇÃO PREMIADA APÓS A LEI Nº 12.850/2013.

O artigo apresenta reflexões teóricas sobre a atividade de ensino que se torna práxis bem-sucedida. Essa discussão gira em torno de duas categorias teóricas: atividade e afetação. A atividade, categoria teórica de base marxista, é discutida a partir dos aportes da psicologia sócio-histórica. A categoria afetação é aqui analisada com base na filosofia de Baruc de Espinosa. Realizamos este estudo a partir de pesquisa bibliográfica que tem como objetivo refletir sobre o que contribui para que o professor consiga realizar um (...) ensino capaz de afetar com alegria seus alunos levando ao desenvolvimento de uma práxis bem-sucedida. A pesquisa bibliográfica é realizada a partir dos teóricos da psicologia sócio-histórica, sobretudo Vygotsky e Leontiev. Da filosofia de Espinosa pesquisamos a obra Ética. Os resultados revelam que professores e alunos são sujeitos que se constituem historicamente, a partir de múltiplas mediações. Significados, sentidos e afetações são parte das mediações que constituem professores e alunos envolvidos em atividades de ensino consideradas exitosas. O estudo aprofundado acerca dessas categorias poderá contribuir de forma determinante para que o ensino, como atividade social que se realiza entre pessoas, possa tornar-se um encontro alegre, gerador de afetos que potencializem desejos e aumentem a potência de agir e pensar de professores e alunos, fato que contribui para a emancipação humana.
