El término '"Dialéctica" hace referencia tanto al movimiento de autodesenvolvimento del concepto - en este caso el de derecho y, em sentido amplio - como a la estrutura de ese movimiento, al cual Hegel trata de encuadrar en esquemas provenientes de la Lógica dei concepto, especialmente en la triada 'tesis - antítesis - síntesis', lo cual potencia la complejidad dei texto y dificulta su comprensión. Uma hermenéÚtica esclarecedora de la lógica dialéctica en juego, donde a la contradicción!e cabe el papel (...) protagónico, exige tener en cuenta estos aspectos como también e: hecho de que Hegel, en su concepción de la Dialéctica asume la herencia de la filosofia aristotélica, tanto como del Idealismo Trascendental moderno, los que se entremezclan permanentemente en intrincada red de múltiples significaciones. La distinción de todos estas aspectos y de su rol en la exposición de la Filosofia del Derecho es imprescindible, tanto para una interpretación adecuada de su letra y espíritu, como de su significación actual. This paper argues that patients' duties are derivable from the idea which typically grounds the idea of patients' rights: patient autonomy. The autonomous patient, joined in partnership with the health care professional, has self-regarding obligations and obligations to others, including health care professionals. Patients' duties include, but are not limited to: a duty to be honest about why the patient seeks care; a duty to collect information on available treatments and likely side-effects; a duty for a patient who has an (...) infectious condition to act on that information which can best prevent further transmission. Ziel der Abhandlung ist die Untersuchung der grundlegenden Prinzipien einer autonombiologischen Kausalität. Wenn die Biologie in autonomer Weise auf ihr gemässe Prinzipien gegründet werden soll —wie das die Physik in ihrer Sphäre auch durchgeführt hat —, dann muss das biologische Denken sich zunächst von einem Idol befreien, das ihr von der klassischen Physik aufgezwungen ist. Das ist der Begriff des „Mechanismus”, der bei seiner Schaffung gewiss von grossem Werte auch für die Biologie gewesen ist, der aber heute dem biologischen Denken (...) grossen Schaden dadurch zufügt, dass er es in eine ihm völlig fremde Richtung zwängt.Die Organismen und alle ihre Organe von der einfachsten Zellorganelle bis zum komplexesten Organsystem sind aber keine Mechanismen sondern Holismen . Es wird versucht, die wesentlichen Kriterien des Holismusprinzips zu bestimmen. Zunächst gilt für sie das Axiom von v.Ehrenfels, demzufolge jeder Holismus „mehr ist als die Summe seiner Teile”. Das wird im einzelnen genauer analysiert. Weiterhin gilt für Holismen das Kompensationsprinzip vonGoethe. Damit im Zusammenhang stehen die Prinzipien der „spezifischen Energie” vonJohannes Müller, das Prinzip vonRedi , das Prinzip vonVernadsky über die Konstanz der Biosphäre, das Prinzip der phylogenetischen Kompensationen und das Prinzip von der „Ektropie” der Biosphäre.Alle diese Prinzipien werden im einzelnen diskutiert und analysiert. In engstem Zusammenhang miteinander bilden sie ein autonomes Axiomengefüge für die Biologische Erkenntnis, durch welches wiederum die eigentümlich „biologische Kausalität” charakterisiert ist. Genau in diesem Sinne sind Holismen „verae causae” .El presente ensayo tiene por fin supremo la investigación de los principios basicos de una autónoma causalidad biologica. This paper addresses two related topics: 1. The disanalogies between elective cosmetic practices and sex reassignment surgery. Why does it seem necessary for me – an aging professional woman – to ignore the blandishments of hairdressers wielding dyes and dermatologists wielding acids and scalpels? Why does it not seem equally necessary for a transgendered person to repudiate sex reassignment procedures? 2. The role of the body in identity and agency. How do phenomenological insights regarding the constitution of selfhood in relation (...) to the interplay between the body image and corporeal know-how contribute to an account of the agency of transgendered individuals? Studying several paintings by contemporary feminist artist Jenny Saville has advanced my thinking on these topics. Saville’s imagery is an invaluable aid to reflection on these issues because she uses her painterly technique, which critics often dub “virtuoso,” to represent lived human bodies. In her work, viewers encounter representations of subjectivized, agentic corporeity, as distinct from inert, objectified flesh. Moreover, her sympathetic engagement with nonconformist, devalued bodies helps to reconfigure the standard gestalts of the human body that viewers typically carry with them and thus to convert fear and/or disgust into appreciation and understanding. In this paper, I consider three of Saville’s paintings. Plan, Saville’s self-portrait as a nude female whose body has been prepped for liposuction, conveys the pathos of this procedure. Matrix is a nude portrait of self-described “gender variant visual artist” Del LaGrace Volcano. In the words of one critic Saville’s depiction of Volcano’s nude intersexed body “restores beauty to the primitive [female] genital organ.” Passage, another nude portrait of an intersexed individual, is an image of vibrant sexuality despite the presumptively jarring juxtaposition of breasts and a penis. I argue that conceiving the agentic subject as a rational deliberative capability that uses a conjoined body as the instrument of its will makes it impossible to theorize the agency of transgendered people. In contrast, when agentic subjects are understood as embodied subjects and embodiment is understood as a dimension of practical intelligence, the agency of transgendered individuals is intelligible. Hume presenta su teoría estética en el ensayo Sobre el criterio del gusto [On the Standard of Taste], en el que propone la existencia de un criterio [standard] capaz de zanjar discusiones de gusto. Ese criterio se basa en la existencia de ciertas formas y cualidades que complacen naturalmente a todo ser humano. Hume asevera que tal criterio corresponde a la opinión del crítico: un hombre que ha desplegado particularmente sus facultades cognoscitivas, lo cual le permite percibir esas finas cualidades (...) que suscitan naturalmente el placer de lo bello en el ser humano. Con respecto a en qué consisten esas formas y cualidades universalmente placenteras, Hume guarda silencio. Pretendo mostrar cómo la teoría de la emoción en la música desarrollada por Leonard Meyer en su texto Emoción y significado en la música (Emotion and Meaning in Music) puede aportar inmensidades en ese aspecto. This paper explores the relationships between American phenomenology of music and conventional studies of musical analysis. The temporality of experience is a central topic in the phenomenology of music: recent research in USA has focused on musical time-consciousness (Schutz and Smith) or on analytical applications (Clifton, Lochhead, Ferrara). Many methods of musical analysis, like phenomenological methods, are concerned to study subjective temporal structures: Schenkerian and post-Schenkerian scholars (Salzer, Meyer, Narmour, Lewin) have elaborated specific systems for the explanation of musical (...) form on a experiential basis. Apart from any comparison with the different approaches, phenomenological analysis appears to be fundamental for the analytical interpretation of music. (shrink)

En este artículo de investigación se muestra, que durante la fabricación de hierro, las escorias han sido una fuente información del producto obtenido. Esto aplica a toda la historia de la fabricación de este metal desde el inicio de la edad del hierro. Los estudios en este campo se conocen como arqueo de metalurgia y se inicia desde la paleo metalurgia hasta el presente. Las escorias primitivas obtenidas a partir de su separación de la masa de hierro sólida obtenidas en (...) procesos muy primitivos y más modernas como la forja catalana. Estudios petrográficos, de difracción de rayos X y de fluorescencia de rayos x, han revelado la existencia fayalita, en escorias siderometalúrgicas antigüas a temperaturas por debajo del punto eutéctico,deducidas como entre 1150°C y 1200°C. Más recientemente, la presencia de fayalita ha sido revelada en procesos de reducción operando con temperaturas menores a los 900°C. En este documento se presenta una explicación para tal hecho mediante un análisis de las energías asociadas a los sistemas. Cerámicos compuestos de FeO- SiO2-MgO- P2O5 presentes en dichos procesos. Enactivists frequently argue their account heralds a revolution in cognitive science: enactivism will unseat cognitivism as the dominant paradigm. We examine the lines of reasoning enactivists employ in stirring revolt, but show that none of these prove compelling reasons for cognitivism to be replaced by enactivism. First, we examine the hard sell of enactivism: enactivism reveals a critical explanatory gap at the heart of cognitivism. We show that enactivism does not meet the requirements to incite a paradigm shift in the (...) Kuhnian sense—there is no internal crisis in cognitivism. Nor does it provide inherently better explanations of cognition as some have claimed. Second, we consider the soft sell of enactivism: enactivism provides a more attractive, parsimonious, or clear-eyed lens on cognition. This move proves to boil down to a misunderstanding of how theories are selected in science. Instead we lend support to a broader and more desirable way to conceive of enactivism, the recent proposal that enactivism is a philosophy of nature. We explain how a philosophy of nature does more than support a single research paradigm by integrating scientific questions into a cohesive picture. (shrink)

This article investigates the meaning of doing good and doing well in positive business. It examines the relationship between the two expressions and discusses their relevance, shedding new light on the significance of ‘positive’ in positive business and positive organizational scholarship. Thus, this article illuminates the ultimate end of positive states and practices. ‘Positive’ primarily represents values and assumptions. These lead to the creation of beneficial situations and marked improvements, which put individuals and organizations on an upward trajectory toward achieving (...) excellent functioning, assuring profitability in addition to sustainability and social well-being. Doing well, with reference to economic performance and profits, is partly constitutive of doing good. This presents a new approach regarding the role of economic outcomes in positive business and POS. It means that financial criteria do not have priority. Profits are considered vital and necessary, but the final ‘raison d'être’ of positive states and practices is the overall well-being of the stakeholders. (shrink)

The purpose of this paper is to formulate first-order Peano arithmetic within the resources of relevant logic, and to demonstrate certain properties of the system thus formulated. Striking among these properties are the facts that it is trivial that relevant arithmetic is absolutely consistent, but classical first-order Peano arithmetic is straightforwardly contained in relevant arithmetic. Under, I shall show in particular that 0 = 1 is a non-theorem of relevant arithmetic; this, of course, is exactly the formula whose unprovability was (...) sought in the Hilbert program for proving arithmetic consistent. Under, I shall exhibit the requisite translation, drawing some Goedelian conclusions therefrom. Left open, however, is the critical problem whether Ackermann’s rule γ is admissible for theories of relevant arithmetic. The particular system of relevant Peano arithmetic featured in this paper shall be called R♯. Its logical base shall be the system R of relevant implication, taken in its first-order form RQ. Among other Peano arithmetics we shall consider here in particular the systems C♯, J♯, and RM3♯; these are based respectively on the classical logic C, the intuitionistic logic J, and the Sobocinski-Dunn semi-relevant logic RM3. And another feature of the paper will be the presentation of a system of natural deduction for R♯, along lines valid for first-order relevant theories in general. This formulation of R♯ makes it possible to construct relevantly valid arithmetical deductions in an easy and natural way; it is based on, but is in some respects more convenient than, the natural deduction formulations for relevant logics developed by Anderson and Belnap in Entailment. Mechanistic explanations are often said to explain because they reveal the causal structure of the world. Conversely, dynamical models supposedly lack explanatory power because they do not describe causal structure. The only way for dynamical models to produce causal explanations is via the 3M criterion: the model must be mapped onto a mechanism. This framing of the situation has become the received view around the viability of dynamical explanation. In this paper, I argue against this position and show that dynamical (...) models can themselves reveal causal structure and consequently produce nonmechanistic, dynamical explanations. Taking the example of cell fates from systems biology, I show how dynamical models, and specifically the attractor landscapes they describe, identify the causes of cell differentiation and explain why cells select particular fates. These dynamical features of the system better fit Woodward’s (2010, 2018) criteria of specificity and proportionality and make them the best candidate causes of cell fates than mechanisms. I also show how these causes are irreducible and inaccessible to mechanistic models, making 3M unworkable and counterproductive in this case. Dynamical models can reveal dynamical causes and thereby provide causal explanations. (shrink)

Fara and Williamson (Mind, 2005) argue that counterpart theory is unable to account for modal claims that use an actuality operator. This paper argues otherwise. Rather than provide a different counterpart translation of the actuality operator itself, the solution presented here starts out with a quantified modal logic in which the actuality operator is redundant, and then translates the sentences of this logic into claims of counterpart theory.

The thought that human embryos could command moral respect yet also be acceptably used in medical research has struck some as incoherent. Given some assumptions about why they deserve respect, however, the thought is not objectionable, indeed not even unusual.

Se parte de la distinción entre los diferentes niveles de interpretación que Spinoza aplica al texto sagrado, y que pueden resumirse en dos: el histórico-filológico y el filosófico. A continuación, se intentan determinar las relaciones entre estos diferentes niveles, y asimismo las diferencias de la propuesta spinoziana frente a otras propuestas interpretativas, en particular, la Philosophia S. I attempt to clarify the specificity of Spinoza’s hermeneutic proposal of the Scripture in the Political-Theological Treatise. In this regard, I assume two levels of analysis in Spinoza interpretation: the historic-critical and the philosophical one. My aim is to find out the relationships between these two levels, and also the differences of Spinoza’s interpretation with others, in particular, that one developed by Lodewijk Meyer in his Philosophia S. Scripturae Interpres.

Si tratta di una vicenda che presenta i motivi fondamentali di ogni racconto epico e tragico. Ispirandosi a questa convinzione l’articolo ripercorre alcune delle maggiori opere letterarie che hanno raccontato da diversi punti di vista lo scontro tra Becket e il (...) suo re: alcune delle agiografie medievali, Alfred Tennyson, Conrad Ferdinand Meyer nel XIX secolo, e – nel XX – Thomas Stearns Eliot, Christopher Fry e Jean Anouilh. Del _vero_ Tommaso Becket è assai difficile riuscire a farsi un’idea precisa, mentre sembra realizzarsi la grande metafora, proposta da Giovanni di Salisbury, suo stretto collaboratore, della vita e della storia come rappresentazione teatrale in cui hanno importanza decisiva solo i ruoli che gli uomini sono chiamati a interpretare. _In the Middle Ages, so often depicted in literature as a great adventure novel, a very special place belongs to the story of Thomas Becket, firstly chancellor of King Henry II and later Bishop of Canterbury, murdered in his cathedral in 1170. _ _This episode presents the fundamental motifs of every epic and tragic tale. Inspired by this conviction, this article examines some of the most significant literary works that have described the conflict between Becket and his king from different points of view: some of the medieval hagiographies, Alfred Tennyson, Conrad Ferdinand Meyer in the 19th century, and – in the 20th – Thomas Stearns Eliot, Christopher Fry and Jean Anouilh._ _It is very difficult to get a precise idea of the _real_ Thomas Becket, while the great metaphor proposed by John of Salisbury, his close collaborator, of life and history as a theatrical representation in which only the roles that men are called to play are of decisive importance, seems to have been realized._. Currently living people cannot be said to be wronged because of the wrongless emissons of greenhouse gases by past people. According to the usual subjunctive-historical understanding of harm, currently living people cannot be said to be harmed by the impact of greenhouse emissions on their well-being. By relying on a subjunctive-threshold notion of harm we can justify conclusions about both the present generation’s duties not to violate the rights of future generations, and the present generation’s duties to compensate currently living (...) people for the harms inflicted upon them through the lasting impact of wrongless past harms. This interpretation supports a forward-looking understanding of the grounds of our relating to wrongless past harms. The significance of past harms lies in their consequences for the well-being of currently living and future people. The subjunctive-threshold notion of harm lends support to a standard of minimal, general, and universal justice. Those actors who are in a position to fulfill its requirements are under a duty to do so. Especially the rich and powerful countries ought to counteract the harmful impact of past greenhouse emissions. (shrink)

This paper argues that modal realism has a problem with mathematical impossibilities. Due to the peculiar way it treats both propositions and mathematical objects, modal realism cannot distinguish the content of different mathematically impossible beliefs. While one might be happy to identify all logically impossible beliefs, there are many different mathematically impossible beliefs, none of which is a belief in a logical contradiction. The fact that it cannot distinguish these beliefs speaks against adopting modal realism.

According to Hans Kamp and Frank Vlach, the two-dimensional tense operators “now” and “then” are ineliminable in quantified tense logic. This is often adduced as an argument against tense logic, and in favor of an extensional account that makes use of explicit quantification over times. The aim of this paper is to defend tense logic against this attack. It shows that “now” and “then” are eliminable in quantified tense logic, provided we endow it with enough quantificational structure. The operators might (...) not be redundant in some other systems of tense logic, but this merely indicates a lack of quantificational resources and does not show any deep-seated inability of tense logic to express claims about time. The paper closes with a brief discussion of the modal analogue of this issue, which concerns the role of the actuality operator in quantified modal logic. (shrink)

Mechanistic explanations, according to one prominent account, are derived from objective explanations (Craver 2007, 2014 ). Mechanistic standards of explanation are in turn pulled from nature, and are thereby insulated from the values of investigators, since explanation is an objectively defined achievement grounded in the causal structure of the world (Craver 2014 ). This results in the closure of mechanism’s explanatory standards—it is insulated from the values, norms and goals of investigators. I raise two problems with this position. First, it (...) relies on several ontological claims which, while plausible, fail to guarantee the objectivity of mechanistic explanatory standards to the degree of certainty required. Second, Craver’s position itself introduces a value–laden explanatory standard—the 3M requirement (Kaplan & Craver 2011 )—which undermines the closure of explanatory standards. I show how in practice mechanistic explanation is in part guided by explanatory taste, shorthand for background contextual values that influence our standards of explanation. Mechanism often has a particular pragmatically-oriented taste for control, and gerrymanders explanatory standards in order to obtain it. I conclude by arguing that objectivity, rather than being obtained through the right set of explanatory standards, is better thought of as the result of processes of intersubjective criticism, which renders visible the contextual values of communities of investigators and allows them to be controlled for (Longino 1990 ). Epistemic entrenchment, as presented by Gärdenfors and Makinson (1988) and Gärdenfors (1988), is a formalisation of the intuition that, when forced to choose between two beliefs, an agent will giveup the less entrenched one. While their formalisation satisfactorilycaptures the intuitive notion of the entrenchment of beliefs in a number ofaspects, the requirement that all wffs be comparable has drawn criticismfrom various quarters. We define a set of refined versions of theirentrenchment orderings that are not subject to the same criticism, andinvestigate (...) the relationship between the refined entrenched orderings,the entrenchment orderings of Gärdenfors and Makinson, and AGM theorycontraction (Alchourrón et al., 1985). Psychological essentialism is a folk theory characterized by the belief that a causal internal essence or force gives rise to the common outward behaviors or attributes of a category's members. In two studies, we investigated whether 4- to 7-year-old children evidenced essentialist reasoning about heart transplants by asking them to predict whether trading hearts with an individual would cause them to take on the donor's attributes. Control conditions asked children to consider the effects of trading money with an individual. Results (...) indicated that children reasoned according to essentialism, predicting more transfer of attributes in the transplant condition versus the non-bodily money control. Children also endorsed essentialist transfer of attributes even when they did not believe that a transplant would change the recipient's category membership. This finding runs counter to predictions from a strong interpretation of the “minimalist” position, an alternative to essentialism. (shrink)

A familiar interpretation of the Stoic doctrine of the πάθη runs as follows: The Stoics claim the πάθη are impulses. The Stoics take impulses to be causes of action. So, the Stoics think the πάθη are causes of action Premise is uncontroversial, but the evidence for needs to be reconsidered. I argue that the Stoics have two distinct but related conceptions of ὁρμή – a psychological construal and a behavioural construal. On the psychological construal is true, but there is strong (...) evidence that is true only on the behavioural construal. That is, when the Stoics classify πάθη as impulses they are thinking of them not as impulses to act, but as cases of action in their own right. (shrink)

In South Africa, ideas around fatherhood, parenthood and family life are greatly shifting as people find themselves caught up between traditional and contemporary understandings of fatherhood and motherhood. Even though more than 70% of young South Africans stated in a national survey that parenthood is one of the top four defining features of adulthood, father absence is on the increase. Some in-depth literature study was conducted regarding South African research on fatherhood and father absence, and the role of both Christian (...) churches and secular organisations in addressing some of these challenges brought on by rapidly growing figures of father absence. The article concludes with some suggestions on the development of a new paradigm in understanding fatherhood in South Africa, with special reference to the role of Christian churches in assisting men to construct a narrative around fatherhood, which will lead to satisfying relationships with their children, their partners and especially with God. The author uses an intersectionality framework to examine how lesbian, gay, bisexual, and transgender people evaluate the severity of their violent experiences. Previous research focusing on the severity of anti-LGBT violence has given relatively little attention to race, class, and gender as systems of power. In contrast, results from this study, based on 47 semi-structured, in-depth interviews, reveal that Black and Latino/latina respondents often perceived anti-queer violence as implying that they had negatively represented their racial communities, whereas white respondents typically (...) overlooked the racialized implications of their violent experiences. Furthermore, while lesbians of color emphasized their autonomy and self-sufficiency to challenge this discourse, Black and Latino gay men underscored their emotional and physical strength to undermine perceptions that they were weak for identifying as gay. Results also indicate that LGBT people experience forms of anti-queer violence in different ways depending on their social position, as Black lesbians faced discourse that neither white lesbians nor Black gay men were likely to confront. Thus, these findings suggest that topics primarily associated with homophobia should be examined through an intersectional lens. (shrink)
