The best way to divide control over children’s education between private and state authorities is unclear. This task has ethical implications that this thesis explores—in the context of a pluralist liberal democracy. In cases where authority over children’s education is granted to private groups, like ethnic or religious minorities, rights are often part of the default vocabulary adopted by politically liberal commentaries. These rights are often viewed as a shield that offers the group immunity from state interference. Some illiberal minority (...) groups argue that they need to be shielded from state interference because the persistence of their cultural or religious identity depends on it. For example, the Amish community in Wisconsin argued in Wisconsin v. Yoder that the future of their community would be jeopardized if they were forced to send their children to school beyond the age of fourteen. While a rights-based approach does explain many of the variables connected with cases like these, the explanation is incomplete. I will offer two clarifications to the rights-based view. First, in the event that a minority group is shielded from state interference, it is not clear that it would be morally legitimate for the group to take over the authority of the state. I will, then, offer a plausible theory that could justify the self-governing authority of minority groups in these situations. My second clarification is that the concept of individual autonomy, often the central liberal value protected by rights, is too broad to support a zero-tolerance approach toward illiberal groups. This indicates that illiberal minority groups might still have a claim to self-governing authority even though they arguably interfere with the autonomy of their children. Some interference with minor elements of individual autonomy should arguably be tolerated in cases where the ruination or assimilation of the group’s unique culture or religion is at stake. (shrink)

Granted, our object of inquiry may look beyond the present toward what Ruth Levitas terms the Imaginary Reconstruction of Society, but we are still workers in what Darren Webb calls the “corporate-imperial” university.1 Webb argues that within the university we can at (...) best protect “bolt holes, breathing spaces, and places of refuge” that can function as “fleeting, transitory, small-scale experiences of utopian possibility.” As academics, our greater value to utopian politics therefore involves using our “knowledge and resources... in the service of a collaborative process of memory- and story-making, pulling together disparate inchoate dreams and yearnings in order to generate a utopian vision that can help inform, guide, and mobilize long-term collective action for systemic change.”2 Such work uses resources and the products of labor within the academy in the service of ends beyond and at times against it. In other words, utopianism within the academy is necessarily complicit in the academy’s constitutive material relations, but it can also be oppositional in intellectual and—more importantly—activist senses to the academy’s ideological form. In other words, whether or not a given [End Page 517] project in the field of utopian studies is politically utopian does not depend on its material basis (i.e., how it is funded) so much as its content, in the senses of both the work that it does and the ways in which it captures and mobilizes available resources. Hence it is possible to imagine both regressive and emancipatory research projects in our field that capture or co-opt additional resources, including both internal and external funding. It is, however, a mark of emancipatory projects that they will use these resources to the ends Webb describes.Implicit in Webb’s argument is an acceptance that politically useful utopian work should be socially engaged beyond the confines of the university campus. However, engaging in utopian politics from within inegalitarian university structures (via what is institutionally termed “outreach” and “engagement” work) should be pursued with caution. Even researchers and educators acting in good faith can easily end up exploiting or causing damage to social movements, support groups and activists. Good allyship and effective support cannot be reduced to institutional mechanisms like ethics committee compliance or equality, diversity and inclusivity (EDI) initiatives, even when these go beyond “lip service” to become meaningful acts.3 For projects involving external collaborators with a connection to the sort of “long-term, collective action” Webb describes, research design must walk a tightrope between being supportive of utopian politics beyond the university and responding to instrumental pressures within it.Here I suggest as an academic field utopian studies is at least a little special as it mediates dialectically between theory and practice at one level while developing a conceptual framework of the dialectic between theory and practice at another. Within what Richter et al term “the paradox of universities as colonizing and liberatory spaces for community engagement and activism” the utopian method is well placed to ask questions about how we engage with the given conditions of the academy, including competitive research funding grants.4 I begin below with a discussion of the relationship of theory and academic work to the social with reference to utopian theory and then apply this to questions about our wider complicity within a discursive regime I term “academic excellence.” I argue this regime is central to the “prestige economy” upon which some of the structural inequalities of our sector are based. I conclude by suggesting that working within the constraints of the given while remaining orientated toward utopian politics in an ethical manner requires close attention to how we navigate the relationship between utopian theory and political practice. Nash Teaching about Ferguson: An Introduction This forum was organized around the idea of asking feminist scholars to reflect on the practice of teaching about racial violence as well as on the experiences of teaching in the midst of racial violence. What do feminist pedagogies centered on Ferguson and (...) its aftermath look like? How do we present the various forms of violence—including state action (in the case of murder) and state inaction (in the case of nonindictments)— that produce and uphold the conditions that mark the current situation? How do we bring our feelings about this moment into our classrooms, and how do we do this feeling-teaching in ways that attend to the fact that feminist scholars are endlessly called on to perform affective labor and also that racialized and gendered bodies’ affects are policed inside and outside of the academy? What happens if we refuse the composure that faculty bodies are supposed to perform and enact grief, rage, or sadness? What happens if we refuse performing anything but exhaustion, numbness, or a protective desire to shield our bodies from our students’ scrutiny or curiosity? Nash the Department of Justice’s recommendation not to bring civil rights charges against the officer, Darren Wilson. “Ferguson” has also become shorthand for a number of lives that ended violently, often at the hands of the state: Eric Garner, Oscar Grant, Trayvon Martin, Tarika Wilson, Tanisha Anderson, Renisha McBride, and Tamir Rice, to name a few. “Ferguson,” then, has become a keyword around which scholars organize conversations about legal murders, the variety of laws that regard property more than black life (so-called stand-your-ground laws, for example), racial profiling, stop and frisk, mass imprisonment, the death penalty, and the racial logics of systems of value that ensure that racially marked bodies are, in Lisa Marie Cacho’s words, “ineligible for personhood.”1 The scholars included in this forum capture the expansive ways that we, as scholars and educators, articulate the meanings of this moment and the ways that we situate Brown’s death in the conditions of the unfolding present. The scholars included in this forum also powerfully ask about the possibilities for activism in the wake of Ferguson(s) and the powerful coalitions that have formed in the wake of Ferguson(s). If “Black Lives Matter” (and #blacklivesmatter) and “I Can’t Breathe” have become refrains that respond to the violence of the present by making visible black pain, the scholars included here voice the possibilities these movements might open up. The relation between the individual and history is as central to the thought of Kierkegaard as it is to political philosophy as a whole. In the present age, does the individual create history or does history create the individual? These questions are also central to Theodor Adorno, who took aim at Kierkegaard for ignoring the historical and social constraints that inhibit the freedom of the individual. Adorno’s Kierkegaard offers only dogmatic faith and abstract individualism without providing any rational, liberating challenge (...) to oppression. Yet Adorno’s interpretation of Kierkegaard is undermined by his uncritical embrace of the dualism of reason and faith as well as his celebration of Socrates as the true individual critic of power. Adorno ironically ignores Kierkegaard’s own exposure of Socratic rationalism as the fatal pathway towards accepting oppression, just as he fails to comprehend Kierkegaard’s idea of the “religious” individual as the true opponent of both religious and secular tyranny. In this important new study, Hamilton establishes and develops innovative links between the sites of postcolonial literary theory, the fiction of the South African/Australian academic and Nobel Prize-winning writer J.M. Coetzee, and the work of the French poststructuralist philosopher Gilles Deleuze. Centering on the key postcolonial problematic of representation, Hamilton argues that if one approaches the colonial subject through Gilles Deleuze’s rewriting of subjectivity, then a transcendent configuration of the colonial subject is revealed. Importantly, it is this rendition of the (...) colonial subject that accounts best for the way in which the colonial subject is able to propose and offer instances of resistance to colonial structures of subjectification. In elucidating this claim, the study turns to the fiction of Coetzee. Ssu-ma Ch'ien's hih chi is one of the most influential of Chinese histories, but its organization reflects a historiography quite different from that of traditional Western history. Ssu-ma divided his account of the past into five overlapping sections: basic annals , chronological tables, treatises, hereditary houses , and biographies. One result of this fragmented arrangement is that stories may be told more than once, from different perspectives, and these accounts may not be entirely consistent. From a Western perspective this would (...) seem to indicate a certain disregard for the truth, but in many hih chi passages Ssu-ma Ch'ien demonstrates a passionate concern for accuracy.In this article I examine in detail one typical set of multiple narrations--the five versions of Wei Pao's defection in c. 205 B.C.--and argue that in some ways Ssu-ma's conflicting accounts reflect the past more accurately than the unified narrative we expect from Western histories. Although Ssu-ma's methods might seem amenable to the constructivist theories of Louis Mink and Hayden White, in the end this type of analysis is inadequate to explain a work which is rooted in a non-Western tradition of historiography. Ssu-ma Ch'ien's own conception of history recognized the limitations of historians and evidence, held out the possibility of multiple interpretations, and focused on moral insight. It is a mix unfamiliar to Westerners, but it does provide a coherent picture of Ssu-ma Ch'ien's historical methodology, and it may serve as an interesting example for modern historians who seek to escape traditional modes of historical writing. In understanding the meaning of the West, twentieth‐century political philosophers Hannah Arendt and Leo Strauss called for a return to “Athens” (classical political philosophy) in order to address the “crisis of the West,” a loss of a sense of legitimate and stable political authority which, in their view, constitutes a nihilistic threat to Western democracy. The only way for the West to escape this nihilistic crisis is to return to Plato and Aristotle. Implicit in this critique is the belief that (...) the other tradition of the West, “Jerusalem” (the Bible) has contributed to this nihilism, by undermining the authority of the Greeks. Is Jerusalem, then, the fatal “Other” for the West? Which tradition—Athens or Jerusalem—is best prepared to alleviate the crisis of the West, especially the survival of democracy? As I address these questions, I shall contend that it is Jerusalem, not Athens, which is the true source of Western democracy. (shrink)

What Shakespeare reveals in Macbeth is the all too human temptation to embrace tyranny. In exposing this temptation, however, Shakespeare also shows that the alleged inevitability of tyranny is a contradictory illusion that cannot survive the cycle of violence that it spawns. In comparable terms Abraham Lincoln exposed the tyranny of slavery as the hypocritical mockery of democracy which threatened the very survival of the American republic. Instead of teaching an illusory and despairing resignation to the tyrannies that plague human (...) history, however, both Shakespeare and Lincoln defend a biblical standard of hope and justice (for all human beings) that is the very opposite of tyrannical illusions. According to prevailing opinion, if a creaturely act is caused by God, then it cannot be free in the libertarian sense. I argue to the contrary. I distinguish intrinsic and extrinsic models of divine causal agency. I then show that, given the extrinsic model, there is no reason one holding that our free acts are caused by God could not also hold a libertarian account of human freedom. This paper argues that corporate governance reformers in Anglo-American jurisdictions should consider a different approach in their quest for better corporate governance. Traditionally, corporate governance reform has taken a structural approach, tightening the rules around the number of independent directors required on boards and committees and fine-tuning the definition of independence. However, such an approach has failed to achieve effective corporate governance. Moreover, this approach is informed by the arguably discredited assumption that individuals are rational self-interest utility maximizers. This conceptual (...) paper questions why corporate governance scholars and regulators remain uncritical of this assumption and suggests an approach to reform inspired by a different view of human nature. Indeed, incorporating an actor-based approach to reform into existing structures may better achieve effective corporate governance while addressing an unjustified adherence to this flawed assumption. Clinical Ethics Consultation (CEC) has grown significantly in the last decade, and efforts are being made to professionalize the practice. The American Society for Bioethics and Humanities (ASBH) has been instrumental in this process, having published the _Code of Ethics and Professional Responsibilities for Healthcare Ethics Consultants_ and founded and endorsed the creation of the _Healthcare Ethics Consultant Certified (HCEC) Certification Commission._ The ASBH also published “core competencies” for healthcare ethics consultants and has delineated a clear identity and role of (...) such consultants distinct from that other healthcare professionals. In addition, more enter the field armed with advanced degrees (MA and PhD) or certification in clinical ethics consultation. While some have questioned the trend toward professionalization, the momentum is clearly in its favor. This paper explores three questions: Does the professionalization of healthcare ethics consultation expose those engaged in the field to the types of liability claims faced by professionals in other fields? What specific liabilities could affect a healthcare ethics consultant? And finally, what should healthcare ethics consultants do to protect themselves against liability claims? We conclude that while the risk of liability remains low, those engaged in the field should accept that risk just as part of their status as professionals and, like those in allied professions, seek appropriate protection in the form of liability insurance. In written and spoken communications, figures of speech (e.g., metaphors and synecdoche) are often used as an aid to help convey abstract or less tangible concepts. However, the benefits of using rhetorical illustrations or embellishments in visualization have so far been inconclusive. In this work, we report an empirical study to evaluate hypotheses that visual embellishments may aid memorization, visual search and concept comprehension. One major departure from related experiments in the literature is that we make use of a dual-task (...) methodology in our experiment. This design offers an abstraction of typical situations where viewers do not have their full attention focused on visualization (e.g., in meetings and lectures). The secondary task introduces “divided attention”, and makes the effects of visual embellishments more observable. In addition, it also serves as additional masking in memory-based trials. The results of this study show that visual embellishments can help participants better remember the information depicted in visualization. On the other hand, visual embellishments can have a negative impact on the speed of visual search. The results show a complex pattern as to the benefits of visual embellishments in helping participants grasp key concepts from visualization. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Philosophy, Psychiatry, & Psychology 12.1 (2005) 83-85 [Access article in PDF] Lacan, Science, and Determinism Douglas McConnell Grant Gillett Keywords Lacan, the unconscious, free will Van Staden And Hinshelwood's commen-taries raise a number of issues, but there are two particular themes common to both that we pick up in this response.The first theme concerns the reconcilability of Lacanian theory to the disciplines of analytic philosophy and "Anglo-American positivist (...) psychiatry." This is closely related to the relationship between the unconscious and the empirical sciences discussed in the editorial (McConnell and Pickering 2005). The second theme concerns the relevance of Lacanian theory to our understanding of free will and the structure of the mind. Lacan, Analytic Philosophy, and Scientific Psychiatry First, psychoanalysis or psychotherapy generally should not try to reunite with neuroscience because of the fundamental difference in their approaches to the patient, which is likely to mean that even if a theoretical rapprochement can be found, a working relationship is unlikely.Although there are many facets of Lacan's theory that were not addressed in our paper and even if many of those are totally irreconcilable to analytic philosophy, we believe that we have addressed the most ontologically fundamental issues and that these can genuinely contribute to and challenge analytic philosophy of mind.As Hinshelwood points out, psychiatry does operate with a philosophical basis, critical (or sometimes relatively uncritical) scientific realism (even though it may not be acknowledged), and it as such it can legitimately be contributed to or challenged by the philosophical aspects of Lacanian theory outlined in our paper.In fact, the theoretical basis is evinced in van Staden's commentary when he remarks on the relation between Lacanian theory and psychiatry: "... the unconscious is not only structured like a language but actually reflects and is produced by linguistic interaction between the subject and others. This is a difficult claim to verify, no doubt, but it prompts further related questions... whether the conscious mind is structured like a language" (van Staden 2005, 78). And one must ask whether this is the kind of claim that can be verified or whether it is a hermeneutic claim (in somewhat the way suggested by Jaspers), serving more as a framing belief to allow people to make sense of what has influenced them in their life histories and is currently played out in their relationships with others. We would lean toward this interpretation of the unconscious, explicitly distancing ourselves from any overreaching, quasi-scientific realism about unconscious contents and mental structures, but clinging to the thought that dealing with such contents is an essential part of the therapeutic encounter. [End Page 83]Looked at in this way, both the Lacanian unconscious and conscious mental life bear the imprint of language due to the subject's immersion and participation in the symbolic realm. This may seem a "difficult claim to verify," but because verification is linked to the scientific framework of inquiry rather than the hybrid that is clinical knowledge, we would better regard it as being difficult to establish as an axiom of therapy. The linguistic structure of the conscious and unconscious mind is, on this account, a conceptual implication of the role of the symbolic register in thought and not a thesis that requires verification (a Wittgensteinian thesis espoused by a number of contemporary philosophers, including Dummett and Davidson).As it happens, cognitive science has found linguistic structure to be important in operations of the cognitive unconscious (arguably different from the dynamic unconscious due to the former's dependence on scientific experiment and the latter's connections to life history rather than mere psychological or cognitive traits [see Gillett and McConnell 2005]). Given that language and problem solving are so closely intertwined, it would suggest that cognitive science was overlooking something important rather than damaging Lacanian theory if linguistic structure did not appear on cognitive science's "radar." Aquinas maintains that, although God created the universe, he could have created another or simply refrained from creating altogether. That Aquinas believesin divine free choice is uncontroversial. Yet doubts have been raised as to whether Thomas is entitled to this belief, given his claims concerning divine simplicity.According to simplicity, there is no potentiality in God, nor is there a distinction in God between God’s willing, His essence, and His necessary being. On the surface, it appears that these claims leave no (...) room for divine free choice. I argue that attempts by Aquinas and a pair of his contemporary defenders to reconcile God’s freedom with God’s simplicity fail to resolve the problem. The study of paraconsistent logic as a branch of mathematics and logic has been pioneered by Newton da Costa. With the growing advent of distributed and often inconsistent databases over the last ten years, there has been growing interest in paraconsistency amongst researchers in databases and knowledge bases. In this paper, we provide a brief survey of work in paraconsistent databases and knowledge bases affected by Newton da Costa's important and lasting contributions to the field.

The philosophy of chemistry has emerged in recent years as a new and autonomous field within the Anglo-American philosophical tradition. With the development of this new discipline, Eric Scerri and Grant Fisher's "Essays in the Philosophy of Chemistry" is a timely and definitive guide to all current thought in this field. This edited volume will serve to map out the distinctive features of the field and its connections to the philosophies of the natural sciences and general philosophy of science (...) more broadly. It will be a reference for students and professional alike. Both the philosophy of chemistry and philosophies of scientific practice alike reflect the splitting of analytical and continental scholastic traditions, and some philosophers are turning for inspiration from the familiar resources of analytical philosophy to influences from the continental tradition and pragmatism. While philosophy of chemistry is practiced very much within the familiar analytical tradition, it is also capable of trail-blazing new philosophical approaches. Between March and June 2008, a group of fifteen Performance Studies and Communications students at Monash University in Melbourne, Australia undertook a course on comedy based on a series of six lectures by Agnes Heller in which she outlined ideas from her book, Immortal Comedy. Subsequently, the students attended a number of comedy shows and other events to perform practical group phenomenological research with an aim to activate the ground opened by Heller’s theories through description of actual comic phenomena. The (...) outcomes—theoretical, experiential and, most surprisingly, pedagogical—were remarkable in their demonstration of the efficacy of group phenomenology as a method of intertwined practice, research and learning.
