Liberal societies conventionally treat religion as unique under the law, requiring both special protection and special containment. But recently this idea that religion requires a legal exception has come under fire from those who argue that religion is no different from any other conception of the good, and the state should treat all such conceptions according to principles of neutrality and equal liberty. Cécile Laborde agrees with much of this liberal egalitarian critique, but she argues that a simple analogy between (...) the good and religion misrepresents the complex relationships among religion, law, and the state. Religion serves as more than a statement of belief about what is true, or a code of moral and ethical conduct. It also refers to comprehensive ways of life, political theories of justice, modes of voluntary association, and vulnerable collective identities. Disaggregating religion into its various dimensions, as Laborde does, has two clear advantages. First, it shows greater respect for ethical and social pluralism by ensuring that whatever treatment religion receives from the law, it receives because of features that it shares with nonreligious beliefs, conceptions, and identities. Second, it dispenses with the Western, Christian-inflected conception of religion that liberal political theory relies on, especially in dealing with the issue of separation between religion and state. We fear that the growing threat of violent attack has upset the balance between existential concepts of political power, which emphasize security, and traditional notions of constitutional limits meant to protect civil liberties. We worry that constitutional states cannot, during a time of war, terror, and extreme crisis, maintain legality and preserve civil rights and freedoms. David Williams Bates allays these concerns by revisiting the theoretical origins of the modern constitutional state, which, he argues, recognized and made room for (...) tensions among law, war, and the social order. We traditionally associate the Enlightenment with the taming of absolutist sovereign power through the establishment of a legal state based on the rights of individuals. In his critical rereading, Bates shows instead that Enlightenment thinkers conceived of political autonomy in a systematic, theoretical way. Focusing on the nature of foundational violence, war, and existential crises, eighteenth-century thinkers understood law and constitutional order not as constraints on political power but as the logical implication of that primordial force. Glitch composition is a meta-discursive practice: rather than writing new music inspired by older recordings, it constructs new music inspired by the technological conditions and limitations in which those recordings emerged. For those listeners who aren’t particularly interested in technology theories, such music is particularly alienating—an in-joke that one doesn’t get. When glitch becomes pop, it loses its theoretical savvy, replacing the “synth pad” in a contemporary pop song. Glitch’s subversion of the bad value judgment placed on damaged media is (...) only a partial one—as scratched CDs (whether they be glitch ones or not) remain economically worthless commodities. In his recent Rescuing Justice and Equality, G. A. Cohen mounts a sustained critique of coerced labour, against the background of a radical egalitarian conception of distributive justice. In this article, I argue that Cohenian egalitarians are committed to holding the talented under a moral duty to choose socially useful work for the sake of the less fortunate. As I also show, Cohen's arguments against coerced labour fail, particularly in the light of his commitment to coercive taxation. In the course (...) of defending those claims, I claim that Cohen's remarks on freedom of occupational choice and taxation exhibit partiality towards the interests of the better-off to the detriment of the less fortunate – a partiality which is in tension with his commitment to equality. The swamping problem is the problem of explaining why reliabilist knowledge (reliable true belief) has greater value than mere true belief. Swamping problem advocates see the lack of a solution to the swamping problem (i.e., the lack of a value-difference between reliabilist knowledge and mere true belief) as grounds for rejecting reliabilism. My aims here are (i) to specify clear requirements for a solution to the swamping problem that are as congenial to reliabilism's critics as possible, (ii) to clear away (...) various existing reliabilist solutions on the basis of these requirements, and (iii) to present a reliabilist solution that succeeds in meeting all of them. To meet all the requirements, my solution develops a more nuanced understanding of the epistemic end than is currently discussed, and with it a novel way of individuating beliefs. I close with a brief discussion of the question whether reliabilism's critics might impose further demands which reliabilism cannot possibly meet. (shrink)

This book articulates a cosmopolitan theory of the principles which ought to regulate belligerents' conduct in the aftermath of war. Throughout, it relies on the fundamental principle that all human beings, wherever they reside, have rights to the freedoms and resources which they need to lead a flourishing life, and that national and political borders are largely irrelevant to the conferral of those rights. With that principle in hand, the book provides a normative defence of restitutive and reparative justice, the (...) punishment of war criminals, the resort to transitional foreign administration as a means to govern war-torn territories, and the deployment of peacekeeping and occupation forces. It also outlines various reconciliatory and commemorative practices which might facilitate the emergence of trust amongst enemies and thereby improve prospects for peace. Many philosophers advocate a change in our thinking in order to move beyond an anthropocentric view of the environment. In order to achieve the kind of thinking that makes for sound environmental thinking, we have to look more deeply into the nature of thought and to revise the relation between thought directed outward to the world and thought directed inwardly to thought itself. Only with such insight can we begin to think soundly about the environment. Thought exhibits a characteristic that (...) makes it hard to think environmentally soundly. This characteristic is the inability to think of something without at thesame time making it one’s property. In other words, if sound environmental thinking means moving beyond anthropocentric attitudes and, for example, extending moral categories to creatures other than humans, then we need to address how our thinking turns everything into “mine” before we go about establishing a theory about how that extension should take shape. Hegel is the philosopher who most deeply analyses the inevitable, yet dangerous role of “mining”—in the sense of “making mine,” in the act of thinking. This potentially problematic character of thought risks making a number of otherwise soundenvironmental ways of thinking, unsound. However, we can provide a balance for this problematic characteristic in our thinking. (shrink)

Western philosophy has long excluded the work of women thinkers from their canon. Presenting Women Philosophers addresses this exclusion by examining the breadth of women's contributions to Western thought over some 900 years. Editors Cecile T. Tougas and Sara Ebenreck have gathered essays and other writings that reflect women's deep engagement with the meaning of individual experience as well as the continuity of their philosophical concerns and practices. Arranged thematically, the collection ranges across eras and literary genres as it emphasizes (...) the intellectual significance of written work by key figures—for example, Hildegard of Bingen's visionary writings, Iris Murdoch's fiction, Hannah Arendt's historical narratives, and the oral storytelling in black women's literary tradition. The collection also brings to light the philosophical importance of little-known work by such writers as Mme de Sablé and Mme de Condorcet. This wide-ranging collection offers non-philosophers an introduction to women's thought but also promises to engage advanced students of philosophy with new research on unrecognized contributions. The book theoretically examines the recent and topical debates over democracy and social rights, arguing that there are four fundamental rights that should be constitutionalized; minimum income; housing; healthcare; and education. The theoretical discussion is explored within an analysis of important legal cases.

The republican tradition seems to have a blind spot about global justice. It has had little to say about pressing international issues such as world poverty or global inequalities. According to the old, if apocryphal, adage: extra rempublicam nulla justitia. Some may doubt that distributive justice is the primary virtue of republican institutions; and at any rate most would agree that republican values have traditionally been realized in the polis not in the cosmopolis. The article sketches a republican account of (...) global non-domination which suggests that duties of distributive justice are not bounded to the institutions of a single society. In particular, it argues that republicans have good reasons to seek to curb those global inequalities which underpin what I call capability-denying domination. (shrink)

The starting point of this paper is the need to promote a people-centred corporate social responsibility framework in a context where many human needs and rights remain unsatisfied and where businesses may have both a positive and a negative impact on the quality of life of human beings today and tomorrow and may even lead to irreversible damage. Our normative definition of CSR is consistent with the criteria established by the EU Commission in 2011. We conceive CSR as a responsibility (...) towards human development in two complementary ways: a holistic responsibility shared by companies together with other actors to safeguard humanity and a direct liability of each company for its impact on stakeholders' capabilities. We apply Nussbaum's list of central capabilities and concept of thresholds to specify the nature and extent of corporate responsibilities towards employees, subcontractors, investors, customers, and humanity as a whole. In addition, we leverage fieldwork in developing and developed countries to analyse the effect of business activities on human capabilities. We demonstrate that by quantifying the impact of businesses' activities on various dimensions of stakeholders' lives, and especially on the most vulnerable ones, these businesses can be held accountable for the negative externalities they produce. Malebranche's metaphysics and the problem of human freedom -- God, order, and general volitions -- Arnauld and Malebranche on the power of the human intellect -- The cognitive faculties and the divine ideas -- Malebranche on free will and imminent causation.

In this paper, I provide a compositional semantics for sentences with enough and too followed by a to-infinitive clause and for resultative constructions with so... that within the framework of possible world semantics. It is proposed that the sentential complement of these constructions denotes an incomplete conditional and is explicitly or implicitly modalized, as if it were the consequent of a complete conditional. Enough, too, and so are quantifiers that relate an extent predicate and the incomplete conditional (expressed by the (...) sentential complement) and are interpreted as comparisons between two extents. The first extent is the maximal extent that satisfies the extent predicate. The second extent is the minimal or maximal extent of a set of extents that satisfy the (hidden) conditional, where the sentential complement supplies the consequent and the main clause the antecedent. This approach permits to predict (a) the context-dependent interpretation of these constructions and (b) the duality relations between the degree words. (shrink)

Al transcribir sus contemplaciones, revela un medio adecuado para entrar en los cuadros: la razón poética, que constituye una nueva estética basada en la fidelidad hacia la realidad originaria y en la revelación de una presencia. Zambrano define la pintura como un acto creador que brota de la odisea del artista hacia sus entrañas y hasta la revelación siempre incompleta del originario. Se trata (...) de entender la expresión de tal presencia enigmática por el arte pictórico y por la razón poética, analizando la coherencia entre los principios de la estética zambraniana con su propia escritura de crítica de arte. Many believe that agent-centred considerations, unlike agent-neutral reasons, cannot show that victims have the right to kill their attackers in self-defence, let alone establish that rescuers have the right to come to their help. In this paper, I argue that the right to kill in self- or other-defence is best supported by a hybrid set of reasons. In particular, agent-centred considerations account for the plausible intuition that victims have a special stake, which other parties lack, in being to thwart the (...) attackers. But if, under the dominion and management of [our human] Art, such splendid things (...) are daily achieved beyond the powers of the objects themselves,... And if, in serving men they carry out such things as are to be marvelled at, what I ask, may we expect from them when they be instruments in the hand of God? These words come near the end of William Harvey's De generatione animalium. 1 As he does often in this work, he is arguing that it is possible for a material object to behave supra vires elementorum, i.e., in a manner that exceeds what can be explained merely from the qualities of the elements from which it is made. In fact, just before this, he argues that human craftsmanship enables the elements of air and water to make ships sail in opposite directions, fire to do one sort of thing in the kitchen, another in the shops of metal-workers, including the production of iron, which in its turn peacefully tills the soil or besieges the town in war. So if even human Art is capable of making something as wonderful as a clock out of the elements, how much more might God be able to do with them? [End Page 577]Not only is it entirely conceivable that the (divinely) artful manipulation of these same elements can account for the wonders of God's nature--such as the generation of a chick out of an egg--there is also no need to infer the existence of additional entities such as faculties, qualities, agents, and the like. All that is needed is the concept of "instrument." Today such things as his appeal to a clock, his reference to "art," and the word "instrument" itself, are liable to arouse in our minds a fairly mechanical sort of image. Ethics review committees have become a common institution in English-speaking research communities, and are now increasingly being adopted in a variety of research environments. In light of existing debates on the aptness of ethics review boards for assessing research work in the social sciences, this article investigates the ways in which researchers navigate issues of research ethics in the absence of a formal review procedure or of an ethics review board. Through the analysis of qualitative and quantitative data, the article (...) questions the overall utility of ethics review boards. Highlighting the importance of space for sharing, the authors argue for the development of a new type of structure that takes into account researchers’ ‘ethos of responsibility’ as an adequate ethical compass for research in the social sciences. This historical study of early 19th-century opposition to vivisection suggests that the moral persona of the vivisector was an important theme. Vivisectors claimed they deliberately suppressed their feelings to perform scientifically necessary experiments: Where there was reason, there could be no cruelty. Their critics argued they were callous and indifferent to suffering, which was problematic for medical practitioners, who were expected to be merciful and compassionate. This anthropocentric debate can be located within the virtue ethics tradition: Compassion for animals signified (...) a humane character. Malebranche, Elucidation 15 One of the signatures of 17th century rationalists (...) is their replacement of the Scholastics's dependence on the deliverances of the senses with a dependence on the deliverances of the intellect as the key to gaining knowledge.1 Correct use of the intellect leading to freedom from the passions and to certain knowledge figures prominently in the works of Spinoza and Leibniz. Descartes's Meditations uses skeptical doubt to withdraw the mind from the senses, and his reliance on the meditative genre not only reveals to his readers the intellect as a distinct source of knowledge, but also trains them to use properly their will or faculty of judgment. Commentators have argued persuasively that overthrowing the sense-based epistemology and metaphysics of the Aristotelians depended on "discovering" the primacy of one's intellect over the senses, and using the deliverances of the mind to establish solid foundations for a new metaphysics and epistemology.2 Indeed, [End Page 83] outlining the proper use of the mind's faculties arguably lay at the basis of the Cartesian program in particular. This importance can be seen in Arnauld and Nicole's influential Port-Royal Logic, which aimed at training its readers in the proper use of the intellect.3Few would question Nicolas Malebranche's inclusion in the rationalist tradition.4 For while Malebranche famously takes ideas out of the Cartesian mind and transports them to God's—thus privileging the divine over the natural light—he shares Descartes's belief that our intellect, not our senses, holds the key to metaphysical truths such as the essence of matter, the mind-body distinction, and the existence of God.5 Yet, recently, Nicholas Jolley has contended that Malebranche's later commitment to "efficacious ideas" undermines his earlier belief in the power of the cognitive faculties: he believes that Malebranche abandons his view that the mind makes "real use" of the intellect to know intelligible objects.6 Jolley's position builds upon Alquié and Robinet's claims that around 1694-95 Malebranche moved from a vision "in" God to a vision "by" God. Now God's ideas act on and modify the soul with both sensations and intellectual concepts, rather than the human intellect contemplating ideas in the Divine Reason.7Alquié and Robinet argue that Malebranche, pushed by the battles with Arnauld and Régis over the status of ideas, introduced the language of "efficacious" ideas to explain how the union of the human and the divine mind is supposed to work.8 Robinet in particular suggests that in cashing out the metaphor of God enlightening human minds, Malebranche moved from a static "ontologist" view of idea-objects in God to an active "illuminationist" view whereby divine ideas cause(intellectual [End Page 84] and sensory) perception by modifying the soul.9 Once one accepts this view of the place and function of efficacious ideas in Malebranche's metaphysics, it seems natural to accept Jolley's declaration that the only way for the mind to apprehend ideas in God is if those ideas "act directly on the mind; [if] they thereby cause cognitive states to arise in a substance which is devoid of all genuine cognitive capacities of its own."10 Indeed, Jolley suggests that Malebranche ultimately made the soul passive in all its states, including its volitional ones.11In this paper, I argue that a strong interpretation of efficacious ideas, whereby they appear to become true causal agents, must be rejected precisely because it pushes us into an incorrect reading of Malebranche's theory of the divine and human faculties.
