This article considers the question of whether a landowner should be responsible for nuisance behaviour which is committed by other people from his land. Recent years have seen a number of cases being brought, particularly against local authority landlords, as victims of nuisance try to get someone to do something about the problem. The case law is somewhat mixed on this and the courts have shown a readiness to apply the approach followed in the more traditional nuisance cases involving pollution (...) and physical damage to respond to the problem. This response fails to take account of the fact that the nuisance creators are autonomous persons and does not explain why the responsibility for controlling them should be thrust on the landowner. In place of this it is argued that a landowner should be accountable only if he has authorized the bad behaviour or if he owes a duty to protect the victim from harm. (shrink)

Only human beings have a rich conceptual repertoire with concepts like tort, entropy, Abelian group, mannerism, icon and deconstruction. How have humans constructed these concepts? And once they have been constructed by adults, how do children acquire them? While primarily focusing on the second question, in The Origin of Concepts , Susan Carey shows that the answers to both overlap substantially. Carey begins by characterizing the innate starting point for conceptual development, namely systems of core cognition. Representations of core (...) cognition are the output of dedicated input analyzers, as with perceptual representations, but these core representations differ from perceptual representations in having more abstract contents and richer functional roles. Carey argues that the key to understanding cognitive development lies in recognizing conceptual discontinuities in which new representational systems emerge that have more expressive power than core cognition and are also incommensurate with core cognition and other earlier representational systems. Finally, Carey fleshes out Quinian bootstrapping, a learning mechanism that has been repeatedly sketched in the literature on the history and philosophy of science. She demonstrates that Quinian bootstrapping is a major mechanism in the construction of new representational resources over the course of childrens cognitive development. Carey shows how developmental cognitive science resolves aspects of long-standing philosophical debates about the existence, nature, content, and format of innate knowledge. She also shows that understanding the processes of conceptual development in children illuminates the historical process by which concepts are constructed, and transforms the way we think about philosophical problems about the nature of concepts and the relations between language and thought. Most people, including philosophers, tend to classify human motives as falling into one of two categories: the egoistic or the altruistic, the self-interested or the moral. According to Susan Wolf, however, much of what motivates us does not comfortably fit into this scheme. Often we act neither for our own sake nor out of duty or an impersonal concern for the world. Rather, we act out of love for objects that we rightly perceive as worthy of love--and it is (...) these actions that give meaning to our lives. Wolf makes a compelling case that, along with happiness and morality, this kind of meaningfulness constitutes a distinctive dimension of a good life. No consensus yet exists on how to handle incidental fnd-ings in human subjects research. Yet empirical studies document IFs in a wide range of research studies, where IFs are fndings beyond the aims of the study that are of potential health or reproductive importance to the individual research participant. This paper reports recommendations of a two-year project group funded by NIH to study how to manage IFs in genetic and genomic research, as well as imaging research. We conclude that researchers (...) have an obligation to address the possibility of discovering IFs in their protocol and communications with the IRB, and in their consent forms and communications with research participants. Researchers should establish a pathway for handling IFs and communicate that to the IRB and research participants. We recommend a pathway and categorize IFs into those that must be disclosed to research participants, those that may be disclosed, and those that should not be disclosed. (shrink)

In this provocative book, Susan Bordo untangles the myths, ideologies, and pathologies of the modern female body. Bordo explores our tortured fascination with food, hunger, desire, and control, and its effects on women's lives.

I analyse the political, economic, and cultural circumstances that have given rise to persistent political disputes about race (known colloquially as “the culture war”) among a subset of Americans. I argue that they point to a deep tension between widely held normative aspirations and pervasive and readily observable material facts about our society. The characterological pathologies this gives rise to are discussed, and a normatively preferable path forward for an individual attempting to reconcile themselves to the current social order is (...) suggested. The book is an investigation of the semantics of numericals, counting and measuring, and its connection to the mass/count distinction from a theoretical and crosslinguistic perspective. It reviews some recent major linguistic results in these topics, and presents the author's new research including in-depth case studies of a number of typologically unrelated languages.

I outline a defence of a naive group-level standpoint epistemology. According to this view then under conditions often met in real situations of oppression, it is the majority view on questions of import to those marginalised by oppression that ought to be treated as deference worthy. I further argue that this view is inspired by and coheres well with various doctrines laid out and defended by W.E.B. Du Bois, making this a recognisably Duboisian vision of standpoint epistemology. The central conceptual (...) move is to relate principles of social epistemology under conditions of oppression that were of great interest to Du Bois with the conditions for group accuracy that have been studied by social-choice theorists working on Condorcet’s Jury Theorem, as well as contemporary epistemological work on group polarisation. I argue that once these elements are brought together a surprisingly cogent case for deference to the simple majority view of the marginalised can often be made. (shrink)

I wrote an essay about why I do philosophy. It would probably not be publishable anywhere, but I think it might be of some interest to others as we reflect on why we do what we do. For those who know me from online I hope in this to provide illustrations of the categories "Sexy Murder Poet" and "Basically Pleasant Bureaucrat", since it so happens that the two tendencies within me can be sorted by these. In any case, I hope (...) the essay helps people think about what they hope to get from philosophy, and whether the tools they adopt are adequate to the tasks they thus set themselves. (shrink)

Considering everything from Nike ads, emaciated models, and surgically altered breasts to the culture wars and the O.J. Simpson trial, Susan Bordo deciphers the hidden life of cultural images and the impact they have on our lives. She builds on the provocative themes introduced in her acclaimed work _Unbearable Weight_—which explores the social and political underpinnings of women's obsession with bodily image—to offer a singularly readable and perceptive interpretation of our image-saturated culture. As it becomes increasingly difficult to distinguish (...) between appearance and reality, she argues, we need to rehabilitate the notion that not all versions of reality are equally trustworthy. Bordo writes with deep compassion, unnerving honesty, and bracing intelligence. Looking to the body and bodily practices as a concrete arena where cultural fantasies and anxieties are played out, she examines the mystique and the reality of empowerment through cosmetic surgery. Her brilliant discussion of sexual harassment reflects on the Clarence Thomas/Anita Hill controversy as well as the film _Disclosure_. She suggests that sexuality, although one of the mediums of harassment, is not its essence, and she calls for the recasting of harassers as bullies rather than sex fiends. Bordo also challenges the continuing marginalization of feminist thought, in particular the failure to read feminist work as cultural criticism. Finally, in a powerful and moving essay called "Missing Kitchens"—written in collaboration with her two sisters—Bordo explores notions of bodies, place, and space through a recreation of the topographies of her childhood. Throughout these essays, Bordo avoids dogma and easy caricature. Consistently, and on many levels, she demonstrates the profound relationship between our lives and our theories, our feelings and our thoughts. (shrink)

Summary Analogue models are actual physical setups used to model something else. They are especially useful when what we wish to investigate is difficult to observe or experiment upon due to size or distance in space or time: for example, if the thing we wish to investigate is too large, too far away, takes place on a time scale that is too long, does not yet exist or has ceased to exist. The range and variety of analogue models is too (...) extensive to attempt a survey. In this article, I describe and discuss several different analogue model experiments, the results of those model experiments, and the basis for constructing them and interpreting their results. Examples of analogue models for surface waves in lakes, for earthquakes and volcanoes in geophysics, and for black holes in general relativity, are described, with a focus on examining the bases for claims that these analogues are appropriate analogues of what they are used to investigate. A table showing three different kinds of bases for reasoning using analogue models is provided. Finally, it is shown how the examples in this article counter three common misconceptions about the use of analogue models in physics. (shrink)

The book is written with grace and wit; again and again, Neiman writes the kind of sentences we dream of uttering in the perfect conversation: where every mot is bon. This is exemplary philosophy.

The topic of self-interest raises large and intractable philosophical questions–most obviously, the question “In what does self-interest consist?” The concept, as opposed to the content of self-interest, however, seems clear enough. Self-interest is interest in one's own good. To act self-interestedly is to act on the motive of advancing one's own good. Whether what one does actually is in one's self-interest depends on whether it actually does advance, or at least, minimize the decline of, one's own good. Though it may (...) be difficult to tell whether a person is motivated by self-interest in a particular instance, and difficult also to determine whether a given act or decision really is in one's self-interest, the meaning of the claims in question seems unproblematic. My main concern in this essay is to make a point about the content of self-interest. Specifically I shall put forward the view that meaningfulness, in a sense I shall elaborate, is an important element of a good life. It follows, then, that it is part of an enlightened self-interest that one wants to secure meaning in one's life, or, at any rate, to allow and promote meaningful activity within it. Accepting this substantial conception of self-interest, however, carries with it a curious consequence: the concept of self-interest which formerly seemed so clear begins to grow fuzzy. Fortunately, it comes to seem less important as well. In Reasons and Persons, Derek Parfit distinguishes three sorts of theories about self-interest–hedonistic theories, preference theories, and what he calls “objective-list theories." Hedonistic theories hold that one's good is a matter of the felt quality of one's experiences. (shrink)

_A surprising, sweeping, and deeply researched history of empathy—from late-nineteenth-century German aesthetics to mirror neurons_ _Empathy: A History_ tells the fascinating and largely unknown story of the first appearance of “empathy” in 1908 and tracks its shifting meanings over the following century. Despite empathy’s ubiquity today, few realize that it began as a translation of _Einfühlung _or “in-feeling” in German psychological aesthetics that described how spectators projected their own feelings and movements into objects of art and nature. Remarkably, this early (...) conception of empathy transformed into its opposite over the ensuing decades. Social scientists and clinical psychologists refashioned empathy to require the deliberate putting aside of one’s feelings to more accurately understand another’s. By the end of World War II, interpersonal empathy entered the mainstream, appearing in advice columns, popular radio and TV, and later in public forums on civil rights. Even as neuroscientists continue to map the brain correlates of empathy, its many dimensions still elude strict scientific description. This meticulously researched book uncovers empathy’s historical layers, offering a rich portrait of the tension between the reach of one’s own imagination and the realities of others’ experiences. The Unity of Reason is the first major study of Kant's account of reason. It argues that Kant's wide-ranging interests and goals can only be understood by redirecting attention from epistemological questions of his work to those concerning the nature of reason. Rather than accepting a notion of reason given by his predecessors, a fundamental aim of Kant's philosophy is to reconceive the nature of reason. This enables us to understand Kant's insistence on the unity of theoretical and practical reason (...) as well as his claim that his metaphysics was driven by practical and political ends. Neiman begins by discussing the historical roots of Kant's conception of reason, and by showing Kant's solution to problems which earlier conceptions left unresolved. Kant's notion of reason itself is examined through a discussion of all the activities Kant attributes to reason. In separate chapters discussing the role of reason in science, morality, religion, and philosophy, Neiman explores Kant's distinctions between reason and knowledge, and his difficult account of the regulative principles of reason. Through examination of these principles in Kant's major and minor writings, The Unity of Reason provides a fundamentally new perspective on Kant's entire work. (shrink)

Jennifer Lackey makes the case that non-summativist accounts of group belief cannot adequately account for an important difference between group lies and group belief. Since non-summativist accounts fail to do this, she argues that they ought be rejected and that we should seek an account of group belief which can do better by this standard. I briefly summarize Lackey’s argument, to give a sense of the role I see the central desideratum playing, and outline her arguments for that desideratum. I (...) then critique one of the positive arguments she offers for the desideratum, briefly outlining the notion of explication and why I think it would not license the appeal to the Group Lie Desideratum that Lackey’s argument depends upon. This leads me to reflections on the broader project of analysing notions of group belief, and the role I think such endeavours can or ought to play in social epistemology more broadly. (shrink)

A philosophical refashioning of the Language of Thought approach and the related computational theory of mind.

Recent philosophical treatment of conspiracy theories supposes them all to be explanatory, thus overlooking those conspiracy theories whose major purpose is the assertion of ‘hidden facts’ rather than explanation of accepted facts. I call this variety of non-explanatory conspiracy theories “counterfact theories”. In this paper, through the use of examples, including the Obama birth certificate conspiracy theory, I uncover the distinctive reasoning pattern and dialectical strategy of counterfact theories, highlighting their epistemic flaws.

Commentators on the work of Immanuel Kant have long held that his later "critical" writings are a radical rejection of his earlier, less celebrated efforts. In this pathbreaking book, Susan Shell demonstrates not only the developmental unity of Kant's individual writings, but also the unity of his work and life experience. Shell argues that the central animating issues of Kant's lifework concerned the perplexing relation of spirit to body. Through an exacting analysis of individual writings, Shell maps the philosophical (...) contours of Kant's early intellectual struggles and their relation to his more mature thought. In this study, Levin explores Plato's engagement with the Greek literary tradition in his treatment of key linguistic issues. This investigation, conjoined with a new interpretation of the Republic's familiar critique of poets, supports the view that Plato's work represents a valuable precedent for contemporary reflections on ways in which philosophy might benefit from appeals to literature.

According to transhumanists who urge the radical enhancement of human beings, humanity’s top priority should be engineering “posthumans,” whose features would include agelessness. Increasingly, transhumanism is critiqued on foundational grounds rather than based largely on anticipated results of its implementation, such as rising social inequality. This expansion is crucial but insufficient because, despite its radical aim, transhumanism reflects beliefs and attitudes that are evident in the broader culture. With a focus on the yearning to eliminate aging, I consider four of (...) these: a disproportionate reliance on science and technology to address major human challenges; the conceptualization of human beings in terms of binaries like “young-old”; a repudiation of vulnerability; and intensifying perfectionism. Illuminating these interlocked commitments both deepens an existing critique of transhumanism and draws our attention to deleterious cultural views that must be vigorously contested if our commitment to human flourishing is to be deep and unwavering. In this book, authors working with Deleuzean theories in educational research in Australia and the United Kingdom grapple with how the academic-writing machine might become less contained and bounded, and instead be used to free impulses to generate different creations and connections. The authors experiment with forms of writing that challenge the boundaries of academic language, moving beyond the strictures of the scientific method that governs and controls what works and what counts to make language vibrate with a new intensity. Nature, as Spinoza conceives of it, contains individual things or finite modes, each with its own essence. Although we humans classify individuals into kinds, Spinoza is adamant that the resulting types or species “are nothing”. Despite Spinoza's nominalism, his mature works posit differences between animal kinds that are discoverable by reasoning and available to philosophical understanding. Spinoza's world is fluid in the sense that the powers of individuals are in flux, changing as they interact with one another. In Spinoza's view, (...) changes in an individual's power are typically the effects of its interactions with external things. Spinoza contrasts the affective dynamics between human natures with a lack of affective commonality between humans and other kinds of animals. In his political works Spinoza translates his account of natures or essences into juridical terms. The claim that mutual sociability is what makes an animal kind is of a piece with the rest of Spinoza's philosophy. (shrink)

Public bioethics bodies are used internationally as institutions with the declared aims of facilitating societal debate and providing policy advice in certain areas of scientific inquiry raising questions of values and legitimate science. In the United States, bioethical experts in these institutions use the language of consensus building to justify and define the outcome of the enterprise. However, the implications of public bioethics at science-policy boundaries are underexamined. Political interest in such bodies continues while their influence on societal consensus, public (...) debate, and science policy remains ambiguous. This article presents a theoretical discussion of public bioethics bodies as boundary organizations and examines them in terms of relationship to the moral and cognitive authority of science and other forms of expertise, mechanisms for public participation in controversial science policy, and the deployment of consensus models. This article explores the potential applications of feminist pedagogy to the lived experience of weekly preaching from the perspective of a young, white, cis female, heterosexual faith community leader. When privilege is both obvious, but authority is simultaneously presumed and challenged based on historical constructs of theological role and presentation of gender, the act of preaching becomes a site of resistance. This article then discusses the act of homiletics – the art of interpretive storytelling, history teaching, persuasive speech, and spiritual (...) performance – as informed by a feminist perspective. Does the pulpit present a bridge or barrier where gender is concerned? The physical act of preaching can represent an in-moment incarnating of a role, a historical step in a long-flowing river, and a psychological break point of self-erasure. This article posits that a thoughtful application of feminist pedagogy might dismantle these unspoken rules of the trade and create an opportunity for preaching as an act of resistance. (shrink)

The 2nd edition of the Oxford Handbook of Music Psychology updates the original landmark text which provided a comprehensive review of the latest developments in this fast growing area of research. The 2nd edition has 55 chapters divided into 11 parts covering both experimental and theoretical perspectives each edited by an internationally recognised authority in the area.

Susan B. Levin argues that Plato's engagement with medicine is richer than previously recognized and that he views it as an important rival for authority on nature and flourishing. Levin shows further that Plato's work, particularly the Laws, holds significant promise for bioethics that has so far been nearly untapped.

The book examines current debates about the emergence of an international legal norm of democratic governance and also considers some of the wider theoretical issues to which those debates give rise. In February 2000, the EuropeanCommission adopted a Communication on theprecautionary principle. This states how theCommission intends to apply the principle andestablishes guidelines for its application. Thedocument is intended to inform discussions oninternational agreements. In particular, itprovides a defense of European Union (EU)precautionary policies in case of tradedisputes, for example, in case the EU isaccused of imposing unfair trade barriers onexports of genetically-modified (GM) productsfrom the United States under the rules of theWorld Trade Organisation. In the communication,the Commission emphasizes the scientificaspects (...) of the precautionary principle, perhapspartly to counter claims from US officials thatthe EU's reluctance to accept GM imports is notbased on science but is politically-motivated.However, a principle is by definition a moralguide to behavior. In other words, it is anethic. The precautionary principle should beviewed as a complement to science, to beinvoked when a lack of scientific evidencemeans that outcomes are uncertain. Anyinterpretation of this principle needs to placeat least as much emphasis on its ethical andvalue-based aspects as on its scientificjustification. The Commission's interpretationrisks undermining the painstaking progress madeamong European Union member states inresponding to public concern about GM crops andfood by adopting increased precaution. Thispaper explores the balance between thescientific and ethical/value-based aspects ofthe precautionary principle as set out in theCommission's communication, to make the casethat it is the ethical and value-based aspectsrather than the scientific aspects of theguidelines that need strengthening.
