In October 2013, the Declaration of Helsinki was revised a seventh time in its 50 year history. While it is the most widely accepted set of ethical principles for the protection of patients participating in medical research, the Declaration of Helsinki has also been subject of constant controversy. In particular, its paragraph on the use of placebo controls in clinical trials divides the research community into active-control and placebo orthodox proponents, both continuously demanding revisions of the Declaration of Helsinki in (...) favour of their position. The goal of the present project is to compare the mainly theoretical controversy with regulatory implementation. We distributed a questionnaire to national drug regulatory authorities from different countries to collect information on the authorities’ respective approaches to interpretation and implementation of the Declarations’ placebo paragraph in the conduct of medical research. Our findings suggest that the majority of drug regulatory authorities have established a practice of a middle ground, allowing placebo controls in some instances. Various interpretations of “serious harm” and “methodological reasons” are proposed as well as safeguards to avoid abuse of the option to use placebo-controls. Leaving the placebo paragraph open to various interpretation is a result of the Declaration of Helsinki’s character as a guidance document. With the current version controversy will continue. The Declaration should be continued to be strengthened to enforce the appreciation of conducting medical research with the highest ethical standard. (shrink)

Background Informed consent is often cited as the “cornerstone” of research ethics. Its intent is that participants enter research voluntarily, with an understanding of what their participation entails. Despite agreement on the necessity to obtain informed consent in research, opinions vary on the threshold of disclosure necessary and the best method to obtain consent. We aimed to investigate Australian researchers’ views on, and their experiences with, obtaining informed consent. Methods Semi-structured interviews were conducted with 23 researchers from NSW institutions, working (...) in various fields of research. Interviews were analysed and coded to identify themes. Results Researchers reported that consent involved information disclosure, understanding and a voluntary decision. They emphasised the variability of consent interactions, which were dependent on potential participants’ abilities and interests, study complexity and context. All researchers reported providing written information to potential participants, yet questioned the readability and utility of this information. The majority reported using signed consent forms to ‘operationalise’ consent and reported little awareness of, and lack of support in implementing more dynamic informed consent procedures, such as verbal informed consent, that was fit for the purposes of their studies. Views on Human Research Ethics Committees varied. Some reported inconsistent, arduous inputs on the information form and consent process. Others expressed reliance on HRECs for guidance, viewing them as institutional safeguards. Conclusions This study highlights the importance of transparent relationships, both between researchers and participants, and between researchers and HRECs. Where the relationship with study participants was reported as more robust, researchers felt that they were better able to ensure participants made better, more informed decisions. Where the relationship with HRECs was reported as more robust, researchers were more likely to view them as institutional safeguards, rather than as bureaucratic hindrances. Conscientious and mindful researchers are paramount to ensuring the procedure accommodates individual requirements. This study advocates that when designing ethical informed consent practices, researchers should be integrated as autonomous players with a positive input on the process, rather than, in the worst case, predatory recruiters to be curtailed by information forms and oversight. Le Poidevin has recently presented an argument that gives rise to a serious problem for relationist theories of space. It appeals to the simple geometrical fact that if A, B and C are three points lying in a straight line, then AB and BC together entail AC. He suggests that an ontological relationship of supervenience must be appealed to to explain this entailment. Given this thesis of supervenience, relationism is implausible. I argue that the problem that Le Poidevin raises for (...) relationism should be rejected, because the thesis of supervenience is false. The latter rests upon what Le Poidevin refers to as ‘The explanatory principle', a principle which he claims to be a natural extension of the truthmaker principle. Contrary to this, I argue that given any plausible theory of truthmaking, the explanatory principle is false. With the rejection of this principle, Le Poidevin's argument against relationism collapses. (shrink)

Brazilian educator, Paulo Freire, best known for his work Pedagogy of the Oppressed, challenged education plans that contributed to the marginalization of minorities and the poor. Freire believed that education should be used for liberation by helping learners reflect on their experiences historically, giving immediate reality to issues of racism, sexism, and the exploitation of workers. Known as one of the most influential theoretical innovators of the twentieth century, his views have left a significant mark on progressive thinkers about education (...) and liberation. Reinventing Paulo Freire is an homage to him by protégé Antonia Darder. Here, she explores the legacy of Freire, interviews eight former students who studied him-- now teachers themselves, and reflects on the teaching practice as demonstrated by Freire himself. The interviews take the form of first person narratives; the epilogue consists simply of a letter and a poem. (shrink)

UK higher education reform (BIS, 2011) has been presented as a common‐sense movement towards efficiency. This article will argue that, in reality, the marketisation of higher education is a movement towards negative freedom, defined after Berlin (2007) as unrestricted choice. Using Shakespeare's Antony and Cleopatra as a means to explore the relationship between rationality and sensibility, it considers how negative freedom may undermine human connectivity and debase our relationships. Many views rely on the idea that it can never be rational to have high confidence in something like, “P, but my evidence doesn’t support P.” Call this idea the “Non-Akrasia Constraint”. Just as an akratic agent acts in a way she believes she ought not act, an epistemically akratic agent believes something that she believes is unsupported by her evidence. The Non-Akrasia Constraint says that ideally rational agents will never be epistemically akratic. In a number of recent papers, the (...) Non-Akrasia Constraint has been called into question. Advances in neuroscience have enabled the transition of transcranial direct current stimulation (tDCS) from research and clinical settings to public use. For this primarily home-based context, tDCS has been popularized as a do-it-yourself (DIY) approach to improved cognition and wellness. The line between wellness and health is blurry, however, and little is known about how engagement with therapeutic tDCS impacts users’ interactions with other interventions such as clinical consultations, pharmacotherapy, complementary medicine, and even other neurotechnology. To close this gap, we (...) collected data from the online content aggregator Reddit and analyzed posts pertaining to tDCS. Findings indicate that most users turn to Reddit to request information about tDCS as an adjunct, but not as a bypass, to ongoing or prior approaches. Posts suggest that mainstream medical care is viewed as necessary but not sufficient to address conditions such as depression and anxiety. Users discuss a mix of benefits and harms. This discourse provides valuable insights into the health practices, concerns and priorities of users, and new knowledge for informing applications of neurotechnology both inside and outside the therapeutic setting. Just as bodily actions are things you do with your body, mental actions are things you do with your mind. Both are different from things that merely happen to you. Where does the idea of mental action come from? What are mental actions? And why do they matter in philosophy? These are the three main questions answered in this paper. Section 1 introduces mental action through a brief history of the topic in philosophy. Section 2 explains what it is to (...) be a mental action in terms of intentional action. Section 3 argues that the fact that we can perform mental actions has some striking consequences concerning mental content. Section 4 shows how mental action helps to explain some important facts about self-knowledge and the normativity of thought. Aesthetic value empiricism claims that the aesthetic value of an object is grounded in the value of a certain kind of experience of it. The most popular version of value empiricism, and a dominant view in contemporary philosophical aesthetics more generally, is aesthetic hedonism. Hedonism restricts the grounds of aesthetic value to the pleasure enjoyed in the right kind of experience. But hedonism does not enjoy any clear advantage over a more permissive alternative version of value empiricism. This alternative is (...) aesthetic liberalism. On this view, an object’s aesthetic value is fully grounded in any value—not just the hedonic value—of a correct and complete experience of its sensory features. To demonstrate the advantages of liberalism over hedonism, I apply both views to analyze the aesthetic value of the Spring Temple Buddha and Anselm Kiefer’s Seraphim. I detail four advantages of liberalism over hedonism, and I conclude by defending liberalism from two kinds of objection. (shrink)

On appelle « Affaire Sokal » l’ensemble de controverses que suscitèrent la publication en 1996 d’une parodie écrite par un physicien américain, Alan Sokal, puis, en 1997, de l’ouvrage Impostures intellectuelles, qu’il co-signa avec un physicien belge, Jean Bricmont. Dans Retours sur l’Affaire Sokal¸ des historiens des sciences reviennent sur cette affaire. Ils montrent qu’elle recouvre différentes controverses et qu’il faut distinguer ces dernières non seulement selon la nature des écrits qui les ont occasionnées, mais aussi en fonction des questions (...) abordées, et peut-être surtout des manières de concevoir et pratiquer les échanges intellectuels. Any contextualist approach to knowledge has to provide a plausible definition of the concept of context and spell out the mechanisms of context changes. Since it is the dynamics of context change that carry the main weight of the contextualist position, not every mechanism will be capable of filling that role. In particular, I argue that one class of mechanisms that is most popularly held to account for context changes, namely those that arise out of shifts of conversational parameters in (...) discourses involving knowledge claims, are not suited to the job because they cannot account for the genuinely epistemic nature of the context shift. A form of epistemic contextualism that defines the context through the structure of our epistemic projects is suggested. Context changes in this account are linked to changes in the background assumptions operative in our epistemic projects and the methods used to carry out our inquiries. (shrink)

Basic actions are those intentional actions performed not by doing any other kind of thing intentionally. Complex actions involve doing one kind of thing intentionally by doing another kind of thing intentionally. There are both basic and complex mental actions. Some complex mental actions have a striking feature that has not been previously discussed: they have several distinct contents at once. This chapter introduces and explains this feature, here called “content plurality.” This chapter also argues for the philosophical significance of (...) this feature. The existence of content plurality offers a new explanation of transparent self-knowledge and suggests a new theory of inference. It also opens up a new conception of the relation between decisions to act and judgments about what ought to be done. (shrink)

Believing rationally is epistemically valuable, or so we tend to think. It’s something we strive for in our own beliefs, and we criticize others for falling short of it. We theorize about rationality, in part, because we want to be rational. But why? I argue that how we answer this question depends on how permissive our theory of rationality is. Impermissive and extremely permissive views can give good answers; moderately permissive views cannot.

Les savoirs de sciences humaines et sociales ont la particularité de circuler dans des espaces variés et de devoir composer avec une critique prompte à remettre en cause leur validité et leur légitimité. Leur acceptabilité sociale ne se joue pas dans la seule (...) communauté savante mais bien dans les multiples réinterprétations et traductions auxquelles ils donnent lieu. Epistemologists often assume that rationality bears an important connection to the truth. In this paper I examine the implications of this commitment for permissivism: if rationality is a guide to the truth, can it also allow some leeway in how we should respond to our evidence? I first discuss a particular strategy for connecting permissive rationality and the truth, developed in a recent paper by Miriam Schoenfield. I argue that this limited truth-connection is unsatisfying, and the version of permissivism that (...) supports it faces serious challenges; so, for mainstream permissivism, the truth problem is still unsolved. I then discuss a strategy available to impermissivists, according to which rationality bears a quite strong connection to truth. I argue that this second strategy is successful. (shrink)

"To explain more is to understand better". This is the mantra by which French philosopher Paul Ricoeur lived and worked, establishing himself as one of the twentieth century's most lucid and broad-ranging critical thinkers. A prisoner of war at 27, Ricoeur was also Dean of Paris X Nanterre during the student disturbances of 1968. In later years he became an outspoken champion of social justice. In work as in life, Ricoeur was committed to the challenges of conflict and the prospect (...) of authentic resolution. Deeply indebted to phenomenology and the hermeneutical tradition of Heidegger and Gadamer, Ricoeur was also an advocate of structural linguistics, of psychoanalysis, and a rare conversant with the Anglo-American analytic tradition. This volume explores how literature and the conflicts of literary-theoretical debate inform Ricoeur's theory of imagination and understanding, and how Ricoeur's unique mode of literary reflection resolves the conflicts of literature's theoretical heyday, presaging a new direction for literary studies. You can come to know that you believe that p partly by reflecting on whether p and then judging that p. Call this procedure “the transparency method for belief.” How exactly does the transparency method generate known self-attributions of belief? To answer that question, we cannot interpret the transparency method as involving a transition between the contents p and I believe that p. It is hard to see how some such transition could be warranted. Instead, in this context, one mental (...) action is both a judgment that p and a self-attribution of a belief that p. The notion of embedded mental action is introduced here to explain how this can be so and to provide a full epistemic explanation of the transparency method. That explanation makes sense of first-person authority and immediacy in transparent self-knowledge. In generalized form, it gives sufficient conditions on an attitude’s being known transparently. The conventional view of Hobbes’s commonwealth is that it was inspired by contemporary theories of tyranny. This article explores the idea that a paradigm for Hobbes’s state could in fact be found in early modern readings of Aristotle on democracy, as found in Book Three of the Politics. It argues that by the late sixteenth century, these meditations on the democratic body politic had developed claims about unity, mythology, and personation that would become central to Hobbes’s own theory of the (...) commonwealth. Tracing the history of commentary on the relevant passages in Aristotle reveals new perspectives not only on the political theories of both Aristotle and Hobbes but also introduces modern readers to the richness of early modern commentaries on classical political texts. The article ends with some thoughts on why attention to traditions of commentary might be valuable for political theorists today. (shrink)

Aesthetic value is not as peculiar as we might think. We do not walk into museums expecting to find there a good so refined that it bears no continuity with the.

Credences, unlike full beliefs, can’t be true or false. So what makes credences more or less accurate? This chapter offers a new answer to this question: credences are accurate insofar as they license true educated guesses, and less accurate insofar as they license false educated guesses. This account is compatible with immodesty; : a rational agent will regard her own credences to be best for the purposes of making true educated guesses. The guessing account can also be used to justify (...) certain coherence constraints on rational credence, such as probabilism. The chapter concludes by discussing some advantages of the guessing account over rival accounts of accuracy. (shrink)

William James famously tells us that there are two main goals for rational believers: believing truth and avoiding error. I argues that epistemic consequentialism—in particular its embodiment in epistemic utility theory—seems to be well positioned to explain how epistemic agents might permissibly weight these goals differently and adopt different credences as a result. After all, practical versions of consequentialism render it permissible for agents with different goals to act differently in the same situation. -/- Nevertheless, I argue that epistemic consequentialism (...) doesn’t allow for this kind of permissivism and goes on to argue that this reveals a deep disanalogy between decision theory and the formally similar epistemic utility theory. This volume looks at Aquinas's views on bodily and spiritual identity through a lens of theological concerns, pagan and Arabic authoritative sources, and contemporary polemic with dualist heresy.

In his fascinating new book Games: Agency as Art, Nguyen endorses an experiential requirement on aesthetic judgment: apt aesthetic judgment requires phenomenal experience. His own aesthetics of agency captures three phenomenally manifest and aesthetically significant harmonies (and corresponding disharmonies). But his view can be significantly extended to capture much more of the rich texture of human agency. In this discussion, I argue that emotions of agency, patterns of attention, and affordances all can be phenomenally experienced as aspects of agency, and (...) that each has genuine aesthetic significance. Name does matter. During exploration of knowledge, name provides dignity of existence. Isolating a quid from a whole, name gives that quid a status (i.e., helps it to gain a space, time, and fact). Biohistory had its own name in August 1992, when finally my mind isolated the historical quantum as the promotor of life. Shape follows name; Biohistory began to take shape in 1993, when it ran into Edgar Morin's ideas. For about a year, Biohistory had been a game (...) I toyed with, using it to show my pupils the explosion of events in spaces. I even gave it a poetic dress, in the form of nursery-rhymes (Spazioliberina; Colamonico, 1993). In 1993 I also read Morin's Introduction to Complex Thought (1993), in which it is assumed that a new science and a new doctrine would manage to read the one-whole. It was then that I understood that this theory would have been the body-mind-eye of my joyful child. So I adopted Morin as the father of my Biohistory. (shrink)

Teaching and learning in a virtual learning environment poses some difficulties, but also challenges and opportunities to rethink the whole learning process, particularly in abstract subjects like logic or high level mathematics. On the other hand, resources and ways to work, now available in VLEs, might soon extend to all kinds of environments. In this paper, we will present experiences at the Open University of Catalonia , a particular VLE, concerning the whole process of teaching logic and mathematics. Antonia Lolordo presents an original interpretation of John Locke's metaphysics of moral agency, in which to be a moral agent is simply to be free, rational, and a person.

Background Pediatric critical care physician attitudes about withdrawal of ventricular assist devices and extracorporeal membrane oxygenation in cases of medical futility are poorly defined. Our aim was to define current attitudes regarding the withdrawal of these devices. Methods IRB-approved, cross-sectional observational survey conducted among pediatric critical care attending physicians and fellow physicians in the United States between 2016 and 2017. Data was collected anonymously and statistically analyzed. Results A total of 158 physicians responded with 67% being attending physicians. Compared to (...) a VAD, a higher percentage had taken care of a patient on ECMO where the device was turned off because care was believed to be futile, including currently. Nearly all reported that it can be ethically permissible to withdraw support from a patient with a VAD and on ECMO, but varied opinions existed as to who should ultimately make this decision if the patient/their family disagrees. More respondents agreed that a patient/their family should agree to withdrawal of VAD or ECMO support prior to initiation if futility is later determined and that protocols should be created for VAD and ECMO withdrawal. Conclusion Most pediatric critical care physicians felt that it can be ethically permissible to withdraw VAD and ECMO support. Our study indicates that pediatric VAD and ECMO withdrawal protocols are desired, but further investigation is needed to determine how to best design protocols that would incorporate multiple stakeholders.
