El propósito de este artículo es fortalecer los vínculos entre las razones de justicia y las razones históricas para justificar el reconocimiento de ciertos derechos en favor de grupos culturalmente diferenciados. Intento con ello mostrar que a la lucha por la defensa de la preservación de ciertas culturas no es marginal, sino más bien esencial, el hecho de que dicha defensa provenga de una historia de exclusión. Acudiendo a ejemplos, en la primera parte del trabajo intentaré integrar algunos rasgos de (...) lo que Charles Taylor entiende por proceso de formación de la identidad al conjunto de etapas que, según Luis Villoro, dan lugar a la proyección de un modelo de justicia. En la segunda parte contaré algunos episodios del reciente proceso de recuperación territorial de la comunidad indígena U'wa en Colombia. El propósito de esta parte del trabajo es fortalecer el vínculo que establece Villoro entre las historias de exclusión y los procesos de consolidación de la justicia. A modo de conclusión y teniendo en cuenta la diferencia planteada por Ernst Tugendhat entre derechos generales y derechos especiales, mostraré en qué medida las historias tristes no dejan de constituirse en contenidos para la justicia una vez que la ley positiva ha consagrado una serie de derechos. Charles Taylor has been one of the most original and influential figures in contemporary philosophy: his 'philosophical anthropology' spans an unusually wide range of theoretical interests and draws creatively on both Anglo-American and Continental traditions in philosophy. A selection of his published papers is presented here in two volumes, structured to indicate the direction and essential unity of the work. He starts from a polemical concern with behaviourism and other reductionist theories (particularly in psychology and the philosophy of language) (...) which aim to model the study of man on the natural sciences. This leads to a general critique of naturalism, its historical development and its importance for modern culture and consciousness; and that in turn points, forward to a positive account of human agency and the self, the constitutive role of language and value, and the scope of practical reason. Zu Beginn standen die Folgen für die Wissenschaften, den Glauben an Gott und die Moralvorstellungen im Vordergrund. Bald kamen Überlegungen über Gesellschaft, Politik, internationale Beziehungen und über Eingriffe bis hinunter auf die Ebene des Individuums und seines Erbmaterials, seiner Gene hinzu. Sozialdarwinismus, Eugenik, Rassismus galten zeitweise als wissenschaftlich legitime Diskussions- und Politikfelder. (...) Befürchtungen vor einem vermeintlichen Niedergang lassen sich bis heute angesichts der Biologisierung des Denkens scheinbar wissenschaftlich-objektiv untermauern. Using data collected at two phases, this study examines why and how ethical leadership behavior influences employees’ evaluations of organization-focused justice, i.e., procedural justice and distributive justice. By proposing ethical leaders as moral agents of the organization, we build up the linkage between ethical leadership behavior and the above two types of organization-focused justice. We further suggest trust in organization as a key mediating mechanism in the linkage. Our findings indicate that ethical leadership behavior engenders employees’ trust in their employing (...) organization, which in turn promotes their justice perceptions toward the organization. The theoretical and practical implications of these findings are discussed, and some directions for future research are suggested. (shrink)

Rawls offers three arguments for the priority of liberty in Theory, two of which share a common error: the belief that once we have shown the instrumental value of the basic liberties for some essential purpose (e.g., securing self-respect), we have automatically shown the reason for their lexical priority. The third argument, however, does not share this error and can be reconstructed along Kantian lines: beginning with the Kantian conception of autonomy endorsed by Rawls in section 40 of Theory, we (...) can explain our highest-order interest in rationality, justify the lexical priority of all basic liberties, and reinterpret Rawls’ threshold condition for the application of the priority of liberty. Perhaps unsurprisingly, this Kantian reconstruction will not work within the radically different framework of Political Liberalism. (shrink)

A number of philosophers have recently argued that we should interpret the debate over moral responsibility as a debate over the conditions under which it would be “fair” to blame a person for her attitudes or conduct. What is distinctive about these accounts is that they begin with the stance of the moral judge, rather than that of the agent who is judged, and make attributions of responsibility dependent upon whether it would be fair or appropriate for a moral judge (...) to react to the agent in various (negative) ways. This is problematic, I argue, because our intuitions about whether and when it would be fair to react negatively to another are sensitive to a host of considerations that appear to have little or nothing to do with an agent’s responsibility or culpability for her attitudes or behavior. If this is correct, then theories which make attributions of responsibility dependent upon the appropriateness of our reactions as moral judges will turn out to be fundamentally misguided. (shrink)

ABSTRACTIt has recently become fashionable among those who write on questions of moral responsibility to distinguish two different concepts, or senses, of moral responsibility via the labels ‘responsibility as attributability’ and ‘responsibility as accountability’. Gary Watson was perhaps the first to introduce this distinction in his influential 1996 article ‘Two Faces of Responsibility’ , but it has since been taken up by many other philosophers. My aim in this study is to raise some questions and doubts about this distinction and (...) to argue that it has led to confusion rather than clarification in debates over moral responsibility. In place of the attributability/accountability distinction, I propose that there is a single concept of moral responsibility underlying our actual moral practices. Reflecting teams play a significant role in family therapy; they broaden perspectives on how family dynamics or problems can be understood. However, what happens when a reflector does not feel compassionate towards a particular family member? There is a risk of biased reflections: families can pick up negative signals, putting the therapeutic relationship at risk. In this paper, I explore how I was supported to explore my lack of compassion for Dad ‘John’. It was only after reaching out to an (...) experienced supervisor who undertook an ‘internalised other’ interview with me – where I played the role of Dad – did my compassion increase. From an ethics of care perspective, I suggest that social professionals need to explore ways to increase empathy and compassion for clients they dislike. If they do not, they are open to valid criticism that they are behaving unethically as professionals. Therefore, there is a need to address deficits in empathy and compassion to sustain ethical social work practices. (shrink)

Where does my body begin? Where does it end? What is inside my body? What is outside? What is primary? What is secondary? What is natural? What is artificial? Science fiction has long imagined a future fusion of humanity with technology. Today, many of us—especially people with health issues such as autoimmune diseases—have functionally become hybrids connected to other machines and to other bodies. The combination of artificial intelligence with implants, transplants, prostheses, and genetic reprogramming is transforming medical research and (...) treatment, and it is now also transforming what we thought was human nature. Mark C. Taylor identifies this process as “intervolution” and explores how it is weaving together smart things and smart bodies to create new forms of life. Our wired bodies are no longer freestanding individuals, but interconnected nodes in worldwide networks. Recognizing this transformation overturns deeply entrenched distinctions and oppositions between minds and bodies. Recently, a number of philosophers have begun to question the commonly held view that choice or voluntary control is a precondition of moral responsibility. According to these philosophers, what really matters in determining a person’s responsibility for some thing is whether that thing can be seen as indicative or expressive of her judgments, values, or normative commitments. Such accounts might therefore be understood as updated versions of what Susan Wolf has called “real self views,” insofar as they attempt to ground (...) an agent’s responsibility for her actions and attitudes in the fact (when it is a fact) that they express who she is as a moral agent. As such, they seem to be open to some of the same objections Wolf originally raised to such accounts, and in particular to the objection that they cannot license the sorts of robust moral assessments involved in our current practices of moral responsibility. My aim in this paper is to try to respond to this challenge, by clarifying the kind of robust moral assessments I take to be licensed by (at least some) non-volitional accounts of responsibility and by explaining why these assessments do not in general require the agent to have voluntary control over everything for which she is held responsible. I also argue that the limited applicability of the distinction between “bad agents” and “blameworthy agents” on these accounts is in fact a mark in their favor. (shrink)

Many of our beliefs are the product of inference and depend on chains of reasoning from other beliefs we hold. Inferential internalism is the view that an inference can only provide justification if one is aware of the support relation that holds between the premises and conclusion. This inferential internalist requirement is controversial even among epistemologists who accept internalist conditions on justification more generally. In this paper, we argue that the intuition underlying a central motivation for internalism more generally is (...) the same intuition that motivates inferential internalism. As such, internalists who reject the more demanding requirements of inferential internalism are prima facie involved in a problematic inconsistency. In this essay I want to consider how Penola's (character in Toni Morrison's novel, The Bluest Eye) circumstance es motivate her petition--"asking for beauty"--and two others, after which I will offer my own petition concerning the practice of aesthetics.

Commercial republicanism is the idea that a properly-structured commercial society can serve the republican end of minimizing the domination of citizens by states (imperium) and of citizens by other citizens (dominium). Much has been written about this idea in the last half-century, including analyses of individual commercial republicans (e.g., Adam Smith and Immanuel Kant) as well as discussions of national traditions of the same (e.g., in America, Britain, France, the Netherlands, and Italy). In this chapter, I review five kinds of (...) arguments that have been historically offered for how commercial society so understood advances the republican ideal of non-domination: first, by simply realizing non-dominating relationships in the marketplace itself (Instantiation); second, by encouraging the growth of a wide middle class that can offer a counterweight to other, dominating classes (Internal Check-and-Balance); third, by increasing the wealth and power of republics vis-à-vis other, dominating states in the international arena (External Check-and-Balance); fourth, by helpfully nurturing bourgeois-civic virtues in republican citizens (Cultivating Virtue); and finally, by transforming dangerous passions into more readily regulable, even socially beneficial material interests (Sublimating Vice). I end the chapter by briefly considering commercial republicanism’s prospects as a continuing research program. (shrink)

Commitment to sparseness amounts to the idea that there is an objective, worldly privileging of certain properties over others that makes the privileged properties suited to play certain roles, and is responsible for their playing such roles. In this chapter I offer a brief, opinionated overview of sparseness. I begin by examining a set of problems that I call “problems of abundance”, which generate canonical motivations for sparseness. I then survey some influential approaches to sparseness and the roles that they (...) attribute to sparse properties, noting that on most approaches sparse properties are deeply connected to inquiry. Finally I consider some problems for sparseness, focusing on the purported connections between sparseness and inquiry, particularly in philosophy of science and inquiry into the social world. (shrink)
