Photographs furnish evidence. This is true in both formal and informal contexts. The use of photographs as legal evidence goes back to the very earliest days of photography, and they have been used in American trials since around the time of the Civil War. Photographs may also serve as historical evidence (for example, about the Civil War). And they serve in informal contexts as evidence about all sorts of things, such as what we and our loved ones looked like in (...) the past. (shrink)

Many have held that photographs give us a firmer epistemic connection to the world than do other depictive representations. To take just one example, Bazin famously claimed that “The objective nature of photography confers on it a quality of credibility absent from all other picture-making” ([Bazin, 1967], 14). Unfortunately, while the intuition in question is widely shared, it has remained poorly understood. In this paper we propose to explain the special epistemic status of photographs. We take as our starting place (...) (in §1) Kendall Walton’s startling proposal that photographs are special because they are “transparent” [Walton, 1984] — that is, that they are special because, unlike other depictive representations, they enable us literally to see their depicta.1 Walton’s proposal has not convinced many; however, it has proven surprisingly difficult to say just what is wrong about the transparency thesis. In §§2–4 we’ll rise to this challenge and show why photographs are not transparent in Walton’s sense. Finally, in §§5–7 we’ll propose and defend a novel diagnosis of what is epistemically special about photographs. (shrink)

We offer a novel theory of information that differs from traditional accounts in two respects: (i) it explains information in terms of counterfactuals rather than conditional probabilities, and (ii) it does not make essential reference to doxastic states of subjects, and consequently allows for the sort of objective, reductive explanations of various notions in epistemology and philosophy of mind that many have wanted from an account of information.

We cannot conceive of a more impartial and truthful witness than the sun, as its light stamps and seals the similitude of the wound on the photograph put before the jury; it would be more accurate than the memory of witnesses, and as the object of all evidence is to show truth, why should not this dumb witness show it?

This paper develops a conceptual model of PhD supervisors’ abuse and exploitation of their students and the outcomes of that abuse. Based on the literature about destructive leadership and the “dark side” of supervision, we theorize about why and how PhD student abuse and exploitation may occur. We offer a novel contribution to the literature by identifying the process through which PhD students experience supervisory abuse and exploitation, the various factors influencing this process, and its outcomes. The proposed model presents (...) the Dark Triad, perceptions of goal blockage, and perceptions of ethical culture as potential characteristics of the PhD supervisor and implies the mediation of the perceptions of power and politics in the relationship between the Dark Triad and student abuse and exploitation. Institutional policies and practices concerning doctoral students and their characteristics are proposed as moderators in such a relationship. Finally, the model suggests that student abuse and exploitation may hinder or even end students’ academic careers. The manuscript discusses the theoretical and practical contributions and managerial implications of the proposed model and recommends further exploration of the dark sides of academia. (shrink)

This paper examines Hermann Cohen's idiosyncratic construction of a medieval Jewish philosophical tradition, focusing primarily, though not exclusively, on his Charakteristik der Ethik Maimunis . This construction, not unlike modern accounts, is filtered through the central place of Maimonides. For Cohen, however, Maimonides' centrality is defined not by his systematization of Aristotelianism, but by his elevation of ethics over metaphysics. The ethical and pantheistic concerns of Maimonides' precursors, according to this reading, anticipate his uniqueness. Whereas Shlomo ibn Gabirol's (...) pantheistic doctrine of emanation, for example, assigned little weight to ethics, Abraham ibn Daud rebelled against such a doctrine. Ibn Daud—much like Bahya ibn Paquda and Abraham ibn Ezra—becomes part of a Jewish philosophical tradition that culminates in Maimonides' rejection of Aristotelian metaphysics. In particular, this paper examines the way in which Cohen envisaged the pre-Maimonidean philosophical tradition, putting his highly critical reading of Shlomo ibn Gabirol and his pantheistic obsession with prime matter in counterpoint with his more favorable readings of Abraham ibn Daud and Bahya ibn Paquda. I distill three somewhat interrelated approaches to the ethical criticism of humor: (1) attitude-based theories, (2) merited-response theories, and (3) emotional responsibility theories. I direct the brunt of my effort at showing the limitations of the attitudinal endorsement theory by presenting new criticisms of Ronald de Sousa’s position. Then, I turn to assess the strengths of the other two approaches, showing that that their major formulations implicitly require the problematic attitudinal endorsement theory. I argue for an effects-mediated responsibility theory , (...) holding that the strongest ethical criticism that can be made of our sense of humor is that it might indicate some omission on our part. This omission could only be culpable in so far as a particular joke could do harm to oneself or others. In response to Ted Cohen’s doubts that such a mechanism of harm is forthcoming, I argue that the primary vehicle of the harmful effects of humor is laughter. (shrink)

Peter Singer argues that when some fail to do their part in alleviating suffering, the rest of us must take up their slack. In response, L. J. Cohen, Liam Murphy, and David Miller argue that such a requirement would be unfair. No one, they contend, should be required to contribute more than she would be required to under full compliance. I argue against Cohen, Murphy, and Miller that we are obligated to take up slack left by noncontributors, but (...) agree that we are thereby treated unfairly. Drawing on the literatures on group causation and moral responsibility, I argue that noncontributors wrong those they fail to help and those who take up their slack. I refer to the latter kind of wrong as “burden dumping.” Furthermore, I argue that my account applies whether we conceive of rescue duties as discretionary or nondiscretionary. One might think that if my duties to rescue do not require me to contribute to any particular rescue effort, I do not dump burdens on anyone when I do nothing. In reply, I argue that when I have a nondiscretionary duty to contribute to a particular rescue effort, I unfairly dump burdens on those contributing to that effort when I fail to do my part. Similarly, when my duty to rescue is discretionary and I do nothing, I unfairly dump burdens on everyone whose rescue efforts I might have contributed to. Using this apparatus, we can account for the force of arguments such as Singer’s as well as the idea that those who dump burdens are blameworthy for treating other rescuers unfairly. (shrink)

The paper suggests that the state is subject to assessment according to principles of social justice because state institutions or practices exercise forms of power over which no particular person has control. This rationale for assessment of social justice equally applies to legally optional or informal social practices. But it does not apply to individual conduct. Indeed, it follows that principles of social justice cannot provide a basis for the assessment and guidance of individual choice. The paper develops this practice-based (...) conception of the subject of justice by rejoining G. A. Cohen's influential critique of Rawls’ focus on the “basic structure” of society. (shrink)

This paper seeks to deflate G. A. Cohen ’s recent meta-ethical argument that fundamental principles must be “fact-insensitive.” That argument does not advance Cohen ’s dispute with Rawls and other social contract theorists. There is attenuated sense of “factinsensitivity” which they can happily grant, which Cohen never rules out on specifically metaethical grounds. While his barrage of substantive arguments may retain independent force, the argument from fact-insensitivity is largely inconsequential.

David R. Blumenthal is Jay and Leslie Cohen Professor of Judaic Studies at Emory University. He has contributed greatly to the growth of Jewish Studies, the place of Judaism in Religious Studies, interreligious dialogue, and the reframing of Judaism in light of the Holocaust, postmodernism, and poststructuralism. The traditional ludomotor activities (LA) are recognized by UNESCO as an intangible piece of cultural heritage. The ethnomotricity analyzes LA in its sociocultural context, taking into account the proprieties of rules or motor conditions (internal logic) and the link with local culture (external logic). The aim of this research was to identify and reveal the distinctive ethnomotor features of LA in order to understand the adaptations that occurred in the social scenario of the Spanish Civil War (1936–1939) in Lleida. The (...) corpus of the research was constituted by 101 LA which were collected from the analysis of 20 semi-structured interviews. An “ad hoc” tool was designed and agreed upon by expert observers. It was comprised of a total of 27 ethnomotor variables related to LA. The experts achieved high reliability [Cohen’s kappa coefficient (κ) and Spearman’s correlation coefficient = 1] when the classification of LA was carried out on two different occasions. Descriptive statistics, cross-tabulations (Pearson’s chi-squared) effect sizes, and two-step clusters were performed by external and internal logic variables. The presence or absence of motor interaction (X2= 9.029;df= 1;p< 0.003;ES= 0.298) was enlightening when comparing LA with and without a war connotation. On the other hand, the hierarchy of variables rested primarily on IL-Domain (Psycho-Coop-Oppo-Coop/Oppo) (PI = 1). Among other singularities, while two-step cluster analysis revealed a corresponding ethnomotor silhouette with cluster 1, with the warlike connotation (n= 48; 96.0%), its homologous structure was expressed (Cluster 2) in the absence of the warlike character (n= 26; 50%). At the turn of the twentieth century, the American surgeon Harvey Cushing (1869-1939) chose to focus his surgical attention on the brain, an organ that had previously proved rather intractable to successful intervention. Over the course of the following decades he made this type of surgery a much safer procedure, reducing the mortality rate from a staggering 50% at the end of the nineteenth century to about 10%. Working first at Johns Hopkins and later at the Peter Bent Brigham hospital (...) in Boston, Cushing established a world-famous school of neurosurgery by training numerous residents and fellows. He also left an extraordinary collection of records and specimens that document his work in surgery: the Cushing Brain Tumor Registry. (shrink)

Consider someone whom you know to be an expert about some issue. She knows at least as much as you do and reasons impeccably. The issue is a straightforward case of statistical inference that raises no deep problems of epistemology. You happen to know the expert’s opinion on this issue. Should you defer to her by adopting her opinion as your own? An affirmative answer may appear mandatory. But this paper argues that a crucial factor in answering this question is (...) the description under which you identify the expert. Experts may be identified under various descriptions (e.g., “the expert appearing on Channel 7 at 5 pm”). Section 2 provides cases that illustrate how deference to a known expert may be appropriate under some descriptions, but not others. Section 3 proposes that, in these cases, the differentiating factor is self-identification: deference to an expert under a given description is appropriate when the expert self-identifies under that description. Section 4 presents a formal framework that demonstrates the sufficiency of self-identification for appropriate deference within a significant class of cases. Section 5 notes a way in which this phenomenon allows for a form of “agreeing to disagree” in Robert Aumann’s sense. Section 6 illustrates the practical application of these results to the case of testimonials. (shrink)

If the global economy seems unfair, how should we understand what a fair global economy would be? What ideas of fairness, if any, apply, and what significance do they have for policy and law? Working within the social contract tradition, this book argues that fairness is best seen as a kind of equity in practice.

This article contains a survey of recent debates in the philosophy of photography, focusing on aesthetic and epistemic issues in particular. Starting from widespread notions about automatism, causality and realism in the theory of photography, the authors ask whether the prima facie tension between the epistemic and aesthetic embodied in oppositions such as automaticism and agency, causality and intentionality, realism and fictional competence is more than apparent. In this context, the article discusses recent work by Roger Scruton, Dominic Lopes, Kendall (...) Walton, Gregory Currie, Jonathan Cohen and Aaron Meskin, Noël Carroll, and Patrick Maynard in some detail. While there are many issues to be raised in using lethal autonomous robotic weapons (beyond those of remotely operated drones), we argue that the most important question is: should the decision to take a human life be relinquished to a machine? This question is often overlooked in favor of technical questions of sensor capability, operational questions of chain of command, or legal questions of sovereign borders. We further argue that the answer must be ?no? and offer several reasons for banning (...) autonomous robots. (1) Such a robot treats a human as an object, instead of as a person with inherent dignity. (2) A machine can only mimic moral actions, it cannot be moral. (3) A machine run by a program has no human emotions, no feelings about the seriousness of killing a human. (4) Using such a robot would be a violation of military honor. We therefore conclude that the use of an autonomous robot in lethal operations should be banned. (shrink)

This discussion responds to important questions raised about my theory of fairness in the global economy by Christian Barry, Charles Beitz, A.J. Julius and Kristi Olson. I further elaborate how moral argument can be ‘internal’ to a social practice, how my proposed principles of fairness depend on international practice, how I can admit several relevant conceptions of ‘harm’ and why my account does not depend on a problematic conception of societal ‘endowments’.

Porphyry, a native of Phoenicia educated in Athens and Rome during the third century AD, was one of the most important Platonic philosophers of his age. In this book, Professor Johnson rejects the prevailing modern approach to his thought, which has posited an early stage dominated by 'Oriental' superstition and irrationality followed by a second rationalizing or Hellenizing phase consequent upon his move west and exposure to Neoplatonism. Based on a careful treatment of all the relevant remains of Porphyry's originally (...) vast corpus, he argues for a complex unity of thought in terms of philosophical translation. The book explores this philosopher's critical engagement with the processes of Hellenism in late antiquity. It provides the first comprehensive examination of all the strands of Porphyry's thought that lie at the intersection of religion, theology, ethnicity and culture. (shrink)

Spurred by a severe shortage of cadaveric organs, there has been a marked growth in living organ donation over the past several years. This has stimulated renewed interest in the ethics of this practice. The major concern has always been the possibility that a physician may seriously harm one person while trying to improve the well-being of another. As Carl Elliott points out, this puts the donor's physician in a difficult predicament: when evaluating a person who volunteers to donate an (...) organ, “a doctor is in the position of deciding not simply whether a subject's choice is reasonable … but whether he [the doctor] is morally justified in helping the subject accomplish it.”1 This question has become even more difficult since the introduction of living donor operations that are more risky than living kidney donation and the suggestion that volunteers at added risk may sometimes be acceptable.2 So, how can we decide when the risk is too much? A right, unlike an interest, is a valid claim, or potential claim, made by a moral agent, under principles that govern both the claimant and the target of the claim. Animals cannot be the bearers of rights because the concept of rights is essentially human; it is rooted in and has force within a human moral world.

Nietzsche claims that we are fated to be as we are. He also claims, however, that we can create ourselves. To many commentators these twin commitments have seemed self-contradictory or paradoxical. The argument of this paper, by contrast, is that, despite appearances, there is no paradox here, nor even a tension between Nietzsche's two claims. Instead, when properly interpreted these claims turn out to be intimately related to one another, so that our fatedness emerges as integral to our capacity to (...) become self-creators. The paper also offers, in the course of undermining a false alternative that is deeply entrenched in the philosophical tradition, a reading of Nietzsche's doctrine of amor fati that actually – and perhaps uniquely – makes full sense of section 276 of The Gay Science, the chief source for this aspect of his thought. The left ventricular assist device was originally designed to be surgically implanted as a bridge to transplantation for patients with chronic end-stage heart failure. On the basis of the REMATCH trial, the US Food and Drug Administration and the US Centers for Medicare & Medicaid Services approved permanent implantation of the left ventricular assist device as a destination therapy in Medicare beneficiaries who are not candidates for heart transplantation. The use of the left ventricular assist device as a destination therapy (...) raises certain ethical challenges. Left ventricular assist devices can prolong the survival of average recipients compared with optimal medical management of chronic end-stage heart failure. However, the overall quality of life can be adversely affected in some recipients because of serious infections, neurologic complications, and device malfunction. Left ventricular assist devices alter end-of-life trajectories. The caregivers of recipients may experience significant burden (e.g., poor physical health, depression, anxiety, and posttraumatic stress disorder) from destination therapy with left ventricular assist devices. There are also social and financial ramifications for recipients and their families. We advocate early utilization of a palliative care approach and outline prerequisite conditions so that consenting for the use of a left ventricular assist device as a destination therapy is a well informed process. These conditions include: (1) direct participation of a multidisciplinary care team, including palliative care specialists, (2) a concise plan of care for anticipated device-related complications, (3) careful surveillance and counseling for caregiver burden, (4) advance-care planning for anticipated end-of-life trajectories and timing of device deactivation, and (5) a plan to address the long-term financial burden on patients, families, and caregivers. Short-term mechanical circulatory devices (e.g. percutaneous cardiopulmonary bypass, percutaneous ventricular assist devices, etc.) can be initiated in emergency situations as a bridge to permanent implantation of ventricular assist devices in chronic end-stage heart failure. In the absence of first-person (patient) consent, presumed consent or surrogate consent should be used cautiously for the initiation of short-term mechanical circulatory devices in emergency situations as a bridge to permanent implantation of left ventricular assist devices. Future clinical studies of destination therapy with left ventricular assist devices should include measures of recipients' quality of end-of-life care and caregivers' burden. (shrink)

Susan Okin has written an important book on justice and the family. Animated by the experiences that contemporary feminism has sought to articulate, and guided by a principled hostility to the subordination of women that continues to disgrace American life, she argues that the current ordering of domestic life in the United States is unjust and that its alteration ought to be made a matter of public policy.Families, according to Okin, are not havens in an otherwise heartless world. Instead the (...) current division of domestic labor marks them as the centerpiece of a broader system of inequalities between men and women. Justice condemns those inequalities and commands their remedy through the transformation of our domestic practices. Because the division of domestic labor is so fundamental to injustice, we need in particular to ‘encourage and facilitate’ equal sharing by parents in the responsibilities of child-rearing, and in the more quotidian chores that provide the material foundation of modern domesticity. Even as “dynamic” policies have proven successful in several recent development success stories, the current system enforces a “static,” laissez-faire system of comparative advantage that threatens to consign poorly-endowed countries to a low-productivity, low-income destiny in agriculture and raw materials. I discuss two very different fairness arguments in favor of allowing and encouraging “dynamic,” pro-development polices: an argument from “structural (...) equity” and an argument from “equity of fortune.” I suggest that the former is of more central importance, and that the difference between the two kinds of fairness argument shows why Rawls’s original objection to the system of natural liberty does not imply “luck egalitarianism.”.
