This paper examines the conceptual development of the philosophical justifications for tyrannicide. It posits that the political philosophy of tyrannicide can be categorised into three distinct periods or models, the classical, medieval, and liberal, respectively. It argues that each model contained unique themes and principles that justified tyrannicide in that period; the classical, through the importance attached to public life and the functional role of leadership; the medieval, through natural law doctrine; and the liberal, through the postulates of (...) social contract theory. Subsequent analysis of these different models however, reveals that these historical models are unable to provide a sufficient philosophical basis for a contemporary justification of tyrannicide. In Part II, it will be contended that a reinvigorated conception of self-defence, a theme common to all three models, when coupled with the modern notion of universal human rights, may provide the foundation for a contemporary theory of tyrannicide. The conceptualization of human agency is one of the oldest and most debated challenges in political theory. This essay defends the continuous relevance of this endeavour against a proliferating theoretical pessimism. Instead of engaging the much rehearsed structure-agency debate, the author conceptualizes agency in relation to discourses. However, such an approach inevitably elicits suspicion. Is discourse not merely a faddish term, destined to wax and wane with fleeting intellectual trends of the postmodern and poststructural kind? Does the concept (...) of discourse, as many fear, suck us into a nihilistic vortex and deprive us of the stable foundations that are necessary to ground our thoughts and actions? Not so, argues this essay, and defends an anti-essentialist stance as the most viable chance for retaining an adequate understanding of how people situate themselves as agents and influence their socio-political environment. The ensuing analysis, which focuses on everyday forms of resistance, demonstrates how the very acceptance of ambiguity, often misrepresented as relativism, is a crucial precondition not only for the conceptualization of human agency, but also for its actual application in practice. Comparative political theory is at best an embryonic and marginalized endeavor. As practiced in most Western universities, the study of political theory generally involves a rehearsal of the canon of Western political thought from Plato to Marx. Only rarely are practitioners of political thought willing (and professionally encouraged) to transgress the canon and thereby the cultural boundaries of North America and Europe in the direction of genuine comparative investigation. The mass movement of people across the globe constitutes a major feature of world politics today. -/- Whatever the cause of the movement - often war, famine, economic hardship, political repression or climate change - the governments of western capitalist states see this 'torrent of people in flight' as a serious threat to their stability and the scale of this migration indicates a need for a radical re-thinking of both political theory and practice, for the sake of (...) political, social and economic justice. -/- This book argues that there is at present a serious gap between the legal and social practices of immigration and naturalisation in liberal democratic states and any theoretical justification for such practices that can be made within the tradition of liberal political philosophy. How can liberal states develop institutions of democratic citizenship and at the same time justifiably exclude 'outsiders' from participating in those institutions? The book examines various responses to this contradiction within the liberal tradition, and finds none of them satisfactory - there are no consistently liberal justifications for immigration control and this has serious implications both for liberal practice and theory. Re-thinking the political workings of habit and habituation, this article suggests, is vital to understanding the logics and possibilities of social change today. Any endeavour to explore habit’s affirmative potential, however, must confront its legacies as a colonialist, imperialist and capitalist technology. As a means to explore what it is that differentiates contemporary neoliberal modes of governing through habit from more critical approaches, this article compares contemporary ‘nudge’ theory and policy, as espoused by the behavioural economist Richard Thaler (...) and the legal scholar Cass Sunstein, with the pragmatist philosophies of habit offered by John Dewey, William James and Shannon Sullivan. While nudge advocates focus on how policy-makers and corporate leaders can intervene in the ‘choice architectures’ that surround us to outsmart or bypass problematic human tendencies, I argue, pragmatist philosophers appreciate the necessity of collective efforts to develop new and flexible forms of habituation in order to engender more enduring and democratic forms of social transformation. The paper seeks to show that there is a distinctive and consistent method in the political thought of Hannah Arendt. It is argued that this method constitutes a salutary and potentially challenging alternative to conventional approaches in contemporary political theory. In contrast with approaches that adopt an unfortunately abstracted standpoint, resulting from the insistence that political theory answer formally to the requirements of philosophy, Arendt adopts a more mediated and phenomenologically sensitive standpoint. Rejecting influential (...) attributions to Arendt of a method resting on the use of narrative form, the paper identifies key mediations — epistemological and temporal — expressed in modulations of the theoretical voice which mark out Arendt's approach as one which aims at 'saving the appearances' of the public realm. These mediations are identified, explored and exemplified by reference to a number of Arendt's key works. This way of characterizing Arendt's distinctive method is then used to shed light on the question of the 'missing' normative dimension to her work. He recognized that the same word can have varying criteria of application depending on the purpose of the practice that requires a criterion. Some criteria for a practice are good and some bad. A wise ruler knows which criteria are good and appropriate to ruling. Ludwig Wittgenstein's work has been widely interpreted and appropriated by subsequent philosophers, as well as by scholars from areas as diverse as anthropology, cultural studies, literary theory, sociology, law, and medicine. The Grammar of Politics demonstrates the variety of ways political philosophers understand Wittgenstein's importance to their discipline and apply Wittgensteinian methods to their own projects. The international community has long been affected by the political, philosophical and ethical issues surrounding the practice of tyrannicide, defined as the targeted killing of a tyrant. However, there exists no specific international legal instrument that concerns the practice of tyrannicide, rendering the legitimacy of the practice ambiguous. This paper aims to investigate the issue of tyrannicide and offers a number of speculative arguments concerning its legal-philosophical status. It finds that there are essentially two arms of international legal jurisprudence (...) that may regulate the practice of tyrannicide. The first is largely prohibitive and is based on the derived legal arguments against assassination involving the element ofperfidy, relevant extradition law, provisions in the Hague, Geneva and New York Conventions, and the prohibition on the use of force in the UN Charter. The second position, though far more radical and speculative, is more permissive regarding the moral legitimacy of tyrannicide. This position is based on arguments from the classical international theorists Gentili, Grotius and Vattel, contemporary human rights standards, the principle of humanitarian intervention, the duty to protect, and legal category of hostis hutnani generis. It is argued that though the vast majority of international legal principles are indicative ofthe illegality oftyrannicide, that the practice may nevertheless be philosophically legitimated under humanitarian principles. Poteat have, in their epistemological and phenomenological theories, articulated what amounts to a conception of the Holy Spirit in non-theological terminology, but that this conception needs to be more explicitly theologically informed to be refined.

This book advances a theory of personal, public and political justification. Drawing on current work in epistemology and cognitive psychology, the work develops a theory of personally justified belief. Building on this account, it advances an account of public justification that is more normative and less "populist" than that of "political liberals." Following the social contract theories of Hobbes, Locke and Kant, the work then argues that citizens have conclusive reason to appoint an umpire to resolve (...) disputes arising from inconclusive public justifications. A prevailing understanding of realism, chiefly among its critics, casts realists as those who seek a ‘distinctively political normativity’, where this is interpreted as meaning nonmoral in kind. Moralists, on this account, are those who reject this and believe that political normativity remains moral. Critics have then focused much of their attention on demonstrating that the search for a nonmoral political normativity is doomed to fail which, if right, would then seem to fatally undermine the realist endeavour. This paper makes the case that casting the difference between realism and moralism in these terms is a mistake, one which overlooks the substantial body of realist work which is clear that it has no such aspirations to develop a nonmoral political normativity. The hope is that in drawing attention to this mistake a line can be drawn under these unhelpful debates, and we can move on to more fruitful constructive and critical discussions between realists and their critics. One of the central difficulties for practitioners of cognate disciplines like comparative political theory and comparative philosophy concerns the hermeneutic problem of understanding that which is different. The philosophical challenge, put briefly, is this: Is it possible to bring something of an entirely different order into our world of understanding without imposing our own epistemological categories and civilizational prejudices on it? This essay focuses on recent exemplary work in comparative political theory that has explicitly grappled (...) with this issue. Examined here are three models of encountering and learning from different traditions of thought—the models of existential immersion, conversion, and pilgrimage—as exemplified in the contributions by Farah Godrej, Leigh Jenco, and J. L. Mehta. The essay shows that while the first two authors have sought to resolve the problem of the encounter with difference methodologically (Godrej) and epistemologically (Jenco), their respective solutions remain implicitly bound to a spectator theory of knowledge. This becomes especially evident when their work is contrasted with Mehta’s own. Unlike Godrej and Jenco, Mehta does not view difference as a problem to be resolved. The advantage of his approach, I argue, is that it provides liberation from the rigid subject-object dichotomy which encourages the view that the ‘objects’ of our knowledge exist prior to and wholly apart from the act of knowing. Mehta’s work, therefore, opens the possibility for redirecting our attention to a question that has thus far been thoroughly avoided in the consolidation of the subfield: the question of the very constitution of difference or heterology. How should political theorists go about their work if they are democrats? Given their democratic commitments, should they develop theories that are responsive to the views and concerns of their fellow citizens at large? Is there a balance to be struck, within political theory, between truth seeking and democratic responsiveness? The article addresses this question about the relationship between political theory, public opinion and democracy. I criticize the way in which some political theorists have (...) appealed to the value of democratic legitimacy in an attempt to justify a more opinion-sensitive approach to their work. Specifically, I identify a problematic model in the existing literature, which I term ‘democratic restraint’: an approach on which the theorist moderates her normative principles in response to evidence about public attitudes in order to enhance the legitimacy of her account. This model renders the discipline newly vulnerable to an otherwise misguided objection that political theory seeks to pre-empt democratic politics. I trace the problem with the democratic restraint model to its flawed underlying conception of democratic legitimacy. The article then outlines a more appealing ‘democratic underlabourer’ view of the status of political theory and draws out the implications of this alternative account for the role of public opinion. ABSTRACT This article examines the under-researched figure A.W. Rehberg in his exchange with Kant over the relationship between theory and practice in the philosophy of right. I argue that Rehberg raises, what I call, two problems of political matter which attempt to show that Kant's overly formal approach to political theory cannot justifiably determine political practice. The first problem is the problem of positive determinations of right, rather than merely negative prohibitions. Rehberg takes this (...) to mean that Kant cannot determine us to a specific form of constitution. I argue that Kant's innovation of intelligible property functions as a response to this critique in that it provides the possibility of synthetic propositions of right a priori. Second, Rehberg insists that an a priori system of right cannot relate to already formed historical communities. Here Kant's response comes close to agreeing with Rehberg as Kant takes prudential or historical reasoning to harmonize with the demands of a priori right in order to applied to the sensible world. Kant, in this instance, comes closer to Rehberg by denying centralized enlightened monarchy and the reliance on natural and historical development for the application of right. (shrink)

Over the course of the past few decades, comparative political theory has acquired a measure of institutional legitimacy and intellectual recognition as part of the ongoing, interdisciplinary challenge to prevailing academic categories, coordinates, and borders. This arrival has been accompanied by a conspicuous focus on methodology both by those who claim the mantle of comparative political theory and those who reject it. The following reflections read this focus symptomatically, as revealing intellectual, institutional, and professional exigencies rather (...) than as distinct to any particular scholar, argument, or publication. Neither a “state of the field” nor a proprietary defense of what comparative political theory is or should be, these observations toggle back and forth between reflections on my own engagement and disengagement with the topic of comparative political theory on the one hand and, on the other, concerns about how this preoccupation with method simultaneously expresses and exacerbates the displacement of politics in the very field that aims to understand it. Among the questions I raise are: What might be driving this disproportionate focus on methodological arguments in and about comparative political theory? What are the stakes of such a focus, particularly for younger scholars in political science departments decreasingly hospitable to political theory? Se propone una respuesta doble a la objeción de inutilidad derivada de obra de Rawls. ENGLISH: The assumption of strict obedience, and other features of the well ordered society (WOS), is a great idealization that Rawls does from the actual and historical circumstances in which contemporary societies exist. From there comes the objection according to which the whole Project of justice as fairness is just useless, for it has no purpose at all to know what would it be the principles of justice for a well ordered society that only exist in theory. The aims of this paper are to make clear the meaning of the well ordered society’s assumption - the society which the ideal theory takes care of -; to point out the links between this kind of theory and the methodology of the political philosophy and the notion of feasibility; and to look again the useless objection in the light of the above considerations. Before the useless objection, it is proposed a twofold answer that could be inferred from Rawls work. (shrink)

Some say that public policy can be made without the benefit of theory--that it emerges, instead, through trial-and-error. Others see genuine philosophical issues in public affairs but try to resolve them through fanciful examples. Both, argues Robert E. Goodin, are wrong. Goodin--a political scientist who is also an associate editor of Ethics--shows that empirical and ethical theory can and should guide policy. In contemporary democracies, global capitalism exerts a significant influence over how state power is exercised, raising questions about where political power resides in global politics. This question is important, since our specific considerations about justifiability of political power, i.e. political legitimacy, depend on how we characterize political power at the global level. As a partial answer to this question, I argue that our notion of global political legitimacy should be reoriented to include the structural power (...) of the Transnational Capitalist Class as its subject matter. Structural power is a social relation in which the institutional context makes some agents comply with others’ preferences regardless of actors’ intentional efforts to bring about such outcomes. Even when global business elites do not intentionally exercise power to obtain political control of global governance, their structural power has recognizable effects that partly enforce the world order. To advance my claim, I utilize the radical realists’ argument that the notion of legitimacy is applicable to a broader range of social practices that are beyond dyadic power relations, i.e. rulers intentionally exercising power over subjects. A challenging new work of cultural and political theory rethinks the concept of hegemony.
