Trade union leaders serve dual, seemingly contradictory roles. They must command militant organizations in conflicts with employers. Simultaneously, they must be accountable and democratically responsive to their members. Few unions possess the institutions or leadership to accomplish both. This article analyzes the practices of the International Longshore and Warehouse Union, in which effective contract negotiation and an informed, active rank-and-file democracy are mutually supportive. We offer an alternative to standard accounts of union democracy. People are often offended by beliefs, expect apologies for beliefs, apologize for their own beliefs. In many mundane cases, people are morally criticized for their beliefs. Intuitively, then, beliefs seem to sometimes wrong people. Recently, the philosophical literature has picked up on this theme, and has started to discuss it under the heading of doxastic wrongdoing. In this paper we argue that despite the strength of such initial intuitions, at the end of the day they have to be rejected. If (...) it can be ever truthfully asserted that beliefs wrong, this is always derivative – beliefs wrong only in virtue of other things (like evidence-gathering actions) wronging. We distinguish between modest and ambitious doxastic wrongdoing theories (the former deny, while the latter accept, the possibility of a morally wrong yet epistemically permissible belief); we argue that each of these options faces insurmountable problems; and we offer partly debunking explanations of the intuitions purportedly supporting doxastic wrongdoing. Statistical evidence—say, that 95% of your co-workers badmouth each other—can never render resenting your colleague appropriate, in the way that other evidence (say, the testimony of a reliable friend) can. The problem of statistical resentment is to explain why. We put the problem of statistical resentment in several wider contexts: The context of the problem of statistical evidence in legal theory; the epistemological context—with problems like the lottery paradox for knowledge, epistemic impurism and doxastic wrongdoing; and the context of a (...) wider set of examples of responses and attitudes that seem not to be appropriately groundable in statistical evidence. Regrettably, we do not come up with a fully general, fully adequate, fully unified account of all the phenomena discussed. But we give reasons to believe that no such account is forthcoming, and we sketch a somewhat messier account that may be the best that can be had here. (shrink)

Openness and transparency are becoming hallmarks of responsible data practice in science and governance. Concerns about data falsification, erroneous analysis, and misleading presentation of research results have recently strengthened the call for new procedures that ensure public accountability for data-driven decisions. Though we generally count ourselves in favor of increased transparency in data practice, this Commentary highlights a caveat. We suggest that legislative efforts that invoke the language of data transparency can sometimes function as “Trojan Horses” through which other political (...) goals are pursued. Framing these maneuvers in the language of transparency can be strategic, because approaches that emphasize open access to data carry tremendous appeal, particularly in current political and technological contexts. We illustrate our argument through two examples of pro-transparency policy efforts, one historical and one current: industry-backed “sound science” initiatives in the 1990s, and contemporary legislative efforts to open environmental data to public inspection. Rules that exist mainly to impede science-based policy processes weaponize the concept of data transparency. The discussion illustrates that, much as Big Data itself requires critical assessment, the processes and principles that attend it—like transparency—also carry political valence, and, as such, warrant careful analysis. The law views with suspicion statistical evidence, even evidence that is probabilistically on a par with direct, individual evidence that the law is in no way suspicious of. But it has proved remarkably hard to either justify this suspicion, or to debunk it. In this paper, we connect the discussion of statistical evidence to broader epistemological discussions of similar phenomena. We highlight Sensitivity – the requirement that a belief be counterfactually sensitive to the truth in a specific way – as (...) a way of epistemically explaining the legal suspicion towards statistical evidence. Still, we do not think of this as a satisfactory vindication of the reluctance to rely on statistical evidence. Knowledge – and Sensitivity, and indeed epistemology in general – are of little, if any, legal value. Instead, we tell an incentive-based story vindicating the suspicion towards statistical evidence. We conclude by showing that the epistemological story and the incentive-based story are closely and interestingly related, and by offering initial thoughts about the role of statistical evidence in morality. In the process, he argues against our Sensitivity-related account of statistical evidence. Here we revisit these issues, partly in order to respond to Pardo, and partly in order to make general claims about legal epistemology. Consequently, parts of Hume's own work are stripped of meaning, isolated as they are from later (...) developments. The puzzles about Smith's analysis which I find illuminated by Hume's are the following: 1. Why does Smith both defend the importance of economic growth for the material of well-being of the working class and claim that property originates as spoil, impoverishing the working class? After all, in the classical system the existence of property is one requisite for economic growth. 2. Why does Smith exalt the assumption of self-interested behavior in private activity but claim that irrationality dominates the political process? 3. Why does Smith deny the importance of benevolence in Wealth of Nations and insist on the importance of morality Sentiment morality in Theory of Moral its?3 The three questions have a common feature: they are related to the question of how public goods are provided. The particular public good in question is the institution of private property. As with all true I am obligated to the Center for Study of Public Choice for generous support of my research. Ill public goods, society considered as a whole benefits from having such an institution, but each individual considered separately can gain by anti-social behavior.4 Public goods provide a considerable difficulty for any social institution; neither competition in the market nor government requests that individuals reveal how much they wish to be taxed are certain to be efficient. There are aspects of the classical economic analysis which stress the importance of moral information as a partial solution to the public goods problem. By "moral information" I only require that the theory is employed as a guide and that if an individual acts contrary to the theory, this choice is not cited as "falsifying" the theory. Rather, something is said to be "wrong" or "wicked" about the choice.6 Much of modern economic analysis assumes that individuals have perfect information; this postulate rules out any significant role for moral information in the provision of the public goods. To avoid assuming away such a role for morality, we will drop the perfect information assumption and then examine if we can make sense of the classics' attack on the public goods problem. Of course, the specification that individuals see their own interests very poorly is consistent with Smith's general approach. The technique employed below is to look at the issue which Hume and Smith addressed as a problem in modern economics. The key difficulty is to determine under what conditions moral information could guide individuals with very imperfect perceptions to maximize their utility. In particular, suppose we find that moral guidance tells an individual how efficiently to produce. Is this morality self-enforcing or are resources required to persuade people to act in accord with these teachings? If resources are required, we will not pay much attention to just how this persuasion 112 is provided, e.g., whether we tell people that theft is "evil" or whether we hang a few thieves. General production theory tells us we probably will do both, but this is a separate issue. The argument to be advanced is that moral information has self-enforcement properties in private activities but these properties are missing in public activities. In this account, then, real resources will be required for implementing the morality. This consideration in turn raises an interesting issue. If the government expends these resources, what reason is there to believe that they will be provided to serve the public interest and not the interest of the government? The Greek poets and philosophers, united in a belief that men and women perceive the world around them very poorly, for this reason describe much of human behavior as fumbling for happiness in the dark. By contrast, perception failure is anathema to the modern tradition, as even the most innocent sort plays havoc with modern preference axioms.

The Global Reporting Initiative (GRI) has successfully become institutionalized as the preeminent global framework for voluntary corporate environmental and social reporting. Its success can be attributed to the “institutional entrepreneurs” who analyzed the reporting field and deployed discursive, material, and organizational strategies to change it. GRI has, however, fallen short of the aspirations of its founders to use disclosure to empower nongovernmental organizations (NGOs). The authors argue that its trajectory reflects the power relations between members of the field, their strategic (...) choices and compromises, their ability to mobilize alliances and resources, and constraints imposed by the broader institutions of financial and capital markets. The authors draw three notable implications from this study. First, institutional theory needs to pay more attention to economic structures, strategies, and resources. Second, institutional entrepreneurship by relatively weak societal groups such as NGOs is inherently constrained by the structural power of wider institutions and by the compromises required to initiate change. Recent discourses about the legitimacy of homeopathy have focused on its scientific plausibility, mechanism of action, and evidence base. These, frequently, conclude not only that homeopathy is scientifically baseless, but that it is “unethical.” They have also diminished patients’ perspectives, values, and preferences. We contend that these critics confuse epistemic questions with questions of ethics, misconstrue the moral status of homeopaths, and have an impoverished idea of ethics—one that fails to account either for the moral worth of care and of (...) relationships or for the perspectives, values, and preferences of patients. Utilitarian critics, in particular, endeavour to present an objective evaluation—a type of moral calculus—quantifying the utilities and disutilities of homeopathy as a justification for the exclusion of homeopathy from research and health care. But these critiques are built upon a narrow formulation of evidence and care and a diminished episteme that excludes the values and preferences of researchers, homeopaths, and patients engaged in the practice of homeopathy. We suggest that homeopathy is ethical as it fulfils the needs and expectations of many patients; may be practiced safely and prudentially; values care and the virtues of the therapeutic relationship; and provides important benefits for patients. Eros and Socratic Political Philosophy offers a new account of Plato's view of eros, or romantic love, by focusing on a question which has vexed many scholars: why does Plato's Socrates praise eros highly on some occasions but also criticize it harshly on others? Behavioural experiments are one of the central and most powerful methods of intervention in cognitive therapy. Yet until now, there has been no volume specifically dedicated to guiding physicians who wish to design and implement behavioural experiments across a wide range of clinical problems.The Oxford Guide to Behavioural Experiments in Cognitive Therapy fills this gap. It is written by clinicians for clinicians. We consider Hume's “other rational species” problem to see whether Smith's wider sympathetic principle would alter Hume's conclusion that “superior” beings will enslave “inferior” beings. We show that Smith introduces the notion of “generosity,” which functions as if it were Hume's justice even when there is no possibility of contract.

The interpretative problem confronting an individual is that of reconstructing two pieces ofinformation, (...) distance d and magnitude m, from one datum T. Let the ratio ofm/d form arctan T. How do we come to distinguish between the pair m1,d1 and the pair m2,d2 when m^d 1 = m2/d2? How do we distinguish big objects at a distance from small objects up close? The evidence Berkeley provides for this thesis is of a funny sort. He gives examples that we do, in fact, distinguish large distant objects from small near objects. Since the arctan of the pair m1, d 1 is by hypothesisthe sameas thatofthepairm2, d2thenrecognizingdistance must be alearned abihty. We cannotextractd and m from? alone. The proper interpretation ofBerkeley's philosophy ofscience is a matter of considerable debate.1 Nonetheless, as a working theorist of visual perception he is afairly simple-minded falsificationist. The negative reaction to Berkeley's theory starts in 1842 with Samuel Bailey who pronounced himself mystified by the very claim that we learn to perceive distance. LEVY The missing social dimension The problem, as I see it, with Berkeley's proposed critical test—stipulating his own doctrine—is that a blind person would grow up in a sighted community. Perhaps, if he grew up in a blind community, and most of the community became sighted at the same time he did, all the community might be able to perceive distance. The problem with Berkeley's test is that ifhe himself is correct about the importance ofheuristics in making the visual distinctions, the fate of one individual is somewhat beside the point. One individual surely cannot create the necessary heuristics. This learning requires some evolutionary social process. Thus, while Berkeley's thesis requires some claim about some verybasicsocial epistemology(Fuller 1988), his proposed test, asking about a blind person growing up in a community silently presumed to be sighted, does not take into account the social dimension oflearning. Having said this, it is easy to think ofa better test for Berkeley's theoryofvision. Let us find an entire community where life takes place without the visual perception of great distance. Take any individual from this community and ask Berkeleian questions. Now, we know the answer becausejust such a dialogue was reported thirtyyears ago. One society which fulfils the test criterion is that ofthe BaMbuti people who lived their life in a very dense African forest. I shall argue rst that Wittgenstein’s philosophy—speci cally in his ideas concerning ethics—can help resolve a challenge such as he imagined his brother Paul faced. My argument faces an immediate di culty. Though Wittgenstein was famously deeply concerned with ethical or moral matters, he also maintained that the will was powerless to e ect change in the world, because will and world were wholly independent. But if the will is powerless, then what is left for the expression of someone’s ethical (...) engagement with the world? It is as if, by this claim, Wittgenstein erased ethics, contrary to what we know of his interests and contrary to what I am arguing. Therefore I shall argue second that we can honor Wittgenstein’s serious interest in ethics by distilling and elaborating from his conception of the will as powerless an account of morality that is not dependent on the power to act, i.e., on agency, but which still gives a place for engaging one’s moral challenges. This account is, I suggest, a plausible reconstruction of Wittgenstein’s view of ethics as it is sparingly set out in his writings. The account I attribute to Wittgenstein is of additional philosophical interest for its revisionary implications for contemporary moral theories. An Morality without agency 263 emphasis on instrumental action as the exemplar of moral response can dis- tort moral philosophy. Moral philosophy, I shall claim, does not wait on theories of action or on what they presuppose, namely agency. To support this claim, I propose—following the reconstruction of Wittgenstein’s account of morality without agency—to suppose that we lack the power to act. Then we can see how little changes in the possibilities for moral understanding and response. If an intelligible account of morality can be recovered without action or agency, then there is a prima facie reason to doubt that action or agency is central to morality. I shall proceed in four sections. First, I shall set out Wittgenstein’s view of ethics based on his three central themes. Second, I shall reconstruct his view in a way that makes it more plausible and reduces its dependence on pecu- liarities of his philosophy. Third, I shall use Wittgenstein’s reconstructed ethical views to engage contemporary views. Finally, I will return to the challenge that Wittgenstein’s brother faced. (shrink)

I provide an explanation of moral understanding. I begin by describing decisions, es- pecially moral ones. I detail ways in which deviations from an ideal of decision-making occur. I link deviations to characteristic critical judgments, e.g. being cavalier, banal, coura- geous, etc. Moral judgments are among these and carry a particular personal gravity. The question I entertain in following chapters is: how do they carry this gravity? In answering the question, I try “external” accounts of moral understanding. I distin- guish (...) between the ideas of a person and a life. The idea of a life essayed is of a network of relations to others. The character of those relations, e.g. friendship, is the object of our understanding of ourselves and our lives. I argue that one’s understanding of oneself conditions the context of decision-making. I elaborate one way of making moral under- standing answerable to truth using Plato’s metaphysics in the Philebus. Truth is valued and truth is essential to the independence of the moral such that seeming right and being right are distinct. However, truth is neither primary nor exhaustive of morality, because we have additional distinct resources for morally judging others. I turn instead to an “internal” account of moral understanding to answer the question regarding the personal gravity of moral criticism. Using Winch’s work on universalizabil- ity and fellowship, I argue that our conception of others must be sufficient to reflect their individuality within our moral understanding. Second, using Gaita’s work on remorse and the lucidity of self-reflection, I argue that the truth about ourselves and the wrong we do others can arrest and constrain our moral understanding and our authority. Moral understanding operates in a social milieu: argument, conversation and rational- ity. Arguments are grounded in meanings with primary (shared) sense, but solicit agree- ment in secondary sense—of what is similar, of what follows. Meaning in the secondary sense can be necessarily practical, creating practical necessities within points of view. Accounting for the consequences and understanding of disagreement is identified as pressing. An original contribution is the idea of critical authority. One’s articulation of moral meaning is controlled via the critical authority expressed using critical vocabulary. Accepting another’s critical authority is based, in differing domains, on our relation to them, e.g. friendship, trust, fellowship. The nature of inter-personal relations are delim- ited by the critical authority characteristic of those relations. Critical authority explains the independent and personal force of moral criticism. To be intelligible depends on accepting some critical authorities, though I allow for the intelligible repudiation of morality in some circumstances. Wronging someone is ex- plained as denying his critical authority, thus denying his relation to oneself, and thereby undermining his place in the moral world. The consequence of wrongdoing is the disinte- gration of the moral world. I defend against Nagel’s realism and Korsgaard’s constructivism. Both are committed to judging individuals but their accounts of morality undermine the intelligibility of the personal gravity of moral criticism. Developing the idea of Moral Consensus, I defend myself against the related charge of relativism. (shrink)

In Plato’s Gorgias, Socrates argues that philosophy is superior to rhetoric in part because the former is a techne while the latter is not. I argue that the Socratic practice of philosophy within this dialogue fails to qualify as a techne for exactly the same reasons that rhetoric fails to qualify as a techne. In doing so, I introduce a new kind of Socratic ignorance: methodological ignorance. I reject both Charles Kahn’s account of the relationship between the dialogue’s dramatic and (...) philosophical contents, and Thomas Brickhouse and Nicholas Smith’s claim that Socrates never regarded his practice as a techne. Focusing mainly on Plato’s Phaedrus, Levy intends to reflect on the way Socrates characterizes his philosophizing in contrast to the intellectual activity of the sophists. Levy’s chapter takes up specifically the question of the character of the self-knowledge Socrates is seeking, why talking to others contributes to his self-knowledge, why Socrates is interested in and respectful of eros, and the character of Socrates’ interest in educating others.

Two prominent normative theories of business ethics are stakeholder and shareholder theory. Business ethicists generally favor the former, while business people prefer the latter. If the purpose of business ethics is “to produce a set of ethical principles that can be both expressed in language accessible to and conveniently applied by an ordinary business person” , then it is important to examine this dichotomy.While superficially attractive, the normative version of stakeholder theory contains numerous limitations. Since balancing multiple stakeholder preferences is (...) difficult, competing claims often become tests of political strength rather than justice. Furthermore, stakeholder theory has significant normative weaknesses.Although less attractive to academic ethicists, shareholder theory may provide superior results for society. The shareholder model focuses companies on meeting society’s material needs. Wise owners often balance other stakeholders’ views well since it is necessary for the business’s long-term success. Finally, shareholder theory has a strong normative basis in autonomy.In light of this analysis, it is incumbent upon academic business ethicists to emphasize the value of shareholder theory when teaching business ethics courses. Knowing the factors that executives deem critical to governance change can improve our understanding of how such changes come about and can help us evaluate those changes. Interviews with business and finance executives at 11 colleges reveal the importance to governance change of chief executive and board member leadership and interactions, as well as executive communication style. Costs are clear constraints to action, particularly since benefits are not quantified and are difficult to describe. Efforts to discuss governance with internal stakeholders (...) require persistence to overcome narrow, individualized concerns. Communication about governance to external stakeholders is rare and represents a missed opportunity for stakeholder feedback and the development of trust. Executives appear willing to adopt governance forms without considering the idiosyncrasies of their institutional field, limiting the working definition of governance and its potential. For corporations and not‐for‐profit enterprises these findings hold implications for the context in which leadership is exercised and the shape of governance structures. They also pose a fundamental ethical dilemma for leaders to address. (shrink)
