This essay argues that the inherent value of Indigenous African Religions, which ensures that the belief in different gods does not eclipse the fact of common humanity might be of importance to contemporary Africa plagued by ceaseless conflicts. The IAR ideology contrasts, for example, with that of Christianity which views the Christian God as the one true God and regards those who worship a different God as pagans and gentiles. It also contrasts with the ideology of Islam, which views (...) Allah as the one true God and regards those who worship different God as infidels. The essay claims that social orientation in contemporary Africa is mostly influenced by the divisive ideologies of these two foreign religions that have come to dominate. These divisive ideologies are to a large extent, indirectly responsible for some of the violent conflicts on the continent. This divisive religious orientation bifurcates humanity into in and out-groups that are extended to the social sphere where people from different religious, ethnic and linguistic groups are treated as outsiders and are made targets for attacks like in South Africa and Nigeria today. Further, if we interpret such violent conflicts as evil and consider its source in light of the perennial problem of evil, what would be our response? Using the conversational method, the essay argues that both good and evil are part of the universe, and that if we want more good, then a change from a divisive to a complementary orientation based on the relational values of the IARs is imperative. Within the Irish government there is a discussion regarding the possibility of limiting the legal protection afforded to the confessional secret. This paper addresses the question of whether this suggestion, if it were to be implemented by the legislature, would be compatible with the right to religious freedom under Article 9 of the European Convention on Human Rights (ECHR). This text will also highlight the role of the confessional secret in canon law and the protection of it under German law. (...) Catholic priests, should this plan that is currently under discussion be implemented, were obliged to disclose the knowledge gained in confession to law enforcement authorities. The canonical consequence of such a breach of the confessional secret would be excommunication. In such cases priests therefore would only have the choice between breaking the law (which would probably also be punishable under criminal law) and excommunication, with all the resulting disadvantages. In this paper, the canonical law rules regarding confession are presented before the provisions relating to the confessional secret in § 53 para. 1 No. 1 of the Code of Criminal Procedure, § 383 para. 1 No. 4 of the Code of Civil Procedure and § 139 para. 2 of the Criminal Code are discussed. Specifically, the question is raised as to whether a duty of priests to co-operate with the law enforcement authorities may be established by law. Here in particular the protection of the confessional secret under the protection of freedom of religion under Article 9 of the European Convention on Human Rights will be discussed. It has to be noted however that the protection afforded by Article 9 of the European Convention on Human Rights extends far less than the scope of § 53 para. 1 No. 1 of the Code of Criminal Procedure, § 129 para. 2 of the Criminal Code and § 383 para. 1 No. 4 of the Code of Civil Procedure, as Art. 9 ECHR only protects the confessional secret as far as it is required from a religious point of view, but not a general pastoral secret. The article then includes a discussion on the limitations of Article 9 ECHR. Limitations of Article 9(1) ECHR on religious freedom under Article 9(2) ECHR are only permitted if they are prescribed by law and necessary in a democratic society for the protection of public order, health, morals or the rights of others. This is discussed against the background of the legislative goal of more effective law enforcement. As a result, a limitation of the protection of confessional secret through normal (sub-constitutional, domestic) laws, despite the understandable goal of more effective law enforcement, is not compatible with Article 9 of the ECHR. The introduction of genomics and biobanking methodologies to the African research context has also introduced novel ways of doing science, based on values of sharing and reuse of data and samples. This shift raises ethical challenges that need to be considered when research is reviewed by ethics committees, relating for instance to broad consent, the feedback of individual genetic findings, and regulation of secondary sample access and use. Yet existing ethics guidelines and regulations in Africa do not successfully (...) regulate research based on sharing, causing confusion about what is allowed, where and when. In order to understand better the ethics regulatory landscape around genomic research and biobanking, we conducted a comprehensive analysis of existing ethics guidelines, policies and other similar sources. We sourced 30 ethics regulatory documents from 22 African countries. We used software that assists with qualitative data analysis to conduct a thematic analysis of these documents. Surprisingly considering how contentious broad consent is in Africa, we found that most countries allow the use of this consent model, with its use banned in only three of the countries we investigated. In a likely response to fears about exploitation, the export of samples outside of the continent is strictly regulated, sometimes in conjunction with regulations around international collaboration. We also found that whilst an essential and critical component of ensuring ethical best practice in genomics research relates to the governance framework that accompanies sample and data sharing, this was most sparingly covered in the guidelines. There is a need for ethics guidelines in African countries to be adapted to the changing science policy landscape, which increasingly supports principles of openness, storage, sharing and secondary use. Current guidelines are not pertinent to the ethical challenges that such a new orientation raises, and therefore fail to provide accurate guidance to ethics committees and researchers. (shrink)

Socio-economic life may differ in terms of cultures and beliefs. Today, it is seen that it is impossible for socio-economic life not to be affected by the rapidly developing digitalization. Digitalization proclaims its dominance in most areas of social life, but especially in economic fields its effect is thought to be more different because economic development is the basis of the digital development. Due to digital economic models based on informational, global and network organizations, people interact with more people (...) than in traditional society. Thus, people contribute to the creation of a real competitive environment by participating in economic processes on a more comprehensive and egalitarian basis. Economic models supported by technological communication tools, e-mails, networks and innovative software are getting stronger day by day and spread to most areas of social life. The effect of digitalization on the economic field prepares the ground for important discussions especially in the relationship between religion and economic life. New forms of shopping such as e-commerce and crypto money that emerged as a result of digital developments are closely related to the approach of religion to economic innovation. Should religion or religious people take a stand in the face of new economic models and crypto money developing in the digitalization environment? Has the sociological role of religion in socio-economic life changed with digitalization? What is the functional dimension of crypto money in the relationship between socio-economic life and religion? The answers to such questions are a matter of curiosity. In this study, research will be made within the framework of the problems whose answers are the subject of curiosity. The main purpose of this study is to reveal the equivalence of crypto money, one of the new economic models in social life, and its relationship with religion, which is human and social capital, in an environment where digitalization is rapidly developing. Methods used in this study are literature review, field research and interviews with people using cryptocurrency. According to the findings, it has been observed that people are exposed to religious concerns when using crypto money. There have even been those who think that the losses in cryptocurrencies are also related to ignoring religious sensitivities. As a result, crypto money will make its presence felt more and more in the new world order and this situation should be considered in terms of religious sociological dimensions. It is seen that it will be beneficial to develop the crypto money, which has emerged as a new generation money and has many types, in line with the general economic models and to be developed in a way that will eliminate the concerns of the religious in this context. In recent years scholars have begun to question the usefulness of the category of ''religion'' to describe a distinctive form of human experience and behavior. In his last book, The Ideology of Religious Studies (OUP 2000), Timothy Fitzgerald argued that ''religion'' was not a private area of human existence that could be separated from the public realm and that the study of religion as such was thus impossibility. In this new book he examines a wide range of (...) English-language texts to show how religion became transformed from a very specific category indigenous to Christian culture into a universalist claim about human nature and society. These claims, he shows, are implied by and frequently explicit in theories and methods of comparative religion. But they are also tacitly reproduced throughout the humanities in the relatively indiscriminate use of ''religion'' as an a priori valid cross-cultural analytical concept, for example in historiography, sociology, and social anthropology. Fitzgerald seeks to link the argument about religion to the parallel formation of the ''non-religious'' and such dichotomies as church-state, sacred-profane, ecclesiastical-civil, spiritual-temporal, supernatural-natural, and irrational-rational. Part of his argument is that the category ''religion'' has a different logic compared to the category ''sacred,'' but the two have been consistently confused by major writers, including Durkheim and Eliade. Fitzgerald contends that ''religion'' imagined as a private belief in the supernatural was a necessary conceptual space for the simultaneous imagining of ''secular'' practices and institutions such as politics, economics, and the Nation State. The invention of ''religion'' as a universal type of experience, practice, and institution was partly the result of sacralizing new concepts of exchange, ownership, and labor practices, applying ''scientific'' rationality to human behavior, administering the colonies and classifying native institutions. Reputation monitoring and the punishment of cheats are thought to be crucial to the viability and maintenance of human cooperation in large groups of non-kin. However, since the cost of policing moral norms must fall to those in the group, policing is itself a public good subject to exploitation by free riders. Recently, it has been suggested that belief in supernatural monitoring and punishment may discourage individuals from violating established moral norms and so facilitate human cooperation. Here we use cross-cultural (...) survey data from a global sample of 87 countries to show that beliefs about two related sources of supernatural monitoring and punishment — God and the afterlife —independently predict respondents' assessment of the justifiability of a range of moral transgressions. This relationship holds even after controlling for frequency of religious participation, country of origin, religious denomination and level of education. As well as corroborating experimental work, our findings suggest that, across cultural and religious backgrounds, beliefs about the permissibility of moral transgressions are tied to beliefs about supernatural monitoring and punishment, supporting arguments that these beliefs may be important promoters of cooperation in human groups. Although only one aspect of Gotthold Ephraim Lessing's diverse oeuvre, his religious thought had a significant influence on thinkers such as Kant, Hegel, Kierkegaard, and present-day liberal Protestant theologians. His thought is particularly difficult to assess, however, because it is found largely in a series of essays, reviews, critical studies, polemical writings, and commentary on theological texts. Beyond these, his correspondence, and a few fragmentary essays unpublished during his lifetime, we have his famous drama of religious toleration, Nathan the Wise, (...) and his philosophical-historical sketch, The Education of the Human Race. In these scattered texts, Lessing challenged the full range of theological views in the Enlightenment, from Protestant orthodoxy, with its belief in Biblical inerrancy, to a radical naturalism, which rejected both the concept of a divine revelation and the historically based claims of Christianity to be one, as well as virtually everything in between. Since he refused to identify himself with any of these parties, Lessing was an enigmatic figure, and a central question from his time to today is where he stood on the issue of the truth of the Christian religion. Now back in print, and with the addition of two supplementary essays, Henry E. Allison's book argues that, despite appearances, Lessing was not merely an eclectic thinker or intellectual provocateur, but a serious philosopher of religion, who combined a basically Spinozistic conception of God with a sophisticated pluralistic conception of religious truth inspired by Leibniz. In lieu of an abstract, here is a brief excerpt of the content:God, the Absolute Wise Man, and the Study of ReligionClemens CavallinThe Absolute Wise ManIn the beginning of the Summa contra gentiles [SCG], Thomas Aquinas remarks that, according to the Philosopher (that is, Aristotle), the wise man orders "things rightly and governs them well."1 To do this, the wise man needs to pay attention to the proper goal of his activity, that is, the good toward which he is to (...) order things. This means that there can be wise politicians, carpenters, and philologists; but Aquinas has primarily in mind "the absolute wise man" (simpliciter sapiens), who queries both the origin of the universe and its end: God.Moreover, not only does the absolute wise man contemplate the nature of God, the ultimate source and truth of the universe, but as even the highest theoretical wisdom (in the Aristotelean sense of sophia) has a practical, ordering dimension, it is also proper for such a person to teach truth and oppose falsehood—in other words, to be a teacher.2Toward the end of the first chapter of SCG, "The Office of the Wise [End Page 1207] Man," Aquinas returns to his introductory quote from Proverbs 8:7: "My mouth shall meditate truth, and my lips shall hate impiety." Aquinas interprets impiety (impietas) as "falsehood against the divine truth," and its opposite, piety (pietas), he writes, is another word for religion.3 The absolute wise person is, therefore, in the business of ordering religion toward its proper goal, God as the origin and end of the universe. As a result, besides the mistaken views of heretics, the Christian wise man, according to Aquinas, has to oppose the errors of Jews, gentiles, and Muslims, that is, all non-Christian religions. In refuting the latter two, he has to use natural reason, as they accept neither the Old nor the New Testament.4 And this philosophical task is the fundamental errand of SCG.Moreover, the quest for and ordering of knowledge in relation to ultimate wisdom brings with it a joyous union of "man to God in friendship," as God, the creator, made everything in wisdom, as ordered to himself, the Supreme Being and Truth.5 To pursue wisdom thus divinizes man.However, my goal in this article is not primarily to deepen our understanding of the Thomist spirituality of higher wisdom, but to probe the possibility of a Catholic "religious studies" endeavor inspired by Aquinas's approach in SCG I. My main question is, therefore, whether the office of the wise man is compatible with (or at least complementary to) the idea and practice of religious studies. Or if a Catholic approach to religious studies must do without absolute wisdom and settle for a lower-level goal such as ordering the relations between the diverse religious traditions of global society with the goal of harmonious coexistence? In that case, the spirituality of the scholar turns from divinization to humanization, but in what way would such studies be Catholic?A Catholic "religious studies" is here understood as different from theology of religions, and more generally from dogmatic theology.6 Theology of religions is concerned with questions such as the possible salvific role of non-Christian religions, with how to understand the principle of extra ecclesiam nulla salus ("no salvation outside the Church") and [End Page 1208] the trichotomy of exclusivism, inclusivism, and pluralism.7 The main concern of religious studies is not such evaluations, but rather the details of the history of religions and the contemporary diversity and changes of religion and spirituality. The theoretical thrust of religious studies aims at understanding the natural inclination for religion and its manifold manifestations (beliefs, rituals, and myths). Humans have a fundamental need to belong. This, need, as Kimberley Brownlee argues in her book Being Sure of Each Other grounds the human right against social deprivation. But in addition to having a human right against social deprivation, we also have a right to associational freedom, which is grounded in our right to autonomy. We cannot be forced into relationships; we are free to choose our friends and loved ones.? In this paper I discuss what our right to associational (...) freedom morally permits us to do when are already in an intimate relationship and, relatedly, what our relationship-dependent duties require of us in such cases. What exactly are the constraints on our right to associational freedom? And what is the content and scope of our relationship-dependent duties, given that our right to associational freedom conflicts with the fulfillment of these duties?? After providing some clarifications as to how we should understand intimate relationships that have ended, I will first highlight what relationship-dependent duties are and how they correlate with a right to associational control. I will then discuss several break-up scenarios, the aim of which is to determine the conditions that justify constraints being imposed on the right to associational freedom and to delineate the scope of relationship-dependent duties. This research employs the Bayesian network modeling approach, and the Markov chain Monte Carlo technique, to learn about the role of lies and violence in teachings of major religions, using a unique dataset extracted from long-standing Vietnamese folktales. The results indicate that, although lying and violent acts augur negative consequences for those who commit them, their associations with core religious values diverge in the final outcome for the folktale characters. Lying that serves a religious mission of either Confucianism or Taoism (...) (but not Buddhism) brings a positive outcome to a character (βT_and_Lie_O= 2.23; βC_and_Lie_O= 1.47; βT_and_Lie_O= 2.23). A violent act committed to serving Buddhist missions results in a happy ending for the committer (βB_and_Viol_O= 2.55). What is highlighted here is a glaring double standard in the interpretation and practice of the three teachings: the very virtuous outcomes being preached, whether that be compassion and meditation in Buddhism, societal order in Confucianism, or natural harmony in Taoism, appear to accommodate two universal vices—violence in Buddhism and lying in the latter two. These findings contribute to a host of studies aimed at making sense of contradictory human behaviors, adding the role of religious teachings in addition to cognition in belief maintenance and motivated reasoning in discounting counterargument. The evidence of human wickedness in the world is so transparent that no rational person can dispute its reality. This paper approaches the question of the human person from an African philosophical perspective and explores the relation between the apparently free-acting human being and God conceived as the creator of the world and the ultimate cause of the human being. The paper will proffer answers to the following question: to what extent can the human being be absolved of blame (...) for the evil they perpetrate in a world conceived in African traditional religion and thought as the creation of a high deity who could have foreseen the negative bent of human nature and should have made human nature inclined to goodness all of the time? The paper will make novel contributions to the debate about human nature in African philosophical discourse by recasting the human being as a homo melancholicus, or melancholy being, whose evil inclination in the world can best be understood in the context of a tragic vision of reality. He begins by citing literature showing that temporal orientation has always been used to speak about how a sociocultural group sees itself in light of a “time or origin” (such as a sacred past) or “time preference” (such as a preference for past, present, or future). Wariboko proposes a third way, redefining temporal orientation as a break or clearing in time between the past and the future—a kairos event. He goes on to say that understanding how members of a sociocultural group understand time is essential to understanding how they see themselves and their moral sources.Wariboko speaks of temporal orientation in terms of “time gaps,” contending that freedom and new beginnings are found within these gaps. Suggesting that these gaps are important to the process of defining subjectivity—since human beings live in a time-defined gap between birth and death—he coins the term “chronomethics” to refer to a new methodology where ethics is studied [End Page 213] through the lens of temporal orientation with attention to the analysis of cultural forms.Wariboko provides an exemplar of this methodology by doing an in-depth analysis of the Kalabari community of the Niger Delta in southern Nigeria. Through the use of ethnography, Wariboko explores politics, religious imagination, apocalypticism, and the philosophy of history in Kalabari beliefs and practices—setting African studies in dialogue with Western philosophy and theology. Here, and throughout the book, he draws heavily on the work of Hannah Arendt in his analysis.Although this ethnographic analysis makes an important contribution to ethical reflection, it is not without problems. Wariboko focuses almost exclusively on the chiefs of the Kalabari community, using both male language and male concepts. When Wariboko moves to a discussion of traditional Kalabari religion, he speaks mainly of the male or neuter aspect of God (which is called So, or so) and only briefly mentions the female aspect (Teme-órú). This leaves the reader to wonder whether the actors and agents Wariboko refers to include women. In sum, his descriptive analysis of Kalabari culture lacks a critique of patriarchy, which should be present in any analysis that seeks to make a contribution to Christian ethics.Perhaps the most significant contribution of the book is found in its chapter on imagination. Here Wariboko examines the ways in which the Kalabari people imagine their own society and construct a moral imagination. He pays significant attention to African conceptions of community and the ways in which individuals relate to their communities. Although Wariboko contributes an important original voice to this dialogue, this voice could be strengthened by incorporating the voices of other African philosophers and theologians rather than relying primarily on Western sources in his analysis of Kalabari culture.The book concludes by relating the newly proposed methodology (and to some extent the ethnography) to concrete applications within the realm of economic development. Here Wariboko focuses on the “kairos-ordering of society,” arguing that economic development will only be attained when the state maintains the rules of just conduct, nurtures kairos, develops human capabilities, embraces pluralism, and uses social practices to disperse knowledge. Although this final section is brief, it invites further reflection by delineating how temporal orientation could be used as a new methodology for Christian ethics. In the field of theology, the comparative study of religions has exhibited growing interest in recent years. For this reason, more than ever, the moment seems right for a critical reflection on the status of comparative religious science as an autonomous discipline and on its relation to theology. At present, a consensus is growing among many – although seldom formally confirmed this tacitly remains, nevertheless, the ruling fundamental orientation – that the comparative study of religions, along with the scientific study (...) of literature , psychology, anthropology, sociology and the other “classical” human sciences, is the only way to practice theology in a “scientifically justified way”. This makes comparative religious science - along with the other human sciences - the only valid authority to claim truth in Christian doctrine. I believe this is an incorrect opinion, which is based upon an underestimation of the distinction between Christian theology and the “classical” practice of science. In the present article, I will attempt to provide a new interpretation of the position of the phenomenology of religion in relation to Christian theology by determining what functions theology is at liberty to perform in view of comparative religious science and vice versa. In doing so, I will restrict myself to the phenomenological method within the context of comparative religious science, a method which has served for a long time as themodel for every comparative research. I intend to take the following twofold thesis as my point of departure: 1. In contrast to what its most fervent adherents claim, the understanding of the phenomenology of religion as a separate branch within human sciences is partly based upon prejudices regarding the scope of the latter disciplines. Theoretically and practically speaking, the research object of the phenomenology of religion can easily be arranged, broadly speaking, under the other disciplines of human sciences, which have religion as their object of research. 2. The relation of the phenomenology of religion to theology is that of an auxiliary science. While it is true that, under certain terms, there is a degree of cross-fertilisation between theology and the phenomenology of religion, theology and the phenomenology of religion must remain, nevertheless, theology and phenomenology of religion. BackgroundThe Western-European concept of libertarian rights-based autonomy, which advocates respect for individual rights, may conflict with African cultural values and norms. African communitarian ethics focuses on the interests of the collective whole or community, rather than rugged individualism. Hence collective decision-making processes take precedence over individual autonomy or consent. This apparent conflict may impact informed consent practice during biomedical research in African communities and may hinder ethical principlism in African bioethics. This study explored African biomedical (...) researchers' perspectives regarding informed consent and potential limitations to the principle of respect for autonomy in African communities.MethodsWe conducted a qualitative study based on in-depth interviews with 12 biomedical researchers, five females and seven males aged 34 to 74 years, currently working at an African university. Interviews lasted 35–40 min each and involved semi-structured open-ended interviews, which allowed participants to offer information about their perceptions and feelings regarding respect for autonomy and informed consent as practised in Africa. Empirical data from the interviews were recorded, transcribed, and analysed using thematic content analysis, together with an interrogation of relevant scientific literature about African communitarian ethics, making evaluations and drawing inferences consistent with the empirical bioethics approach.ResultsBased on these interviews and analysis of relevant literature, we found that informed consent is difficult to apply in an African context because it derives from a Western conception of libertarian rights-based autonomy. Most respondents pointed out that it was challenging to implement informed consent in the African setting. Furthermore, communalism, customary beliefs, spirituality, and relational autonomy are predominant in most African communities, as exemplified by the African moral philosophies of Ubuntu/botho and Ukama, which emphasize communitarianism over individual rights. We also found that language, education, poverty, and cultural beliefs are barriers to obtaining proper informed consent in African communities.ConclusionsWe conclude that there are limitations to applying the principle of respect for autonomy and informed consent in African communities, especially in the context of human biomedical research. We recommend using a more relational approach, such as Ross’s prima facie duties, to implement informed consent in African communities. (shrink)

Religion is a social ideology. Today the study of the history of the development of a religion as an ideology not only has a general significance but also a particular significance. It is possible for us to discern, from a plethora of evidence in places outside of China, that while scientific technology may be progressing and developing rapidly, progress has not brought about a decline in religious ideology but has indeed strengthened people's pursuit of religion. From our (...) own domestic conditions, too, we can see that for all sorts of reasons, there is a growing trend among people to adhere to one religion or another. Such a phenomenon, therefore, suggests a number of theoretical questions related to religion that ought to be studied seriously, such as: What is the essence of religion? "Is it a psychological characteristic of human beings to need some kind of religious faith? Axe religion and religious belief one and the same thing? Can religious faith be of benefit to social life? Are religion and science mutually contradictory? Are they mutually supplementary? Can religion be modernized? Naturally, these problems do not fall within the scope of this essay. Nonetheless, there are, I believe, related questions that ought to be given consideration by those who write the history of religions, such as why we study the history of religions at all, whether a good study in the history of religions ought to have a strong sense of the times, and whether or not it is sufficient to bring the people who have read such a study to consider seriously and earnestly the religious questions that exist in the contemporary world. The recent bioethical literature addresses numerous new problems posed by advancing medical technology and demonstrates an erosion of standards rooted in religion and long widely accepted as almost axiomatic. In the deep soul-searching that pervades the publications on bioethics, several disturbing and dangerous trends neglect some basic lessons of philosophy, logic, and history. (...) The bioethics discourse on medical aid in dying emphasizes similarity over previously recognized important distinguishing features. For example, it overplays a likeness between assistance in dying and the withdrawal of life-saving technology. In many bioethics’ topics, arguments based on a logical continuum are used to question the lines demarcating important moral differences. l. The Line Between Ethical and Not: Logic Based on Continuum Careful case selection, often either end of a continuum, allows the tearing down or ridiculing of many rules and codes across most professions and fields of interest. This situation holds true for traffic laws as well as medical ethics guidelines. It is relatively simple for those who desire to attack a particular viewpoint by selecting a case that makes that position seem untenable. In the ethics realm, good and bad medicine exist at opposite ends of an ethical continuum, with many practices lying in between. For example, much of medical ethics exists between the Nazi criminal physicians and the most sainted nurse or physician. A gradual progression occurred over less than two decades from a utilitarian position that supported limited euthanasia for those with certain mental illnesses to genocide. German society embraced a utilitarian ethic in which the value of human life no longer was intrinsic but instrumental.[1] Many morally significant points on a continuum were then ignored as the misguided utilitarian policy rampantly continued. A point in the continuum to distinguish between ethically justifiable and that which is not can be difficult to identify compared to the two extremes. This continuum is not unique to ethics but can be applied to almost any other aspect of human life and endeavor. Between a severely ill schizophrenic person and a superbly well-adjusted individual, there is a continuum of mental and psychological function. The existence of a continuum should not paralyze thinking and prevent us from drawing lines and identifying moral differences based on objective criteria as well as moral philosophy. Yet, by focusing on a continuum, many bioethicists use logic to disregard dividing lines between an "ethical" and an "unethical" act. Unfortunately, sometimes bioethicists draw revolutionary conclusions that would change the scope of medical practices which is accepted as ethical. There are many examples of similar shifts on the continuum. Many authors argue for the ethical permissibility of abortion by pointing out that the human fetus is no different in various characteristics, one arguing it is as like an ape or chick as it is like a person,[2] and does not achieve unique human and individual characteristics until well into the first year of life.[3] While human fetuses arguably do not have certain distinctive qualities of personhood, most people shy away from the logical next conclusion: permitting infanticide. For example, Joshua Lederberg condemns infanticide, in the face of biological illogic, because of our emotional commitment to infants, to me, a relatively weak explanation. Sir Francis Crick suggests we might consider birth at two days of life in order to decide whether an infant is a "suitable" member of society.[4] Giublini and Minerva suggest that infanticide should be permissible since late pregnancy abortions are permissible, arguing there is no significant difference between a fetus just before birth and an infant just after birth.[5] Clearly the continuum approach would allow for subjective arguments in favor of later infanticide at other points many days post-birth. Years ago, with a cynical tone, I mentioned infanticide as a further step on the continuum beyond abortion, and I was rightly shouted down as being deliberately provocative to assert the logic would ever stretch so far. While it is not an accepted mainstream position, the movement in academic settings from widespread condemnation to limited possible acceptance of infanticide has taken place in an incredibly short time. Public opinion and medical opinion in these areas have shifted dramatically in a short time. In another area, from a biological and chemical point of view, there is a continuum from man down to a single carbon atom. Yet, it would not seem logical to ignore the emotional differences, the meaning of personhood, or the moral distinction between killing an insect and killing a person. ll. A False Continuum: Medical Aid in Dying I assert that there has been an erosion of ethical guidelines in recent years attributable to using continuums to camouflage important distinctions. James Rachels’ work on active and passive euthanasia, which contends that the two are ethically identical, exemplifies that logic.[6] He illustrates this thesis, using a continuum to compare different scenarios with like consequences as morally equivalent, by comparing the deliberate drowning of a child with a deliberate failure to rescue a drowning child when easily able to do so. The author's comparison proposes that since much of the medical profession has already made peace with withholding treatment in order to hasten death, consistency inexorably demands that we permit active euthanasia as well.[7] When permission for active euthanasia was first introduced, it was limited exclusively to patients suffering severely from an intractable, incurable, and irreversible disease. These guidelines have been continuously eroded. There is now a substantial serious consideration for permitting active euthanasia of healthy elderly individuals who feel that they have completed their lives and are "tired of living."[8] There are many moral and factual differences along the ethical continuum. In human life, there is a difference between a live baby and a fetus, between a viable fetus and one that is not, between a fetus and a zygote, and between a zygote and a sperm cell. Similarly, there is a difference between pulling a trigger to kill someone and not interfering in preventing his death, which is reprehensible though both may be. There is a difference between not resuscitating an 80-year-old man with cancer when his heart stops and injecting him with a fatal dose of potassium chloride. I argue that an overt act of taking life repels civilized human beings is to be commended and encouraged as the reverence for human life or even for just a moment of human life is one of the great contributions of our civilization. CONCLUSION As an orthodox Jew, I feel that divinely inspired guidelines that have stood the test of centuries shape my beliefs, and such guidelines contradict medical aid in dying. I cannot speak to the viewpoint of those who do not access religion in defining their moral stance, nor do I implicate them in the current bioethics' trends, as I am not aware of the personal role of religion in the lives of most such authors. While many nonreligious people have a firm philosophical grounding and oppose medical aid in dying, I suggest that in the absence of any religious or other absolute standards, developing logically defensible ethical guidelines may be challenging. At the least, religion may play a role in defining the points on the continuums that are ethically meaningful and refuting the trending beliefs that if the endpoint is the same, allowing different methods of arriving at that end are somehow ethically equal. The continuum of ways death may result does not negate analysis of whether death is brought about in ways that recognize the importance of life. The German philosopher Hans Jonas said, "It is a question whether without restoring the category of the sacred, the category most thoroughly destroyed by the scientific enlightenment, we can have an ethics able to cope with the extreme powers that we possess today and constantly increase and are compelled to use."[9] While countries vary on the role of religion in policy, with many emphasizing freedoms of religion, a recent position paper released by a group of Jewish, Christian, and Moslem leaders suggested the need for agreement on the unique sanctity of human life.[10] I would recommend that such a document serve as an example of consensus on critical foundational bioethical guidelines for democratic secular societies. - [1] Alexander L Medical science under dictatorship. Religion emerged among early humans because both purposive and non-purposive explanations were being employed but understanding was lacking of their precise scope and limits. Given also a context of very limited human power, the resultant foregrounding of agency and purposive explanation expressed itself in religion’s marked tendency towards anthropomorphism and its key role in legitimizing behaviour. The inevitability of death also structures the religious outlook; with ancestors sometimes assigned a role in relation to the living. Subjective elements (...) such as the experience of dreams and the internalization of moral precepts also play their part. Two important sources of variation among religions concern the adoption of a dualist or non-dualist perspective, and whether or not the religion’s early political experience is such as to generate a systematic doctrine subordinating politics to religion. The near ubiquity and endurance of religion are further illuminated by analysis of its functions and ideological role. She aims to show how antitrafficking initiatives in the United States are influenced by and expressive of distinctively (...) Protestant norms regarding gender, sex, and freedom. Zimmerman argues that US antitrafficking initiatives are limited in their ability to promote [End Page 229] diverse expressions of freedom because they are both implicitly and explicitly framed from within such a religious worldview. As a result of the biases that have shaped US antitrafficking efforts, the complex social phenomenon of human trafficking, which involves a variety of forms of exploitation and abuse, has become essentially identified with the sexual exploitation of vulnerable women and girls. According to Zimmerman, this has led to a disproportionate focus on “freeing” trafficking victims from sexual slavery and exploitation to “choose” to live lives that better reflect “good old American values” (126). Instead of respecting the agency of victims and promoting their freedom to make diverse choices about their own lives, current initiatives encourage conformity to “American” (i.e., middle class, white, and Protestant) values. If dreaming “other dreams of freedom” is ever to become a reality for the wide range of individuals who are or have been trafficked, becoming critically aware of these biases is an important first step.Zimmerman’s primary aim is to reveal these biases, and she examines them from a number of different angles. Thus, she examines the historical development of antitrafficking legislation; the gendered and theological language of US antitrafficking public policy; the implementation of policy under the Bush and Obama administrations; and the historical influence of distinctively Protestant conceptions of human freedom, morality, and sexual expression on what many typically consider to be “traditional American values.” Zimmerman’s analysis urges readers to become critically aware of how the language used in public policy communicates and enforces particular norms. She highlights the gendered language that normativizes female passivity and male aggression, and pays close attention to the deeper theological meaning of terms like “evil” and “God-given potential” used in US public policy that link Christian understandings of freedom to sexual expression. According to Zimmerman, understanding the religious moral imagination evoked by such language helps to explain the otherwise unreasonable “conflation of sex work and human trafficking” in US policy (173).On the whole, the threads of sex, gender, and freedom that Zimmerman picks up are generally well supported throughout Other Dreams. Her research also raises some difficult questions that are beyond the scope of her book but worth considering. For example, even if the language of evil carries with it certain theological assumptions, is it possible that there are good reasons for using such language in addition to the language of justice? Or, even if one challenges the Protestant norms that are being used to shape antitrafficking efforts, are there other reasons for supporting the policy that is in place?Zimmerman’s book is clear, well-written, and accessible. Other Dreams of Freedom will likely appeal to a number of different audiences: diverse scholars interested in the relationship between religion and public policy; political activists, social workers, or policy makers interested in the problem of human [End Page 230] trafficking; and teachers of advanced undergraduate or graduate courses that deal with these issues. In this paper, I make a case for an intercultural philosophy of religion from an African perspective. I focus on the philosophical underpinnings of the various meaningful religious practices and beliefs that give rise to the concepts of God, death and the problem of evil. A philosophical study of African traditional religions, based on anthropological findings across African cultural orientations, gives us a good starting point in understanding African worldviews and religious experiences. It also (...) reveals that the various world religions may all be seen as offering different perspectives on the same reality. Specifically, I argue that traditional African conceptions of God, death and the problem of evil could make significant contributions to global discourses in the philosophy of religion. First, I articulate points of convergence and divergence between African traditional religions with Saint Aquinas’ proofs for God’s existence; Second, I question the phenomenon of death and one’s life’s meaning. This essay tries to place the humanities in Africa squarely within the process of articulating an “agonistic imaginary” that is crucial in creating an African modernity. The humanities, in spite of the growing crisis in African university curricula , could and should serve as an intellectual catalyst towards the creation of a pedagogical atmosphere. Such an atmosphere is necessary for conceptualising an imaginary around which an African modern existence can emerge. In the words of Aloni , a (...) humanistic education will therefore serve as “a formative and self-defining process that is driven by a natural need for self-actualization.” It must be “facilitated by reliance on inner motivation, self-respect, self-regulation, stimulating environment and supportive and dialogical human relations.”. The article examines the practice of the applicability of the Article 18 of the International Covenant on Civil and Political Rights (hereinafter—ICCPR) and Article 9 of the European Convention on Human Rights and Fundamental Freedoms (hereinafter—ECHR). Through the case—law of the European Court on Human Rights (hereinafter—ECtHR) and insights of the Human Rights Committee the author is investigating the content and limits of the freedom of religion. The article examines in detail the limiting clauses to the freedom of belief (...) (national security, public order, public health, public morals) and the possibility to apply derogation clause. The author comes to the conclusion that due to the complexity of this right it is difficult to forecast the future developments of this right. The jurisprudence of the ECtHR is numerous as well as the decisions of the Court are often accompanied by dissenting opinions. Moreover, some potential cases related to the freedom of religion are not considered by the ECtHR as the admissibility criteria are not met. Therefore the author looks forward to the forthcoming jurisprudence of both—regional and universal human rights bodies. (shrink)

Religion is presented as a family of religions, identified by a cluster of religion-making features, most but not all of which must be present, involving beliefs and practices which are diverse and often in conflict. Because of differences in scope, application of scientific method, and vocabulary, science can also be regarded as a family—this time a family of sciences. The universality of the physical sciences contrasts with the more restricted scope of the earth sciences and (...) the human sciences. Their relationship can be shown by a three-tiered pyramid, with the physical sciences at the base, the human sciences at the top, and the earth sciences in the middle. Despite three notable differences between science and religion, science and religion are not, as popularly believed, in conflict. The contrary view, espoused by the “new atheists,” is shown to be based on oversimplified views of religion and science. There are nontheistic religions and science is committed, not to metaphysical naturalism (“scientism”), but only to methodological naturalism. Stephen Jay Gould escapes the conflict view by proposing that science and religion are independent “magisteria”, science being occupied with facts and religion with values. In divorcing the realm of facts from the realm of values, he too distorts their complex nature, for science is not devoid of values and religion makes claims about the facts. As Hume long ago suggested, facts and values are interconnected. While a fact is not the same as a value, a fact cannot support a value without presupposing another value in turn. Bio‐banking in research elicits numerous ethical issues related to informed consent, privacy and identifiability of samples, return of results, incidental findings, international data exchange, ownership of samples, and benefit sharing etc. In low and middle income (LMICs) countries the challenge of inadequate guidelines and regulations on the proper conduct of research compounds the ethical issues. In addition, failure to pay attention to underlying indigenous worldviews that ought to inform issues, practices and policies in Africa may exacerbate the situation. In this (...) paper we discuss how the African context presents unique and outstanding cultural thought systems regarding the human body and biological materials that can be put into perspective in bio‐bank research. We give the example of African ontology of nature presented by John Samwel Mbiti as foundational in adding value to the discourse about enhancing relevance of bio‐bank research in the African context. We underline that cultural rites of passage performed on the human body in majority of communities in Africa elicit quintessential perspective on beliefs about handling of human body and human biological tissues. We conclude that acknowledgement and inclusion of African indigenous worldviews regarding the human body is essential in influencing best practices in biobank research in Africa. (shrink)

The goal I pursue is to redefine the study of religious epistemology on the basis of an ethnomethodological extension of Wittgenstein. This approach shows that the nature of religious belief and its relation to facts, proofs, and empirical reality are matters that are dealt with by ordinary members of society. The examination of this lay epistemology reveals that -- far from being a settled and established entity -- religious belief is a polymorphous phenomenon. Religious belief is a pragmatic resource whose (...) configuration is shaped to allow the accomplishment of interactional moves within specific contexts. This article uses a fictionalised encounter as the basis for an autoethnographic exploration of the intersections between the South African social value of ubuntu and the notion of spatial justice. Ubuntu describes the interconnectedness of human lives. It asserts that a person is only a person through other people, a recognition that calls for deep respect, empathy and kindness. Ubuntu is expressed in selfless generosity and sharing. The spatial turn in the social sciences and humanities has resulted in a (...) concern with the relationship between space and justice. It recognises that space is not simply an empty container in which people live and act, but is something that is constructed by social relations – and simultaneously constitutive of them. While this recognition gives rise to spatial perspectives on justice, what constitutes spatial, justice, as distinct from other notions of justice, and how such justice is to be achieved are contested. Building on the work of legal scholar, Andreas Philippopoulos-Mihalopoulos, on spatial justice, I argue that the notion of ubuntu is able to shape our understanding of spatial justice, and when practised, it is able to disrupt space and challenge dominant spatial configurations. _Purpose._ This paper aims to investigate the phenomenon of a human being within the Confucian tradition as well as its interpretations from intercultural perspective. _Theoretical basis._ One of the ways to understand the deepest level of the intercultural dialogue is to reveal the interpretations of a human being in philosophical traditions, since they refer to the formation of personality and identity within a given culture including interpersonal, intergroup, and intercultural relations. Humanism based on the unity of Human and Heaven runs (...) like a red thread through the philosophical teachings of Confucius, Mencius, Xunzi, Zhu Xi, Wang Yangming defining the ideas of human nature, his/her duties, his/her place and roles in society that shaped the Chinese mentality. _Originality._ Quite often, Chinese concepts (for example, human dignity beyond the ideas of democracy and mass political participation, guanxi, mianzi) are incomprehensible to the representatives of the Western civilization, which leads to the challenges in intercultural communication. The interpretation of these ideas in the context of Confucianism allows to understand them from the perspective of Others and expand the set of patterns of cultural perception. This ultimately leads to the awareness that there are many social, political, cultural realities, which we perceive through the lens of our own concepts and attitudes. The participants of an intercultural dialogue realize that each of them has a unique experience, own way of posing a problem and resolving it, and no one is better or worse. _Conclusions._ Confucian philosophy shaped the worldview of Chinese people, defined values, goals, meanings, attitudes, communication models, which affected all spheres of Chinese life and culture. The study of the philosophical heritage of the great Chinese civilization enhances the cultural competence of the intercultural communicators and expands the field of dialogue to the level of global communication. Richard Swinburne argues that belief is a necessary but not sufficient condition for faith, and he also argues that, while faith is voluntary, belief is involuntary. This essay is concerned with the tension arising from the involuntary aspect of faith, the Christian doctrine that human beings have an obligation to exercise faith, and the moral claim that people are only responsible for actions where they have the ability to do otherwise. Put more concisely, the problem concerns the coherence of (...) the following claims: (1) one cannot have faith, (2) one has an obligation to have faith, and (3) ought implies can. To solve this dilemma, I offer three solutions that I believe have the philosophical resources to demonstrate the consistency of these claims. Thus, I defend the claim that it is logically possible for a person to be culpable for an involuntary failure to have faith in God. (shrink)

The intent of this research article is to argue with the line of reasoning of arguments from Paul Hager and other educational theorists against the front-end model of education. The model is rejected because it cannot be achieved in occupational preparation, and, moreover, those critics said that it is based on a wrong idea of conceptual interpretation of learning that makes it less conducive to lifelong learning in the long run. The framework which is rejected is a sharp distinction of (...) two concepts; process and product. The reason of rejection is that the sharp distinction does not exist. However, from the research, many analyses show that the front-end model is one of the most important aspects of employment and vocational education, which is the belief that actual practice at work will guarantee the skills of learners before they enter the actual operation. Based on a method of postmodern philosophical analysis, I found that the relationship between education and work is a highly complex relationship. The result of this complexity makes it impossible to have a perfect reason for Hager and his colleagues to reject the significance of the front-end model as concluded by their previous research. On the other hand, I argue that we would have more weight in reasoning if we are to point out that the new policy of lifelong learning still requires a new interpretation on integrity of front-end model of career preparation. This is because the more plausible definition of human being from Hannah Arendt is related to work and working. From what is conceptualized here as an argument of imperfect employability, I pointed out that the rejection of front-end model itself has an important base of conceptualization that does not match the definition of such conditions of being human. Therefore, the rejection of front-end model should be considered as an argument that does not yet have enough weight in reasoning. (shrink)

In Joeri Schrijvers’ (2016) book, Between Faith and Belief, Schrijvers discusses various answers to a deceptively simple and yet complex question: what can be said for religious faith “at the end of metaphysics”? Although Schrijvers engages a variety of thinkers in the elaboration of his thesis, he takes particular interest in Ludwig Binswanger, a Swiss existential psychologist, whose contemporaries include Martin Heidegger, Edmund Husserl, and Martin Buber. Although Schrijvers does not discuss it in his manuscript, it is important to note (...) that Binswanger was heavily influenced by the existential philosophy of Søren Kierkegaard. This influence is particularly apparent in Binswanger’s understanding of the transcendental nature of human love. Demonstrating the degree to which Binswanger draws on Kierkegaard, Elisabetta Basso writes, “What is undeniable, in any event, is the fact that Kierkegaard is almost everywhere present in Binswanger’s work” (Basso 2011 p. 35). Anyone familiar with Kierkegaard’s authorship should also be able to see his ideas shining through Binswanger’s work; but what are as interesting as their similarities are their divergences. The purpose of this essay is to examine the relationship between belief in predestination and trust in God in terms of the disciplines of kalām and mysticism. Tawakkul is regarded in Islamic ethics as one of the positive characteristics of faith. Considering that humans cannot be all-powerful, they need to depend on and trusting another. As to religion, the being described is God. Notably, in Sūfism, tawakkul is a significant indicator of worshipping with reference to the human-God relationship. Moreover, (...) the content of the concept is closely associated with the tenet of predestination in kalām. There is a fine line between being responsible and fulfilling the tasks given and the belief in destiny. In the Sūfī understanding of tawakkul, relinquishing the will described as the final state of the worshipping and the state of submission to and trust in God, which is a positive attitude, when combined with the kalām belief that everything happens by a divine decree, can turn into a problematic phenomenon. The impact of the problem in question on the underdevelopment of the Islamic societies in the last two centuries. However, it should be kept in mind that a sound interpretation of the traditional perception of the belief in destiny in both Sūfism and Sunnī kalām literature may lead to a tawakkul understanding encouraging and strengthening the human and the society. In the present study, the concept of tawakkul has been discussed with regard to the doctrines of will, power (qudrah), preordination-destiny (qāzā-qadar) within kalām discipline, and the positive relation of tawakkul with the belief in destiny has been investigated. Life among most African families and communities revolves around women. In both African religion and culture, women’s lives oscillate between two opposite extremes of being at the centre and periphery at the same time. Women are both the healers and the often wounded by the system that respects them when there are problems and displaces them whenever there are opportunities. Their central role is expressed by a Shona proverb musha mukadzi (the home is a woman). This proverb (...) expresses how women endure the pain of both religion and culture to create a decent society. Women also endure the pain of pandemics such as human immunodeficiency virus (HIV) and acquired immunodeficiency syndrome (AIDS) and COVID-19 and at times succumb to the same while taking care of some family members who would have fallen victim to the epidemic. Countless married women have been made susceptible to HIV and AIDS as they try to live according to the African cultural dictates of mothering and/or motherhood. Other women and girls also contract the disease because of how religion and culture exert them to some unbearable circumstances. For example, women and girls nurse their ill relatives without protective equipment and clothing. At times they are abused by men because of some cultural beliefs that unprotected sex is a remedy for HIV and AIDS. In addition, most women and girls were also victims of COVID-19 while serving their family members. In doing all the good work to serve families, women are driven by the proverb musha mukadzi. Using desk research methodology, this paper argues that musha mukadzi is both a toolkit for women’s resilience to endure pandemics and at the same time a subtly oppressive statement often used to manipulate and abuse women to stand in places that are too difficult for their capabilities. Contribution: African women bear the brunt of pandemic burdens such as HIV, AIDS and COVID-19. Sometimes they become susceptible to the same while taking care of their family members affected by pandemics in the name of fulfilling the Shona proverb, musha mukadzi. The topic has contributed to the scope of the journal as it advocates to inculcate a peaceful society. The article also challenges African societies not to use musha mukadzi to ill-treat women as objects of African religio-cultural patriarchal ideology. (shrink)

Much of the recent literature on the normativity of belief has focused on undermining or defending narrow scope readings of doxastic norms. Wide scope readings are largely assumed to have been decisively refuted. This paper will oppose this trend by defending a wide scope reading of the norm of belief. We shall argue for the modest claim that if it is plausible to regard belief as constitutively normative (in the minimal sense that false belief is eo ipso (...) defective), then a modified version of the wide scope reading of the norm of belief should be preferred to the narrow scope reading. I have two major aims in this chapter, which is philosophical in nature. One is to draw upon values that are salient in the southern African region in order to construct a novel and attractive conception of human dignity. Specifically, I articulate the idea that human beings have a dignity in virtue of their communal nature, or their capacity for what I call ‘identity’ and ‘solidarity’, which contrasts the most influential conception in the West, according to which our (...) dignity inheres in our rationality or autonomy. The second aim is to invoke this Afro-communitarian conception of human dignity in order to advance a new conception of why poverty is morally problematic and of what people, particularly states, are ethically required to do with regard to it. Common conceptions of poverty focus on it in terms of people lacking income, preference satisfaction (‘utility’) or general-purpose means (‘social primary goods’ in the Rawlsian jargon). In contrast, if what is special about human beings is our ability to commune with one another in a certain way, then the respects in which poverty can be an injustice and the ways that it must be fought must be understood in more communitarian or relational terms, which I both specify with several concrete examples in a South African context and contrast with the more dominant approaches. In the recent Anglo-American philosophy of religion, significant attention has been given to the nature of faith. My goal is to show that some of the recent discussion of faith can be fruitfully brought to bear on a problem for a less globally well-known version of monotheism found in African Traditional Religion. I argue that African Traditional Religion could benefit from utilizing non-doxastic accounts of faith. For a significant number of Africans questioning authority or tradition, (...) including the tenets of African Traditional Religion is viewed as harmful to the community and hence beyond the pale. A non-doxastic account of faith would be helpful for adherents of African Traditional Religion who find themselves disbelieving yet wanting to continue in religious practice and maintain communal harmony. This is because a non-doxastic state such as hope is within one’s direct control and does not require as much evidential justification as rational belief. (shrink)

Other scholars want to move beyond the the practitioners’ views to create explanatory accounts of religion in terms of social power, psychological benefits, and modules in the evolved brain—causal accounts of which the practitioners might not be aware or that they might deny. Gabriel Levy argues that to develop consilience between the divergent efforts of the humanities and the sciences, the academic study of religion would be well served by developing a more adequate metaphysics that can do justice simultaneously to human behavior as moved both by subjective reasons and by material forces. Specifically, he recommends the “anomalous monism” of Donald Davidson. [End Page 98]According to this view, there is only one kind of reality, and this is a monist metaphysics that includes no nonmaterial or supernatural entities. However, this one kind of reality is “anomalous” in that the world we experience together permits two irreducible vocabularies, one that is physical and deterministic and another that is mental and includes free will. Davidson considered this two-sided approach Spinozistic (169), and Levy notes its similarities to Thomas Nagel’s “neutral monism” (8, 35, 50–51). In short, then, Levy is proposing to scholars of religion a non-reductive but science-friendly “pragmatist monism” (8) that would be congenial to many readers of this journal. Such a metaphysics would also be in line with the methodological naturalism that, for many, defines the legitimate scope of the academy. We might therefore consider this book an example of a philosophy of religious studies, or even a metaphysics for religious studies.An important feature of Davidson’s approach is that, on his account, semantic content is necessarily intersubjective and therefore non-nomological and irreducible to the physical. Imagine a parent offering their prelinguistic child a doll while asking, “Do you want your doll?” or pulling the child away from a neighbor’s dog while telling them, “You have to be careful around dogs.” Davidson argues that human beings learn the meaning of words and sentences in social exchanges like these as the listener makes an educated guess about the entities to which the other person is referring, a process that Davidson calls “triangulation.” The generation of meaning on this model depends on the human capacity for shared intentionality about things in the world. Davidson argues that having meaningful thoughts, even when alone, then requires that one has had intersubjective, “triangulated” experiences like these. As Levy says, “semantic content arises in immanent, contextual, enacted dialogue and conversation with other agents” (182). It follows that this Davidsonian approach insists on irreducible, non-eliminable mental categories such as meaning, belief, and reasons, now recast in terms of practical engagement with things rather than inner representations of them. Some foundations have been provided for the social validity of human rights in Western philosophical literature. Some African scholars have also sought to ground the notion of human rights within the traditional African cultural beliefs and practices. There is, however, a dearth in literature on the Yoruba notion of human rights. Perhaps this may be due to scholars’ attitude that any talk about human rights is incompatible with the communalistic social structure of the Yoruba. The present paper (...) challenges this prevalent attitude by providing some philosophical foundations for human rights within the limits permitted by the Yoruba world-view. The paper attempts a theoretical reconciliation between the Yoruba claim to communitarianism and the possibility of human rights. The paper concludes that, in spite of the seemingly antinomic relation they bear to each other, the idea of human rights is neither practically meaningless/unintelligible in a communitarian society, nor is it conceptually incompatible with the communitarian ideology. The replicability and importance of the correlation between cognitive style and religious belief have been debated. Moreover, the literature has not examined distinct psychological accounts of this relationship. We tested the replicability of the correlation (N = 5284; students and broader samples of Canadians, Americans, and Indians); while testing three accounts of how cognitive style comes to be related to belief in God, karma, witchcraft, and to the belief that religion is necessary for morality. The first, the dual process (...) model, posits that analytical thinking is recruited in overriding intuitions related to supernatural beliefs. The second, the expressive rationality model, posits that analytical thinking is recruited in supporting already-held beliefs in an identity-protective manner. And the third, the counter-normativity rationality model, posits that analytical thinking is recruited to question beliefs supported by prevailing cultural norms. In Study 2, we tested the replicability of our results in a re-analysis of published data. The association between analytic thinking style and beliefs was replicated. We conclude that whereas the counter-normativity rationality model was contradicted by the data, both the dual process and expressive rationality models received varying degrees of empirical support, but neither model fully accounted for all the patterns in the data. Although conditional stimulus (CS)/unconditional stimulus (US) contingency awareness appears to be necessary for human Pavlovian autonomie conditioning, only a selective review of the literature and the forgetting of certain basic, brute facts can allow the cognitive conclusion that awareness causes, or even is important for, conditioning. That conclusion is theoretically barren for explaining the phenomenon and is also of little potential practical use.

Cosmopolis A Review of Cosmopolitics -/- 2015/3-4 -/- Editorial Dominique de Courcelles & Paul Ghils -/- This issue addresses the general concept of “spirituality” as it appears in various cultural contexts and timeframes, through contrasting ideological views. Without necessarily going back to artistic and religious remains of primitive men, which unquestionably show pursuits beyond the biophysical dimension and illustrate practices seeking to unveil the hidden significance of life and death, the following papers deal with a number of interpretations covering a (...) wide field extending from belief to theory, from emotions to concepts, from the wisdom of personal experience to the most sophisticated doctrines. Spirit and spirituality are indeed many-faceted notions. They may refer to the intricate world of the interacting spirits which inhabit living beings in animistic traditions, without excluding a “grand force” linking human beings within a dynamic whole on which their very existence rely . They also bear upon more atomistic and either/or approaches of Western philosophy, which have become embodied in Cartesian dualism against a monotheist background, to the point of freezing the essence of individuals and culminating in the extreme individualism that characterizes our contemporaries. However, this equally refers to the opposite conception of materialism, across times and cultures, from ancient India and Greece (Cārvāka, originally known as Lokāyata, or some Buddhist doctrines for the former, Democritus or Lucretius for the latter) to more contemporary materialistic schools, whether modern or postmodern. -/- The following papers look at the contrasting forms of the philosophy and spirit of the human factor set into a whole, with no artificial disjoint between the psychical and the physical levels, as Wittgenstein put it: “And how can a body have a soul?”. This approach is not unrelated to the notion of anthropocene examined in a recent issue of Cosmopolis, with provides another comprehensive framework open to a spiritual life emerging from the very environment that generated it. -/- *** The first section of this issue was edited by Dominique de Courcelles, director at the National French Research Centre (CNRS), whom we wish to thank for collecting relevant studies relating to the religious and political questions, with a view to focusing on the war of ideas inevitably waged behind images, concepts and perceptions, taking an asymmetrical approach. To the extent that they are mindful of global/local interactions and include representations, opinions and beliefs, such disciplines as philosophy, philology, history and social sciences can provide useful studies accounting for new practices in geopolitics and a fair diplomacy. -/- In her introduction, Dominique de Courcelles first poses the question of how the religious and political spheres interrelate, with their corresponding religious demands and humanistic values. She then suggests that the right question today may be breaking with the philosophy of human rights concerned with the defense of human beings against the hazards of arbitrary politics or the instrumental use of religion, in favour of a fair philosophy of humankind, a new humanism. This would consist in recognizing a common loyalty of all towards one interhuman, not only interstate community, to protect it from both the autonomy demanded by individuals and the instrumental use of minorities. -/- Considering the fact of diversity, so important today in terms of both politics and religion, Abdelhai Azarkan looks at the conditions under which tolerance could obtain the double status of right and duty. He revisits to two philosophers, John Locke and Voltaire, who thought about it from the historical reality of religious wars. The former made tolerance into a right, basing his analysis on the political-legal level, while the latter saw tolerance as a duty, from an analysis based on ethical-political criteria. -/- Mathieu Guidère examines what he calls semantic denominationalism, a term which implies religious attributes and identities, whichever national loyalties or personal belonging they may have at the same time. Since the early 2000s, thie phenomenon has expanded tremendously, compounded by the “war on terror” and the over media-oriented terrorist actions. Denominational expressions act as formal names for ordinary and high-profile players in domestic and foreign policies of democratic states. These systems reveal a receding secularization, while the powerful comeback of religious identities signals the failure of nation-states and the weakening of the humanist spirit. -/- Barbara De Poli retraces the history of a contemporary jihadism claiming its Islamic essence and asserting the truth of genuine coranic principles via the war on infidels, with a view to restoring the Caliphate. After defining the term jihad, she shows that even if this contemporary jiadism is spreading in the Muslim world, it radically departs from Islamic law and the received use of the term jihad, in so far as it is rooted in the early radical thinking of Islamic ideologues in the 20th century, starting with with Hassan al-Banna, the founder of the Muslim Brotherhood. This current has been fueled by by international conflicts since the outbreak of the war in Afghanistan, in which the so-called Western countries bear a major responsibility. -/- Abderrazak Sayadi starts from the Tunisian experience to ask the question of humanist values and democracy within the relationships between the religious and political spheres. As a historian of religion, he is brought to demystify certain islamic principles and to paying attention to the reform of law, seeing the separation of religion and politics as a precondition to a successful democratic gamble and the establishment of a renewed humanism. -/- Dominique de Courcelles reminds us that getting a better knowledge of narrations and words makes it possible to better understand how logical and rhetorical thinking works for those who wage an asymetriccal war, re-enchanting and mystifying the world to better take control. As soon as 1932, an exchange of letters between Einstein and Freud made it clear that, in order to free man from fatality and war, education understood as culture was fundamental. Such illustrations as the exécution of Oussama ben Laden and the Caliph’s speech in Mossoul show that a premiminary analysis of images and words is essential to a fair diplomacy conducted by people from civil society, whose culture and wisdom allow justice and force to speak together and better resist war. -/- Marcel Boisard thinks that on the day the guns fall silent, exhausted by war, we will not return to the state borders that have prevailed for a century as an outcome of the Sykes-Picot agreement of 1916. It is time to prepare the “day after”, which will be a huge challenge. To this end, a summit of Middle-East nations is urgently needed to globally decide the fate of those peoples. On the condition that we know who the enemy is and accept to name it, to understand the history of the countries, groups and alliances, and to question any false or self-interested sense of certainty. -/- *** In the second section, Paul Schafer provides the author’s experiences to explain how culture, from the artistic to the biological, has the power to to open the doors to spirituality, from the inner self to the global environment. He asks himself whether a relative permanence of spirituality can arise from the specific moments that characterize it. Laurent Ledoux synthesizes the conclusion of a symposium held on 22 January 2015 on the links between philosophy and management, on the basis of the spiritual dimension conceived as “natural” and the answers it may suggest to the issues that face the organizations in a “contemporaniversal” world. Jacques Rifflet makes that question in a secular perspective, based on the wellsprings of personal commitment before it can be caught by any religious creed or scientific theory. In this sense spirituality, in alliance with reason, both inspires human consciousness and illuminates its destiny. Sami Aldeeb asks himself whether Islam can be reconciled with human rights. Caught between the belief in an absolute and final Word descended from the sky, and evidence showing that any religion is the creation of a given culture and a society situated in time and space, the Makkan and … contexts et médinois call for differentiated, if not opposite answers and exegeses. Bernard Carmona provides the outline of a dialogical framework, which is known to be a feature of debates between the various philosophical schools of classical India, exemplified here by the transdisciplinary perspective of debates within a Buddhist context. *** The articles not focused on the previous topic include a study by Landry Signé on China’s strategy, competing with the United States to control African resources. The author deals with the specific case of China’s rapprochement with Southern Sudan since Sudan was broken up. In the last paper, Goran Fejić and Rada Iveković, return to the essential role that women should play, and comments upon the role of some international legal instruments related in particular to the elimination of all forms of discrimination. The perspective is transnational and transethnic and is based on secular criteria, as regards nation-building and more generally society-building. Considering the persistence of widespread violence, whether in times of armed conflict or in times of peace, the question remains whether it is possible to fully implement rights and justice instruments. This paper introduces Basic Intuitionistic Set Theory BIST, and investigates it as a first-order set theory extending the internal logic of elementary toposes. Given an elementary topos, together with the extra structure of a directed structural system of inclusions on the topos, a forcing-style interpretation of the language of first-order set theory in the topos is given, which conservatively extends the internal logic of the topos. This forcing interpretation applies to an arbitrary elementary topos, since any such is equivalent to (...) one carrying a dssi. We prove that the set theory BIST+Coll is sound and complete relative to forcing interpretations in toposes with natural numbers object . Furthermore, in the case that the structural system of inclusions is superdirected, the full Separation schema is modelled. We show that all cocomplete and realizability toposes can be endowed with such superdirected systems of inclusions.A large part of the paper is devoted to an alternative notion of category-theoretic model for BIST, which, following the general approach of Joyal and Moerdijkʼs Algebraic Set Theory, axiomatizes the structure possessed by categories of classes compatible with BIST. We prove soundness and completeness results for BIST relative to the class-category semantics. Furthermore, BIST+Coll is complete relative to the restricted collection of categories of classes given by categories of ideals over elementary toposes with nno and dssi. It is via this result that the completeness of the original forcing interpretation is obtained, since the internal logic of categories of ideals coincides with the forcing interpretation. (shrink)
