O presente artigo desenvolve questões sobre o estudo das marcas de água dos séculos XV a XIX, procurando clarificar as especificidades de uma terminologia própria, e evidenciando a importância da sua interpretação e descodificação. Só assim toda a simbologia contida na marca de água, ou na(s) contramarca(s), se revela como uma fonte para o conhecimento da arte de fazer papel.

O estudo da iconografia do livro impresso em Portugal entre os séculos XV e XVIII não prescinde do levantamento, tão extenso quanto possível, de marcas de água e contramarcas identificadoras do papel em que as obras foram estampadas. Este levantamento sistemático é tanto mais indispensável quanto são raros e avulsos os estudos portugueses neste campo da investigação histórica. O conjunto de marcas a reunir, algumas centenas de unidades, permitirá uma visão cronológica e panorâmica dos motivos iconográficos das filigranas utilizadas na (...) produção do papel das obras impressas no nosso país, revelando a sua origem e contribuindo para a investigação no âmbito histórico, artístico e económico. A reliable medical image management must provide proper security for patient information. Protecting the medical information of the patients is a major concern in all hospitals. Digital watermarking is a procedure prevalently used to secure the confidentiality of medical information and maintain them, which upgrades patient health awareness. To protect the medical information, the robust and lossless patient medical information sharing system using crypto-watermarking method is proposed. The proposed system consists of two phases: (i) embedding and (ii) extraction. In this (...) paper, we securely share three types of patient information, medical image, electronic health record (EHR), and face image from one hospital to another hospital. Initially, all the three inputs are encrypted and the information is concordant. In order to enhance the robustness of the crypto-watermarking system, the obtained bit stream is compressed, and the compressed bit streams are embedded into the cover image. The same process is repeated for the extraction process. The experimentation result is carried out using different medical images with EHR, and the effectiveness of the proposed algorithm is analyzed with the help of peak signal to noise ratio. (shrink)

In this paper a new technique of dual image watermarking is proposed for protection of ownership rights which utilizes salient properties of homomorphic transform (HT), discrete wavelet transform (DWT), singular value decomposition (SVD) and Arnold transform (AT). In embedding algorithm host image is splitted into reflectance and illumination components using HT, DWT is further applied to the reflectance component resulting in frequency subbands (HL and LH) which are transformed by SVD. Two image watermarks are selected for embedding process whereas security (...) of proposed algorithm is strengthen by performing scrambling of second watermark through AT. Both watermarks are transformed with DWT and SVD. Singular values (SVs) of both transformed watermark are embedded into SVs of host image. Simulation results clearly signifies for high robustness and imperceptibility of proposed algorithm as it is examined under various attacks. Superiority of proposed technique is illustrated by comparing it with other reported methods. (shrink)

In this paper we will discuss some epistemological aspects of lexical and terminological usage in the international arena, with special reference to the different rhetorics of the social and natural sciences. Sociolinguistic research confined to monolingual communities suggests that close-knit network structure is an important mechanism of language maintenance, in that speakers are able to form a cohesive group capable of resisting pressure, linguistic and social, from outside the group (MILROY, 1987). The concept of a linguistic norm in sociolinguistic theory (...) can be viewed here as the product of "cultural focusing". In the same way, intercultural communication is characterized by the spreading of standardized terminologies (ISO) and conceptual modes of thinking associated with a common scientific and technological practice in cross-border communities. A basic feature is frequent language interaction, based upon the need for scientific exchange and upon the extralinguistic models conveyed by powerful inter/transnational links and shared scientific paradigms. In this context, an international standard language could be seen as another case of cultural focusing, where intercultural contact would evolve along monocultural lines. However, a formally standardized language may conceal conceptual fuzziness, as has been shown for example in analyses of the kind of language used by social scientists (INTERCOCTA) or found in political rhetoric (ECCRDSS). The semantic and pragmatic differentiations of these latter forms of intercultural communication, and more generally, the interactions between the ordering of knowledge, the transfer of this knowledge through standardized language and the variety of cultural perceptions, call for a polylogic framework that accounts for their coexistence. This paper examines the translation of literary terminology as cultural sign in the selected versions of the History of Chinese Literature in the Anglophone world. It argues that classical Chinese literary terminology with its rich connotations and strong prescriptiveness as „symbol‟ in semiotics, holds great difficulty for translators and scholars. Its inherent social and cultural elements in determining the meaning of these terms cannot be transferred across cultures, thus causing problems such as „neutralization‟ either in free or literally translation or (...) transliteration of these terms. The paper points out that an ideal way out for translation of classical Chinese literary terms should be transliteration coupled with proper notes. Although not qualified as translation in the strict sense, transliteration could, in some way, remind the readers of the heterogeneity of the term, thus offsetting the negative effect by the “neutralization” of the term. It could also guarantee the term‟s independency with the ultimate aim to make the term accepted by and integrated into the culture of the new land. (shrink)

This paper recommends that experimental analysts of language development abandon for the purposes of experimental inquiry both the term "language" and the concept it designates. In support of this recommendation, the paper dis cusses the multiple meanings of "language," the proposal that "language" refers to behavior, the implicit acceptance by behavior analysts of psycholinguistic thought despite their ostensible rejection of it, and the nature of language as a subject matter. In addition, the nature of common-sense psychology, the domain of behavior (...) analysis, the formal nature of Chomskyan linguistics, and the rela tion between psychology and behavior analysis are discussed. Among the political changes brought about by the First World War was the formation of new countries, including Latvia. This in turn resulted in a strong need for the first national legislative acts and thus a substantial amount of effort to develop Latvian legal terminology which dates back to the beginning of the 19th century. The purpose of the paper is to study the development of Latvian terminology of marriage in the 20th century through analysis of the relevant body of (...) laws. The paper focuses on marriage-related terms extracted from the major legislative acts governing the institution of marriage in the 20th century. The present study adopts the qualitative research approach which constitutes data collection and data analysis. For the purposes of a comprehensive and efficient analysis of the extracted legal terms, marriage terms are divided into the following five thematic groups: 1) engagement; 2) entering into marriage; 3) nullity of marriage; 4) dissolution of marriage ; and 5) consequences of dissolution or nullity of marriage. The paper suggests that the core of the Latvian terminology of marriage has remained stable, as entering into marriage is a solid procedure where two interested parties give notice to a public or religious institution in order to officially register their relationship. Similarly, both parties often feel the need to terminate this relationship just as officially. This stability of fundamental processes contributes to terminological continuity. (shrink)

The purpose of this paper is to highlight the importance and impact of terminology used to describe corporate social responsibility (CSR). Through a review of key literature and concepts, we uncover how the economic business case has become the dominant driver behind CSR action. With reference to the literature on semiotics, connotative meaning and social marketing we explore how the terminology itself may have facilitated this co-opting of an ethical concept by economic interests. The broader issue of moral muteness and (...) its relation to ethical behaviour is considered. This paper examines the concept of “terminological gaps” and strives to identify suitable methods for dealing with them during translation. The analysis begins with an investigation of the contended notion of gaps in terminology based on empirical examples drawn from a German-Italian terminological database specifically designed for translation purposes. Two macro categories of gaps are identified, conceptual and linguistic level gaps, which only partially correspond to previous observations in the literature. The paper uses examples to explore the advantages of ontological (...) representations for detecting conceptual terminological gaps and identifying appropriate translation strategies. However, limitations are also observed and an attempt is made to resolve these using a frame-based approach. A frame-based analysis reveals that while certain designations may appear to refer to convergent conceptual units with matching distinctive features, differences also emerge due to the way the two language systems build designations. Examples from the corpus make it evident that a frame-based approach is helpful for identifying both kinds of terminological gaps, and then resolving them during translation. An important presupposition for this approach is that larger units of analysis need to be addressed rather than just terms themselves. There is confirmation of the existing idea that methods embracing entire segments or paragraphs as units of investigation are preferable during translation, and this is also seen to apply in terminological studies. Ontology is currently perceived as the solution of first resort for all problems related to biomedical terminology, and the use of description logics is seen as a minimal requirement on adequate ontology-based systems. Contrary to common conceptions, however, description logics alone are not able to prevent incorrect representations; this is because they do not come with a theory indicating what is computed by using them, just as classical arithmetic does not tell us anything about the entities that are added or (...) subtracted. In this paper we shall show that ontology is indeed an essential part of any solution to the problems of medical terminology – but only if it is understood in the right sort of way. Ontological engineering, we shall argue, should in every case go hand in hand with a sound ontological theory. (shrink)

During the summer of 1900, the Chemical Section of the Society for the Promotion of Russian Industry and Commerce in Warsaw published a very special booklet in which prominent philologists debated proposals concerning adjustments to chemical nomenclature. Several issues were discussed, including systems of classification of chemical compounds, new specialist terms, and which element names to select among the many then in use. Chemists translated and modified these proposals while strongly disagreeing with using philological expertise. But both the booklet and (...) the debate were novelties within discussions on chemical terminology, which provides an opportunity to examine the peculiarities of such endeavors. This article examines this special moment in the history of chemistry when chemists ceded (partially) their authority over their subject to philologists. I discuss how this episode was shaped by the low grade of academic professionalization in the Polish-language scholarly community and the practical needs of industry, which engendered different habitus among scholars debating chemical issues. This paper asks what language was for chemists and philologists and which epistemic ideals were linked with it. I argue that this episode was a form of interdisciplinary interrogation in which philologists and their arguments were instrumentalized for the needs of chemists. (shrink)

In the Internet age, information security is threatened anytime and anywhere and the copyright protection of audio and video as well as the need for matching detection is increasingly strong. In view of this need, this paper proposes a zero-watermarking algorithm for audio and video matching based on NSCT. The algorithm uses NSCT, DCT, SVD, and Schur decomposition to extract video features and audio features and generates zero-watermark stream through synthesis, which is stored in a third-party organization for detection and (...) identification. The detection algorithm can obtain zero watermark from the audio and video to be tested and judge and locate tampering by comparing with the zero watermark of the third party. From the experimental results, this algorithm can not only detect whether the audio and video are mismatched due to tampering attacks but also locate the mismatched audio and video segments and protect the copyright. This paper offers a reflection on the complicated relationship between Derrida and Heidegger, particularly as concerns the issue of difference in their respective thoughts. Taking one of Geschlecht III’s most stunning passages as my point of departure, I walk the reader through some of Derrida’s own remarks on his relationship to Heidegger, before arriving at the différend that seems to exist between them as regards the notion of difference itself. I argue that the margins of Heidegger’s text inscribe a quite (...) radical thinking of difference not at all incompatible with Derridean différance. In conclusion, I turn to Heidegger’s “Anaximander Fragment” where, in the margins of Heidegger’s text, we find a marginal note that, given its content, could surely have been written by Derrida himself. This paper analyses the use of legal terminology in Roman love elegy of the 1st century BCE. Catullus, Tibullus, and Ovid all employ this seemingly strange vocabulary in their love poetry for different ends, while also sharing some specific similarities. This legal vocabulary does not make these love poems stilted, dry, nor unemotional, but is used deftly and rather indicates an interesting layer of Roman concern and preoccupation.

This paper deals with translating legal terminology concerning child maintenance from Polish to Swedish. The analysis covers selected terms regulated in the Polish civil law and their possible Swedish equivalents. The method used is based on the parameterisation of legal terms, which allows the specification of terms by selected parameters, which are understood as mutually exclusive properties. The parameterised equivalents are analysed in the context of various types of recipients. This provides the basis for the choice of appropriate translation strategies. (...) Heidegger, reflecting a distinctive style of conceptual thinking, seems to be a complex, structurally ordered system: a fixed and a condensed idea of human existence. Lots of individual existentials, different in their meanings, forms and terminological values point to the creative and systematic efforts of the philosopher to find an appropriate name for each of the components of the analyzed significant structures of human being. The empirical study of Heidegger’s terminology focuses on the most important (...) naming strategies in creating terms and words with distinctive lexical structures, as well as on their functions. The aim of the paper is to unveil the mystery of the language structures of Heidegger’s neologisms and to offer a key to decoding their meanings, making them more easily translatable. (shrink)

While in the majority of English-speaking territories the dominant legal tradition iscommon law, in Louisiana and Quebec the native language is English and the legal system stems from continentalcivil law. Both the Louisiana Civil Code and the Civil Code of Quebec take root in the European codification movement, following Code Napoleon. Bearing in mind the link between law and language, these jurisdictions provide a unique source of Englishcivil lawterminology with well-founded conceptual background.The civil codes of Louisiana and Quebec seem to (...) be potentially useful for the translation of Polish private law into English. Yet there are some reservations which should be considered. By comparing two different translations of Article 292 of the Polish Civil Code, this paper is intended to contribute to the debate on the use of Quebec and Louisiana terminology in Polish-English legal translation. Not the least noticeable is the fact that the ancient Greek compound euthanasia, formed by Francis Bacon, has retained its original terminological form since it was first used in the 17th century. Among all other controversial ethical issues, however, the conceptual notion of euthanasia categorically evokes rather important controversies. The questions that arise in this context are whether there is a definition, or at least a determination, of the term euthanasia and whether we are aware of its use in scientific (...) discourse, what exactly is euthanasia. The paper offers a terminological elaboration of the term euthanasia in a linguistic, but mainly legal and medical-procedural context, in order to examine the coherence in defining the term between these categories and, consequently, to determine the key determinants of euthanasia according to categorical sections. The key facts stated are the primary determination or the possible definition of the term for any further scientific study of euthanasia as one of the most controversial issues within bioethical doctrine. The paper discusses the problem of translating selected Civil Procedure terminology from Greek into Polish and from Polish into Greek. The research material includes corpora of normative acts and more precisely those, which regulate Civil Procedure of Poland, Greece and the Republic of Cyprus. The research methodology is based on the concept of parameterisation, according to which the legal linguistic reality becomes axiomatic. Then the set of relevant dimensions and parameters is extracted. The set of parameters are a tool where (...) certain information is given: yes/no/none and thus a clear result of comparison between legal system bond terminology can be drawn up. The results of this comparative analysis provide highly regulated and available translation equivalents, which are essential when legal translation is performed within the frame of legal reality. The aim of this paper is to discuss a selection of Japanese rape-related terminology and their potential equivalents in English and Polish. In this article the author will present an analysis of chosen rape-related terminology which is present in legislation and other legal texts, as well as in the media. Firstly, the definitions of selected terms will be provided; next, potential equivalents from the British, American, and Polish legal systems will be chosen in order to carry out comparative linguistic analysis. Legal terminology changes as a result of language usage, technological development, political and social changes and even economy reasons. The following research methods have been applied: the terminological analysis of the research material and the analysis of pertinent literature. The research material included legislation from the United Kingdom, the United States of America, Canada and Australia. Several fields contributing to psychiatric advances, such as psychology, biology, and the humanities, have not yet met to produce a cohesive and integrated picture of human function and dysfunction, strength and vulnerability, etc., despite advances in their own areas. The failure may have its roots in a disagreement on what we mean by the human person and his or her relationship with the world, for which the incommensurate language of these disciplines may be partly to blame. Turns taken by western (...) philosophy over the past 400 years may help to explain this. Language is such an important tool for psychiatrists, that examination of it may afford an insight into the reasons for divisions in the field. This paper aims to examine and compare psychologies (and hence psychiatries) derived from modern western philosophy, with similar concepts in other cultures, through the study of developments in terminology, in terms of the simplest facts about what it means to be human. Terminology used in mental health in western cultures is examined, with particular consideration of the term “self” as it has come to be used in a technical sense. Analogous terms from non-English speaking European languages, and some non-western cultures are studied. Western philosophy and psychology have evolved a meaning for the term “self” which is quite different from equivalent terms in non-western cultures. It is a moot point whether or not the development in western psychiatry of what are now technical terms to describe normal human experience has become needlessly obscure and ambiguous. It is not evident that this “new” language represents a genuine advance in understanding; it distances mental health professionals from those who are not familiar with it; and it makes transcultural dialogue difficult. In the study of special languages and translation, the legal field is often insulated from other domains. This is primarily due to the extreme system dependence of the terminology of law, which results from a lack of a common legal system of reference throughout the world. The abstract nature of this human-made field and its dynamicity in view of the continuously evolving case law and constant changes in legislation make it difficult to illustrate its complex ontology through traditional terminology management (...) techniques. Therefore, this paper argues for an interdisciplinary approach to constructing the ontology of legal concepts based on structural constituents from frame semantics and comparative law. Frames allowing for the representation of interconnected knowledge segments evoked by legal concepts and the distinction between micro- and macro-dimensions in legal comparison research make it possible to capture the complex ontology of legal terminology evoked in a specific point in time and a determined legal context. The paper deals with the problem of translating selected insolvency terminology from Polish into English and from English into Polish. The re- search corpora encompassed the Insolvency Act 1986 as amended and Ustawa z dnia 28 lutego 2003. Prawo upadłościowe i naprawcze [the Act on Polish Insolvency and Rehabilitation Law of 28th February 2003 as amended]. The research methods included: the comparison of parallel texts, the method of axiomatisation of the legal linguistic reality, the termino- logical analysis of the corpus (...) material, the concept of adjusting the target text to the communicative needs and requirements of the community of recipients and the techniques of providing equivalents for non-equivalent terminology. The research hypothesis has been so formulated that the parametrisation of legal reality may assist in finding more adequate equivalents and determine differences in meaning of compared source and target language terms, which in turn facilitates the choice of a more adequate technique of providing equivalents for non-equivalent or partially equivalent legal terminology meeting the com- municative needs of translation recipients. The research results revealed that insolvency terminology is highly system-bound and available equivalents may often be misleading for the community of target text recipients. (shrink)

Studying cultural memory and practices of “oblivion” and “remembrance”, scholars encounter a whole range of phenomena which have remained nameless and practically undescribed in special literature so far and, therefore, are, in a manner of speaking, “illegitimate”. Moreover, to use well-established terminology inevitably means to employ traditional approaches, which due to their retrospective character aren’t able to recognize new phenomena. Thus, we should describe such phenomena and “bring them to light” by means of specific terminology. The paper introduces these fundamental (...) terms, allowing for the description of previously unapparent cultural phenomena. The list of these terms includes “cultural exclusion zones”, “current (field) of culture”, “deactualization,” “reactualization”, and “cultural frontier (borderline) zones”. (shrink)

The goal of this paper is to reconsider some key concepts of nondualist Kashmirian Śaivism whose interpretation and translation have generally been the subject of some sort of silent consensus. Through the close examination of a particular text, the Paramārthasāra of Abhinavagupta and its commentary by Yogarāja, as well as of related texts of the system, I shall attempt to improve upon the understanding and translation of terms such as ghana (and the compounds derived therefrom), the roots sphar, sphur, pra]kāś (...) etc., and their derivatives, bhavanakartr̥tā, and the names of the three malas. The importance of forests is reflected in the national forest legislation which has been developed and implemented in European countries over recent years. Due to regional and national specificities, forest regulations include culturally immersed terms specific to the described area. The aim of this paper is to analyses the culturally driven legal terms existing in specific legal regulations concerning forestry in Germany, the United Kingdom, the United States of America and Poland, and identify possible ways of translating them. In order (...) to take the interdisciplinary nature of the issue into account, the degree of hybridity of the selected texts will be examined by means of corpus analysis. The methodology applied in the paper uses a comparative approach. Additionally, the authors also resort to the aforementioned corpus analysis, as well as the analysis of comparable texts and the analysis of terminology according to the three categories of equivalence as determined by Šarčević, and the techniques of providing equivalents for non-equivalent or partially equivalent terms as research methods. The material used for analysis comes from selected German, English and Polish legal acts regulating forest management and maintenance that are considered as corpora for the selection of culturally immersed terminology, namely: the Polish Act on Forests of 28th September 1991 [Ustawa z dnia 28 września 1991 r. o lasach], Title 16 U.S. Code Chapter 2—National Forests, Forestry Act 1967, Chapter 10, German Forestry Act 1975 [Gesetz zur Erhaltung des Waldes und zur Förderung der Forstwirtschaft von 1975]. The paper concerns potential problems that could occur in the translation of culturally immersed legal terminology due to the terms’ rigidity and high degree of specificity. The studies presented will allow conclusions to be drawn regarding the possibilities and strategies for translating culturally immersed terms. SummaryThe history of languages is closely related to the history of other human activities. Ideally, hypotheses that are designed for linguistic questions on independent grounds should help to consolidate theories in other knowledge fields, such as the history of ideas. This paper deals with the first Portuguese translation of Forbonnais's Elémens du commerce, considering it as a lexical corpus. The linguistic analysis aims to contribute to the general knowledge about this text and its translations. Furthermore, a lexical analysis of Portuguese (...) data can also be understood in the broader context of Romance languages. To this end, we analysed three linguistic expressions, perceived to be representative case-studies: identifying circulação as a terminological loan, the terminological use of a common word and the contrast between terms from different languages. Translations are obvious tools for communicating new ideas. Carrying out linguistic analyses of translations can help to document how ideas take shape. Furthermore, translation studies provide linguistic evidence that is essential for the study of terminology from a diachronic and inter-linguistic standpoint. Data provided by translated texts helps to clarify the date when neologisms were first introduced in a given language. It also helps to identify possible sources of words and to decode the meaning behind lexical innovation. The cyber domain is one of the newest and most rapidly evolving fields of knowledge which has led to the development of a new area of law—cyber law, that regulates the use of the Internet and activities performed over the Internet and other networks. The cyber domain is particularly dynamic: new concepts are constantly developed and need new terminological designations, which in turn need new counterparts in other languages. Formation of these designations and their counterparts often raises terminological issues that (...) are important to deal with in order to develop a coherent system of the cyber domain terms. The given paper focuses on the terminology that includes the lexical item cyber which may be considered as the main signifier of the cyber domain indicating its specific nature. The aim of the paper is threefold: to analyse the origin and development of the lexical item cyber, to investigate conceptual categories of the EU legislation terminology that includes the lexical item cyber and to establish the Lithuanian counterparts that are used for translation of the lexical item cyber in the Lithuanian equivalents of the English terms. For the purposes of the study, the ad hoc English and Lithuanian corpora of the EU legislative documents were compiled. Corpus-driven methodology was used to extract and investigate the terminology used in the corpora. The results of the research are believed to provide useful information to learners and teachers of the legal language and legal translation, as well as drafters of legislative and administrative documents and other professionals engaged in cybersecurity matters. The importance of pedagogy as a science is in exploration and improvement of education as an integral part of the social reality. Theory of education, General pedagogy and Methodics of educational work are the scientific disciplines that are most directly related to examining the educational work, and represent its theoretical and methodological basis in the process of its realization. Educational work provides the essence of the overall education process, since it refers and unites the knowledge, skills, attitudes, beliefs and values (...) of the individual, and its results are seen in developing student’s unique personality. In this paper the focus is on the Methodics of educational work, as a pedagogical discipline which is most closely related to the process of realization of educational work. The aim is through analysis of the basic theoretical and terminological aspects to emphasize its role in the overall education process. Taking into consideration the complexity of educational work and difficulties related to the process of assessment of the outcomes, application of the taxonomy of the affective domain is suggested as a possible approach. Also, the importance of some topics that are particularly relevant in pedagogy is emphasized, but which, due to terminological inconsistencies, are not sufficiently recognized as part of the Methodics of educational work. Such personality traits are viewed through the prism of forming the future biology teachers’ professional and terminological competence. The main aspects and categories that characterize the professional and terminological competence of future biology teachers, including terminology, nomenclature, term, nomen (...) and term element, have been explained. The criteria and stages of shaping the future biology teachers’ professional and terminological competence during the vocational training process have been fixed. Methods, techniques, technologies, guiding principles and forms of staged work on the forming of an active terminological dictionary of students have been described and specified. The content of the distant special course “Latin. Botanical Terminology”, which provides training for future teachers to study the professional subjects and to understand of international scientific terminology, has been presented. It is concluded that the proper level of formation of the future biology teachers’ professional and terminological competence will eventually ensure the qualitative preparation of pupils for life in a sustainable development era. This paper explores the nature of the language used when teaching mathematics to young children. It proposes that an important part of the teaching of a mathematical concept is the introduction of specific terminology. Children may need to be taught new meanings for already familiar words. The timing of these introductions to new words or meanings is critical to their understanding of the concepts being taught. It will be argued that there are two aspects of the children's learning that need (...) to be considered. First, their understanding of the concept being introduced, and secondly, their learning the appropriate word to describe that concept. By assessing children's understanding of new mathematical concepts through their own use of the terminology, the teacher can then negotiate new meanings with them through practical experiences, introducing new word meanings only when the concepts have been understood. Following the manuscript's discovery in 1864, scholars have widely assumed that De Jure Praedae (Commentary on the Law of Prize and Booty) was written by the Dutch lawyer Hugo Grotius (1583–1645) in the period 1604–1606. Yet the conventional dating fails to consider the materiality of Ms. BPL 917 in Leiden University Library. By analyzing paper supplies, this article throws new light on the date and manner of the manuscript's composition. The watermarks in the paper, the quire divisions and foliation are (...) considered in combination with relevant textual evidence, such as manuscript references to historical events and any allusions to Ms. BPL 917 in Grotius’ letters and other archival sources. This approach has yielded unforeseen results. Yes, Grotius wrote out the original text in 1604/05, as a fair copy of a previously existing work. Yet he did not stop there. Entire folio-pages were crossed out in Ms. BPL 917 and new ones inserted in the following sequence: - in, or shortly before, January 1607, Grotius deleted f. 63v and 67r and inserted f. 64–66 - between January 1607 and Nov–Dec. 1608, he deleted f. 7v, 19r, 38v, and 43r-v and inserted f. 8–9, 18, and 39–42 - in November–December 1608, he deleted f. 119r–122r and inserted f. 117–118. These revisions were a direct response to the challenges faced by the Dutch East India Company (VOC) in this period. Its growing empire in Southeast Asia was under threat from the peace and truce negotiations between the States General and Philip III of Spain and Portugal. Grotius’ revisions of Ms. BPL 917, along with chapter twelve's appearance as Mare Liberum in April 1609, justified the continuation of Dutch empire-building in the East Indies, the Twelve Years’ Truce (1609–1621) notwithstanding. Grotius’ rights and contract theories made it perfectly acceptable to conclude a peace or truce in (Western) Europe, yet persist in colonial warfare beyond the Line (i.e. the Tropic of Cancer). In this respect – the (implicit) differentiation between ‘the West and the rest’ in international relations – Grotius’ legacy is still with us today. (shrink)

The aim of the paper is to present the diachronic changes taking place in legal languages and discuss whether the translators, who for some reason use as an equivalent an obsolete term, may produce a target text which is communicatively ineffective. The research methods applied encompass: the parametric approach to the interlingual comparison of legal terminology for translation purposes, the analysis of pertinent literature on translation and translation errors, the analysis of comparable texts for the purpose of observing diachronic changes (...) in terminology. The diachronic change in terminology most frequently is the result of the amendments of legislation or repealing one act and replacing it with a new one. The terminological changes are especially frequent when the change in the political system occurs and the need appears to adjust the legal system to the new political ideology and principles. For that reason, the authors have analysed in detail three Polish acts on copyright enacted under three different political regimes that is to say (i) after the First World War when Poland regained independence after 123 years of occupation (Act of 29 March 1926 on Copyrights [Ustawa z dnia 29 marca 1926 r. o prawie autorskiem]), (ii) under the communist rule in Poland that lasted from 1945 until 1989 (Act of 10 July 1952 on Copyrights [Ustawa z dnia 10 lipca 1952 r. o prawie autorskim]), and finally (iii) after the collapse of communism in Poland and the period of transition into the democratic and free market society (Act on Copyrights and Related Rights of 4 February 1994 [Ustawa o prawie autorskim i prawach pokrewnych z dnia 4 lutego 1994 roku]). Apart from the main Polish corpus of above-mentioned acts, the authors have also provided examples from some other languages to confirm that the diachronic changes take place everywhere and miscommunication problems resulting from using an obsolete term in translation may occur in any pair of languages. In the last part of the paper the problem of the scale of miscommunication resulting from the usage of obsolete terminology in the target text is discussed. (shrink)

The aim of the paper is to analyse works by Gumilev and Huntington from the point of view of their approaches and terminologies. Both of them have attempted to give an overall explanation of new phenomena in world history. Though the terminology differs, their arguments are relatively similar. They propose a synthetic approach that looks at the whole of society and puts them among historians specializing in issues of civilization, a theory whose validity, together with the status they are given, (...) is still very controversial at the present time. Analogies and differences are discernible first through their taxonomic system. Both authors also try to answer the question as to the eastern border of western civilization. (shrink)

The idea of personalised medicine (PM) has gathered momentum recently, attracting funding and generating hopes as well as scepticism. As PM gives rise to differing interpretations, there have been several attempts to clarify the concept. In an influential paper published in this journal, Schleidgen and colleagues have proposed a precise and narrow definition of PM on the basis of a systematic literature review. Given that their conclusion is at odds with those of other recent attempts to understand PM, we consider (...) whether their systematic review gives them an edge over competing interpretations. We have found some methodological weaknesses and questionable assumptions in Schleidgen and colleagues’ attempt to provide a more specific definition of PM. Our perplexities concern the lack of criteria for assessing the epistemic strength of the definitions that they consider, as well as the logical principles used to extract a more precise definition, the narrowness of the pool from which they have drawn their empirical data, and finally their overlooking the fact that definitions depend on the context of use. We are also worried that their ethical assumption that only patients’ interests are legitimate is too simplistic and drives all other stakeholders’ interests—including those that are justifiable—underground, thus compromising any hope of a transparent and fair negotiation among a plurality of actors and interests. As an alternative to the shortcomings of attempting a semantic disciplining of the concept we propose a pragmatic approach. Rather than considering PM to be a scientific concept in need of precise demarcation, we look at it as an open and negotiable concept used in a variety of contexts including at the level of orienting research goals and policy objectives. We believe that since PM is still more an ideal than an achieved reality, a plurality of visions is to be expected and we need to pay attention to the people, reasons and interests behind these alternative conceptions. In other words, the logic and politics of PM cannot be disentangled and disagreements need to be tackled addressing the normative and strategic conflicts behind them. (shrink)

Legal terminology is deemed a key feature of legal discourse and a pivotal constituent of competence evaluation and quality control in the translation of legal texts. Problems of terminology unequivocally prove the need for analysing factors governing changing situations as well as macro-textual parameters and measures for the sake of making strategic decisions at a micro-level. There have been a lack of translation methodology among practitioners and trainees and a lack of a practical operational model that comprises all the primary (...) measures and criteria for analysing translation. The present paper seeks to test the efficacy of the integrative model proposed by Prieto Ramos The Ashgate Handbook of Legal Translation, Ashgate Publishing Limited, Surrey, 2014) in surmounting terminological problems of Arabic-English legal translation through applying the said model to the translation of the three Arabic Islamic legal terms: ‘bayʿu al-tawliya’, ‘bayʿu al-wafāʾi wal-amāna’ and ‘takhliya’ into legal English. The present paper claims that the integrative model proposed by Prieto Ramos The Ashgate Handbook of Legal Translation, Ashgate Publishing Limited, Surrey, 2014) proves useful and fruitful in coping with terminological incongruencies and particularly successful in surmounting problems of rendering legal terms from legal Arabic into legal English. This may be owing to the fact that the said integrative model encompasses all the steps and criteria required for adopting plausible strategic translation decisions. (shrink)

The roles companion animals have played in our lives has dramatically changed over the last few decades. At the same time, the terms we use to describe both the people and animals in these human-animal relationships have also changed. One example includes the use of the terms ‘owner’ or ‘guardian’ to refer to the human caretaker. While preferences by society appear to indicate increased interest in referring to companion animal caretakers as ‘guardians’, others have cautioned against its use or attempted (...) to restrict it. Additionally, the use of animal welfare terminology has direct implications for how we conduct both welfare research and practice. Our paper examines the use of ‘owner’ and ‘guardian’ with respect to (1) the implications for changing terminology on the function, clarity and uniformity of their use, and (2) the ethical and welfare impact that coincides with each term’s use. Our goal is to propose terminological considerations that could influence future welfare research, as well as help guide our interactions with companion animals. (shrink)
