Modern social and political thought has approached the questions of politics, law, and citizenship from the vantage point of a fundamental divide between the occidental and oriental, or archaic and modern, institutions. This article creates a concept, the gift of law, by staging two gift-giving practices as two historical moments: Greek euergetism and Ottoman waqf. While it is indebted to Mauss, our articulation of the gift of law also owes to the critical interventions of Jacques Derrida and Pierre Bourdieu, who (...) emphasized non-voluntaristic and non-calculative aspects of the gift. We argue that both euergetism and the waqf enabled and substantiated legal subjectivities that allocated rights and obligations. Those gift-giving practices establish relationships between various groups and legal authorities that were crucial in the formation of cities as spaces of government, for both citizens and non-citizens alike. With the concept ‘gift of law’, categories ‘oriental’ and ‘occidental’ become problematic. (shrink)

The commentary raises political questions about the ways in which data has been constituted as an object vested with certain powers, influence, and rationalities. We place the emergence and transformation of professional practices such as ‘data science’, ‘data journalism’, ‘data brokerage’, ‘data mining’, ‘data storage’, and ‘data analysis’ as part of the reconfiguration of a series of fields of power and knowledge in the public and private accumulation of data. Data politics asks questions about the ways in which data has (...) become such an object of power and explores how to critically intervene in its deployment as an object of knowledge. It is concerned with the conditions of possibility of data that involve things, language, and people that together create new worlds. We define ‘data politics’ as both the articulation of political questions about these worlds and the ways in which they provoke subjects to govern themselves and others by making rights claims. We contend that without understanding these conditions of possibility – of worlds, subjects and rights – it would be difficult to intervene in or shape data politics if by that it is meant the transformation of data subjects into data citizens. Much has been written about data politics in the last decade, which has generated myriad concepts such as ‘surveillance capitalism’, ‘gig economy’, ‘quantified self’, ‘algorithmic governmentality’, ‘data colonialism’, ‘data subjects’ and ‘digital citizens’. Yet, it has been difficult to plot these concepts into an historical series to discern specific continuities and discontinuities since the origins of modern power in its three major forms: sovereign, disciplinary and regulatory. This article argues that the coronavirus pandemic in 2020 brought these three forms of (...) power into sharp relief but made particularly visible a fourth form of power that we name ‘sensory power’, which has been emerging since the 1980s. The article draws on early studies of power by Michel Foucault, subsequent studies on biopower and biopolitics that expanded on them, and studies in the past decade that focused on data produced from apps, devices and platforms. Conceptual engineers endeavor to improve our concepts. But their endeavors face serious practical difficulties. One such difficulty – rational conceptual conflict - concerns the degree to which agents are incentivized to impede the efforts of conceptual engineers, especially in many of the contexts within which conceptual engineering is viewed as a worthwhile pursuit. Under such conditions, the already difficult task of conceptual engineering becomes even more difficult. Consequently, if they want to increase their chances of success, conceptual engineers should pay (...) closer attention to – and devise strategies to mitigate – rational conceptual conflict. After outlining the phenomenon at greater length and mapping its connections to other similar practical problems (Section 1), I explore the dynamics of such conflict by way of several detailed case studies (Section 2). In particular, I focus on cases driven by material, social, and moral incentives. I then consider some important methodological implications of rational conceptual conflict (Section 3). Among other things, I argue that conceptual engineers should focus more heavily on cultivating settings that modify the payoffs and penalties associated with conceptual conflict. By such indirect means, they can incentivize conceptual cooperation rather than conflict, thus making it easier to achieve success in conceptual engineering. Section 4 concludes. (shrink)

The production of scientific instruments in America was neither a postwar phenomenon nor dramatically different from that of several other developed countries. It did, however, undergo a step-change in direction, size and style during and after the war. The American scientific instrument industry after 1945 was intimately dependent on, and shaped by, prior American and European experience. This was true of the specific genres of instrument produced commercially; to links between industry and science; and, just as importantly, to manufacturing practices (...) and cultures. I will argue that, despite the new types of instrument commercialized after the war, this historical continuity of links with science and scientists guided and constrained the design and manufacture of these products. Nevertheless, new designers, manufacturers and customers gradually transformed the culture of scientific instruments in the second half of the century. -/- This chapter deals with a subset of the American instrument industry, namely the measuring and monitoring instruments manufactured for scientific use. Even with the specification of ‘scientific’ instruments, however, these borders are rather artificial and unclear: instrument making from the seventeenth through the twentieth century has generally involved the fabrication of both standard products and custom-made devices for scientific use.2 In this context of sales quantities, ‘scientific’ instruments have often been defined as low-volume, special-order or custom devices. In a similar vein, ‘scientific’ instruments were commonly distinguished from ‘production’ instruments by context of usage, namely their very absence from – and indeed irrelevance to – production environments. This demarcation according to customer and environment was mirrored in at least one furth er respect: the training of their users. The classification into ‘scientific’ and ‘engineering’ applications was as fluid as the relationship between American universities and technical industries themselves.Despite these complementary definitions, the notion of the ‘scientific instrument’ was beginning to prove inadequate even at the turn of the twentieth century, and dramatically so when discussing the post-Second World War period. Definitions altered qualitatively after the Second World War in at least three further ways: (a) new genres of device altered the scope of the scientific instrument; (b) the contribution of State and military sponsorship of new forms of instrument became significant; and, (c) the postwar demand for specialist instruments increased rapidly, owing to wartime innovation, new applications and new customers. While new generations of implantable brain computer interface devices are being developed, evidence in the literature about their impact on the patient experience is lagging. In this article, we address this knowledge gap by analysing data from the first-in-human clinical trial to study patients with implanted BCI advisory devices. We explored perceptions of self-change across six patients who volunteered to be implanted with artificially intelligent BCI devices. We used qualitative methodological tools grounded in phenomenology to conduct in-depth, semi-structured interviews. Results (...) show that, on the one hand, BCIs can positively increase a sense of the self and control; on the other hand, they can induce radical distress, feelings of loss of control, and a rupture of patient identity. We conclude by offering suggestions for the proactive creation of preparedness protocols specific to intelligent—predictive and advisory—BCI technologies essential to prevent potential iatrogenic harms. The highly sophisticated techniques of modern engineering are normally conceived of in practical terms. Corresponding to the instrumental function of technology, they are designed to direct the forces of nature according to human purposes. Yet, as soon as the realm of mere skills is exceeded, the intended useful results can only be achieved through planned and preconceived action processes involving the deliberately considered application of well designed tools and devices. This is to say that in all complex cases theoretical reasoning (...) becomes an indispensable means to accomplish the pragmatic technological aims. Hence the abstracting from the actual concrete function of technology opens the way to concentrate attention on the general conceptual framework involved. If this approach is adopted the relevant knowledge and the procedures applied clearly exhibit a logic of their own. This point of view leads to a methodological and even an epistemological analysis of the theoretical structure and the specific methods of procedure characteristic of modern technology. Investigations of this kind, that can be described as belonging to an ana lytical philosophy of technology, form the topic of this anthology. The type of research in question here is closely akin to that of the philosophy of science. But it is an astonishing fact that the commonly accepted and carefully investigated philosophy of science has not yet found its counterpart in an established philosophy of technology. (shrink)

President Obama's Presidential Commission for the Study of Bioethical Issues has just concluded its inaugural meeting, designed as a primer—the first of three that it plans to hold—on synthetic biology. As a topic for deliberation by a national bioethics commission, "synbio" is ideal. A cloud of (...) equipoise hangs over the practical implications of recent developments in this, the latest phase in the evolution of biotechnology—a seemingly genuine uncertainty about the need for additional mechanisms of oversight to mitigate potential risks to biosafety or biosecurity. Despite these concerns, its advocates and practitioners enthusiastically champion the prospect of eventual, perhaps significant benefits to be gained with progress in "synbio," including, for example, enhanced processes for the mass production of vaccines and biofuels. And yet like the advent of recombinant DNA technologies in the mid-1970s, synthetic biology has generated not only hope for benefits and concern for risks, but also questions variously described as "deep," "profound," "fundamental," and "philosophical": Is the capacity to synthesize novel, living entities yet another technological invitation to hubris on the part of humankind? Will that capacity alter the relationship between humankind and nature? How should we think about the moral status of living entities created de novo in the laboratory? Should we even care? How will wide-scale applications of synthetic biology tip the scales of social justice? And finally, the democratization of synthetic biology, the growth of DIY-BIO (do-it-yourself-biology) communities beyond the usual scientific arenas of academia and industry, has infused old questions about scientific freedom and responsibility with new complexities—all in the midst of an American public that is reportedly unaware and uneducated about this new chapter in the often triumphant, unsettling history of biotechnology.Thus, the topic of synthetic biology presents the new commission with several possibilities. It could very well make a substantial contribution to public policies responsive to both the current capabilities and the possible trajectories of [End Page 291] these emergent biotechnologies. The very fact that the President explicitly asked the Commission to take up the topic and report back to him (in six months) means that that potential is especially promising. It could, as well, delve into the "deeper" philosophical questions that "synbio" raises with the aim of bringing both depth and breadth to the tasks of critically analyzing and reflecting upon what currently is known and what, with regard to the future, can only be glimpsed of this amalgam of the life sciences, engineering, and other disciplines. The Commission could also set its sights on diminishing the apparent deficit in public understanding of these biotechnologies. And finally, with this topic as well as any others it takes up, the Commission, along with the administration that established it, could make an effort to reinvigorate public bioethics in the United States. At the very least, in the sobering light of experience with the President's Council on Bioethics, certain actions or behaviors could be avoided in the interests of preserving the integrity—the moral and political legitimacy—of the new commission. To develop more effective ethics education for cross-cultural and international engineering, a study was conducted to determine what Chinese engineering students have learned and think about ethics. Recent research shows traditional approaches to ethics education are potentially ineffective, but also points towards ways of improving ethical behaviors. China is the world’s most populous country, graduating and employing the highest number of STEM majors, although little empirical research exists about the ethical knowledge and perspectives of Chinese engineering students. When compared to (...) engineering students in the US, Chinese engineering students received less ethics education; the form of the education they did receive stressed virtue ethics or the development of moral character; conceive of ethics in contradistinction to the law, where ethics deals with matters of right and wrong not covered by legality. Bill McKibben’s book, Enough, is about cloning, genetic enhancement, and nanotechnology. His thesis is that these things are bad—nay, they are downright evil. In vivid and readable prose, McKibben explains what will soon be possible with these technologies and provides a dystopian portrait of the future. His alarmist tone is effective. Despite having read several similar works and remaining unmoved, McKibben’s images struck home with me. I began to feel, in my gut, anxiety about the genetically engineered future. McKibben is (...) no stranger to raising the dangers of new technology. His The End of Nature is widely acclaimed to have alerted an unsuspecting public about the danger of global warming. Alarmism was appropriate for The End of Nature, since little was written on global warming prior to 1989. But despite McKibben’s effective writing, his alarmism seems out of place for his current topic, since the potential harms of cloning and genetic engineering have been discussed in the academic and popular press for some time. Remember, it has been 34 years since the appearance of Paul Ramsey’s Fabricated Man, and 72 years since Huxley’s Brave New World.McKibben’s most prominent argument against human genetic engineering is that it will cause psychological harm to the people produced from the use of the technology. McKibben claims that people with the knowledge that they resulted from engineered embryos will undergo a crisis in personal responsibility. In this book a distinguished group of environmental experts argues that in order to solve global environmental problems, we must view them in a broad interdisciplinary perspective that recognizes the relations—the interconnected circle—among ecology, economics, and ethics. Currently the circle is broken, they say, because environmental policy is decided on short-term estimations of material that take little account of the economic or moral burdens that will be borne by future generations if we deplete our resources now. We must, assert the (...) authors, have a better knowledge of the science underlying our environmental problems, we must understand their causes and consequences in relation to our economic and political systems, and we must recognize that an effective response will require a shift in a technologically oriented society’s ethical attitude toward the natural environment. Engineering is more cross-cultural and international than ever before, presenting challenges and opportunities in the way engineering ethics is conceived and delivered. To assist in providing more effective ethics education to increasingly diverse groups, this paper shares three related projects implemented at the University of Michigan-Shanghai Jiao Tong University Joint Institute (China). These projects are united in their attempts to address challenges arising from the increasingly global nature of engineering. The first is a course on global engineering ethics, developed for (...) and attended by engineering students from diverse backgrounds. The second is a website hosting contents on global engineering ethics education and conducting research related to cross-cultural moral psychology. The third explores methods of assessing engineering ethics and moral development, using paradigms of ethical decision-making. Although these projects were developed in a Chinese-US collaboration with university students, these contexts could facilitate the adoption of similar programs elsewhere, with practicing engineers. New technologies in germ–line engineering have raised many questions about obligations to future generations. In this article, I focus on the importance of increasing freedom and the equality of freedom for present and future generations, because these two ideals are necessary for a just society and because they are most threatened by the wide–scale privatisation of GLE technologies. However, there are ambiguities in applying these ideals to the issue of genetic technologies. I argue that Amartya Sen's capability theory can be (...) used as a framework to ensure freedom and equality in the use of GLE technology. Capability theory articulates the goal of equalising real freedom by bringing all people up to a threshold of basic human capabilities. Sen's capability theory can clarify the proper moral goal of GLE insofar as this technology could be used to bring people up to certain basic human capabilities, thereby increasing their real freedom. And by increasing the freedom of those who lack basic human capabilities, GLE can aid in decreasing the inequalities of freedom among classes of people. (shrink)

The Internet allows for the efficient dissemination of texts, thereby creating a rich hypertextual environment that is potentially conducive to stimulating the free exchange of ideas in a manner worthy of the modern scholar. However, the fact that any user whatsoever may disseminate texts in this manner presents two distinct problems. First, finding relevant resources on the Internet may take a fair amount of time and, second, once resources are found, determining their reliability is often difficult if the user is (...) not already an expert in the field of the resource under consideration. These problems -- efficiency in searching and academic quality-control -- are surmountable with existing technology, and many laboratories around the world are working hard to shape this technology into a variety of academic information retrieval services. This article describes the development and teaching of a course on global engineering ethics in Shanghai Jiao Tong University, China. It outlines course objectives, methods, and contents, and instructor experience and plans for future development. This is done with the goal of helping educators to plan standalone courses and/or integrated modules on global engineering and technology ethics, which address challenges arising from the increasingly cross-cultural and international environments of contemporary technology and engineering practice. These efforts are motivated by the global (...) environments of engineering, as well as recent research in empirical moral psychology. The paper surveys the origins of chemical engineering in England in the late nineteenth and early twentieth centuries. It deals particularly with the recognition of the field as an independent discipline, its relations with chemistry and mechanical engineering, and the influence on its growth of industrial ‘demand’. The position of chemical engineering in public discourse, in the City and Guilds Central Institution, and at Imperial College of Science and Technology and University College London are discussed, together with the creation of (...) the Institution of Chemical Engineers in 1922. This is the first comprehensive translation of the expanded French version of E.F.F. Chladni's Traité d'Acoustique, using Chladni's 1802 Die Akustik for reference and clarification. Chladni's experiments and observations with sound and vibrations profoundly influenced the development of the field of Acoustics. The famous Chladni diagrams along with other observations are contained in Die Akustik, published in German in 1802 and Traité d'Acoustique, a greatly expanded version, published in French in 1809. The present translation was undertaken by Robert T. Beyer, (...) PhD (1920-2008), noted acoustician, Professor of Physics at Brown University, and Gold Medal recipient of the Acoustical Society of America. Along with many other projects completed over the course of his career, Dr. Beyer translated Von Neumann's seminal work, Mathematical Foundations of Quantum Mechanics from the original German, spent 30 years translating Russian physics treatises and journals, served as editor of the English translation of the Soviet Journal of Experimental and Theoretical Physics, and also authored Sounds of our Times: Two Hundred Years of Acoustics. Ethical dissonance arises from conflicts between beliefs or behaviors and affects ethical factors such as normality or conformity. This paper proposes a weak signal-oriented framework to investigate ethical dissonance from experiences linked to human–machine interactions. It is based on a systems engineering principle called human-systems inclusion, which considers any experience feedback of weak signals as beneficial to learn. The framework studies weak signal-based scenarios from testimonies of individual experiences and these scenarios are assessed by other people. For this purpose, the (...) framework proposes several databases as sources of weak signals, formalization tools of experience feedback of weak signals, models of references of conformity, ethical factors, and a list of examples of ethical dissonance. It also includes sequential steps to make the latter credible regarding the results from the experimental protocols. The framework was used to investigate ethical dissonance by analyzing experiences pertaining to achieving inclusive mobility. The first example focuses on ethical dissonance in terms of hindrance that goes against autonomous mobility due to a misunderstanding of how the system functions in terms of negative and positive emotions. Two other examples present possible ethical dissonance when the use of safety systems such as car driver-assistance systems, may create danger. Investigating ethical dissonance can then help system-inclusive design or evaluation processes by taking into account scenarios from weak signal-based experiences and making them credible. (shrink)

Liberal theory seeks to achieve toleration, civil peace, and mutual respect in pluralistic societies by making public policy without reference to arguments arising from within formative ideals about what gives value to human life. Does it make sense to set aside such conceptions of the good when it comes to controversies about stem cell research and the genetic engineering of people or animals? Whether it is reasonable to bracket our worldviews in such cases depends on how we answer the moral (...) questions that the use of these biotechnologies presuppose. I argue that the moral language of liberal justice – of rights and duties, interests and opportunities, freedom and consent, equality and fairness – cannot speak to these underlying concerns about what the human embryo is, why the natural lottery matters to us, and whether 'animal nature' is worth preserving. I conclude that liberal theory is incapable of furnishing a coherent or desirable account to govern the way we use our emerging powers of biotechnology. (shrink)

PurposeSelf-efficacy has been argued theoretically and shown empirically to be an essential construct for students’ improved learning outcomes. However, there is a dearth of studies on its causal effects on performance in mathematics among university students. Meanwhile, it will be erroneous to assume that results from other fields of studies generalize to mathematics learning due to the task-specificity of the construct. As such, attempts are made in the present study to provide evidence for a causal relationship between self-efficacy and performance (...) with a focus on engineering students following a mathematics course at a Norwegian university.MethodThe adopted research design in the present study is a survey type in which collected data from first-year university students are analyzed using structural equation modeling with weighted least square mean and variance adjusted estimator. Data were generated using mainly questionnaires, a test of prior mathematics knowledge, and the students’ final examination scores in the course. The causal effect of self-efficacy was discerned from disturbance effects on performance by using an innovative instrumental variable approach to structural equation modeling.ResultsThe findings confirmed a significant direct effect of the prior mathematics knowledge test on self-efficacy, a significant direct effect of self-efficacy on performance, and a substantial mediating effect of self-efficacy between a prior mathematics knowledge test and performance. Prior mathematics knowledge and self-efficacy explained 30% variance of the performance. These findings are interpreted to be substantial evidence for the causal effect of self-efficacy on students’ performance in an introductory mathematics course.ConclusionThe findings of the present study provide empirically supports for designing self-efficacy interventions as proxies to improve students’ performance in university mathematics. Further, the findings of the present study confirm some postulates of Bandura’s agentic social cognitive theory. (shrink)

We base that obligation on long standing engineering traditions that place the public good as a central tenant and on the professional relationship between a software developer and the users of the software developed.

Open peer commentary on the article “A Computational Constructivist Model as an Anticipatory Learning Mechanism for Coupled Agent–Environment Systems” by Filipo Studzinski Perotto. Upshot: Constructivist theory gives a nice high-level account of how knowledge can be autonomously developed by an agent interacting with an environment, but it fails to detail the mechanisms needed to bridge the gap between low levels of sensorimotor data and higher levels of cognition. AI workers are trying to bridge this gap, using task-specific engineering approaches, without (...) any principled theory to guide them; they could use help from psychologists. (shrink)

The recent progress in the development of autonomous cars has seen ethical questions come to the forefront. In particular, life and death decisions regarding the behavior of self-driving cars in trolley dilemma situations are attracting widespread interest in the recent debate. In this essay we want to ask whether we should implement a mandatory ethics setting for the whole of society or, whether every driver should have the choice to select his own personal ethics setting. While the consensus view seems (...) to be that people would not be willing to use an automated car that might sacrifice themselves in a dilemma situation, we will defend the somewhat contra-intuitive claim that this would be nevertheless in their best interest. Environmentalists have advocated the Precautionary Principle (PP) to help guide public and private decisions about the environment. By contrast, industry and its spokesmen have opposed this. There is not one principle, but many that have been recommended for this purpose. Despite the attractiveness of a core idea in all versions of the principle—that decision-makers should take some precautionary steps to ensure that threats of serious and irreversible damage to the environment and public health do not materialize into harm—even one of (...) the most widely endorsed principles needs considerable specification and refinement before it can be used. Moreover, the PP is an approach or guide to utilizing scientific evidence in social or legal decision-making contexts. In this it does not differ in kind from other approaches to using factual information such as in the law. The law provides some models for different strategies to guide decision-making under uncertainty when factual issues cannot be resolved with certainty. These in turn can help guide the formulation of different versions of PP and help clarify some presuppositions of the principle. Once some plausible versions of PP are articulated, I suggest some applications to existing environmental problems. (shrink)

Polls show that 45% of the American public believes that humans were created about 10,000 years ago and that evolution is a fictitious myth. Another 25% believes that changes in the natural world are directed by a supernatural being with a particular goal in mind. This thinking clashes head on with scientific findings from the past 150 years, and there is a dearth of public critical thinking about the natural world within a scientific framework. In 1738, Jacques Vaucanson unveiled his masterpiece before the court of Louis XV: a gilded copper duck that ate, drank, quacked, flapped its wings, splashed about, and, most astonishing of all, digested its food and excreted the remains. The imitation of life by technology fascinated Vaucanson's contemporaries. Today our technology is more powerful, but our fascination is tempered with apprehension. Artificial intelligence and genetic engineering, to name just two areas, raise profoundly disturbing ethical issues that undermine our most fundamental beliefs (...) about what it means to be human. In The Vital Machine, David Channell examines the history of our relationship with technology and argues that, while the resolution of these issues may not be imminent, a philosophical framework for dealing with them is already in place. One way of explaining Rudolf Carnap’s mature philosophical view is by drawing an analogy between his technical projects—like his work on inductive logic—with a certain kind of conceptual engineering. After all, there are many mathematical similarities between Carnap’s work in inductive logic and a number of results from contemporary confirmation theory, statistics and mathematical probability theory. However, in stressing these similarities, the conceptual dependence of Carnap’s inductive logic on his work on semantics is downplayed. Yet it is precisely the conceptual (...) resources made available to Carnap from his work on semantics which allows him to understand his work on inductive logic as a kind of conceptual engineering project. This project was undertaken to develop a telelearning knowledge base aimed at making specialized telelearning knowledge accessible to non-specialized practitioners in the field. The challenge stems from a rationale related to a user-centered approach for the software design process, which is focused on learning in the context of professional practice, the bridge to be built between expert and practitioner knowledge, as well as the knowledge valorization of the latter. In order to take into account users and their situated actions, a (...) usage study was integrated in the analysis phase. This study allows the creation of procedural and contextual telelearning models, and also lists of needs. These results serve as a basis for formulating guidelines for the development of ontologies, for the design of the telelearning knowledge base user interface and telelearning knowledge base environmental description. The state of computing science and, particularly, software engineering and knowledge engineering is generally considered immature. The best starting point for achieving a mature engineering discipline is a solid scientific theory, and the primary reason behind the immaturity in these fields is precisely that computing science still has no such agreed upon underlying theory. As theories in other fields of science do, this paper formally establishes the fundamental elements and postulates making up a first attempt at a theory in this (...) field, considering the features and peculiarities of computing science. The fundamental elements of this approach are informons and holons, and it is a general and comprehensive theory of software engineering and knowledge engineering that related disciplines (e.g., information systems) can particularise and/or extend to take benefit from it (Lakatos’ concepts of core theory and protective belt theories).
