Evolutionary theories of morality, beginning with Darwin, have focused on explanations for altruism. More generally, these accounts have concentrated on conscience to the neglect of condemnation. As a result, few theoretical tools are available for understanding the rapidly accumulating data surrounding third-party judgment and punishment. Here we consider the strategic interactions among actors, victims, and third-parties to help illuminate condemnation. We argue that basic differences between the adaptive problems faced by actors and third-parties indicate that actor conscience and third-party condemnation (...) are likely performed by different cognitive mechanisms. Further, we argue that current theories of conscience do not easily explain its experimentally demonstrated insensitivity to consequences. However, these results might be explicable if conscience functions, in part, as a defense system for avoiding third-party punishment. If conscience serves defensive functions, then its computational structure should be closely tailored to the details of condemnation mechanisms. This possibility underscores the need for a better understanding of condemnation, which is important not only in itself but also for explaining the nature of conscience. We outline three evolutionary mysteries of condemnation that require further attention: third-party judgment, moralistic punishment, and moral impartiality. (shrink)

People sometimes disagree about who owns which objects, and these ownership dilemmas can lead to costly disputes. We investigate the cognitive mechanisms underlying people's judgments about finder versus landowner cases, in which a person finds an object on someone else's land. We test psychological hypotheses motivated directly by three major principles that govern these cases in the law. The results show that people are more likely to favor the finder when the object is in a public space compared to a (...) private space. We find mixed support for the hypothesis that people are less likely to favor a finder who is employed by the landowner. Last, we find no support for the hypothesis that people are more likely to favor finders for objects located above ground compared to below ground. We discuss implications for psychological theories of ownership and potential applications to property law. (shrink)

The target article by Baumard et al. uses their previous model of bargaining with outside options to explain fairness and other features of human sociality. This theory implies that fairness judgments are determined by supply and demand but humans often perceive prices (divisions of surplus) in competitive markets to be unfair.

The target article claims that we should speak in code to understand property, because natural language is too ambiguous. Yet the best computer programmers tell us the opposite: Arbitrary code is too ambiguous, so we should use natural language for variables, functions, and classes. I discuss how meaningless code makes Boyer's theory too enigmatic to properly debate.

The theory proposed by Fitouchi et al. misses the core of puritanical morality: Cruel punishment for harmless actions. Punishment is mutually harmful, unlike cooperation which is mutually beneficial. Theories of moral judgment should not obscure this fundamental distinction.

As I write this, in November 1971, people are dying in East Bengal from lack of food, shelter, and medical caxc. The suffering and death that are occurring there now axe not inevitable, 1101; unavoidable in any fatalistic sense of the term. Generally speaking, people have not given large sums to relief funds; they have not written t0 their parliamentaxy representatives demanding increased government assistance; they have not demonstrated in the streets, held symbolic fasts, or done anything else directed toward providing thc refugees with the means to satisfy their essential needs. At thc government level, no govcrmmcnt has given the sort of massive aid that would enable the refugees to survive fm: more than a few days. Britain, for instance, has given rather more than most countries. It has, to date, given £14,750,000. For comparative purposes, B1~itain’s share of thc nonreccverabla development costs of the Anglo-French Concorde project is already in excess of £275,000,000, and on present estimates will reach £440,000,¤00. Truthmaker theorists hold that propositions about higher-level entities (e.g. the proposition that there is a heap of sand) are often made true by lower-level entities (e.g. by facts about the configuration of fundamental particles). This generates a problem: what should we say about these higher-level entities? On the one hand, they must exist (since there are true propositions about them), on the other hand, it seems that they are completely superfluous and should be banished for reasons of ontological parsimony. Some (...) truthmaker theorists—most prominently David Armstrong—have tried to solve this puzzle by arguing that these entities are ‘an ontological free lunch’, i.e. real existents that are still ‘no addition of being’. This answer is prima facie attractive, but I argue in this paper that the standard approaches to truthmaking—modal theories and grounding theories—are unable to vindicate the doctrine of the ontological free lunch, and thus fail to solve the problem of higher-level entities. Fortunately, there is a non-standard account of truthmaking available, the reductive explanation account, which succeeds where the standard approaches fail. (shrink)

We are each left-libertarians, and we would like to take this opportunity to address some of the general issues that she raises. We shall focus, as Fried does much of the time, on the question of whether left-libertarianism is a well-defined and distinct alternative to existing forms of liberal egalitarianism. (...) My current opinion is that the selective realist is in a strong position vis-à-vis the historical challenges. Certainly the realist needs to invoke some careful criteria for realist commitment, and various nuances concerning the nature of her epistemic commitment, and this may raise the ‘death by a thousand qualifications’ question mark. But the concern is unfounded: the qualifications are all independently motivated, and indeed necessary given the philosophical complexity. Contrary to this view, it is argued in the article that beyond these standardized models of “invited” participation, there exist various forms of “uninvited” and independent civil society engagement, which frequently not only have more significant impact but are profoundly democratically legitimate as well. Using the two (...) examples of patient associations and environmental and consumer organizations in the field of nanotechnology, it is illustrated that interest-based civil society interventions do play an important role in the polycentric governance of science and technology. One can rightly say of Peter Sloterdijk that each of his essays and lectures is also an unwritten book. That is why the texts presented here, which sketch a philosophical physiognomy of Martin Heidegger, should also be characterized as a collected renunciation of exhaustiveness. In order to situate Heidegger's thought in the history of ideas and problems, Peter Sloterdijk approaches Heidegger's work with questions such as: If Western philosophy emerged from the spirit of the polis, what are we (...) to make of the philosophical suitability of a man who never made a secret of his stubborn attachment to rural life? Is there a provincial truth of which the cosmopolitan city knows nothing? Is there a truth in country roads and cabins that would be able to undermine the universities with their standardized languages and globally influential discourses? From where does this odd professor speak, when from his professorial chair in Freiburg he claims to inquire into what lies beyond the history of Western metaphysics? Sloterdijk also considers several other crucial twentieth-century thinkers who provide some needed contrast for the philosophical physiognomy of Martin Heidegger. A consideration of Niklas Luhmann as a kind of contemporary version of the Devil's Advocate, a provocative critical interpretation of Theodor Adorno's philosophy that focuses on its theological underpinnings and which also includes reflections on the philosophical significance of hyperbole, and a short sketch of the pessimistic thought of Emil Cioran all round out and deepen Sloterdijk's attempts to think with, against, and beyond Heidegger. Justifying, in contrast to giving a reason, requires a special normative context: justifying an action means to defend the action against the charge of norm violation. It is not only possible to justify an action but also to justify a norm. A norm constrains the freedom of the addressees, therefore it could be oppressive and that is the reason why it needs a justification – a justification which ensures (...) that the norm which forbids oppression is not circumvented. "Divination and Human Nature" casts a new perspective on the rich tradition of ancient divination--the reading of divine signs in oracles, omens, and dreams. Popular attitudes during classical antiquity saw these readings as signs from the gods while modern scholars have treated such beliefs as primitive superstitions. In this book, Peter Struck reveals instead that such phenomena provoked an entirely different accounting from the ancient philosophers. These philosophers produced subtle studies into what was an odd but observable fact--that humans (...) could sometimes have uncanny insights--and their work signifies an early chapter in the cognitive history of intuition. Examining the writings of Plato, Aristotle, the Stoics, and the Neoplatonists, Struck demonstrates that they all observed how, setting aside the charlatans and swindlers, some people had premonitions defying the typical bounds of rationality. Given the wide differences among these ancient thinkers, Struck notes that they converged on seeing this surplus insight as an artifact of human nature, projections produced under specific conditions by our physiology. For the philosophers, such unexplained insights invited a speculative search for an alternative and more naturalistic system of cognition. Recovering a lost piece of an ancient tradition, "Divination and Human Nature" illustrates how philosophers of the classical era interpreted the phenomena of divination as a practice closer to intuition and instinct than magic.
