Each year since 1983 the American Council of Learned Societies has invited one of America's leading scholars to deliver the Haskins Lecture, in honor of Charles Homer Haskins, a distinguished scholar and teacher who was instrumental in the founding of the ACLS. In this volume, which commemorates the 75th anniversary of the ACLS, Douglas Greenberg and Stanley Katz bring together the lectures presented by ten of America's most distinguished scholars. Each lecture is a personal and intellectual glimpse into (...) the "life of learning" of such leading scholars as Maynard Mack, Annemarie Schimmel, and John Hope Franklin. The lectures focus on self-reflection of lives dedicated to learning, rather than on scholarship in the usual sense of the term. Ranging from being forced to learn Latin to painful memories of war and racism, the lecturers all recount stories from their eventful lives. Each offers thoughts on the body of work he or she has produced and the forces, personal and intellectual, that have shaped it. This essay asks the question “What would it mean to be a just university?” and answers to that the question may be understood in two ways. One way to understand “just” is procedural, having to do with internal governance and ensuring that a university’s policies are themselves just. The other is substantive, having to do with the university’s purpose or reason for existing. The second assumes the university is to serve some function necessary for the general good. This good is (...) often defined in material terms: fostering a stronger economy, medical breakthroughs, more efficient use of natural resources, and so on. But such a view of the university defines its value entirely by factors external to itself. Proponents of one definition of the university’s purpose typically acknowledge some validity in the other, and universities commonly strive to fulfill the claims of both definitions. But universities also have an obligation to teach the young and to do so within the context of a common set of values that both determines the setting in which teaching takes place and encourages students to develop values that will shape their own lives. Katz argues in particular that intellectuals have a special obligation to work cooperatively to eliminate intellectual obstacles that stand in the way of commensuration, communication, and comprehension globally. It is this responsibility that he calls “intellectual philanthropy.”. (shrink)

At the founding editor’s invitation in 1991–92, the members of the editorial board and the department editors of Common Knowledge wrote individual and small-group calls for papers to be published in the inaugural issue of Spring 1992 and the succeeding issue, Fall 1992. This call for papers was published among the second group.

This article consists of two important parts. The first is a specific defense of some of the central claims made by stanley cavell in "must we mean what we say" against the criticisms of fodor and katz in "the availability of what we say." the major issue concerns the question of whether evidence of some sort is needed to support a claim by a native speaker about what we mean when we say something. The paper develops a conception of marital love as a complex recognitive relation, which I articulate by juxtaposing it against other recognitive relations that figure in Hegel's theory of modern civil society (i.e., respect and esteem). Drawing on Hegel's early writings, I argue that, if love is to provide its unique sort of recognition, it must obtain between “living beings who are equal in power”—a peculiar form of equality that I name (drawing on Stanley Cavell's work) “dynamic equality.” I (...) conclude that it is by Hegel's own lights that we should reject his notorious conception of the sexual difference. However, I also offer reasons why, from Hegel's early 19th century perspective, he could consider the following two conditions as compatible: (1) equality within marriage and (2) sexual hierarchy outside marriage, namely, in civil society. This article analyzes the question of how the size of bribes should impact criminal sanctions. In contrast to the commonly held view that punishment should increase with the size of the bribe, we argue to the contrary: that the punishment of the bribee should decrease with the size of the bribe. Our conclusion is based both on a philosophical argument and an economic argument. We argue that all else being equal, as an agent’s reservation price for selling public interests decreases, (...) the culpability of the agent willing to receive a bribe increases. In addition, from an economic perspective, the expected social harm of an official acting with a low reservation price for bribes is much greater than one acting with a high reservation price: both the susceptibility of being bribed as well as the potential for social harm is much greater when the reservation price is low. Based on the author's ethnographic research in India, the book explores the psychology of Hinduism, and offers an innovative synthesis of psychoanylsis with modern anthropological theories of cultural difference. Stanley N. Kurtz offers a new interpretation of the multiple "mother goddesses" of Hinduism, and explores how this multiplicity is key to understanding early childhood experience in which a child is raised by many "mothers" in the Hindu joint family. Arguing that traditional psychoanalytic approaches to Indian culture have applied Western (...) models without regard to differing cultural circumstances, Kurtz suggests that immersion in a joint family plays a central role in the development of feelings and needs which are carried over into adult life. The book concludes with a briefr comparison of mothering in India and contemporary America. _All the Mothers Are One_ makes a significant contribution to the growing debate concerning the role of psychoanalysis in the interpretation of culture and the study of cross-cultural human development. This article focuses on Barth's explication of Anselm's Proslogion 2-4 in his book on Anselm and attempts to show how Anselm helped clarify for Barth the ontological nature of his own early theology, in particular what he meant by the “is” in his affirmation “God is God.” My contention is that Barth's continual pointing to Anselm's Fides Quaerens Intellectum as a vital key to his own theology should not be overlooked. In fact, I argue that only by returning Barth to (...) Anselm in this way is it possible to understand more thoroughly Barth's relevance to contemporary onto-theological debates. (shrink)

In this chapter, Dahan Katz defends relational conceptions of retribution and desert. She clarifies the ways in which such relational conceptions avoid major worries associated with retributive theory, while addressing further worries that arise distinctively with respect to such an approach. In doing so, Dahan Katz provides further defense of the response-retributive theory of punishment that she has proposed elsewhere, while defending a wider set of views within the retributive tradition.

Stanley Rosen's book is the first full-length study of the Sophist in English and one of the most complete in any language. He follows the stages of the dialogue in sequence and offers an exhaustive analysis of the philosophical questions that come to light as Theaetetus and the Eleatic Stranger pursue the sophist through philosophical debate. This paper offers a response retributive theory of punishment, taking the role of the punisher as well as the relations between the parties to punishment to be central to retributive justification. It proposes that punishment is justified in terms of the ethics of appropriate response, and more precisely, in terms of the duty agents have to dissociate from the devaluation inherent in the culpable wrongdoing of others. The paper demonstrates that on such account, while the harm and suffering involved in (...) punishment are rightly imposed, they are not good, grounding a further duty to mitigate our retributive practices. The result is a moderate vision of retributive justification, which has the resources to justify, not only criminal punishment, but punishment as imposed across a wide variety of relations: private, institutional and political. We develop an evidence-based theoretical account of how widely shared cultural beliefs about gender, race, and class intersect in interpersonal and other social relational contexts in the United States to create characteristic cultural “binds” and freedoms for actors in those contexts. We treat gender, race, and class as systems of inequality that are culturally constructed as distinct but implicitly overlap through their defining beliefs, which reflect the perspectives of dominant groups in society. We cite evidence for the contextually contingent interactional (...) “binds” and freedoms this creates for people such as Asian men, Black women, and poor whites who are not prototypical of images embedded in cultural gender, race, and class beliefs. All forms of unprototypicality create “binds,” but freedoms result from being unprototypical of disadvantaging rather than advantaging statuses. (shrink)

In this paper, I address the theory of excuse, or more precisely, exculpatory excuse, and the question of what it is that justifies the category of excuse. I address different potential grounds for the law of excuse, which are often run together in ways that confound rather than clarify, focusing on the role of blamelessness and unfairness of expectations in the theory of excuse.

The first part of my hypothesis, then, is simple enough, and would be accepted in principle by most students of Plato: the dramatic structure of the dialogues is an essential part of their philosophical meaning. With respect to the poetic and mathematical aspects of philosophy, we may distinguish three general kinds of dialogue. For example, consider the Sophist and Statesman, where Socrates is virtually silent: the principal interlocutors are mathematicians and an Eleatic Stranger, a student of Parmenides, although one who (...) is not always loyal to his master's teaching of what might be called monadic homogeneity. In these dialogues, the mathematical character of philosophy is not merely emphasized but exaggerated, and any attempt to interpret them must take this fact into account. Otherwise, we shall not be able to understand why the Stranger seems to classify the general's art in the same species of the genus hunting as the louse catcher. The significance of this step, which does not stem from humanitarian considerations, but rather illustrates how the human becomes invisible from the mathematical viewpoint, contributes its share to the obscurity of these two dialogues. Second, there are dialogues like the Phaedrus and Symposium, in which the style, the interlocutors, and even the subject-matter seem to be largely poetic and rhetorical. Here, the overwhelming impression is of enthusiasm, divine madness, and intoxication in speech and deed. Finally, there are dialogues like the Philebus and Republic, in which it is not so easy to say whether poetry or mathematics predominates, if indeed either may be said to do so. (shrink)
