It is still underestimated to what extent in his main works Hugo Grotius not only sketched and developed a system of private, state and international law; but also outlined a general philosophy or theory of law. By asking questions concerning the law of property, the law of prize and booty, the law of peace and war or the legal status of sovereignty he did not only refer to the 'right side', i.e. to actions that can be labelled as rightful and (...) legal. He also dealt with many aspects of what is not right and unlawful, not limiting himself to just give mere examples of crossing the border to the 'non right side'. It was a part of Grotius's methodological approach to systematically reflect on the law from the perspective of its violations. One example of such a violation is the act of piracy and the figure of the pirate. To outline this is the aim of the following article. By showing that the pirate and his 'legal twin', the privateer, were belong together as two sides of the same coin, they come to symbolise in an exemplary way the differentiation between 'right' and 'non right' as the unity of law in the legal philosophy of Grotius. Hegel famously accuses Christianity of ‘unhappy consciousness’: it has a normative goal – union with the divine – that it cannot, in principle, satisfy. Kierkegaard was intimately aware of this criticism and, unlike some of Hegel’s other accusations, takes it seriously. In this paper my co-author and I investigate the way in which Kierkegaard addresses this issue in two texts published in 1843: Fear and Trembling and ‘The Expectancy of Faith’. We are especially interested in how the two texts describe (...) faith’s relationship to finitude: for instance, whether the person of faith is permitted to expect that God will bless her in particular and concrete ways. My co-author and I offer competing interpretations. I argue that there is a deep tension in the way faith is described in the two texts; my co-author argues that there is consonance. (shrink)

ISBN-13: 9781438428246. This review analyzes the extent to which The Obsessions of Georges Bataille: Community and Communication, edited by Andrew J. Mitchell and Jason Kemp Winfree, may contribute to recent treatments of sensibility and affect in critical thought. After first posing the question of why community appeared to recede from the critical attention (...) it received in the 1990s, my discussion then assesses the ways the volume’s essays argue collectively for a renewed engagement with community via the work of Bataille. I attempt to show how Mitchell’s and Winfree’s volume provides an important provocation to recover the exigency of community at a time when popular appeals to community remain no less spectacular, inflated, and cynical than they were at the height of its engagement by critical thought. The essay concludes with a suggestion of how Bataille’s work can intervene in what Fredric Jameson has called the post-09/11 manufacturing of affect. (shrink)

Green Ethical decisions made inside the Beltway sometimes have global consequences. Nowhere is this more true than with respect to the decision by Secretary of State Colin Powell on 21 July 2002 to halt $34 million in U.S. funding for the United Nations Population Fund (UNFPA). Behind this decision (...) lay the forces of America's abortion politics as well as tangled issues in law and bioethics.I became involved in this debate when, in early September 2003, I served as a member of a nine-person delegation of U.S. religious leaders and ethicists that traveled to China to meet with those associated with the UNFPA program there. The delegation was assembled by Frances Kissling, of Catholics for a Free Choice, which also provided support and funding for the necessary travel and administrative services. In China, our contacts included UNFPA administrators, Chinese government officials, and ordinary villagers touched by UNFPA efforts. In the middle of its week-long stay, the delegation left Beijing in three separate groups to travel to remote provincial regions (Hubei, Gansu, and Ningxia). Our goal was to respond to the Bush administration's defunding decision by deepening our understanding of the current Chinese population program and UNFPA's relationship to it. In the course of this enquiry, I encountered challenging questions that drew on my own training in ethics in novel ways. Historical Background UNFPA is the world's largest organization providing family planning and reproductive health services. It was established in 1969 as the United Nations Fund for Population Activities. In 1987, the Economic and Social Council decided to rename it the United Nations Population Fund, but to retain the original abbreviation-acronym. UNFPA works to improve access to and the quality of family planning services in more than 140 of the poorest countries in the world. It is also very active in providing services aimed at preventing the spread of HIV/AIDS. It does not provide abortion services, but works to prevent abortion through family planning and to help countries provide services for women suffering from the complications of unsafe abortion. [End Page 393]Although UNFPA is officially an agency of the United Nations, its budget, currently about $200 million per year, comes from voluntary payments by donors, including UN member states. U.S. funding has been irregular. In 1985, the U.S. House of Representatives passed a foreign operations appropriations measure that has come to be known as the "Kemp-Kasten Amendment." This measure, which has been repassed in substantially unchanged form every year since, forbids funding for "any organization or program which, as determined by the President of the United States, supports or participates in the management of a program of coercive abortion or involuntary sterilization."1 From 1986 on, the Reagan and Bush administrations halted all U.S. funding for UNFPA activities around the world on the grounds that the agency's activities in China caused it to be involved in supporting or participating in the management of a program of coercive abortion or involuntary sterilization, and, hence, put it in violation of Kemp-Kasten.Efforts by the People's Republic of China to slow the increase of its population date from the early 1970s when, in a striking departure from classical Marxist theory, which had insisted on the positive value of added labor power and denied the need for demographic controls, the government imposed a policy of delayed marriage and birth spacing. In 1979, these efforts intensified with the advent of the "one child policy." This article critically appraises David Bloor’s recent attempts to refute criticisms levelled at the Strong Programme’s social constructionist approach to scientific knowledge. Bloor has tried to argue, contrary to some critics, that the Strong Programme is not idealist in character, and it does not involve a challenge to the credibility of scientific knowledge. I argue that Bloor’s attempt to deflect the charge of idealism, which calls on the self-referential theory of social institutions, is partially successful. However, I suggest that although (...) the Strong Programme should not be accused of ‘strong idealism’, it is still vulnerable to the criticism that it entails a form of ‘weak idealism’. The article moves on to argue that, contrary to Bloor, constructionist approaches do challenge the credibility of the scientific knowledge that they analyse. In this paper I outline the PAIR account of joint attention as a perceptual-practical, affectively charged intentional relation. I argue that to explain joint attention we need to leave the received understanding of propositions and propositional attitudes and the picture of content connected to it behind and embrace the notions of subject mode and position mode content. I also explore the relation between joint attention and communication.

I dispute the claim that it is attention to only limited parts of the Strong Programme framework that allows me to argue that this approach: leads to weak idealism, undermines the idea that theories have varying levels of instrumental success, and challenges the theoretical claims of scientific actors. Systems for color naming across languages have been a fascinating topic for decades. Zaslavsky and colleagues challenge Gibson's argument that color names are shaped by patterns of communicative need. Using an information‐theoretic analysis, they show that color naming is shaped by both perceptual structure (as is usually argued) but also by communication need.

Hume uses the term 'idea' to refer to both mental acts and mental contents.

Theories of discourse bring to realism new ideas about how knowledge develops and how representations of reality are influenced. We gain an understanding of the conceptual aspect of social life and the processes by which meaning is produced. This collection reflects the growing interest realist critics have shown towards forms of discourse theory and deconstruction. The diverse range of contributions address such issues as the work of Derrida and deconstruction, discourse theory, Eurocentrism and poststructuralism. What unites all of the contributions (...) is a sense that it is essential to provide a realist alternative to the hitherto dominance of social constructionism, hermeneutics and postmodernism, over many of the issues discussed. By developing a realist perspective the different authors attempt to embed discourse within the structured nature of the reality of the world. Realism can situate language, discourse and ideology within context specific, or 'causally efficacious' circumstances. Realism can help to uncover issues of power, representation, and subjectivity and how discursive and other social practices produce real effects. This can help us understand the manner in which social structures are reproduced through various forms of ideology and discourse. And by knowing this, we can start to address questions concerning human emancipation and how the world is to be transformed. (shrink)

The guiding inspiration of this book is the attraction and distance that mark the relation between anthropology and philosophy. This theme is explored through encounters between individual anthropologists and particular regions of philosophy.
