We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

Paperback. The book treats two general questions: 1. Whether Erasmanism and Erasmian Humanism existed as a recognizable attitude during the sixteenth and early seventeenth centuries; 2. Whether Erasminism represented a definable middle way between the confessional conflicts of these times. How important was Erasmanism in these respects? The treatment of these two questions is geographically limited to those countries where Erasmus himself was active: Italy, The Netherlands, Holy Roman Empire, Switzerland and England.Erasmanism as a concept has hardly been studied before, (...) although the term is used freely by scholars of the early modern period. Das Embryonenschutzgesetz von 1990 erfasst die neuesten technischen Entwicklungen nicht, ist in manchen Bereichen unstimmig und lückenhaft, setzt die betroffenen Frauen, Paare und Kinder unnötigen gesundheitlichen Risiken aus, erschwert paradoxerweise die Durchsetzung von Kinderrechten und erzeugt Gerechtigkeitsprobleme und Rechtsunsicherheit für die betroffenen Paare und die behandelnden Ärztinnen und Ärzte.Das Embryonenschutzgesetz enthält zudem nur strafrechtliche Verbote. Diese erlauben keine angemessene Reaktion auf die medizinische Entwicklung und den gesellschaftlichen Wandel und werden der Komplexität der (...) Materie nicht gerecht.Diese Probleme müssen gelöst werden. Der Bundesgesetzgeber verfügt seit mehr als 20 Jahren über die Kompetenz zur Regelung der Fortpflanzungsmedizin. In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this book we argue that chimpanzees are persons because they are autonomous. (shrink)

We reject arbitrary distinctions that deny adequate protections to other animals who share with protected humans relevantly similar vulnerabilities to harms and relevantly similar interests in avoiding such harms. We strongly urge this Court, in keeping with the best philosophical standards of rational judgment and ethical standards of justice, to recognize that, as a nonhuman person, Happy should be (...) released from her current confinement and transferred to an appropriate elephant sanctuary, pursuant to habeas corpus. In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

An editorial / opinion piece on abortion: -/- "I’m a philosophy professor who specializes in medical ethics and I teach and write about the ethics of abortion. So I am very familiar with the medical, legal and – most importantly – ethical or moral issues related to HB 481, the so-called “heartbeat bill” that would effectively ban abortion in Georgia. At least hundreds of other philosophy, ethics and law professors in Georgia teach these ethical debates about abortion: they are also, (...) to varying degrees, experts on the issues. -/- What is taught is the arguments about the ethics of abortion, that is, the reasons to think that abortion is wrong and the reasons to think that it’s not wrong. Evaluating these arguments requires understanding and skill. Much of these skills amount to consistently asking ‘What do you mean?’ and ‘Why think that?’ We need better arguments on these issues, and asking and answering these questions helps with that. . .". The book opens with an article on the chronology and life of St. Thomas, which was written originally in 1920 by the well-known Thomistic scholar, Pierre Mandonnet, for the Revue des sciences philosophiques et théologiques. In a critical study, written in 1932 and reproduced here in its German version, Palémon Glorieux challenges Mandonnet's conclusions with regard to Thomas's Quaestiones disputatae, while in another essay, also appearing in this volume, he advances hypotheses and clarifies certain points about Aquinas's treatise, De regimine (...) Judaeorum. Many penetrating insights into Thomas's life and personality are furnished by Martin Grabmann in his essay on Aquinas's relationship to the civil and religious authorities of his time, while Heribert Scheeben discusses Thomas's sojourn in Cologne and his personal rapport with his master, Albert the Great. Aquinas's helpers and secretaries are also the subject of a special study by Antoine Dondaine. (shrink)

In 50 B.C. Cicero writes to Atticus as follows : ‘Brundisium uenimus VII Kalend. Decembr. usi tua felicitate nauigandi; ita belle nobis flauit ab Epiro lenissimus Onchesmites. hunc si cui boles pro tuo uendito.’ The antonomasia, the euphonic sibilance, and the mannered rhythm are all prominent in Cicero's hexameter. The line is a humorously concocted example of affected and Grecizing narrative. But it is also a line which, Atticus is to suppose, would value; presumably therefore it is meant to (...) hit off characteristics of their style. Cicero must in fact be parodying what he regards as a typical ‘neoteric’ line, and the significance of this simple fact has perhaps been underestimated. (shrink)

This study described the relationships between academic class and student moral sensitivity and reasoning and between curriculum design components for ethics education and student moral sensitivity and reasoning. The data were collected from freshman (n = 506) and senior students (n = 440) in eight baccalaureate nursing programs in South Korea by survey; the survey consisted of the Korean Moral Sensitivity Questionnaire and the Korean Defining Issues Test. The results showed that moral sensitivity scores in patient-oriented care and conflict were (...) higher in senior students than in freshman students. Furthermore, more hours of ethics content were associated with higher principled thinking scores of senior students. Nursing education in South Korea may have an impact on developing student moral sensitivity. Planned ethics content in nursing curricula is necessary to improve moral sensitivity and moral reasoning of students. (shrink)

From the Preface -/- To many people, abortion is an issue for which discussions and debates are frustrating and fruitless: it seems like no progress will ever be made towards any understanding, much less resolution or even compromise. -/- Judgments like these, however, are premature because some basic techniques from critical thinking, such as carefully defining words and testing definitions, stating the full structure of arguments so each step of the reasoning can be examined, and comparing the strengths and weaknesses of different explanations can help us make progress towards these goals. -/- When emotions run high, we sometimes need to step back and use a passion for calm, cool, critical thinking. This helps us better understand the positions and arguments of people who see things differently from us, as well as our own positions and arguments. And we can use critical thinking skills help to try to figure out which positions are best, in terms of being supported by good arguments: after all, we might have much to learn from other people, sometimes that our own views should change, for the better. -/- Here we use basic critical thinking skills to argue that abortion is typically not morally wrong. We begin with less morally-controversial claims: adults, children and babies are wrong to kill and wrong to kill, fundamentally, because they, we, are conscious, aware and have feelings. We argue that since early fetuses entirely lack these characteristics, they are not inherently wrong to kill and so most abortions are not morally wrong, since most abortions are done early in pregnancy, before consciousness and feeling develop in the fetus. -/- Furthermore, since the right to life is not the right to someone else’s body, fetuses might not have the right to the pregnant woman’s body—which she has the right to—and so she has the right to not allow the fetus use of her body. This further justifies abortion, at least, until technology allows for the removal of fetuses to other wombs. Since morally permissible actions should be legal, abortions should be legal: it is an injustice to criminalizing actions that are not wrong. -/- In the course of arguing for these claims, we: 1. discuss how to best define abortion; 2. dismiss many common “question-begging” arguments that merely assume their conclusions, instead of giving genuine reasons for them; 3. refute some often-heard “everyday arguments” about abortion, on all sides; explain why the most influential philosophical arguments against abortion are unsuccessful; 4. provide some positive arguments that at least early abortions are not wrong; 5. briefly discuss the ethics and legality of later abortions, and more. -/- This essay is not a “how to win an argument” piece or a tract or any kind of apologetics. We sometimes seek expert guidance when we don’t know what to think or do about a problem. In challenging cases concerning medical ethics, we may seek a clinical ethics consultation for guidance. The assumption is that the bioethicist, as an expert on ethical issues, has knowledge and skills that can help us better think about the problem and improve our understanding of what to do regarding the issue.The widespread practice of ethics consultations raises these questions and more:What would it take (...) to be a moral expert?Is anyone a moral expert, and if so, how could a non-expert identify one?Is it in any way problematic to accept and follow the advice of a moral expert as opposed to coming to moral conclusions on your own?What should we think and do when moral experts disagree about a practical ethical issue?In what follows, we address these theoretical and practical questions about moral expertise. Most abortions occur early in pregnancy. I argue that these abortions, and so most abortions, are not morally wrong and that the best arguments given to think that these abortions are wrong are weak. I also argue that these abortions, and probably all abortions, should be legal. -/- I begin by observing that people sometimes respond to the issue by describing the circumstances of abortion, not offering reasons for their views about those circumstances; I then dismiss “question-begging” arguments about abortion (...) that merely assume the conclusions they are given to support; most importantly, I evaluate many arguments: both common, often-heard arguments and arguments developed by philosophers. -/- My defense of abortion is based on facts about early fetuses’ not yet possessing consciousness or any mental life, awareness or feeling, as well as concerns about rights to one’s own body. By the standard of popular approval, the South African state has no legitimacy, since only whites are enfranchised and blacks are being denationalized. This institutionalized politicization of ethnicity increasingly erodes the efficiency of private and state institutions alike. Enforced ethnic identities without representative leadership undermine proposed liberal arrangements of negotiated power-sharing as well as the government policy of cooptation. In the absence of political democracy, politicized labor relations substitute for restricted mobilization elsewhere. There are three basic responses to this legitimation (...) crisis of the South African state: 1) the radical left response of revolutionary reversal of power 2) the reformist business response of co-optation and 3) the technocratic government response of further political separation with increased economic collaboration. Modal dependence logic was introduced recently by Väänänen. It enhances the basic modal language by an operator = (). For propositional variables p 1, . . . , p n , = (p 1, . . . , p n-1, p n ) intuitively states that the value of p n is determined by those of p 1, . . . , p n-1. Sevenster (J. Logic and Computation, 2009) showed that satisfiability for modal dependence logic is complete for nondeterministic (...) exponential time.In this paper we consider fragments of modal dependence logic obtained by restricting the set of allowed propositional connectives. We show that satisfiability for poor man’s dependence logic, the language consisting of formulas built from literals and dependence atoms using ${\wedge, \square, \lozenge}$ (i. e., disallowing disjunction), remains NEXPTIME-complete. If we only allow monotone formulas (without negation, but with disjunction), the complexity drops to PSPACE-completeness.We also extend Väänänen’s language by allowing classical disjunction besides dependence disjunction and show that the satisfiability problem remains NEXPTIME-complete. If we then disallow both negation and dependence disjunction, satisfiability is complete for the second level of the polynomial hierarchy. Additionally we consider the restriction of modal dependence logic where the length of each single dependence atom is bounded by a number that is fixed for the whole logic. We show that the satisfiability problem for this bounded arity dependence logic is PSPACE-complete and that the complexity drops to the third level of the polynomial hierarchy if we then disallow disjunction.In this way we completely classify the computational complexity of the satisfiability problem for all restrictions of propositional and dependence operators considered by Väänänen and Sevenster. We offer a relatively simple and straightforward argument that each of us ought to be vegan. We don’t defend this position by appealing to ‘animal rights’ or the view that animals and humans are ‘moral equals’. Rather, we argue that animal agriculture causes serious harms to other animals (such as pain, suffering and death) and these harms are morally unjustified or caused for no good reason. This is true for both ‘factory farming’ and smaller, so-called ‘humane’ farms. We argue that (...) attempts to justify these harms don’t succeed, and conclude that raising and killing animals for food is wrong. -/- In the second part of our essay we explain how this argument relates to the choices of individuals to buy and consume animal products. Since most people don’t raise and kill animals themselves, the argument above doesn’t directly address individuals’ daily choices. To address this concern, we offer a plausible, general moral principle that describes when consumers should not purchase or consume a product: most simply, we should not support those who act wrongly by seriously harming others, provided we can safely and easily do so. Since, for most people, it is safe and relatively easy to not support those who do wrong by raising and killing animals so they can be eaten, we should not buy or consume animal food products. -/- After making our case that we ought to be vegan, we respond to some of the more challenging objections to our argument. We argue that these objections don’t succeed and so, given our previous argument, nearly everyone is morally obligated to eat a vegan diet. (shrink)
