In this paper, I embark upon a hermeneutic phenomenological analysis of the emotion of grief, based upon three experiences of grief I witnessed over the preceding year. I find that grief is best construed not as an emotion akin to sadness or anger, but as an affective-behavioural complex resulting from a discord between the world that we affectively inhabit and the world in which we currently find ourselves. I therefore conceive the process of getting over grief, or grieving, as an (...) active process of readjusting our affective and behavioural habits on both a thematic and a pre-thematic level. Recently much attention has been paid to the concept of expression in Merleau-Ponty’s philosophy and its role in his theories of language, art, history, and truth. However, most authors have considered expression only as a mode of language. This paper attempts to show that a full understanding of Merleau-Ponty’s concept of expression, and in particular the problem of how new meanings can be created out of existing language, is possible only by considering the role of emotional gesture in expression. Many poor and oppressed people wish to leave their countries of origin in the third world to come to affluent Western societies. This essay argues that there is little justification for keeping them out. The essay draws on three contemporary approaches to political theory - the Rawlsian,the Nozickean, and the utilitarian - to construct arguments for open borders. The fact that all three theories converge upon the same results on this issue, despite their significant disagreements on others, strengthens the (...) case for open borders and reveals its roots in our deep commitment to respect all human beings as free and equal moral persons. It is a commonsense thesis that unactualized possibilities are not parts of actuality. To keep his modal realism in line with this thesis, David Lewis employed his indexical account of the term “actual.” I argue that the addition of counterpart theory to Lewis’s modal realism undermines his strategy for respecting the commonsense thesis. The case made here also reveals a problem for Lewis’s attempt to avoid haecceitism.

The thesis of the present volume is critical and dual. (1) Present day philosophy of man and sciences of man suffer from the Greek mis taken polarization of everything human into nature and convention which is (allegedly) good and evil, which is (allegedly) truth and fal sity, which is (allegedly) rationality and irrationality, to wit, the polar ization of all fields of inquiry, the natural and social sciences, as well as ethics and all technology, whether natural or social, into the (...) totally positive and the totally negative. (2) Almost all philosophy and sci ences of man share the erroneous work ethic which is the myth of man's evil nature - the myth of the beast in man, the doctrine of original sin. To mediate or to compromise between the first view of human nature as good with the second view of it as evil, sociologists have devised a modified utilitarianism with deferred gratification so called, and the theory of the evil of artificial competition (capitalist and socialist alike) and of keeping up with the Joneses. Now, the mediation is not necessary. For, the polarization makes for abstract errors which are simplistic views of rationality, such as reductionism and positivism of all sorts, as well as for concrete errors, such as the disposition to condemn repeatedly those human weaknesses which are inevitable, namely man's inability to be perfectly rational, avoid all error, etc. , thus setting man against himself as all too wicked. If promises are binding there must be a reason to do as one promised. The paper is motivated by belief that there is a difficulty in explaining what that reason is. It arises because the reasons that promising creates are content-independent. Similar difficulties arise regarding other content-independent reasons, though their solution need not be the same. -/- Section One introduces an approach to promises, and outlines an account of them that I have presented before. It forms the backdrop for the (...) ensuing discussion. The problems discussed in the paper arise, albeit in slightly modified ways, for various other accounts as well. It is, however, helpful to use a specific account as a springboard leading to one explanation of promissory reasons, namely of the reasons that valid promises constitute for performing the promised act (Section Two). There is a need for empirically based research on social and ethical challenges related to informed consent processes, particularly in studies focusing on adolescent sexual and reproductive health. In a pilot study of a school-based pregnancy prevention intervention in rural Zambia, the majority of the guardians who were asked to consent to their daughters’ participation, refused. In this paper we explore the reasons behind the low participation in the pilot with particular attention to challenges related to the community engagement and (...) informed consent process. The pilot was implemented in two schools and examined the acceptability of a package of interventions including economic support to families to keep their girls in school, pocket money for girls, youth club meetings on reproductive health, and community meetings to sensitize the community. Focus group discussions were conducted with girls who participated in the pilot, boys in their class and with parents. Individual semi-structured interviews were conducted with teachers, peer educators and community health workers involved in the coordination of the intervention as well as with religious and traditional leaders. Data were analyzed through thematic analysis. The findings indicate that inadequate use of recognized community communication channels during the community engagement process and dissemination of information about the pilot resulted in limited understanding of the pilot concept by the community. This surfaced through uncertainty and fear that the intervention may result in loss of control over daughters, worries about why money was provided unconditionally to girls, and suspicion of links to satanism. The sense of insecurity appeared to be exacerbated by low literacy levels, poverty, fear of loss of bride wealth, perceived disregard for local perceptions of social status, and scanty trust in the actors implementing the pilot. Inadequate use of locally appropriate channels in the dissemination of information created room for interpretation and facilitated development of mistrust, undermining the conditions for community engagement and actual informed consent. A key lesson learnt is the importance of taking seriously the complexity of local values and structures that may impact people’s capability to consent or not consent to a study in an informed manner. Moral responsibility requires that we are in control of what we do. Many contemporary accounts of responsibility cash out this control in terms of abilities and hold that the relevant abilities are strong abilities, like general abilities. This paper raises a problem for strong abilities views: an agent can plausibly be morally responsible for an action or omission, despite lacking any strong abilities to do the relevant thing. It then offers a way forward for ability‐based views, arguing that very weak (...) abilities can form the basis of moral responsibility for both actions and omissions. (shrink)

Disability activists have sometimes claimed their disability has actually increased their well-being. Some even say they would reject a cure to keep these gains. Yet, these same activists often simultaneously propose improvements to the quality and accessibility of assistive technology. However, for any argument favoring assistive over curative technology to work, there must be a coherent distinction between the two. This line is already vague and will become even less clear with the emergence of novel technologies. This paper asks and (...) tries to answer the question: what is it about the paradigmatic examples of curative and assistive technologies that make them paradigmatic and how can these defining features help us clarify the hard cases? This analysis will begin with an argument that, while the common views of this distinction adequately explain the paradigmatic cases, they fail to accurately pick out the relevant features of those technologies that make them paradigmatic and to provide adequate guidance for parsing the hard cases. Instead, it will be claimed that these categories of curative or assistive technologies are defined by the role the technologies play in establishing a person’s relational narrative identity as a member of one of two social groups: disabled people or non-disabled people. The crash of two 737 MAX passenger aircraft in late 2018 and early 2019, and subsequent grounding of the entire fleet of 737 MAX jets, turned a global spotlight on Boeing’s practices and culture. Explanations for the crashes include: design flaws within the MAX’s new flight control software system designed to prevent stalls; internal pressure to keep pace with Boeing’s chief competitor, Airbus; Boeing’s lack of transparency about the new software; and the lack of adequate monitoring of Boeing by the (...) FAA, especially during the certification of the MAX and following the first crash. While these and other factors have been the subject of numerous government reports and investigative journalism articles, little to date has been written on the ethical significance of the accidents, in particular the ethical responsibilities of the engineers at Boeing and the FAA involved in designing and certifying the MAX. Lessons learned from this case include the need to strengthen the voice of engineers within large organizations. There is also the need for greater involvement of professional engineering societies in ethics-related activities and for broader focus on moral courage in engineering ethics education. (shrink)

What is the relation of business ethics to politics? My answer has two parts. First, business ethics exists quite apart from politics in matters of simple, basic ethical norms like those prohibiting lying, wanton injury, sexual harrassment. One would be foolish to unsettlethis settled ethics as A. Z. Carr does in this article, “Is Business Bluffing Ethical?” For the business community thus loses the public’s trust and invites a government regulation of business smothering to business and burdensome to government.Second, there (...) are issues in business ethics which do not represent a settled and shared and common ethics because they represent a choice between competing, almost equally attractive, values. These problems in business ethics can only have a political solution. Politics here represents the commitment to different basic values and will represent liberal and conservative extremes or somecompromise in-between. The solution acceptable for these problems will change with the political climate and will be unstable. We should strive to keep the basic, simple, settled, ethical issues in business out of politics, and we should strive to be frank about our political differences as we needfully politicize the solutions to the more complex unsettled problems in business ethics. This article addresses the problem of divine foreknowledge and human freedom by developing a modified version of Boethius' solution to the problem – one that is meant to cohere with a dynamic theory of time and a conception of God as temporal. I begin the article by discussing the traditional Boethian solution, and a defence of it due to Kretzmann and Stump. After canvassing a few of the objections to this view, I then go on to offer my own modified (...) Boethian solution, according to which temporal reality is fundamentally dynamic, but truth is not. The romance of the nineteenth-century discovery, by Salomon Munk, that "Avicebron's" Fons Vitae, a major source of neoplatonic thought in the thirteenth and fourteenth centuries, was actually the work of the eleventhcentury Hispano-Jewish poet, Solomon ibn Gabirol, and has often been retold. It is, indeed, a remarkable story. Perhaps its most noteworthy feature is that it reveals how closely alike Muslim, Jewish, and Christian philosophers were; by implication, then, it indicates that theological considerations were of less importance in medieval philosophy than is suggested by most historical accounts. Although the story of The Fountain of Lqe has now become an oft-told tale, the work itself has never been available in English dress. The present edition remedies this situation in part. It presents Tract III of the original text, a section dealing with the existence of simple spiritual substances. Harry Wedeck's translation is lucid and readable. Theodore E. James's introduction is useful for the beginning student but too elementary to be of much use to a more advanced reader. Generally speaking, the two Summae of St. Thomas, long available in English translation, contain all that is most personal and most profound in his philosophical thought. Nonetheless, it is quite impossible to get a fully adequate conception of St. Thomas' place in the history of western thought from a consideration of his theological writings alone. Hence, by translating St. Thomas' Commentary on the Metaphysics of Aristotle into English, Professor J. P. Rowan has provided the non-Latin reading student of the history of philosophy an invaluable service. For it is in his r61e as Aristotelian commentator that we see St. Thomas creating for the Schoolmen a version of Aristotle which served to render the Stagirite's thought into terms which became fundamental to the philosophical defense of Christianity. On September 17, 1994, Karl Popper died at the age of 92.He was described as the official opposition of the “ Vienna Circle”, the philosophical club which in the inter-war period was glamorous and which espoused the then popular doctrine of logical positivism, so-called. His relations with that club were friendly-hostile, to use the term with which he liked to characterize the relations between scientific researchers. He is the last of that generation (unless it is Carl G. Hempel, who, however, (...) sees himself as too young to belong there). The public aspect of Popper’s friendly-hostile relations with his Viennese peers was unfortunately more hostile than friendly. Somehow, philosophers have managed to keep the accounts open for too long. The end of the era is the time to close accounts so as to be able to go on with the job at hand, since the intermingling of personal affairs with objective knowledge is unhealthy. Yet most of the leading heirs of the “ Vienna Circle” still coast around the issues raised by Popper, and so they can neither overlook him nor quote him correctly. Shortly after enrolling in a course on Indian Buddhist philosophy, I recall a question that in spite of its apparent simplicity has since troubled me. Having been informed of my interests, (...) the instructor approached me at a coffee break and asked, "What's the point of comparing?" Feeling caught off guard by the absurdity of his question, I fumbled for a reply. Surely, it's obvious (I thought). "To understand?" I jousted with noticeable unease. He nodded, and I was left wanting. Indeed, what initially appeared as an awkward icebreaker became one of the more pressing theoretical questions that has plagued my thinking as a scholar in the Buddhist and Christian traditions as well as in the philosophy of religions: Do I compare with the hope of canonizing those very concepts and categories that I claim ostensibly to call into question? Do I seek to secure some place of conceptual stability for my home tradition amidst the sacred rhetoric of "the other"? Inevitably, this raises the question, is the term "compare" even appropriate?Comparative study of religious traditions must learn from the spectre of its missiological past.2 This means keeping at the forefront of scholarship questions about how "the other" is depicted, and made accessible. In an effort to gain its legitimacy in the academy, pioneers of comparative religions wrestled with reconciling the aims of this burgeoning academic field with the mission of entrenched, confessional theology.3 Among so-called liberal theologians of the nineteenth century, such as Ernst Troeltsch, Christianity represented the pinnacle of human culture amidst a backdrop of less-evolved cultures.4 (No doubt, much of German theology during that century was directly—or indirectly—influenced by Hegel's progressive view of history.)The so-called liberal shift toward inclusivism, beginning in the nineteenth century and continuing to the present, warrants critical redress whenever doctrines and [End Page 119] categories deemed sacrosanct by the speaker's tradition of identification are mapped (even inadvertently) onto "the other."5 Karl Rahner's concept of the Anonymous Christian might serve to illustrate this point.6 His extension of the Christian concept of grace for the purpose of extending salvation outside the Church, for example, says little or nothing about the beliefs of the recipients who may not have requested such "charitable" extension. A more productive line of inquiry might seek to dissemble and expose the mechanisms (epistemological, psychological, historical, theological, and so forth) that underpin inclusive approaches as well as ascertain some insight into how such conceptual extensions accommodate the grantors, rather than recipients. Put another way, is the goal of comparative study to reinterpret one's own tradition or to redefine "the other"?7 Recent "experiments" in comparative theology advocate the need to proceed in a self-conscious manner, questioning even the appropriateness of the term "comparative."8Again, does one extend or elaborate on concepts in order to secure a place of safety for one's own tradition amidst the sacred rhetoric of "the other"? Is the exchange simply an attempt at negotiating tolerance economically, politically, or legally? Viewed pragmatically, is the underpinning value one of cultural or religious self-preservation?Tolerance evokes a connotation of "putting up with," and does not necessarily imply any respect or commitment toward comprehending the religious convictions of "the other." Rather, tolerance more suitably concurs with Thomas Hobbes's redaction on the Golden Rule: "Do not that to another, which thou wouldest not have done to thy selfe."9 Embracing the value of tolerance does not necessitate the view that one must appreciate the beliefs and practices of another tradition, nor does it require an openness of being transformed by "the other."Frequently undertaken for reasons of tolerance, dialogue centers on securing ways of achieving, if not mutual respect, a right to... KronickThe modern quarrel between theory and practice, like the ancient one between philosophy and poetry, is at once a practical one—at its heart is the question how we should live—and a pedagogical one—who or what is the proper teacher of virtue? Today, the quarrel is between theory and literature rather than between philosophy and poetry, a change that (...) has not been beneficial. The modern complaint against the abstractions of theory reflects a diminution in the quality of the argument. For the ancient Greeks, to ask about the virtuous life was to inquire into what it is to be human, for aretê, which is typically translated as "virtue," but is understood to mean "excellence" or "goodness," meant acting in accordance with what it is to be fully human. 1 The notion that "real issues," as one prominent theorist argues, belong to the realm of action and epistemological and ontological questions to the abstract realm of theory is a simplification of the more serious question of the relation of particulars to universals. It reverses the Platonic and Aristotelian hierarchy that makes thinking the highest form of activity. But something else is going on in this call to action: in denigrating thinking as abstract, it elevates doxa, opinion, in its place. Under the regime of doxa, two things occur: philosophy and poetry are looked upon as useless because utility becomes the criteria for measuring value, and singularity is looked upon with disdain, if it is, indeed, acknowledged at all, because to the extent the world as it appears is common to us all, doxa is not distinct or individual but uniform or the same. Philosophy and poetry share not only the stigma of being deemed useless, but they are dismissed as odd, singular, not common.This essay is concerned with the status of the singular in philosophy [End Page 436] and poetry. The ancient quarrel has not been settled, which may indeed be a good thing because the quarrel keeps alive the question, who is to speak for that which cannot be spoken of, the singular? Silence may be the appropriate response, yet to preserve the experience of that which resists language is the task of philosophy and poetry, hence the quarrel. A long tradition has it that the philosopher seeks universals, while the poet offers particular images of virtue, but at the heart of this argument over ethics is the question of how to account for the singular or unique. To do so, I turn to Socrates, whose singularity remains unaccounted for to this day.Socrates may be said to embody the very problem of the relation between philosophy and literature, for he left us no writings and exists for us primarily through the writings of Plato. Yet there is widespread acceptance of Plato's portrait of him, particularly as to Socrates' method, the elenchus, and his principle of the priority of definitions. However, Socrates' insistence upon the priority of definition is not an example of the philosopher elevating theory over experience but a practical issue involving the care of the self. Furthermore, in ancient Greece, moral and philosophical questions concerning the soul were as much the provenance of poetry as they were of philosophy. The search for truth is a practical matter concerning the conduct of life, but the Platonic philosopher wishes to give a rational account, or logos, that would link conduct to knowledge, whereas the poet's examples are bound to their representations. Sentimentality is usually thought of as a mild vice. Unlike such vices as cruelty, dishonesty, or contemptuousness, sentimentality appears to affect only the individuals who have it, and then, not very adversely. So what if we indulge our taste for prematurely dying heroines or stoic, sweet-natured children? Shedding a tear or feeling a diffuse affection does not seem to hurt anyone, not even ourselves. But because of its impact on the self, sentimentality is a more serious vice than might be (...) suspected.Regardless of the immediate object of our sentimental gaze, the self is also sentimentalized. The self is not only the subject engaged in sentimentalizing activity, but also its mediated object. A sentimentalized sense of self discourages activity and keeps us from dealing with the world directly. The distortion of and absorption in the self is dangerous for sentimental individuals and those with whom they interact. To see why, we must examine the structuring of perception, thought, and emotion which makes up sentimentality. Our inquiry will be sharpened by reference to literary depictions which reflect or encourage sentimental response. Versing us in the ways of sentimentality, some literature may generate our everyday patterns of sentimentalized thought and feeling. (shrink)

As is well enough known, the term physis in Empedocles Fr. 8 is cited by Aristotle in the Metaphysics as meaning the ousia of natural things, in the sense of the stable substance or form that is the terminus of generation. This interpretation is rejected almost unanimously by commentators. The three or four attempts to defend it have not proved convincing. The case now seems officially closed. Yet there remain some loose ends. These are of the kind that would keep (...) bothering television detectives and would cause enough loss of sleep to prompt a fresh investigation of a whole case. Do the conditions under which promises are made determine whether they ought to be kept? Philosophers have placed a number of conditions on promising which, they hold, must be met in order to make promise‐keeping obligatory. In so doing, they have distinguished valid promises from invalid promises and justified promises from promises that are not justified. Considering such conditions, one by one, we argue that they are mistaken. In the first place, the conditions they lay down are not necessary (...) for either valid or justified promise‐making. In the second place, promises need not meet such conditions in order to create moral obligations. In general, such analyses of promising fail because they suffer from a confusion between promise‐making and promise‐keeping. Philosophers have wrongly supposed that obligations to keep promises are dependent upon, or derivable from, the quality of the promises themselves, at the time they are made, instead of focusing on conditions that must be satisfied at the time when promises are supposed to be kept. It is not the quality of a promise that determines an obligation to keep it but the rightness or wrongness of performing the promised act. (shrink)

On 26 July 1240 Walter de Cantilupe, bishop of Worcester , held a diocesan synod in his cathedral church, where he issued a set of synodal statutes regulating the life and pastoral activities of his diocesan clergy. In calling this synod, Walter put himself in the company of many other prelates who sought to enact statutes in keeping with the reforming spirit of the Fourth Lateran Council of 1215. His statutes are comparable to those produced in many other dioceses (...) during the first decades of the thirteenth century. In one respect, however, Walter pursued an innovative path which he shared with a small group of contemporary English bishops during the 1230s and 1240s. These prelates, recognizing both the limitations of public assemblies and the potential for educating their clerics by means of written texts, supplemented their diocesan statutes with brief treatises designed to explain in more detail certain aspects of pastoral care. Alexander of Stavensby was probably the first to append such tracts; one treatise on confession and another on the seven deadly sins were circulated with his synodal statutes. (shrink)

The romance of the nineteenth-century discovery, by Salomon Munk, that "Avicebron's" Fons Vitae, a major source of neoplatonic thought in the thirteenth and fourteenth centuries, was actually the work of the eleventhcentury Hispano-Jewish poet, Solomon ibn Gabirol, and has often been retold. It is, indeed, a remarkable story. Perhaps its most noteworthy feature is that it reveals how closely alike Muslim, Jewish, and Christian philosophers were; by implication, then, it indicates that theological considerations were of less importance in medieval philosophy than is suggested by most historical accounts. Although the story of The Fountain of Lqe has now become an oft-told tale, the work itself has never been available in English dress. The present edition remedies this situation in part. It presents Tract III of the original text, a section dealing with the existence of simple spiritual substances. Harry Wedeck's translation is lucid and readable. Theodore E. James's introduction is useful for the beginning student but too elementary to be of much use to a more advanced reader. It is good that there is now this much to recommend to our students; we may hope that the day will come when BOOK REVIEWS 249 larger sections of the work will be translated-preferably not from the Latin, but from the Arabic original. Generally speaking, the two Summae of St. Thomas, long available in English translation, contain all that is most personal and most profound in his philosophical thought. Nonetheless, it is quite impossible to get a fully adequate conception of St. Thomas' place in the history of western thought from a consideration of his theological writings alone. Hence, by translating St. Thomas' Commentary on the Metaphysics of Aristotle into English, Professor J. P. Rowan has provided the non-Latin reading student of the history of philosophy an invaluable service. For it is in his r61e as Aristotelian commentator that we see St. Thomas creating for the Schoolmen a version of Aristotle which served to render the Stagirite's thought into terms which became fundamental to the philosophical defense of Christianity. Further, by keeping in mind the fully-developed notions of St. Thomas on the existence of God and the nature of being as these are given us to understand in the Summae, the reader becomes better enabled, by a critical reading of Thomas' Commentary, to grasp the sense in which the Saint's theological writings are said by his enthusiasts to represent a "completing" and "perfecting" of... Courts reviewing gun laws that burden Second Amendment rights ask how effectively the laws serve public safety — yet typically discuss public safety narrowly, without considering the many dimensions of that interest gun laws serve. “Public safety” is a social good: it includes the public's interest in physical safety as a good in itself, and as a foundation for community and for the exercise of constitutional liberties. Gun laws protect bodies from bullets — and Americans' freedom and confidence to participate (...) in every domain of our shared life, whether to attend school, to shop, to listen to a concert, to gather for prayer, or to assemble in peaceable debate. Courts must enforce the Second Amendment in ways that respect the public health and constitutional reasons a democracy seeks to protect public safety. Lawyers and citizen advocates can help, by creating a richer record of their reasons in seeking to enact laws regulating guns.This inquiry is urgent at a time when the Supreme Court's new conservative majority may expand restrictions on gun laws beyond the right to keep arms for self-defense in the home first recognized inDistrict of Columbia v. The ideal of universal human rights is arguably the most potent moral concept marking the modern world. Its accelerated fruition in the last half of the twentieth century has created a powerful political force, laying the groundwork for future generations to extend and apply. Whereas anything resembling international legal status for human rights had to wait for the post-Nazi era, the bold proclamations of the Universal Declaration of Human Rights (UDHR, 1948) loosened a revolutionary force with endless potential for application (...) to the full range of human endeavors. The roots of this movement can be traced to each and every era in which the vulnerable and powerless sought justification to oppose arbitrary domination. Its roots are, therefore, deep and wide.
