A course in professional ethics for civil engineers was taught for the first time in Spain during the academic year 2007/08. In this paper a survey on the satisfaction and expectation of the course is presented. Surprisingly the students sought moral and ethical principles for their own ordinary lives as well as for their profession. Students were concerned about the law, but in their actions they were more concerned with their conscience, aware that it can be separate from the law.

In case of special engineering projects of important relevance it is interesting to pay attention to several possible risks; some of them are in the field of morality or ethics. Due to the social importance of these risks, additional considerations or even additional warranties are justified.

From the most prominent thinkers in Latin American philosophy, literature, politics, and social science comes a challenge to conventional theories of globalization. The contributors to this volume imagine a discourse in which revolution requires no temporalized march of progress or takeovers of state power but instead aims at local control and the material conditions for human dignity.

In this article Jason Brennan’s arguments about the moral duties relating to our practice of voting are examined. These arguments provide an epistocratic approach of politics and present a conception of abstention at four levels: abstention as a personal choice, as a moral responsibility, as a duty legally enforceable and as an obligation decided by lot. The contrast with John Stuart Mill’s positions helps to highlight the postdemocratic ambivalences and the latent paternalism behind Brennan’s rejection of massive voting and electoral (...) democracy. A deliberative, Millian-inspired understanding of abstention also allows questioning the assumption in Brennan’s successive proposals that there is no significant loss in overlooking the political valence of qualified abstention. El humanismo contemporáneo se enfrenta al relativismo epistemológico. Si no hay una noción clara de verdad, tampoco puede haberla de la verdad del ser humano. Buscando en la tradición filosófica, nos proponemos indagar en la obra de tres referentes para el tema de la verdad: Platón, San Agustín y San Anselmo. A los tres les une un aire de familia; a la evidente relación entre San Agustín y San Anselmo se le une el hecho de que ambos bebieron de las (...) fuentes de Platón y que Platón además fue el primer filósofo pagano en impactar significativamente en la teología cristiana. El Protágoras de Platón, el Contra Académicos de San Agustín y el De veritate de San Anselmo son tres obras unidas por una misma intención temática: la búsqueda de la verdad en todos los ámbitos de la existencia frente al desafío relativista; y por una misma forma literaria: el diálogo. Así pues, tres diálogos de tres maestros hablando sobre la verdad pueden ser una magnífica ocasión para oponer un dique a las habladurías, la curiosidad y la ambigüedad en la reflexión referida al ser humano. In this article, we identify various kinds of injustice at work in the global care chains by looking at the damages they entail and at some of their ties. Taking as our point of reference an invidious privileges dilemma that poses a real challenge to feminist theories, we analyze first the moral harm that, as Eva Kittay maintains, follows the fracturing of central, interpersonal and affective relationships of the women migrant workers. This specific moral harm of care relationships is not (...) reducible to other kinds of social injustice. These other kinds are identified by applying Nancy Fraser’s questioning of the frame problem to the global care chains. We can then talk of an interdependence of several genres or axes of injustice (maldistribution, misrecognition and misrepresentation) that work and intersect at several scales. (shrink)

La teoría discursiva afirma que la razón que la tradición filosófica ha concebido ante todo como razón moral y como razón política puede ser reformulada con una racionalidad práctico-comunicativa que está incorporada en los procesos de diálogo y en los procedimientos argumentativos. El artículo indaga en la propuesta habermasiana de la transformación de la razón práctica. En la parte central se analizan además los conceptos básicos de la formulación del principio del discurso, entendido como un principio general de justificación fundado (...) en la racionalidad comunicativa. El artículo propone una lectura de la obra de Jürgen Habermas tomando dos temas vertebradores: su convicción metafilosófica de que tras la muerte de Hegel existe un clausura infranqueable en el destino de la filosofía, cuya actual condición postmetafísica es estructuralmente análoga a la situación legada por los jóvenes hegelianos; y su convicción kantiana de que la concepción crítica y pública de la racionalidad va unida de suyo a ese destino de la filosofía, la cual queda hoy posicionada entre las (...) culturas de expertos y el sentido común y se hace cargo de los principales impulsos del pensamiento postmetafísico contemporáneo. En este artículo se analizan algunas de las implicaciones que tienen las prácticas de triaje para la ética de desastres. Se considera la centralidad técnica de la cuantificación en los modelos algorítmicos y numéricos de triaje y se incide en la prevalencia normativa de los criterios consecuencialistas, incluso cuando éstos hayan de ajustarse a sistemas de múltiples principios. Finalmente se sugiere que una concepción ética de los desastres precisa de una perspectiva compleja y integral de la gestión de los desastres (...) que no se limite a la fase de respuesta inmediata a los mismos y que supere a la par que integre los principios de la bioética y la indispensabilidad de los criterios consecuencialistas en las decisiones de triaje. Se proponen tres ejemplos históricos para mostrar cómo la religión, en la forma del cristianismo católico, ha promovido el avance de la filosofía moral o la filosofía social. Frente a posiciones que entienden que la religión tiene como función principal la conservación del status quo de una sociedad en particular (Marx o Durkheim) estos casos notables muestran que más bien es al contrario: las motivaciones religiosas han provocado cambios en la forma de pensar que inevitablemente implican cambios en el modo (...) de vida (Weber). Elegimos tres autores ligados por la época y el espacio (Siglo de oro español) y la religión (cristianismo católico). Juan Luis Vives propuso desde la filosofía cristiana que inspira todo su trabajo una asistencia regular y organizada a los pobres, que andando el tiempo se convertiría en la asistencia social contemporánea. Francisco de Vitoria, reflexionando sobre las causas de la guerra justa, los títulos de conquista o esclavitud, sentó las bases del derecho internacional al margen de la imposición violenta. Juan de Mariana hizo una reflexión política limitando tanto el poder del emperador que incluso sugirió la posibilidad del tiranicidio en caso de necesidad. Estos tres autores nos muestran que, aunque la religión continúa jugando un papel importante en la transmisión del estado de cosas, también ejerce una influencia que permite la evolución en las costumbres y, en consecuencia, en la reflexión ética. In this paper we argue that the best way to explain the normative framework of science is to adopt a model inspired in the democratic characterization of a public sphere. This model assumes and develops some deliberative democratic principles about the inclusiveness of the concerned, the parity of the reasons and the general interest of the subjects. In contrast to both bargaining models and to power-inspired models of the scientific activities, the model of scientific public sphere proposes to account for (...) the self-legislative capacity of science, the public nature of the scientific results and the epistemic virtues of scientific research in terms of the deliberative process carried out by individuals who are engaging in the public use of reason. Las normas internacionales, como la Convención sobre los Derechos de las Personas con Discapacidad, suponen un avance hacia la equidad. Asimismo, im­plican tanto un incremento de la legislación nacional y autonómica, como una mayor complejidad institucional, para hacer efectivos estos derechos. Por ello, queremos conocer cómo se ha implementado el derecho a la accesibilidad univer­sal en la legislación. Se realizó un análisis de contenido de 36 normas relaciona­das con la discapacidad y la dependencia en Aragón. Finalmente, se detectó que, a (...) pesar de ciertos avances, la adaptación de la normativa no se ha consolidado, afectando al reconocimiento de derechos de las personas con discapacidad, espe­cialmente de las más jóvenes y aquellas con grandes necesidades de apoyo. The positive reception of Buber’s philosophy does not fully match Buber’s intention in terms of overcoming the problem of the subject–object binary. In other words, a number of authors have remained within the traditional way of thinking by merely replacing the subject and object with Buber’s I and You, establishing a more dogmatic normative subjectivity, paradoxically going against Buber’s intent and even seemingly not noticing this problem. In this article, we will investigate the reasons for these paradoxical readings of Buber. (...) By focusing on the structure and significance of Buber’s ontology of between-humane, we will study the concept of I–You and I–It, suggesting that these are not intentionality-oriented concepts, but a radically relationship-centered one. The theoretical problem caused by Buber himself in the process of adaptation of his dialog-philosophy to his dialog-pedagogy, namely the impossibility of complete mutuality in the educational relationship will be critically examined, based on Buber’s own declaration in his “Afterword” (1957) in I and Thou (1923). With this, we will reflect on the problematic situation of post-Buberian literature in contemporary pedagogy to pave a way to modernize Buber’s dialog-pedagogy. (shrink)

The present article wishes to examine John Caputo’s notion of ‘hyperbolic justice’ considering his critique of Heideggerian philosophy. In Demythologizing Heidegger (1993), Caputo tries to deconstruct Martin Heidegger’s account of Dasein’s being as Sorge, as Being-towards-death in its existentiality, facticity and fallenness, not by rejecting that account but by showing that it is fissured by an absence, the absence of kardia (heart), of flesh, disablement, affliction. According to Caputo, Heidegger’s aesthetics of Being, and his concern to overcome the oblivion of (...) Being, left him scandalously oblivious to the cry of the suffering other. Against Heidegger, Caputo opposes what he calls the “prophetic imagination” of Emmanuel Levinas, Jean-François Lyotard, and particularly Jacques Derrida. I will seek to examine the ways in which Caputo opposes to Heidegger Derrida’s ‘undeconstructibility of justice,’ whilst also resorting to Levinas’ ‘hyperbolic justice’. (shrink)

Online supplement, "Mulsow: Additions to Notes drawn from the 2002 edition of Moderne aus dem Untergrund" full versions of nearly 300 notes that were truncated in the print edition. Hosted on H. C. Erik Midelfort's website. Martin Mulsow's seismic reinterpretation of the origins of the Enlightenment in Germany won awards and renown in its original German edition, and now H. C. Erik Midelfort's translation makes this sensational book available to English-speaking readers. In Enlightenment Underground, Mulsow shows that even in the (...) late seventeenth century some thinkers in Germany ventured to express extremely dangerous ideas, but did so as part of a secret underground. Scouring manuscript collections across northern Europe, Mulsow studied the writings of countless hitherto unknown radical jurists, theologians, historians, and dissident students who pushed for the secularization of legal, political, social, and religious knowledge. Often their works circulated in manuscript, anonymously, or as clandestinely published books. Working as a philosophical microhistorian, Mulsow has discovered the identities of several covert radicals and linked them to circles of young German scholars, many of whom were connected with the vibrant radical cultures of the Netherlands, England, and Denmark. The author reveals how radical ideas and contributions to intellectual doubt came from Socinians and Jews, church historians and biblical scholars, political theorists, and unemployed university students. He shows that misreadings of humorous or ironic works sometimes gave rise to unintended skeptical thoughts or corrosively political interpretations of Christianity. This landmark book overturns stereotypical views of the early Enlightenment in Germany as cautious, conservative, and moderate, and replaces them with a new portrait that reveals a movement far more radical, unintended, and puzzling than previously suspected. In this article, I propose a unified account of systemic emergence, downward causation, and interlevel integrative explanations. First, I argue for a relational-transformational notion of emergence and a structural-relational account of downward causation in terms of both its transformational and conditioning effects. In my view, downward causation can avoid the problems traditionally attributed to it, provided that we are able to reconceptualize the notion of ‘whole’ and that form of causality in a purely relational way. In this regard, I distinguish (...) contextual or whole-to-part causation from downward causation, the latter defined by the existence of second-order structural relations. Finally, I argue that while emergence and downward-structural causation imply the in-principle failure of micro-determinism and therefore micro-reduction, they do not rule out the possibility of any type of explanation. _Blood_, according to Gil Anidjar, maps the singular history of Christianity. As a category for historical analysis, blood can be seen through its literal and metaphorical uses as determining, sometimes even defining Western culture, politics, and social practices and their wide-ranging incarnations in nationalism, capitalism, and law. Engaging with a variety of sources, Anidjar explores the presence and the absence, the making and unmaking of blood in philosophy and medicine, law and literature, and economic and political thought from ancient Greece (...) to medieval Spain, from the Bible to Shakespeare and Melville. The prevalence of blood in the social, juridical, and political organization of the modern West signals that we do not live in a secular age into which religion could return. Flowing across multiple boundaries, infusing them with violent precepts that we must address, blood undoes the presumed oppositions between religion and politics, economy and theology, and kinship and race. It demonstrates that what we think of as modern is in fact imbued with Christianity. Christianity, Blood fiercely argues, must be reconsidered beyond the boundaries of religion alone. (shrink)

Is there a relation of logical consequence in natural language? Logicality, in the philosophical literature, has been conceived of as a restrictive phenomenon that is at odds with the unbridled richness and complexity of natural language. This article claims that there is a relation of logical consequence in natural language, and moreover, that it is the subject matter of the bulk of current theories of formal semantics. I employ the framework of _semantic constraints_ (Sagi in Log Anal 57(227):259–276, 2014), which (...) generalizes the Tarskian definition of logical consequence. I apply the widely accepted criterion of invariance under isomorphisms (Sher in J. Symb Log 61(2):653–686, 1996) generalized to the framework of semantic constraints (Sagi in Bull Symb Log 28(1):104–132, 2022b), combined with a theory of Glanzberg (in Metasemantics: new essays on the foundations of meaning, 2014) to delineate the relation of logical consequence in natural language. Philosophers of well-being have tended to adopt a foundationalist approach to the question of theory and measurement, according to which theories are conceptually before measures. By contrast, social scientists have tended to adopt operationalist commitments, according to which they develop and refine well-being measures independently of any philosophical foundation. Unfortunately, neither approach helps us overcome the problem of coordinating between how we characterize well-being and how we measure it. Instead, we should adopt a coherentist approach to well-being science.

Feelings are conscious mental events that represent body states as they undergo homeostatic regulation. Feelings depend on the interoceptive nervous system (INS), a collection of peripheral and central pathways, nuclei and cortical regions which continuously sense chemical and anatomical changes in the organism. How such humoral and neural signals come to generate conscious mental states has been a major scientific question. The answer proposed here invokes (1) several distinctive and poorly known physiological features of the INS; and (2) a unique (...) interaction between the body (the ‘object’ of interoception) and the central nervous system (which generates the 'subject' of interoception). The atypical traits of the INS and the direct interactions between neural and non‐neural physiological compartments of the organism, neither of which is present in exteroceptive systems, plausibly explain the qualitative and subjective aspects of feelings, thus accounting for their conscious nature. Downward causation exercised by emergent properties of wholes upon their lower-level constituents’ properties has been accused of conceptual and metaphysical incoherence. Only upward causation is usually peacefully accepted. The aim of this paper is to criticize and refuse the traditional hierarchical-vertical way of conceiving both types of causation, although preserving their deepest ontological significance, as well as the widespread acceptance of the traditional atomistic-combinatorial view of the entities and the relations that constitute the so-called ‘emergence base’. Assuming those two perspectives (...) with no reserves, we are condemned to confine our debate to the question of whether reified wholes can have the power to downwardly change or influence their lower-level parts, a question which seems profoundly misleading to me. I therefore propose an alternative relational ontological view, assuming a straightforward horizontal and intra-level way of representing those putative cases of cross-level causation. I finally confront two recent replies to Kim’s well-known objections to DC—Craver and Bechtel and Kistler :595–609, 2009)—, emphasizing their global positive approaches, as well as the reasons why their accounts still seem insufficient to me. I conclude arguing that both Kim’s principle of the causal closure of the physical domain and its allegation of an overdetermination in cases of DC can be surpassed by the new relational ontological perspective presented here. The year 1492 is only the last in a series of “ends” that inform the representation of medieval Spain in modern Jewish historical and literary discourses. These ends simultaneously mirror the traumas of history and shed light on the discursive process by which hermetic boundaries are set between periods, communities, and texts. This book addresses the representation of the twelfth and thirteenth centuries as the end of al-Andalus (Islamic Spain). Here, the end works to locate and separate Muslim from Christian (...) Spain, Jews from Arabs, philosophy from Kabbalah, Kabbalah from literature, and texts from contexts. The book offers a reading of texts that emerge from its Andalusi, Jewish, and Arabic cultural sphere: Maimonides’ Guide of the Perplexed; the major text of Kabbalah, the Zohar; and the Arabic rhymed prose narrative of Ibn al-Astarkuwi. The author argues that these texts are written in a language that disrupts the possibility of locating it in a pre-existing cultural situation, a recognizable literary tradition, or a particular genre. At stake are issues – texts and contexts – that have gained particular urgency in the writings of such recent thinkers as Walter Benjamin, Jacques Derrida, Giorgio Agamben, Jean-Luc Nancy, and Avital Ronell. The book reads the place and taking place of language, interrogating the notion of disappearing contexts and the view that language is derivative of its true place, the context that, having ended, is mourned as silent and lost. In this article I address the issue of the ontological conditions of possibility for a naturalistic notion of emergence, trying to determine its fundamental differences from the atomist, vitalist, preformationist and potentialist alternatives. I will argue that a naturalistic notion of ontological emergence can only succeed if we explicitly refuse the atomistic fundamental ontological postulate that asserts that every entity is endowed with a set of absolutely intrinsic properties, being qualitatively immutable through its extrinsic relations. Furthermore, it will be shown (...) that, ironically enough, this metaphysical assumption is implicitly shared by all the above mentioned alternatives to Emergentism. The current article concludes that the notion of organization by itself is not enough, and that ontological emergence can only be justified by assuming a relational ontological perspective that, in opposition both to atomism and holism, defends that the existence-conditions, the identity and the causal behavior of any emergent systemic property can only be conceived, and explained, as constructed by and through specific networks of qualitatively transformative relational processes that occur between the system’s components and between the system and its environment. Additionally, I try to explain how one can make sense of the idea that an emergent phenomenon is both dependent on, and autonomous from, its emergence base. (shrink)

Generating an account that can sidestep the disagreement among substantive theories of well-being, while at the same time still providing useful guidance for well-being public policy, would be a significant achievement. Unfortunately, the various attempts to remain agnostic regarding what constitutes well-being fail to either be an account of well-being, provide useful guidance for well-being policy, or avoid relying on a substantive well-being theory. There are no theory-free lunches in well-being policy. Instead, I propose an intermediate account, according to which (...) well-being is constituted by endorsed veridical experiences. This account refers back to theories of well-being but does so as agnostically as possible. An intermediate account of well-being is meant as a policy guiding compromise between the different theories of well-being that make claims regarding what constitutes well-being. An intermediate account does as well as can be hoped for in providing a basis for well-being policy. (shrink)

Acts of Religion, compiled in close association with Jacques Derrida, brings together for the first time a number of Derrida's writings on religion and questions of faith and their relation to philosophy and political culture. It is an open question whether well-being ought to primarily be understood as a temporal concept or whether it only makes sense to talk about a person’s well-being over their whole lifetime. In this article, I argue that how this principled philosophical disagreement is settled does not have substantive practical implications for well-being science and well-being policy. Trying to measure lifetime well-being directly is extremely challenging as well as unhelpful for guiding well-being public policy, while temporal well-being is both an (...) adequate indirect measure of lifetime well-being, and an adequate focus for the purposes of improving well-being through public policy. Consequently, even if what we ought to care about is lifetime well-being, we should use temporal measures of well-being and focus on temporal well-being policies. (shrink)

Spoofing is the act of placing orders to buy or sell a financial contract without the intention to have those orders fulfilled in order to create the impression that there is a large demand for that contract at that price. In this article, I deny the view that spoofing in financial markets should be viewed as morally permissible analogously to the way bluffing is permissible in poker. I argue for the pro tanto moral impermissibility of spoofing and make the case (...) that spoofing is disanalogous from bluffing in at least one important regard—speculative trading serves an important economic role, whereas poker does not. To advance current knowledge on ethical decision-making in organizations, we integrate two perspectives that have thus far developed independently: the organizational identification perspective and the ethical climate perspective. We illustrate the interaction between these perspectives in two studies, in which we presented participants with moral business dilemmas. Specifically, we found that organizational identification increased moral decision-making only when the organization’s climate was perceived to be ethical. In addition, we disentangle this effect in Study 2 from participants’ moral identity. We argue (...) that the interactive influence of organizational identification and ethical climate, rather than the independent influence of either of these perspectives, is crucial for understanding moral decision-making in organizations. Policy-makers sometimes aim to improve well-being as a policy goal, but to do this they need some way to measure well-being. Instead of relying on potentially problematic theories of well-being to justify their choice of well-being measure, Daniel Hausman proposes that policy-makers can sometimes rely on preference-based measures as evidence for well-being. I claim that Hausman’s evidential account does not justify the use of any one measure more than it justifies the use of any other measure. This leaves us at (...) a loss as to which policy should be chosen in the non-trivial cases for which there is substantial disagreement between the different measures in their assessment of policy.
